In this paper, we present a method for introducing law students to the writing of legal documents. The method uses a machine-readable representation of the legal knowledge to support document assembly and to help the students to understand how the assembly is performed. The knowledge base consists of enacted legislation, document templates, and assembly instructions. We propose a system called LEDAS (LEgal Document Assembly System) for the interactive assembly of legal documents. It (...) guides users through the assembly process and provides explanations of the interconnection between input data and claims stated in the document. The system acts as a platform for practicing drafting skills and has great potential as an education tool. It allows teachers to configure the system for the assembly of some particular type of legal document and then enables students to draft the documents by investigating which information is relevant for these documents and how the input data shape the final document. The generated legal document is complemented by a graphical representation of legal arguments expressed in the document. The system is based on existing legal standards to facilitate its introduction in the legal domain. Applicability of the system in the education of future lawyers is positively evaluated by the group of law students and their TA. (shrink)

This article analyzes a deliberative forum on nanotechnologies, organized in Portugal within the scope of the research project DEEPEN—Deepening Ethical Engagement and Participation in Emerging Nanotechnologies. This event included scientists, science communicators and members of the “lay public”, and resulted in a position document which summarizes collective aspirations and concerns related to nano. Drawing upon our previous experience with focus groups on nanotechnologies—characterized by methodological innovations that aimed at suspending epistemological inequalities between participants—this paper delves into the performativity of (...) the deliberative event, exploring some of the tensions and power/knowledge asymmetries generated by the forum. Recognizing that the design of participatory assemblages matters, we reflect on our role as facilitators and explore the difficulties in organizing exercises of upstream engagement with emerging technologies. In 2009, health authorities from Taiwan formally attended the 62nd World Health Assembly of the World Health Organization as observers, marking the country’s participation for the first time since 1972. The long process of negotiating this breakthrough has been cited as an example of successful global health diplomacy. This paper analyses this negotiation process, drawing on government documents, formal representations from both sides of the Taiwan Strait, and key informant interviews. The actors and their motivations, along with the forums, (...) practices and outcomes of the negotiation process, are detailed. While it is argued that non-traditional diplomatic action was important in establishing the case for Taiwan’s inclusion at the WHA, traditional concerns regarding Taiwanese sovereignty and diplomatic representation ultimately played a decisive role. The persistent influence of these traditional diplomatic questions illustrates the limits of global health diplomacy. (shrink)

In 179 b.c. the censors M. Aemilius Lepidus and M. Fulvius Nobilior brought about a reform in the voting. The only evidence for this is a single sentence in Livy : mutarunt suffragia regionatimque generibus hominum causisque et quaestibus tribus discripserunt The meaning of these words has often been discussed but never in a fully systematic manner. Further, the attempts to discover their meaning have always been made in an effort to throw light upon some other problem. They are thus (...) transported into the historical context in question, such as the vicissitudes of the freedman vote or the reforms of the comitia centuriata. Yet the formulaic nature of the sentence and its virtual independence from its immediate context make it essential to examine it in its own right in order objectively to establish its meaning. Only then should the question of historical context be considered. The purpose here is to provide a systematic analysis of each element in this sentence. If the results of this are accepted it will become apparent that Livy 40.51.9 relates to central questions concerning the census and the centuriate assembly. As it stands the sentence is entirely divorced from what precedes and follows it, with the exception of the subject, the censors. Not only is there nothing in the surrounding context to explain it; there is nothing remotely comparable anywhere else in Livy. This, together with the precision of the language, the institutional content, and the formal and formulaic sound of the whole, suggests that Livy has either lifted the sentence out of an official document or is using the terminology characteristic of such documents. Summary This article is a response to Hansen's recent defence of the authenticity of the document at Demosth. or. 24.20–3. It discusses the methodology for assessing the authenticity of the documents in the orators, in particular the role of the stichometry and the importance of the epigraphic evidence. It provides an in-depth analysis of the evidence about the nomothesia procedure provided in Demosthenes' „Against Timocrates“, showing, first, that this procedure was one centred on the enactment of new laws, and (...) not, as the document describes, a general review of the laws of Athens; second, that the procedure described in the speech is one that can be initiated at all points of the year, whereas the document describes an annual procedure taking place only on the 11th day of the first prytany; third, that the procedure described in the speech was initiated by a simple διαχειροτονία that allowed new proposals to be made, whereas the document describes multiple initial votes „kapitelweise“ to be held in the Assembly on different groups of existing laws. The last part of the article surveys eight specific problems with the text of the document, which confirm that it cannot be an authentic Athenian law. (shrink)

There is more to legal knowledge representation than knowledge-bases. It is valuable to look at legal knowledge representation and its implementation across the entire domain of computerisation of law, rather than focussing on sub-domains such as legal expert systems. The DataLex WorkStation software and applications developed using it are used to provide examples. Effective integration of inferencing, hypertext and text retrieval can overcome some of the limitations of these current paradigms of legal computerisation which are apparent when they are used (...) on a stand-alone basis. Effective integration of inferencing systems is facilitated by use of a (quasi) natural language knowledge representation, and the benefits of isomorphism are enhanced. These advantages of integration apply to all forms of inferencing, including document generation and casebased inferencing. Some principles for development of integrated legal decision support systems are proposed. (shrink)

The paper outlines ongoing research on logic-based tools for the analysis and representation of legal contracts, of the kind frequently encountered in large-scale engineering projects and complex, long-term trading agreements. We consider both contract formation and contract performance, in each case identifying the representational issues and the prospects for providing automated support tools.

Gemins 2–8 and Unr‐interacting protein (UNRIP) are intimate partners of the survival motor neuron (SMN) protein, which is the determining factor for the neuromuscular disorder spinal muscular atrophy (SMA). The most documented role of SMN, Gemins and UNRIP occurs within the large macromolecular SMN complex and involves the cytoplasmic assembly of spliceosomal uridine‐rich small nuclear ribonucleoproteins (UsnRNPs), a housekeeping process critical in all cells. Several reports detailing alternative functions for SMN in either motor neurons or skeletal muscles may, however, (...) hold the answer to the extreme neuromuscular tissue specificity observed in SMA. Recent discoveries indicate that collaboration between SMN and Gemins also extends to these non‐canonical functions, hence raising the possibility that mutations in Gemin genes may be the cause of unlinked neuromuscular hereditary syndromes. This review evaluates the functions of Gemins and UNRIP inside the SMN complex and discusses whether these less notorious SMN complex members are capable of acting independently of SMN. (shrink)

This article aims to present a reflection on the Conference of the Bishops of Latin America in Rio de Janeiro in 1955. Lived in previous ecclesial context of the Second Vatican Council II, this conference reveals, in many ways, another ecclesiology. This study, so specifically, points out its relationship with Sacred Scripture. It is proposed to analyze the quotes that the Final Document of this Assembly makes the use of the Bible for animation of church’s life. In the (...) same way, it also wants to present that in the first Conference of the Bishops of Latin America had already been released some assumptions that favored a creative reception of the conciliar indications specifically the document Dei Verbum. In documenting the dizzying diversity of human languages, Evans & Levinson (E&L) highlight the lack of universals. This suggests the need for complex learning. Yet, just as there is no universal structure, there may be no universal learning mechanism responsible for language. Language is a behavior assembled by many processes, an assembly guided by the language being learned.

The rite of the Mass has undergone changes that have transformed the way the faithful participated in the celebrations. On the occasion of the Second Vatican Council, there were changes which were intended to bring about a more active participation of the assembly in the liturgical act. The distance between the canticle and the liturgical rite calls for an investigation, for it is necessary that we know the reason for this happening even today. There is evidence that many chants (...) sung in celebrations are discordant with the liturgical time, and the lack of a correct understanding of the teachings of the Church may be the reason for this, since there are several ecclesial documents on the subject. The present work intends to demonstrate, through the analysis of Church documents and the ideas of renowned authors, specialists in liturgy, the importance of music having a liturgical objective. This article is a bibliographical research, which through the analysis of Church documents mainly, seeks to highlight the importance of liturgy linked to music. Since the Motu Proprio Tra le Sollecitudini, the Church has been regulating how to perform the song to achieve a true liturgical action in the Eucharistic celebration. It should not be forgotten, however, that the participation of the assembly in the Latin Mass was restricted, and there was no possibility of innovation in singing. With the Constitution Sacrosanctum Concilium, the lay participation was expanded, as well as the introduction of the vernacular in the celebrations. Subsequent Church documents have ratified the expansion of secular participation and the local language has made it possible to include new chants in celebrations, including popular ones, which were previously banned. In the Latin mass, the liturgy was more restricted to the clergy; With the council reform, the laity gained more space. Today, the Church's challenge is to preserve the liturgical meaning of singing, respecting popular cultures, but further deepening the lay liturgical-musical formation. (shrink)

Today's industrial society is having an encounter with ecology: in April, 1976 the French government presented the National Assembly with documents on the dumping and burning of waste in the sea, as well as on the protection of nature. Electoral campaigns, discussions and demonstrations are centered about the theme of pollution and environment. In the last century the accumulation of waste had already become a problem : “ One of the most important duties of industry is to find a (...) useful employment for waste,” wrote P. L. Simmons in 1875. The advice was heeded if we may believe what J. Gottmann wrote on the matter nearly a century later: “ If our era is to be defined by its most important raw material and one that is truly proper to it, as is done for the Bronze Age or the Iron Age, we may no longer speak of a Steel or Petroleum Age, nor of an Atomic Age (which may come in the future) but of the Garbage Age.” The extraordinary demographic expansion of humanity that has gone from a population of five million in the Paleolithic Age to four billion today gives rise to a monstrous abundance of refuse resulting as much from the natural mechanisms of living as from industrial activity (factory waste) or from the present attitude haunted by the idea of obsolescence (the throw-away society of Alvin Toffler). The outline of a universe submerged in waste matter appears, similar to that evoked by Italo Calvino in Città Invisibili apropos of the town of Leonia: “The refuse of Leonia would gradually invade the world if the interminable garbage heaps were not pressed upon, beyond the last crest, by the refuse of other towns that also push mountains of refuse far away from themselves. Perhaps the entire world beyond the borders of Leonia is covered with craters of trash, each with a continually erupting metropolis in its center. The borders between foreign or enemy towns are thus contaminated bastions in which the detritus of the one and the other serves as mutual support, menacing and mixing together.” The world of Metamorphosis is approaching in which man, transformed into an insect, covered with dust and remains of food, gnaws on the cores and parings of half-rotten vegetables. Science fiction invents a remedy to fit the problem : a planet specialized in storing all the garbage unloaded by an entire galaxy. (shrink)

Based on archival documents, regulatory and other official materials, as well as the press of that time, the article attempts to shed some light on the complex beginning of Lithuanian Roman legal system research. Since the beginning of theUniversity law degree in 1922, the Roman law courses (then divided into history and dogma, the system) were taught with an exclusive focus. However, while assembling the faculty of professors at the Lithuanian university, in the beginning they had to content mainly with (...) practitioners, therefore it was particularly difficult to solve the problem of the Roman legal system researcher that required very specific knowledge. In 1964, Augusto Del Noce assembled in a book some of his best works on Marxism, atheism, and the history of modern philosophy. The result was Il problema dell’ateismo, which he always regarded as foundational to his way of thinking. The book remains his best-known work and is still in print in Italy almost sixty years later. The Problem of Atheism offers the first English translation of this landmark book, one of the earliest works to recognize the new secularizing trends (...) in Western culture following World War II. Del Noce situates atheism historically, reconstructing its philosophical trajectory through European modernity. Documenting the author’s entire intellectual experience, these essays explore the birth of modern philosophy, reckon with the great European crisis of 1917 to 1945 and the Cold War that followed, and mine the opposition between Marxism and the rise of the affluent society. The result is rich with premonitions of the cultural landscape that would take shape throughout the 1960s and the decades that followed. This article assembles reasons for holding that the propaedeutic rationale for much of the discourse produced by ‘ethogenic science’ is inadequate. One reason is that the interactional principles that are the pretext for assembling the situational vignettes, which are the staple of ethogenics, are truisms and do not require documentation. Our familiarity with the risks and rewards of social life is already considerable and it is not clear how, or to what end, ethogenic science can augment them. Moreover ethogenic theorists (...) do not explain how a discipline that eschews experiment and causal inquiry can transcend the understanding of the subject and how, if it does not, it can do more than provide perspicuous views of the social facts and practices already known, or at least within reach of unspecialized observation. The programme of uncovering the mechanisms by which we register and evince our social standing is not one of which we are given a coherent account and is, in any case, not to be served by multiplying examples of how respect and contempt are merited or meted out. It is suggested that the need such discourse surreptiously meets is that of an autonomous craving for Wittgensteinian Übersichten - overviews - of the vicissitudes of social existence. (shrink)

This volume of the Complete Works provides the first English translation of Nietzsche's unpublished notes from Summer 1886 through Fall 1887. In these writings we find drafts of new prefaces for the second editions of his earlier works, notes for the soon-to-appear On the Genealogy of Morality, and crucially, fragments and plans for an anticipated "master work" under the title "The Will to Power." This projected work, as is now well-known, was never written by Nietzsche; instead, it was fraudulently assembled (...) by his sister Elisabeth Förster-Nietzsche and his friend Heinrich Köselitz (aka Peter Gast), and published under Nietzsche's name after his death. Only now, with the publication of this volume and the ones that precede and follow it, are English readers able to examine for themselves the full set of unpublished writings of the last creative period of Nietzsche's life. Taking into account the latest editorial work on his final notebooks, and including a detailed account by Mazzino Montinari of Nietzsche's decision not to complete a "master work," this volume documents the evolution of Nietzsche's thinking on such important themes as nihilism, eternal recurrence, and the revaluation of all values as it presents his late 'Nachlass' free from the distortions perpetrated against it over a century ago. Legal studies and consequently legal history focus on constitutional documents, believing in a nominalist autonomy of constitutional semantics.Reconsidering Constitutional Formation in the late 18th and 19th century, kept historic constitutions from being simply log-books for political experts through a functional approach to the interdependencies between constitution and public discourse. Sovereignty had to be 'believed' by the subjects and the political élites. Such a communicative orientation of constitutional processesbecame palpable in the 'religious' affinities of the constitutional preambles. They were held as (...) 'creeds' of a new order, not only due to their occasional recourse to divine authority, but rather due to the claim for eternal validity contexts of constitutional guarantees. The communication dependency of constitutions was of less concern in terms of the preamble than the constituents' big worries about government organisation. Their indecisiveness between monarchical and popular sovereignty was established through the discrediting of the Republic in the Jacobean reign of terror and the 'renaissance' of the monarchy in the military resistance against the French revolutionary and later Napoleonic campaigns. The constitutional formation as a legal act of constituting could therefore defend the monarchy from the threat of the people (Albertine Statute 1848), could be a legal decision of a national constituent assembly (Belgian Constitution 1831), could borrow from the old liberties (Polish May Constitution 1791) or try to remain in between by referring to the Nation as sovereign (French September Constitution 1791, Cádiz Constitution 1812). Common to all contexts is the use of national sovereignty as a legal starting point. The consequent differentiation between constituent and constituted power manages to justify the self-commitment of political power in legal terms. National sovereignty is the synonym for the juridification of sovereignty by means of the constitution. The novelty of the constitutions of the late 18th and 19th century is the normativity, the positivity of the constitutional law as one unified law, to be the measure for the legality of all other law. This second volume of ReConFort, published open access, addresses the decisive role of constitutional normativity, and focuses on discourses concerning the legal role of constitutional norms. Taken together with ReConFort I (National Sovereignty), it calls for an innovative reassessment of constitutional history drawing on key categories to convey the legal nature of the constitution itself (national sovereignty, precedence, justiciability of power, judiciary as constituted power). In the late 18th and early 19th centuries, constitutional normativity began to complete the legal fixation (...) of the entire political order. This juridification in one constitutional text resulted in a conceptual differentiation from ordinary law, which extends to alterability and justiciability. The early expressions of this 'new order of the ages' suggest an unprecedented and irremediable break with European legal tradition, be it with British colonial governance or the French ancien régime. In fact, while the shift to constitutions as a hierarchically 'higher' form of positive law was a revolutionary change, it also drew upon old liberties. The American constitutional discourse, which was itself heavily influenced by British common law, in turn served as an inspiration for a variety of constitutional experiments - from the French Revolution to Napoleon's downfall, in the halls of the Frankfurt Assembly, on the road to a unified Italy, and in the later theoretical discourse of twentieth-century Austria. If the constitution states the legal rules for the law-making process, then its Kelsian primacy is mandatory. Also included in this volume are the French originals and English translations of two vital documents. The first - Emmanuel Joseph Sieyès' Du Jury Constitutionnaire (1795) - highlights an early attempt to reconcile the democratic values of the French Revolution with the pragmatic need to legally protect the Revolution. The second - the 1812 draft of the Constitution of the Kingdom of Poland - presents the 'constitutional propaganda' of the Russian Tsar Alexander I to bargain for the support of the Lithuanian and Polish nobility. These documents open new avenues of research into Europe's constitutional history: one replete with diverse contexts and national experiences, but above all an overarching motif of constitutional decisiveness that served to complete the juridification of sovereignty. An effectiveness assessment on ASCT in locally advanced and metastatic breast cancer identified serious ethical issues associated with this intervention. Our objective was to systematically review these aspects by means of a literature analysis. We chose the reflexive Socratic approach as the review method using Hofmann's question list, conducted a comprehensive literature search in biomedical, psychological and ethics bibliographic databases and screened the resulting hits in a 2-step selection process. Relevant arguments were assembled from the included articles, and were assessed (...) and assigned to the question list. Hofmann's questions were addressed by synthesizing these arguments. Of the identified 879 documents 102 included arguments related to one or more questions from Hofmann's question list. The most important ethical issues were the implementation of ASCT in clinical practice on the basis of phase-II trials in the 1990s and the publication of falsified data in the first randomized controlled trials (Bezwoda fraud), which caused significant negative effects on recruiting patients for further clinical trials and the doctor-patient relationship. Recent meta-analyses report a marginal effect in prolonging disease-free survival, accompanied by severe harms, including death. ASCT in breast cancer remains a stigmatized technology. Reported health-related-quality-of-life data are often at high risk of bias in favor of the survivors. Furthermore little attention has been paid to those patients who were dying. The questions were addressed in different degrees of completeness. All arguments were assignable to the questions. The central ethical dimensions of ASCT could be discussed by reviewing the published literature. (shrink)

In this groundbreaking editorial and curatorial project, more than 100 writers, artists, and philosophers rethink what politics is about. In a time of political turmoil and anticlimax, this book redefines politics as operating in the realm of things. Politics is not just an arena, a profession, or a system, but a concern for things brought to the attention of the fluid and expansive constituency of the public. But how are things made public? What, we might ask, is a republic, a (...) res publica, a public thing, if we do not know how to make things public? There are many other kinds of assemblies, which are not political in the usual sense, that gather a public around things—scientific laboratories, supermarkets, churches, and disputes involving natural resources like rivers, landscapes, and air. The authors of Making Things Public—and the ZKM show that the book accompanies—ask what would happen if politics revolved around disputed things. Instead of looking for democracy only in the official sphere of professional politics, they examine the new atmospheric conditions—technologies, interfaces, platforms, networks, and mediations that allow things to be made public. They show us that the old definition of politics is too narrow; there are many techniques of representation—in politics, science, and art—of which Parliaments and Congresses are only a part. The authors include such prominent thinkers as Richard Rorty, Simon Schaffer, Peter Galison, Richard Powers, Lorraine Daston, Richard Aczel, and Donna Haraway; their writings are accompanied by excerpts from John Dewey, Shakespeare, Swift, La Fontaine, and Melville. One of the contemporary results of Germany’s memorial conundrum is the rise of its “counter-monuments”: brazen, painfully self-conscious memorial spaces conceived to challenge the very premises of their being. On the former site of Hamburg’s greatest synagogue, at Bornplatz, Margrit Kahl has assembled an intricate mosaic tracing the complex lines of the synagogue’s roof construction: a palimpsest for a building and community that no longer exist. Norbert Radermacher bathes a guilty landscape in Berlin’s Neukölln neighborhood with the inscribed light of (...) its past. Alfred Hrdlicka began a monument in Hamburg to counter—and thereby neutralize—an indestructible Nazi monument nearby. In a suburb of Hamburg, Jochen Gerz and Esther Shalev-Gerz have erected a black pillar against fascism and for peace designed to disappear altogether over time. The very heart of Berlin, former site of the gestapo headquarters, remains a great, gaping wound as politicians, artists, and various committees forever debate the most appropriate memorial for this site.4 4. The World Medical Association (WMA), the global representation of the medical profession, first adopted the International Code of Medical Ethics (ICoME) in 1949 to outline the professional duties of physicians to patients, other physicians and health professionals, themselves and society as a whole. The ICoME recently underwent a major 4-year revision process, culminating in its unanimous adoption by the WMA General Assembly in October 2022 in Berlin. This article describes and discusses the ICoME, its revision process, the controversial and (...) uncontroversial issues, and the broad consensus achieved among WMA constituent members, representing over 10 million physicians worldwide. The authors analyse the ICoME, including its response to contemporary changes and challenges like ethical plurality and globalisation, in light of ethical theories and approaches, reaching the conclusion that the document is a good example of international ethical professional self-regulation. In this work we study, design, and evaluate computational methods to support interpretation of statutory terms. We propose a novel task of discovering sentences for argumentation about the meaning of statutory terms. The task models the analysis of past treatment of statutory terms, an exercise lawyers routinely perform using a combination of manual and computational approaches. We treat the discovery of sentences as a special case of ad hoc document retrieval. The specifics include retrieval of short texts, specialized (...) class='Hi'>document types, and, above all, the unique definition of document relevance provided in detailed annotation guidelines. To support our experiments we assembled a data set comprising 42 queries which we plan to release to the public in the near future in order to support further research. Most importantly, we investigate the feasibility of developing a system that responds to a query with a list of sentences that mention the term in a way that is useful for understanding and elaborating its meaning. This is accomplished by a systematic assessment of different features that model the sentences’ usefulness for interpretation. We combine features into a compound measure that accounts for multiple aspects. The definition of the task, the assembly of the data set, and the detailed task analysis provide a solid foundation for employing a learning-to-rank approach. (shrink)

This article discusses ‘Notes on Language Games’, written by Harold Garfinkel in 1960 and never before published, one of three distinct versions of his famous ‘Trust’ argument, i.e., that constitutive criteria define shared events, objects, and meanings. The argument stands in contrast to an approach to cultural anthropology that was becoming popular in 1960 called ‘ethnoscience’. In this previously unknown manuscript, Garfinkel proposes that cultural events and language events are the same, in that both are created through constitutive commitments to (...) interactional systems. The best-known version of the Trust argument (Garfinkel, 1963) emphasizes Schutz, while other versions build on Parsons (Garfinkel 2019). In this third version, the Trust conditions are elaborated in terms of Wittgenstein’s language games. Various strands of Garfinkel’s thinking about culture, language and interaction are interwoven. That Garfinkel was working with Parsons in 1960 to document a contractual basis for social events and their assembly practices in ‘systems of interaction’, a constitutive practice argument with roots in Durkheim’s work, is yet another strand. The article highlights how the Trust argument is the key to everything, not only ethnomethodology, but also Garfinkel’s attempt to develop a general sociology of culture, language and interaction. Contributors to the 2016 Special Issue of Discourse Studies on the ‘Epistemics of Epistemics’ claim that studies of epistemics in interaction have lost the ‘radical’ character of groundbreaking work in ethnomethodology and conversation analysis. We suggest that the critiques and related writings are a kind of mandarin EM, lacking an adequate definition of ‘radical’, other than to invoke brief and by now familiar statements from Garfinkel and Sacks regarding the pursuit of ‘ordinary everyday activities’ and the avoidance of ‘formal analysis’. (...) Drawing on Egon Bittner’s work, we further suggest that the EoE group shares properties and problems common to social movements claiming the mantle of radicalism. Because of their particular focus on CA and Harvey Sacks’ early work, we also demonstrate that Sacks was not, as asserted, preoccupied with the singularity of occasions. Rather, from his earliest available work, Sacks pursued trans-situational aspects of sequential organization, and documented these not only through single cases but also through the comparative analysis of specimen collections. We conclude by considering how EM and CA are compatible endeavors, both in their engagement with traditional research topics – or what Garfinkel called ‘asymmetric alternates’ – and in their appreciation of generic features implicated in the assembly of social actions and social worlds. This implies a relationship of mutual interchange between EM and CA. (shrink)

Albany: State University of New York Press, 2007. xi + 228 pp.The existence of the “Universal Declaration of Human Rights by the World’s Religions” (UDHRWR) deserves to be more widely known, and this book not only reproduces the text, drawn up for a conference in Montreal to (...) mark the fiftieth anniversary of the UN’s Universal Declaration of Human Rights (UNUDHR, 1948), but offers a point-by-point comparison of the two documents by Frances Adeney and a series of papers that illuminate the issues raised by such declarations from very different points of view. The premise of the whole undertaking is that religious perspectives were not adequately represented in the UN Universal Declaration of Human Rights, though even this is questioned by some of the contributors. The UDHRWR explicitly mentions the right to change one’s religion, asserting in article 18 (1): “There shall be no compulsion in religion. It is a matter of choice,” and it includes “the rights of nature and the earth” (art. 29 [1]; see also 24 [2]). Article 12 (4 and 5) also asserts the duty and the corresponding right of not denigrating the religions of others. Article 16 (5) mentions monasticism as an institution worthy of protection alongside marriage. [End Page 172]In an extremely detailed examination of the work of the Third Committee, which brought the original UN document to the floor of the General Assembly, Sumner B. Twiss finds abundant evidence that religious issues were debated at great length, with great respect, and from a wide range of cultural and religious backgrounds. The committee included representatives of Christian, Confucian, Marxist, Hindu, Buddhist, and Muslim traditions, and Twiss claims that it is a mistake to regard the document they produced as either Western or secular in intent. The question of the relationship between rights and duties was thoroughly debated, as were the social dimensions of both and the underlying theological and ideological issues. Although religious terminology was eventually omitted, this was agreed in an atmosphere of exemplary tolerance and mutual understanding. Twiss concludes: “The UDHRWR is redressing a nonexistent problem presumably posed by the UDHR” (p. 69).Nevertheless, in the present context of the desecularization or resacralization of the world, a more explicit treatment of religious aspects of human rights seems appropriate, and the papers collected here raise problems that are still with us. Frances Adeney introduces several of them: the distinction between public and private spheres, the relative weighting given to creation and sin, and the relationship between rights and duties. The specifically Christian contribution to the debate, in her view, is the insistence on the universality of human rights derived from the biblical conception of the human as the “image of God,” so that “Christians through the ages have assigned a transcendent worth to human beings” (p. 20). The dimension of community is signaled by the extension of the covenant from ethnic group to faith community, thus linking the covenant family of God to the unity of humankind. Whether this link is strong enough to secure the universality of human rights, however, remains an open question.The Christian ethicist Max Stackhouse counterposes to this the “profound individualism” implicit in human rights thinking: it is this, rather than abstract or absolute universals, that lays the basis for civil society and, in its Christian variants, “provides the safest havens for non-Christian religions to flourish without political control” (p. 49). It is the rights of each individual, not of communitarian entities, that are to be respected. The religions tend to be particularistic, but this does not mean that the sources of human rights thinking are necessarily secular humanist. Stackhouse leaves us with two very significant questions: “... whether we can form a global civil society that does not have a theologically based inner moral architecture,” and whether “human rights principles become more effective without attention to their roots and justifying ultimate legitimations” (p. 50). That the issue of racism is a pressing social concern which requires serious and detailed attention is, for ethnomethodology, not a first principle from which its own inquiry is launched but rather a matter to be considered in light of how mundane actors (both professional and lay) treat that very topic. This paper explores how the assumption of an ontological distinction between social structure and individual agency is integral to the intelligibility of racism as formulated in scholarly accounts. In particular, (...) I explore how recent scholarly treatments of racism pose as problematic the diverse formulations of racial identity assembled through the deployment of various measures, and then seek to adjudicate upon the resulting inconsistency with an analytic heuristic that assumes an underlying or foundational source for the various expressions it seeks to resolve. Further, I explore examples of analytic work that makes use of first-person accounts of racially significant episodes and experiences as a means to document the formulation of the events and actions those accounts describe in terms that warrant a reading informed by the assumption of the structure-agency distinction. I relate the corroborative work that takes place in the research relationships between students and teachers with ethnomethodology’s own project to explore how the efficaciousness of analytic readings of racism entail the pervasive assumption of the structure-agency distinction in order to be rendered them with the sense they have for the various participants involved. Background: An effectiveness assessment on ASCT in locally advanced and metastatic breast cancer identified serious ethical issues associated with this intervention. Our objective was to systematically review these aspects by means of a literature analysis. Methods: We chose the reflexive Socratic approach as the review method using Hofmann's question list, conducted a comprehensive literature search in biomedical, psychological and ethics bibliographic databases and screened the resulting hits in a 2-step selection process. Relevant arguments were assembled from the included articles, and (...) were assessed and assigned to the question list. Hofmann's questions were addressed by synthesizing these arguments. Results: Of the identified 879 documents 102 included arguments related to one or more questions from Hofmann's question list. The most important ethical issues were the implementation of ASCT in clinical practice on the basis of phase-II trials in the 1990s and the publication of falsified data in the first randomized controlled trials (Bezwoda fraud), which caused significant negative effects on recruiting patients for further clinical trials and the doctor-patient relationship. Recent meta-analyses report a marginal effect in prolonging disease-free survival, accompanied by severe harms, including death. ASCT in breast cancer remains a stigmatized technology. Reported health-related-quality-of-life data are often at high risk of bias in favor of the survivors. Furthermore little attention has been paid to those patients who were dying. Conclusions: The questions were addressed in different degrees of completeness. All arguments were assignable to the questions. The central ethical dimensions of ASCT could be discussed by reviewing the published literature. (shrink)

On 5 August 1968, publication of the Harvard Committee’s report on the subject of “irreversible coma” established a standard for diagnosing death on neurological grounds. On the same day, the 22nd World Medical Assembly met in Sydney, Australia, and announced the Declaration of Sydney, a pronouncement on death, which is less often quoted because it was overshadowed by the impact of the Harvard Report. To put those events into present-day perspective, the authors reviewed all papers published on this subject (...) and the World Medical Association web page and documents, and corresponded with Dr A G Romualdez, the son of Dr A Z Romualdez. There was vast neurological expertise among some of the Harvard Committee members, leading to a comprehensible and practical clinical description of the brain death syndrome and the way to diagnose it. This landmark account had a global medical and social impact on the issue of human death, which simultaneously lessened reception of the Declaration of Sydney. Nonetheless, the Declaration of Sydney faced the main conceptual and philosophical issues on human death in a bold and forthright manner. This statement differentiated the meaning of death at the cellular and tissue levels from the death of the person. This was a pioneering view on the discussion of human death, published as early as in 1968, that should be recognised by current and future generations. (shrink)

Ḥadīths have been preserved and recorded in various ways since the Companions. These activities continued dur-ing the Tābiīn (the successors of the Companions) Period. So much so that these methods have formed the infra-structure of other methods that will emerge later. In this context, before the 70's (A.H.), works named al-Aṭrāf appeared. However, these first works consisted of the notes that they wrote some of the ḥadīths before coming to the science assemblies to help students remember in ḥadīth learning. Ḥadīth (...) scholars have adopted and applied this method in a very short time. Thus, this method also provided the opportunity for the formation of the first written ḥadīth documents. In addition, with the writing of ḥadīth works, it has turned into a system of al-Taṣnīf and al-Takhrīj in order to make maximum use of these books and to reach the source of a narration that is tried to be found. As a result, al-Aṭrāf literature, which can be evaluated as index, has emerged. As a matter of fact, the first examples of this literature, arranged alphabetically according to the names of the Companions or ḥadīth texts, started to be given since the 4th (A.H.) century. In this way, the way to quickly benefit from the accumulation of the ḥadīth area has been opened. This article focuses on the historical adventure of al-Aṭrāf and their contributions to the ḥadīth field, as well as literature knowledge of the works of al-Aṭrāf which are of great importance for both al-Kitābah, al-Taṣnīf and al-Takhrīj.Summary: In order to understand and practice the religion of Islām, great efforts have been made both in the past and later periods in order to convey the words, verbs, interpretations and qualifications of the Prophet to the next genera-tions as they are protected from all kinds of falsification and changes. This process, which started with memoriza-tion and partly writing at the beginning, has gained momentum with the use of other methods since the period of Tābiīn. In this context, the method of aṭrāf was started to be used to facilitate memorization, to be a reminder, and to transmit the ḥadīth through the hearing of the ḥadīth sheikh. The first examples of this method were seen by Muḥammad b. Sīrīn during his participation of his teacher Abīde/Ubayda Salmān in the scholarly assembly. At this stage, the relevant method was manifested as writing a passage from the beginning of the ḥadīth. Thus, the aforementioned method, which had great contributions in recording and memorizing ḥadīths in accordance with the original, has gained widespreadness and application among the ḥadīth scholars like Ubeydullaḥ b. Omar, Shu’bah b. al-Ḥajjāj, Sufyān as-Sawrī, Mālik b. Anas, Ismāīl b. Ayyāş and Vakī b. Jarrāḥ in a very short time. In this context, Yazīd b. Zuray’ stated that he went to his teacher without his aṭrāf work of ḥadīths which he transmitted from Shu’bah and listened to ḥadīth in this way. Therefore, this mentioned event is important in terms of putting forth that Shu’bah allowed the aṭrāf method in his assemblies. The method was used by Aḥmad b. Ḥanbal, who traveled to Madīnah to convey the reports recorded with the mentioned method of his teacher Abū Alḳama al-Farawī and at the same time listen to the related transfers from him, but who could not reach his goal. Therefore, the related narrations show that aṭrāf method was used effectively by ḥadīth scholars to remember the ḥadīths in the 1st and 2nd centuries, so sections from the narrations were written during the preparatory stage before coming to the scholarly assembly. Ultimately, the importance of these works, which manifest in different ways and offer great contributions to writing, is an undeniable reality for the history of ḥadīth.Aṭrāf, the plural form of taraf that literally means the side and edge of something, mean a section, phrase or first part that indicates the whole of the ḥadīth. This method, along with the formation of ḥadīth literature, has been started to be given as a name to the works organized alphabetically according to the name of the Companions or ḥadīth texts by mentioning some of the ḥadīths with the 4th century. In this sense, aṭrāf has started to become a unique literature in a sort of taṣnīf and takhrīj method in order to make use of the ḥadīth writing easier.Aṭrāf studies may aim to bring together the isnāḍs (chains of transmitters) in all books, or they can be limited to the chains in certain books. Aṭrāf books contain the ḥadīths in the Ṣaḥīḥān or Kutub al-Sittah and are written in alphabetical form based on the name of the companions or according to the texts of ḥadīth. The first of these, which has the attribute of the musnad in a sense, is arranged in alphabetical order according to the name of the Companion, and if there are many people who narrate from him, according to the names of the tābiīn and taba-i tābiīn (successors of the tābiīn). Accordingly, the narrations of each companion were determined and listed in al-phabetical order in aṭrāfs in musnad-type, and a passage was written from the ḥadīths and marked as books/chapters in the places of relevant narration. On the other hand, the second type of aṭrāf books were ar-ranged by giving a few words from a section that allows remembering the head or all of the ḥadīths without in-cluding chains, and then placing these texts in alphabetical order.The type of aṭrāf offers the opportunity to see different chains of narrations together and provides many facilities for the ḥadīth researchers. Therefore, ḥadīth researchers show great interest in this genre. Aṭrāfs provide many benefits for both ḥadīth chain and text. In this respect, it is possible to talk about many advantages of the ḥadīth to its transmister such as the determination of mutawātīr, garīb, azīz, mashhūr, mutābī or the testimony of ḥadīth; to provide facility to make a reputation research of a riwāyah (narration), to provide an opportunity to determine the location of the narrations in the primary sources; to detect the link or any blackout in the chain, to reach the nu-merical knowledge of ḥadīth narrated by a companion or other narrators, to obtain information about narrators whose identity is not explicitly stated, to know the first narrator, to provide the protection of the ḥadīths from taḥrīf or alteration, to give the opportunity to identify the subject they contain, to be able to obtain text integrity by getting various chains, the detection of the sabab al-wurūd (the context of ḥadīth).Due to the contributions we have mentioned above, many books on aṭrāf literature that started with Abu’l-Ḥasen Ali b. Omar ad-Dārakutnī have been published. Among them Aṭrāfu’s-ṣaḥīḥayn/el-Jem`u bayna’s-ṣaḥīḥayn by Abū Mas`ūd Ibrāhīm b. Muḥammad b. Ubayd ad-Dimashkī, Aṭrāfu’s-ṣaḥīḥayn by Abū Muḥammad Ḥalaf b. Muḥammad b. Ali al-Vasiṭī, Zaḫāiru’l-mavārīs fi’d-dalālati alā mavāzi`i’l-hadīs by Abdülganī b. İsmāīl en-Nāblūsī and Tuḥfatu’l-ashrāf bi ma`rifati’l-aṭrāf by Abu’l-Ḥajjāj Yūsuf b. Abdurrahman el-Mizzī can be mentioned. Some of the related works are arranged in musnad style while others are arranged according to the first word of ḥadīth texts. As a result, the method of aṭrāf has become a kind of indexer in order to facilitate reaching the source of the re-ports and make the highest level of use required by the classification and bookings of the ḥadīths in the 3rd centu-ry. These works, arranged alphabetically in the name of the Companions or according to the texts of the ḥadīth, have taken their place in the history of the ḥadīth with their many examples, both in the form of taṣnīf and the method of takhrīj by mentioning a part of the ḥadīth by the head. In this introduction to The Journal of Aesthetics and Art Criticism special issue on the aesthetics of creative activism, we canvas influential scholarship of political aesthetics to sculpt a broad typology of six interconnected mechanisms by which art might intervene in the world. We label these: Documentation, Disruption, Recognition, Participation, Imagination, and Beauty. Each has a compelling tradition of theory and application, augmented, extended, and sometimes challenged by the thirteen fresh and provocative contributions in the special issue. Yet, we ask, (...) if both politically minded artists and culturally minded activists are convinced of the power of art to provoke social change, and if we live a world that by almost all measures is now saturated with politically inclined, aesthetically informed practices, interfaces, objects, and texts, why does art not seem to be making a difference? In the summer of 2015 the governor of Wisconsin signed an omnibus budget bill that, among other things, removed tenure from state statute—forcing the Board of Regents to rewrite it into board policy documents—and attempted to undermine aspects of shared governance that had been part of life at the university since the founding of the system in the early 1970s. Two years later, the Wisconsin Assembly passed a bill that directed the university to "strive to remain neutral on the (...) public policy controversies of the day". In __Unearthed: The Economic Roots of Our Environmental Crisis_, _Kenneth M. Sayre argues that the only way to resolve our current environmental crisis is to reduce our energy consumption to a level where the entropy produced by that consumption no longer exceeds the biosphere’s ability to dispose of it. Tangible illustrations of this entropy buildup include global warming, ozone depletion, loss of species diversity, and unmanageable amounts of nonbiodegradable waste._ Degradation of the biosphere is tied directly to human energy use, (...) which has been increasing exponentially since the Industrial Revolution. Energy use, in turn, is directly correlated with economic production. Sayre shows how these three factors are invariably bound together. The unavoidable conclusion is that the only way to resolve our environmental crisis is to reverse the present pattern of growth in the world economy. Economic growth is motivated by social values. Key among them are the desire for wealth and consumer values including gratification, convenience, and acquisition of goods. Sayre maintains that economic growth can be reversed only by eliminating these social values in favor of others more conducive to environmental health. Eliminating these values will involve major changes in lifestyle within industrial societies generally. Only with such changes in lifestyle, he argues, does human society as we know it have a chance of survival. GILBERT University ol CaliIornia, Davis A "Nsw" DESCARTESEDITION?* Few definitive editions of a great philosopher's works have been more successful and influential than the Descartes edition which Charles Adam and Paul Tannery launched in 1896 and which Adam completed alone in 1913, long after the death of his collaborator and friend. The prestige of AT (as the edition is commonly called) is such that its texts in practice supersede even the originals? But this monument to French scholarship is now half a century old--almost seventy years old if we consider the date of the first volume. AT has always been a difficult edition to work with. Texts and comments that belong together are not infrequently scattered through its twelve massive volumes and the Supplement (AT XIII), chiefly because the launching of this edition stimulated a new search and resulted in the finding of documents and in critical work that had to be incorporated as the edition went along. Although what is now known as the Entretien avec Burman had already been discovered when AT got under way, the user will find no reference to it in the tables of contents or even in the list of Descartes' works in AT XIII. It is buried in AT V among the correspondence, and only Adam's own separate edition of it, with his French translation of the original [86], has assured this remarkable document of the wide readership it deserves. By now, AT is also woefully incomplete; important new material has been found since 1913, notably the bulk of Descartes' correspondence with Constantijn Huygens, and the Ballet for Queen Christina * (Editor's note. The recent proliferation of AI scandals led private and public organisations to implement new ethics guidelines, introduce AI ethics boards, and list ethical principles. Nevertheless, some of these efforts remained a façade not backed by any substantive action. Such behaviour made the public question the legitimacy of the AI industry and prompted scholars to accuse the sector of ethicswashing, machinewashing, and ethics trivialisation—criticisms that spilt over to institutional AI ethics boards. To counter this widespread issue, contributions in the literature have (...) proposed fixes that do not consider its systemic character and are based on a top-down, expert-centric governance. To fill this gap, we propose to make use of qualified informed lotteries: a two-step model that transposes the documented benefits of the ancient practice of sortition into the selection of AI ethics boards’ members and combines them with the advantages of a stakeholder-driven, participative, and deliberative bottom-up process typical of Citizens’ Assemblies. The model permits increasing the public’s legitimacy and participation in the decision-making process and its deliverables, curbing the industry’s over-influence and lobbying, and diminishing the instrumentalisation of ethics boards. We suggest that this sortition-based approach may provide a sound base for both public and private organisations in smart societies for constructing a decentralised, bottom-up, participative digital democracy. This article will address the overall responsibilities and current projects relating to human subject protections.OPRR implements the Department of Health and Human Services' (HHS) regulations for the protection of human subjects (45 CFR (...) 46 (1991)). These regulations fulfill the responsibilities set forth in the Public Health Service (PHS) Act with regard to institutional review boards (IRB) and other protections for human subjects involved in biomedical and behavioral research conducted or supported by HHS. The PHS Act also mandates a program to clarify ethical issues in biomedical research involving human subjects and to address violations of the rights of human subjects of research (P.L. 99-158 (1985)).OPRR staff negotiate assurances of compliance with institutions conducting Federally-supported research involving human subjects. The assurances describe the policies and procedures each institution will follow to fulfill the requirements of the regulations, including specific IRB composition and functions.In addition, OPRR cosponsors with the Food and Drug Administration and awardee institutions a series of regional workshops that address human subject protections issues. These are attended by IRB members, institutional officials, research investigators, and others involved with human subject protections.Current ActivitiesNumerous activities are underway in OPRR. Prowse, Christopher C On 27 October 2010, His Holiness, Pope Benedict XVI, announced that the topic for the XIII Ordinary General Assembly in Rome (7-28 October 2012) would be 'The New Evangelisation for the Transmission of the Christian Faith.' This was not entirely unexpected given the importance this topic has generated in the documents of the Second Vatican Council, and in the teachings of Popes Paul VI, John Paul II and now Benedict XVI. Clearly, with the establishment of the (...) ad hoc dicastery (21 September 2010) on evangelisation, the Holy Father, Benedict XVI, wishes to raise the promotion of this vital topic to an even higher level. Jan Kavan was one of the most active émigrés who fled Czechoslovakia after the 1968 Soviet-led invasion that crushed the Prague Spring. As his mother was British, Kavan settled in London. A devout socialist, he founded the Palach Press Agency and established a smuggling network for circulating banned literature to and from Czechoslovakia. Kavan was also active in the European Nuclear Disarmament movement. On his return to Czechoslovakia in 1990, Kavan held several important posts, including that of foreign minister of (...) the Czech Republic and president of the General Assembly of the United Nations. Based largely on archival documents, this essay sheds light on some of the more controversial aspects of Kavan’s personality, life, and work. (shrink)

This article seeks to show Pope Francis’ position, right from the beginning of his pontificate, and what he expects from the Roman Catholic Church in relation to LGBT people. In order to do that, some documents of his pontificate are analyzed in relation to this theme. Among them: Community of Community: A new Parish, Preparatory for the III Assembly, III Extraordinary General Assembly of the Synod of Bishops, XIV Ordinary General Assembly, Encyclical Letter Laudato Si, Post-Synodal Exhortation (...) Amoris Latitia etc. Then, we try to understand the meaning of Francisco's gestures, and to understand which church he wants. What changes and perspectives may occur between the Church and LGBT people, based on the Second Vatican Council, which the pope attempts to bring back, and the unconditional love of God found in the gospels. It is important to remember that in Francis' pontificate, dialoguing, welcoming, integrating, and finding points to come together in favor of life, especially the lives of the most vulnerable, is always very important. The first is an archival case/place: a partial assembly of documents of beats and their uses during and in the wake of Gay Liberation in Australia. The second is a literary case/place: Thomas Mann's Death in Venice, a canonical twentieth-century imbrication of male homosexuality and geography. This article will seek to rationalize the mobilization of these two asynchronous cases/places through the (...) insights that both afford, when brought together, for elaborating contributions that queer readings of Nietzsche can make to contemporary queer theories of space, time and masculinities. Not referring to clinical schizophrenia, but to the fact that the culture is divided up into all sorts of classes and groups, etc., and that some of the old lines are breaking down. And that this is a healthy sign. -- William Burroughs, from _Schizo-Culture_ The legendary 1975 "Schizo-Culture" conference, conceived by the early Semiotext collective, began as an attempt to introduce the then-unknown radical philosophies of post-'68 France (...) to the American avant-garde. The event featured a series of seminal papers, from Deleuze's first presentation of the concept of the "rhizome" to Foucault's introduction of his _History of Sexuality_ project. The conference was equally important on a political level, and brought together a diverse group of activists, thinkers, patients, and ex-cons in order to address the challenge of penal and psychiatric institutions. The combination proved to be explosive, but amid the fighting and confusion "Schizo-Culture" revealed deep ruptures in left politics, French thought, and American culture. The "Schizo-Culture" issue of the Semiotext journal came three years later. Designed by a group of artists and filmmakers including Kathryn Bigelow and Denise Green, it documented the chaotic creativity of an emerging downtown New York scene, and offered interviews with artists, theorists, writers, and No Wave and pre-punk musicians together with new texts from Deleuze, Foucault, R. D. Laing, and other conference participants. This slip-cased edition includes _The Book: 1978_, a facsimile reproduction of the original Schizo-Culture publication; and _The Event: 1975_, a previously unpublished and comprehensive record of the conference that set it all off. The Islamic education curriculum in Indonesia tends to be partial and dichotomous. However, Muhammadiyah has reformed the holistic–integrative curriculum as a solution for the sustainability of education. This study aims to reveal a special curriculum reform in the holistic–integrative Muhammadiyah education system to solve the dichotomous problems and the inadequacy in the Islamic education curriculum in Indonesia. Furthermore, the study describes a specific curriculum model that includes all aspects of students’ personality and integrates science and technology with Islamic values. Data (...) were collected from previous studies and special curriculum documents of Al-Islam, Kemuhammadiyahan and Arabic Language (ISMUBA). Curriculum documents were obtained from elementary, junior and Muhammadiyah senior high school, published by Primary and Secondary Education Assembly of Muhammadiyah Central Board in 2017. Data analysis used a content model with a systematic and rational framework. The results showed that the special reform curriculum based on the holistic–integrative model develops students’ potentials, including spiritual, emotional, intellectual and transcendental intelligence, in an integrated manner. Contribution: The holistic–integrative curriculum is a future Islamic education model for the sustainability of private Islamic education system in Indonesia that can form a good, faithful, pious and a noble community. Magna Carat is a foundation of the powers of Parliament and the legal principles, as the rule of law, the rule that everybody has equality before the law. It promised the access to justice. In that respect Magna Carta is still a challenge for many states and officials. The myth of Magna Carta is the protection of the personal rights and is held in great respect by the legal communities against the arbitrary of the authority In respect of the aim of this international conference to see the way how these principles have found their implementation in contemporary legislations as well as to identify the problems that occur regarding these rights, an overview of the Albanian right to appeal for the social insurance rights.
