American liberals believe that both civil liberties and civil rights are harmonious aspects of a basic commitment to human rights. But recently these two clusters of values have seemed increasingly to conflict – as, for example, with the feminist claim that the legal toleration of pornography, long a goal sought by civil libertarians, actually violates civil rights as a form of sex discrimination.Here I propose an interpretation of the conflict of civil rights and civil liberties in its latest manifestation: the (...) controversy over how to treat discriminatory verbal harassment on American campuses. I was involved with the controversy in a practical way at Stanford, where I helped draft a harassment regulation that was recently adopted by the university.Like the pornography issue, the harassment problem illustrates the element of paradox in the conflict of civil-liberties and civil-rights perspectives or mentalities. This problem does not simply trigger familiar disagreements between liberals of a classical or libertarian orientation as against those of a welfare state or social democratic one – though it does sometimes do that. In my experience, the issue also has the power to appear to a single person in different shapes and suggest different solutions as it oscillates between being framed in civil-liberties and in civil-rights terms. At the same time, however, it remains recognizably the same problem. It is thus a very practical and political example of the kind of tension noted by Wittgenstein in the aphorism that heads this essay – a puzzle of interpretive framing, of “seeing-as.”. (shrink)

This essay applies the principle of justice as fairness to the issue of same-sex marriage. I will outline Rawls’s theory of justice, including the original position and the veil of ignorance as the means by which choosers craft a just state. In considering whether same-sex marriage should be permissible, I argue that a just society, formulated in the Rawlsian context of justice as fairness, should allow them. I assert that gays and lesbians do count as equal citizens because they possess (...) the minimum requirements of the capacity for a sense of justice, a conception of the good, and the ability to be cooperating members of society. Furthermore, within the original position gays and lesbians will be represented because choosers do not know their sexual orientation because it is one of the individual characteristics that are withheld behind the veil. Since the choosers do not know their sexual orientation, they will be unable to use that information in their construction of what counts as a just state comprised of free and equal citizens. Because the family, and the institution of marriage as a primary manifestation of the family, is one of the major social institutions within the basic structure, limitations must be carefully scrutinized. This article explores the role of changing memes in large systems change toward marriage equality—popularly referred to as same-sex marriage—in the United States. Using an abbreviated case history of the transformation, the article particularly explores the shifting memes or core units of culture, in this case, word phrases associated with marriage equality over time, influencing the social change process. This book brings C.G. Jung into conversation with the French philosopher Emmanuel Levinas, taking a radical view of post-modernist theory which, the author argues, is relentlessly introverted. Frances Gray presents completely new research which extends analytical psychology into the world of dispute resolution in mediation within a deeply philosophical framework. Arguing that mediation is a therapeutics that entails a psycho-social archaeology which, in turn, requires recognition of the foundational roles of sex/gender, time and narrative in inter-subjective relationships, this book (...) develops Jung’s approach to projection as an ethical process that assumes the presence of a sex/gendered Other. Chapters explore the possibility of a psycho-social archaeology through development of the argument that a radical turn to the fundamentals of our own consciousnesses can open up a landscape on which we begin to fashion the moral courage necessary for the practice of alternative dispute resolution in mediation. This book highlights Jung’s contention that withdrawal of projection is a fundamentally moral endeavour and that although Levinas’ face of the Other can be seen as a way of acknowledging the Otherness of the Other, there are limits to its application in Jungian thinking. This book maintains that the face of the Other is critical to any moral encounter and, above all, brings us to the transformational possibilities of the process of dispute resolution in mediation. Anatomy texts are seen as authoritative sources for knowledge about natural sex differences. The concepts of a natural, biological sex and of a natural difference are, however, increasingly difficult to sustain. A growing number of scholars have pointed to the fact that `sex' as much as `gender' is a historical and social construction. This article examines how the multiple-edition anatomy textbook, Gray's Anatomy, has portrayed the sexed body and male/female differences during the course of its publication, 1858 to the (...) present, focusing on specific parts of the anatomy, namely the sex organs or `organs of generation', the pelvis, the skull and the brain. An analysis of textual descriptions and graphic illustrations reveals that the male body has been the stable norm or standard against which the female body has been compared and implicitly judged as underdeveloped, weak or faulty. Only rarely has the male body been compared with the female body. Reflecting long-standing views about sexual complementarity and natural differences between men and women, some comparisons emphasize the reproductive functioning of females or imply that females are intellectually inferior. It would appear that the discipline of anatomy has remained largely immune from broader public debates about sexual inequality and gender representations. (shrink)

It is widely accepted that consent is a normative power. For instance, consent can make an impermissible act permissible. In the words of Heidi Hurd, it “turns a trespass into a dinner party... an invasion of privacy into an intimate moment.” In this chapter, I argue against the assumption that consent has such robust powers for moral transformation. In particular, I argue that there is a wide range of sex that harms or wrongs victims despite being consensual. Moreover, these cases (...) are not limited to those where con- sent is vitiated by background conditions. I start by calling this category of consensual sex Bad Sex. I then distinguish subspecies of this category, including psychological pressure, social coercion, and epistemically unsafe sex. I end by responding to an objection on which we should treat at least some subspecies of Bad Sex as rape. Though this alternative proposal is often motivated by ameliorative and strategic considerations, I argue that such considerations actually count against collapsing the categories of Bad Sex and rape. This article returns to a philosophical conundrum that has troubled feminist theory since the topic of sexual violence has been taken seriously, what I call the problem of the “heteronormative sexual continuum”: how sexual assault and hegemonic heterosex are conceptually and politically related. I continue my response to the work of Nicola Gavey, who has argued for the existence of a “gray area” of sexual interactions that are ethically questionable without rising to the category of sexual assault, but whose (...) analysis did not explicitly articulate what these two categories share or what distinguishes them from each other. After summarizing Gavey's position, I summarize my previous articulation of the common ground between instances of sexual assault and examples of sexual interactions in the “gray area.” I then develop a theoretical account of how the two categories differ, arguing that the victim's agency plays different roles in the two types of interactions. Both the fact of that distinction—that we are capable of providing a philosophical account of the difference between sexual interactions that fall into the gray area and those that constitute sexual assault—and its particular content are crucial for the development of a tenable feminist sexual ethics. Two decades of literature and discussion on the topic of therapist-client sexual relationships have revealed much about the nature and consequences of these relationships and have produced an explicit prohibition against such relationships in American Psychological Association (APA) Ethical Principle 6a. This article reviews the literature as it relates to the ethically gray area of sex with former clients. The relative lack of an empirical basis for extending the prohibition of Principle 6a to posttermination relationships is noted. AimTo examine the association of body mass index (BMI) [kg/m2] and its classifications (underweight [BMI < 18.5], normal [18.5 ≤ BMI < 25], overweight [25 ≤ BMI < 30], and obese [BMI ≥ 30]) with brain structure in individuals with a wide range of BMI group.Materials and methodsThe participants included 382 right-handed individuals (mean age: 46.9 ± 14.3 years, 142 men and 240 women). The intelligence quotient was assessed using the Japanese Adult Reading Test. Voxel-based morphometry (VBM) and diffusion tensor (...) imaging (DTI) were performed to analyze the association of BMI and its classifications with gray and white matter structures, respectively.ResultsAccording to VBM, BMI was significantly and negatively correlated with the bilateral cerebellum exterior volumes. In group comparisons, the right cerebellum exterior volume was significantly lower in the overweight or obese group than in the underweight or normal group, while the bilateral cuneus and calcarine cortex, left cuneus, and left precuneus volume was significantly lower in the underweight group than in the non-underweight group. Sex-related stratification analyses for VBM revealed that BMI was significantly and negatively correlated with the bilateral cerebellum exterior volumes only in women. In group comparisons, the left cerebellum exterior volume was significantly lower in obese women than in non-obese women. The left thalamus proper and the right cerebellum exterior volumes were significantly lower in overweight or obese group than in underweight or normal group in men and women, respectively. The bilateral cuneus and calcarine cortex, left cuneus and carcarine cortex, and bilateral cuneus volume was significantly lower in underweight men than in non-underweight men. In contrast, there were no notable findings on DTI.ConclusionOur results suggest association of continuous BMI, being overweight or obese, and being underweight with decreased gray matter volume in individuals with a wide range of BMI group. Furthermore, sex-related differences are seen in the association of BMI and its classifications with regional gray matter volume reductions. Abnormally high or low BMIs may have a negative influence on regional gray matter volumes. (shrink)

In my dissertation, I explore how emotions operate under conditions of injustice. Specifically, my interest is in how one should deploy their emotions in order to combat patriarchally informed, affective ways of making sense of and responding to the social world. My dissertation consists of the following three papers. In the first paper, “Vindictive Anger,” I argue for two claims. First, that anger is not necessarily made morally worse whenever and to the extent that it involves a desire for payback. (...) Second, that in certain cases, anger’s retributive component is precisely what moralizes the emotion. Victims of sexual violence, I argue, paradigmatically deploy their anger as a way of getting their transgressor or, in some cases, the broader moral community, to more fully understand, through affect, the wrongness of their action. One can see this occur in the anger expressed by Chanel Miller in her victim’s impact statement, read aloud during the case of People v. Turner. When anger functions in this way, I propose, it serves to moralize the emotion. In the second paper, titled “Feminism and Suspect Femininity,” I ask how feminists should feel towards women who conform to suspect norms of appearance, and of hyper-femininity in particular. I present a novel type of empathy – proleptic empathy – which avoids treating women as either pitiful victims or as accomplices deserving of harsh moral criticism. Proleptic empathy requires switching back and forth between two types of imaginings: on the one hand, simulating what it is like to be in the woman’s shoes on the assumption that her suspect behavior stems from her will. On the other, simulating what it is like to be in the woman’s shoes on the assumption that her suspect behavior stems from external cultural influences. In the third paper, “Transitional Moral Contexts,” I address how one should feel towards the perpetrators who figure in the cases that have gone by the language of ‘grey rape’ or ‘bad sex’. These cases are ones that are rife with disagreement, especially amongst members of the moral community, who even disagree over whether they ought to count as cases of ‘sexual assault’ or ‘rape’. My suggestion is that the reason we have such difficulty adjudicating individuals’ responsibility for cases of bad sex is because these are instances of transitional moral contexts where what it is to act morally is in the process of being actively negotiated by the moral community. With this analysis in place, I present reasons for and against deploying shame against those who falter in these cases. (shrink)

There is a belief that exercise has a major role to play in the current health and wellbeing agendas. Consequently, health interventions are implemented based upon the recommendations of the ACSM and similar exercise research organizations. However this development has been challenged through both social and political perspectives. Specifically accusations of medicalization have been raised against the increasing relationship between the exercise and medical domains. The purpose of this article is to present a similar critique of the growing emergence of (...) a medical paradigm within the exercise domain. In this instance the focus will examine the relationship between exercise professional, exercise science and the proposed medical paradigm. Through the use of philosophical essay and systematic review of literature, it is argued that a continuing shift by exercise science to mirror the medical paradigm will cause a number of issues and potential hazards in the working practices of its professionals. We suggest that the configuration of moral emotions is special—a configuration given by the underlying structure of morality. Research suggests that people divide the moral world along the two dimensions of valence (help/harm) and moral type (agent/patient). The intersection of these two dimensions gives four moral exemplars—heroes, villains, victims and beneficiaries—each (...) of which elicits unique emotions. For example, victims (harm/patient) elicit sympathy and sadness. Recent studies have used methods designed to obtain a precise quantitative assessment of sexual aggression, but these are based on the presumption of a normative psychological understanding of what the questionnaire items mean to respondents. This article takes a novel approach that is appropriate for analysing the ‘grey zone’ between wanted and unwanted sex as the key to obtaining a deeper understanding of the data on sexual violence. Stenner and Clinch (2013) developed the concept of “liminal hotspots”, which refer to (...) liminal situations in which a rite of passage occurs from one recognised ‘structure’ to another. The article draws on in-depth interviews to examine the optimal and pessimal sexual encounters and contexts participants encounter in their sex lives. The main research question concerns how the boundary between wanted and unwanted sex is constructed. One important finding is that the concept of liminal hotspots can be used effectively to investigate the boundary between wanted and unwanted sex. (shrink)

Ryan Johnson and Biko Mandela Gray study the relationship between Hegel's Phenomenology of Spirit and Black Thought from Frederick Douglass to Angela Davis. This staging of an elongated dialectical parallelism between Hegel's classic text and major 19th-20th-century Black thinkers explodes the western canon of philosophy. Johnson and Mandela Gray show that Hegel's abstract dialectic is transformed and critiqued when put into conversation with the lived dialectics of Black Thought: from Frederick Douglass and Harriet Jacobs through to Malcolm X (...) and Angela Davis. While Hegel articulates the dynamic logics that we see in these Black thinkers, when they are placed in parallel and considered together, the whiteness, both explicit and implicit, of Hegelianism itself is revealed. Participants compared the mental capacities of various human and nonhuman characters via online surveys. Factor analysis revealed two dimensions of mind perception, Experience and Agency. The dimensions predicted different moral judgments but were both related to valuing of mind.

On the ethics of extending human life: healthy people have a right to carry on livingHumanity has long demonstrated a paradoxical ambivalence concerning the extension of a healthy human lifespan. Modest health extension has been universally sought, whereas extreme health extension has been regarded as a snare and delusion—a dream beyond all others at first blush, but actually something we are better off without. The prevailing pace of biotechnological progress is bringing ever closer the day when humanity will be able (...) to act on the latter view by rejecting a clear and present opportunity for much longer healthy lives. Indeed, some biogerontologists contend that that day has already arrived, to the extent that our hesitation in embarking on a vigorous “war on ageing” is already delaying the point at which a cure for ageing will be developed. Here I consider whether our present caution concerning the wisdom of truly curing ageing is likely to survive the increased scrutiny that it will receive in coming years as a result of these technical advances. I conclude that it will not, because of its irreconcilability with values that are more deeply held by the large majority of humanity than any values that argue against the quest for a cure. I further conclude that all the major current reasons given for not curing ageing are mere crutches to help us cope with the immutability of ageing that we have been brought up to accept. Our failure to set aside such irrationality is already shortening potential longevity—quite probably of those already alive today—to a staggering degree. Also, how important is a vote that is between only two viable and equally unsavory options? by looking at how the power to vote has been extended in the United States over the past 200 years. “Deep Thoughts” and “Fuzzy Memories” were fan favorites as transitional pieces between larger set pieces on Saturday Night Live in the 1990s. Delivered over soothing music and serene images, Jack Handey's bits never showed his face on screen, calling to mind his observation that “the face of a child can say it all, especially the mouth part of the face.” Some dark and offbeat takes on the human condition often have an existentialist feel. Existentialism is a philosophy concerned with “the (...) individual, the experience of choice, and the absence of rational understanding of the universe with a consequent dread or sense of absurdity in human life.” In other words, human beings find themselves trying to live meaningful lives without truly comprehending the nature of what that meaning may be, or whether or not true meaning could even exist. ABSTRACT For some years now, the history of modern mathematics and the history of modern science have developed independently. A step toward a reunification that would benefit both disciplines could come about through a revived appreciation of mathematical practice. Detailed studies of what mathematicians actually do, whether local or broadly based, have often led in recent work to examinations of the social, cultural, and national contexts, and more can be done. Another recent approach toward a historical understanding of the abstractness (...) of modern mathematics has been to see it as a species of modernism, and this thesis will be tested by the raft of works on the history of modern applied mathematics currently under way. This volume is the product of an important recent conference, convened by His Holiness the Dalai Lama, focusing on the intellectual legacy of the Tibetan philosopher, yogi, and saint Tsongkhapa (1357-1419). Entitled "Jé Tsongkhapa: Life, Thought, and Legacy," the conference commemorated the sixth hundredth anniversary of Tsongkhapa's passing and was held on December 21-23, 2019, at Ganden Monastery in Mundgod, India. Part 1 concerns Madhyamaka, a natural reflection of the very important and well-known contributions Tsongkhapa made to the study of (...) Indian philosophical thought. The first essay, Guy Newland's "Start Making Sense: Finding Tsongkhapa's Middle Way," provides a straightforward and clear introduction to Tsongkhapa's interpretation of Madhyamaka philosophy, showing how Tsongkhapa played an essential role in clarifying Candrakīrti's contributions to Madhyamaka thought. The second essay, "Celebrating Jé Tsongkhapa: The Twofold Object of the Identity View" by Dr. Dechen Rochard explores Tsongkhapa's understanding of Candrakīrti's negation of individual identity. The essay neatly demonstrates the centrality of the practitioner's view of self to the path to spiritual awakening. In the third chapter, "Thinking Beyond Thought: Tsongkhapa and Mipham on the Conceptualized Ultimate," Jay L. Garfield explores Tsongkhapa's views on the nature of ultimate reality, specifically Tsongkhapa's argument that this entails a movement from inferential to direct awareness of emptiness. The essay explores the need for accurate philosophical analysis in the context of meditation practice so as to directly realize the truths about the nature of self and reality that are the objects of the practice. It thus nicely points to the integration of Buddhist theory and practice. The second section of this volume is dedicated to Tsongkhapa's writings on the tantras. In the first chapter in this section, "Tsongkhapa's Masterful Exegesis of Cakrasaṃvara Tantra," I elucidate Tsongkhapa's approach to the study of tantric literature with a focus on his commentary on the Cakrasaṃvara Tantra. Chapter 6 is Gavin Kilty's contribution, "A Lamp to Illuminate the Five Stages: Tsongkhapa's Reformatory Work on Guhyasamāja Tantra." Kilty first surveys the Guhyasamāja tradition and its transmission to Tibet and the two main Indian exegetical traditions, the Ārya and J.ānapāda schools. Outlining Tsongkhapa's approach to the Guhyasamāja Tantra, he then focuses on how the tradition conceptualizes the generation-stage and completion-stage practices. Chapter 7, "The Shadow of Heshang: Tsongkhapa on Chan, Dzokchen, and Mahāmudrā" by Roger R. Jackson. Jackson explores the claim that Tsongkhapa received and secretly transmitted esoteric instructions on advanced meditation practices to realize the nature of mind and awakening. The volume concludes with a section entitled "Moving Minds," which explores Tsongkhapa's legacy and impact both in Tibet and beyond. It opens with "Jé Tsongkhapa's Contribution to Buddhist Hermeneutics" by Geshé Ngawang Samten. Buddhist hermeneutics, as understood here, is a response to the challenge posed by scriptures that appear to contradict one another. Chapter 9, "Tsongkhapa's Hermeneutics and the Perfection of Wisdom," contributed by Gareth Sparham, takes a more focused look at the interpretation of the Perfection of Wisdom literature in both India and Tibet. The tenth chapter is "Jé Tsongkhapa's Teachings and Translations in Mongolian" by Bataa Mishig-Ish, who surveys the dissemination of Tsongkhapa's oeuvre to Mongolia. The final chapter is BhikṣuṇīThubten Chodron's "Learning, Living, and Teaching Bodhicitta: Jé Tsongkhapa's Contribution to Spreading Compassion in the World." Venerable Chodron argues that Tsongkhapa's approach to teaching compassion is particularly suited for the modern, Western context. While this volume does not come close to exhausting the limits of what might be said concerning the impact of Tsongkhapa's work in Tibet and beyond, it does reunite contributions to this study that briefly converged in Preface xi Mundgod, India, just before the global pandemic ushered in a new awareness of our profound human interdependence. Hopefully these essays will advance the appreciation of Tsongkhapa's intellectual legacy in the wider English-speaking world, where he remains a little understood figure of Asian religious history, unlike in the Tibetan-speaking world, where his impact is justly celebrated. Current debates about “Darwinizing culture” have typically focused on the validity of memetics. In this article we argue that meme-like inheritance is not a necessary requirement for descent with modification. We suggest that an alternative and more productive way of Darwinizing culture can be found in the application of phylogenetic methods. We review recent work on cultural phylogenetics and outline six fundamental questions that can be answered using the power and precision of quantitative phylogenetic methods. However, cultural evolution, like biological (...) evolution, is often far from treelike. We discuss the problems reticulate evolution can cause for phylogenetic analyses and suggest ways in which these problems can be overcome. Our solutions involve a combination of new methods for the study of cultural evolution , and the triangulation of different lines of historical evidence. Throughout we emphasize that most debates about cultural phylogenies can only be settled by empirical research rather than armchair speculation. (shrink)
