This paper advocates for a general policy of penal leniency: judges should often sentence offenders to a punishment less severe than initially preferred. The argument’s keystone is the relatively uncontroversial Minimal Invasion Principle (MIP). MIP says that when more than one course of action satisfies a state’s legitimate aim, only the least invasive is permissibly pursued. I contend that MIP applies in two common sentencing situations. In the first, all sentences within a statutorily specified range are equally (...) proportionate. Here MIP applies directly. In the second, judges reasonably believe that one of the sentences within the range is the most proportionate, but can’t identify it with any certainty. In these cases of sentencing uncertainty, judges must be indifferent between their preferred sentence and a softer one, and this indifference triggers MIP. MIP thus frequently mandates some degree of leniency. I conclude with some comments on statistical uncertainty. (shrink)

In response to the racial disparities that plague the American criminal justice system, the Movement for Black Lives calls for an end to policing and punishment “as we know it.” But refusing to punish violent offenses leaves unprotected those most vulnerable to crime, and outright abolition thus appears to undermine black rights and liberties. I call this the decarceration dilemma. After discussing Tommie Shelby and Christopher Lewis’s attempts to resolve the dilemma, I offer my own, which employs a procedural rather (...) than a substantive solution. I lean on the principle of expanded asymmetry (EA), which holds that it is better to underpunish than overpunish. After defending EA, I note that it obtains only under conditions of uncertainty. I then show that because virtually all trials of black offenders meet the uncertainty condition, sentencing authorities are obliged to treat black offenders leniently. I conclude by noting the advantages of my proceduralist approach. (shrink)

This article proposes that cosmetic minimally-invasive procedures – Botox injections, soft-tissue fillers, microdermabrasion, chemical peels and laser treatments – are an under-researched area and provide a number of promising paths for skin studies research. I argue that cosmetic minimally-invasive procedures collapse the difference between the surfaces of the photograph and the skin – the primary surfaces of cosmetic surgery – more successfully than cosmetic surgical procedures. More precisely, I maintain that the difference between photograph and skin is collapsed in two (...) ways: first, through narrating the transformation of the skin’s surface in a way that more closely matches the photographic promises of the cosmetic surgery industry; and, second, by depicting the surgical penetration of the skin through advertising photography. The article concludes by suggesting that further investigation into cosmetic minimally-invasive procedures could offer a new way to think about relationships between ‘normative’ and ‘non-normative’ skin modification practices. Analytical models describing the motion of colloidal particles in given force fields are presented. In addition to local approaches, leading to well known master equations such as the Langevin and the Fokker–Planck equations, a global description based on path integration is reviewed. A new result is presented, showing that under very broad conditions, during its evolution a dissipative system tends to minimize its energy dissipation in such a way to keep constant the Hamiltonian time rate, equal to the difference between (...) the flux-based and the force-based Rayleigh dissipation functions. In fact, the Fokker–Planck equation can be interpreted as the Hamilton–Jacobi equation resulting from such minumum principle. At steady state, the Hamiltonian time rate is maximized, leading to a minimum resistance principle. In the unsteady case, we consider the relaxation to equilibrium of harmonic oscillators and the motion of a Brownian particle in shear flow, obtaining results that coincide with the solution of the Fokker–Planck and the Langevin equations. Non-beneficial paediatric research is vital to improving paediatric healthcare. Nevertheless, it is also ethically controversial. By definition, subjects of such studies are unable to give consent and they are exposed to risks only for the benefit of others, without obtaining any clinical benefits which could compensate those risks. This raises ethical concern that children participating in non-beneficial research are treated instrumentally; that they are reduced to mere instruments for the benefit of science and society. But this would make the research (...) incompatible with the widely endorsed principle of the primacy of the human subject, which stipulates that the interests of the participating individual should prevail over the interests of science and society. This paper deals with this conflict. It analyses solutions to this problem developed in the literature, and shows that they are unsuccessful. Finally, it offers a new idea of how to reconcile the conduct of non-beneficial paediatric research with the PP. The paper argues for a new formula of the PP, and shows that it implies a specific non-comparative definition of the minimal risk threshold. (shrink)

We investigate the notion of minimal cognition, and claim that this notion already applies to bacterial behavior. On the basis of the example of E. coli, we argue that the basis of cognition can be profitably cast as sensorimotor coordinations which subserve the metabolic requirements of organisms.

This paper analyzes the notion of a minimal belief change that incorporates new information. I apply the fundamental decision-theoretic principle of Pareto-optimality to derive a notion of minimal belief change, for two different representations of belief: First, for beliefs represented by a theory – a deductively closed set of sentences or propositions – and second for beliefs represented by an axiomatic base for a theory. Three postulates exactly characterize Pareto-minimal revisions of theories, yielding a weaker set (...) of constraints than the standard AGM postulates. The Levi identity characterizes Pareto-minimal revisions of belief bases: a change of belief base is Pareto-minimal if and only if the change satisfies the Levi identity (for “maxichoice” contraction operators). Thus for belief bases, Pareto-minimality imposes constraints that the AGM postulates do not. The Ramsey test is a well-known way of establishing connections between belief revision postulates and axioms for conditionals (“if p, then q”). Pareto-minimal theory change corresponds exactly to three characteristic axioms of counterfactual systems: a theory revision operator that satisfies the Ramsey test validates these axioms if and only if the revision operator is Pareto-minimal. In Minimal Morality, Michael Moehler justifies what he calls the weak principle of universalization as a principle of pure instrumental morality. This article addresses the application of this principle and problems associated with it. Specifically, the article focuses on the principle’s ability to protect the interests of the most vulnerable members of society: agents without primary moral standing, specifically non-human animals; and the weakest members of society, either as a result of their diminished relative bargaining (...) power in certain cases of conflict, or because of their present standing in society, made worse off by historical injustices. To this end, the article considers, respectively, the problems of moral standing, indivisible goods and historical injustice. (shrink)

Recent defenses of same-sex marriage and polygamy have invoked the liberal doctrines of neutrality and public reason. Such reasoning is generally sound but does not go far enough. This paper traces the full implications of political liberalism for marriage. I argue that the constraints of public reason, applied to marriage law, entail ‘minimal marriage’, the most extensive set of state-determined restrictions on marriage compatible with political liberalism. Minimal marriage sets no principled restrictions on the sex or number of (...) spouses and the nature and purpose of their caring relationships, nor on which marital rights are exchanged, and whether they are exchanged reciprocally or asymmetrically. Minimal marriage supports adult care networks, urban tribes, friendships, and other forms of relationships as well as ‘traditional’ marriages. I provide a publically justifiable rationale for a legal framework supporting non-dependent caring relationships between adults. The argument is that caring relationships are primary goods, and that liberal justice accordingly requires legal frameworks supporting caring relationships. Minimal marriage is one such framework. We prove that Kreisel's Conjecture is true, if Peano arithmetic is axiomatised using minimality principle and axioms of identity (theory $PA_M $ )-The result is independent on the choice of language of $PA_M $ . We also show that if infinitely many instances of A(x) are provable in a bounded number of steps in $PA_M $ then there existe k ∈ ω s. t. $PA_M $ ┤ ∀x > k̄ A(x). According to a well-known view in the philosophy of mind, intentional attitudes by their very nature satisfy requirements of rationality (e.g. Davidson 1980; Dennett 1987; Millar 2004). This view (which I shall call Constitutivism) features prominently as the ‘principle of minimal rationality’ in de Sousa’s monograph The Rationality of Emotion (1987). By explicating this principle in terms of the notion of the formal object of an attitude, de Sousa articulates an interesting and original version of Constitutivism, which (...) differs in important respects from other extant versions. In this paper, I explore this version of Constitutivism against the background of recent developments in the theory of rationality and make explicit its ramifications for the long-standing dispute over whether the mind is essentially normative. My focus will be on how to conceive of the form of the rationality requirements that attitudes as such must satisfy according to this principle. I argue that, although de Sousa seems officially to endorse a structuralist conception of rationality, according to which these requirements are requirements of coherence, his considerations on formal objects suggest that they are more aptly conceived in terms of a reasons-responsive conception of rationality. I further argue that which of these two readings we choose makes a significant difference to the prospect of vindicating the essential normativity of mind by invoking the principle of minimal rationality. We outline a scenario which highlights possible inconsistencies with ethical decision-making. We then discuss the case against permitting these uses. The objections include practical problems; increasing inequities; increasing the burden of choice; negative (...) impacts on the child, family, and society; and issues with implementation. We then outline the case for permitting the use of NIPT for these traits. These include arguments for reproductive liberty and autonomy; questioning the labeling of traits as “non-medical”; and the principle of procreative beneficence. The surprise minimization principle has been applied to explain various cognitive processes in humans. Originally describing perceptual and active inference, the framework has been applied to different types of decision making including long-term policies, utility maximization and exploration. This analysis extends the application of surprise minimization to a multi-agent setup and shows how it can explain the emergence of social rules and cooperation. We further show that in social decision-making and political policy design, surprise minimization is superior in many (...) aspects to the classical approach of maximizing utility. Surprise minimization shows directly what value freedom of choice can have for social agents and why, depending on the context, they enter into cooperation, agree on social rules, or do nothing of the kind. Yet finding an intermediate standard of minimal rationality has proven difficult. In this paper, I take suggestions found in the literature (Lewis, 1988; Hawke, Özgün and Berto, 2020; Plebani and Spolaore, 2021) and join the forces of subject matter and impossible worlds approaches to devise a new solution to this quandary. I do so by combining a space (...) of FDE worlds (Berto and Jago, 2019) with a Lewisian (1988) understanding of subject matters as partitions. By doing so, I show how subject matters impose some order in the anarchic space of FDE worlds, while the worlds allow for distinctions between contents which would not otherwise be available. Combining the two approaches, then, brings us closer to the desired closure principles for knowledge of minimally rational agents. (shrink)

Many aquatic invasive species (AIS) management programs are doing important work on preventing non-indigenous species movement to our wild places. Attitudes and perspectives on aquatic non-indigenous species and their management by ecologists and the public are fundamentally a question of human values. Despite eloquent philosophical writings on treatment of non-indigenous species, management agency rhetoric on 'invasive' species usually degenerates to a good versus evil language, often with questionable results and lost conservation dollars. We assess and learn from an established AIS (...) program. We discuss an ethic framework and operational directives to minimise the trap of a binary classification of species into bad or good, and we advocate for a principled pragmatic approach to minimise conflicts. We make a case for not labelling species and instead focusing on managing nuisance conditions and protecting ecosystem health. (shrink)

This book develops a novel multilevel social contract theory that, in contrast to existing theories in the liberal tradition, does not merely assume a restricted form of reasonable moral pluralism, but is tailored to the conditions of deeply morally pluralistic societies which may be populated by liberal moral agents, nonliberal moral agents, and, according to the traditional understanding of morality, nonmoral agents alike. The book draws on the history of the social contract tradition, especially the work of Hobbes, Hume, Kant, (...) Rawls, and Gauthier, as well as on the work of some of the critics of this tradition, such as Sen and Gaus. The two-level contractarian theory holds that morality in its best contractarian version for the conditions of deeply morally pluralistic societies entails Humean, Hobbesian, and Kantian moral properties. The theory defines the minimal behavioral restrictions that are necessary to ensure, compared to violent conflict resolution, mutually beneficial peaceful long-term cooperation in deeply morally pluralistic societies. The theory minimizes the problem of compliance for morally diverse societies by maximally respecting the interests of all members of society. Despite its ideal nature, the theory is, in principle, applicable to the real world and, for the conditions described, most promising for securing mutually beneficial peaceful long-term cooperation in a world in which a fully just society, due to moral diversity, is unattainable. If Rawls’ intention was to carry the traditional social contract argument to a higher level of abstraction, then the two-level contractarian theory brings it back down to earth. (shrink)

Most current techniques to deal with invasive species are ineffective or have highly damaging side effects. To this end suppression-drives based on clustered regularly inter-spaced short palindromic repeats (CRISPR/Cas9) have been touted as a potential silver bullet for the problem, allowing for a highly focused, humane and cost-effective means of removing a target species from an environment. Suppression-drives come with serious risks, however, such that the precautionary principle seems to warrant us not deploying this technology. The focus of this (...) paper is on one such risk – the danger of a suppression-drive escaping containment and wiping out the target species globally. Here, I argue that in most cases this risk is significant enough to warrant not using a gene-drive. In some cases, however, we can bypass the precautionary principle by using an approach that hinges on what I term the ‘Worst-Case Clause’. This clause, in turn, provides us with a litmus test that can be fruitfully used to determine what species are viable targets for suppression-drives in the wild. Using this metric in concert with other considerations, I suggest that only three species are currently possible viable targets – the European rabbit, ship rat and Caribbean Tree Frog. (shrink)

Timothy Williamson thinks that every object is a necessary, eternal existent. In defense of his view, Williamson appeals primarily to considerations from modal and tense logic. While I am uncertain about his modal claims, I think there are good metaphysical reasons to believe permanentism: the principle that everything always exists. B-theorists of time and change have long denied that objects change with respect to unqualified existence. But aside from Williamson, nearly all A-theorists defend temporaryism: the principle that there (...) are temporary existents. I think A-theorists are better off without this added commitment, but I will not argue for that in any great detail here. Instead, I will contend that a very tempting A-theoretic argument for temporaryism is unsound. In the first half of the paper, I will develop the Moorean “common sense” argument for temporaryism and dispute its central premise, namely that temporaryism is a valid generalization from highly plausible beliefs about change. I will argue that given the pervasive vagueness in our ordinary beliefs about change and the background commitments of all A-theories, no party can claim to be the common sense view because no party can accommodate most of our common sense beliefs about change in existence. In the second half of the paper, I will propose a permanentist A-theory that explains all change over time as a species of property change. I call it the minimal A-theory, since it dispenses with the change in existence assumption. As we'll see, the permanentist alternative performs well enough in explaining our ordinary beliefs about change, and it has better prospects for answering some objections commonly levied against A-theories. Minimal Negation is defined within the basic positive relevance logic in the relational ternary semantics: B+. Thus, by defining a number of subminimal negations in the B+ context, principles of weak negation are shown to be isolable. Complete ternary semantics are offered for minimal negation in B+. Certain forms of reductio are conjectured to be undefinable (in ternary frames) without extending the positive logic. Complete semantics for such kinds of reductio in a properly extended positive logic are offered.

Cells mitigate the detrimental consequences of DNA damage on genome stability by attempting high fidelity repair. Homologous recombination templates DNA double‐strand break (DSB) repair on an identical or near identical donor sequence in a process that can in principle access the entire genome. Other physiological processes, such as homolog recognition and pairing during meiosis, also harness the HR machinery using programmed DSBs to physically link homologs and generate crossovers. A consequence of the homology search process by a long nucleoprotein (...) filament is the formation of multi‐invasions (MI), a joint molecule in which the damaged ssDNA has invaded more than one donor molecule. Processing of MI joint molecules can compromise the integrity of both donor sites and lead to their rearrangement. Here, two mechanisms for the generation of rearrangements as a pathological consequence of MI processing are detailed and the potential relevance for non‐allelic homologous recombination discussed. Finally, it is proposed that MI‐induced crossover formation may be a feature of physiological recombination. (shrink)

Within many approaches to the interpretation of quantum mechanics, especially modal interpretations, one singles out a particular decomposition of the state vector in order to fix the properties that are well-defined for the system. We present a novel proposal for this preferred decomposition. Given a distinguished factorization of the Hilbert space, it is the decomposition that minimizes the Ingarden–Urbanik entropy from among all product decompositions with respect to the distinguished factorization. We incorporate this choice of preferred decomposition into a framework (...) for modal interpretations and investigate in detail the extent to which it provides a solution to the measurement problem and the extent to which it ensures that measurements whose outcomes are predictable with probability 1 reveal pre-existing properties of the system under investigation. This article examines the metaphysics and phenomenology of the self or subject of experience. It suggests that the phenomenological description of the minimal subject requires no reference to body, environment, or social relations and argues for a thin conception of subjectivity which equates the subject with the experience itself. Under this principle of minimal conception, the subject does not exist if the person is asleep. It contends that the profound metaphysical question about experience and experiential selves is (...) whether experience is limited to certain types of physical processes, or is characteristic of all physical processes, which would entail panpsychism. Plant predictive processing suggests that plants anticipatorily perceive their environment. This hypothesis runs up against a challenge which takes the form of two constraints on per- ception advanced by Tyler Burge: the veridicality constraint and the constancy constraint. This paper argues that the veridicality constraint can be satisfied by assuming a general account of predictive processing. To show how the constancy constraint may be fulfilled, an ecologically informed account of invariant pick-up is developed and given a place within plant predictive (...) processing. It is concluded that, against our anthro- pocentric folk-psychological notions of perception, there is reason to believe that plants engage in minimal perception. (shrink)

The current literature on indeterminacy centers around two projects. One concerns the logic of indeterminacy; the other concerns its nature or source. The aim of this paper is to introduce, motivate and go some way toward addressing a new, third project: that of providing what I call a minimal characterization of indeterminacy. An MC, to a first approximation, is a relatively pre-theoretical characterization of indeterminacy that is neutral between the various substantive theories of the nature and logic of indeterminacy. (...) An MC thus captures a generic sense of indeterminacy that, at least in principle, is recognized by all parties to the debate over the phenomenon’s underlying nature and logic. I begin by introducing the concept of an MC and outlining some of the main theoretical virtues of providing an MC. I then establish some desiderata on a suitable MC, and use these desiderata to rule out various initially attractive proposals. In the final part of the paper I sketch the beginnings of my own MC and defend it against objections. (shrink)

The Great Divide in metaphysical debates about laws of nature is between Humeans, who think that laws merely describe the distribution of matter, and non-Humeans, who think that laws govern it. The metaphysics can place demands on the proper formulations of physical theories. It is sometimes assumed that the governing view requires a fundamental / intrinsic direction of time: to govern, laws must be dynamical, producing later states of the world from earlier ones, in accord with the fundamental direction of (...) time in the universe. In this paper, we propose a minimal primitivism about laws of nature (MinP) according to which there is no such requirement. On our view, laws govern by constraining the physical possibilities. Our view captures the essence of the governing view without taking on extraneous commitments about the direction of time or dynamic production. Moreover, as a version of primitivism, our view requires no reduction / analysis of laws in terms of universals, powers, or dispositions. Our view accommodates several potential candidates for fundamental laws, including the principle of least action, the Past Hypothesis, the Einstein equation of general relativity, and even controversial examples found in the Wheeler-Feynman theory of electrodynamics and retrocausal theories of quantum mechanics. By understanding governing as constraining, non-Humeans who accept MinP have the same freedom to contemplate a wide variety of candidate fundamental laws as Humeans do. (shrink)

I propose a minimal account of authorship that specifies the fundamental nature of the author-relation and its minimal domain composition in terms of a three-place causal-intentional relation holding between agents and sort-relative works. I contrast my account with the minimal account tacitly held by most authorship theories, which is a two-place relation holding between agents and works simpliciter. I claim that only my view can ground productive and informative principled distincitons between collective production and collective authorship.

Expanded non-invasive prenatal testing (NIPT) has provoked ethical concerns about its justifiable scope. In this paper, we evaluate the role of the child’s right to an open future in setting the scope of NIPT. This ‘open future principle’ has been cited in arguments both limiting and expanding parental freedoms. This moral right holds that adult autonomy rights which children cannot yet exercise should nonetheless be protected until they can. Its purpose is to protect the future autonomy of the child (...) as a future adult. Several authors have extended this rationale from child to fetus. However, the right was not anticipated to apply to the fetus, a non-legal entity in many jurisdictions. The aim of this paper is to reconsider whether this principle is useful to help deliberate the scope of NIPT. We find that extending the open future principle to delineate the scope of NIPT is theoretically flawed. We contend that in the prenatal context its value primarily lies with counselling for prenatal screening where it can be used to encourage parents’ reflection on the implications of knowing for the sake of knowing on their future children and their relationship with them. Background Non-invasive prenatal testing (NIPT), which can screen for aneuploidies such as trisomy 21, is being implemented in several public healthcare systems across Europe. Comprehensive communication and information have been highlighted in the literature as important elements in supporting women’s reproductive decision-making and addressing relevant ethical concerns such as routinisation. Countries such as England and France are adopting broadly similar implementation models, offering NIPT for pregnancies with high aneuploidy probability. However, we do not have a deeper understanding of how professionals’ (...) counselling values and practices may differ between these contexts. Methods In this paper, we explore how professionals in England and France support patient decision-making in the provision of NIPT and critically compare professional practices and values. We draw on data from semi-structured interviews with healthcare professionals. Results Both English and French professionals emphasised values relating to patient choice and consent. However, understandings and application of these values into the practice of NIPT provision differed. English interviewees placed a stronger emphasis on interpreting and describing the process of counselling patients and clinical care through a “principle” lens. Their focus was on non-directiveness, standardisation, and the healthcare professional as “decision-facilitator” for patients. French interviewees described their approach through a “procedural” lens. Their focus was on formal consent, information, and the healthcare professional as “information-giver”. Both English and French professionals indicated that insufficient resources were a key barrier in effectively translating their values into practice. Conclusion Our findings illustrate that supporting patient choice in the provision of NIPT may be held as an important value in common on a surface level, but can be understood and translated into practice in different ways. Our findings can guide further research and beneficially inform practice and policy around NIPT provision. (shrink)

Although logical empiricists strove for decades to develop an adequate principle of verification, they failed to resolve its problems. This led to a general abandonment of the verificationist project in the early 1960s. In the last 50 years, this view has received tremendously bad press. Today it is mostly regarded as an (...) outdated historical concept. Theories that have evolved since the abandonment of verificationism can, however, help overcome some of its key problems. More specifically, an adequate criterion of significance can be derived from a combination of modern theories of justification and belief revision, along with a formal semantics for counterfactuals. In view of these potential improvements, the abandonment of verificationism appears premature. Half a century following its decline, it might be about time to revisit this disreputable view. The author argues in favor of a weak form of verificationism. This approach could be referred to as minimal verificationism, as it involves a weakening of traditional verificationist principles in various respects while maintaining their core idea. (shrink)

In this paper, we set out to develop a theoretical and conceptual framework for the new field of Radical Embodied Cognitive Neuroscience. This framework should be able to integrate insights from several relevant disciplines: theory on embodied cognition, ecological psychology, phenomenology, dynamical systems theory, and neurodynamics. We suggest that the main task of Radical Embodied Cognitive Neuroscience is to investigate the phenomenon of skilled intentionality from the perspective of the self-organization of the brain-body-environment system, while doing justice to the phenomenology (...) of skilled action. In previous work, we have characterized skilled intentionality as the organism's tendency toward an optimal grip on multiple relevant affordances simultaneously. Affordances are possibilities for action provided by the environment. In the first part of this paper, we introduce the notion of skilled intentionality and the phenomenon of responsiveness to a field of relevant affordances. Second, we use Friston's work on neurodynamics, but embed a very minimal version of his Free Energy Principle in the ecological niche of the animal. Thus amended, this principle is helpful for understanding the embeddedness of neurodynamics within the dynamics of the system “brain-body-landscape of affordances.” Next, we show how we can use this adjusted principle to understand the neurodynamics of selective openness to the environment: interacting action-readiness patterns at multiple timescales contribute to the organism's selective openness to relevant affordances. In the final part of the paper, we emphasize the important role of metastable dynamics in both the brain and the brain-body-environment system for adequate affordance-responsiveness. We exemplify our integrative approach by presenting research on the impact of Deep Brain Stimulation on affordance responsiveness of OCD patients. (shrink)

ABSTRACT Mutz argues that there is an inverse correlation between deliberation and participation. However, the validity of this conclusion partly depends on how one defines deliberation and participation. Mutz's definition of deliberation as ?hearing the other side? or ?cross-cutting exposure? is narrower than a minimal conception of deliberation with which deliberative democrats could agree. First, a minimal conception of deliberation would have to revolve around the principle of a reasoned exchange of arguments, as opposed to mere exposure (...) to dissenting views. Second, Mutz's almost exclusive focus on participation as partisan activism gives the impression of an essential tension between participation and deliberation. But another form of civic participation, which I call ?critical-deliberative involvement,? is perfectly compatible with the incentives for reasoned exchange of arguments with others. We should thus encourage people to participate in politics in ways that engage their reasoning faculty, not just their party loyalty. This also requires teaching people how to disagree constructively. (shrink)

I argue for three principles of minimal beneficence, which constrain when and what at least we are obligated to do on behalf of someone. All three may be accepted by both the consequentialist Peter Singer and by his staunch opponents in material value-ethics, who are typically anti-consequentialists. Either side would philosophically benefit from accepting the principles. At the same time, the first principle is rarely applicable, the second only when the available relevant evidence is not too complex, and (...) the third only as a prompt to keep thinking seriously about how to practice beneficence. We study the minimal enumeration degree problem in models of fragments of Peano arithmetic () and prove the following results: in any model M of Σ2 induction, there is a minimal enumeration degree if and only if M is a nonstandard model. Furthermore, any cut in such a model has minimal e-degree. By contrast, this phenomenon fails in the absence of Σ2 induction. In fact, whether every Σ2 cut has minimal e-degree is independent of the Σ2 (...) bounding principle. (shrink)

This paper analyzes the notion of a minimal belief change that incorporates new information. I apply the fundamental decisiontheoretic principle of Pareto-optimality to derive a notion of minimal belief change, for two different representations of belief: First, for beliefs represented by a theory –a deductively closed set of sentences or propositions–and second for beliefs represented by an axiomatic base for a theory. Three postulates exactly characterize Pareto-minimal revisions of theories, yielding a weaker set of constraints than (...) the standard AGM postulates. The Levi identity characterizes Pareto-minimal revisions of belief bases: a change of belief base is Pareto-minimal if and only if the change satisfies the Levi identity (for “maxichoice” contraction operators). Flere land har tatt i bruk disse testene, og Helsedirektoratet i Norge har mottatt søknad om å ta i bruk en test som erstatter tidlig ultralyd og blodprøver. Likevel nøler norske myndigheter. Hvorfor gjør de det? Ett av svarene er at non-invasive prenatale tester fører med seg en rekke faglige og moralske spørsmål og (...) gir flere grunnleggende etiske utfordringer. Denne artikkelen gjennomgår et bredt knippe av de utfordringene som NIPT reiser. Hensikten er å synliggjøre hvorfor NIPT påkaller etisk refleksjon og å bidra til en åpen debatt og en transparent beslutningsprosess. The tests are claimed to be better than existing alternative tests, they reduce the risk, and it is claimed they are cheaper. They have been used in several countries since 2012, and the University Hospital of North Norway has applied to the Directorate of Health to replace first trimester ultrasound and plasma screening with NIPT. The Directorate of Health is reluctant to reply. Why is this? One of the answers may be that NIPT raises a series of professional and moral questions, and poses profound ethical challenges. This article reviews a series of the challenges with NIPT. The aim is to highlight why NIPT calls for ethical reflection and to contribute to an open debate and a transparent decision-making process. The article identifies five major questions to address in the assessment of NIPT: What are the criteria for screening and removing certain conditions? How certain do we have to be that these conditions do appear in living children? How should we handle information from NIPT for living persons? How can we avoid that persons with the conditions that are selected for screening and removal are insulted, stigmatized, or discriminated? How can we avoid that systematic screening and removal of fetuses with certain conditions develop norms and values that breach with basic social or ethical principles? (shrink)

We introduce a realist, unextravagant interpretation of quantum theory that builds on the existing physical structure of the theory and allows experiments to have definite outcomes but leaves the theory’s basic dynamical content essentially intact. Much as classical systems have specific states that evolve along definite trajectories through configuration spaces, the traditional formulation of quantum theory permits assuming that closed quantum systems have specific states that evolve unitarily along definite trajectories through Hilbert spaces, and our interpretation extends this intuitive picture (...) of states and Hilbert-space trajectories to the more realistic case of open quantum systems despite the generic development of entanglement. We provide independent justification for the partial-trace operation for density matrices, reformulate wave-function collapse in terms of an underlying interpolating dynamics, derive the Born rule from deeper principles, resolve several open questions regarding ontological stability and dynamics, address a number of familiar no-go theorems, and argue that our interpretation is ultimately compatible with Lorentz invariance. Along the way, we also investigate a number of unexplored features of quantum theory, including an interesting geometrical structure—which we call subsystem space—that we believe merits further study. We conclude with a summary, a list of criteria for future work on quantum foundations, and further research directions. We include an appendix that briefly reviews the traditional Copenhagen interpretation and the measurement problem of quantum theory, as well as the instrumentalist approach and a collection of foundational theorems not otherwise discussed in the main text. Human and non-human animals are social beings, both have social interactions. The ability to anticipate behavior of others is a fundamental requirement of social interactions. However, there are several ways of how agents can succeed in this. Two modes of anticipation, namely mindreading and behavior-reading, shape the animal mindreading debate. As a matter of fact, no position has yet convincingly ruled out the other. This paper suggests a strategy of how to argue for a mentalistic interpretation as opposed to a (...) behavioral interpretation. The first step suggests considering a pluralistic approach in order to allow for shortcomings such as not having a natural language. Second, a critical examination of the principle called Morgan’s Canon will show that this principle cannot be used as a final argument to rule out mentalistic approaches. Finally, the author argues that the setting of current experiments is responsible for the indistinguishability of mindreading versus behavior-reading and she suggests alternative experimental designs. This book introduces generative grammar as an area of study and asks what it tells us about the human mind. Wolfram Hinzen lays the foundation for the unification of modern generative linguistics with the philosophies of mind and language. He introduces Chomsky's program of a 'minimalist' syntax as a novel explanatory vision of the human mind. He explains how the Minimalist Program originated in work in cognitive science, biology, linguistics, and philosophy, and examines its implications for work in these fields. (...) He considers the way the human mind is designed when seen as an arrangement of structural patterns in nature, and argues that its design is the product not so much of adaptive evolutionary history as of principles and processes that are ahistorical and internalist in character. Linguistic meaning, he suggests, arises in the mind as a consequence of structures emerging on formal rather than functional grounds. From this he substantiates an unexpected and deeply unfashionable notion of human nature. Clearly written in nontechnical language and assuming a limited knowledge of the fields it examines and links, Minimal Mind Design will appeal to a wide range of scholars in linguistics, philosophy, and cognitive science. Of all the ethical questions, the one of what we owe our fellow humans seems to be both the most pressing and the one around which there is the least agreement. Plausible-looking answers range from the extremely demanding claim that we are obliged to give to others until giving to them costs us more than it benefits them, to the minimally demanding claim that we are not obliged to give to others at all, but that it would be nice if (...) we did. The minimally demanding view often combines with the view that beneficence is the responsibility of governments rather than individuals, and with the thought that we dispense with our duties by paying our taxes. The minimally demanding view, however, does not deal well with the intuitions that we have about clear cases like Peter Singer's example of our duty to save a baby who is lying face down in a pond when we can do so at little cost to ourselves. There seems, here, to be a duty of beneficence that is not reflected in the claim that it would merely be nice to help the baby; it exists regardless of the taxes we pay. Our thinking about beneficence needs to be sensitive to clear intuitions such as this. This paper is essentially a methodological consideration of the role that intuitions like the above might play in moral reasoning. (shrink)
