Ancient dialectic started as an art of refutation and evolved into a science akin to our logic, grammar and linguistics. Scholars of ancient philosophy have traditionally focused on Plato's and Aristotle's dialectic without paying much attention to the diverse conceptions and uses of dialectic presented by philosophers after the classical period. To bridge this gap, this volume aims at a comprehensive understanding of the competing Hellenistic and Imperial definitions of dialectic and their connections with those of the classical period. Xenophon’s conception of the dialectical method shares many similarities with Antisthenes’ point of view regarding the relation between language and reality. The key element supporting this reading is the parallel between Xenophon’s method of dialegein kata genē and Antisthenes’ method of episkepsis tōn onomatōn. In this paper, I claim that a correct understanding of both methods yields a clear structural proximity between the two Socratics on the issue of dialectics. Although they present some significant differences, which I will also explore, (...) I will argue that both variants express a single Socratic motive with regard to dialectics. That is that dialectics, in its basic structure, consists of organizing reality through discourse in order to make it comprehensible. In particular, this is done through establishing unified instances capable of comprehending a multiplicity. This nuclear position could also be extended to include middle Plato’s concept of dialectics. This concurrence takes up different forms in Plato, Xenophon and Antisthenes. Nevertheless, they share the same structure, which indicates quite plausibly a major characteristic of Socratic philosophies, as opposed to previous attempts by the Presocratics and the Sophists. <I>Dialectics beyond Dialectics is a study of contemporary French philosophy from Bataille to Derrida. It analyses, on the first level of generalization, the decomposition of Hegelianism understood as <I>philosophy of totality. Many French philosophers of the 20<SUP>th century deconstruct Hegelian dialectics and harshly criticize the very idea of totality as either dangerous or impossible. The thesis of the book is that, on doing so, they do not really break with dialectics, but transform it. On the second level of generalization, the (...) issue of the book is modernity and the thesis is that transformations of dialectics reveal transformations of modern consciousness which - despite hasty declarations on the <I>end of modernity - still remains ours. I first became interested in De dialectica in 1966, while I was doing re search on Augustine's knowledge of logic. At the time I made a transla tion of the Maurist text and included it as an appendix to my doctoral dissertation (Yale, 1967). In 1971 I thoroughly revised the translation on the basis of the critical text of Wilhelm Crecelius (1857) and I have re cently revised it again to conform to Professor Jan Pinborg's new edition. The only previously (...) published translation of the whole of De dialectica. is N. H. Barreau's French translation in the Oeuvres completes de Saint Augustin (1873). Thomas Stanley translated parts of Chapters Six and Nine into English as part of the account of Stoic logic in his History of Philosophy (Pt. VIII, 1656). I offer De dialectica in English in the hope that it will be of some interest to historians of logic and of the liberal arts tradition and to students of the thought of Augustine. In translating I have for the most part been as literal as is consistent with English usage. Although inclusion of the Latin text might have justified a freer translation, for example, the use of modern technical terms, it seemed better to stay close to the Latin. One of the. values in studying a work such as De dialectica is to see familiar topics discussed in a terminology not so familiar. In the translation I follow these conventions. (shrink)

Inspired by legal reasoning, this paper presents a formal framework for assessing conflicting arguments. Its use is illustrated with applications to realistic legal examples, and the potential for implementation is discussed. The framework has the form of a logical system for defeasible argumentation. Its language, which is of a logic-programming-like nature, has both weak and explicit negation, and conflicts between arguments are decided with the help of priorities on the rules. An important feature of the system is that these priorities (...) are not fixed, but are themselves defeasibly derived as conclusions within the system. Thus debates on the choice between conflicting arguments can also be modelled.The proof theory of the system is stated in dialectical style, where a proof takes the form of a dialogue between a proponent and an opponent of an argument. An argument is shown to be justified if the proponent can make the opponent run out of moves in whatever way the opponent attacks. Despite this dialectical form, the system reflects a declarative, or relational approach to modelling legal argument. A basic assumption of this paper is that this approach complements two other lines of research in AI and Law, investigations of precedent-based reasoning and the development of procedural, or dialectical models of legal argument. This book proposes a treatise on the Hegelian dialectical method as based on dialectical logic. Part One explores sources of dialectical logic before Hegel in ancient thought. Part Two examines dialectical logic and the dialectical method in Hegel, with attention to the relationship between dialectical logic and contemporary formal logic. Part Three concerns the dialectical method after Hegel, in which we seek to show that the method is available for uses other than the one to which the historical Hegel put (...) it. My intention has been constructive. I want to take issue with those who have contested the existence or validity of any dialectical logic, and of the dialectical method as well.1 The payoff for studying dialectical logic is the dialectical method. By using it one can reconstruct, rethink, and relive a historical course of dialectical deduction with the purpose of achieving deeper self-comprehension, i.e., comprehension of oneself by retraveling one’s past path of dialectical assumptions, contradictions, and corrections. Dialectical self-comprehension is possible when one’s present identity has historically constituted itself through such a path. It is possible when the individual is conscious of herself as triumphant over the contradictions of the past. Part Three, treating the dialectical method after Hegel, includes a reconstruction of American history since World War II in chapter 8, according to INTRODUCTION 9 1 0 Introduction the dialectical method. We will see how a Hegelian use of the method can assist in comprehending a post-Hegelian historical standpoint present to us but unknown to Hegel. (shrink)

This book considers the emergence of dialectic out of the spirit of dialogue and traces the relation between the two. It moves from Plato, for whom dialectic is necessary to destroy incorrect theses and attain thinkable being, to Cusanus, to modern philosophers—Descartes, Kant, Hegel, Schleiermacher and Gadamer, for whom dialectic becomes the driving force behind the constitution of a rational philosophical system. Conceived as a logical enterprise, dialectic strives to liberate itself from dialogue, which it views as merely accidental and (...) even disruptive of thought, in order to become a systematic or scientific method. The Cartesian autonomous and universal yet utterly monological and lonely subject requires dialectic alone to reason correctly, yet dialogue, despite its unfinalizable and interruptive nature, is what constitutes the human condition. Dialogues and dialectics have come to playan important role in the field of ArtificialIntelligence and Law. This paper describes thelegal-theoretical and logical background of this role,and discusses the different services into whichdialogues are put. These services include:characterising logical operators, modelling thedefeasibility of legal reasoning, providing the basisfor legal justification and identifying legal issues,and establishing the law in concrete cases. Specialattention is given to the requirements oflaw-establishing dialogues.

This article offers an analysis of the argumentative method of two treatises by Alexander of Aphrodisias, On Fate and On Providence, the latter of which is preserved only in Arabic translation. It is argued that both texts use techniques from Aristotelian dialectic, albeit in different ways, with On Fate adhering to methods outlined in Aristotle's Topics whereas On Providence uses the ‘aporetic’ method familiar from texts such as MetaphysicsΒ‎. This represents a revision of a previous study of Alexander's method in (...) On Fate by Jaap Mansfeld, which emphasized parallels between that method and the techniques of ancient scepticism. It is, however, suggested that Alexander does reflect developments in epistemology during the Hellenistic period, especially in so far as he ‘upgrades’ the status of endoxa to play something like the role of common conceptions in the dogmatic Hellenistic schools. In this paper, I will argue for a complex of three theses. First, that the problem of deep disagreement is an instance of the regress problem of justification. Second, that the problem of deep disagreement, as a regress problem, depends on a dialecticality requirement for arguments. Third, that the dialecticality requirement is plausible and defensible.

Beginning with the influential discussion of the dialectic of progress found in Amy Allen’s The End of Progress, this paper outlines some difficulties encountered by critical theories of normative justification drawing on the early Frankfurt School. Characterizing Adorno and Horkheimer’s critical social theory as a dialectical reflection eschewing questions of normative foundations, I relate their well-known treatment of the dialectic of enlightenment reason and myth to their critique of capitalist society as a negative totality. By exploring the concepts of historical (...) development used by Adorno and Horkheimer to describe both the progressive domination of capitalism, and the formation and cultivation of reflective consciousness, I trace the importance of progression and its inseparable relationship to regression in these early versions of critical theory. The dialectical social theory found here recognizes the persistence of social contradictions on both a methodological level and on the level of theory’s development and expression, a connection potentially obscured by a division of historical progress according to its temporal orientation. Particularly in Adorno’s later work, an opposition to the negative social totality requires notions of cultivation and learning which work against the prevailing forms of conceptual thinking, including the concern for the stability of rational foundations. By compiling an experimental method combining both dialectic and rhetoric, 'Dialectic, Rhetoric and Contrast: The Infinite Middle of Meaning' demonstrates how singular meanings can be rendered in a spectrum of 12 repeating concepts that are in a continuum, gradated and symmetrical. The ability to arrange meaning into this pattern opens enquiry into its ontology, and presents meaning as closer to the sensation of colours or musical notes than the bivalent oppositions depicted in classical logic. However, the experiment does not assert (...) that this pattern suggests some sort of constant or absolute principle; instead, it theorises on the ways in which meaning can be considered to be recursive. To explain this, the book explores the concept of contrast itself. No exactitude on the precise existence of contrast can ever be struck because the answer varies infinitely depending upon the scale of measurement used to gauge the meeting point. This characteristic of contrast helps to define a whole new dimension from which sensation, meaning, cognition and consciousness can be analogised to the infinite forms between forms. At a time when the widest consensus in philosophy is the exhaustion of its central themes, the significance of such a hypothesis provides fresh impetus to revise some of the key meanings and concepts underpinning contemporary thought. To do this, the method explores the opposing themes of idealism and realism that run throughout western philosophy from Plato to the Speculative turn. This book will be of interest to professional academic audiences in the humanities and social sciences, from graduates to senior scholars. Lorenzo Valla (1407–1457) ranks among the greatest scholars and thinkers of the Renaissance. He secured lasting fame for his brilliant critical skills, most famously in his exposure of the “Donation of Constantine,” the forged document upon which the papacy based claims to political power. Lesser known in the English-speaking world is Valla's work in the philosophy of language—the basis of his reputation as the greatest philosopher of the humanist movement. Dialectical Disputations, translated here for the first time into any modern (...) language, is his principal contribution to the philosophy of language and logic. With this savage attack on the scholastic tradition of Aristotelian logic, Valla aimed to supersede it with a new logic based on the actual historical usage of classical Latin and on a commonsense approach to semantics and argument. Valla provides a logic that could be used by lawyers, preachers, statesmen, and others who needed to succeed in public debate—one that was stylistically correct and rhetorically elegant, and thus could dispense with the technical language of the scholastics, a “tribe of Peripatetics, perverters of natural meanings.” Valla's reformed dialectic became a milestone in the development of humanist logic and contains startling anticipations of modern theories of semantics and language. Both "dialectical contradiction" and "logical contradiction" use the word "contradiction." This is misleading; it may easily lead people to believe that the word "contradiction" has only one meaning and thus confuse dialectical contradiction with logical contradiction. As a matter of fact, in dialectics and logic "contradiction" implies different things. "Contradiction" as used in dialectics refers to the two contradictory aspects in a thing. In contrast, "contradiction" as described in formal logic means the self-contradictoriness in thinking. For example, contradictions between the (...) productive forces and the relations of production, between one's merits and weaknesses, and between getting rid of the stale and taking in the fresh are all dialectical contradictions. "At once a man and a not-man," "at once existent and non-existent," "at once meritorious and non-meritorious," and so forth are all logical contradictions. The law of contradiction of formal logic excludes only the self-contradictoriness in thinking and has nothing to do with dialectical contradiction. The law of contradiction says that there can be no"A and not-A." That is to say, "A and not-A" is the logic contradiction that the law of contradiction should rule out. If we admit that dialectical contradiction is not logical contradiction, we then cannot describe dialectical contradiction as "A and not-A.". (shrink)

Our analysis in this paper unfolds on two levels: a critique of the ‘realities’ of graduate nursing education and an argument to sustain its ‘ideals’. We open for discussion an aspect of graduate nursing education dominated by instrumental reason, namely the research industry, using an internal critique approach developed by Max Horkheimer and Theodor Adorno of the Early Frankfurt School. As we explain, internal critique arises out of, and relies on, the mismatch between goals, or ‘ideals’, and existing realities. Thinking (...) about ‘ideals’ of the academy, we draw on Hans-Georg Gadamer's view of the university as a place to think freely, creatively, and critically. The contemporary realities of the university, on the other hand, that emphasize the market values of the research industry forcefully shape nursing academic scholarship in a particular direction. In our attempt to recognize and disrupt the forces of the research industry with its instrumental reason, we consider Judith Butler's writings on how norms operate in society. We show that our growing involvement in the research industry makes it very difficult to disentangle ourselves from that situation. The values of the research industry actually suppress the very ideals of education and scholarship that we would like to uphold. As a contra-force, the internal critique of the ‘existing realities’ in the graduate nursing education unmasks the tyranny of the research industry and makes visible the importance of sustaining the higher goals and ideals in nursing scholarship. The Nicomachean Ethics is generally thought to be a “dialectical” work, aimed at resolving aporia in a set of endoxa, which it takes as its starting-point. I argue that Aristotle’s aim in the treatise is, rather, to produce definitions of key ethical terms, and that his starting-points are limited to evaluative and discriminative judgments of a certain sort, which are demanded by the nature of the discipline and are not endoxa. I discuss also how the definitions are reached (focusing on (...) the cases of the virtues of character) and the roles that aporiai do play in the process. (shrink)

Epistemic justification of non-summative group beliefs is studied in this paper. Such group beliefs are understood to be voluntary acceptances, the justification of which differs from that of involuntary beliefs. It is argued that whereas epistemic evaluation of involuntary beliefs can be seen not to require reasons, justification of voluntary acceptance of a proposition as true requires that the agent, a group or an individual, can provide reasons for the accepted view. This basic idea is studied in relation to theories (...) of dialectical justification in which justification is taken to require ability to justify. Since the reasons offered can in principle always be challenged, there is no ultimate end to the dialectical chain of justification. This makes justification of acceptance, and thus group belief, social and, in a way, contextual, but this does not seem to entail strong forms of epistemic relativism. (shrink)

In this paper, we provide a detailed critical review of current approaches to ecthesis in Aristotle’s Prior Analytics, with a view to motivate a new approach, which builds upon previous work by Marion & Rückert (2016) on the dictum de omni. This approach sets Aristotle’s work within the context of dialectic and uses Lorenzen’s dialogical logic, hereby reframed with use of Martin-Löf's constructive type theory as ‘immanent reasoning’. We then provide rules of syllogistic for the latter, and provide proofs of (...) e-conversion, Darapti and Bocardo and e-subalternation, while showing how close to Aristotle’s text these proofs remain. This chapter examines the notion of philosophical truth that Adorno, in Negative Dialectics, believes to be possible by means of his changed conception of philosophy. What that examination finds is that philosophical truth, as Adorno recommends it, is realized through “singular” philosophical experiences. The critical question is that of how the truths that are conveyed through “singularity” can be understood to have persuasive force over us, Adorno's readers. The period from Plato's birth to Aristotle's death (427-322 BC) is one of the most influential and formative in the history of Western philosophy. The developments of logic, metaphysics, epistemology, ethics and science in this period have been investigated, controversies have arisen and many new theories have been produced.
