This paper introduces constitutivism about practical reason, which is the view that we can justify certain normative claims by showing that agents become committed to these claims simply in virtue of acting. According to this view, action has a certain structural feature – a constitutive aim, principle, or standard – that both constitutes events as actions and generates a standard of assessment for action. We can use this standard of assessment to derive normative claims. In short, the authority of (...) certain normative claims arises from the bare fact that we are agents. Constitutivism argues that the source of the categorical force of the norms of rationality and morality lies in the constitutive features of agency. A systematic failure to be guided by these norms would amount to a loss or lack of agency. Since we cannot but be agents, we cannot but be unconditionally guided by these norms. The constitutivist strategy has been challenged by David Enoch. He argues that our participation in agency is optional and thus cannot be a source (...) of categorical demands. In this paper, I defend the viability of constitutivism by showing that agency is indeed a special ‘inescapable’ enterprise. Agency has the largest jurisdiction, and it is closed under rational assessment. This inescapability does not exempt constitutivism from raising the question whether agents have reason to be agents, but this question has to be taken up within agency. If this question is answered affirmatively, then—I argue—the criteria of practical correctness are self-ratifying in a non-circular way. This is sufficient to show the viability of the constitutivist strategy. Whether agents have conclusive reasons to be agents, however, is a matter to be addressed in the terms of particular versions of constitutivism. (shrink)

Over the last two decades, Kant’s name has become closely associated with the “constitutivist” program within metaethics. But is Kant best read as pursuing a constitutivist approach to meta- normative questions? And if so, in what sense? In this essay, I’ll argue that we can best answer these questions by considering them in the context of a broader issue – namely, how Kant understands the proper methodology for philosophy in general. The result of this investigation will be that, while Kant (...) can indeed be read as a sort of constitutivist, his constitutivism is ultimately just one instance of a much more general approach to philosophy – which treats as fundamental our basic, self-conscious rational capacities. Thus, to truly understand why and how Kant is a constitutivist, we need to consider this question within the context of his more fundamental commitment to “capacities-first philosophy”. (shrink)

In recent work, Michael Smith argues that particular desires are constitutive of ideal agency and draws on his dispositional account of reasons to establish the normative significance of those desires. In a sustained critique, Michael Bukowski objects that Smith’s recent arguments that particular desires are constitutive of ideal agency rely on indefensible premises and his dispositional account of reasons is unable to establish the normative significance of such desires. On the contrary, I argue not only that Smith has the resources (...) to respond to these objections but also that the form of Smith’s constitutivist explanation has unappreciated explanatory strengths. Constitutivist accounts in metaethics explain the normative standards in a domain by appealing to the constitutive features of its members. The success of these accounts turns on whether they can explain the connection between normative standards and the nature of individuals they authoritatively govern. Many such explanations presuppose that any member of a norm-governed kind must minimally satisfy the norms governing its kind. I call this the Threshold Commitment, and argue that constitutivists should reject it. First, it requires constitutivists to (...) restrict the scope of their explanatory ambitions, because it is not plausibly true of social kinds. Second, despite the frequent reliance on physical artifacts in constitutivists’ illustrations of the Threshold Commitment, it counter-intuitively entails that physical artifacts can cease to exist without being physically destroyed. Third, it misconstrues the normative force of authoritative norms on very defective kind-members because it locates this force not in the norm, but in the threat of non-existence. Fortunately, constitutivism can be decoupled from the Threshold Commitment, and I close by sketching a promising alternative account. (shrink)

Constitutivists explicitly emphasize the importance of self-reflection for rational agency. Interestingly enough, there is no clear account of how and why self-reflection plays such an important role for these views. My aim in this paper is to address this underappreciated problem for constitutivist views and to determine whether constitutivist self-reflection is normatively oriented. Understanding its normative features will allow us to evaluate a potential way that constitutivism may meet its purported metaethical promise. I begin by showing why constitutivism, (...) as exemplified by Korsgaard’s and Velleman’s respective views, takes self-reflection to be a constitutive feature of rational agency. Closer examination of this claim suggests three underappreciated problems for the constitutivist’s apparent reliance on self-reflection. First, we have no picture of the specific role that self-reflection plays. Second, it is unclear in what sense it is a requirement for full-fledged agency and, thereby, for self-constitution. Third, it is not clear whether it has any necessary normative features, even given the often cited moral normativity associated with constitutivism. Contemporary forms of Kantian constitutivism generally begin with a conception of agency on which the constitutive aim of agency is some form of autonomy or self-unification. This chapter argues for a re-orientation of the Kantian constitutivist project towards views that begin with a conception of rationality on which both theoretical and practical rationality aim at forms of understanding. In a slogan, then, understanding-first as opposed to autonomy-first constitutivism. Such a view gives the constitutivist new resources for explaining many (...) classes of reasons, while also offering a new way of understanding the unity of theoretical and practical reason. The chapter concludes by arguing that the resulting view is best understood, not so much as an alternative to autonomy-first constitutivism, but as a complement to it. (shrink)

Hinge epistemology has to dispel the worry that disagreeing over hinges is rationally inert. Building on a companion piece (Coliva and Palmira 2020), this paper offers a constitutivist solution to the problem of rational inertia by maintaining that a Humean sceptic and a hinge epistemologist disagree over the correct explication of the concept of epistemic rationality. The paper explores the implications of such a solution. First, it clarifies in what sense a disagreement over hinges would be a conceptual disagreement. Secondly, (...) it uses considerations about the (alleged) rational inertia of hinge disagreement to offer a test whereby to demarcate genuine hinges from merely entrenched beliefs. Thirdly, it offers a response to the challenge of explaining why we have reason to engage in the epistemic practices that hinges are constitutive of in the first place. In this article, I defend a meta-normative account of constitutivism by specifically addressing what I take to be a fundamental criticism of the constitutivist stance, namely, the objection that constitutive standards have conceptual, not normative, force, and so that no practical normativity can be extracted from them as constitutive of agency. In reply to this objection, I argue that the conceptual role of the standards constitutive of agency? their applying to us by virtue of our being the kinds of (...) creatures we are? does not exclude, but rather combines with, the normative role the same standards play in our practical life. Constitutivism is best understood as a strategy for meeting a set of related metanormative challenges, rather than a fully comprehensive metanormative theory in its own right, or so many have plausibly argued. Whether this strategy succeeds may depend, in part, on which broader metanormative theory it is combined with. In this paper I argue that combining constitutivism with expressivism somewhat surprisingly provides constitutivists with their best chances for success, and that this combination of views has some surprising benefits (...) for both parties. Constitutivism is the view that we can derive a substantive account of normative reasons for action—perhaps a Kantian account, perhaps a hedonistic account, perhaps a desire-fulfillment account, this is up for grabs—from abstract premises about the nature of action and agency. Constitutivists are thus bound together by their conviction that such a derivation is possible, not by their agreement about which substantive reasons can be derived, and not by agreement about the features of action and agency that permit the (...) derivation. In the final section of the penultimate chapter of Reasons, a chapter devoted to discussing the merits of constitutivism, Eric Wiland has this to say: Constitutivism is ambitious. It attempts to extract an account of reasons for action from reflection on the bare ideas of action and agency. So we shouldn’t be surprised if doubts remain. Constitutivism holds that an account of what a thing is yields those normative standards to which that thing is by nature subject. We articulate a minimal form of constitutivism that we call _formal, non-epistemological constitutivism_ which diverges from orthodox versions of constitutivism in two main respects. First: whereas orthodox versions of constitutivism hold that those ethical norms to which people are by nature subject are sui generis because of their special capacity to motivate action and legitimate (...) criticism, we argue that these features are compatible with treating these norms as of a piece with those ‘formal’ natural-historical norms which can be used to assess living things. Second: unlike orthodox versions of constitutivism, our version does not seek to use a non-normative account of that kind of being which we are as a means of identifying those normative claims to which we are are by nature subject. Constitutivism aims to justify substantial normative standards as constitutive of practical reason. In this way, it can defend the constructivist commitment to avoiding realism and anti-realism in normative disciplines. This metaphysical debate is the perspective from which the nature of the constitutivist justification is usually discussed. In this paper, I focus on a related, but distinct, debate. My concern will not be whether the substantial normative claims asserted by the constructivist have some elements, which are not constructed, but real, (...) given independently from us; instead, my concern will be more narrowly epistemic – whether those claims can be derived from premises, which are normatively less substantial than the normative conclusions themselves. I focus on Korsgaard’s transcendental articulation of the constitutivist argument. I conclude that more work would need to be done, in order for this argument to function as intended. (shrink)

The introduction summarizes the main arguments formulated in the six papers of this special issue on Constitutivism and Kantian Constructivism in Ethical Theory. We highlight the unifying theme addressed in the essays, i.e., the question of whether constitutivism is able to fulfill the promise of providing an account of normativity starting from relatively slender assumptions, including the avoidance of realist presuppositions.

The aim of this paper is twofold: In its first part, we work out the key features of constitutivism as presented by Christine Korsgaard. This reconstruction serves to clarify which goals Korsgaard wants to achieve with her account and which of its central claims she has to defend in particular. In the second part, we discuss whether Korsgaard can vindicate constitutivism's most central claim. To do this, we analyse two important arguments - the argument from unavoidability and the (...) argument from the abstract constitutive principle - that have been made in support of constitutivism. We show how both these arguments go amiss and conclude that at least for now, constitutivism's most central claim has not been successfully argued for. (shrink)

Epistemic constitutivism (EC) holds that the nature of believing is such that it gives rise to a standard of correctness and that other epistemic normative notions (e.g., reasons for belief) can be explained in terms of this standard. If defensible, this view promises an attractive and unifying account of epistemic normativity. However, EC faces a forceful objection: that constitutive standards of correctness are never enough for generating normative reasons. This paper aims to defend EC in the face of this (...) objection. I do so in two steps. First, I dispute a crucial assumption underlying the case against EC: that constitutive standards of correctness in general are ‘reason-giving’ only if and because there is also a prior reason to comply with them. Second, I outline a strategy of how EC can meet the challenge of explaining what’s special about the activity of believing such that, unlike other standard-governed activities, it is capable of generating normative reasons. Constitutivism is a family of theories of normativity, especially in metaethics, that rely on the concept of constitutive norms: norms that are grounded in constitutive features of the kind of thing to which they apply. In this paper, I present two conditions that any constitutivism must meet in its account of constitutive norms, if it is to remain true to its motivations: the constitutivity and broad normativity conditions. I argue that all extant accounts of constitutive norms fail to (...) meet these conditions due to making constitutive norms either inviolable or in need of some external ground of normativity. I then propose a new account of constitutive norms that is better fitted to meet these conditions. This account relies on an analysis of constitutive norms in terms of a specific kind of generic generalization, the “generic proposition”. I explain how norms of this form can be constitutive of a kind, while also allowing for violability. (shrink)

According to constitutivists about epistemic normativity, epistemic normativity is explained by the nature of belief. Specifically, it is explained by the fact that, as a matter of conceptual necessity, belief stands in a normative relation to truth. We ask whether there are persuasive arguments for the claim that belief stands in such a relation to truth. We examine and critique two arguments for this claim. The first is based on the transparency of belief. The second is based on Moore-paradoxical sentences. (...) We develop a common objection to both. Both arguments are reliant on implausible claims about the relation between accepting a norm and being motivated by it. This point has sometimes been made in connection with the transparency of belief. But its development and application to Moore-paradoxical sentences are, we believe, novel. (shrink)

Constitutivists have tried to answer Enoch’s “schmagency” objection by arguing that Enoch fails to appreciate the inescapability of agency. Although these arguments are effective against some versions of the objection, I argue that they leave constitutivism vulnerable to an important worry; namely, that constitutivism leaves us alienated from the moral norms that it claims we must follow. In the first part of the paper, I try to make this vague concern more precise: in a nutshell, it seems that (...) constitutivism cannot provide an adequate account of the relation between the constitutive norms of agency and the particular ends the agent pursues. I then provide a broad outline of an interpretation of Kant’s formalism that is immune to this objection. I conclude that constitutivism is best understood as the upshot of a formalist view of categorical practical principles. (shrink)

In “Constitutivism without Normative Thresholds,” Kathryn Lindeman raises two objections to what she aptly calls Threshold Constitutivism. My aim in this short discussion is to respond to her first objection. Although I will argue that this objection fails, I will also argue that thinking through how to respond to it reminds us of something important, namely, that many of the Norm-Governed Kinds that are directly related to intentional action are social kinds, that is, kinds whose existence conditions we (...) ourselves collectively write. Moral constitutivism purports to explain moral normativity by appeal to the nature of either agency or rational powers. Ambitious constitutivism aspires to ground the categorical authority of morality and to derive the content of the basic moral norms while avoiding the problems of moral realism. As a general strategy, moral constitutivism faces three serious challenges. First, the shmagency challenge. The worry is that the authority of the norms derived from the nature of agency is only conditional on (...) having a reason to be an agent rather than some other kind of subject, a shmagent or an alienated agent. Constitutivists usually reply by appealing to the inescapability of agency. Second, there is a worry that agency is too thin a basis for the derivation of the substantive content of moral norms. Finally, there is the worry that constitutivism might be unable to make room for bad actions. The entry considers possible responses by moral constitutivism to these concerns and whether, if these responses are unsatisfactory, moral constitutivism might still have some explanatory power but of a less ambitious sort. Constitutivists about one's cognitive access to one's mental states often hold that for any rational subject S and mental state M falling into some specified range of types, necessarily, if S believes that she has M, then S has M. Some argue that such a principle applies to beliefs about all types of mental state. Others are more cautious, but offer no criterion by which the principle's range could be determined. In this paper I begin to develop such a criterion, (...) arguing that although the principle applies when M is a belief, it does not apply when M is an emotion. I account for this asymmetry by focusing on differences in the commitments that belief and emotion conceptually involve, and briefly sketch out a psychological explanation of those differences. I conclude that one can reasonably split one's epistemological loyalties between constitutivism regarding meta-beliefs and non- constitutivism regarding beliefs about one's emotions. (shrink)

A central element of constitutivist accounts of categorical normativity is the claim that the ultimate foundation of the relevant kind of practical authority is sourced in certain tasks, features, and aims that every person inevitably possesses and inescapably has to deal with. We have no choice but to be agents and this fact is responsible for the norms and principles that condition our agency-related activities to have anunconditional normative grip on us. Critics of constitutivism argue that it is exactly (...) because of itsinescapability that agency is a powerless source of normative authority. I investigate why our intuitionsconcerning the appeal to inescapability point into such contrary directions. Why do we feel the attraction ofgrounding categorical normativity in phenomena that not even the skeptic can ignore, on the one hand, butseem to hold dear the principle that “ought implies need not,” on the other? Instead of fully developing thethird, neutral, way of conceptualizing the relationship between inescapability and normativity that theimpasse between constitutivists and their critics suggests, this paper diagnoses the disagreement at hand.That agency is inescapable does neither guarantee nor rule out its status qua source of categoricalnormativity. Both camps of the debate overlook this option and depict their opponents as adhering to animplausible perspective of how appeals to inescapability and unconditional normativity are related. Sincethe debate relies on a false dichotomy it is not surprising that its participants so often talk past each other. (shrink)

A brief explanation and overview of constitutivism.

In his writings on moral philosophy, Bishop Joseph Butler adopts an identifiably “constitutivist” strategy because he seeks to ground normativity in features of agency. Butler's constitutivist strategy deserves our attention both because he is an influential precursor to much modern moral philosophy and because it sheds light on current debates about constitutivism. For example, Butler's approach can easily satisfy the “error constraint” that is often thought to derail modern constitutivist approaches. It does this by defining actions relative to the (...) kind of being who performs them, instead of relative to the circumstances of their performance. This gives Butler a conceptually stable account of something that is both fully an action yet morally bad, for which an agent might be held morally responsible. Should modern constitutivists wish to model their views on Butler's in order to satisfy the error constraint, they need not adopt all his theological and other commitments, but they will have to avoid the currently popular constitutivist strategy of deriving normative force from the inescapability of a given principle. This essay is about two familiar theses in the philosophy of mind: constitutivism about instrumental desires, and constitutivism about introspective beliefs, and the arguments for and against them. Constitutivism about instrumental desire is the thesis that instrumental desires are at least partly constituted by the desires and means-end beliefs which explain them, and is a thesis which has been championed most prominently by Michael Smith. Constitutivism about introspective belief is the thesis that introspective beliefs are at (...) least partly constituted by the mental states they are about, and is a thesis which has been championed most prominently by Sydney Shoemaker. Despite their similarities, the fortunes of these two theses could not be more opposed: constitutivism about instrumental desire is widely accepted, and constitutivism about introspective belief is widely rejected. Yet, the arguments for both theses are roughly analogous. This essay explores these arguments. I argue that the argument which is widely taken to be the best argument for constitutivism about instrumental desires---what I call the argument from necessitation---does not provide the support for the thesis it is widely taken to provide, and that it fails for much the same reasons that it fails to provide support for constitutivism about introspective belief. Furthermore, I argue that the best argument for constitutivism about instrumental desires---what I will call the argument from cognitive dynamics---is also a good argument, if not equally good, for constitutivism about introspective belief (at least when the thesis is suitably qualified). Some things, but only some things, are by nature subject to standards. Why? I explain and develop what I call nature-first constitutivism, which says that what something is determines what it should be. Nature is the basis of normativity. I explain this view in terms of a unique type of property which particulars of a genus can lack even though those properties partially determines the nature of the genus. Such properties partially describe the nature of a genus and are (...) thereby normative for the particulars of that genus. Particulars of genera with such essential properties are by nature subject to standards with respect to those properties. In the concluding section of the Book One of the Treatise, Hume confronts radical scepticism about the standards of correct reasoning. According to the naturalistic interpretations, Hume resolves this scepticism by appealing to some psychological facts. A common criticism of this interpretation is that the alleged naturalistic epistemic norm seems to be merely Hume’s report of his psychology, and it remains unclear why this seemingly mere psychological description can provide a principled reason to overcome his scepticism. In this paper, I (...) will argue that Hume’s discussions of the ”indirect passions” and social identity provide a constitutivist ground for the naturalistic epistemic standards in the “Conclusion”: being the object of the indirect passions constitutes what kind of person one is, and being the kind of person (philosopher in Hume’s case) gives non-optional reason to pursue certain kinds of reasoning. I defend constitutivism against two prominent objections and argue that agential constitutivism has the resources to take normative and ethical deliberation seriously. I first consider David Enoch’s shmagency challenge and argue that it does not form a coherent objection. I counter Enoch’s view that the phenomenology of first-person deliberation pragmatically justifies belief in irreducibly realist normative truths, claiming that constitutivism can respect the practice of moral deliberation without appeal to robustly realist truths. Secondly, I argue that the (...) error theoretic worry that all normative judgements are false does not threaten constitutivism ; the objection either fails to shift the burden of proof to constitutivism, or poses justificatory challenges that constitutivism can meet. I conclude that a questionable foundationalism about justification underlies these objections. (shrink)

According to constitutivism, we can justify the authority of aims and norms on the ground that they are inescapable. Constitutivist views divide between ambitious and modest ones. According to ambitious constitutivism, the inescapability of aims grounds their unconditional authority, whereas according to modest constitutivism, the inescapability of aims only grounds their conditional authority. Either way, both forms of constitutivism share the assumption that inescapability grounds authority, which in turn presupposes that at the foundation of normativity we (...) find aims and norms that can be evaluated as having or lacking authority. In this paper I shall defend a form of constitutivism that rejects this assumption. According to this view, which I shall call Hinge Constitutivism, at the foundation of epistemic normativity we find an aim, the truth-aim, that is altogether beyond the evaluation in terms of the ordinary notion of authority. Moreover, I shall argue that to aim at truth is a condition of possibility for justifying the authority of any other aims or norms. In this sense, to aim at truth is a hinge of deliberation. Is moral constructivism an account of the basis of the content of morality or of its authority? In fact, different writers have understood constructivism to be addressing different issues. In this paper I argue that Kant should be understood as a constructivist about the content of morality – or better about a limited set of general substantive principles – and as a constititutivist about its authority. After some general remarks in Section 1 about contemporary discussions of constructivism, in Section 2 (...) I discuss Rawls’s understanding of Kant’s constructivism; Rawls takes Kantian constructivism to be a view about the content of morality. In Section 3, I give an overview of Kant’s moral conception as constructivist about the content of morality and as constitutivist about its authority. In Section 4 I address a worry whether certain features of Kant’s constitutivism rest his constructivism on a realist foundation, arguing that they do not. (shrink)

Constitutivist theories in ethics seek to derive and justify normative ethical claims via facts about constitutive features of agency. In Agency and the Foundations of Ethics: Nietzschean Constitutivism, Paul Katsafanas uses Nietzsche to elucidate a version of the position he believes avoids worries besetting its competitors. This paper argues that Nietzschean constitutivism falters in many of the same places: it may remain vulnerable to ‘schmagency’ objections; it faces problems giving an account of the weights of reasons that adequately (...) explains why we have more reason to perform some actions than others; and it is unable to generate normativity from constitutive aims. These doubts have wider import than Nietzschean constitutivism alone, though: they give good reason to think that such difficulties arise from the very structure of constitutivist approaches. Neo-Kantian accounts which try to ground morality in the necessary requirements of agency face the problem of “bad action”. The most prominent example is Christine Korsgaard’s version of constitutivism that considers the categorical imperative to be indispensable for an agent’s self-constitution. In my paper I will argue that a constitutive account can solve the problem of bad action by applying the distinction between constitutive and regulative rules to the categorical imperative. The result is that an autonomous agent can violate (...) the categorical imperative in so far as it amounts to a regulative rule of morality; however, an agent cannot call into question the categorical imperative as a constitutive rule of the practice of morality without losing her or his identity as a moral agent. We examine whether Thomsonian constitutivism, a metaethical view that analyses value in terms of ‘goodness-fixing kinds,’ i.e. kinds that themselves set the standards for being a good instance of the respective kind, offers a satisfactory explanation of value change and disagreement. While value disagreement has long been considered an important explanandum, we introduce value change as a closely related but distinct phenomenon of metaethical interest. We argue that constitutivism fails to explain both phenomena because of its commitment to (...) goodness-fixing kinds. Constitutivism explains away disagreement and at best explains the emergence of new values, not genuine change. Therefore, Thomsonian constitutivism is not a good fix for realist problems with explaining value disagreement, and value change. (shrink)

This paper has two goals. First, I offer an interpretation of Nietzsche’s puzzling claims about will to power. I argue that the will to power thesis is a version of constitutivism. Constitutivism is the view that we can derive substantive normative conclusions from an account of the nature of agency; in particular, constitutivism rests on the idea that all actions are motivated by a common, higher-order aim, whose presence generates a standard of assessment for actions. Nietzsche’s version (...) of constitutivism is based on a series of subtle claims about the psychology of willing and the nature of satisfaction, which imply that all actions aim at encountering and overcoming resistance (this is what Nietzsche means by “will to power”). Second, I argue that Nietzsche’s theory, thus interpreted, generates a new, a posteriori version of constitutivism that is not vulnerable to certain familiar objections. If this is right, then we can deploy Nietzschean ideas in order to make a substantive contribution to issues that are currently at the forefront of ethics and action theory. (shrink)

Why be moral? According to constitutivism, there are features constitutive of agency, actual or ideal, the properties of which explain why moral norms are normative for us. I aim to investigate whether this idea is plausible. I start off critically. After defining constitutivism and outlining its attractions and problems (chapter 1), I discuss the theories of various features of agency that are supposed to ground morality according to the leading constitutivists in the literature. I find these theories wanting. (...) They are based on implausible assumptions about agency (chapter 2), and they fail to make sense of moral (and other) norms because the so-called shmagency objection, according to which we can shirk from our normative commitments by being ‘shmagents’ rather than agents, appears in new ways for them (chapter 3). Then I get more constructive. I defend a two-tiered form of constitutivism. The first tier captures practical rationality, and the second tier captures reasons for action. Starting with the first tier, I defend a Humean theory of agency (chapter 4) and add a principle of instrumental rationality to it (chapter 5). Appendices A and B supplement these chapters with replies to criticisms of the Humean picture. In chapters 6 and 7, I put this conception of agency to work to reach the second tier of the view. I start by defending a form of reasons internalism which treats practical reasons as grounded in the desires of ideal agents (chapter 6). Then I extend this theory to moral reasons, arguing – unexpectedly for a Humean – that we have universally prescriptive reasons to cooperate with other cooperative agents to satisfy our other respective desires (chapter 7). Hence, the constitutive features of ideal agency ground a morality of cooperation. I conclude by summarizing the case for constitutivism (chapter 8). (shrink)
