Este artículo revisa los problemas relacionados con la distinción actual entre Ética pública y Ética privada; una distinción basada en una tesis reduccionista, según la cual los políticos y empleados públicos son los únicos sujetos agentes en los asuntos de Ética pública. El autor destaca especialmente que la noción actual de Ética Pública cae en el error de aislar en el espacio privado, cuestiones relacionadas con la Ética pública. Un concepto tan limitado, es un gran error que ha servido para (...) ocultar del foco de la Ética Pública una gran cantidad de asuntos vitales que van más allá del campo de interrelación público-privado. Los partidos políticos, los sindicatos, los contribuyentes, los contratistas, los medios de comunicación, las personas subsidiadas, los ciudadanos en general; todos ellos tienen un papel muy importante en la esfera pública, y por lo tanto son agentes en temas de Ética Pública. Por estas razones, el autor refuta la visión estrecha del concepto actual de Ética Pública y cree imprescindible repensarlo, objetiva y subjetivamente. Por otra parte, este estudio examina el nuevo panorama de los "códigos de ética" en España, con una mirada crítica cuando son sólo normas legales acompañadas de sanciones y no verdaderos “códigos de ética”. Estos principios, llamados "principios éticos", deberían ser deberes que los funcionarios públicos poseen por sí mismos y no por imposición. Por el contrario, en el caso que examinamos, esos principios son claramente deberes establecidos en la Constitución Española de 1978 y representan las obligaciones más primarias, superlativas y básicas de un empleado público. En un estado de duda moral, los códigos podrían ser útiles para proporcionar consejo, dando una regla para resolver el dilema ético. El autor reconoce que, en determinadas circunstancias, en tales casos, los códigos de ética pueden ayudar a los servidores públicos como guía en sus decisiones. Sin embargo, la obligación de respetar y garantizar el respeto de los mandatos constitucionales y la prohibición de la discriminación contra las personas por motivos de raza, sexo, religión.., u otras circunstancias, no plantean cuestiones morales. Por esa razón, el autor considera que el Estatuto Básico del Empleado Público en España comete un error al establecer como un principio ético, el deber de cumplir con la Constitución; el más alto deber legal que uno puede imaginar en el caso de los servidores públicos. I argue that the Holonomy Interpretation, at least as it has been presented in Richard Healey’s Gauging What’s Real, faces serious problems. These problems are revealed when certain approximations and idealizations that are innate in the original formulation of the Aharonov-Bohm effect are thrust aside; in particular, when the temporal dimension is taken into account. There are two ways in which time re-appears in the picture: by considering complete solutions to the original problem, where the magnetic flux is static, and (...) by examining the effects of time dependent magnetic fluxes. Both cases expose explanatory gaps in the Interpretation, as well as conflicts between it and customary ideas about relativistic locality and local action on which the Interpretation depends. The article aims to investigate the problematic relationship between populism and democracy by comparing the conceptions of ‘the people’ and popular sovereignty which they presuppose. In the first two sections, the populist and the democratic ‘peoples’ are reconstructed, and the unbridgeable gap dividing them is highlighted. The discussion of the democratic people requires a concise analysis of the main contemporary democratic frameworks, including deliberative democracy, ‘neo-Roman’ republicanism, agonistic democracy. The article works out the implications of the incompatibility between the (...) two ‘sovereign peoples’ identified, and concludes that such an incompatibility undercuts the kinship of populism and democracy. While populism is often said to intertwine with democracy in some way, the article argues that it significantly departs from democratic theory and practice, and belongs to a distinct conceptual space. It cannot be made to overlap with ‘illiberal democracy’, a ‘democratic myth’, a crude electoral majoritarianism, nor does it amount to hiding undemocratic policies into properly democratic justifications. The boundary dividing populism and democracy, therefore, starts unfolding at the level of the conception of the people. While democratic theory invariably assumes a people intended as simultaneously heterogeneous and united, populism conceives of the people as a moral whole, internally undifferentiated, whose homogeneity and intrinsic righteousness preclude the task of specifying what popular sovereignty ultimately means. Such specification, on the other hand, is inescapable for any democrat assuming the people as a composite unity. The last section addresses four possible objections to the argument, variously formulated by Ernesto Laclau and by scholars approaching populism from a post-Laclauian or discursive-performative perspective. I argue that Sarah Sawyer's and Herman Cappelen's recent accounts of how speakers talk and think about the same concept or topic even when their understandings of that concept or topic substantially diverge risk multiplying our metasemantic categories unnecessarily and fail to prove explanatory. When we look more closely at our actual practices of samesaying, we find that speakers with seemingly incompatible formulations of a subject matter take one another to samesay when they are attempting to arrive at a correct (...) understanding of that subject matter. These speakers adopt what I call a prospective externalist perspective on the subject matter in question. I then argue that there are contexts where judgments of samesaying are more routinely defeated because speakers are taking up a perspective I call retrospective internalism. From this perspective, speakers are aiming to render maximally intelligible the linguistic behavior of other speakers that appear to them to deviate from their own. Whether or not we count speakers as samesaying with us will therefore depend on the kind of the perspective we adopt. Different perspectives, it will turn out, often yield different verdicts. On my perspective-based approach, there is no need to hypostatize or inflate our metasemantic taxonomies. (shrink)

Is conceptual relativity a genuine phenomenon? If so, how is it properly understood? And if it does occur, does it undermine metaphysical realism? These are the questions we propose to address. We will argue that conceptual relativity is indeed a genuine phenomenon, albeit an extremely puzzling one. We will offer an account of it. And we will argue that it is entirely compatible with metaphysical realism. Metaphysical realism is the view that there is a world of objects and (...) properties that is independent of our thought and discourse (including our schemes of concepts) about such a world. Hilary Putnam, a former proponent of metaphysical realism, later gave it up largely because of the alleged phenomenon that he himself has given the label ‘conceptual relativity’. One of the key ideas of conceptual relativity is that certain concepts—including such fundamental concepts as object, entity, and existence—have a multiplicity of different and incompatible uses (Putnam 1987, p. 19; 1988, pp. 110 14). According to Putnam, once we recognize the phenomenon of conceptual relativity we must reject metaphysical realism: The suggestion . . . is that what is (by commonsense standards) the same situation can be described in many different ways, depending on how we use the words. The situation does not itself legislate how words like “object,” “entity,” and “exist” must be used. What is wrong with the notion of objects existing “independently” of conceptual schemes is that there are no standards for the use of even the logical notions apart from conceptual choices.” (Putnam 1988, p. 114) Putnam’s intriguing reasoning in this passage is difficult to evaluate directly, because conceptual [1] relativity is philosophically perplexing and in general is not well understood. In this paper we propose a construal of conceptual relativity that clarifies it considerably and explains how it is possible despite its initial air of paradox. We then draw upon this construal to explain why, contrary to Putnam and others, conceptual relativity does not conflict with metaphysical realism, but in fact comports well with it.. (shrink)

This paper applies conceptual engineering to deal with four objections that have been levelled against operationalism in psychology. These objections are: operationalism leads to harmful proliferation of concepts, operationalism goes hand-in-hand with untenable antirealism, operationalism leads to arbitrariness in scientific concept formation, and operationalism is incompatible with the usual conception of scientific measurement. Relying on a formulation of three principles of conceptual engineering, I will argue that there is a useful form of operationalism that does not fall prey (...) to these four objections. (shrink)

Psychologists' emerging interest in spirituality and religion as well as the relevance of each phenomenon to issues of psychological importance requires an understanding of the fundamental characteristics of each construct. On the basis of both historical considerations and a limited but growing empirical literature, we caution against viewing spirituality and religiousness as incompatible and suggest that the common tendency to polarize the terms simply as individual vs. institutional or ′good′ vs. ′bad′ is not fruitful for future research. Also cautioning against (...) the use of restrictive, narrow definitions or overly broad definitions that can rob either construct of its distinctive characteristics, we propose a set of criteria that recognizes the constructs' conceptual similarities and dissimilarities. Rather than trying to force new and likely unsuccessful definitions, we offer these criteria as benchmarks for judging the value of existing definitions. (shrink)

It is widely believed that some a priori necessary truths are not analytic in the sense of transformable by substitution of synonyms into logical truths. One much-cited example comes from the supposed incompatibility between colour predicates. The idea is that sentences like “Nothing is both blue all over (or uniformly or at a point) and also red” are not transformable into a logical truth in the same way as “Nothing is both a bachelor and married” because the requisite (...) class='Hi'>conceptual link between “bachelor” and “not married” is absent between “blue” and “not red”. This paper examines whether colour exclusion may be more like the bachelor case than it initially appears. It transpires that the most promising line of thought is not, however, as has been argued at length in the literature, that “blue” in some more or less convoluted way manages to mean “not red”. Instead it is suggested that the requisite conceptual link may reside in the oft-ignored qualifications (“all over”, “uniformly”, etc.), without which there is no incompatibility in the first place. Hilary Putnam's doctrine of conceptual relativity sustains that there are many different incompatible, yet equivalent, descriptions of what have to be considered "the same" phenomena. This fact is reason to justify the idea that metaphysical realism is wrong and that a better general view of reality should be something like a "pragmatic realism." Putnam sustains further that the different incompatible and equivalent descriptions have to bear the same explanatory virtue. Here it is contended that there seems to be difficulties (...) in construing this requirement in a non-question begging way in an argument designed to show that metaphysical realism should be dismissed. Different descriptions can only be deemed to have the same explanative virtue if our knowledge of, for example, structures in the natural world, seems to be simply a form to "save the phenomena," but this is a characteristic anti-realist thesis that should not be taken for granted in the dialectical setting. In the fifth of his John Locke Lectures, Robert Brandom takes up the challenge to define a formal semantics for modelling conceptual contents according to his normative analysis of linguistic practices. The project is to exploit the notion of incompatibility in order to directly define a modally robust relation of entailment. Unfortunately, it can be proved that, in the original definition, the modal system represented by Incompatibility Semantics (IS) collapses into propositional calculus. In this paper I show (...) how IS can be technically amended so to overcome this failure: the required modifications are already known and consist in adapting and including the main notions of Kripke's standard framework of possible worlds. By 1929, after the full acknowledgment of the colour–exclusion problem, Wittgenstein had to admit that material incompatibilities presented in conceptual systems could not be reduced to formal tautologies and contradictions. Wittgenstein then, in his middle period, had to examine the kind of negation which, for instance, colour systems should render, which expose not just one but many or, in some cases, infinite inferentially articulated alternatives. Here, inspired by Brandom’s inferentialism, I explore the idea that Wittgenstein, in his middle period, (...) advocated a form of inferentialism based on the inferentially articulated content of propositions in Satzsysteme. At that time, Wittgenstein suggested that every sentence should be logically connected to many others. I call this feature inferential thickness. Therefore, I use Löf’s normative read of verificationism to explain Middle Wittgenstein’s holist solution to problems concerning the use of negation related to material incompatibilities and determination of propositional sense. I also investigate the distinction between contrariety and contradiction and some possible connections to a mandatory restriction of the principle of excluded middle in Satzsysteme. (shrink)

Approaching language change within a Darwinian framework constitutes a long-standing tradition within the literature of diachronic linguistics. However, many publications remain vague, omitting conceptual details or missing necessary terminology. For example, phylogenetic trees of language families are regularly compared to biological speciation, but definitions on mechanisms of inheritance, i.e. how linguistic information is transferred between individuals and cohorts, or on the linguistic correlates to genotype and phenotype are often missing or lacking. In light of this, Haider’s attempts to develop (...) this approach into a theoretically more precise position, closely mirroring principles of Darwinian natural selection in the dimension of diachronic grammatical change, but contrasting this with non-Darwinian lexical change. He draws a comparison to viral replication, essentially positing that grammar variants act as mental viruses, competing for replication in new hosts, i.e. children during critical periods of language acquisition. Haider proposes that in light of this competition for replication, the unconscious fixation of an individual’s grammar leads to diachronic grammatical change largely mirroring Darwinian natural selection. Despite the intuitive appeal this mode of reasoning may feature, the following response paper identifies and discusses a suit of shortcomings to this conceptualization. Some problems arise from underspecified theoretical notions, others due to the incomplete or inaccurate adoption of biological principles, and yet more through a partial incompatibility with empirical data. These criticisms do not amount to a dismissal of the Darwinian framework Haider is following, but to a rejection of Haider’s current position. Albeit it remains unclear if a truly Darwinian approach to language change can be reached, suggestions on how Haider’s theoretical notions could be further developed are made and pertinent efforts may ultimately lead to a productive theory. In Choosing Normative Concepts, Eklund considers a “variance thesis” about our most fundamental (and seemingly most “authoritative”) normative concepts. This thesis raises the threat of an alarming symmetry between different sets of normative concepts. If this symmetry holds, it would be incompatible with “ardent realism” about normativity. Eklund argues that the ardent realist should appeal to the idea of “referential normativity” in response to this challenge. I argue that, even if Eklund is right in his core arguments on this front, (...) many other important challenges for ardent realism remain that also stem from the issues about possible variance in normative concepts that he considers. Following this, I introduce further issues about conceptual variance. These are issues that arise within the context of the framework that Eklund proposes the ardent realist use to confront the variance theses he considers. In particular, the issues concern what normative role as such is, as well as, relatedly, which roles associated with a concept (or predicate) get to count as part of its normative role. The current discussions of conceptual schemes and related topics are misguided; for they have been focused too much on the truth-conditional notions of meaning/concepts and translation/interpretation in Tarski's style. It is exactly due to such a Quinean interpretation of the notion of conceptual schemes that the very notion of conceptual schemes falls prey to Davidson's attack. We argue that what should concern us in the discussions of conceptual schemes and related issues, following the initiatives of I. (...) Hacking, T. Kuhn, and N. Rescher, is not the truth-values of assertions, but rather the truthvalue-status of the sentences used to make the assertions. This is because the genuine conceptual innovation between alternative theories/languages does not lie in differences in determining the truth-values of their sentences, but turns on whether these sentences have truth-values when considered within the context of a competing one. The core of conceptual relativism does not consist in the claim that different conceptual schemes may yield incommensurable truth claims, but rather that different conceptual schemes may yield incompatible truth-value-status and therefore lead to distinct perceptions of reality. Conceptual schemes are no longer seen as sentential languages consisting of a set of sentences accepted as true, but rather seen as metaphysical presuppositions of presuppositional languages.[ABSTRACT FROM AUTHOR]. The quantization of gravity represents an important attempt at reconciling the two seemingly incompatible frameworks that lie at the base of modern physics, quantum theory and general relativity. The dissertation begins by looking at the incompatibilities between the two frameworks. The incompatibility with quantum theory, it is argued, is rooted in the profound differences between general relativity and ordinary field theories. The dissertation goes on to look at how, in practice, these incongruities are treated in the canonical quantization program, (...) and argues that their treatment is such that it is unlikely to lead to a satisfactory physical theory. The dissertation concludes by arguing that quantum theory only makes sense when embedded in a classical theory. Thus the reconciliation of quantum theory and general relativity suggests that we look outside the bounds of ordinary quantum theory for the proper theoretical framework. (shrink)

This article explores the explanation of incommensurable theories as alternative conceptual schemes based on different categorical or taxonomic structures. The concept of incommensurability, which is a cornerstone of the late philosophy of Thomas Kuhn, is elucidated, reflecting his approach to avoid assessing the history of science in terms of the truth and falsity of scientific paradigms. It is shown how Kuhn has combined Frege – Russell’s descriptivist semantics and the causal theory of reference by Hilary Putnam and Saul Kripke. (...) His version of semantics consists in redefinition of natural kinds in terms of neuropsychology, in substantiating mentalist and internalist perspective on language. Kuhn’s philosophical position is identified as post-Darwinian Kantianism. It is expressed not in a priori nature of knowledge, but in its determination by conceptual schemes and sociocultural relativity. Despite the fact that the incommensurable terms seem to occur in the history of knowledge, incommensurability remains not the clearest and most consistent way of thinking on the history of science. Kuhn repeatedly refined his views on incommensurability, ultimately aligning it more closely with alternative classifications of objects serving as a framework for subsequent theories. Natural kind concepts, like taxonomic units, distribute the perceived objects into hierarchies reflecting structures of external world. On the one hand, kinds differentiate objectively existing objects into groups. On the other hand, kind terms are both mental modules and cultural constructs that are used to organize the experience of language speakers, identify objects, and provide the basis for group beliefs. Kuhn posits that the development of scientific theories constitutes an evolution of conceptual schemes characterized by disparities and incommensurability. (shrink)

Over the past years McDowell’s conceptualist theory has received mixed phenomenological reviews. Some phenomenologists have claimed that conceptualism involves an over-intellectualization of human experience. Others have drawn on Husserl’s work, arguing that Husserl’s theory of fulfillment challenges conceptualism and that his notion of “real content” is non-conceptual. Still others, by contrast, hold that Husserl’s later phenomenology is in fundamental agreement with McDowell’s theory of conceptually informed experience. So who is right? This paper purports to show that phenomenology does not (...) have to choose between any of these positions. Central to the outline I offer is that there are multiple approaches to non-conceptual content in play today. By separating them we can begin to oversee the diversity of phenomenological contributions to the debate about non-conceptual content. I conclude that current literature presents us with at least three sound phenomenological accounts of non-conceptual content, but also that these are generally not incompatible with conceptualism. This paper attempts to reconcile the conceptual conflict between typological and population thinking to provide a philosophical foundation for extended evolutionary synthesis. Typological thinking has been considered a pre-Darwinian, essentialist dogma incompatible with population thinking, which is the core notion of Darwinism. More recent philosophical and historical studies suggest that a non-essentialist form of typology has some advantages in the study of evolutionary biology. However, even if we adopt such an epistemological interpretation of typological thinking, there still remains an (...) epistemological and methodological conflict between these two styles of thinking. How can we relate typological thinking with population thinking in pursuit of more integrated or interconnected research into evolutionary biology? I propose that homology thinking, which is another style of thinking that recognizes homologous characters, provides a common basis for typological representations of character states and for character dynamics in an evolving population. Good examples of this bridging role are found in teratology and breeding, where variation and novelty are recognized in developmental and morphological traits, gene expression patterns, and so on. Essentialism-free, dynamic views of homology have great potential to reconcile typological and population thinking and to set the stage for the EES. (shrink)

By contrast, non-conceptualism is the view that mental representations of the world do not necessarily presuppose concepts by means of which the content of these representations can be specified, thus cognizers can have mental representations of the world that are non-conceptual. Consequently, if conceptualism is true then non-conceptualism must be (...) false, and vice versa. This incompatibility makes the current debate over conceptualism and non-conceptualism a fundamental controversy since the range of conceptual capacities that cognizers have certainly has an impact on their mental representations of the world, on how sense perception is structured, and how external world beliefs are justified. Conceptualists and non-conceptualists alike refer to Kant as the major authoritative reference point from which they start and develop their arguments. The appeal to Kant attempts to pave the way for a robust answer to the question of whether or not there is non-conceptual content. Since the incompatibility of the conceptualist and non-conceptualist readings of Kant indicate a paradigm case, hopes have risen that the answer to the question of whether Kant is a conceptualist or a non-conceptualist might settle the contemporary controversy across the board. The notion of conceptual space, proposed by Gärdenfors as a framework for the representation of concepts and knowledge, has been highly influential over the last decade or so. One of the main theses involved in this approach is that the conceptual regions associated with properties, concepts, verbs, etc. are convex. The aim of this paper is to show that such a constraint—that of the convexity of the geometry of conceptual regions—is problematic; both from a theoretical perspective and (...) with regard to the inner workings of the theory itself. On the one hand, all the arguments provided in favor of the convexity of conceptual regions rest on controversial assumptions. Additionally, his argument in support of a Euclidean metric, based on the integral character of conceptual dimensions, is weak, and under non-Euclidean metrics the structure of regions may be non-convex. Furthermore, even if the metric were Euclidean, the convexity constraint could be not satisfied if concepts were differentially weighted. On the other hand, Gärdenfors’ convexity constraint is brought into question by the own inner workings of conceptual spaces because: some of the allegedly convex properties of concepts are not convex; the conceptual regions resulting from the combination of convex properties can be non-convex; convex regions may co-vary in non-convex ways; and his definition of verbs is incompatible with a definition of properties in terms of convex regions. Therefore, the mandatory character of the convexity requirement for regions in a conceptual space theory should be reconsidered. (shrink)

An examination of conceptually and rhetorically equivocating positions among academic philosophers and other theorists who are sympathetic to constructivist epistemological developments but unwilling to relinquish key aspects of traditional understandings of truth and knowledge and/or anxious to avoid charges of relativism. A major problem with the resulting hybrid formulations is that, seeking, as they often claim, to “steer a course between Scylla and Charybdis” and being composed of essentially incompatible elements, they can do little theoretical work. Since the incompatibility of the conceptualist and non-conceptualist readings of Kant indicate a paradigm case, hopes have risen that the answer to the question of whether Kant is a conceptualist or a non-conceptualist might settle the contemporary controversy across the board. Organizational scholars tend to view justice and compassion as incompatible. While both have important functions in organizational life, compassion's affective elements appear difficult to synthesize with the reasoning and impartiality that underlie the concept of justice. We draw on theoretical arguments from the sensemaking perspective to argue that we can integrate organizational compassion and organizational justice conceptually because both are inherently dynamic processes that rely on emotional and cognitive components, and both are shaped by the social context of the organization. Based on this integrative conceptualization, we propose a construct we call ‘compassionate organizational justice’, in which compassion becomes an integral element of an organization's justice requirements and members’ fairness perceptions, and that those justice perceptions in turn inform future instances of organizational compassion. I argue that algebraic quantum field theory (AQFT) permits an undisturbed view of the right ontology for fundamental physics, whereas standard (or Lagrangian) QFT offers different mutually incompatible ontologies.My claim does not depend on the mathematical inconsistency of standard QFT but on the fact that AQFT has the same concerns as ontology, namely categorical parsimony and a clearly structured hierarchy of entities.

David Chalmers has recently argued that Bayesian conditionalization is a constraint on conceptual constancy, and that this constraint, together with “standard Bayesian considerations about evidence and updating,” is incompatible with the Quinean claim that every belief is rationally revisable. Chalmers’s argument presupposes that the sort of conceptual constancy that is relevant to Bayesian conditionalization is the same as the sort of conceptual constancy that is relevant to the claim that every belief is rationally revisable. To challenge this (...) presupposition I explicate a sort of “conceptual role” constancy that a rational subject could take to be necessary and sufficient for a rule of Bayesian conditionalization to govern her belief updating, and show that a rational subject may simultaneously commit herself to updating her beliefs in accord with such a rule and accept the claim that every belief is rationally revisable. There has been little discussion of the compatibility of Theistic Conceptual Realism with the doctrine of divine simplicity. On the one hand, if a plurality of universals is necessary to explain the character of particular things, there is reason to think this commits the proponent of TCR to the existence of a plurality of divine concepts. So the proponent of the DDS has aprima faciereason to reject TCR. On the other hand, many mediaeval philosophers accept both the existence of (...) divine ideas and the DDS. In this article I draw on mediaeval and contemporary accounts of properties and divine simplicity to argue that the two theories are not logically incompatible. (shrink)

La principal objeción contra al dualismo cartesiano en filosofía de la mente es que resulta incompatible con la ciencia. Se sostiene, en particular, que el principio de clausura causal del mundo físico y el teorema de preservación de la energía, así como el concepto de interacción dinámica de la física fundamental, desautorizan la postulación de interacciones causales entre sustancias pensantes y sustancias extensas. En este trabajo sostengo que esta conclusión es por lo menos apresurada y que no es un asunto (...) trivial refutar el dualismo cartesiano usando consideraciones empíricas. Mis tesis son: (i) que las críticas antidualistas basadas en premisas científicas colapsan en un reduccionismo metafísicamente implausible y (ii) que la teoría física no excluye la existencia de una relación de causación o interacción dinámica recurrente como la que se requiere para explicar la experiencia consciente, postulando un nexo pertinente entre mentes inmateriales y sistemas nerviosos. The virtue of honesty has been stunningly neglected in contemporary philosophy, with only two papers appearing in the last 40 years. The first half of this paper is a conceptual exploration of one aspect of the virtue, namely the honest person’s motivational profile. I argue that egoistic motives for telling the truth or not cheating are incompatible with honest motivation. At the same time, there is no one specific motive that is required for a person to be motivated in (...) a virtuously honest way. Instead I advance a pluralistic theory of honest motivation, which allows for motives of caring, fairness, and virtue, among others. The second half of the paper then turns briefly to the empirical literature in psychology and behavioral economics on cheating, to see to what extent honest motives appear to be operative. The upshot is that we have good preliminary evidence for the claim that most people are not virtuously honest. (shrink)

The relationship between legal pluralism and international human rights law is a complex and multi-faceted one. To fully appreciate the nature of this relationship, one has to desegregate the various forms of legal pluralism and analyse whether in their existence or operation they are compatible with international human rights law. This article undertakes such an exercise drawing on the jurisprudence of global and regional human rights bodies. In doing so, it goes beyond a mechanical audit of legal pluralism in the (...) light of specific human rights and explores more foundational issues such as the nature and extent of a State’s human rights obligations when legal pluralism exists within its borders, the possibility of waiving human rights and questions of cultural relativism which hover over any discussion of legal pluralism. What emerges from this analysis is that a tentative conceptual framework exists to regulate the relationship between legal pluralism and international human rights law. It is one that not only requires the State to render legal pluralism compatible with human rights but also stipulates the process by which this should be done. Effectively implemented, it can achieve this objective and harness the pull of religious and customary law to ensure the more effective protection of human rights. (shrink)

Making Sense of Evolution explores contemporary evolutionary biology, focusing on the elements of theories—selection, adaptation, and species—that are complex and open to multiple possible interpretations, many of which are incompatible with one another and with other accepted practices in the discipline. Particular experimental methods, for example, may demand one understanding of “selection,” while the application of the same concept to another area of evolutionary biology could necessitate a very different definition.

The article discusses the features of the love-passionate plot in the stories of Ivan Bunin. The question is raised why Bunin, describing the strange or immoral acts of the heroes, does not condemn them, and in general draws a bright, sometimes sad atmosphere. Analysis of L. S. Vygotsky’s short story “Easy Breathing” by Bunin allows us to express an idea about a certain strategy for building Bunin’s works. Based on this consideration, the methods by which Bunin achieves the effect of (...) perception of the characters he needs are analyzed. There are three such techniques: the convergence of the actions and behavior of the characters with the life and breath of nature, the depiction of the life of the characters from the point of view that Bunin needs, and the endowment of the characters with personality traits that exclude ethical characteristics and problems. The scientific explanation of Bunin's artistic constructions is based on the analysis of mental trauma (caused by the departure of the first wife and the horrors of the revolution), artistic understanding of the events that interest the writer, and the peculiarities of the conceptualization of these events. In addition, it is proposed to take into account that Bunin began and became famous as a poet, and as a poet he composed his prose partly according to the laws of versification. (shrink)

The paper presents the heterogeneous proxytypes hypothesis as a cognitively-inspired computational framework able to reconcile, in both natural and artificial systems, different theories of typicality about conceptual representation and reasoning that have been traditionally seen as incompatible. In particular, through the Dual PECCS system and its evolution, it shows how prototypes, exemplars and theory-theory like conceptual representations can be integrated in a cognitive artificial agent (thus extending its categorization capabilities) and, in addition, can provide useful insights in the (...) context of a computationally grounded science of the mind. Despite the intriguing philosophical impetus underlying the latter, the author formulates doubts about its compatibility with logical and metaphysical principles of absolute idealism. The criticism is articulated in four theses: pragmatism’s concerns with concept-acquisition and concept-application are largely alien to Hegel’s logical-metaphysical theory of conceptuality; the interchangeability of ‘word’ and ‘concept’ in the pragmatist discussion is incompatible with Hegel’s notion of thinking; the distinction (...) of Vertsandesbestimmung and Vernunftbegriff, while ignored in practice in the pragmatist approach, is pivotal to Hegel’s understanding of the nature of conceptuality; finally, pragmatism’s use of the recognition-thesis from the Phenomenology of Spirit ignores the noncontractarian, non-negotiative function of the same in Hegel’s work. The Global Workspace Theory (GWT) proposed by Bernard Baars (1988) along with Daniel Dennett’s (1991) Multiple Drafts Model (MDM) of consciousness are renowned cognitive theories of consciousness bearing similarities and differences. Although Dennett displays sympathy for GWT, his own MDM does not seem to be fully compatible with it. This work discusses this compatibility, by asking if GWT suffers from Daniel Dennett’s criticism of what he calls a “Cartesian Theater”. We identified in Dennett 10 requirements for avoiding the Cartesian Theater. (...) We believe that some of these requirements are violated by GWT, but not all, hence there is partial incompatibility with MDM, and it is nonsense to answer if GWT is or is not a Cartesian Theater. However, by asking such question we conclude that the issues around this discussion involve fuzzy claims about degrees of consciousness and we show how the Neuro-Astroglial Interaction Model (NAIM) is fit for solving such conceptual issues. It has been argued extensively that diagnostic services are a general good, but that it is offered in excess. So what is the problem? Is not “too much of a good thing wonderful”, to paraphrase Mae West? This article explores such a possibility in the field of radiological services where it is argued that more than 40% of the examinations are excessive. The question of whether radiological examinations are excessive cries for a definition of diagnostic futility. However, no such definition (...) is found in the literature. As a response, this article addresses the issue of diagnostic futility in five steps. First, it investigates whether the concept of therapeutic futility can be adapted to diagnostics. A closer analysis of the concept of therapeutic futility reveals that this will not do the trick. Second, the article scrutinizes whether there are sources for clarifying diagnostic futility in the extensive debate on excessive radiological examination. Investigating the debate’s terms and definitions reveals a disparate terminology and no clear concepts. On the contrary, the study uncovers that quite different and incompatible issues are at stake. Third, the article examines a procedural approach, which is widely used for settling controversies over utility by focusing on the role of the professionals. On scrutiny however, a procedural approach will not solve the problem in diagnostics. Fourth, a value analysis reveals how we have to decide on the negative value of excessive examinations before we can measure excess. The final and constructive part presents a definition of diagnostic futility drawing upon the lessons from the previous analytical steps. Altogether, too much radiological examination is not a good thing. This is simply because radiological examinations are not unanimously good. Excessive radiological examinations can be defined, but not by one simple general and value-neutral definition. We have to settle with contextually framed value-related definitions. Such definitions will state how bad “too much of a good thing” is and make it possible to assess how much of the bad thing there is. Hence we have to know how bad it is before we can tell how much of it there is in the world. (shrink)

I compare Sellars’s criticism of the ‘myth of the given’ with Quine’s criticism of the ‘two dogmas’ of empiricism, that is, the analytic–synthetic distinction and reductionism. In Sections I to III, I present Quine’s and Sellars’s views. In IV to X, I discuss similarities and differences in their views. In XI to XII, I show that Sellars’s arguments against the ‘myth of the given’ are incompatible with Quine’s rejection of the analytic–synthetic distinction.

The debate over the future of East Asian democracy centers largely on the fit between democratic values and the Confucian way of life. Some interpret Confucianism's hierarchical, communitarian, and anti-pluralistic values as a roadblock to democratic consolidation. Others interpret the Confucian traditions of dissent and accountability as comparable to liberal institutions. This article surveys this scholarly debate by dividing the literature into three theoretical camps: compatibility, incompatibility, and convergence. Additionally, the few available empirical works on the Confucian-democratic dynamic are (...) discussed and the findings are applied to the three categorizations. This review article maintains that a consensus on the relationship between Confucianism and democracy remains elusive due to the divergent conceptualizations and operationalizations of the two doctrines.
