This paper responds to the reform agenda of Reiner Eichenberger who proposes the deregulation of the voting system in order to enhance the competition among the candidates and to improve the responsiveness of elected representatives. Based on the theory of parliamentary representation the paper argues that a simple transfer of economic principles into the realm of politics comes to its limits where the differences between the economic and political systems are significant. Leibniz holds that we cannot give an account of the synchronic and diachronic identity of a person without appealing to a substance. This paper analyses his reasons for this anti-Lockean thesis. It first looks at his theory of substance, paying particular attention to his commitment to the Principle of Sufficient Reason: the existence of a well-ordered series of mental states cannot be sufficiently explained without reference to a substance. The paper then examines the distinction Leibniz draws between the substance as (...) the “real person” and the “appearing person” that comes into existence through reflexive consciousness. It argues that there can be no appearing person without a real person and looks at the relationship between these two types of person. Leibniz’s distinction is still relevant because it shows that questions concerning the metaphysical constitution of a person need to be carefully distinguished from questions concerning the psychological construction of a personality. There is a certain disconnect between the airiness with which modern research handles the person of Cynaethus of Chios and the scarcity of ancient information on him, the unreliability of which is at the heart of this essay. Cynaethus of Chios occurs only twice in ancient literature, in two anonymous undatable scholia on Pindar, N. 2, 1, the first of which not only satisfies the need for attributions of names on the part of modern philologists, but presumably satisfied already the (...) same need on the part of ancient philologists. In order to illustrate why it might indeed make sense to assume that there was a certain Cynaethus of unknown origin, but in fact not necessarily a Cynaethus of Chios, said scholion is thoroughly re-examined here. Following Henkin's discovery of partially-ordered (branching) quantification (POQ) with standard quantifiers in 1959, philosophers of language have attempted to extend his definition to POQ with generalized quantifiers. In this paper I propose a general definition of POQ with 1-place generalized quantifiers of the simplest kind: namely, predicative, or "cardinality" quantifiers, e.g., "most", "few", "finitely many", "exactly α", where α is any cardinal, etc. The definition is obtained in a series of generalizations, extending the original, Henkin definition first to a general (...) definition of monotone-increasing (M↑) POQ and then to a general definition of generalized POQ, regardless of monotonicity. The extension is based on (i) Barwise's 1979 analysis of the basic case of M↑ POQ and (ii) my 1990 analysis of the basic case of generalized POQ. POQ is a non-compositional Ist-order structure, hence the problem of extending the definition of the basic case to a general definition is not trivial. The paper concludes with a sample of applications to natural and mathematical languages. (shrink)

Modern sciences produce knowledge and findings which improve technological advance and our quality of life in every regard. But do the sciences also provide us with a genuine knowledge about the world in the sense of giving us insights into that which is taking place? This book traces the most important approaches, which have in past decades attempted to make intelligible the contemporary forms of scientific research and progress. The book suggests a new approach for a philosophy of science fit (...) for the 21st century. This new approach brings together and unites the various competing trends, from the philosophy of science to the sociology of science. Based on the findings the book discusses whether the sciences do in fact follow 'scientific' methods in order to reach their successes and whether what they produce can be considered 'knowledge' for us as individuals and for society at large. In this paper I develop an account of Fichte’s conception of philosophical construction. Following the latter’s definition of philosophy as the ‘science of science’, philosophy is to be understood as a normative theory of what should qualify as science. In order to ground scientific knowledge-production as such, philosophy itself has to acquire a scientific method, through the application of which the constitution of scientific knowledge is secured. In systematic continuity to Kant’s account of geometrical construction, Fichte develops a philosophical (...) method that exploits the special epistemic conditions of performativity. Construction is then defined as an experimental, self-reflexive performance that exemplifies consciousness. Throughout its acts of exemplification this reflexive kind of self-observation yields a particular type of experience, which ultimately satisfies the Science of Knowledge’s demand for certainty, that is intellectual intuition. At the time of the crisis culminating in the First World War, Bloch, a long time opponent of the authoritarian German state, was taking liberal, pacifist and finally even socialist positions. This criticism was also directed at German scholarly philosophy. In order to elaborate the fundamental idea of his theory – a metaphysics of inwardness – without being affected by current trends, Bloch refers back to the classical antique and neoplatonic gnostic metaphysics as well as to Manichaeism. These elements, (...) which constitute the very basis of his idea of the anticipating consciousness, are then related to a central problem facing the 19th century: the fate of subjectivity in the context of capitalist reification. In essayistic style Bloch develops and exemplifies classical themes using references to contemporary culture in all its complexity. (shrink)

This paper discusses C.G. Hempel's contention according to which universal laws fulfil the same 'theoretical function' in natural and historical science. To this end, the author differentiates between system ·building and genetically structured sciences. Their modes of presentation are respectively hierarchically ordered theory and narrative. These two basic ways of arranging our knowledge are led back to a difference in explanation, of a pragmatic, not logical nature, that is, to the difference between subsumtion and ascription. Whereas in the systematic organization (...) of knowledge, the basic underlying theory sets the exact conditions, under which a fact can be described as explained, such an epistemological directive function of laws is not to be found in genetic organization. The object of this study is to examine the way in which the later Fichte handles Kantian ideas. In the first part Kant’s theory of principles will be investigated in order to find out how many types of ideas he uses. In the second part the ideas will be assigned to the basic moments of Fichte’s Outlines 1810. Not only the transcendental concepts and postulates play a key role in the Science of Knowledge, but also the methodological ideas of (...) a theoretical and practical reason. While the latter are mentioned by Kant only in passing, in Fichte’s later works they constitute a pivotal part in the reflexions about the faculty of reason.Es soll untersucht werden, wie der späte Fichte mit den Kantischen Ideen umgeht. Der erste Teil widmet sich der Kantischen Prinzipienlehre und prüft, wie viele Arten sich überhaupt unterscheiden lassen. Im zweiten Teil folgt die Zuordnung der einzelnen Ideen zu den Grundmomentenin Fichtes Umriss von 1810. Dort werden sich nicht nur die transzendentalen Vernunftbegriffe und Postulate wiederfinden, sondern auch die methodologischen Ideen einer theoretischen und praktischen Vernunft. Während die letzteren bei Kant eher am Rande erwähnt werden, sind sie bei Fichte ein expliziter Bestandteil der Reflexion über das Vernunftvermögen. (shrink)

Far from being part only of Early Modern learning, Polyhistory as a way of gathering and shaping knowledge can be traced through the Middle Ages back to Grammar and Rhetoric of Roman Antiquity. Practical use and wise limitation have always been the regulations to polyhistorical libido sciendi. During the sixteenth and seventeenth centuries Polyhistory assumed the very high standard of Universitatis rerum historia , before it was losing its value by the rise of the new Cartesian paradigm of subject-centered epistemology. It is indispensable to survey the whole of its tradition, however incompletely and tentatively, in order to come to due distance to a term with polemical connotations dating from early Enlightenment when Polyhistory lost its credit. Usually, the ontology of art is executed as an ontology of artworks. This has the consequence that the answer to the question what art is says nothing about why art is valuable. But it is, I argue, necessary to determine the value of art if one wants to say what art is. In order to account for the value of art, I start with the claim that art is a practice of transformation. Thus, I propose to develop the ontology (...) of art as the ontology of a practice of transformation. The practice in question has four elements: first artworks, second interpretive activities through which recipients and producers follow the constellations realized in artworks, third ordinary practices which are reflected through interpretive activities, and fourth practices of art criticism. By way of these four elements art is realized. According to the proposed conception, art is a profoundly unstable practice which challenges human beings and their self-understandings in such a way that they and their self-understandings develop further. The museum of Trebizond houses a seal with a metrical legend of special interest, documenting a Synadenos, who had for some time been in a Sicilian prison but managed to escape, and thanks the apostle Thomas for this liberation. He might be Andronikos Synadenos, the husband of Theodora Komnene, a daughter of Alexios I, who served with distinction as general and as diplomat. As a military commander he maintained order in several border regions such as Dyrrachion, Niš, Cyprus, and (...) finally Trebizond. The legend of the seal enhances the information from his epitaph which is known from Codex Marc. gr. 574: Synadenos must have been taken prisoner as dux of Dyrrachion, either at the fights during the Second Crusade in 1147/49, or during the failed expedition to Southern Italy; it ended in 1158 by a peace treaty which included an exchange of prisoners. The seal stems from Synadenos’ last post in his military career as dux of Trapezunt (before 1179), since it was found there. A parallel piece, also published in this article, is nowadays in Dumbarton Oaks. (shrink)

“Older than Language Is the Mimicking of Gestures”: The Body as the Origin of Language. Nietzsche’s early philosophical ideas about language and its origin occupy a central place in scholarly discussions of his work. In order to examine Nietzsche’s interpretation of the constitution of human language, this article focuses not only on his early writings, but also on the first volume of Human, All Too Human as well as on his later period, in particular his work in 1887 and (...) 1888. The central claim of this article is that Nietzsche begins to view the body, with its gestures and movements, as the site of origin for instinctive unconscious language and the subsequent emergence of conceptual language. Already in 1872, and with the influence of contemporary scientific ideas, he begins to conceive the movement and gesture of the human body as the foundation for the origin of language. Strengthened in Human, All Too Human, this idea appears again in his later writings in 1887, when Nietzsche connects it to Charles Féré’s theories of “psychomotor induction” and “mental suggestion.” Finally, it is the Dionysian artist of 1888 who enjoys par excellence the capacity for suggestion, affect and immediate representation, and who thus becomes the master of communication. This question cannot be answered in a simple form, because philosophy is a historical phenomenon that has experienced many changes. Hence the contribution begins by sketching what was called «Philosophy» in the past in order to, against the background of this history of the concept, sketch what happens in philosophy today. The thesis is that philosophy essentially concerns attempts at conceptual orientation in the domain of our fundamentals of thought, recognition and action. In philosophical discourse explicative, normative and descriptive (...) aspects can be distinguished. Seen on the whole, philosophy is a conversation and that explains what may seem strange about it, namely its close connection to the history of philosophy, the high measure of forgetting and remembering, and the remarkable consistency of a few core themes over the centuries. In this paper, I start from the observation that there are obvious instances of instrumental irrationality, i.e. cases where subjects act knowingly against their strongest preferences. This observation raises an important question: Which facts determine the ‘strength’ of preferences? I consider a standard answer to this question – ‘revealed preference theory’– which turns out to be unsatisfactory. Then I turn to a more promising alternative: the ‘higher order theory’ of preference strength. But this proposal also faces a major problem, (...) the ‘problem of authority’. I argue that this difficulty can be overcome, but only if we are prepared to make some significant normative assumptions – assumptions which imply, among other things, that instrumentalism – the view that instrumental rationality is all there is to rationality – cannot be maintained. As a cultural institution for debate on European history, the House of European History in Brussels is a perfect example for the complementary relation between history and the present, since its main aim, as it is being claimed, “gives visitors the opportunity to learn about European history and to engage them in critical reflection about its meaning for the present day”. The main focus of the article is the analysis of the speeches of German and Austrian MPs presented in the (...) plenary debates of the European Parliament in spring 2011 on the expenditures on the building, in which the House of the European History is to be established. The focus of the analysis lies on the lexical level in order to prove the typical aspect of the political language in the European Parliament, which is the special mixture of various specialist languages. Following Hegel's remark that art is a “thousand-eyed Argos,” one can formulate the assumption that under contemporary conditions art and surveillance state do not necessarily exclude, but reflect each other. The film minority report as popular art offers a visual self-reflection on this proposition. The central question is whether and to what extend this film performs a legitimization or delegitimization of the normative order.

How natural is natural deduction?– Gentzen's system of natural deduction intends to fit logical rules to the effective mathematical reasoning in order to overcome the artificiality of deductions in axiomatic systems (¶ 2). In spite of this reform some of Gentzen's rules for natural deduction are criticised by psychologists and natural language philosophers for remaining unnatural. The criticism focuses on the principle of extensionality and on formalism of logic (¶ 3). After sketching the criticism relatively to the main rules, (...) I argue that the criteria of economy, simplicity, pertinence etc., on which the objections are based, transcend the strict domain of logic and apply to arguments in general (¶ 4). (¶ 5) deals with Frege's critique of the concept of naturalness as regards logic. It is shown that this concept means a regression into psychologism and is exposed to the same difficulties as are: relativity, lack of precision, the error of arguing from `is' to `ought' (the naturalistic fallacy). Despite of these, the concept of naturalness plays the role of a diffuse ideal which favours the construction of alternative deductive systems in contrast to the platonic conception of logic (¶ 6). This article examines Kant′s use of the expression “fact of reason” by giving an analysis of the pseudo-mathematical method which Kant employs in the first part of the Critique of Practical Reason. It turns out that Kant′s use of this expression has nothing to do with appealing to a certain fact as being an obvious, self-evident truth. There is no need for such an appeal since the “Fundamental Law of Pure Practical Reason” is a “practical postulate” which, like a postulate (...) in geometry, is unquestionably certain. In order to realize its validity it is sufficient to know what a practical law is and on what its validity depends. The fundamental law of pure practical reason needs, in Kant′s view, a “deduction” since it is a synthetic principle a priori. But its deduction cannot be a proof since postulates neither can nor need be proved. It has to be a justification which guarantees that the use of pure reason in giving practical laws is not “transcendent”, but “immanent”. This justification has, unlike Kant′s deduction of the “Postulates of Empirical Thinking”, the systematic form of a “defence” which invalidates possible objections by showing that they themselves necessarily rest on a transcendent use of reason. ZusammenfassungWährend die juristische und medizinethische Rechtfertigung des Verzichts auf Wiederbelebung in Deutschland akademisch hinreichend geklärt ist, zeigen sich doch erhebliche Unterschiede und zahlreiche Probleme bei der praktischen Umsetzung in der Klinik. Innerhalb des interdisziplinären Behandlungsteams gehören Kommunikationsdefizite und die Intransparenz der ethischen Entscheidungsprozesse zu den häufigsten Schwierigkeiten, die in der Medizinischen Klinik für Nephrologie und Hypertensiologie am Klinikum Nürnberg mit der Implementierung einer hausinternen Leitlinie, der Anordnung zum Verzicht auf Wiederbelebung, behoben werden sollten.Die Evaluationsstudie, die 118 VaW-Anordnungen bei 4718 Behandlungsfällen (...) im Zeitraum von November 2004 bis Juli 2005 einschloss, verfolgte einen dualen Forschungsansatz. Eine quantitative Dokumentationsanalyse aller VaW-Protokolle wurde mit der leitfadengestützten Befragung von 16 Ärzten und Pflegekräften kombiniert.Teambesprechungen waren in 62,4 %, Entscheidungsgründe in 74,6 % aller VaW-Protokolle dokumentiert. Die Interviews ergaben eine positive, aber berufsgruppendifferente Bewertung der Kommunikation, wobei die Pflegenden kritischer eingestellt waren als ihre medizinischen Kollegen. Die VaW-Dokumentation bewirkte nach Auffassung aller Befragten eine hohe Nachvollziehbarkeit und Transparenz. Die VaW-Anordnung wurde darüber hinaus als gut anwendbar und praxistauglich betrachtet. Nahezu alle Befragten sprachen sich für eine Beibehaltung des VaWVerfahrens in der Klinik aus.Die Implementierung der VaW-Anordnung als hausinterne Leitlinie und Dokumentationsstandard hat zu einer Förderung des interdisziplinären Dialogs und zu einer erheblichen Verbesserung der Transparenz der ethischen Entscheidungsprozesse im Rahmen des Verzichts auf Wiederbelebung geführt. Hilfreich und praxistauglich erfreut sich die VaW-Anordnung einer hohen Akzeptanz bei Pflegenden und Medizinern und wird seit drei Jahren in der Nephrologie am Klinikum Nürnberg konsequent angewendet. The Ecclesiastical History of Orderic Vitalis has been called `the greatest of all medieval chronicles'. Written in Normandy between 1114 and 1141, it is a detailed history of the Norman people and their conquests, full of vivid, often penetrating portraits of the lives and characters of kings and queens, lords and bishops, simple knights, and humble villagers. After the three families divided up the state of Jin and the Tian family took over Qi, the political situation in the fourth century B.C.E. appeared even more chaotic. Wei conquered Chu's Luyang and Qin's Xihe, Qin defeated Wei at Shimen , and again at Shaoliang , and Wei moved its capital to Daliang. During the mid-Warring States period, Qin became dominant in the west, Qi in the east, Chu in the south, and Wei in the center. Rapid changes occurred (...) one after another; trickery and conflict were rampant. However, the shi , the intelligentsia, actually managed to expand their spheres of existence and activity accordingly in this state of tension between countries, states, and men. A few major states assembled quite a number of literati; and those men of the villages, who had in earlier times merely waited passively for opportunities to fall into their laps, crisscrossed the various feudal states; literati who previously had no cause to use military force became, one by one, the honored guests of the feudal lords. With the breakdown of the previously simple and obvious order, the gradually dismantling of the common body of the ancestral clan of the past, and the increasing complexities of social relationships after the dissolution of blood ties, social order became a matter of concern. Or, to reword this most practical issue: How could this universally chaotic society go from disorder to order? (shrink)

The BRAHMASUTRA of BADARAYANA represents the fundamental text of exegesis of Vedanta. The intent of Badarayana - the sage that for authority and realization of consciousness has been identified with Vyasa, the Rsi who ordered the texts of the Vedas - is that of providing the right perspective in the interpretation of the most profound and meaningful contents of the Upanisads. This had proven necessary in order to rectify some unilateral aspects propounded by several schools of thought, both orthodox (...) and non-orthodox. The Brahmasutra presents, in their simplicity and incisiveness, the assertions of the Sruti and of the Smrti, showing their concordance in the recognition of the Nirguna Brahman as the ultimate Realty. In his notes, RAPHAEL underlines the fact that Badarayana does not oppose the various philosophical schools, but the Rsi allows us to comprehend that their postulates cannot represent the ultimate Truth as expounded in the Vedas and in the Upanisads. Moreover, at times Raphael focuses on certain aspects of the Advaita Doctrine with references to the Western Tradition, and - making the relevant parallels to the philosophy of Parmenides, Plato, Plotinus, and so on - highlights the unity of the sole universal Tradition at the metaphysical level.
