Scandals involving celebrities’ moral transgressions are common in both Western and Eastern cultures. Existing literature, however, has been primarily based on Western cultures. We examine differences between South Korea and the United States in consumers’ support for celebrities engaged in moral transgressions and for the brands they endorse. Across six studies, we find that Korean consumers show lower support for celebrities who engaged in moral transgressions. This effect occurs because Korean consumers have a stronger belief that an individual’s competence (...) and morality are interconnected. Thus, Korean consumers are less likely to separate their judgments of celebrities’ morality and competence in professional performance, thereby lowering support for the celebrities. Building on the proposed mechanism, we identify the moderating role of transgression relevance. When a moral transgression is relevant to the domain of the celebrity’s professional competence, the difference in celebrity support between the two countries is attenuated. This difference extends to the support for a brand endorsed by the celebrity transgressor when the brand retains the celebrity endorser, but not when the brand dismisses the endorser. (shrink)

How do we deal with difference personally, interpersonally, nationally? Can we weave a cohesive social fabric in a religiously plural society without suppressing differences? This collection of significant essays suggests that to truly honour differences in matters of faith and religion we must publicly exercise and celebrate them. Towards an Ethics of Community introduces readers to some of the most challenging and divisive dilemmas we face in this increasingly pluralistic, postmodern world — issues such as family and domestic violence, Aboriginal rights, homosexuality and public policy, and female genital mutilation. Personalised learning systems—systems that predict learning needs to tailor education to the unique learning needs of individual students—are gaining rapid popularity. Praise for educational technology is often focused on how technology will benefit school systems, but there is a lack of understanding of how it will affect the student and the learning process. By uncovering what the meaning of ‘personal’ is in educational philosophy and as embodied in the technology, we illustrate that these two understandings are different regarding the autonomy (...) of the student. Personalised learning technology, therefore, bears the risk of failing to achieve its educational ideal of what personalisation should be. We also illustrate how personalised learning technology effects student autonomy by requiring the intensive tracking of the learning process, exposing them to privacy and data protection risks. We do not claim that education does not need technology, but we want to illustrate the importance of values as drivers of innovation. (shrink)

We routinely need to process the identity of many faces around us, and how the brain achieves this is still the subject of much research in cognitive neuroscience. To date, insights on face identity processing have come from both healthy and clinical populations. However, in order to directly compare results across and within participant groups, and across different studies, it is crucial that a standard task is utilised which includes different exemplars (for example, non-face stimuli along with faces), is memory-neutral, (...) and taps into identity recognition across orientation and across viewpoint change. The goal of this study was to test a previously behaviourally tested, optimised face and object identity matching design in a healthy control sample whilst being scanned using fMRI. Specifically, we investigated categorical, orientation, and category-specific orientation effects while participants were focused on identity processing of simultaneously presented exemplar stimuli. Alongside observing category and orientation specific effects in a distributed set of brain regions, we also saw an interaction between stimulus category and orientation in the bilateral fusiform gyrus and bilateral middle occipital gyrus. Generally these clusters showed the pattern of a heightened response to inverted, as opposed to upright faces; and to upright, as opposed to inverted shoes. These results are discussed in relation to previous studies and to potential future research within prosopagnosic individuals. (shrink)

After the French Revolution, the codification movement led to the introduction of the Dutch Civil Code and the Commercial Code of 1838. These codifications were generally regarded as the bedrock of a dogmatic system in which little space was left for customs and customary law. Mercantile jurists, such as Holtius and Levy, were opponents of the legalistic approach of the new codifications. They tried to separate mercantile law from civil law in order to protect mercantile law from excessive legalistic influences. (...) According to them, mercantile law was characterised by internationality, custom as its main source of law, continuity through an extended mercantile legal history and by good faith and mutual trust between the merchants. Out of these, the historicity and homogeneity of a strong community of merchants are particularly in line with a traditional and conservative view on society. Holtius and Levy, however, had little in common with their Christian-conservative contemporaries. On the one hand, they rather seemed to foreshadow the kind of liberal-conservatism as expressed by Hayek during the 20th century. On the other hand, their ideas have much in common with different lex mercatoria –traditions developed by authors as Goldman and Schmitthoff. On the aspects of historicity and internationality Holtius and Levy seem to have much in common with Hayek whereas concerning communality and the legal nature of customary law there are more similarities with the lex mercatoria-traditions. This study aimed to evaluate if eye blinks can be used to discriminate players with different performance in a session of Nintendo Entertainment System (NES) Tetris. To that end, we developed a state-of-the-art method for blink extraction from EAR measures, which is robust enough to be used with data collected by a low-grade webcam such as the ones widely available on laptop computers. Our results show a significant decrease in blink rate per minute (blinks/m) during the first minute of playing (...) Tetris. After having defined 3 groups of proficiency based on in-game performance (Novices, Intermediates, and Experts) we found out that expert players display a significantly lower decrease in blinks/m compared to novices during the first minute of gameplay, which shows that Tetris players' proficiency can be detected by looking at eye blinks/m variations during the early phase of a game session. This difference in blinks/m is observed throughout the entire game session, which supports the general conclusion that proficient Tetris players have a lower decrease in blinks/m, even when playing more difficult levels. Finally, we offer some interpretations of this effect and the relationship that our results may have with the visual cognitive workload experienced during the gameplay. (shrink)

Kant's epistemology and the Buddhist philosophy are an idealism. But these two different philosophies have in themselves the contradictory element, namely the element of the outer sense of bodies and of the inner mind. Although Kant's transcendental idealism and the school Vijnanavadin (唯識學派) acknowledge only the representations and the consciousnesses., the mind need to be affected by the outer part. In Kant's theoretical philosophy the outer sense of bodies plays an alien role. It stands outside the subject. In spite of (...) this, the subject have to relate itself to the outer element. And in the Buddhism, in order to have consciousnesses, the subject have to be transformed from the fundamental ground, the Alayavijnana (第8 識). But the Alyavijnana need to have a certain moment in order to be transformed. In my paper I have concentrated myself on the problem of relation of the mind to the matter. I have tried to see into the way in which these two philosophies develop this relation. Moreover I am also interested in the problem in relation to the theoretical, practical, and aesthetical fields. In the past 20 years, the concept of instinct has been discussed in respect to various disciplines such as evolutionary biology, evolutionary psychology, linguistics, ethics, aesthetics, and phenomenology, etc. However, the meaning of instinct still remains unclarified in many respects. In order to overcome this situation, it is necessary to elucidate the genuine meaning of instinct so that the discussion of instinct in these disciplines can be carried out systematically. The objective of this paper is to establish the genuine concept (...) of instinct on the basis of a phenomenological criticism of A. Gehlen’s theory of instinct-reduction. Moreover, it seeks to show that this concept is the genetic origin of the embodied consciousness. According to Gehlen, instinct is defined as Instinkthandlung. However, this definition of instinct is problematic in the formal logical sense, since the definiendum is already included in the definiens. Moreover, it faces different kinds of serious material problems. Criticizing Gehlen’s theory of instinct systematically, I will show that instinct should be redefined as “the innate living force that urges a species of living being to pursue a certain kind of object,” and I will attempt to clarify this definition of instinct in a more detailed manner by offering 11 points. Thereafter, I will argue that Gehlen’s theory of instinct-reduction has to be replaced by the theory of instinct-enlargement in human beings. Finally, I will point out that the genuine concept of instinct is nothing other than the genetic origin of the embodied consciousness. (shrink)

Based on in-depth interviews with 18 Korean immigrant working couples, this study explores Korean immigrant working wives' ongoing challenge to male dominance at home and to the unequal division of family work. A main factor in wives' being less obedient to their husbands is their psychological resources such as pride, competence, and honor, which they gain from awareness of their contribution to the family economy. Under immigrant family circumstances in which working for family survival is prioritized, wives feel that their (...) negligence of family work, rejection of the superwoman ideal, and perceived right to demand their husbands' help with family work is legitimized. However, Confucian patriarchal beliefs lead these wives to place limits on the degree of challenge. The findings highlight the interplay of wives' psychological resources, gender norms, and the social standing of being immigrant families in affecting wives' challenge to gender inequality at home. Differences in effects among Korean immigrant families are explored. (shrink)

Like any construction of the human mind, ideologies and utopias are products of reason and social imagination. The human interactions they feed off are nowadays being intensified by processes of globalization. Utopian projects, which are by nature ambitious, consist of dreams of freedom and equality but the voluntarist character of their implementation very often takes them far from their declared objectives. Thus utopia frequently tips over into ideology. In order to survive, utopia has to go through a process of ‘universalization’ (...) that allows ideas from different cultures to develop and mature in contact with one another. By forging bonds between individuals and cultures, this process could define the outlines of a constantly evolving global civil society. Universalization of conceptualizations that transform and motivate us, such as the global inclusivity of human rights, freedom and justice, builds an ethic of peace for the emergence, beyond frontiers, of an extended society such as that envisioned by the American philosopher John Dewey. Experiments using a preferential looking method, a perceptual judgment method, and a predictive judgment method investigated the development, from 7 months to 6 years of age, of sensitivity to the effects of gravity and inertia on inanimate object motion. The experiments focused on a situation in which a ball rolled off a flat surface and either continued in linear motion (contrary to gravity), turned abruptly and moved downward (contrary to inertia), or underwent natural, parabolic motion. When children viewed the three (...) fully visible motions, both the preferential looking method and the perceptual judgment method provided evidence that sensitivity to inertia developed between 7 months and 2 years, and that sensitivity to gravity began to develop after 3 years. When children predicted the future location of the object without viewing the motions, the predictive judgment method provided evidence that sensitivity to gravity had developed by 2 years, whereas sensitivity to inertia began to develop only at 5±6 years. These findings suggest that knowledge of object motion develops slowly over childhood, in a piecemeal fashion. Moreover, the same system of knowledge appears to be tapped both in preferential looking tasks and in judgment tasks when children view fully visible events, but a different system may underlie children's inferences about unseen object motions. Biobanking in Europe has made major steps towards harmonization and shared standards for the collection and processing of data and samples stored in biobanks. Still, biobanks and researchers face substantial legal difficulties in the field of data protection and sample management. Data protection law was harmonized almost 15 years ago while rights in samples fall under the competence of the Member States of the EU. Despite the Data Protection Directive the field of data protection shows a substantial degree of deviation (...) as public health was excluded from the harmonization. Biobanks seem to have substantially fewer difficulties to cope with in terms of the legal requirements in the field of sample management. This paper discusses the legal framework, experiences of different biobanks in Europe and potential ways forward. It also highlights the need for a health economic analysis of the costs and benefits of privacy protection in Europe. At the moment, policymakers seem to build their decisions on an insufficient evidence base which underestimates the potential value of biobanks for European public health. Within the past few years little progress has been achieved with regards to the development of a unified legal framework in Europe, The diversity in the legal system is also reflected in the different approaches of ethics committees towards biobanking. While understanding and expressing causal relations are universal aspects of human cognition, language users may differ in their capacity to perceive, interpret, and express events. One source of variation in descriptions of caused motion events is agentivity, which refers to the attribution of a result to the agent's action. Depending on the perspective taken, the same event may be described with agentive or non-agentive interpretations. Does language play a role in how people construe and express caused motion events? The present (...) study investigated the use of agentive vs. non-agentive language by speakers of different languages (i.e., monolingual speakers of English and Korean, and Korean learners of English). All three groups described prototypical causal events similarly, using agentive language (active transitive sentences). However, when it came to non-prototypical causal events (where the agent was not shown in the scene), they diverged in their choice of language: English speakers favored agentive language (passive transitive sentences), whereas Korean speakers preferred non-agentive language (intransitive sentences). Korean learners of English patterned with Korean speakers, demonstrating L1 influence on their use of English. These findings highlight the effects of language on motion event construal. (shrink)

The history of the concept of “religion” in Western tradition has intrigued scholars for years. This important collection of eighteen essays brings further light to the ongoing debate. Three of the invited participants, W.C. Smith, M. Despland and E. Feil, has each previously written impressive books treating this subject; the last two acknowledged the impact and continuing influence of Smith’s work, The Meaning and End of Religion. Max Scheler and Mencius both take feeling to be the origin of value and could therefore be considered to be proponents of axiological sentimentalism. Despite the great spatial and temporal distance between them, there are striking similarities between the theories of value they developed. It should be noted, however, that there are also some differences between them that are mainly derived from some difficulties with their theories of value. These difficulties should be removed so that a better theory of (...) value could be developed. It is accordingly the aim of this paper to promote a phenomenological dialogue between Scheler and Mencius that could lead to such a better theory. In Sects. 1, 2, I will first delineate Scheler’s theory of value and feeling, then that of Mencius. In Sect. 3, I will point out some difficulties with the two theories and promote a dialogue between them that would improve each theory. In Sect. 4, I will conclude with some remarks concerning the future task of the phenomenological dialogue between Scheler and Mencius. (shrink)

In the process of cultural dissemination, the dissemination of false information will have a negative impact on the entire environment. In this case, it is an effective method to regulate the behavior of cultural dissemination participants. Based on the community network structure and the improved classic network communication model, this paper constructs the susceptible-infected-recovered model for the grassroots communication of engineering safety culture and discusses the law of grassroots transmission of engineering safety culture. The communication process is simulated, and it (...) is concluded that a good engineering safety culture will be the first to be covered by low-level engineering safety culture in the process of dissemination. With a modularity coefficient of 0.5 as the boundary, it will affect the scale of good safety culture in different directions; the dissemination infection rate of low-level engineering safety culture changes in the same direction with the speed and scale of transmission; the maximum transmission scale of low-level engineering safety culture does not decrease with the increase of the initial value of the susceptible state. When the initial value of the immune state is 15%, the low-level safety culture scale is the lowest value of 0.135, which is the low initial value of employees with low-level engineering safety culture and is more conducive to control its maximum spread. It also puts forward management recommendations for the subjects and objects of the grassroots dissemination of engineering safety culture. This paper transforms cultural communication into an evolutionary game model, uses a game tree to describe it, and analyzes that the model has a Nash equilibrium point by adding a penalty function to the income matrix. This model can encourage cultural communication participants to take honest behaviors, effectively restrain the transmission of false information, and promote a virtuous circle of cultural communication. It is the aim of this paper to develop the phenomenology of phronesis through a phenomenological interpretation of Aristotle’s theory of phronesis by employing different kinds of phenomenological reductions. In section 1, I will show that phenomenological reduction is identical with a change of attitude and that we have to employ different kinds of phenomenological reductions in order to interpret Aristotle’s theory of phronesis phenomenologically. In section 2, employing different kinds of phenomenological reductions, I will attempt to develop the phenomenological (...) psychology of phronesis through a phenomenological interpretation of Aristotle’s theory of phronesis. In section 3, employing different kinds of intersubjective reductions, I will clarify intersubjective aspects of phronesis. In section 4, adopting these insights, I will try to resolve two of the many difficulties of Aristotle’s theory of phronesis. In section 5, I will conclude with two remarks concerning the future tasks of the phenomenology of phronesis. (shrink)

Drawing on Moreno's cognitive-affective theory of learning with media, this research aims to investigate the effectiveness of different multimedia glosses on learners' vocabulary acquisition and reading comprehension in a CALL environment. A total of 160 university students who learnt English as a foreign language in four classes participated in the study and were exposed to one of the four conditions: L2 definition only, L2 definition coupled with audio, L2 definition plus video, and L2 definition with picture. Participants were asked to (...) read eight hypermediated reading texts. Reading comprehension as well as vocabulary acquisition were measured using a pretest–posttest design. The results show first that all these four conditions led to students' vocabulary gains. More specifically, participants who had access to L2 definition plus picture and plus videos achieved significantly higher scores than the other two groups, L2 definition coupled with audio and L2 definition only. Concerning reading comprehension, all multimedia glossing presentation led to better reading comprehension, but no differences were found among all the glossing groups. The questionnaire and interview data indicate that students preferred L2 definition coupled with video and picture glosses, followed by audio and L2 definition only. The results reflect that multimedia glossing presentation creates a different effect on students' vocabulary acquisition and reading comprehension, respectively. They also provide pedagogical implications for learning in times of COVID-19. (shrink)

This article examines whether people share the Gettier intuition (viz. that someone who has a true justified belief that p may nonetheless fail to know that p) in 24 sites, located in 23 countries (counting Hong Kong as a distinct country) and across 17 languages. We also consider the possible influence of gender and personality on this intuition with a very large sample size. Finally, we examine whether the Gettier intuition varies across people as a function of their disposition to (...) engage in “reflective” thinking. (shrink)

Philosophers have long debated whether, if determinism is true, we should hold people morally responsible for their actions since in a deterministic universe, people are arguably not the ultimate source of their actions nor could they have done otherwise if initial conditions and the laws of nature are held fixed. To reveal how non-philosophers ordinarily reason about the conditions for free will, we conducted a cross-cultural and cross-linguistic survey (N = 5,268) spanning twenty countries and sixteen languages. Overall, participants tended (...) to ascribe moral responsibility whether the perpetrator lacked sourcehood or alternate possibilities. However, for American, European, and Middle Eastern participants, being the ultimate source of one’s actions promoted perceptions of free will and control as well as ascriptions of blame and punishment. By contrast, being the source of one’s actions was not particularly salient to Asian participants. Finally, across cultures, participants exhibiting greater cognitive reflection were more likely to view free will as incompatible with causal determinism. We discuss these findings in light of documented cultural differences in the tendency toward dispositional versus situational attributions. (shrink)

Does the Ship of Theseus present a genuine puzzle about persistence due to conflicting intuitions based on “continuity of form” and “continuity of matter” pulling in opposite directions? Philosophers are divided. Some claim that it presents a genuine puzzle but disagree over whether there is a solution. Others claim that there is no puzzle at all since the case has an obvious solution. To assess these proposals, we conducted a cross-cultural study involving nearly 3,000 people across twenty-two countries, speaking eighteen (...) different languages. Our results speak against the proposal that there is no puzzle at all and against the proposal that there is a puzzle but one that has no solution. Our results suggest that there are two criteria—“continuity of form” and “continuity of matter”— that constitute our concept of persistence and these two criteria receive different weightings in settling matters concerning persistence. Although fairness is a key moral trait, limited research focuses on participants' observed fairness behavior because moral traits are generally measured through self-report. This experiment focused on day-to-day interpersonal fairness rather than impersonal justice, and fairness was assessed as observed behavior. The experiment investigated whether a self-reported fairness trait would moderate a situational influence on observed fairness behavior, such that individuals with a stronger fairness trait would be less affected by a situational influence than those with a weaker fairness trait. (...) We used an iterated resource game in which participants could withdraw resources as they chose, and we manipulated the number of resources bogus players withdrew. The number of resources participants withdrew was the behavioral measure of fairness. Results confirmed the expected moderation of the unfairness manipulation by a fairness trait on observed behavior. Those reporting a stronger fairness trait were unaffected by the manipulation, whereas those reporting a weaker fairness trait were more strongly influenced. (shrink)

This Introduction to a Journal of Consciousness Studies Special Issue on Monist Alternatives to Physicalism summarises some of the basic problems of Physicalism and common fallacies in arguments for its defence that are found in the philosophical and scientific literature. It then introduces six monist alternatives: 1) a form of emergent panpsychism developed by William Seager; 2) a novel introduction to the process philosophy of A.N. Whitehead by Anderson Weekes; 3) a review of current developments in Russellian Monism by Torin (...) Alter and Yujin Nagasawa; 4) an analysis of dual-aspect monism and its relation to quantum mechanics originally proposed developed by Pauli and Jung and given a modern interpretation by Harald Atmanspacher; 5) a form of processing monism that might help to resolve ontological differences in Indian philosophy and psychology between dualist Samkya Yoga and nondualist Advaita Vedanta by K. Ramakrisna Rao; and 6) an account of Reflexive Monism, which, viewed as a global system, can incorporate many of the seemingly opposed “isms” that currently populate Consciousness Studies by Max Velmans. Whatever the fundamental nature of Nature might be, it must have the power to give rise to its observable manifestations. Consequently, all the papers in this issue are concerned to give a “natural” account of the relationships among consciousness, mind, and the material world that is entirely consistent with the findings of science, and they all accept that for a unified understanding, mind, consciousness and the material world must have a common base. The aim of the Special Issue is to contribute to a deeper understanding of that base, and to stimulate novel thinking about its nature. (shrink)

We explore and provide an account for a recently identified judgment anomaly, i.e., an order effect that changes the strength of intentionality ascriptions for some side effects (e.g., when a chairman's pursuit of profits has the foreseen but unintended consequence of harming the environment). Experiment 1 replicated the previously unanticipated order effect anomaly controlling for general individual differences. Experiment 2 revealed that the order effect was multiply determined and influenced by factors such as beliefs (i.e., that the same actor (...) was involved in bringing about both good and bad side effects) and philosophical training (i.e., more training was associated with smaller differences in judgment when harm followed help). Results provide more evidence that the folk's philosophically relevant intuitions are predictably fragmented and depend on the dynamic interplay between persons, process, and environments. This study examines the stability of trust and explores whether it differs across men and women using a panel dataset. Data were first collected in 2008 and later in 2019, from 1056 male and 1113 female respondents in the Netherlands. The analysis results suggest that trust is significantly correlated over time, irrespective of gender. Similarly, the subgroup analysis restricted to respondents with low levels of trust in 2008 showed a significant correlation between trust measured in 2008 and that measured in (...) 2019. Further, this study analyzes whether the correlation decays with time by comparing the correlation between trust in 2008 and 2019 with the correlation between trust in 2008 and 2013. The analysis reveals a significant decay in the correlation with time, and this decay is driven by men. A closer look shows that older men (with age ≥ median value) primarily caused this decay in correlation. These findings provide evidence of the interaction between gender and the stability of trust. This major essay collection takes a fresh look at how differences among people matter for music and musical thought.

The main goal of the article is to briefly review the difference between analytical and synthetic in Hegel's philosophy, as well as to determine whether this philosopher was a follower of Kant's philosophy or not. First, in the "Introduction" section, the difference between analytical and synthetic in Kant's philosophy is shown; moreover, Kant's influence on Hegel and, generally, on the period in question and the conclusions of both scientists on this issue are analyzed. In the article, the main (...) features of Hegel's and Kant's worldviews and some conclusions related to the pair of concepts in Hegel's philosophy, i.e., analytical and synthetic concepts, are examined. In the conclusion of the article, Hegel's main philosophical views are identified, and the possibility of resolving the difference between analytical and synthetic through dialectical judgment is put forward. 본 논문은 하이데거와 레비나스의 존재이해의 차이를 존재론적 차이대(對) 존재론적 분리라는 문제틀 속에서 접근하는 작업의 두 번째 시도로서, 이번에는 불교의 조명을 통하여 문제의 차이를 해명한다. 이를 통하여 얻은 결과는 크게 두 가지다. 첫째, 존재의 문제와 관련하여 레비나스가 하이데거의 존재와 시간에 가한 비판은 불심(佛心)의 발로라 해도 무리가 없다. 그리하여 삶의 고통과 그로부터의 해탈, 그리고 무아론과 연기설 등, 불교의 근본적 가르침과 깊이 공명하는 것은 하이데거의 존재론적 차이라기보다는 레비나스의 존재론적 분리이다. 둘째, 레비나스의 성찰은 불교의 전통을 쇄신하는 데 이바지할 수 있다. 그의 존재론적 분리는 불교적 (...) 사태의 존재론적 의미를 깊이 있게 밝혀 주고, 그의 현상학적 연출기법은 『대승기신론』의 삼세론에 대한 이해를 구체화·심화시켜 주는 한편, 그의 침전론은 불교가 정신분석과 같은 현대 담론과도 회통할 수 있는 지점 또한 시사한다. Although being widely considered as only a Western tradition, individualism is not absent in traditional Chinese philosophy and culture. In some of the classic Chinese philosophic works such as Zhuangzi, we can clearly identify some elements which can be appropriately attributed to “individualism”, such as the awareness of individual “self” as an independent and unique existence, advocating individual freedom and liberty, emphasizing on the value and dignity of individual life, favoring individuals’ autonomy and privacy, pursuing unconstrained development in personality and (...) spirituality. However, due to its particular pre-Qin social cultural background and its unique Daoist philosophic origin, this kind of individualism in Zhuangzi has its own unique characteristics, which has made it distinguishable from the variety of other individualist thoughts emerged in different times and places in the West. Zhuangzi has a dynamic and open view on individual or “self”, he does not consider individuals as fixed and interchangeable “atoms” but as dynamic, changing and unique beings, he set the unlimited and indefinable Dao as the only and ultimate source for individuals to conform to, thus to release individual mind into an realm of infinite openness and freedom. Zhuangzian individualism is “inward” rather than “outward”, which means while concentrating on individuals’ freedom of spirit and innate nature, it cares less about individuals’ outside material interests and rights in social reality, and does not encourage competition and rivalry among individuals. The special type of individualism in Zhuangzi has a profound influence on Chinese culture, providing a spiritual space for the development of individuality and personality in ancient China. Critical responses to Wide Sargasso Sea have seized upon Rhys's novel as an exemplary model of writing back. Looking beyond the actual repetitions which recall Brontë’s text, I explore Rhys's novel as an expression of virtual difference and becomings that exemplify Deleuze's three syntheses of time. Elaborating the processes of becoming that Deleuze's third synthesis depicts, Antoinette's fate emerges not as a violence against an original identity. Rather, what the reader witnesses is a series of becomings or masks, some (...) of which are validated, some of which are not, and it is in the rejection of certain masks, forcing Antoinette to become-Bertha, that the greatest violence lies. 이 글은 의료 행위의 중요한 경우에서 합리적인 의사결정을 내리기 위해서는 법적 판단과 함께 도덕적 판단 또한 반드시 고려되어야 하는 이유를 논증한다. 이러한 목적을 이루기 위해 먼저 한 사고실험을 통해 의료 행위에서 초래될 수 있는 업무상 과실치사상죄 적용에 대한 법적 판단을 분석함으로써 행위자의 법적 책임을 최소화할 수 있는 결정이 무엇인지 논증한다. 다음으로 도덕의 관점에서 그 문제를 분석할 경우 법적 판단과 다른 결론을 도출할 수 있음을 논증함으로써 중요한 의료적 결정을 내릴 때 법적 판단과 함께 도덕적 판단을 함께 고찰해야 하는 이유를 논증한다. 우리가 (...) 가진 도덕 감정은 일반적으로 도덕적으로 선하거나 옳은 행위를 권장하고 도덕적으로 악하거나 그른 행위를 금지한다. 하지만 우리가 몸담고 있는 현실 세계에서 일어나는 다양한 사건들 중에는 도덕적으로 최선의 행위를 선택하는 것이 아닌, 도덕적인 ‘차악’의 행위를 선택해야 할 처지에 놓이기도 한다. 이러한 경우는 ‘나를 보호하기 위한 실천적 선택’의 기로에 놓인 경우로 나타난다. 즉 우리는 그러한 순간에 자신의 현실적인 이익에는 부합하지만 도덕적인 부담을 감수해야 하는 선택을 하거나, 반대로 도덕적인 부담으로부터 벗어나기 위해 자신의 현실적인 이익을 포기해야 할 수 있다. 그리고 행위자가 행한 행위를 오직 법과 도덕에 의해서만 평가한다면, 그 행위자가 중대한 결정을 내려야 하는 경우는 법적 판단과 도덕적 판단이 충돌하는 경우라고 할 수 있다. 즉 그 행위자는 도덕적으로 문제될 것은 없지만 법적으로 처벌을 받을 수 있는 경우, 반대로 도덕적으로 비난받을 수 있지만 법적으로 문제가 없는 경우 중에서 한 행위를 선택해야 할 경우 중대한 결정을 내려야 한다. 법적 책임을 최소화하는 결정이 도덕적으로는 정당화될 수 없는 비판적인 사례를 분석함으로써 의료 행위에서 윤리적 분석과 숙고가 요청되는 이유를 강조할 수 있다.
