Normative political philosophy always refers to a standard against which a society's institutions are judged. In the first, analytical part of the article, the different possible forms of normative criticism are examined according to whether the standards it appeals to are external or internal to the society in question. In the tradition of Socrates and Hegel, it is argued that reconstructing the kind of norms that are implicit in practices enables a critique that does not force the critic's (...) particular views on the addressee and can also be motivationally effective. In the second part of the article, Axel Honneth's theory of recognition is examined as a form of such reconstructive internal critique . It is argued that while the implicit norms of recognition made explicit in Honneth's philosophical anthropology help explain progressive social struggles as moral ones, his theory faces two challenges in justifying internal critique. The Priority Challenge asks for the reasons why the implicit norms of recognition should be taken as the standard against which other implicit and explicit norms are to be judged. The Application Challenge asks why a social group should, by its own lights, extend equal recognition to all its members and even non-members. The kind of functional, prudential, conceptual, and moral considerations that could serve to answer these challenges are sketched. (shrink)

This article reconstructs Hegel’s chapter “Sense Certainty” (Phenomenology of Spirit, chap. 1) in detail in its historical and philosophical context. Hegel’s chapter develops a sound internal critique of naive realism that shows that sensation is necessary but not sufficient for knowledge of sensed particulars. Cognitive reference to particulars also requires using a priori conceptions of space, spaces, time, times, self, and individuation. Several standard objections to and misinterpretations of Hegel’s chapter are rebutted. The later Rawls attempts to offer a non-comprehensive, but nonetheless moral justification in political philosophy. Many critics of political liberalism doubt that this is successful, but Rawlsians often complain that such criticisms rely on the unwarranted assumption that one cannot offer a moral justification other than by taking a philosophically comprehensive route. In this article, I internally criticize the justification strategy employed by the later Rawls. I show that he cannot offer us good grounds for the rational hope that citizens (...) will assign political values priority over non-political values in cases of conflict about political matters. I also suggest an alternative approach to justification in political philosophy (that is, a weak realist, Williams-inspired account) that better respects the later Rawls’s concern with non-comprehensiveness and pluralism than either his own view or more comprehensive approaches. Thus, if we take reasonable pluralism seriously, then we should adopt what Shklar aptly called ‘liberalism of fear’. (shrink)

The ‘cultural turn’ in social thought, and the rise of interpretive modes of social analysis, have raised the issue of how social criticism can legitimately be undertaken given the central role of actors’ understandings in constituting social reality. In this article I examine this issue by exploring debates around Winch’s interpretive approach. I suggest that Winch’s arguments usefully identify problems with external criticism, that is, criticism that attempts to contrast actors’ beliefs with the social world as it really is. However, (...) I also argue that Winch’s Wittgensteinian account of rule-following, on a plausible interpretation, places excessively strong restrictions on the possibility of internal criticism. In order to show the problems with such restrictions, I critically appraise two accounts of social criticism that are compatible with Winch’s arguments, those of Pleasants and Giddens, arguing that neither offers a satisfactory analysis. I then argue that if a viable notion of internal criticism is to be established Winch’s account of rule-following needs to be rejected. Having briefly offered an alternative, I suggest that it allows a more convincing conception of internal criticism, in which the understandings of actors can be criticized on the basis of their internal contradictions. The article then attempts to meet a possible objection to this position: that the logical judgements of contradiction and coherence required for immanent critique are not cross-culturally valid. I claim that such judgements are generally valid, and develop an argument for this position based on a critique of Lukes’s arguments. (shrink)

A private property account is central to a liberal theory of justice. Much of the appeal of the Lockean theory stems from its account of the so-called `enough-and-as-good' proviso, a principle which aims to specify each employable person's fair share of the earth's material resources. I argue that to date Lockeans have failed to show how the proviso can be applied without thereby undermining a guiding intuition in Lockean theory. This guiding intuition is that by interacting in accordance with the (...) proviso persons interact as free and equal, or as reciprocally subject to the `laws of nature' rather than as subject to one another's arbitrary will. Because Locke's own and contemporary Lockean conceptions of the proviso subject some persons to some other persons' arbitrary will, the proviso so conceived cannot function as it should, namely as a principle that restricts interacting persons' actions reciprocally and thereby enables Lockean freedom under law. What conditions the possibility of existentially valuable experience? Against nihilism, the threat that philosophical cognition undermines the very idea of purposiveness, German idealism posits that we are unconditionally conditioned by life, construed as the infinite purposive activity of reason. I reconstruct Schelling’s critique of this project as defending the idea that death conditions or puts into question our rational activity. Scholars tend to read the idealists as rejecting Kant’s idea of an unknowable thing in itself by grounding philosophy on (...) a knowable first principle and tend to situate Schelling as a phase between or a late attack on Fichte and Hegel. Part I gives a systematic account missing on the former, arguing that idealism is an instance of immortalism, which holds that life is the unconditioned condition of rational activity, while death is unconditionally conditioned. Part II gives a historical account missing on the latter, arguing that Schelling is an early and continual critic of idealism on behalf of mortalism, which holds that death unconditionally conditions rational activity. My first argument modifies typical readings of German idealism, revealing a deep connection between its rejection Kant’s idea and its refusal to let death put us into question. My second complicates typical readings of Schelling, casting his mortalism as rehabilitating the idea that something radically outstrips rational activity while representing a regulative ideal. Although Schelling’s mortalism anticipates Heidegger’s, they differ: Schelling aligns death with the goal of systematic knowing, Heidegger with taking over one’s history as care. But Schelling overcomes immortalism, enabling Heidegger’s idea of death. Part III shows this idea is structurally analogous to Kant’s idea of the thing in itself. Immortalism’s failure leaves unsolved two antinomies I argue are formally identical and only solvable by thinking these ideas as boundary concepts the thought of which is necessary for the unity, respectively, of finite being and finite understanding. By reconstructing the role of death in Schelling’s internal critique of German idealism, then, my thesis also brings into closer contact Kant’s transcendental and Heidegger’s existential projects. _Grounds of Pragmatic Realism_ shows Hegel is a major epistemologist, who disentangled Kant’s critique of judgment, across the Critical corpus, from transcendental idealism, and augmented its enormous evaluative and justificatory significance for commonsense knowledge, the natural sciences and freedom of action.

Thomas Piketty’s evidence on wealth distribution trends in Capital in the Twenty- First Century shows that – contra his own interpretation – there has been little rise in wealth inequality in Europe and America since the 1970s. This article relates that finding to the other principal trends in Piketty’s analysis: the capital/national income ratio trend, the capital-labor split of total incomes and the income inequality trend. Given that wealth inequality is not rising markedly, what can we deduce about the putative (...) causes that might be operating upstream? Only the capital-labor split looks like a plausible explanation of the wealth inequality trend. (shrink)

Victoria S. Harrison’s theory of internal pluralism approaches religious beliefs in terms of conceptual schemes. To her, this approach has the advantage of preserving core pluralist intuitions without being challenged by the usual difficulties. My claim is that this is not the case. After providing a succinct presentation of internal pluralism, I show that the critique of traditional pluralist views such as Hick’s may also be addressed to Harrison. There are two main reasons in support of my (...) claim. Firstly, a believer’s common understanding of religious experiences conflicts with the way in which internal pluralism understands religious belief. Such conflict implies that if internal pluralism were a sound theory, most religious beliefs would turn out to be false, and, contrary to Harrison’s intention, they would be rendered cognitively irrelevant. Secondly, internal pluralism excludes the possibility of religious disagreements. By applying to religions an epistemological approach based on conceptual schemes, doxastic dissent is actually dismantled at the cost of developing an entirely solipsistic reading of religious beliefs. In the final section of my paper, I will show that such unattractive features are consequences of the notion of conceptual scheme. (shrink)

Hiring international migrant eldercare workers to work hard for little pay simply because this traveling workforce needs wages higher than those they would receive back home seems somehow “wrong.” The standard justification for hiring migrants seems more like an excuse than a justification. My purpose in this article, however, is not to condemn people who hire international migrant eldercare workers, but to suggest that these employers as well as their employees are caught in the same moral bind. Depending on how (...) uncaring a state is about meeting its people’s fundamental needs including adequate long-term care, it will create a hostile environment for the development of caring people. But a society without a sufficient number of caring people risks unraveling. People who avoid care work and who shun the practice of care are, in my estimation, “marginal” to society in that they are not contributing to the foundation that makes society possible. (shrink)

Across the globe, radical conservative political forces and ideas are influencing and even transforming the landscape of international politics. Yet IR is remarkably ill-equipped to understand and engage these new challenges. Unlike political theory or domestic political analyses, conservatism has no distinctive place in the fields’ defining alternatives of realism, liberalism, Marxism, and constructivism. This paper seeks to provide a point of entry for such engagement by bringing together what may seem the most unlikely of partners: critical theory and the (...) New Right. Important parts of today’s New Right represent self-conscious appropriations of Critical themes and thinkers—turning them to self-declared “reactionary” ends. Developing outside the confines of the academy, these forms of thought have woven insights from across Critical theory into new and mobilizing forms of conservative ideology, seeking to link that ideology to social forces that play increasingly active roles in global politics. Our intention here is not to somehow blame Critical perspectives for the ideas of the New Right, either directly or by association. Rather, we seek to show how an engagement with Critical theory helps us understand the New Right, while also demonstrating some of the direct challenges the New Right poses for critical perspectives. The distinction between internalism and externalism can be interpreted in different ways, which must be kept clearly distinct. The distinction between internal and external reasons for action, proposed by Bernard Williams , can be interpreted as expressing a form of internalism. If we assume that internalism seems preferable to externalism and Williams’s "internal reason theorist" as an internalist, we have an example of an anti-rationalistic form of internalism. I will suggest that Williams’s arguments do not justify his distinction (...) and the consequences he draws, basically because of the unjustified exclusion of rational elements from the "subjective motivational set". Moreover, Williams’s position seems exposed to a subjectivistic outcome which he himself probably would wish to avoid. Therefore, I argue that the distinction between internal and external reasons should be abandoned. Some considerations in favour of a rationalistic interpretation of internalism and of the normativity of moral reasons are then suggested. (shrink)

It asks; should international law seek to promote democratic political arrangements? If so, on what basis, and using which of the many competing conceptions of democracy?

The interpretive strategy of this article is to identify the joint stock company as an independent unit of analysis in Adam Smith's theory of international political economy. Such companies, in Smith's view, had corrupted and captured many European and non-European governments and undermined their societies' ability to engage in peaceful transnational affairs and equitable self-rule. In contrast with Smith's well-known concerns about the rise of commerce in modern Europe in his four-stage account of social development-- which were outweighed, in his (...) view, by the many material benefits and personal liberties brought about by the eclipse of feudalism--his narrative of globalization offers a trenchantly critical appraisal of commercial practices that ultimately undermine many of the gains that the initial rise of modern commerce once made possible. Even in his rare moments of optimism about the future of global relations, Smith remained deeply ambivalent about globalization. (shrink)

Modern jurisprudence has typically been presented as a debate between legal positivism and natural law. Though the demise of legal positivism has been touted despite its pre-eminence in past decades, it is clear that there remains a vigorous debate surrounding this theory. It is noteworthy that Hans J. Morgenthau’s legal thought and critique of legal positivism have remained unexplored in the context of this debate. Largely forgotten, his legal thought answers questions that lie at the heart of the natural (...) law and legal positivist debate. It showcases his deeply nuanced understanding of legal and political theory and contains a powerful and insightful commentary on the fundamental problems faced by international law. Building on existing literature, this paper unearths Morgenthau’s critique of legal positivism. It does this by re-examining his works, which address the question of whether moral considerations are relevant to determining the content of the law in force. It brings his legal thought to light, which highlights the artificiality of the division between law and morality and offers a nuanced analysis of problems inherent in international law. Ultimately, the paper challenges the claim that the law can be determined without resorting to moral judgement and shows how Morgenthau’s insights remain relevant to legal positivism and natural law debates today. In this chapter, my main aim is to explore some of the central moral critiques of international financial institutions as well as proposals to overcome the moral problems that they face.

Je rejette les théories analytiques récentes qui assimilent l'expérience de la douleur à une forme de perception externe, à savoir la perception d'un dommage physique relatif au corps du sujet. Mais je ne souscris pas pour autant à la thèse phénoménologique selon laquelle il y a un 'espace douloureux', (...) et plus généralement un espace corporel, distinct de l'espace de la perception externe. Selon moi, la différence entre la conscience 'à l'extérieur' et la conscience 'de l'intérieur' ne réside ni dans la forme de la perception, ni dans la nature de l'espace perçu, mais dans l'objet intentionnel lui-même, indépendant de l'expérience dans le premier cas, mais dépendant de celle-ci dans le second. This working paper examines the notion of "immanent critique", a central methodological commitment of critical theories of society. In the first part, I distinguish immanent critique - a critique which reconstructs norms immanent in a social practice which point beyond the normative self-understanding of its members - from both external and internal critique and examine three questions that a theory of immanent critique has to answer (a social ontological, an epistemological and a justificatory question). (...) After surveying some of the classic accounts of immanent critique in part two, I then distinguish two varieties of immanent critique, a hermeneutic and a practice-theoretic approach. Drawing on theories in recent analytic philosophy, I finally argue for a practice-theoretic approach to immanent critique that locates the relevant norms in a practice constituted by mutual recognition. Rorty was one of the great dissolvers of dualisms, but strangely this iconoclasm ended when it came to liberal democracy. Here he held fast to the most stubborn of dualisms in political thought, a simple dichotomy of the public and the private, and used it, unsuccessfully, to resolve questions concerning the place of religion in modern democratic politics. Yet the philosophical basis of Rorty's pragmatism both undercuts two common ways of spelling out the relationship between religion and the polity in (...) liberalism and makes his use of the public/private dichotomy impossible. For many liberals, the question "Do others live rightly?" feels inappropriate. Liberalism seems to demand a follow-up question: "Who am I to judge?" Peaceful coexistence, in this view, is predicated on restraint from morally evaluating our peers. But Rahel Jaeggi sees the situation differently. Criticizing is not only valid but also useful, she argues. Moral judgment is no error; the error lies in how we go about judging. One way to judge is external, based on universal standards derived from ideas (...) about God or human nature. The other is internal, relying on standards peculiar to a given society. Both approaches have serious flaws and detractors. In On the Critique of Forms of Life, Jaeggi offers a third way, which she calls "immanent" critique. Inspired by Hegelian social philosophy and engaged with Anglo-American theorists such as John Dewey, Michael Walzer, and Alasdair MacIntyre, immanent critique begins with the recognition that ways of life are inherently normative because they assert their own goodness and rightness. They also have a consistent purpose: to solve basic social problems and advance social goods, most of which are common across cultures. Jaeggi argues that we can judge the validity of a society's moral claims by evaluating how well the society adapts to crisis--whether it is able to overcome contradictions that arise from within and continue to fulfill its purpose.
