This chapter begins by explaining the distinction between meta-ethics and normative ethics. It then introduces the main issues in the two fields and provides a critical overview of the chapters in the volume. In meta-ethics, it focuses on explaining the different kinds of moral realism and anti-realism, including the divine command theory, naturalism, non-naturalism, relativism, nihilism, and non-cognitivism. Quasi-realism illustrates how the distinction between anti-realism and realism can become blurred. A variety of views about the relation (...) between morality and practical reason, including contractarianism, are discussed. In normative ethics, the chapter focuses on the distinction, among theories of right action, between consequentialism and non-consequentialism, as well as the distinction between theories of right action and other kinds of normative theory, such as rights theory, virtue theory, and the ethics of care. There is an overview of the debate between consequentialism and deontology regarding moral constraints, as well as a discussion of indirect consequentialist responses to deontological objections. What makes ethical accounts natural law ethical is, I argue, commonly misrepresented in teaching within much of the philosophical academy. Yet those immersed in the field of natural law and ethics rarely give definitions/brief characterisations of what makes ethical accounts natural law ethical. I suggest theoretical reasons for the lack. I argue that bringing natural law into ethics is best understood as leading to theoretically unitary accounts, not simply collections of positions detachable from each other: an overlooked and (...) significant point when defending natural law ethical accounts. My arguments throughout rely on the metaethical/normative ethical distinction, which is relatively little used in the natural law literature. I argue that the distinction helps clarify what is distinctive of natural law ethical accounts in general, especially to the secular contemporary philosophical academy, where appreciation of natural law ethical accounts is commonly appreciably lower than in philosophical contexts with a religious ethos. This chapter deals with Kierkegaard's contributions to ethics by focusing on his relation to virtue ethics and deontology, his views of moral agency, and the source of moral obligations. It argues that Kierkegaard presents a critique of Kantian autonomy that favors moral realism and theological voluntarism, and that he gives an account of human agency and selfhood in which morality is inescapable.

Due largely to the influential work of Ronald Dworkin, there is an ongoing debate concerning the possibility of genuine metaethical theorizing. Dworkin, and others, argue that metaethical theories collapse into first-order normative theories. In his short and widely neglected paper, L.W. Sumner provides a compelling account of how to engage in metaethical theorizing while avoiding substantive moral commitments.

The recent production of major treatises devoted to elaborating normative ethical theories and the eruption of lively debates concerning the merits of opposed normative systems have been greeted with applause. This reaction is an historical about-face, since for forty or fifty years “ethical” treatises had been attacking the pretensions of traditional moral philosophy, calling for its demise or at the least severely limiting its claims. These skeptical attacks had succeeded in seriously undermining the academic status of moral philosophy (...) and consequently moral philosophy was transformed into “metaethics,” a highly abstract and technical discipline considered much less necessary to the general education of students than what it replaced and with a diminished role in the curriculum. The recent resurgence of interest in normative ethics has generally been lauded as a sign that philosophy has rededicated itself to its proper and time-honored tasks. There is a widespread feeling that the overblown claims of twentieth century skepticism have been whittled down to innocuous proportions and thus that nothing stands in the way of proceeding to construct ethical theories. The study of normative ethical theory now enjoys such respectability and popularity that it is difficult to raise once more the uncomfortable ideas that the ideal of normative ethical theory is a false one, that vanquishing the spectre of noncognitivism is not sufficient for legitimizing it, and that the popular new justifications for the enterprise fail in mischievous ways. This paper discusses a challenge to normative ethics motivated by experimental philosophy. Experimental philosophers object to the perceived “armchair” or a priori nature of philosophy, claiming it should rather be empirical or naturalistic. The paper investigates the application of this claim to normative ethics. Dubbing the application of the experimental philosophers’ contention to normative ethics “the Armchair Claim,” I distinguish descriptive and normative versions of this challenge, and consider their merits as comments on (...) the method of normative ethics (descriptive versions), and as comments on how normative ethics should be done (normative versions). Characterizing normative ethics as essentially involving the use of the method of reflective equilibrium, I show how the versions of the Armchair Claim that I distinguish either misconstrue normative ethics, or are committed to metaethical views that are controversial. To bring home the latter point, I contrast two meta-ethical positions, and show how, on one such view, naturalism, the descriptive version could be correct, whereas on another, intuitionism, it would be false. The normative version, in turn, is consistent with naturalism, but begs the question against the intuitionist since she argues that normative ethics cannot be empirical. The upshot is that a conclusive assessment of the Armchair Claim will have to await the resolution of disputed issues in meta-ethics. However, normative ethicists can get on with their work since reflective equilibrium is unaffected by such debates. (shrink)

Philip Kitcher presents an ambitious account of pragmatic naturalism that incorporates an explanatory story of the emergence and development of ethics, a metaethical perspective on progress, and a normative stance for moral theorizing. This article contends that Kitcher's normative stance is incompatible with the explanatory and metaethical components of his project. Instead, pragmatic naturalists should endorse a normative ethics that is experimental, grounded in practice, and acutely aware of cognitive and informational limitations. In particular, the (...) ethical project would benefit from endorsing empirical work on participatory democracy for the identification of mechanisms to guide us on deep moral conflicts. (shrink)

This paper argues for the value of distinguishing two projects concerning our normative and evaluative thought and talk, which we dub “metanormative inquiry” and “the conceptual ethics of normativity” respectively. The first half of the paper offers a substantive account of each project and of the relationship between them. Roughly, metanormative inquiry aims to understand actual normative and evaluative thought and talk, and what (if anything) it is distinctively about, while the conceptual ethics of normativity engages (...) in normative or evaluative reflection on normative and evaluative thought and talk. We explore how certain theories of content determination complicate the distinction between these projects, but argue that both the distinction and its significance survive these complications. The second half of the paper argues that attention to the distinction between these projects can promote progress in both projects in three ways. First, it can transform our understanding and evaluation of views that are routinely classified as part of “metaethics”. Second, it can help us to identify important theoretical options that otherwise tend to remain obscure. And, third, it can help us to avoid tempting but fallacious arguments which can easily arise if the projects are not distinguished. (shrink)

Many political realists endorse some notion of political normativity. They think that there are certain normative claims about politics that do not depend on moral premises. The most prominent moralist objections to political normativity have been metaethical: specifically, that political normativity is not genuinely normative; and that it is incapable of justifying normative claims. In this article, I criticize the latter metaethical objection. I argue that the objection presupposes a notion of ‘justification’ that renders it something that (...) is no longer necessarily valuable to realists. I then extend this argument to show that all metaethical objections to political normativity are unsuccessful. Furthermore, insofar as these metaethical objections purport to constrain the types of politics that realists endorse, realists should regard them as another expression of what Raymond Geuss calls ‘dead politics’. Philosopher-novelist Ayn Rand is a cultural phenomenon. Her books have sold more than 25 million copies, and countless individuals speak of her writings as having significantly influenced their lives. In spite of the popular interest in her ideas, or perhaps because of it, Rand’s work has until recently received little serious attention from academics. Though best known among philosophers for her strong support of egoism in ethics and capitalism in politics, there is an increasingly widespread awareness of both the (...) range and the systematic character of Rand’s philosophic thought. This new series, developed in conjunction with the Ayn Rand Society, an affiliated group of the American Philosophical Association, Eastern Division, seeks a fuller scholarly understanding of this highly original and influential thinker. The first volume starts not with the metaphysical and epistemological fundamentals of Rand’s thought, but with central aspects of her ethical theory. Though her endorsement of ethical egoism is well-known—one of her most familiar essay collections is _The Virtue of Selfishness—_the character of her egoism is not. The chapters in this volume address the basis of her egoism in a virtue-centered normative ethics; her account of how moral norms in general are themselves based on a fundamental choice by an agent to value his own life; and how her own approach to the foundations of ethics is to be compared and contrasted with familiar approaches in the analytic ethical tradition. Philosophers interested in the objectivity of value, in the way ethical theory is virtue-based, and in acquiring a serious understanding of an egoistic moral theory worthy of attention will find much to consider in this volume, which includes critical responses to several of its main essays. It is not clear to what the projects of creating an artificial intelligence (AI) that does ethics, is moral, or makes moral judgments amounts. In this paper we discuss some of the extant metaethical theories and debates in moral philosophy by which such projects should be informed, specifically focusing on the project of creating an AI that makes moral judgments. We argue that the scope and aims of that project depend a great deal on antecedent metaethical commitments. Metaethics, therefore, (...) plays the role of an Archimedean fulcrum in this context, very much like the Archimedean role that it is often taken to take in context of normative ethics (Dworkin 1996; Dreier 2002; Fantl 2006; Ehrenberg 2008). Epistemology is widely seen as a normative discipline like ethics. Just like moral facts, epistemic facts – i.e. facts about our beliefs’ epistemic justification, rationality, reasonableness, correctness, warrant, and the like – are standardly viewed as normative facts. Yet, whereas many philosophers have rejected the existence of moral facts, few have raised similar doubts about the existence of epistemic facts. In recent years however, several metaethicists and epistemologists have rejected this Janus-faced or dual stance towards the existence (...) of moral and epistemic facts. As recent developments in metaethics and normativity theory have made clear, objections to the existence of moral facts really are metanormative objections that target the existence of normative facts more generally. But since epistemic facts are no less normative than moral facts, the argument goes, the existence of the former is equally threatened by metaethical objections. In this thesis, I argue that this rejection of the dual stance fails because epistemic facts are not normative facts. Although they imply norms, they do not imply genuine normativity since the epistemic norms of belief that they imply lack necessary normative authority or force. Unlike moral norms and just like e.g. norms of etiquette and the law, there is not automatically a normative reason to conform to epistemic norms. Therefore, even if metaethical objections target all normative facts, it does not follow that they also target epistemic facts. I offer a two-part abductive argument in favour of that conclusion. First, I argue that epistemic facts lack five commonly cited features of normative facts (but not of merely norm-implying facts). Then, I argue that this is best explained by the thesis that epistemic facts are merely norm-implying and not genuinely normative. I end by exploring the potential consequences of this conclusion for epistemology and metaethics. (shrink)

Most agree that when it comes to so-called 'first-order' normative ethics and political philosophy, constructivist views are a powerful family of positions. When it comes to metaethics, however, there is serious disagreement about what, if anything, constructivism has to contribute. In this paper I argue that constructivist views in ethics include not just a family of substantive normative positions, but also a distinct and highly attractive metaethical view. I argue that the widely accepted 'proceduralist characterization' of (...) constructivism in ethics is inadequate, and I propose what I call the 'practical standpoint characterization' in its place. I then offer a general taxonomy of constructivist positions in ethics. Since constructivism's standing as a family of substantive normative positions is relatively uncontested, I devote the remainder of the paper to addressing skeptics' worries about the distinctiveness of constructivism understood as a metaethical view. I compare and contrast constructivism with three other standard metaethical positions with which it is often confused or mistakenly thought to be compatible: realism; naturalist reductions in terms of an ideal response; and expressivism. In discussing the contrast with expressivism, I explain the sense in which, according to the constructivist, the distinction between substantive normative ethics and metaethics breaks down. I conclude by distinguishing between two importantly different debates about the mind-dependence of value. I argue that a failure to make this distinction is part of what explains why the possibility of constructivism as a metaethical view is often overlooked. (shrink)

In this response I raise a number of problems for Michael Slote's normative and metaethical sentimentalism. The first is that his agent–based account of rightness needs be qualified in order to be plausible; any such qualification, however, leaves Slote's normative ethics in tension with his metaethical views. The second is that an agent–based ethics of empathic caring will indeed struggle to capture our common–sense understanding of deontological constraints, and that appeal to the notion of causal immediacy (...) will be of little help here. Finally, it seems to me that Slote's metaethical account will turn out to be much less externalist than he suspects. (shrink)

There has, in recent decades, been considerable scholarship regarding the moral aspects of corporate governance, and differences in corporate governance practices around the world have been widely documented and investigated. In such a context, the claims associated with moral relativism are relevant. The purpose of this paper is to provide a detailed consideration of how the metaethical and normative claims of moral relativism in particular can be applied to corporate governance. This objective is achieved, firstly, by reviewing what is (...) meant by metaethical moral relativism and identifying two ways in which the metaethical claim can be assessed. The possibility of a single, morally superior model of corporate governance is subsequently considered through an analysis of prominent works justifying the shareholder and stakeholder approaches, together with a consideration of academic agreement in this area. The paper then draws on the work of Wong, firstly in providing an argument supporting metaethical moral relativism and secondly regarding values of tolerance and/or accommodation that can contribute to the normative claim. The paper concludes by proposing an argument that it is morally wrong to impose a model of corporate governance where there are differences in moral judgements relevant to corporate governance, or to interfere with a model in similar circumstances, and closes with consideration of the argument’s implications. Two common medical-ethical axions, the health-maximizing axiom and the personhood-respecting axiom, are discussed. On the basis of a philosophical analysis of personhood and freedom of the will it is shown that these two axioms are incompatible. The rejection of the first axiom is suggested.

This dissertation examines the psychology of moral judgment and its implications for normative ethics and metaethics. Recent empirical findings in moral psychology, such as the impact of emotions, intuitions, and situational factors on moral judgments, have sparked a debate about whether ordinary moral judgments are systematically error-prone. Some philosophers, such as Peter Singer and Joshua Greene, argue that these findings challenge the reliability of moral intuitions and support more "reasoned", consequentialist approaches over deontological ones. The first part of (...) the dissertation reviews these provocative findings and the philosophical reactions to them, which often invoke the notion of 'moral relevance' - the idea that some factors shaping moral judgments are morally irrelevant. The second part develops a psychological account of moral relevance, drawing on theories of the moral domain, the role of emotions, and models of moral cognition. This account reveals the complex interplay of intuitive and reasoned processes in generating impressions of moral relevance. The final part reevaluates the philosophical discussions in light of this psychological understanding. It contends that the evolutionary background of moral intuitions does not necessarily render them inadequate, and that both deontological and consequentialist judgments likely depend on evolved intuitions to a significant degree. Furthermore, the tendency to dismiss certain influences on moral judgment as irrelevant can itself be explained psychologically. Considering the psychological account presented, mind-independent accounts of morality become less plausible. The dissertation concludes that while empirical moral psychology reveals important constraints on normative theorizing, it does not decisively favor consequentialism over deontology. To assess the significance of empirical-scientific findings for ethics, a nuanced understanding of the origins of moral judgments is nevertheless indispensable. (shrink)

Understood one way, the branch of contemporary philosophical ethics that goes by the label “metaethics” concerns certain second-order questions about ethics—questions not in ethics, but rather ones about our thought and talk about ethics, and how the ethical facts (insofar as there are any) fit into reality. Analogously, the branch of contemporary philosophy of law that is often called “general jurisprudence” deals with certain second-order questions about law—questions not in the law, but rather ones about our (...) thought and talk about the law, and how legal facts (insofar as there are any) fit into reality. Put more roughly (and using an alternative spatial metaphor), metaethics concerns a range of foundational questions about ethics, whereas general jurisprudence concerns analogous questions about law. As these characterizations suggest, the two sub-disciplines have much in common, and could be thought to run parallel to each other. Yet, the connections between the two are currently mostly ignored by philosophers, or at least under-scrutinized. The new essays collected in this volume are aimed at changing this state of affairs. The volume collects together works by metaethicists and legal philosophers that address a number of issues that are of common interest, with the goal of accomplishing a new rapprochement between the two sub-disciplines. This essay seeks to clarify the meaning and nature of normativity in metaethics and offers reasons why comparative religious ethics (CRE) must properly address questions about normativity. Though many comparative religious ethicists take CRE to be a normative discipline, what they say about normativity is often unclear and confusing. I argue that the third‐wave scholars face serious questions with respect to not only the justification of moral belief but also the rationality of moral belief and action. These scholars (...) tend to view the justification of moral belief to be a matter of process (that is, discursive social practice) rather than evidence‐possession, thus overlooking crucial differences between the two. They also run the risk of confusing motivating and explanatory reasons with normative reasons for moral belief and action. A prominent trend in moral philosophy today is the interest in the rich textures of actual human practices and lives. This has prompted engagements with other disciplines, such as anthropology, history, literature, law and empirical science, which have produced various forms ofcontextual ethics. These engagements motivate reflections on why and how context is important ethically, and such metaethical reflection is what this article undertakes. Inspired by the work of the later Wittgenstein and the Danish theologian K.E. Contemporary Kantianism is often regarded as both a position within normative ethics and as an alternative to metaethical moral realism. We argue that it is not clear how contemporary Kantianism can distinguish itself from moral realism. There are many Kantian positions. For reasons of space we focus on the position of one of the most prominent, contemporary Kantians, Christine Korsgaard. Our claim is that she fails to show either that Kantianism is different or that it is better than (...) realism. This paper develops an interpretation of Nietzsche’s ethics and metaethics that reconciles his apparent antirealism with his engagement in normative discourse. Interpreting Nietzsche as a metaethical constructivist—as holding, to a first approximation, that evaluative facts are grounded purely in facts about the evaluative attitudes of the creatures to whom they apply—reconciles his vehement declarations that nothing is valuable in itself with his passionate expressions of a particular evaluative perspective and injunctions for the free spirits to create new values. (...) Drawing on Nietzsche’s broader epistemological and psychological views, I develop a distinctive, and genuinely Nietzschean, version of constructivism. On this account, evaluative properties are grounded in affective valuations of the new philosophers. The maturing of metaethics has been accompanied by widespread, but relatively unarticulated, discontent that mainstream metaethics is fundamentally on the wrong track. The malcontents we have in mind do not simply champion a competitor to the likes of noncognitivism or realism; they disapprove of the supposed presuppositions of the existing debate. Their aim is not to generate a new theory within metaethics, but to go beyond metaethics and to transcend the distinctions it draws between metaethics and normative ethics (...) and between cognitivism and non-cognitivism. In our experience, the differences with traditional metaethics go deep enough that it can feel as if two different paradigms are talking past each other. We attempt to bring clarity and focus to this rather inchoate debate by simultaneously articulating the general issues involved and engaging in a detailed case study of one of the prominent representatives of this discontent, Christine Korsgaard. We argue that Korsgaard fails to go beyond metaethics–indeed, fails even to provide a theory within metaethics. Our strategy for showing this is to argue that her claims are compatible with both cognitivism and non-cognitivism. We have argued elsewhere that her distinctive claims are compatible with realism. Here we focus on the crucial role that claims about agency and the will seem to play her in work and, according to our interpretation, in her attempts to go beyond mainstream metaethics. We show in detail that these claims are actually compatible with non-cognitivism. Though our discussion often focuses on her work in particular, it has clear implications for other attempts to obviate the debates of traditional metaethics. (shrink)

Robert Elliot claims that the metaethical distinction between subjectivism and objectivism is unimportant in environmental ethics. He argues that because a sufficiently sophisticated subjectivist can accommodate all the intrinsic value an objectivist can, even in apparently problematic situations where humans either do not exist or do not have the relevant values, and because metaethical commitments fail to have any normative or motivational impact on rational debate, it makes no difference whether an environmental ethicist is a subjectivist or an (...) objectivist. Elliot's dismissal, however, is unjustified. As it turns out, objectivists argue differently from the way subjectivists do, are motivated differently from the way subjectivists are, and are able to make a greater range of intrinsic value claims than subjectivists are. If Elliot's arguments have any appeal at all, it is only because he blurs the fundamental metaethical distinction in the first place and defends a subjectivism so objectivist that it is almost unrecognizable as subjectivism. The concepts we use to value and prescribe are historically contingent, and we could have found ourselves with others. But what does it mean to say that some concepts are better than others for purposes of action-guiding and deliberation? What is it to choose between different normative conceptual frameworks?

Stephen Ingram defends a robustly realistic metaethical theory, based on the concept of normative arbitrariness, of which he provides the first in-depth analysis. He argues that, in order to capture the normative non-arbitrariness of moral choice, we must commit to the existence of robustly stance-independent, categorical, irreducibly normative, non-natural moral facts. Specifically, he identifies five ways in which a metaethical theory might fail to capture the non-arbitrariness of moral choice. The first involves claims about the bruteness of (...) moral attitudes or facts. The second involves claims about the privileging of some attitudes over others. The third involves the claim that some metaethical theories leave a normative deficit. The fourth involves a claim about our ownership over moral reality. And the fifth involves the claim that certain metaethical theories introduce a destabilising contingency into the moral domain. Ingram argues that robust realism is the theory that is best placed to avoid all five of these arbitrariness charges. He then goes on to show that, by exploring the nature of interpersonal moral dialogue, robust realists can defend epistemological and meta-semantic theories that are friendly to their view. Specifically, he defends a dualistic form of moral intuitionism on which some moral beliefs are justified on the basis of a priori intuitions, whilst others are justified on the basis of a posteriori moral experiences, and provides a theory of 'moral mental files' to explain how moral terms and concepts are able to refer to robust moral facts. I present and defend (1) an account of ethical judgments as judgments about our reasons to feel specific motivationally laden attitudes, (2) an account of what an agent should do in terms of what would achieve ends that she has reason to be motivated to pursue, and (3) an account of an agent’s reasons for motivation (and thus action) in terms of the prescriptions of the most fundamental principles that guide her deliberations. Using these accounts, I explain the connection between (...) ethics and reasons for action, how ethical judgments are both descriptive and intrinsically motivating, and how ethical facts arise from facts about agents’ deliberations. Foot , Hursthouse , and Thompson , along with other philosophers, have argued for a metaethical position, the natural goodness approach, that claims moral judgments are, or are on a par with, teleological claims made in the biological sciences. Specifically, an organism’s flourishing is characterized by how well they function as specified by the species to which they belong. In this essay, I first sketch the Neo-Aristotelian natural goodness approach. Second, I argue that critics who claim that this sort of (...) approach is inconsistent with evolutionary biology due to its species essentialism are incorrect. Third, I contend that combining the natural goodness account of natural-historical judgments with our best account of natural normativity, the selected effects theory of function, leads to implausible moral judgments.
