This book offers a critical appraisal of Karl Olivecrona's legal philosophy. Based on Olivecrona's critique of the view that law has binding force, the analysis of the concept and function of a legal rule, and the idea that law is a matter of organized force, the book argues that Olivecrona's legal philosophy is a unique contribution to twentieth century legal philosophy. It shows how Olivecrona's philosophy can be used in the assessment of contemporary theories of law, such as (...) those put forward by Hart, Raz, Dworkin, and Alexy. In addition, the book argues that Olivecrona's various discussions of theories defended by key people in the history of legal and political philosophy are highly interesting contributions. They not only increase our understanding of the legal and political philosophy of previous generations, but also enhances our insight into legal-philosophical questions that remain with us today. In his book Struktura rewolucji relatywistycznej i kwantowej w fizyce (The Structure of the Relativistic and Quantum Revolution in Physics, 2020), Wojciech Sady presents his vision of the two greatest scientific revolutions in the 20th century. The book provides an illuminating account of the way these revolutions proceeded and strongly supports the thesis that, contrary to Thomas Kuhn’s famous suggestions, the revolutions involved no breaches in the continuity in scientific development but progressed in an evolutionary (although swift) step-by-step way, and (...) were products of collective interactive processes in the scientific community rather than individual achievements of geniuses. On the other hand, it makes a number of controversial claims. In this article, I contest Sady’s claims that new scientific theories (including the most revolutionary ones) logically follow from the theoretical and experimental knowledge already available (the Entailment thesis) or, at least, their emergence is necessary, inevitable, given the available knowledge, the thought style of the scientific community, and some minimally necessary conditions for the development of science (the Necessitation thesis), and that the role of extra-logical and extra-empirical factors, that can be designated as “creative imagination,” in the development of science is either negative or neglectable. The morally responsible practice of clinical medicine depends on many factors, the integrity of clinical judgment chief among them. Responsible clinical judgment requires that it be deliberative. The disciplines of the humanities, all of which contribute to clinical ethics—as the papers that follow illustrate—teach that deliberative reasoning includes critical self-awareness and self-scrutiny. Critical appraisal proves essential to achieving both. The papers in the 2013 Clinical Ethics number of the Journal provide distinctive critical appraisals of clinical judgment: (...) concepts of race; narrative; stewardship; and the Rule of Rescue. Significant contributions to debates in the philosophy of evidence-based medicine (EBM) have come from a variety of different philosophical quarters, yet mainstream discourse in the field has been largely devoid of contributions from scholars working in the pragmatist tradition. This is a particularly conspicuous omission, given pragmatism’s commitment to the melioristic view that philosophy both can, and should, be about the business of concretely bettering the human estate. Two exceptions to this oversight come from Brian Walsh and Maya Goldenberg. Unfortunately, (...) in both cases, the misapplication of pragmatist thinking leads to the mistaken view that EBM is committed to some form of pernicious objectivism. This article aims to revise these pragmatist critiques in order to bring them more consistently in line with pragmatist values and commitments. Doing so shows that EBM is defensible on pragmatist grounds against objectivist attacks. (shrink)

The ampliativity of deduction has been defended in several ways—such as the semi-decidability of the theories, the surprise of unexpected consequences, the need of new individuals in deduction, or ampliative inference as deduction with suppressed premises (Dummett, Frege. Philosophy of mathematics. Duckworth, London, 1991; Hintikka, Logic, language-games and information. Oxford University Press, Oxford, 1973; Musgrave, Imre Lakatos and theories of scientific change. Kluwer, Boston, 1989; Rota, Indiscrete thoughts. Birkhäuser, Boston, 1997). These lines of defensive arguments fail if we characterize ampliativity (...) in a strong way, that is, in terms of ‘novelty’ stricto sensu, as an inferential process producing genuinely new pieces of information in the conclusion of a reasoning (Cellucci, Rethinking logic. Springer, Dordrecht, 2013; Ippoliti, Heuristic reasoning. Springer, Basel, 2015). Nevertheless, it is possible to defend a weaker stance of the ampliativity of deduction and its usefulness. This requires interpreting novelty more loosely, that is, as the inferential production of new relations among known entities. This stance maintains that, in this sense, deduction can provide us with new knowledge. Thus, a typical deductive activity, as re-proving theorems, can be thought as heuristic and ampliative because it establishes new relations between known elements (e.g. between given axioms or properties and the statement of the theorem). I argue that also this line of defence is defective for it does not account for the necessity and usefulness of reproving theorems. In particular, a foundationalist, axiomatic-deductive viewpoint does not fully account for the usefulness and the weak ampliative power of deduction. (shrink)

As scientists target communities for research into the etiology, especially the genetic determinants of common diseases, there have been calls for the protection of communities. This paper identifies the distinct characteristics of aboriginal communities and their implications for research in these communities. It also contends that the framework in the Belmont Report is inadequate in this context and suggests a fourth principle of respect for communities. To explore how such a principle might be specified and operationalized, it reviews existing guidelines (...) for protecting aboriginal communities and points out problems with these guidelines and areas for further work. BackgroundAdvance directives imply the promise of determining future medical treatment in case of decisional incapacity. However, clinical practice increasingly indicates that standardized ADs often fail to support patients’ autonomy. To date, little data are available about the quality and impact of ADs on end-of-life decisions for incapacitated acute stroke patients.MethodsWe analyzed the ADs of patients with fatal stroke, focusing on: their availability and type, stated circumstances to which the AD should apply, and stated wishes regarding specific treatment options.ResultsBetween 2011 and (...) 2014, 143 patients died during their hospitalization on our stroke unit. Forty-two of them had a completed and signed, written AD, as reported by their family, but only 35 ADs were available. The circumstances in which the AD should apply were stated by 21/35 as a “terminal condition that will cause death within a relatively short time” or an ongoing “dying process.” A retrospective review found only 16 of 35 ADs described circumstances that, according to the medical file, could have been considered applicable by the treating physicians. A majority of patients objected to cardiopulmonary resuscitation, mechanical ventilation, and artificial nutrition, while almost all directed that treatment for alleviation of pain or discomfort should be provided at all times even if it could hasten death.ConclusionsThe prevalence of ADs among patients who die from acute stroke is still low. A major flaw of the ADs in our cohort was their attempt to determine single medical procedures without focusing on a precise description of applicable scenarios. Therefore, less than half of the ADs were considered applicable for severe acute stroke. These findings stress the need to foster educational programs for the general public about advance care planning to facilitate the processing of timely, comprehensive, and individualized end-of-life decision-making. This article examines the development, impact and integration of interdisciplinary approaches in British Higher Education Institutions. It evaluates how the concept of interdisciplinarity has become popularised over time and embraced by disciplines such as archaeology. It then explores the extent to which interdisciplinary approaches have impacted research agendas, first, by evaluating the interdisciplinary research calls from 2019 for seven UK-based research councils and then, at a discipline (...) level, using archaeology as an exemplar. Overall, interdisciplinary research calls only accounted for, at best, 11.9% of a council’s budget. Interrogation of the funding requirements of four of the largest archaeological-research funders demonstrated that successful archaeology-themed grant applications are reliant on interdisciplinarity. The influence of interdisciplinarity on British University’s research and education agendas was examined through analysing the strategic plans of eight universities, followed by an analysis of the availability and potential benefits of interdisciplinary undergraduate and research programmes. This indicated that interdisciplinary approaches are interwoven into university’s research aspirations but displayed variation in relation to their educational goals, with only 20% of institutions offering specific interdisciplinary degree programmes. Despite this, the skillset and research outputs produced as a result of interdisciplinary collaboration were found to be highly valued, thereby suggesting that interdisciplinarity will increasingly feature in the research and education strategies of British universities. Naturalism - the thesis that all facts are natural facts, that is the facts that can be recognised and explained by a natural science - plays a central role in contemporary analytical philosophy. Yet many philosophers reject the claims of naturalism. The essays in this anthology explore the difficulties of naturalism by revealing the ambiguities surrounding it, as well as the tensions that exist among its critics.

A new framework for the study of the human moral faculty is currently receiving much attention: the so-called ‘universal moral grammar' framework. It is based on an intriguing analogy, first pointed out by Rawls, between the study of the human moral sense and Chomsky's research program into the human language faculty. In order to assess UMG, we ask: is moral competence modular? Does it have an underlying hierarchical grammatical structure? Does moral diversity rest on culture-dependent parameters? We review evidence that (...) supports negative answers and argue that formal grammatical concepts are of limited value for the study of moral judgments, moral development and moral diversity. This article draws attention to struggles inherent in discourse about the meaning of participation in a Flemish participatory technology assessment (pTA) on nanotechnologies. It explores how, at the project’s outset, key actors (e.g., nanotechnologists and pTA researchers) frame elements of the process like ‘the public’ and draw on interpretive repertoires to fit their perspective. The examples call into question normative commitments to cooperation, consensus building, and common action that conventionally guide pTA approaches. It is argued that pTA itself must reflect (...) an awareness of competing interests and perspectives inherent in the discourse associated with the meaning of ‘participation’ if it is to incite action beyond vested interests and ensure genuine mutual learning. This book explores Pierre Bourdieu's philosophy and sociology of science, which, though central to his thought, have been largely neglected in critical examinations of his work. Addressing the resultant confusion that surrounds Bourdieu's sociologized philosophy of science, it expounds his epistemology and sociology of science, situating it within the context of Anglo-American post positivist philosophy of science and shedding light on the critique of relativist sociology of science that emerges from his field theory. From a detailed critique of Bourdieu's (...) reflexive sociology and his attempt to enhance the uneasy epistemic status of the social sciences, the author draws on the thought of Jürgen Habermas to suggest critical ethnography as a way of going beyond Bourdieu's critical theory. As such, Bourdieu's Philosophy and Sociology of Science will appeal to sociologists, philosophers and scholars across the social sciences with interests in the work of Bourdieu and the sociology and philosophy of science. I first show that most authors who developed Plural Quantification Logic (PQL) argued it could capture various features of natural language better than can other logic systems. I then show that it fails to do so: it radically departs from natural language in two of its essential features; namely, in distinguishing plural from singular quantification and in its use of an relation. Next, I sketch a different approach that is more adequate than PQL for capturing plural aspects of natural language (...) semantics and logic. I conclude with a criticism of the claim that PQL should replace natural language for specific philosophical or scientific purposes. (shrink)

In The Phenomenology of Spirit, Hegel draws out the interdependency of unity and difference. In order to have a unity, there must be differences that compose it, as a unity unifies different elements. At the same time, in unifying these elements, they must not cease to be different from one another, as that would reduce the unity to a simple singularity.In this paper, I take up this interdependency of unity and difference, applying it to gender identities. I follow the psychoanalytically (...) oriented exchange between Judith Butler and Adam Phillips, in which they agree that gender identities are a farce, superimposed upon ungendered subjects, but disagree about the extent to which this artificial binary should be disassembled. Picking up their conversation at this point, I investigate how binary systems of identity can be both injurious and useful. Should they be cast off or does it make sense to keep them? Following this vein of thought, I end with a discussion of good and bad hate, arguing that there is an inescapable need for psychologically productive hate neutralized through empathy. (shrink)

In his book Defending Life, Francis Beckwith claims that the question of personhood and human nature is the central question in the abortion debate. In this paper I try to show that the argument Beckwith offers for the moral wrongness of abortion in Defending Life is unpersuasive, his elucidation of key terms question-begging, and his claims concerning embryology and zygotic (and (...) postzygotic) development highly controversial. Whether economics warrants public trust depends on the extent to which assertions by economists can be deemed credible. Three examples from microeconomics are examined to assess how the discipline performs in this regard. First, a purely theoretical argument with broad conceptual implications: a quasi-evolutionary argument for rational choice based on the notion of money pumps. Second, a modelling-related claim with significant social implications: economists’ objection to minimum wages based on a simple supply-demand model. Third, methodological choices with implications for all (...) empirical work in microeconomics: the recent proclamation of a ‘credibility revolution’ in applied microeconomics through the use of experimental and quasi-experimental methods. These are assessed against proposed criteria for credibility: epistemic validity, epistemic reliability, and epistemic reflexivity. On the basis of the performance of the discipline against these criteria on the examples considered, I conclude that public distrust of economics and economists can be well-founded. (shrink)
