Die ethischen Aspekte der Verwendung von Placebos in klinischen Versuchsreihen wurden im letzten Jahrzehnt ausführlich und kontrovers diskutiert. Es fehlt dennoch eine gründliche vergleichende Analyse der verschiedenen internationalen Richtlinien, ihrer Terminologien und ihrer auf Placebo bezogenen Prinzipien. Das zentrale Problem ist die Rechtfertigung von Placebo bei einer nachgewiesen wirksamen Therapie. Alle aktuellen Versionen der untersuchten Richtlinien schlagen solche Rechtfertigungen vor, unterscheiden sich hierbei jedoch beträchtlich. Zunächst werden wir ein formales allgemeines Prinzip herausarbeiten. Dann werden wir drei verschiedene Kategorien von Kriterien (...) darstellen: das Schadensrisiko oder die Belastung, zwingende wissenschaftliche Gründe und die Erhältlichkeit einer nachgewiesen wirksamen Therapie. Die Analyse zeigt bedeutende normative Abweichungen und Widersprüche innerhalb und zwischen den einzelnen Richtlinien. Besonders frappierend ist es, dassmancheRichtlinien es erlauben, Versuchsteilnehmer dem Risiko eines schweren Schadens auszusetzen, während andere gerade dies untersagen. Abschließend versuchen wir zu zeigen, wie sich die normativen Unterschiede bei der Entscheidungsfindung von Forschern und Ethikkommissionen auswirken können. (shrink)

Constitutional and judicial law-making is increasingly beginning to find its reflection not only in the Anglo-Saxon, but also in the Romano-Germanic legal family. However, the prerequisites for the use of this legal instrument are different, which determines the relevance of conducting a comparative analysis regarding the provision of such a mechanism in the USA and Kazakhstan. The purpose of the research is to identify common and distinctive features in the process of implementation of constitutional and judicial law-making in (...) countries belonging to different legal systems. The article uses the methods of analysis, synthesis, comparison, deduction and generalization. As a result, the specificity of ensuring the mechanism of constitutional law-making in the USA was expressed, taking into account various forms of law-making activity. It has been established that the development of constitutional provisions in the United States takes place with the help of the constitutional doctrines of the Supreme Court of the United States, which provide for the introduction of amendments to constitutional provisions without a formal procedure. As a result of the study of the experience of Kazakhstan, it was established that special priority was given to the role of precedent, in particular, the decision of the Supreme Court of the Republic of Kazakhstan. This is explained by the integrative nature of the Romano-Germanic legal system, which allows effective development of national legislation as a whole and its provisions. Prediction is one of the major challenges in complex systems. The prediction methods have shown to be effective predictors of the evolution of networks. These methods can help policy makers to solve practical problems successfully and make better strategy for the future. In this work, we focus on exporting countries’ data of the International Trade Network. A recommendation system is then used to identify the products that correspond to the production capacity of each individual country but are somehow overlooked (...) by the country. Then, we simulate the evolution of the country’s fitness if it would have followed the recommendations. The result of this work is the combination of these two methods to provide insights to countries on how to enhance the diversification of their exported products in a scientific way and improve national competitiveness significantly, especially for developing countries. The enrolment of children and adolescents in health research requires that attention to be paid to specific assent and consent requirements such as the age range for seeking assent; conditions for parental consent (and waivers); the age group required to provide written assent; content of assent forms; if separate assent and parental consent forms should be used, consent from emancipated young adults; reconsent at the age of adulthood when a waiver of assent requirements may be appropriate and the conditions for (...) waiving assent requirements. There is however very little available information for researchers and ethics committees on how to navigate these different issues. To provide guidance to research initiatives, the SickleInAfrica consortium conducted a thematic analysis of a sample of research ethics guidelines and procedures in African countries, to identify guidance for assent requirements in health research. The thematic analysis revealed that 12 of 24 African countries specified the age group for which assent is required. The minimum age for written assent varied across the countries. Five countries, Algeria, Botswana, Cameroon, Nigeria and The Democratic Republic of Congo require consent from both parents/family council in certain circumstances. Botswana, Nigeria, South Africa and Uganda have specific assent/consent requirements for research with emancipated minors. South Africa and Algeria requires re-consent at onset of adulthood. Five countries (Botswana, Cameroon, Nigeria, South Africa and Tanzania) specified conditions for waiving assent requirements. The CIOMS and the ICH-GCP guidelines had the most comprehensive information on assent requirements compared to other international guidelines. An interactive map with assent requirements for different African countries is provided. The results show a major gap in national regulations for the inclusion of minors in health research. The SickleInAfrica experience in setting up a multi-country SCD registry in Africa highlights the need for developing and harmonising national and international guidelines on assent and consent requirements for research involving minors. Harmonisation of assent requirements will help facilitate collaborative research across countries. (shrink)

The vision and mission statements of 24 environmental organisations were analysed under the premise that the language used in these statements reflects and influences the priorities of their operation. A dominant perspective, hinging on the concept of 'sustainable development', merged the profile of government agencies and non-governmental groups. The language reflected an utilitarian ethics: the environment was more generally portrayed as resources than as nature. Aesthetic remarks were exceptional, even among groups focusing on wildlife. Despite a broadly claimed link between (...) human welfare and habitat viability, environmental issues were not broadly referred to by humanitarian organisations, while conservation groups comply with societal priorities and needs. Organisational statements seem more concerned about political legitimation by audiences with specific expectations than about articulating purposes with internal structural consequences or goals that advocate change or reflect organisational uniqueness. In this report we focus on the definition of autonomous weapons systems (AWS). We provide a comparative analysis of existing official definitions of AWS as provided by States and international organisations, like ICRC and NATO. The analysis highlights that the definitions draw focus on different aspects of AWS and hence lead to different approaches to address the ethical and legal problems of these weapons systems. This approach is detrimental both in terms of fostering an understanding of (...) AWS and in facilitating agreement around conditions of deployment and regulations of their use and, indeed, whether AWS are to be used at all. We draw from the comparative analysis to identify essential aspects of AWS and then offer a definition that provides a value-neutral ground to address the relevant ethical and legal problems. In particular, we identify four key aspects—autonomy; adapting capabilities of AWS; human control; and purpose of use—as the essential factors to define AWS and which are key when considering the related ethical and legal implications. The approach to analysing population ageing and its impacts on the economy has evolved in recent years. There is increasing interest in the development and use of products and services related to gerontechnology as well as other social innovations that may be considered as central parts of the "silver economy." However, the concept of silver economy is still being formed and requires detailed research. This article proposes a typology of models of the silver economy in the European Union at the (...) national and regional levels. This typology was created by comparing the Active Ageing Index to the typology of varieties and cultures of capitalism and typology of the welfare states. Comparing the degree of openness of the economy of Poland and the Netherlands, we can say the following. The Netherlands is more dependent on foreign trade than Poland. The Netherlands export quota reaches almost 50%, unlike 41,37% in Poland in 2016. However, Poland has become more import-dependent. Poland, in contrast to the Netherlands, is continuing to increase the indicators of "economic globalization". To date, the Netherlands has been pursuing more moderate foreign trade policy and trying to protect itself from external (...) risks by focusing on an internal market with high purchasing power. On the contrary, Polish politics tries to focus on the new markets for its products in order to increase the prosperity and well-being of its citizens. Poland as a country and an economic entity has made a qualitative leap in its development. The economy of this country has become more open and integrated into the world economy. (shrink)

We examine whether the current regulatory regime instituted in South Korea and the United States would have prevented Hwang’s potential transgressions in oocyte procurement for somatic cell nuclear transfer, we compare the general aspects and oversight framework of the Bioethics and Biosafety Act in South Korea and the US National Academies’ Guidelines for Human Embryonic Stem Cell Research, and apply the relevant provisions and recommendations to each transgression. We conclude that the Act would institute centralized oversight under governmental auspices (...) while the Guidelines recommend politically-independent, decentralized oversight bodies including a special review body for human embryonic stem cell research at an institutional level and that the Guidelines would have provided more vigorous protection for the women who had undergone oocyte procurement for Hwang’s research than the Act. The aim of this study is to explore the representation of Pashtuns in Pashtu classic (before 1985) and modern (after 2000) movies and what is the difference of the portrayal of these movies and Pashtun literature. In particular, this study investigated in which time frame the depiction of Pashtun is positive and similar to their academic descriptions. A mixed methods approach consisting of qualitative case study, content analysis and comparative semiotic analysis was used to examine the content (...) of the movies. In this paper we analyse how the risks associated with research on transgenic plants are regulated in Sweden. The paper outlines the way in which pilot projects in the plant sciences are overseen in Sweden, and discusses the international and national background to the current regulatory system. The historical, and hitherto unexplored, reasons for the evolution of current administrative and legislative procedures in plant science are of particular interest. Specifically, we discuss similarities and differences in the regulation of medicine (...) and plant science, and we examine the tendency towards dichotomizing risk — focusing on social/ethical risks in medicine and biological risks in plant science. This article provides a critical comparative analysis of the substantive and procedural values and ethical concepts articulated in guidelines for allocating scarce resources in the COVID-19 pandemic. We identified 21 local and national guidelines written in English, Spanish, German and French; applicable to specific and identifiable jurisdictions; and providing guidance to clinicians for decision making when allocating critical care resources during the COVID-19 pandemic. US guidelines were not included, as these had recently been reviewed elsewhere. (...) Information was extracted from each guideline on: 1) the development process; 2) the presence and nature of ethical, medical and social criteria for allocating critical care resources; and 3) the membership of and decision-making procedure of any triage committees. Results of our analysis show the majority appealed primarily to consequentialist reasoning in making allocation decisions, tempered by a largely pluralistic approach to other substantive and procedural values and ethical concepts. Medical and social criteria included medical need, co-morbidities, prognosis, age, disability and other factors, with a focus on seemingly objective medical criteria. There was little or no guidance on how to reconcile competing criteria, and little attention to internal contradictions within individual guidelines. Our analysis reveals the challenges in developing sound ethical guidance for allocating scarce medical resources, highlighting problems in operationalising ethical concepts and principles, divergence between guidelines, unresolved contradictions within the same guideline, and use of naïve objectivism in employing widely used medical criteria for allocating ICU resources. The events surrounding the ‘Arab Spring’ have attracted an enormous amount of attention by the international press as well as on social media platforms, especially in its initial phase in early 2011. This article investigates how violent and forceful actions during the ‘Arab Revolutions’ were conceptualised linguistically by incorporating notions of Cognitive Semantics in a critical comparative study of press reports and Twitter posts. Focus is placed specifically on combining Talmy’s theory of Force Dynamics with methods of Critical (...) Discourse Studies in order to investigate diverging forms of schematisation of forceful interactions among protest participants. The most frequently recurring opposing force-dynamic patterns identified are defying a hindrance, prevailing stability and causation of action as well as inaction. Notable differences may be observed between mass media and social media in regard to the representation of dynamic power relations between police and protesters. (shrink)

This paper analyses the main perceptions of capitalism and crises from a mainstream and heterodox perspective. Broadly defined within the neoclassical structure, the mainstream approaches support the idea of long-term stability of capitalism and describe crises as exogenous events. The heterodox perceptions, on the contrary, perceive crises as an internal feature of capitalism and propose to reframe the global economy within the limits of the socio-environmental systems. Despite the historical recurrence of crises, the neoclassic capitalist framework and the related mainstream (...) perceptions are still dominating the international economic debate. Most of the crises have then been addressed with reforms oriented to adjust some elements of the system without changing the overall economic structure. On the contrary, limited numbers of initiatives have been implemented to reorganise the economy according to the heterodox perspectives. Within this context, further analysis would be needed to investigate the feasibility of the proposed heterodox solutions. By discussing the main perceptions of capitalism and crises and by considering the ethical implications of the mainstream and the heterodox approaches, the present paper contributes to the existing debate around stability of capitalism and provides a starting point for analysis oriented to investigate the feasibility of alternative economic structures. This study analyzes the possible occurrence of plagiarism and self-plagiarism in a sample of articles published in the Scientific Periodicals Electronic Library, an open database that indexes business journals in Brazil. The author compared one sample obtained in 2013 and another selected from 2018. In both samples, we verified the guidelines that each of the journals provided to authors regarding plagiarism and the adoption of software to detect textual similarities. In the analysis conducted in 2013, it was found (...) that only one journal mentioned the word “plagiarism” in its policies, although the majority of the directives required guarantees that no type of violation of authors’ rights was contained in the manuscript. In the analysis conducted in 2013, it was determined that there were literal reproductions in 31 published articles, and no relevant similarities with other publications were encountered in 16 articles. In the 2018 analysis, 69 of the publications included observations and guidelines related to plagiarism and self-plagiarism. In the analysis conducted in 2018, it was found that similarities occurred in 52 articles, and no relevant evidence of plagiarism or self-plagiarism was found in 66 manuscripts. Although a reduction in the index of the occurrence of plagiarism was observed, as was an increase in the instructions on the prevention of plagiarism by authors, practices directed at guiding authors by means of directives concerning the importance of preventing plagiarism in manuscripts submitted for publication can be recommended. Judicial Deliberations compares how and why the European Court of Justice, the French Cour de cassation and the US Supreme Court offer different approaches for generating judicial accountability and control, judicial debate and deliberation, and ultimately judicial legitimacy. Examining the judicial argumentation of the United States Supreme Court and of the French Cour de cassation, the book first reorders the traditional comparative understanding of the difference between French civil law and American common law judicial decision-making. It then uses this (...) analysis to offer the first detailed comparative examination of the interpretive practice of the European Court of Justice. Lasser demonstrates that the French judicial system rests on a particularly unified institutional and ideological framework founded on explicitly republican notions of meritocracy and managerial expertise. Law-making per se may be limited to the legislature; but significant judicial normative administration is entrusted to State selected, trained, and sanctioned elites who are policed internally through hierarchical institutional structures. The American judicial system, by contrast, deploys a more participatory and democratic approach that reflects a more populist vision. Shunning the unifying, controlling, and hierarchical French structures, the American judicial system instead generates its legitimacy primarily by argumentative means. American judges engage in extensive debates that subject them to public scrutiny and control. The ECJ hovers delicately between the institutional/argumentative and republican/democratic extremes. On the one hand, the ECJ reproduces the hierarchical French discursive structure on which it was originally patterned. On the other, it transposes this structure into a transnational context of fractured political and legal assumptions. This drives the ECJ towards generating legitimacy by adopting a somewhat more transparent argumentative approach. (shrink)

This paper presents a comparative analysis of three American and three European corporate failures. The first part of the analysis is based on a theoretical framework including six areas of ethical climate; tone at the top; bubble economy and market pressure; fraudulent financial reporting; accountability, control, auditing, and governance; and management compensation. The second and third parts consider the analysis of these cases from fraud perspective and in terms of firm-specific characteristics and environmental context. The research (...) analyses shed light on the fact that, despite major differences between Europe and U.S. in terms of political institutions, laws and regulations as well as managerial practices, there are significant similarities between six groups. The analysis also demonstrates that, the ethical dilemma has been coupled with ineffective boards, inefficient corporate governance and control mechanisms, distorted incentive schemes, accounting irregularities, failure of auditors, dominant CEOs, dysfunctional management behavior and the lack of a sound ethical tone at the top. Significant similarities were also observed in the analysis from the fraud triangle perspective. However, there are several major differences between the six corporate failure cases particularly with regard to ownership structure, coverage in media, and legal, regulatory and governance frameworks. This research study may have several academic and practical contributions, particularly because of multidisciplinary, international features, and comparative analyses used in the paper. (shrink)

The rapid pace of scientific advancements has given rise to various ethical issues, emphasizing the importance of learning about bioethics at a young age. However, bioethics education often begins at the undergraduate level or beyond. Consequently, current literature assesses the perceptions of bioethical issues among university students. This pilot study assesses perceptions on relevant bioethical issues among high school students from the United States of America and Pakistan. A cross-sectional study design using an online quantitative survey was utilized to collect (...) data using non-probability convenience sampling. The questionnaire collected demographic information, and attitudes of students towards ethical issues surrounding social media use and patient rights on a 7-point Likert scale. Data was analyzed using Statistical Package for Social Sciences (SPSS) through descriptive and inferential statistics. One hundred and seventy-seven respondents returned the survey, with 75 from Pakistan. 80% of the respondents were females. While 85% of respondents believed that bioethics is an important field of study for adolescents, 86% also felt a lack in bioethics outreach and education. 69% reported having a social media account. While there was no statistically significant difference between perceptions of students from the two countries regarding ethical concerns surrounding social media, a statistically significant difference (p. This paper argues that a thorough discussion on women’s rights needs to go beyond progress in civil and political rights. Looking comparatively at Iran and Turkey, it posits that the legal and political context of secularism v. theocracy has much less of an impact than expected, and suggests that other variables offer much more compelling explanations. The paper combines feminist constructivist insights with the broader lens of world -system theory to hypothesize that the explanation for women‘s inequality in employment is (...) found at the intersection of endogenous gender constructions heavily influenced by culture and religion, and of an international economic order that contributes to the reproduction of a patriarchal structure in poorer countries, regardless of their political system. On March 11, 2020 the World Health Organization classified COVID‐19, caused by Sars‐CoV‐2, as a pandemic. Although not much was known about the new virus, the first outbreaks in China and Italy showed that potentially a large number of people worldwide could fall critically ill in a short period of time. A shortage of ventilators and intensive care resources was expected in many countries, leading to concerns about restrictions of medical care and preventable deaths. In order to be prepared for (...) this challenging situation, national triage guidance has been developed or adapted from former influenza pandemic guidelines in an increasing number of countries over the past few months. In this article, we provide a comparative analysis of triage recommendations from selected national and international professional societies, including Australia/New Zealand, Belgium, Canada, Germany, Great Britain, Italy, Pakistan, South Africa, Switzerland, the United States, and the International Society of Critical Care Medicine. We describe areas of consensus, including the importance of prognosis, patient will, transparency of the decision‐making process, and psychosocial support for staff, as well as the role of justice and benefit maximization as core principles. We then probe areas of disagreement, such as the role of survival versus outcome, long‐term versus short‐term prognosis, the use of age and comorbidities as triage criteria, priority groups and potential tiebreakers such as ‘lottery’ or ‘first come, first served’. Having explored a number of tensions in current guidance, we conclude with a suggestion for framework conditions that are clear, consistent and implementable. This analysis is intended to advance the ongoing debate regarding the fair allocation of limited resources and may be relevant for future policy‐making. (shrink)

The introduction of genomics and biobanking methodologies to the African research context has also introduced novel ways of doing science, based on values of sharing and reuse of data and samples. This shift raises ethical challenges that need to be considered when research is reviewed by ethics committees, relating for instance to broad consent, the feedback of individual genetic findings, and regulation of secondary sample access and use. Yet existing ethics guidelines and regulations in Africa do not successfully regulate (...) research based on sharing, causing confusion about what is allowed, where and when. In order to understand better the ethics regulatory landscape around genomic research and biobanking, we conducted a comprehensive analysis of existing ethics guidelines, policies and other similar sources. We sourced 30 ethics regulatory documents from 22 African countries. We used software that assists with qualitative data analysis to conduct a thematic analysis of these documents. Surprisingly considering how contentious broad consent is in Africa, we found that most countries allow the use of this consent model, with its use banned in only three of the countries we investigated. In a likely response to fears about exploitation, the export of samples outside of the continent is strictly regulated, sometimes in conjunction with regulations around international collaboration. We also found that whilst an essential and critical component of ensuring ethical best practice in genomics research relates to the governance framework that accompanies sample and data sharing, this was most sparingly covered in the guidelines. There is a need for ethics guidelines in African countries to be adapted to the changing science policy landscape, which increasingly supports principles of openness, storage, sharing and secondary use. Current guidelines are not pertinent to the ethical challenges that such a new orientation raises, and therefore fail to provide accurate guidance to ethics committees and researchers. (shrink)

The article explores the unique character of international commercial arbitration as a globalized phenomenon, where universalizing and harmonizing effects have largely been achieved by private means and spontaneous expansion, outside the States’ direct intervention and control. The evolution of arbitration in recent decades from an alternative to the core mechanism of deciding cross-border commercial controversies is considered. Privatization of this area of dispute resolution is examined in the context of its growing autonomization, marked—as observed by Emmanuel Gaillard—by notable changes (...) in its theoretical representations and narratives. This specific conceptual, institutional, and procedural framework of commercial arbitration reflects the demands of decision-making exercised in a legally, linguistically, and culturally diversified environment. Interpretation and application of law in arbitral cases requires skillful navigation between the rules of domestic, international and transnational origin, performed not only on the level of substantive norms, but also on those involving conflict of laws and procedure. As a consequence, comparative analysis plays a critical and complex role in arbitral decision-making, reaching beyond the mere demands of rendition of relevant provisions, and has been defined sensu largo as a ‘comparative mindset’, characteristic to international commercial arbitration. The article examines this phenomenon and its mechanics, challenges for legal professions and the effect of transnationalization of relevant domestic rules. The problem which is both created and tackled by this article is that although it advocates the Iranian progressive reformism as the most preferable political force in Iran, it simply does not find reformists’ own formulation of their “competitive advantage” convincing enough. Thus, to provide an argument for Iranian progressive reformism this article not only strives to explain one of the latest Iranian reformists’ mistakes through the Lacanian concept of imaginary identification as elaborated upon by Slavoj Zizek, but also to (...) illuminate precisely at formulation of what that mistake was an attempt. In doing so, it conducts a comparative analysis of the funeral processions for General Qassem Soleimani in 2020 and for Ayatollah Khomeini in 1989, and then proceeds to draw some perhaps neglected points from the moment of the Islamic revolution of 1979 as well as from the period of Khomeini’s leadership. However, far from being just a more elaborated explanation of Iranian reformism, an attempted reformulation like this of Iranian progressive reformism hopes to pave the way for creating new spaces for political act in Iran. Organising smallholder farmers into groups or co-operatives is widely promoted as a strategy to connect farmers to markets and turn them into price makers rather than price takers. This pathway usually combines co-operative organisational models, based on collective ownership and representation in internal governance, with measures to shorten the agri-food chain, shifting the ownership of intermediary sourcing, aggregating and trading functions to the group. The underlying assumption is that this improves smallholder farmers' terms of inclusion in markets. To scrutinise this (...) assumption, our study compares two examples of farmer-led auctions facilitating trading in the chilli market in Java, Indonesia. The auctions' ownership, management and performance evolved differently: one was run by a group and the other by a family. The comparison brings nuance to the prevalent emphasis on co-operative ownership structures. By researching practices central to collective trading at the chilli supplier–trader interface, this study unravels four dimensions—ownership, voice, reward and risk—capturing smallholder chilli farmers' terms of inclusion in both the auctions and the market. Our comparative analysis suggests that shared ownership and control of the trading function, a central feature of co-operative models, does not necessarily ensure favourable terms of inclusion for smallholder farmers with little capacity to take risks. The capacity to reconfigure the terms of market inclusion for vulnerable smallholder farmers involves direct payment modalities and risk taking. A collectively owned trading organisation does not necessarily imply an inclusive business concept when the organisation cannot acquire sufficient working capital to pay its suppliers. (shrink)

The article provides a comparative analysis of the final paragraphs of Diogenes Laertius' Life of Pyrrho and a chapter from the Adversus ethicos by Sextus Empiricus. The results of the analysis make plausible the hypothesis regarding a common source, partially reproduced in DL, but elaborated on and refined in Sextus. The notions of end and choice are central in both texts. The paper presents the differences between the texts regarding the former and the common internal tensions entailed by treatment of the latter. (shrink)

This article aims to compare the national legal systems that regulate biomedical research in an industrialized country (United States) and a developing country (Venezuela). A new international order is emerging in which Europe, Japan and the United States (US) are revising common guidelines and harmonizing standards. In this article, we analyze – as an example – the US system. This system is controlled by a federal agency structured to regulate research funded by the federal government uniformly, either in (...) the US or abroad. In contrast, in Venezuela, a developing country, the creation of a centralized system is a slow process. Different types of ethical committees review research projects using non-uniform criteria. Consequently, various parallel organizations that conduct biomedical research, such as universities, research institutes and private hospitals have diverse regulations operating at a local level. Thus, the most relevant difference between the Venezuelan and the US systems is the degree of standardization. In the US, the review process is performed by institutional review boards (IRBs), which have a similar organization and maintain relationships with a centralized agency, following standard regulations. Although new proposals for establishing national regulations are currently being considered in Venezuela, the success of these initiatives will depend on promoting governmental efforts to create a more structured centralized system supported by a national regulatory framework. This system will need governmental financial support at all levels. This article proposes an integrated system to regulate research with human participants in Venezuela and other developing countries. (shrink)

Although the concept of biobanking is not new, the open and evolving nature of biobanks has created profound ethical, legal, and social implications, including issues around informed consent, community engagement, secondary uses of materials over time, ownership of materials, data sharing, and privacy. Complexities also emerge because of increasing international collaborations and differing national positions. In addition, the degrees and topics of concern vary as legislative, ethical, and social frameworks differ across developed and developing countries. Implementing national laws in (...) an internationally consistent manner is also problematic. However, these concerns should not cause countries, especially developing countries, to lag behind as this novel wave of research gains momentum, particularly while several biobank initiatives are already underway in the developing world. As the law has always struggled to keep up with the fast-evolving scientific arena, this article seeks to identify the ethico-legal frameworks in place in the United Kingdom, Australia, Uganda, and South Africa, for human biobank research, in an attempt to compare and contextualize the approaches to human biobanking in specific developed and developing countries. Purpose. The study is aimed at considering self-reflection through an analysis of the features of internal dialogue in ancient texts in order to identify signs of human’s mythological and philosophical thinking. Theoretical basis of the work is the contemplation of a person’s self-reflection in the context of his internal dialogue, through which his own human existence, his subjective and creative comprehension of the world manifest. New meanings are created and shared with others in this mental space, in particular, in (...) crisis periods of personal and social life. Therefore, the ancient Egyptian vision of man’s nature, consciousnesses and dialogism of the Self is viewed through the prism of modern philosophical concepts and as the basis for the emergence of a philosophical worldview itself. Originality. The analysis from the viewpoint of the philosophical anthropology in the text "The Dispute of a Man with His Ba" showed the opportunity of considering it not only in the context of internal dialogue, but also as a confirmed internal dialogue, which expresses itself in external speech. Comparing the mythical thinking of a man in his cohesiveness with others and the philosophical thinking of a dialogical Self, the authors come to the conclusion that it is necessary to distinguish between internal dialogues with oneself and with the introjects of others, which can be either Double or Interlocutor. It has been revealed that internal dialogues in ancient times played an important role both in structuring social chaos and in overcoming personal crisis states. This is precisely from such self-reflection that philosophy emerges as a certain discourse and a new type of thinking. Conclusions. The analysis of the text "The Dispute of a Man with His Ba" speaks about the emergence of philosophical discourse in the XXII-XXI centuries BC, on the basis of which we can conclude concerning the earlier, in comparison with K. Jaspers’s definition, the transition of mankind from the cognitive revolution to a new phase of the development. (shrink)

Over the last three quarters of a century, international guidelines and regulations have undergone significant changes in how children are problematised as participants in biomedical research. While early guidelines enacted children as vulnerable subjects with diminished autonomy and in need of special protection, beginning in the early 2000s, international regulatory frameworks defined the paediatric population as vulnerable due to unaddressed public health needs. More recently, ethical recommendations have promoted the active engagement of minors as research partners. (...) In this paper, I adopt a post-structuralist approach to policy analysis to examine deep-seated assumptions and presuppositions underlying the changes in the problematisation of children as biomedical research participants over time. While biomedical research ethics focuses on the autonomy and vulnerability of minors, ethical guidelines are situated in specific sociocultural contexts, shaped, among other things, by contingent public health needs and changing conceptions of the value of research and science for society. In the process, I demonstrate the challenge of moving away from an approach that in taking adults as the model overshadows the complexity of children’s lived experiences as well as their personal, cultural, and social lives. The lack of acknowledgement of this complexity makes children vulnerable to epistemic injustice, which is particularly crucial to address in public involvement initiatives. (shrink)

BackgroundInstitutional Review Boards (IRBs) play a vital role in safeguarding the rights and interests of both research participants and researchers. However, China initiated the establishment of its own IRB system relatively late in comparison to international standards. Despite commendable progress, there is a pressing need to strengthen the organizational capacity building of Chinese IRBs. Hence, this study aims to analyze the key factors driving the enhancement of organizational capacity within these committees.MethodThe cross-sectional survey for this research was conducted from (...) July 2020 to January 2022. Following the statistical grouping based on the "2020 China Health Statistical Yearbook", a systematic investigation of IRBs in various provinces of China was carried out. In-depth interviews and questionnaire surveys were conducted with the chairpersons and administrative executives (or secretaries) of highly cooperative IRBs. Subsequently, data were collected from 107 IRBs. Qualitative Comparative Analysis (QCA) was employed as the method to analyze the factors influencing the organizational capacity of medical ethics committees and explore the diverse combinations of these factors.ResultsThrough a singular necessary condition analysis, the variable "protection of rights and interests" emerges as a critical factor contributing to the robust construction of Institutional Review Boards Institutional Review Boards (IRBs). Conversely, the variables of "lack of member ability, absence of review process, and deficiency in the supervision mechanism" collectively constitute a sufficient condition leading to weaker IRB construction. The state analysis uncovers three interpretation modes: member ability-oriented (M1), system process-oriented mode (M2), and resource system-oriented mode (M3).ConclusionsThe results of this study are effectively explicable using the "Triangular Force" model proposed for the hypothesis of IRBs' organizational capacity, which provides a solid foundation for the development of organizational capabilities in IRBs. To enhance the organizational capacity of IRBs in China, it is imperative to elevate the competence of committee members and strengthen team development. This can be achieved by establishing a comprehensive regulatory framework and refining procedural protocols. Moreover, clarifying the organizational structure and optimizing resource allocation are essential steps in bolstering the overall organizational capabilities of these committees. (shrink)

Human reproductive cloning has become the most palpable example of the globalization of science. Throughout the world, events and conjectures in the media, such as the birth and death in the United Kingdom of the cloned sheep Dolly and projects to clone human beings by Korean scientists, by members of the Canadian-based Raelian cult, and by the Italian physician Antinori in an undisclosed country, have galvanized the political will of individual countries to ban human reproductive cloning.Yet, international attempts to (...) harmonize policies in the area of biomedical ethics and human research, such as the 1997 Council of Europe’s Convention on Human Rights and Biomedicine, and most recently, the United Nations’ efforts to adopt an international convention against human reproductive cloning, have been insufficient to trigger a substantial global policy design process on issues relating to these new technologies. The current study aims to compare compliance with the COVID-19 prevention guidelines among citizens from 13 districts in Wuhan and to explore the influence of individual-level psychological factors and district-level factors on compliance. A total of 811 participants from 13 districts in Wuhan were invited to complete surveys regarding demographics, psychosocial factors and compliance with epidemic prevention guidelines. Individual-level characteristics were combined with district-level measures to create multilevel predictive models of compliance with prevention guidelines, and used the (...) Hierarchical Linear Model to analyze the data. Findings revealed that there were significant differences in the compliance of citizens from 13 districts of Wuhan. Hierarchical linear model analysis revealed that the risk factors case growth rate, COVID-19-related perceived stress, anxiety, significantly negatively predicted compliance. Hope and conscientiousness significantly positively predicted compliance with prevention guidelines, and the negative predictive effect of anxiety disappeared. Overall, we found significant differences in compliance with prevention guidelines among different districts. Risk factors at the individual level have had a negative impact on individuals’ compliance with prevention guidelines, but this impact can be mitigated by the positive role of personal protective factors such as conscientiousness and hope. The rise of liberal market economies, propagated by neoliberal free market thought, has created a vacant responsibility for public interests in the market order of society. This development has been critiqued by Catholic social teaching (CST), forcefully arguing that governments and businesses should be directed to the common good. In this debate, no attention has yet been given to the Reformational tradition and its principle of sphere sovereignty, which provides guidelines on the responsibilities of governments and companies for the (...) public interest of society. This article analyzes the differences and similarities between CST and the Reformational philosophy in their critiques of the neoliberal free market perspective of Hayek. We apply the three perspectives to the case of orphan drugs in the pharmaceutical industry and show that CST and the Reformational philosophy offer valuable insights in correction to Hayek’s views on the responsibilities of governments and companies for public health interests. This book investigates whether treaty interpretation at the ECtHR and WTO, which are sometimes perceived as promoting 'self-contained' regimes, could constitute a means for unifying international law, or, conversely, might exacerbate the fragmentation of international law. In this regard, the practice of the ICJ on treaty interpretation is used for comparison, since the ICJ has made the greatest contribution to the development and clarification of international law rules and principles. Providing a critical analysis of cases at (...) the ICJ, ECtHR and WTO, both prior to and since the adoption of the 1969 Vienna Convention on the Law of Treaties, the book reveals how the ECtHR and WTO apply the general rules of treaty interpretation in patterns which are similar to those used by the ICJ to address difficulties in interpreting the text of treaties. Viewed in the light of the ECtHR's and WTO's interpretative practices, both the VCLT's general rules of interpretation and the ICJ's interpretative practice serve to counteract the fragmentation of international law.. ABSTRACTSuicide attempt rates are on the rise in predominantly Islamic Republic of Pakistan. However, there exists an indigenous academic apathy toward exploring media-suicide relationships. This study, using content analysis and interviews, examines the lack of compliance with international ethical guidelines for suicide reporting by Pakistani newspapers. In 553 reported suicide cases, 2,355 guideline violations were detected. The overall tone of suicide news stories remained overwhelmingly irresponsible, and analysis indicates that both Urdu and English language newspapers made (...) similar violations. Largely ignorant of international standards, Pakistani journalists report attempted suicide cases just like any other crime. This study suggests a prompt action on the part of appropriate bodies to amend relevant codes of ethics and eventually educate relevant journalist fraternities to report suicides in a socially responsible way. Purpose As Big Data and Artificial Intelligence (AI) proliferate, calls have emerged for ethical reflection. Ethics guidelines have played a central role in this respect. While quantitative research on the ethics guidelines of AI/Big Data has been undertaken, there has been a dearth of systematic qualitative analyses of these documents. Design/methodology/approach Aiming to address this research gap, this paper analyses 70 international ethics guidelines documents from academia, NGOs and the corporate realm, published between 2017 and 2020. Findings The article presents four key findings: existing ethics guidelines (1) promote a broad spectrum of values; (2) focus principally on AI, followed by (Big) Data and algorithms; (3) do not adequately define the term “ethics” and related terms; and (4) have most frequent recourse to the values of “transparency,” “privacy,” and “security.” Based on these findings, the article argues that the guidelines corpus exhibits discernible utilitarian tendencies; guidelines would benefit from greater reflexivity with respect to their ethical framework; and virtue ethical approaches have a valuable contribution to make to the process of guidelines development. Originality/value The paper provides qualitative insights into the ethical discourse surrounding AI guidelines, as well as a concise overview of different types of operative translations of theoretical ethical concepts vis-à-vis the sphere of AI. These may prove beneficial for (applied) ethicists, developers and regulators who understand these guidelines as policy. (shrink)

In this paper, we examine the ethico-legal issue of P2P file sharing and copyright infringement in two different countries - Japan and Sweden - to explore the differences in attitude and behaviour towards file sharing from a socio-cultural perspective. We adopt a comparative case study approach focusing on one Japanese case, the Winny case, and a Swedish case, the Pirate Bay case. Whereas similarities in attitudes and behaviour towards file sharing using P2P software between the two countries are found (...) in this study, the Swedish debate on file sharing has been coloured by an ideological and political dimension, which is absent in the Japanese context. This might indicate that Swedes have been more interested in issues of right and wrong, and the creation of political subject of piracy, while the Japanese are more interested in their own individual well being. In this article we explore the influences upon the proportion of women on a country’s corporate boards. Using a conceptual framework that builds uponnational business systems theory, we investigate the extent to which national economic, cultural, political and social institutions explain cross-country variationin the gender composition of corporate elites. In the context of a sample drawn from over 40 countries, our empirical analysis shows that such institutionscollectively explain approximately two-thirds of the variance between countries in the percentage of women (...) on their corporate boards. Specifically, our findingsshow that economic and cultural factors play a particularly important role in shaping the gender balance of boards in comparison to political and social factors. (shrink)

This paper addresses two main issues. First, it develops a systematic mechanism to examine corporate social orientation by contextualizing the researcharound the 2007 global financial crisis and second, it applies this mechanism to compare the CSOs across the U.S., Germany and India. Using a 7-code index of CSO on a sample of financial companies across the three countries, this paper captures the dissolution of loose couplings between corporate private intentions and corporate public pretentions thereby exposing the de-facto CSOs. This study investigates the relationship among ethical philosophy, thinking style, and managerial ethical decision-making. Based on the premise that business ethics is a function of culture and time, we attempt to explore two important questions as to whether the national differences in managerial ethical philosophies remain over time and whether the relationship between thinking style and ethical decision-making is consistent across different national contexts. We conducted a survey on Korean managers’ ethical decision-making and thinking style and made a cross-cultural, cross-temporal (...) comparison with the results presented by previous studies that surveyed Korean and US managers with the same questionnaire at different points in time. Our analysis revealed that Korean managers have become more reliant on rule utilitarianism for ethical decision-making over the last two decades, which is dominantly used by US managers, corroborating our convergence hypothesis built on social contracts theory. However, as opposed to previous research, we found that managers with a balanced linear and nonlinear thinking style do not necessarily make more ethical decisions compared to those with a predominantly linear or nonlinear thinking style. This study contributes to international business ethics literature by presenting a theoretical framework that may explain the convergence of ethical philosophies employed by managers in different national contexts over time, and that the relationship between thinking style and managerial ethical decision-making may not be universal, but contingent on contextual factors.
