The article explores specificities of thematization of science and scientific rationality in Martin Heidegger’s fundamental ontology. This analysis focuses on the concept of scienticity, character- istic for Heidegger’s “early” line of thought, as well as continuation and divergence of exposition of “science” and the nature of “theoretical attitude” as the subject of interpretation of transcen- dental phenomenology of E. Husserl. This research places an emphasis on particularity of Hei- degger’s explication of existential concept of science as opposed to prevailing (...) logico-epistemolog- ical philosophy of science, and foundation of thematization of scientific “subject matters” and theoretical attitude upon the universe of ontological understanding of being of entities (regional ontologies). It also focuses on Heidegger’s assertion of fundamental ontological projection in a status of a peculiar “science of knowledge”, which gives ground for a priori pre-conditions of specific sciences. Separate attention is paid to a specifically Heideggerian approach to explication of the rooting of initial scientific orientation in the sphere of pre-scientific experience, which ar- ticulates itself in so called “fundamental concepts”, as well as positioning of contemplative ‘present-at-hand’ paradigm of theoretical knowledge as a derivative modus of a primary use of ‘ready-to-handness’ as a phenomenological founding basis of everydayness’ experience. The author came to the attention that scientific knowledge is a project Dasein. It is within the framework of self-design that Dasein thematizes what happens to another region of being that is the subject of scientific knowledge. In my dissertation I analyze the structure of fundamental physical theories. I start with an analysis of what an adequate primitive ontology is, discussing the measurement problem in quantum mechanics and theirs solutions. It is commonly said that these theories have little in common. I argue instead that the moral of the measurement problem is that the wave function cannot represent physical objects and a common structure between these solutions can be recognized: each of them is about a clear (...) three-dimensional primitive ontology that evolves according to a law determined by the wave function. The primitive ontology is what matter is made of while the wave function tells the matter how to move. One might think that what is important in the notion of primitive ontology is their three-dimensionality. If so, in a theory like classical electrodynamics electromagnetic fields would be part of the primitive ontology. I argue that, reflecting on what the purpose of a fundamental physical theory is, namely to explain the behavior of objects in three--dimensional space, one can recognize that a fundamental physical theory has a particular architecture. If so, electromagnetic fields play a different role in the theory than the particles and therefore should be considered, like the wave function, as part of the law. Therefore, we can characterize the general structure of a fundamental physical theory as a mathematical structure grounded on a primitive ontology. I explore this idea to better understand theories like classical mechanics and relativity, emphasizing that primitive ontology is crucial in the process of building new theories, being fundamental in identifying the symmetries. Finally, I analyze what it means to explain the word around us in terms of the notion of primitive ontology in the case of regularities of statistical character. Here is where the notion of typicality comes into play: we have explained a phenomenon if the typical histories of the primitive ontology give rise to the statistical regularities we observe. In recent years, a hierarchical view of reality has become extremely influential. In order to understand the world as a whole, on this view, we need to understand the nature of the fundamental constituents of the world. We also need to understand the relations that build the world up from these fundamental constituents. Building pluralism is the view that there are at least two equally fundamental relations that together build the world. It has been widely, though tacitly, (...) assumed in a variety of important metaphysical debates. However, my primary aim in this paper is to argue that this has been a mistake. I will show that serious problems concerning the relationship between building and fundamentality afflict pluralism and are likely fatal to it. I claim that, for better or worse, our best hope is building singularism, the view that there is a single most fundamental building relation. I conclude by examining the advantage that singularist accounts enjoy over their pluralist rivals. (shrink)

In an effort to disrupt the hegemonic dominance of learning theory, in this article Tyson Lewis explores the unique educational logic of studying. Drawing on the work of Giorgio Agamben, we can understand the operation of study as one of suspension through three modes: preferring not; no longer, not yet; and as not. But the relationship between the operation of suspension and the everyday mode of learning remains an open question requiring further analysis. In order to accomplish this task, it (...) is important to remember that for Agamben, study is a kind of profanation or improper life. Through examining Heidegger's analytic of Dasein's everyday being, Lewis demonstrates that the nature of study is always already saturated with the everyday, and is itself a contaminated process that is neither simply everyday living nor “authentic” existence. To be absolutely precise, the studier engages in idle talk, is curious, and is caught up in ambiguity in order to explore the seemingly uninhabitable zone that rests between everyday falling and authentically standing. In this paper I argue that the central issue in Heidegger’s path of thought from Being and Time to Contributions and beyond is what he will later call “the matter itself”: neither the meaning of being nor the analysis of Dasein but a transformational encounter in the margins of fundamental ontology. Heidegger’s account of temporality and transcendence from the late 1920s is a clue to the transformation, but it is not until the completion of fundamental ontology in the (...) naming of ontological difference that he arrives at a crisis which performs the transformation and announces the “overturning.” This interpretation revolves around a reading of Heidegger’s 1929 treatise “On the Essence of Ground” in which the text and subsequent marginal notes prepare the transition from Being and Time to Contributions, from Sein to Seyn, and from ontological difference to its appropriation. Thus we find that the language of Ereignis beginning in the 1930s and whatever we might call the “turn” signal the doing of justice to the original task from Being and Time. (shrink)

Based on the philosophy of Martin Heidegger the article presents the possibility of actualizing Heidegger’s main question about the meaning of Being in the context of the analysis of so-called “a priori perfect.” During the development of fundamental ontology in the second half of the 1920s, Heidegger ponders the approach to Being in the history of philosophy and identifies such a feature of Being as a priori, a kind of antecedence of Being in relation to being. Although tradition invariably (...) understands Being in this way, in it, according to Heidegger, the question is no longer raised either about the sense of such antecedence, or about the temporal basis of this sense, and therefore a priori as the essential character of Being is left in total oblivion. We suggest that it is the problematization of apriority in its temporal origin that can contribute to resolving Heidegger’s fundamental philosophical question of time as the transcendental horizon of any concept of Being that precedes being. In this precedence there is a cherished temporal moment, the comprehension of which allows us to develop the “basic question of metaphysics” about the relationship of Being and time in a more concrete way than Heidegger’s four main themes of the question of Being: the ontological difference; the basic articulation of Being ); the truth-character of Being; the possible modifications of Being and the unity of Being’s variety. Revealing a priori question as the central question of all Heideggers thinking before the “Turn” we attempt to update this question and justify the need for its renewal on the basis of a fundamental ontology. With this task we relate the question of the essence of philosophy in general in its existential-temporal concept since philosophy appears as a temporality-based possible of the questioning return to the “earlier”: to the essential structures of being, knowledge, Being, Dasein. Our analysis is based on the following decisions: Being in relation to being is always pre-understood as “earlier,” and in this understanding a temporal definition operates, hence the main question of fundamental ontology about the relation of Being and time can be developed or at least clarified through the problem of meaning of a priori. The question of the meaning of the “earlier” and of the temporal basis for understanding Being as “earlier,” a priori, is concretized into the question of the conditions for the possibility of any ontology, including the fundamental ontology, which raises the question of the earlier in relation to Being and therefore “lives” in the light of the understanding of the “earlier” as such. This reflexive foundation of the fundamental ontology from itself is a necessary stage on the way of developing its project, if we remember that the main “duty” of the philosopher is to clarify “our inner nature” for the sake of opening the boundaries and conditions of the possibility of philosophy. The conclusion is that the possibilities of fundamental ontology in making sense of Being, time, and philosophy in general are far from exhausted, but await the questions that actualize them and new readings that allow to see the hidden richness of Heidegger’s thought. The subject of this paper is Heidegger’s understanding of world and world-formation [Weltbildung] in his lecture The Fundamental Concepts of Metaphysics (GA 29/30) and his references to the idealistic philosophy of Schelling, the ancient thought of Aristotle and Heraclitus. I will put forward the following thesis: World is prevailing [Walten] and, as this prevailing, it is the being of beings as such as a whole in the projection of world that lets it prevail. In this paper, I will clarify (...) how the world prevails, how Dasein forms the world, and the significance of physis, logos and as-structure [als-Struktur] in this context. I will also show that Heidegger’s concept of world-formation can be thought together with his concepts of being-in-the-world and worldhood. Finally, I will discuss some of the difficulties in Heidegger’s understanding of the world and propose some solutions. (shrink)

The scientific successes of the last 400 years strongly suggest a view on which things are organized into layers, with phenomena in higher layers dependent on and determined by what goes on below. Philosophers have recently explored the idea that we can make sense of this idea by appeal to a relation called grounding. This book develops the rudiments of a theory of grounding, and applies that theory to questions of independent interest. The theorizing consists in saying in (...) more detail what grounding is and how it relates to explanations of the relevant sort, discussing objections to the deployment of a notion of grounding, and drawing points of contrast between a grounding-centered approach to relative fundamentality and other approaches in the literature. The book then turns to a demonstration of how this theorizing bears fruit in the investigation of other interesting questions. The applications are to central questions concerning (i) how to distinguish between truths that say how objective reality is in itself, quite independently of us, and truths that do not; (ii) the nature of truth; and (iii) the relation between fundamental physical facts and the rich panoply of other facts that depend on and are determined by them, including facts concerning our own doings. The aim is to advance our understanding of one of the deepest and thorniest questions which the stunning scientific achievements of the last 400 years pose: how higher-level phenomena, including ourselves, fit into an ultimately physical world. This article examines the ontology and politics of Peter Sloterdijk's Spheres trilogy, focusing in particular upon the notion of microspherical enclosure explicated in the first volume of this series. Noting Sloterdijk's unusual alignment of his philosophy with media theory, three main contentions are put forward. Firstly, that Sloterdijk's reconfiguration of Heidegger's fundamental ontology represents a largely unacknowledged renunciation of the primacy of Being-towards-death in the authentic existence of Dasein, foregrounding instead an originary co-belonging between mother and child. Secondly, that (...) Sloterdijk borrows from media theory a concern regarding the facticity of all communication, grounding philosophical discourse in the determinate locality of its origin, but does so while exalting a pre-natal communicative immediacy that would seem to disparage the everydayness of Dasein. Finally, that Sloterdijk's oft-justified scepticism regarding globalization often retreats into an anti-cosmopolitanism that, in its nostalgia for the comfort, security and immediacy of the matrixial co-belonging, evinces a covert but potentially noxious politics of exclusion. The question of personal identity lies in the question: In virtue of what is a person correctly considered the same person throughout a life‐course? This chapter shows that this question is central to the thought of Dilthey, Martin Heidegger, Hans‐Georg Gadamer, Ricoeur, as well as other thinkers in the hermeneutic tradition. Despite the deep differences among hermeneutic thinkers on the topic of personal identity, there are areas of common ground that enable us to formulate a general view that is distinctively (...) hermeneutic. Heidegger rejects the conception of the self as a substance. Gadamer asks about the nature of understanding and how it is possible, and addresses these questions by drawing on the fundamental ontological approach of Heidegger's question of the being of Dasein. Ricoeur goes beyond the proto‐narrative accounts of identity by distinguishing different levels at which life can be seen as having a narrative structure. (shrink)

This paper focuses on two issues related to ontological emergence: whether it is a coherent notion, and its relation to the doctrine of physicalism. First, it is argued that ontological emergence is best understood as a thesis relying on three fundamental tenets claiming that emergents are basic, genuinely causal, and determined by the physical realm. The paper elucidates the roles of these tenets, and introduces an interpretation that is able to resolve any apparent contradiction between the tenets, thereby supporting (...) the claim that the commitments of ontological emergence form a consistent view. The proposed understanding also hints that telling physicalism and emergentism apart is not a problem even if one subscribes to a supervenience-based formulation of physicalism. The difference in the modal strength of the supervenience relation physicalism and emergentism endorse readily distinguishes them – the former is committed to metaphysical determination whereas the latter to nomological determination. However, in a recent paper, Jessica Wilson has posed an objection to this way of differentiating physicalism from emergentism on the ground that the metaphysical/nomological distinction cannot be drawn in this context. The second part of this paper introduces Wilson's objection, and argues in detail that it fails to disqualify the modal strength-based distinction. (shrink)

This book argues that Western philosophy's traditional understanding of Being as substance is incorrect, and demonstrates that Being is fundamentally Relationality. To make that argument, the book examines the history of Western philosophy's evolving conception of being, and shows how this tradition has been dominated by an Aristotelian understanding of substance and his corresponding understanding of relation. First, the book establishes that the original concept of Being in ancient Western philosophy was relational, and traces this relational understanding of Being through (...) the Neoplatonists. Then, it follows the substantial understanding of Being through Aristotle and the Scholastics to reach its crisis in Descartes. I begin with a brief exposition of what is positive in Haugeland's interpretation of Heidegger. At the same time, I show how Haugeland subtly shifts the ground so as to make it possible to read into the texts his own idea that being is the entity-beholden, variable, normative basis for ways of life. I then argue that what Heidegger himself says about the being of available (zuhanden) entities, i.e., things of use or equipment (Zeug), doesn’t fit with Haugeland’s normativity-oriented account. (...) I develop this argument further through a look at Heidegger’s treatment of occurrent (vorhanden) nature as he elaborates that in his reading of Kant. This allows us to see how Heidegger follows Kant in thinking of the forms of being as spontaneous but non-arbitrary creations we produce for ourselves via what Kant called imagination, which activity Heidegger takes to be the self-temporalizing of Dasein identified but only opaquely described in SZ. From there, I show how we might generalize from Heidegger’s Kant’s treatment of the occurrent to a broader account in which other regional understandings of being, including that of the available, may also be understood as emerging from our temporalizing/imaginative activity. This shows what Heidegger’s overall project of fundamental ontology looks like, and how it could be completed in a way he himself didn't, if an understanding of being is an understanding of forms not norms. The history of philosophy is constituted in such iterations. Indeed, die relationship between Gadamer and Heidegger offers us a paradigm for the understanding of die history of philosophy, manifesting as it does how this history is less marked by change than by a (...) ceaseless repetition of the same. Nevertheless, whUe Gadamer reappropriates the Heidegger of Being and Time, he does so with a different aim in mind; an aim very similar to that of Wilhelm Dilthey: to give to die human sciences (Geisteswissenschaften) a solid epistemological foundation for their judgments of cultural artifacts. He wanted hermeneutics to be systematic, and he criticized previous hermeneutics for being only an" amalgam of rules "and lacking systematic coherence. Rather , they were methods for dealing with an array of different kinds of problems. Schleiermacher's hermeneutics was directed at avoiding misunderstanding of the text. At the end of this section Gadamer's criticisms of Schleiermacher will be discussed. Ⅱ. Dilthey's Contribution to Philosophical Hermeneutics Dilthey wrote his dissertation on Schleiermacher and included a history of Protestant hermeneutics since the Reformation as a second companion volume. He was a broadly educated professor and wrote on many topics. For our purposes, Dilthey was a life-philosopher with a passion for placing the Humanities and Social Sciences on an equal footing with the Natural Sciences by developing a basic methodology for them based on hermeneutics. But in competing with the sciences, he sought an "Allgemeingultigkeit," a universal validity, and in doing so he tended to give too much ground to the way of thinking in the sciences. Still, he is a major figure in the development of philosophical hermeneutics. Ⅲ. The Contribution of Martin Heidegger to Philosophical Hermeneutics before and in Being and Time The decisive turn in the development of a philosophical hermeneutics came in the early writings of Martin Heidegger, a radical and original philosopher. He was in Freiburg an assistant to Husserl and found in Husserl's phenomenology a useful way of overcoming traditional philosophy, but he still found Husserl too preoccupied with scientific validity. Part Ⅰ: Heidegger's Early Lectures: Ontology-the Hermeneutics of Facticity A posthumously published and translated set of Heidegger's lectures on ontology in terms of a hermeneutics of facticity gives us a sense of his understanding of hermeneutics. He bypassed the traditional sense of hermeneutics and went back to the Greek usage of hermeneuein and hermeneia. He attempted to overcome the limitations of modern objectivity by returning to the usages current in ordinary language in ancient Greece. There hermeneutics meant orally interpreting Homer, announcing, translating, and explaining. His account of the history of hermeneutics after Plato and Aristotle is a history of decline and loss of the richness found in Greek usage. But hermeneutics for Heidegger meant a means of access to something, and in these early lectures hermeneutics became an interpretive means of access to facticity, to the realm of pre-interpretive understanding as Dasein faces life. Ultimately hermeneutics became a means for the self-understanding for Dasein. But in a letter to his student, Engelbert Krebs, Heidegger also emphasizes the historical character of cognition. We understand from our situation in history, and our understanding is structured by historically shaped concepts and even our language. Dilthey, too, emphasized the historical matrix for understanding in his hermeneutics, and Heidegger took this up from Dilthey. Heidegger defined hermeneutics in the opening lines of the lectures as "the unified manner of the engaging, approaching, accessing, interrogating, and explication of facticity." Hermeneutics as interpretation is not just understanding as a passive process of cognition but an active engaging, interrogating, and accessing. Facticity itself is interpretive in that it sees what something is through question and answer. Heidegger is stepping back into the factors that precondition our understanding, the "forestructure" of understanding. This forehaving, he says, belongs to the very nature of knowing and understanding. We see something "as "something, and we see it in a specific historical situation. Furthermore, we see it in an existential horizon of expectation, a horizon haunted by uncertainty, by the" fundamental questionability of the future, that is of "possible being," of what is possible for this particular being at this particular time and place. Already in these early works Heidegger finds in the sense of what is possible being, a sense of "ontic questionability, care, restlessness, anxiety, temporality." All of this leads to a new conception of humanity. Instead of being an animal endowed with reason, as in Aristotle, a human being is a being with a possible future, a being with temporality. Humans are beings seeking to know themselves. Hermeneutics, Heidegger says, offers the standpoint for a new conception of the human being. Part Ⅱ: Being and Time The first mention of hermeneutics is in section 7 of Being and Time, where Heidegger is already interpreting phenomenology as letting what is show itself. He finds that " the meaning of phenomenological description as a method lies in interpretation. The logos of the phenomenology of Dasein has the character of hermēneúein. The phenomenology of Dasein is a hermeneutic in the original signification of the word, where it designates the work of interpreting. "In a second sense, Heidegger finds in hermeneutics a means of uncovering the meaning of being for Dasein. And the third sense is the interpretation Dasein as continually making its future possibilities, its future being. Section 31 is important to hermeneutics because there the being of Dasein is said to be understanding. Understanding is the central process of an existing human being. In section 32, titled "Understanding and Interpretation," interpretation builds on understanding. It looks around at the surrounding world and sees things as this or that, always already , never as pure perception. As Heidegger puts it, "The seeing of this sight is always already understanding and interpreting." In other words, there is no pure perception prior to interpretation; there is always the horizon of questioning and interpreting. In section 44, Heidegger argues that truth, too, in its modern forms as statements which are true, is derivative from the deeper processes of understanding and interpreting that are always already going on. But when truth is rightfully defined in connection with being, then it moves into the horizon of fundamental ontology. It is the disclosure of being. This insight is part of what leads him to his view of art, which we will discuss in the next lectur. (shrink)

This book challenges received notions of ontology in political theory and international relations by offering a psychoanalytically informed critique of depoliticisation in prominent liberal, post-liberal, dialogic and agonistic approaches to pluralism in world politics. Paipais locates the temptation of depoliticisation in their labouring under the fundamental fantasy of various guises of foundationalism (in the form of either political anthropology or ontology as ‘in the last instance’ ground) or, conversely, anti-foundationalism (the denial of all grounds, yet still operating within a (...) foundationalist imaginary). He argues, instead, for a formal political ontology of the void (against historicism) shot through an ‘incarnate’ messianic nihilism (against ethicism and teleological forms of politics). In so doing, the author offers critical readings of the messianic nihilism of Benjamin, Agamben, Taubes and Žižek by problematising the antinomian tendencies in their respective political theologies. The book argues for a version of Žižek’s Badiouian politics of militancy supplemented by a proper participatory understanding of St Paul’s messianic meontology and incarnational Christology as a means to reconceptualise the nexus between subjectivity, universality and political action in world politics. The 'Metaphysics of Dasein ' is the name which Heidegger gave to a new philosophical project developed immediately after the partial publication of his masterwork Being and Time. As Heidegger was later to recall, an 'overturning' took place at that moment, more precisely right in the middle of the 1929 treatise On the Essence of Ground. Between the fundamental-ontological formulation of the question of being and its metaphysical rephrasing, Heidegger discovered that a 'metaphysical freedom' stood at the root of (...) Dasein 's relation to his world and, thus, at the basis of his whole ontological questioning. This article will show how the very structure of the 1929 essay clearly illustrates the path Heidegger followed between Being and Time and the new philosophical beginning of the mid 1930s. It will conclude with a few critical remarks concerning Heidegger 's attempt to free his thinking from traditional philosophy and to overcome metaphysics. (shrink)

MARTIN HEIDEGGER’S FUNDAMENTAL ONTOLOGY – REALITY ENCLOSED IN DASEIN Martin Heidegger’s fundamental ontology was supposed to divert philosophy towards the absolutely fundamental issue, which in the history of philosophy, unfortunately, as the author claimed, had been neglected. It was an attempt to designate the real foundation, which western metaphysics – while forgetting about being – had never touched. Thus, Heidegger focused on being. He asked about its sense, the way in which it can be described and explained. (...) The answer was to be found in the analysis of some special being – the human being. Only man, who exists in such a way (Heidegger uses the concept of Dasein) that by his very nature refers to being, is “open” to being. This article shows Heidegger’s explanation based on the analysis of man’s being, connecting the existence of reality with human existence, in its essence making the world thoroughly dependent on man, enclosing the world in Dasein. The world ceases to be the whole reality consisting of particular essences existing independently of man. It becomes “the condition”, the way of being. In the first part, the author presents how the fundamental ontology, while placing being at the centre of the discourse and using the phenomenological method, directs the attention to man. When asking about being, it asks about Dasein, about the way of man’s being. Then, the paper presents the existential analytics, the hermeneutics of Dasein, which is crucial from the point of view of Heidegger’s philosophy. The author explains what Heidegger’s existentials are and what it means that man exists as “being-in-the world”, that he exists in a way of “care”. Finally, it is shown that such an understanding of human being, the way in which he cares about the world and understands the world, i.e. designs it, results in enclosing the world in Dasein. Being and Time argues that we, as Dasein, are defined not by what we are, but by our way of existing, our “existentiell possibilities.” I diagnose and respond to an interpretive dilemma that arises from Heidegger's ambiguous use of this latter term. Most readings stress its specific sense, holding that Dasein has no general essence and is instead determined by some historically contingent way of understanding itself and the meaning of being at large. But this fails to explain the sense (...) in which Being and Time is a work of fundamental ontology, concluding in Heidegger's claim to have found the meaning of Dasein's being in the concept of originary temporality. On the other hand, readings that stress the general sense of “existentiell possibilities” find Heidegger on a fruitless quest for the transcendental conditions necessary for Dasein's existence, which seems to founder on the claims that Dasein is constitutively thrown, factical, and “in-each-case-mine” [jemeinig]. Both readings are problematic and, I contend, result from a failure to disambiguate and explain the ontologically unique relationship between the specific and general aspects of Dasein's essence. I argue that we can better explain this relationship, Heidegger's method for investigating it, and the sense in which Dasein has an essence that is open to philosophical investigation, if we read Being and Time's ontology of Dasein in terms of what Anton Ford calls “categorial” genus-species relationships. In this article, I will argue that while Marion’s criticism of Heidegger’s project of fundamental ontology is in many ways sound, Marion remains bound to the conceptual opposition that existential phenomenology has successfully overcome. Namely, I will argue that Marion remains dependent upon the transcendental dilemma according to which we must rely on the strict differentiation between explanans and explanandum. Marion sees no way of departing from Heidegger’s project other than reversing the order of explanation and switching the places (...) of the explanans and explanandum, which means that phenomena start appearing as explanans. I will demonstrate how existential phenomenology has overcome this conceptual dilemma, and then I will argue that we could make a much better account of saturated phenomena, if we ground our insights in the idea of being-in-the-world. Metaphysical views typically draw some distinction between reality and appearance, endorsing realism about some subject matters and antirealism about others. There are different conceptions of how best to construe antirealist theories. A simple view has it that we are antirealists about a subject matter when we believe that this subject matter fails to obtain. This paper discusses an alternative view, which I will call the fundamentality-based conception of antirealism. We are antirealists in this sense when we think that the relevant (...) matter fails to be constitutive of fundamental reality. The following discussion will not rely on any particular understanding of fundamental reality, covering conceptions based on grounding, naturalness and truthmaking, to name three salient ones. This paper argues that there are serious issues with fundamentality-based metaphysics. It will be argued that: the fundamentality-based approach shapes and restricts our realist and antirealist views in unsatisfying ways, that it is unable to handle the conflicting facts that lie across the envisaged ‘layers’ of the metaphysically structured world, and that the methodological reasons for adopting the fundamentality-based approach fail. The paper will conclude with a diagnosis of the discussed issues, identifying a common source. (shrink)

Leibniz portrays the most fundamental entities in his mature ontology in at least three different ways. In some places, he describes them as mind-like, immaterial substances that perceive and strive. Elsewhere, he presents them as hylomorphic compounds. In yet other passages, he characterizes them in terms of primitive and derivative forces. Interpreters often assume that the first description is the most accurate. In contrast, I will argue that the third characterization is more accurate than the other two. If that (...) is correct, Leibniz’s monadological metaphysics is even more radical than it initially seems: his ontology is best understood not as a substance-mode ontology but as a force ontology. At the metaphysical ground floor, we do not find substances that possess force; instead, we just find forces. Interpreting Leibniz as a force ontologist has far-reaching consequences. For instance, it requires us to reconsider the status of time in Leibniz’s system and to revise our understanding of appetitions and perceptions. (shrink)

A leading contemporary theory of consciousness in theoretical neuroscience apparently shares significant common ground with a philosophical system of thought from Antiquity. Although chronologically disparate, the integrated information theory of consciousness and Aristotelian metaphysics seem to be akin with regards to fundamental ontology, epistemic priority, and causal powers. In this article, I explore these areas of common ground. Additionally, I consider an apparent dissimilarity regarding panpsychism and suggest that an Aristotelian understanding of powers provides a natural way for IIT (...) to reasonably regulate its ascription of consciousness. Grounding is a powerful metaphysical concept; yet there is widespread scepticism about the intelligibility of the notion. In this paper, I propose an account of an entity’s nature or essence, which I then use to provide grounding conditions for that entity. I claim that an understanding of an entity’s nature, together with an account of how logically complex entities are grounded, provides all we need to understand how that entity is grounded. This approach not only allows us to (...) say what grounds what, it also sheds light on the formal features of the grounding relation. It provides a principled argument for the orthodox view that grounding is irreflexive, asymmetrical, and transitive; but it allows that it may not be well-founded. The resulting approach gives us a powerful framework for understanding nature, grounding, and the relationship between them. (shrink)

This dissertation investigates grounding, the relation of non-causal determination whereby one fact obtains in virtue of some other fact or facts. Although considerations of grounding have been central throughout Western philosophy, the last 15-20 years have seen a renaissance of systematic work on grounding in analytic philosophy. The aim of the dissertation is to contribute to our understanding of the nature of grounding and its relation to other central phenomena in metaphysics. -/- Chapter 1 of the (...) dissertation provides a brief presentation of grounding and introduces some distinctions of relevance to later chapters. Chapter 2 discusses the question of whether grounding can be reduced. Four reductive accounts – in terms of fundamentality and supervenience, essence, reduction, and metaphysical laws respectively – are considered. All of these accounts are found to be subject to objections and are consequently rejected. -/- Chapter 3 considers the relation between grounding and another important phenomenon in metaphysics, namely ontological dependence. The question of the relation between the two is approached through an investigation of their modal connection (or lack thereof). It is argued that on the common assumption that grounding is a factive relation, ontological dependence can be shown to be neither necessary nor sufficient for grounding. Furthermore, to get any form of modal connection between the two relations, one needs to move to a non-factive conception of grounding or consider generic ontological dependence and accept a potentially controversial principle about the modal behaviour of grounding. Even then, the modal connection between grounding and ontological dependence is weak and subject to qualifications. -/- Chapter 4 develops and defends the novel notion of metaphysically opaque grounding. It is commonly assumed that grounding is an especially intimate and powerful connection and enables a form of explanation that is particularly strict and illuminating. An arguably related idea is that grounding is necessarily connected with the core features of things – their essences or natures. Metaphysically opaque grounding constitutes a form of grounding that falsifies both of these ideas. Chapter 4 makes the notion of metaphysically opaque grounding precise, motivates the idea that there are genuine cases of such grounding, explores its consequences for the theory of grounding, and defends the notion from potential objections, concluding that there are currently no strong reasons to rule out opaque grounding. In Risk Management, security issues arise from complex relations among objects and agents, their capabilities and vulnerabilities, the events they are involved in, and the value and risk they ensue to the stakeholders at hand. Further, there are patterns involving these relations that crosscut many domains, ranging from information security to public safety. Understanding and forming a shared conceptualization and vocabulary about these notions and their relations is fundamental for modeling the corresponding scenarios, so that proper security countermeasures can (...) be devised. Ontologies are instruments developed to address these conceptual clarification and terminological systematization issues. Over the years, several ontologies have been proposed in Risk Management and Security Engineering. However, as shown in recent literature, they fall short in many respects, including generality and expressivity - the latter impacting on their interoperability with related models. We propose a Reference Ontology for Security Engineering (ROSE) from a Risk Treatment perspective. Our proposal leverages on two existing Reference Ontologies: the Common Ontology of Value and Risk and a Reference Ontology of Prevention, both of which are grounded on the Unified Foundational Ontology (UFO). ROSE is employed for modeling and analysing some cases, in particular providing clarification to the semantically overloaded notion of Security Mechanism. (shrink)

In this paper, I shall examine the evolution of Heidegger’s concept of ‘transcendence’ as it appears in Being and Time (1927), ‘On the Essence of Ground’ (1928) and related texts from the late 1920s in relation to his rethinking of subjectivity and intentionality. Heidegger defines Being as ‘transcendence’ in Being and Time and reinterprets intentionality in terms of the transcendence of Dasein. In the critical epistemological tradition of philosophy stemming from Kant, as in Husserl, transcendence and immanence are key notions (...) (see Husserl, The Idea of Phenomenology, 1907, and Ideas I, 1913). Indeed, ‘transcendence in immanence’ is a leitmotif of Husserl’s phenomenology. Husserl discusses transcendence in some detail in Cartesian Meditations §11 in a manner that is not dissimilar to Heidegger. Heidegger is critical of Husserl’s understanding of consciousness and intentionality and Heidegger deliberately chooses to discuss transcendence as an exceptional domain for the discussion of beings in his ‘On the Essence of Ground’, his submission to Husserl’s seventieth-birthday Festschrift. Despite his championing of a new concept of transcendence in the late 1920s, Heidegger effectively abandons the term during the early 1930s. In this paper, I shall explore Heidegger’s articulation of his new ontological conception of finite transcendence and compare it with Husserl’s conception of the transcendence of the ego in order to get clearer what is at stake in Heidegger’s conceptions of subjectivity, Dasein and transcendence. Could a person ever transcend what it is like to be in the world as a human being? Could we ever know what it is like to be other creatures? Questions about the overcoming of a human perspective are not uncommon in the history of philosophy. In the last century, those very interrogatives were notably raised by American philosopher Thomas Nagel in the context of philosophy of mind. In his 1974 essay What is it Like to Be a Bat?, Nagel (...) offered reflections on human subjectivity and its constraints. Nagel’s insights were elaborated before the social diffusion of computers and could not anticipate the cultural impact of technological artefacts capable of materializing interactive simulated worlds as well as disclosing virtual alternatives to the “self.” In this sense, this article proposes an understanding of computers as epistemological and ontological instruments. The embracing of a phenomenological standpoint entails that philosophical issues are engaged and understood from a fundamentally practical perspective. In terms of philosophical praxis, or “applied philosophy,” I explored the relationship between human phenomenologies and digital mediation through the design and the development of experimental video games. For instance, I have conceptualized the first-person action-adventure video game Haerfest (Technically Finished 2009) as a digital re-formulation of the questions posed in Nagel’s famous essay. Experiencing a bat’s perceptual equipment in Haerfest practically corroborates Nagel’s conclusions: there is no way for humans to map, reproduce, or even experience the consciousness of an actual bat. Although unverifiable in its correspondence to that of bats, Haerfest still grants access to experiences and perceptions that, albeit still inescapably within the boundaries of human kinds of phenomenologies, were inaccessible to humans prior to the advent of computers. Phenomenological alterations and virtual experiences disclosed by interactive digital media cannot take place without a shift in human kinds of ontologies, a shift which this study recognizes as the fundamental ground for the development of a new humanism (I deem it necessary to specify that I am not utilizing the term “humanism” in its common connotation, that is to say the one that emerged from the encounter between the Roman civilization and the late Hellenistic culture. According to this conventional acceptation, humanism indicates the realization of the human essence through “scholarship and training in good conduct” (Heidegger 1998, p. 244). However, Heidegger observed that this understanding of humanism does not truly cater to the original essence of human beings, but rather “is determined with regard to an already established interpretation of nature, history, world, and […] beings as a whole.” (Heidegger 1998, p. 245) The German thinker found this way of embracing humanism reductive: a by-product of Western metaphysics. As Heidegger himself specified in his 1949 essay Letter on Humanism, his opposition to the traditional acceptation of the term humanism does not advocate for the “inhuman” or a return to the “barbaric” but stems instead from the belief that the humanism can only be properly understood and restored in culture as more original way of meditating and caring for humanity and understanding its relationship with Being.). Additionally, this study explicitly proposes and exemplifies the use of interactive digital technology as a medium for testing, developing and disseminating philosophical notions, problems and hypotheses in ways which are alternative to the traditional textual one. Presented as virtual experiences, philosophical concepts can be accessed without the filter of subjective imagination. In a persistent, interactive, simulated environment, I claim that the crafting and the mediation of thought takes a novel, projective (In Martin Heidegger’s 1927 Being and Time, the term “projectivity” indicates the way a Being opens to the world in terms of its possibilities of being (Heidegger 1962, pp. 184–185, BT 145). Inspired by Heidegger’s and Vilem Flusser’s work in the field of philosophy of technology as well as Helmuth Plessner’s anthropological position presented in his 1928 book Die Stufen des Organischen und der Mensch. Einleitung in die philosophische Anthropologie, this study understands the concept of projectivity as the innate openness of human beings to construct themselves and their world by means of technical artefacts. In this sense, this study proposes a fundamental understanding of technology as the materialization of mankind’s tendency to overcome its physical, perceptual and communicative limitations.) dimension which I propose to call “augmented ontology.”. It is also argued that Heidegger special understanding of the level and method of KrV deserves serious attention. Finally it is argued that Heidegger’s phenomenological reading of the KrV is best seen as representative of an hermeneutical conception of phenomenology.

"The second reason this philosophical enquiry seeks to connect with Thomas Mann is that he accommodates a narrative ontology of meaning, by contemplating, in his way, the same fundamental question."Along with an introduction, Hutter divides his book into three parts. In Part One ("The Stories of Jacob"), Hutter undertakes a precise explication of Mann's novel, in order to illustrate how ontology can be reconstituted as a narrative event that redefines "being" as a foundational act of history. The common opposition between the imaginary and the real prevents us from genuinely understanding either one. Indeed, the imaginary embodies a certain intuitive presence of the thing and not an empty signitive intention. Moreover it is able to compete with perception and even to offer an increased presence, a sur-real display, of the things, as shown by Merleau-Ponty’s analyses of art in Eye and Mind. As a result, we have to overcome the conception according to which the imaginary field is (...) a mere figment of my imagination, a mental entity that I could still possess in the very absence of its object. On the other hand, the presence of reality is never complete or solid: “The transcendence of the far-off encroaches upon my present and brings a hint of unreality even into the experiences with which I believe myself to coincide.” Therefore, first, the imaginary has to be redefined as a special hovering modality of the presence of the beings themselves. Second and furthermore: is not the imaginary always intertwined with perception? Merleau-Ponty advocates the puzzling thesis that there is an “imaginary texture of the real.” What is the meaning of this assertion? To what extent will it be able to blur the classical categories without arousing confusion? Can we avoid reducing reality to illusion? Lastly, consistently followed, this reflection leads as far as to discover, in the imaginary mode of being, an ontological model, the canon enabling Merleau-Ponty to think Being, an “Oneiric Being.” Thus we will venture the apparently paradoxical contention that the imaginary is the fundamental dimension of the real. The notion of “fundament” becomes indeed problematic and receives an ironical connotation, however this is precisely what is at stake in a non-positivist ontology. Existence “lies” in a ghost-like, sketchy and unsubstantial ground, in a restlessly creative being that is open to creative interpretations. We articulate a distinction between ontology, understood as involving existence questions, and metaphysics, understood as either providing for metaphysical profiles of entities or else as dealing with fundamentality and/or grounding and dependence questions. The distinction, we argue, allows a better understanding of the roles of metaontology and metametaphysics when it comes to discussing the relations between ontology and science on the one hand, and metaphysics and science on the other. We argue that while ontology, as understood in this paper, (...) may have reasonable perspectives for naturalization, given its relation to science, the same cannot be said for metaphysics, given that it is typically understood as an additional theoretical layer over science, not participating in the scientific investigation. That may result either in skepticism over metaphysics, or else on accepting that metaphysics is an autonomous branch of investigation, depending on one’s concern for metaphysics. (shrink)

In the Freedom Essay, Schelling provides four different accounts of the copula, two of which are largely implicit. In this paper, I focus on the first of these accounts, which I call the "mediated account." I argue that this explanation of the copula articulates a fundamental ontological structure in Schelling's philosophy. In the first half of the paper, I analyze the structural features of the account, drawing on Schelling's more extensive treatment in the Ages of the World. In the (...) second half of the paper, I argue that Schelling's fundamental distinction between that-which-exists and the ground of existence exhibits the same structure as the mediated account of the copula. This has implications for understanding the enigmatic relationship of these two principles to the Ungrund. I conclude by briefly suggesting other applications of this fundamental structure in Schelling's philosophy. (shrink)

Arthur Kaufmann is one of the most prominent figures among the contemporary philosophers of law in German speaking countries. For many years he was a director of the Institute of Philosophy of Law and Computer Sciences for Law at the University in Munich. Presently, he is a retired professor of this university. Rare in the contemporary legal thought, Arthur Kaufmann's philosophy of law is one with the highest ambitions — it aspires to pinpoint the ultimate foundations of law by explicitly (...) proposing an ontology, a general theory of knowledge and concept of a person. Kaufmann's work derives, first of all, from the thinking of Gustav Radburch, his teacher, and then from ideas of Karl Engish and Hans-Georg Gadamer. The philosophy undertakes to pursue the ultimate foundation of law, law which is understood by Kaufmann, first of all, as a "concrete judgement" that is, what is right in a concrete situation. Justice belongs to the essence of law and "unjust law" is contradictio in adiectio. Kaufmann opposes all those theories, which as the only foundation for establishing just law (Recht) adopt legal norms (Gesetz). In Kaufmann's opinion , such theories are powerless in the face of all types of distortions of law rendered by political forces. He suggests that the basic phenomenon which needs to be explained and which cannot be disregarded by a philosopher of law is so-called "legal lawlessness" ("Gestzliches Unrecht"). "Legal lawlessness" which forms a part of life experience for the people of twentieth century totalitarian states. It proved "with the accuracy of scientific experiment" that the reality of law consists of something more than bare conformity with legal norms. The existence of lex corrupta indicates that law contains something "non-dispositive" which requires acknowledgment of both law-maker and judge. Kaufmann, accepting the convergent concept of truth and cognition, assumes that "non-dispositive" content, emerging as the conformity of a number of cognitive acts of different subjects (inter-subjective communicativeness and verifiability), indicates the presence of being in this cognition. The questions "What is law?" and "What are the principles of a just solution?" lead straight to the ontology of law, to the question about the ontological foundations of law. Kaufmann discerns the ontological foundations of law in the specifically understood "nature of things" and, ultimately, in a "person". He proposes a procedural theory of justice, founded on a "person". In my work, I undertake to reconstruct the train of thought which led Kaufmann to the recognition of a "person" as the ontological foundation of law. In the first part, the conception of philosophy adopted by Kaufmann, initial characteristics of law — of reality which is the subject of analysis, as well as, the requirements for proper philosophical explanation of law posed by Kaufmann are introduced. In the second, Kaufmann's reconstruction of the process of the realisation of law is presented. Next, the conception of analogy which Kaufmann uses when explaining law is analyzed. In the fourth part, Kaufmann's conception of ontological foundations of law is discussed. A critical analysis is carried out in which I demonstrate that the theory of the ontological foundation of law proposed by Kaufmann and the concept of a person included in it do not allow a satisfac¬tory explanation of the phenomenon of "legal lawlessness" and lead to a number of difficulties in the philosophical explanation of law. Finally, the perspectives of a proper formulation of the issue of the ontological foundations of law are drafted in the context of the analyzed theory. My interest is centered on the conception of philosophy adopted by Kaufmann, according to which the existence of the reality is inferred on the basis of a certain configuration of the content of consciousness, whereas at the point of departure of philosophy of law, the data to be explained is a certain process, which is, basically, a process of cognition, while the reality appears only as a condition for the possibility of the occurrence of the process. I wish to argue that the difficulties which appear in the explanation of law are a consequence of the assumed fundamental philosophical solu¬tions, which seem to be characteristic, though usually not assumed explicitly, in philoso¬phy and theory of law dominant at present in continental Europe. Thereby, I wish to show the significance of ontological and epistemological solutions to the possibility of a proper formulation of the problems posed by philosophy and theory of law. Kaufmann proclaims himself in favour of a philosophy which poses questions about the ultimate foundations of understanding of the reality. In epistemology, he assumes that answers to the questions "What is reality like?" and ultimately "What is real?" are inferred on the basis of uniformity of a cognitive acts of different subjects. Cognition of the reality is accomplished exclusively through the content of conceptual material. The two fundamental questions posed by philosophy of law are "What is just law?" and "How is the just law enacted?" The latter is a question about the process of achieving a solution to a concrete case. Since, in Kaufmann's opinion, law does not exist apart from the process of its realisation, an answer to the question about the manner of realisation of law is of fundamental significance to answering the question: "What is law?" and to the explanation of the question about the ontological grounding of law, which is, as well, the foundation of justice. The proper solution has to take into account the moment of "non-dispositive" content of law; its positiveness understood as the reality and, at the same time, it has to point to the principles of the historical transformation of the content. Law, in the primary meaning of the word, always pertains, in Kaufmann's opinion, to a concrete case. A legal norm is solely the "possibility" of law and the entirely real law is ipsa res iusta, that which is just in a given situation. Determination of what is just takes place in a certain type of process performed by a judge (or by man confronted with a choice). Kaufmann aims to reconstruct this process. A question about the ontological foundation of law is a question about the ontological foundations of this process. In the analyzed theory it is formulated as a question about the transcendental conditions, necessary for the possibility of the occurrence of the process: how the reality should be thought to make possible the reconstructed process of the realisation of law. Kaufmann rejects the model for finding a concrete solution based on simple subsump¬tion and proposes a model in which concrete law ensues, based on inference by analogy, through the process of "bringing to conformity" that which is normative with that which is factual. Kaufmann distinguishes three levels in the process of the realisation of law. On the highest level, there are the fundamental legal principles, on the second legal norms, on the third — concrete solutions. The fundamental principles of law are general inasmuch as they cannot be "applied" directly to concrete conditions of life, however, they play an important part in establishing norms. A judge encounters a concrete situation and a system of legal norms. A life situation and norms are situated on inherently different levels of factuality and normativeness. In order to acquire a definite law both a norm (system of norms) and a life situation (Lebenssachverhalt) should undergo a kind of "treatment" which would allow a mutual conformity to be brought to them. Legal norms and definite conditions of life come together in the process of analogical inference in which the "factual state" ("Tatbestand") — which represents a norm, and in the "state of things" ("Sachverhalt") — which represents a specific situation are constructed. A "factual state" is a sense interpreted from a norm with respect to specific conditions of life. The "state of things" is a sense constructed on the basis of concrete conditions of life with respect to norms (system of norms). Legal norms and concrete conditions of life meet in one common sense established during the process of realisation of law. Mutatis mutandis the same refers to the process of composition of legal norms: as the acquisition of concrete law consists in a mutual "synchronization" of norms and concrete conditions of life, so acquisition of legal norms consists of bringing to conformity fundamental principles and possible conditions of life. According to Kaufmann, both of these processes are based on inference through analogy. As this inference is the heart of these processes it is simultaneously a foundation finding just law and justice. How does Kaufmann understand such an inference? As the basis for all justice he assumes a specifically interpreted distributive justice grounded on proportionality. Equality of relations is required between life conditions and their normative qualification. Concrete conditions of life are ascribed normative qualification not through simple application of a general norm. More likely, when we look for a solution we go from one concrete normative qualified case to another, through already known "applications" of norms to a new "application". The relation between life conditions and their normative qualifica¬tion has to be proportional to other, earlier or possible (thought of) assignments of that which is factual to that which is normative. Law as a whole does not consist of a set of norms, but only of a unity of relations. Since law is a, based on proportion, relative unity of a norm and conditions of life, in order to explain law in philosophical manner, the question about ontological base of this unity has to be asked. What is it that makes the relation between a norm and conditions of life "non-dispositive"? What is the basis for such an interpretation of a norm and case which makes it possible to bring a norm and conditions of life into mutual "conformity"? This is a question about a third thing (next to norms and conditions of life), with respect to which the relative identity between a norm and conditions of life occurs, about the intermediary between that which is normative and that which is factual and which provides for the process of establishing of norms, as well as, finding solutions. It is the "sense" in which the idea of law or legal norm and conditions of life have to be identical to be brought to mutual "conformity". In Kaufmann's opinion such a sense is nothing else but the "nature of things" which determines the normative qualification of the reality. Since establishment of this "sense" appears to be "non-dispositive" and controlled inter-subjectively (namely, other subjects will reach a similar result) so, in conformity with the convergent concept of truth, the "nature of things" must be assigned a certain ontological status. According to Kaufmann this is a real relation which occurs between being and obligation, between the conditions of life and normative quality. However, it should be underlined that from the point of view of the analyzed system the "nature of things" is a correlate of constructed sense, a result of a construction which is based on the principle of consistent understanding of senses ("non-normative" and "normative") and is not a reality which is transcendent against the arrangement of senses. In Kaufmann's theory, inference from analogy appears to be a process of reshaping the concepts (senses) governed by tendency to understand the contents appearing in relations between that which is factual and that which is normative in a consistent way. The analogical structure of language (concepts) and recognition of being as composed of an essence and existence is an indispensable requirement for the possibility of the realisation of law, based on specifically understood inference from analogy. It is necessary to assume a moment of existence without content which ensures unity of cognition. Existence emerges thus as a condition of the possibility of cognition. According to Kaufmann, the "nature of things" is the heart of inference through analogy and the basis for establishment of finding of law. Inference from the "state of things" to a norm or from a norm to the "state of things" always means inference through the "nature of things". The "nature of things" is the proper medium of objective legal sense sought in every cognition of law. In Kaufmann's view, the question whether the "nature of things" is ultima ratio of interpretation of law or is only a means of supplement gaps in law or whether it is one of the sources of law, is posed wrongly. The "nature of things" serves neither to supplement the gaps nor is it a source of law as, for example, a legal norm may be. It is a certain kind of "catalyst" necessary in every act of making law and solving a concrete case. Owing to "nature of things" it is possible to bring to a mutual conformity the idea of law and possible conditions of life or legal norms and concrete conditions of life. In Kaufmann's conception the "nature of things" is not yet the ultimate basis for understanding the "non-dispositiveness" of law. The relation between obligation and being is determined in the process of the realisation of law. Both the process itself and that which is transformed in this process are given. A question about the ontological bases of "material" contents undergoing "treatment" in the process of the realisation of law and about being which is the basis of regularity of the occurrence of the process arises. Only this will allow an explanation that the result of the process is not optional. Thus, a question about reality to which law refers and about the subject realising the law has to be formed. To this, Kaufmann gives the following answer: that which is missing is man but not "empirical man" but man as a "person". A "person" understood as a set of relations between man and other people and things. A "person" is the intermediary between those things which are different — norm and case are brought to conformity. A "person" is that which is given and permanent in the process of the realisation of law. It determines the content of law, is "subject" of law; this aspect is described by Kaufmann as the "what" of the process of realisation of law. A "person" consists of precisely just these relations which undergo "treatment" in the process. On the other hand, a "person" is "a place" in which the processes of realisation of law occur, it is the "how" of normative discourse, a "person" is that which determines the procedure of the process, being "outside" of it. This aspect of a "person" is connected with the formal moment of law. A "person" being, at the same time, the "how" and the "what" of the process of the realisation of law, is also, to put it differently, a structural unity of relation and that which constitutes this relation (unity of relatio and relata). According to this approach a "person" is neither an object nor a subject. It exists only "in between". It is not substance. Law is the relation between being and obligation. That which is obligatory is connected with that which is general. That which is general does not exist on its own, it is not completely real. Accordingly, a "person" as such is also not real. It is relational, dynamic and historical. A "person" is not a state but an event. In Kaufmann's opinion, such a concept of a "person" helps to avoid the difficulties connected with the fungibility of law in classical legal positivism. A "person" is that which is given, which is not at free disposal and secures the moment of "non-dispositiveness" of law. Kaufmann concludes: "The idea (»nature«) of law is either the idea of a personal man or is nothing". Theory points at the structure of realising law and explains the process of adoption of general legal norms for a concrete situation. The analysis has shown however, that in this theory a satisfactory answer to the question about the ultimate foundations of law is not given. It seems that in the analyzed theory the understanding of human being takes place through understanding of law. What is good for man as a "person", what is just, what a "person" deserves may be determined only against the existing system of law. A "per¬son" adopted as a basis of law is the reality postulated in the analysis of the process of the realisation of law. It is a condition of possibility of this process ( explaining, on one hand, its unity and, on the other hand, the non-dispositive moments stated in this process). A "person" in the discussed theory is entirely defined by the structure of law, it can be nothing more than that which is given in law, what law refers to, what law is about. Being, which is a "person", is constituted by relations between people and objects, the relations which are based on fundamental links between norms and conditions of life established in a process of bringing them to conformity. It has to be assumed that man as a "person" is a subject of law only as far as realising law "treats" given senses according to their current configuration. The system of law is a starting point and it describes in content what man is as a "person". Moreover, being a "person" is the condition for entering legal relations. Consistently, Kaufmann writes that "empirical man" is not the subject of law, man is not "out of nature" a "person". People become "persons" due to the fact that they acknowledge each other as "persons" — acknowledging, at the same time, law. This acknowledgement is a con¬dition of existence, of the possibility of the occurrence of process of realisation of law and of constituting legal relations which ultimately constitute a "person". Kaufmann assumes, that law tends towards a moral aim: it may and must create an external freedom, without which the internal freedom to fulfil moral obligations cannot develop. However, this postulate is not based on the necessary structure of human being. From the point of view of his system, it is nothing more than only a condition for the possibility of the occurrence of the process of the realisation of law — lack of freedom would destroy the "how" of this process. Thus, the postulate to protect the freedom of personal acts has to be interpreted, in accordance with the analyzed theory, as a postulate, the fulfilment of which aims ultimately at the accomplishment of the very same process of realisation of law itself and not the realisation of a given man. Kaufmann considers a "person" to be an element which unites the system of law as a whole. Law is a structure of relations, which are interdependent and inter-contingent. Consequently, a "person" which is to form the ontological basis of law has to be entity consisting of all relations. Being also the "how" of the process of realisation of law, if a "person" is to warrant its unity, it has to be a common source for all procedures. Hence, a single "person" would constitute a subject of law. Man appears to be only a moment of a certain entirety, realisation of which should be an aim of his actions. Law, creating a "person" as an object and subject of law becomes a primary entity. In the analyzed theory, the basis for determination of aims which law sets to man is not the allocation of man-subject to something which improves him but rather, such relation is only just constituted by law. A question appears, why should aims set in law also be the aims of "empirical man"? Why is this "empirical man" to be punished in the name of a "person" understood in such a way? If, however, it is assumed that what is man is determined by a system which is superior to him, then man has to be understood only as a part of a whole and there are no grounds to prohibit istrumental treatment of man and so the road to all aspects of totalitarianism might be opened. A problem of the application of created theory to the reality arises, the reality which the theory pretends to explain. Ultimately in his theory Kaufmann does not give any systemic grounds for a radical questioning of the validity of any legal norms. Every new norm becomes an equal part of system of norms. It is only its interpretation and application to given conditions of life that may be disputable, however, this refers to all norms without exception. Cohesive inter-pretation of norms and applications is necessary and sufficient for the acquisition of just law. New norms have to be interpreted in the light of others, correspondingly, the other norms require reinterpretation in the light of the new ones. Contradiction in interpretation of a norm does not form a basis for questioning norms but may serve only to question the manner of their interpretation (understanding). Therefore, no grounds exist to assume any legal norm as criminal or unjust, and in consequence, to question any consistently realised system based on formally, properly established norms, as "legal lawlessness". As law and a "person" do not exist without the process of realisation of law, the role of legal safety becomes crucial as the condition for the possibility of the occurrence of the process of realisation of law. Denying legal safety would be tantamount to negation of law in general (also of moral law) as negation of safety takes away, at the same time, the basis for occurrence of the process of realisation of law. Moreover, any lack of legal safety would also mean lack of a basis for the existence of man as a "person". Kaufmann's thesis, that civil disobedience is legalized only when it has a chance to lead to success, consistent with his concept of the foundations of law, seems to point directly to conclusions which deny the facts taken under consideration and doubtlessly Kaufmann's own intentions, since it would have to be assumed that accordingly there are no grounds to question a legal system in force based on violence which secures its operation. Force finally seems to determine which one of the mutually irreconcilable normative systems constitute law and which does not. A legitimate position is one which leads to success, it is the weaker system which is negated. If so, then basically violent imposition of law is not an act directed against the law in force but, to the contrary, realisation of law. In the context of the new system the former system of law may be talked about as unjust solely in the sense of being incapable of being consistently united with the new. However, at the base, ultimately, lies force which reaffirms differences and excludes from the process of realisation of law certain norms and their interpretations. Kaufmann was aiming at grounding of that which is "non-dispositive" in a certain given framework of interpretation. Nevertheless, he does not provide foundations for the understanding of phenomena, which he undertakes to explain at a point of departure. Instead of explaining them the theory negates the possibility of their existence. The reality postulated in regard to "non-dispositive" moments of the reconstructed process of acquiring law consist of a specifically understood "person", which appears in Kaufmann's conceptions as a condition of the possibility of the realisation of law. According to this approach understanding of a "person" may be only a function of law. To understand "legal lawlessness" and foundations of justice it is necessary to look for such theory of law in which understanding of man as a "person" and being is not a function of understanding of law (in which a "person" is not only a condition for possibility of reconstructed process of realisation of law; for possibility of cognition processes). It seems necessary to start from theory of being and a "person" based on broader experience than the one assumed by Kaufmann and reconstruct the ontological foundations of the process of realisation of law only in such perspective. Kaufmann points out that that to which law refers is ipsa res iusta a concrete relation of man to other people and things. This relation, in his theory, appears to be basically only just constituted by law (normative senses "applied" to conditions of life). Therefore, understanding the relation between a given man and other people and things which constitute the aim of his actions, that is understanding of good, is enacted against the background of constitution of senses; constitution which is a result of a process aiming towards consistent understanding of particular contents (of nor¬mative and non-normative senses). "Being" is secondary towards constructed senses it is only their correlate. The primary relation consists of relation of a man to law (system of norms), while the secondary relation is one of man to something which is the aim of his action (relation between man and good). Considering such approach it is difficult to envision a satisfying answer to the fundamental question: why does law put concrete man under any obligation to obey it? The source of this problem can be seen in reduction of the base for understanding good to content of obligation formulated in auto-reflection. Such reduction seems to be a consequence of Kaufmann's adoption of "convergent concept of truth" and in con¬sequence his recognition of indirect, essentialistic grasp of reality formulated in concepts as the basic and only foundation of theory of being and of law. In view of such an approach, analogy of law, concepts and being is the condition for the possibility of the process of transformation of senses which aims at consistent interpretation of all law. Existence is postulated with respect to the possibility of unity of experience and cognition. However, also a different approach to understanding of the problem of being and good is possible. In spontaneous cognition being is affirmed, first of all, not as a certain, non-contradictory, determined content, but as something existing. Together with a cer¬tain content (passed indirectly through notions) existence of being is co-given. The basis for unity of being is not formed by the consistence of content, as it is in the case of the theories departing from the analysis of cognition processes, but by an act of existence realising content (essence). Such an approach makes it also possible to go beyond the convergent concept of truth. It is worth mentioning that allocation of an agent to good is realised not only by the content of duty. A statement that something is good is primary with respect to determination of this good in content. The recognised good always bears some content, however, there are no reasons to base the concept of good exclusively on indirect, formulated in concepts cognition. As primary, can be adopted the relation of man to good and not of man to law. Determination in content appears to be only an articulation of aspectual cognition of being, as an object of action. In such a case the basis for relative unity of norm and conditions of life is not the "nature of things" understood as correlate of sense but it is relation to good based on internal constitution of man as potential, not self-sufficient being. It does not mean, that the moments of the process of realisation of law singled out by Kaufmann are not important to determination of what is just. He, quite rightly, points to significant role played by norms in the evaluation of concrete situations, in man's search for closer specification in content of good innate to him. The structure of process of determining law for a concrete situation, to a great degree corresponds to the processes of determining law which take place not only in the legal sciences. Kaufmann's analyses of the process of realisation of law show the complexity of the structure of these processes and point towards important moments allowing a better understanding of law and man. Nevertheless, these analyses cannot be a basis for construction of philosophical theory of law, theory which hopes to point out the ultimate, ontological foundations for understanding law. Kaufmann's results may become fully valid only in a more general perspective including broader experience at the point of departure. (shrink)

While Heidegger privileges the role of language ( logos ) as the condition for being-in-the-world, the fundamental ontology ignores how logos is informed by our bodily comportment to the world as animals. This capacity for logos ultimately depends upon the capacities we share with members of other animal species. Although Aristotle privileges logos as distinctive to the human being, logos also maintains an aporetic relationship to the other capacities of the soul. If we are to reexamine Heidegger’s debt to (...) Aristotle, we might begin by retrieving Heidegger’s interpretation of logos as an ontological problem for distinguishing Dasein from animal life. This article deals with the notion of time in the Martin Heidegger’s fundamental оntology. The conceptual deference between the ordinary understanding of time and its ontological comprehension as temporality is made here. Namely the time of the ordinary understanding is guided by the moment of “now”, but the temporality as the meaning of human being (of Dasein) has to be treated on the base of its ecstatical character. In lieu of an abstract, here is a brief excerpt of the content:A Báñezian Grounding for Counterfactuals of Creaturely Freedom:A Response to James Dominic Rooney, O.P.Taylor Patrick O'NeillIntroductionIn a recently published article, James Rooney, O.P., critiques a fundamental aspect of Réginald Garrigou-Lagrange's articulation of the relation between divine causality and creaturely freedom, which I also defended in my recent book.1 Specifically, Rooney argues that at least some of what Garrigou-Lagrange holds is rooted in a Molinist rather than Báñezian (...) understanding of human freedom and divine causality. The aim of this paper is to articulate the basic objections raised by Rooney and to show why the objections fail. We shall not provide an exegetical or textual analysis of Báñez himself, but rather will establish a speculative grounding and agreement between basic principles of Báñezianism and Garrigou-Lagrange's articulation, ultimately affirming the necessity of positing creaturely counterfactuals for Báñezianism.Rooney makes two distinct (but related) objections to Garrigou-Lagrange's treatment. First, he claims that Báñezianism as a system rejects the notion of "alternative possibilities" when considering the creaturely will and its relation to divine causality, especially in regard to physical premotion. I shall argue that this is incorrect, and indeed misses one of the constitutive elements of Báñezianism—in fact the very grounding for its claim that infallibly moved actions remain free. Second, Rooney claims that Garrigou-Lagrange posits [End Page 651] a circular argument regarding the reality of sin. Garrigou-Lagrange's argument would be circular if it corresponded to a single order of causality or if counterfactuals of creaturely freedom were incompatible with Báñezianism. But we shall argue that they are not. As such, the argument is not only not circular, but rather elucidates a constitutive element of the Báñezian system, thereby refuting the objection. In short, Garrigou-Lagrange's articulation of Báñezian premotion admits of counterfactuals without relying upon divine passivity, and it remains internally coherent.Rooney's Critique of the So-called "Garrigou Manoeuvre"Rooney begins the essay by outlining a few of the major differences between a Molinist and Báñezian view of human freedom. Rooney's argument is that there is a potential "grounding problem" for Báñezianism, or at least for Báñezianism as articulated by Garrigou-Lagrange. As Rooney notes, Báñezianism posits that God's efficacious grace is ontologically antecedent to our good actions (and his permission of sin is ontologically antecedent to our sin). But how does this position retain free choice, if divine causation or permission is infallibly determinative and antecedent to creaturely choice? Rooney says:The Banezians need to account for how it is possible that a creature can do otherwise in the special case when God moves the creature to act through grace. Specifically, what grounds the truth of the claim that, even when God determines human free choices from eternity such that a human being has only one course of action open to them, those human beings are morally responsible for their actions? If the Banezian view entails that human beings, acting under grace, strictly lack any ability to do otherwise, then the view is incoherent.2As such, we can see that "the ability to do otherwise" is an essential, grounding element for defending Báñezianism against radically compatibilist or double-predestinarian views of human freedom, which have been condemned by the Church at Trent and in subsequent condemnations of Jansenism.3 Of course, the phrase "ability to do otherwise" is metaphysically [End Page 652] ambiguous, which Rooney admits. Various articulations of a more metaphysically precise grounding for the preservation of free choice under the influence of efficacious grace (or while efficacious grace is withheld) have been put forth, and Rooney focuses on a particular "strategy" which he associates with Garrigou-Lagrange and myself.4 He terms this strategy the "Garrigou Manoeuvre."Rooney notes that "Garrigou-Lagrange claims that there is something in virtue of which God denies someone efficacious grace, and that this is in the control of the sinner."5 He quotes Garrigou-Lagrange as saying that a person "is deprived of efficacious grace because by sinning he resists sufficient grace.... Physicalism is the thesis that all entities are nothing over and above physical entities. Here I investigate into whether and how physicalism might be formulated so as to substantively contrast with its best traditional rivals---including and especially emergentism. Formulating physicalism requires making sense of both the physical/non-physical distinction and the nothing/something over and above distinction. It has been argued that no distinction between the physical and the non-physical exists, that can serve as the basis for a sub stantive physicalism. But (...) such arguments miss the mark, for participants to the physicalism debates do not disagree about the boundary of the physical, which, while roughly drawn is clear enough for debate to proceed. Rather, participants disagree on whether there are any entities over and above those entities they agree are physical. Hence the viability of physicalism primarily depends on the over and above distinction. ;I argue that existing accounts of over and aboveness are inadequate, for the key class of cases where two properties are instanced in a single subject, and one property is supposed to necessitate the other, with at least nomological necessity. I go on to provide an adequate account of over and aboveness, by reference to the notion of a fundamental force . We can formulate physicalism and emergentism using Force-relative Over and Aboveness: according to physicalism, all causal powers bestowed by all properties are grounded only in fundamental physical forces; according to emergentism, some causal powers are grounded in a new fundamental force, different from any physical force. ;Understanding over and aboveness as involving fundamental forces is not new. But arguments against forces have lately been accepted; hence the notable absence of forces from contemporary philosophizing. I distinguish two uses of 'force', and show that these arguments do not tell against fundamental forces. I then give positive arguments for admitting fundamental forces, stemming from the reasonable hypothesis that fundamental forces are collections of interacting fields. Forces, so understood, are ontologically defensible; and thus can serve as the needed basis for formulating physicalism and emergentism. (shrink)

In the article, the author analyzes methodological approaches to the study of the concept of historical responsibility, comparing the German tradition of study with the voluntary actions ontology of M.M. Bakhtin 's. The German tradition, influenced by the thinking of World War II, emphasizes the perception of responsibility in the context of the relationship with guilt, which raises a substantial question about the nature of responsibility and its boundaries. In particular, H. Arendt formulates the concept of banality of evil, focusing (...) on the disappearance of internal perception of responsibility, but does not solve the question of the origins of such feeling. The Russian religious tradition, presented by M.M. Bakhtin, allows to propose a way to solve the issues raised due to the identification of ontological grounds of individual responsibility. Nevertheless, M.M. Bakhtin conclusions are also important for solving the problem of collective responsibility. Bakhtin addresses responsibility as an ontological characteristic of human existence, opposing its freedom. Responsibility manifests itself in acts, but ontologically precedes a separate action performed by a person. The role of the act is that it allows the person himself to understand the burden of responsibility and act on these prerequisites. The transfer of the Bakhtins methodology from individual to collective responsibility makes it possible to link the moment of its occurrence not to public recognition, but to the very fact of the individual 's entry into a certain community. The ontological integrity of the individual also acquires a social dimension, not only synchronic but also diachronic. According to the author, the application of the Bakhtins methodology in the field of social research makes it possible to consider problems of historical responsibility in the context of more fundamental philosophical questions about the relationship between individual and collective identity, the dynamics of identity, the combination of regularity and variability in human behavior.
