The metaphor of a border has also been employed to demonstrate this transformation, which may be liberating, oppressive, or some complex combination thereof (Weir 2006; Martinez (...) 2004). What happens, in psychic and sociopolitical terms, in the journey across this border? Can a woman, as an independent, autonomous being, preserve her identity, her selfhood as a mother? Is the transition to motherhood an expression of culture or nature? The answers to these questions are infinitely complex, yet are at the core of philosophical, political, and personal explorations of the maternal. Central to these explorations are academic critiques and personal responses to the biomedical mediation of the transition to motherhood. For some women, medical intervention in pregnancy and childbirth is inherently oppressive, whereas for other women such intervention is a marker of privilege. In a groundbreaking volume published in 1998, Margaret Lock and Patricia Kaufert argue that women respond to different biomedical interventions in pragmatic ways, which reflect their lived experiences. They claim that “it is more appropriate to understand women’s responses in medical settings as reflecting their daily experiences as part of a domestic group, a community, or a society” (19). [End Page 65]I would like to advance this analysis by suggesting that women respond to biomedical intervention in pregnancy and childbirth in ways that reflect not simply their practical needs and realities, but important details about inequality and identity. Women’s relative degrees of power and agency in society are expressed through their preferences for care during pregnancy and childbirth. In addition, and in connection with the (structural) dynamics of inequality, these preferences reflect the complexities of shifting, negotiated, maternal identities. In order to consider the ways in which women negotiate maternal identity through their preferences concerning care during pregnancy and childbirth, I will examine the contributions of Adrienne Rich, which effectively serve as the foundation for this and countless other areas of women’s and gender studies. In Of Woman Born, Rich dedicates two full chapters to childbirth, and explains in these chapters that the institution of childbirth has come to dominate and eclipse women’s experiences. Moreover, the patriarchal circumscription of childbirth is reinforced by the isolation of childbirth (and motherhood) from other life events. Rich demonstrates these problems through the metaphor of “giving birth to oneself ” (29), which has (at least) two distinct meanings: self actualization and self replacement.My investigation into these meanings will include an examination of Rich’s philosophical treatment of pregnancy and childbirth and an assessment of the sociopolitical implications of both conceptions of “giving birth to oneself.” I will then subject these conceptions to empirical testing, as Rich insists. Such empirical testing is crucial because the social and political dimensions of the institutions of childbirth and motherhood are complex and differ from one context to the next. Rich explains that[t]o hold power over others means that the powerful is permitted a kind of short-cut through the complexity of human personality. He does not have to enter intuitively into the souls of the powerless, or to hear what they are saying in their many languages, including the language of silence. Colonialism exists by virtue of this short-cut—how else could so few live among so many and understand so little?(65)This essay will avoid a similar shortcut often taken by theorists, which builds philosophical arguments without empirical support. The empirical cases to be considered in the context of philosophical debate include Canada, Honduras, and Cuba, and details of each case will be drawn from extensive interview data from a larger empirical study.1 In the Canadian context, resistance to the constraining effects of motherhood as institution is reduced to resistance to medical regulation of pregnancy and childbirth. This study examines negotiations of motherhood among women in the illegal hard drug economy in Norway. Based on interviews with mothers who are users and dealers, this study analyzes four predominant maternal identities: grieving mothers, detached mothers, motherly dealers, and working mothers. Particularly relevant factors explaining variations in maternal identities include the timing of pregnancy, time spent with children, control over drug use, and place in the drug market hierarchy. In the discussions leading up to the enactment of the UK Human Fertilisation and Embryology Regulations 2015, it was repeatedly emphasised, by many commentators, that maternal spindle transfer and pronuclear transfer did not give rise to children who could be considered as having three or more parents. This was because it was argued that only the genetic material found in the chromosomes should be considered as the determining factor for the formation of parent–child relationships and the resulting kinship identities. (...) In this present study, however, this assertion will be questioned in the light of different kinds and different understandings of kinship identities. It will also be suggested that any person who is partly responsible for the very existence of a child, through any means, may qualify as a causal parent — a parent whom the resulting child may want to identify. As a result, a positive response should be given to a request from a person born from MST and PNT concerning identifying information for all the individuals responsible for bringing him or her into existence. In the light of this, the article will conclude that it is regrettable that the UK government enacted binding legislation making sure that children, born through MST and PNT, will never be able to contact the egg donors and, in the case of PNT, the sperm donors. This reflects a very limited understanding of who parents really are and may give rise to serious long-term psychological distress in the prospective children. (shrink)

This article retrieves Sara Ruddick’s Maternal Thinking as a resource for analyzing contemporary activism by mothers advocating for gun control and police reform. Concerns about ethnocentrism and gender essentialism have discouraged engagement with maternal thinking. However, self-identified “moms” continue an historical pattern of protecting their children through public advocacy on social issues. Given the role that maternal identity plays in political activism, feminist ethics must continue to develop robust theoretical resources for analysis and critique. Sara Ruddick’s (...) This paper examines the complexity and fluidity of maternal identity through an examination of narratives about "real motherhood" found in children's literature. Focusing on the multiplicity of mothers in adoption, I question standard views of maternity in which gestational, genetic and social mothering all coincide in a single person. The shortcomings of traditional notions of motherhood are overcome by developing a fluid and inclusive conception of maternal reality as authored by a child's own perceptions.

The onomasticon of Hellenistic Uruk demonstrates that, in some cases, individuals with Greek names were included in otherwise Babylonian families. Often, such Greek names have been interpreted by scholars as evidence for Hellenization. This article suggests an alternate explanation, based on evidence throughout the family trees for a series of naming practices that focus on the perpetuation of names of female relatives and transmission of preferred family names through maternal lines. Particularly important to this discussion are the practices of (...) mammonymy, a term coined here to refer to papponymy’s gendered parallel, i.e., the naming of a girl after her grandmother or other female ancestor, and the practice, previously unexamined in the Assyriological literature, of “maternal-line papponymy,” the tradition of naming a son for his maternal grandfather or other male ancestor from a maternal line. Maternal-line papponymy can be observed in family trees in which the members bear only Babylonian names, as well as in family trees that include individuals with Babylonian names and individuals with Greek names. The Greek names used for boys are often those of fathers or grandfathers of women with Greek names who married into these Babylonian families. This article argues that the incorporation of Greek names into the elite Babylonian families of Hellenistic Uruk cannot be assumed to be straightforward evidence of impulses toward “Hellenization.” Rather, this evidence indicates that Greek names were given to sons in such families within the context of traditional Babylonian maternal-line naming practices. This finding has important implications for scholarship’s understanding of acculturation and the display of cultural identity in Hellenistic Babylonia. (shrink)

This essay suggests that despite the traditional viewpoint that it seemingly supplements patriarchy's consistent marginalization of maternal bodies, masochism, as formulated by Gilles Deleuze, offers the possibility of a maternal subjectivity beyond paternal domination. Deleuze's conception of masochism reveals an innovative way in which to view maternity as a tactical schema that operates through the perverse disavowal and resexualization of patriarchal law in order not only to destabilize its foundations, but to produce a maternal identity of (...) the mother's own creation. This essay will use Ira Levin's horror novel Rosemary's Baby to contextualize an adaptation of Deleuze's theory in order to account for the relationship between mother and child, and the emergent subjectivity the dyad produces. Levin's novel seamlessly showcases how the maternal body is observed and optimized by reproductive technologies in order to produce not only a heteronormative ideal of maternity, but a child who will reflect paternal law. This essay argues that the titular character, Rosemary Woodhouse, establishes a masochistic contract with her son whereby she reconfigures his identity through a perverse disavowal of the Law of the Father, replacing it with maternal authority. Most important, her performance of masochism results in the marginalization of the father, and the emergence of a new maternal identity. (shrink)

Mitochondrial replacement techniques have the potential to allow prospective parents who are at risk of passing on debilitating or even life-threatening mitochondrial disorders to have healthy children to whom they are genetically related. Ethical concerns have however been raised about these techniques. This article focuses on one aspect of the ethical debate, the question of whether there is any moral difference between the two types of MRT proposed: Pronuclear Transfer and Maternal Spindle Transfer. It examines how questions of (...) class='Hi'>identity impact on the ethical evaluation of each technique and argues that there is an important difference between the two. PNT, it is argued, is a form of therapy based on embryo modification while MST is, instead, an instance of selective reproduction. The purpose of the study was to understand community perceptions (...) of maternity services. This article highlights the activities that the research team carried out during each phase of the research process, and how they established team identity, team trust, and team efficacy. This research has created a platform for new avenues for health providers and community to partner to improve maternal‐newborn care. Maternal health has become a top global priority. In contrast to the decline of the maternal subject (Stephens, 2011), and despite previous evidence that maternal health has struggled to find a place on the global policy agenda (Shiffman and Smith, 2007), it is now clear that the promotion of health for mothers and children is a staple of both government and private donor commitments. On humanitarian grounds, it makes sense to focus on maternal health and survival (...) in the Global South. Death related to pregnancy or childbirth is a disheartening example of needless suffering. But beyond the initial impulse to reduce suffering, what motivates and/or requires action for addressing injustice in the form of distributional inequities for maternal and reproductive health? In this article, I make a case for the necessity and validity of transnational cooperation to address maternal mortality and morbidity in the Global South. The first component of my argument addresses the transnational elements of both global interconnectedness and responsibility to act. These elements are drawn from Iris Marion Young’s philosophical justification for North-South responsibility-taking. The second component of my argument adds the concept of affective solidarity to that of transnational responsibility. My argument in this section draws from Iris Marion Young’s earlier work on identity (Young, 1990) and embodiment (Young, 1984) and expands the analysis of affective solidarity as a form of both embodiment and political commitment in order to explain the mechanism for transnational connection and understanding. And the final component of my argument explains how both of these elements – transnational responsibility and affective solidarity – support a theory of transnational maternal feminism. (shrink)

In the late 1720s, Daniel Turner and James Blondel engaged in a pamphlet dispute over the power of the maternal imagination. Turner accepted the long-standing belief that a pregnant woman's imagination could be transferred to her unborn child, imprinting the foetus with various marks and deformities. Blondel sought to refute this view on rational and anatomical grounds. Two issues repeatedly received these authors' attention: the identity of imagination, and its power in pregnant women; and the process of generation (...) and foetal development. In their discussions of these issues, differences between the authors' acceptance of general medical theories and philosophies became apparent. Blondel invoked Newtonian matter theory, experimental philosophy, and iatro-mechanism, while Turner adhered more to the authority of the Ancients and advocated a more direct role for the Creator as an alternative to mechanism in explaining natural phenomena. Additionally, the authors held differing views of what they regarded as experience. The widespread contemporary interest in their dispute suggests that Turner and Blondel raised the phenomenon of the maternal imagination from an issue of folk belief to a concern of eighteenth-century medicine. Sara Ruddick's Maternal Thinking: Towards a Politics of Peace is both an anomaly and a product of the tradition associating maternal activities with peace. Ruddick argues that maternal work gives mothers distinct motives for rejecting war, unique abilities for nonviolent conflict resolution, and a critical perspective on military thinking. If she is correct, maternal thinking may provide the foundation for a feminist peace politics. My project is a critical account of maternal thinking as Ruddick unfolds (...) it in her book. Ruddick's argument has two central components: The theoretical development of maternal thinking, which she explains in terms of a "practicalist conception of truth" , and The case that maternal thinking can ground a feminist peace politics, based on Nancy Hartsock's version of feminist standpoint theory. ;Ruddick constructs mothering as a genderfree practice under the PCT to distinguish from earlier accounts of mothering. This is problematic for three reasons. First, it portrays mothers as autonomous, ahistorical, and acultural caretakers and ignores how other practices shape and contribute to maternal practice's definition. Second, Ruddick does not say enough about the identity of her mothers. She acknowledges racial and cultural differences, but does not explore the implications of her pluralism. Also, her genderfree account excludes any discussion of masculine and feminine styles of mothering. Third, the cross-practice critical power of MT is restricted by the practicalist view that "there is no truth by which all truths can be judged." I suggest Ruddick can overcome this confusion by distinguishing between internal and external goals of practices. I argue that a holistic view, which places maternal practice within a complex web of related practices, helps to eliminate the remaining problems with mothering under the PCT. ;Ruddick's move from a practicalist to a standpoint version of MT solves a critical problem for her. Feminist standpoint theorists typically argue that distinctions between men's and women's understandings of the world are rooted in the sexual division of labor; they maintain that "thinking from women's lives" makes available a privileged view on male supremacy. Ruddick draws on Hartsock's radical version of a feminist standpoint, which holds that both the sexual division of labor in women's subsistence activities and the intimate involvement of their bodies in "menstruation, coitus, pregnancy, childbirth, and lactation" have epistemological consequences. To show the superiority of feminist standpoint, she compares maternal and military "histories of the human flesh." The central role of this comparison in Ruddick's argument makes her position dangerously close to the essentialist arguments she desires to avoid. (shrink)

Kant's contribution to modern Protestant theology is as unmistakable as it is controversial. The authors of this volume are investigating a new perspective on the work of theology and the effects of Kant's philosophy of religion concentrated on biblical hermeneutics and dogmatic theology.

In order to avoid the implication that ‘mitochondrial replacement techniques’ (MRT) would produce ‘three parent babies’, discourses around these techniques typically dismiss the contribution of the mitochondria to genetic parenthood and personal identity. According to many participants in debates about MRT, ‘real parenthood’ is a matter of contributing nuclear DNA, which in turn implies that men and women make the same contribution to the embryo. Even when the importance of the mitochondria is acknowledged, an emphasis on mitochondrial DNA still (...) has the effect of valorizing the role of DNA (and thus the paternal contribution to conception) at the expense of the role played by the cytoplasm of the oocyte in the development of the embryo and placenta, and that of the mother’s body in gestation. In this way, discourses around MRT falsely imply that what men and women contribute to reproduction and parenthood is the same—nuclear DNA—and thus erase the distinctive contribution that women make to conception. The potential of MRT to reconfigure relationships between the sexes in the service of patriarchal norms is perhaps one of the most significant things about it and should, we argue, be counted in the discussion of the ethical and policy implications of legitimating these procedures. Mitochondrial replacement techniques, known in the popular media as 'three-parent' or 'three-person' IVFs, have the potential to enable women with mitochondrial diseases to have children who are genetically related to them but without such diseases. In the debate regarding whether MRTs should be made available, an issue that has garnered considerable attention is whether MRTs affect the characteristics of an existing individual or whether they result in the creation of a new individual, given that MRTs involve the genetic manipulation of (...) the germline. In other words, do MRTs affect the qualitative identity or the numerical identity of the resulting child? For instance, a group of panelists on behalf of the UK Human Fertilisation and Embryology Authority has claimed that MRTs affect only the qualitative identity of the resulting child, while the Working Group of the Nuffield Council on Bioethics has argued that MRTs would create a numerically distinct individual. In this article, I shall argue that MRTs do create a new and numerically distinct individual. Since my explanation is different from the NCOB's explanation, I shall also offer reasons why my explanation is preferable to the NCOB's explanation. (shrink)

Drawing on empirical research from two focus groups, this article investigates the narratives and discourses that emerged around pregnancy, technology, birth and motherhood. In so doing, the article engages in some long-standing debates within feminism around embodied and maternal subjectivity, agency and identity. Seen here, the focus groups serve initially to remind us of the pervasiveness of gender inequality and the continual ambiguity of, and anxieties around, maternal subjectivity. The focus groups reconfigure these issues through a technological (...) lens, which in turn seems to offer new spaces where agency can be (momentarily, problematically) claimed. This in turn extends existing debates in new directions through the particular framework of technology that is variously figured here as an object, as information and as imaginary digital space. All of these constructions, however, become problematic as they—despite their promises—nevertheless ultimately and profoundly return the women to an emplaced, embodied subjectivity that has been at the heart of feminist debate for so long. Few discussions of the ethics of mitochondrial ‘replacement’ techniques have drawn significant ethical distinctions between the two approaches now legal in the U.K. However, Anthony Wrigley, Stephen Wilkinson and John Appleby have together argued that under some circumstances pronuclear transfer (PNT) may be in better ethical standing than maternal spindle transfer (MST). They base their conclusion on what they allege to be different implications of the techniques with respect to non‐identity considerations, which they ground on a version of (...) origin essentialism. I raise a series of problems for their argument, which have cautionary implications for invocations of origin essentialism that go beyond specialized debates regarding MST and PNT. I argue that (i) origin essentialism is a fragile foundation for non‐identity considerations; (ii) gametic essentialism, which Wrigley et al. believe licenses their claims, is more questionable than origin essentialism; (iii) gametic essentialism does not straightforwardly justify their conclusion; and (iv) their conclusion in fact relies on an especially dubious position that we can call chromosomal origin essentialism. No good reasons have yet been supplied to distinguish PNT from MST on ethical grounds, and one should be wary of basing claims with practical impact on fragile foundations relating to origin essentialism. Motherhood is no longer a clear-cut concept. Is it a mere biological fact, or does it require a volitional component? This question is answered differently throughout Europe. The French regime of accouchement sous X is more oriented towards the second option. Conversely, the English system identifies parturition as the exclusive determinant for defining legal motherhood. This debate has an impact on the resolution of another issue, namely whether an individual, preeminently a child, has a right to know about his/her origins. (...) The recognition of an absolute right of a woman to give birth anonymously evidently contravenes France’s obligation to protect the right to know one’s origins, as enshrined in the UNCRC as well as in the ECHR. Furthermore, despite its laudable purpose, the French regime has proved unable to prevent tragic events, such as infanticide, abandonment and abortion. But does English law offer a solution that is more respectful of children’s rights? To all appearances, it does, but not substantially. The denial of accouchement sous X should not be viewed as enhancing the overall protection of children’s rights in England. By providing abortion on demand, a woman’s right to renounce maternity is fully protected and, therefore, the legalization of anonymous birth would be superfluous. In light of the complexity of the issue whether a child has the right to know his/her origins, categorical positions are not appropriate, since they implicitly postulate hierarchies of rights. To the contrary, the acknowledgement of the competing rights as equally fundamental makes it possible to achieve a fair equilibrium between the interests of all parties involved. In this balancing exercise, the reconceptualization of identity as child-centered has the potential to overcome the culturally-constructed dichotomy of biological connections/social bonds and, therefore, to realize the best interests of every child. The advantages and risks of a number of new genome modifying procedures seeking to create healthy or enhanced individuals, such as Maternal Spindle Transfer, Pronuclear Transfer, Cytoplasmic Transfer and Genome Editing, are currently being assessed from an ethical perspective, by national and international policy organizations. One important aspect being examined concerns the effects of these procedures on different kinds of identity. In other words, whether or not a procedure only modifies the qualities or properties of an existing human (...) being, meaning that merely the qualitative identity of this single individual is affected, or whether a procedure results in the creation of a new individual, meaning that a numerically distinct human being would have come into existence. Drawing on data from 18 months of participant observation and interviews at a community health clinic in North Carolina, the author illustrates how an intersectional perspective deepens our understanding of the construction of a moral identity. In this case, the author examines the moral identity of health care providers—all women—who provide family planning and contraceptive counseling for women clients. The author analyzes how maternity care coordinators—two whites and two Latinas—craft a moral identity by drawing on the cultural (...) toolkit available to them, using gendered frames but also racial, class, and nationalist frames. An intersectional lens helps us better understand how maternity care coordinators' moral identities are shaped by their different locations within racism, classism, and nationalism. (shrink)

An Irish surrogacy case from 2013 illustrates how negotiations of the mother’s identity in a given national and legal context are drawing on novel scientific perspectives, at a time when the use of new biotechnological possibilities is becoming more widespread and commonplace. The Roman dictum, ‘Mater Semper Certa Est’ is contested by the finding of this Irish court, in which the judge made a declaration of parentage stating that the genetic parents of twins born using a surrogate were the (...) parents. This article critically examines the normative background assumptions involved in this ruling. It will argue that the particular deployment of arguments from genetics and epigenetics in this court case produces a naturalization of the mother’s identity that is inherently reductive. A second surrogacy case is also examined, this time regarding the rights of a woman of Irish nationality to receive paid maternity leave or paid leave similar to adoptive leave after the birth of her daughter to a surrogate mother in the US state of California. This case, which was brought to the Equality Tribunal in Ireland and decided by the Court of Justice of the European Union, is used to illustrate the possible ramifications of conflicting definitions of motherhood in the legal system. In concluding, this article argues for the development and deployment of a more complex understanding of the evolving state of motherhood within the courts, in keeping with developments in the IVF industry and the various new mother-relations it makes possible. Cet article a pour objectif de montrer l’importance de la réception de la théologie politique de J.B. Metz auprès de certains théologiens soucieux de la dimension politique de la foi chrétienne. L’étude présente les réactions immédiates au projet théologique de Metz pour ensuite se focaliser sur des théologiens contemporains. Premièrement, on trouve J. Milbank, qui apprécie la pensée de Metz en la confrontant à son programme de Radical Orthodoxy. Deuxièmement, on rencontre H.-J. Gagey et J.-L. Souletie, qui évaluent la force (...) politique de la théologie de Metz. Enfin, on découvre la façon dont L. Boeve reprend de façon personnelle certains aspects de la pensée du théologien allemand. Pour terminer, l’article propose une réflexion synthétique et critique sur cette réception, avec le souci de montrer la pertinence de la théologie politique de Metz et sa capacité à stimuler la réflexion sur le rapport foi et société. Purpose. Based on the comparative analysis of the European and post-Soviet countries, the purpose of the article is to study one of the manifestations of gender discrimination, namely the problem of gender equality in the sphere of labor. It involves the consistent solution to the following tasks: a) to emphasize the basic principles of gender international and legal policy; b) to reflect the praxeological dimension of providing the equal social and economic opportunities for men and women at current level; c) (...) to emphasize the key criterion for ensuring the equality in socio-cultural sphere – equality in political life; d) to study the educational level of women and the possibility of self-realization in employment equal to men. Theoretical basis. The authors proceed from the standpoint that gender equality at the present stage has become a priority of legal policy and an important principle of the state of pro-European orientation. It is characterized in the legal plane, first of all, by the equality of the social roles of men and women, and the overcoming of the gender hierarchy of social ties, in which men are perceived as higher beings by their mental and physical abilities, and their activities are more significant and of priority in comparison with the activities of women. Originality. The authors have substantiated that in many economically developed countries the problem of providing a gender is still relevant, but most of the crisis problems in this area have found their legal regulation. The motivated position of the authors is that the level of education and professionalism of women cannot serve a reason for discrimination against women, which now exists in the economic and political sphere in the post-Soviet space. Conclusions. Gender stereotypes remain the priority in woman’s keeping family household, which creates significant inequalities of women and men at the labor market. Specialized regulatory acts in the field of gender declare the equality of men and women, while labor law defines a number of norms and guarantees that complicate the employment of women. In order to improve the situation we propose to implement a number of measures, such as, creation and financial support of the programs at the state level for supporting maternity, family and childhood; examination of all normative acts and concerning the issue of gender asymmetry, and especially the norms of labor law; introduction of state monitoring of employment and income of persons as to the complying with the principle of gender equality; introduction of quotas for women’s participation in political activities, in the work of the government and parliament, etc. (shrink)

In den Publikationen der Synthetischen Biologie und in Darstellungen dieser neuen Biotechnologie finden sich häufig Begriffe des Herstellens, Konstruierens, Erschaffens und Kreierens. Im folgenden Beitrag wird dieses Begriffsfeld auf der Basis von technikphilosophischen und kunsttheoretischen Ansätzen systematisiert. Es wird erstens untersucht, inwiefern sich die verschiedenen Forschungsrichtungen in der Synthetischen Biologie mit diesem Begriffsinstrumentarium angemessen beschreiben lassen; zweitens wird analysiert, welche ethischen Fragestellungen mit den unterschiedlichen Begriffen des Herstellens und Erschaffens im Fall der Synthetischen Biologie verbunden sind.
