It is well-established that algorithms can be instruments of injustice. It is less frequently discussed, however, how current modes of AI deployment often make the very discovery of injustice difficult, if not impossible. In this article, we focus on the effects of algorithmic profiling on epistemic agency. We show how algorithmic profiling can give rise to epistemic injustice through the depletion of epistemic resources that are needed to interpret and evaluate certain experiences. By doing so, we not only (...) demonstrate how the philosophical conceptual framework of epistemic injustice can help pinpoint potential, systematic harms from algorithmic profiling, but we also identify a novel source of hermeneutical injustice that to date has received little attention in the relevant literature: epistemic fragmentation. Epistemic fragmentation is a structural characteristic of algorithmically-mediated environments that isolate individuals, making it more difficult to develop, uptake and apply new epistemic resources. This, in turn, can impede the identification and conceptualisation of emerging harms in these environments. We trace the occurrence of hermeneutical injustice back to the fragmentation of the epistemic experiences of individuals, who are left more vulnerable by the inability to share, compare, and learn from shared experiences. Based on a deliberative democracy, this book uses a hermeneutic-critical methodology to study bibliographical sources and practical issues in order to analyse the possibilities, limits and consequences of the digital transformation of democracy. Drawing on a two-way democracy, the aim of this book is intended as an aid for thinking through viable alternatives to the current state of democracy with regard to its ethical foundations and the moral knowledge implicit in or assumed by the way we perceive and understand democracy. This article puts into perspective the practice of financial regulation in contemporary financial markets, while a new normative order has emerged. This order, heralded by algorithmic technologies, changes the conditions for the exercise of regulation: to date, it has not yet been fully acknowledged nor understood by regulatory bodies. Computer code, replacing speech and writing, induces a changeover from one normative order to another in contemporary markets: the norm, previously explicated with recourse to interpretation, is now replaced by an (...) order characterized by calculation. Such paradigm change is identified based on a discussion of works by Gilles Deleuze. In so doing, it contributes to the developing research programme in the cultures of high-frequency trading (Lange et al. 2016) and also points at broader issues for conceptualising financial regulation. This paper examines racial discrimination and algorithmic bias in predictive policing algorithms (PPAs), an emerging technology designed to predict threats and suggest solutions in law enforcement. We first describe what discrimination is in a case study of Chicago’s PPA. We then explain their causes with Broadbent’s contrastive model of causation and causal diagrams. Based on the cognitive science literature, we also explain why fairness is not an objective truth discoverable in laboratories but has context-sensitive social meanings that need to (...) be negotiated through democratic processes. With the above analysis, we next predict why some recommendations given in the bias reduction literature are not as effective as expected. Unlike the cliché highlighting equal participation for all stakeholders in predictive policing, we emphasize power structures to avoid hermeneutical lacunae. Finally, we aim to control PPA discrimination by proposing a governance solution—a framework of a social safety net. (shrink)

I would like to introduce the notion of machine hermeneutics in this paper. The notion refers to hermeneutical activity performed by machines. Machines are now capable of making the very interpretive tasks, using artificial intelligence algorithms based on the technology of machine learning that used to be the exclusive domain of human beings. In making this claim, I am not talking about possible conscious machines of the future, but those existing here and now. With facial recognition algorithms, for example, (...) machines are now performing routinely what must be regarded as hermeneutical analyses with astounding accuracy and power. Thus, machine hermeneutics supplements Don Ihde’s notion of material hermeneutics. In the latter, it is still human beings who do the interpretation, through the lenses provided the natural sciences; in this case, the natural sciences, or the technology afforded by the sciences, intervene between the human being and the world. In machine hermeneutics, on the contrary, the intervening comes in two layers. On the one hand, there is the usual intervention that Ihde talks about, but on the other, the artificial intelligence algorithm performs its own kind of intervention and interpretation, presenting an already interpreted result to the human beings, who then perceive it through the aid of the usual intervention such as the normal eyeglasses. Then the paper discusses the problem of how to justify the kind of perception that undergoes this process. In what sense can it be said that the algorithm is performing the right action, i.e., one such that the process comes up with a right picture of the world? I contend that this does not merely consist of technical excellence for the technology involved, but also ethical excellence. The two cannot be considered one apart from the other. (shrink)

In this paper, I present a Foucauldian reflection on our datafied present. Following others, I characterize this present as a condition of “digital capitalism” and proceed to explore whether and how digital conditions present an important change of episteme and, accordingly, an importantly different mode of subjectivity. I answer both of these concerns affirmatively. In the process, I engage with Colin Koopman’s recent work on infopower and argue that, despite changes in episteme and modes of subjectivity, the digital capitalist present (...) is continuous with biopolitics as Foucault understood it, though it does raise serious worries about the possibility of transgressive resistance. Scholars in both digital humanities and media studies have noted an apparent disconnect between computation and the interpretive methods of the humanities. Alan Liu has argued that literary scholars employing digital methods encounter a “meaning problem” due to the difficulty of reconciling algorithmic methods with interpretive ones. Conversely, the media scholar Friedrich Kittler has questioned the adequacy of hermeneutics as a means of studying computers. This paper argues that that this disconnect results from a set of contingent decisions (...) made in both humanistic and mathematical disciplines in the first half of the nineteenth century that delineated, with implications that continue to resonate in the present day, which aspects of human activity would come to be formalized in algorithms and which would not. I begin with a discussion of Nicolas de Condorcet, who attempted, at the height of the 1789 revolution, to turn algebra into a universal language; his work, I argue, exemplifies the form of algorithmic thinking that existed before the Romantic turn. Next, I discuss William Wordsworth’s arguments about the relationship of poetry and science. While Wordsworth is sometimes viewed as a critic of science, I argue that his polemic is specifically targeted at highly politicized projects like Condorcet’s that sought to supplant existing modes of thought with scientific rationality. Finally, I demonstrate the importance of Romantic thought for George Boole, creator of the logic system that would eventually form the basis of digital electronics. The reason Boole was able to succeed where Condorcet had failed, I argue, was that Romantic notions of culture enabled him to reconcile a mechanical view of mathematical reasoning with an organic view of the development of meaning—a dichotomy that remains a key assumption of computer interfaces in the twenty-first century. The article presents an overview of A. S. Akhiezer’s reconstruction of Russia’s socio-cultural history as a cultural hermeneutic. The underlying idea is that the way humans make sense of their existence is driven by an algorithm of meaning production informing the organization of their ‘world’, in particular the selection of the means involved in that production. Thus the central axis of Akhiezer’s hermeneutic, methodogically, is symbolization: ‘worlds’, that is, socio-cultural matrices, are made according to and reflect specific modes of symbolization. (...) Akhiezer’s account of the Russian socio-cultural experience is centred on the particular algorithm that he names raskol. His purpose was twofold: to examine the ‘logic’ of raskol, on the one hand, and to investigate, on the other hand, in the manner of a historian, its impact and consequences for Russian society at large, including its effects on institution-building. In this way, the study of raskol goes hand in hand with an investigation of and commentary concerning the uncertain state in Russia of what Akhiezer named the bol’šoe obščestvo. In effect, his theory is a social ontology with culture at the centre. (shrink)

This book presents novel formalizations of three of the most important medieval logical theories: supposition, consequence and obligations. In an additional fourth part, an in-depth analysis of the concept of formalization is presented - a crucial concept in the current logical panorama, which as such receives surprisingly little attention.Although formalizations of medieval logical theories have been proposed earlier in the literature, the formalizations presented here are all based on innovative vantage points: supposition theories as algorithmic hermeneutics, theories of (...) consequence analyzed with tools borrowed from model-theory and two-dimensional semantics, and obligations as logical games. For this reason, this is perhaps the first time that these medieval logical theories are made fully accessible to the modern philosopher and logician who wishes to obtain a better grasp of them, but who has always been held back by the lack of appropriate ‘translations' into modern terms.Moreover, the book offers a reflection on the very nature of logic, a reflection that is prompted by the comparisons between medieval and modern logic, their similarities and dissimilarities. It is thus a contribution not only to the history of logic, but also to the philosophy of logic, the philosophy of language and semantics.The analysis of medieval logic is also relevant for the modern philosopher and logician in that, being the unifying methodology used across all disciplines at that time, logic really provided unity to science. “Interpretation” is a term that encompasses both the most esoteric and the most fundamental activities of our lives, from analyzing medical images to the million ways we perceive other people’s actions. Today, we also leave interpretation to the likes of web cookies, social media algorithms, and automated markets. But as John Frow shows in this thoughtfully argued book, there is much yet to do in clarifying how we understand the social organization of interpretation. On Interpretive Conflict delves into four case (...) studies where sharply different sets of values come into play—gun control, anti-Semitism, the religious force of images, and climate change. In each case, Frow lays out the way these controversies unfold within interpretive regimes that establish what counts as an interpretable object and the protocols of evidence and proof that should govern it. Artificial intelligence-based (AI) technologies such as machine learning (ML) systems are playing an increasingly relevant role in medicine and healthcare, bringing about novel ethical and epistemological issues that need to be timely addressed. Even though ethical questions connected to epistemic concerns have been at the center of the debate, it is going unnoticed how epistemic forms of injustice can be ML-induced, specifically in healthcare. I analyze the shortcomings of an ML system currently deployed in the USA to predict patients’ likelihood (...) of opioid addiction and misuse (PDMP algorithmic platforms). Drawing on this analysis, I aim to show that the wrong inflicted on epistemic agents involved in and affected by these systems’ decision-making processes can be captured through the lenses of Miranda Fricker’s account of hermeneutical injustice. I further argue that ML-induced hermeneutical injustice is particularly harmful due to what I define as an automated hermeneutical appropriation from the side of the ML system. The latter occurs if the ML system establishes meanings and shared hermeneutical resources without allowing for human oversight, impairing understanding and communication practices among stakeholders involved in medical decision-making. Furthermore and very much crucially, an automated hermeneutical appropriation can be recognized if physicians are strongly limited in their possibilities to safeguard patients from ML-induced hermeneutical injustice. Overall, my paper should expand the analysis of ethical issues raised by ML systems that are to be considered epistemic in nature, thus contributing to bridging the gap between these two dimensions in the ongoing debate. Neuroadaptive technology (NAT) is a closed-loop neurotechnology designed to enhance human–computer interaction. NAT works by collecting neurophysiological data, which are analysed via autonomous algorithms to create actions and adaptations at the user interface. This paper concerns how interaction with NAT can mediate self-related processing (SRP), such as self-awareness, self-knowledge, and agency. We begin with a postphenomenological analysis of the NAT closed loop to highlight the built-in selectivities of machine hermeneutics, i.e., autonomous chains of algorithms that convert data into an (...) assessment of psychological states/intentions. We argue that these algorithms produce an assessment of lived experience that is quantitative, reductive, and highly simplistic. This reductive assessment of lived experience is presented to the user via feedback at the NAT interface and subsequently mediates SRP. It is argued that congruence between system feedback and SRP determines the precise character of the alterity relation between human user and system. If feedback confirms SRP, the technology is regarded as a quasi-self. If there is a disagreement between SRP and feedback from the system, NAT is perceived to be a quasi-other. We argue that the design of the user interface shapes the precise ways in which NAT can mediate SRP. (shrink)

In this article I discuss the nature and sense of legal reasoning as reasonableness, i.e. as judgement and equilibrium between normativity and factuality, and as constant approximation between these two dimensions. By phrasing the intertwinement between legal hermeneutics and the nature and function of writing, the structure of the article is constructed so that the focus is on the changes currently occurring with the so-called ‘digital revolution’: in imagining a juridical system administrated through data analysis and algorithms, some contradictions (...) emerge, especially concerning the nature, sense and task of legal hermeneutics. The current shift of paradigm should be first of all addressed starting from the grammatological nature of the revolution at stake. Only from this perspective can the shift be entirely grasped and, at the same time, only from this perspective can the methodological conundrum be deconstructed. (shrink)

Digitalisation and platformisation are continuously impacting and reshaping the societies we live in. In this context, we are witnessing the rise of phenomena such as fake news, hate speech, and the sharing of any other illegal content through social media. In this paper, I propose some ethical reflections on content moderation in the context of digital (social) media, as this topic seems – to me – to already incorporate other relevant digital issues in it, such as algorithms bias, the spread (...) of fake news, and the potential misuses of artificial intelligence. In the first section, I will provide a few hermeneutic reflections over a speech given by the Italian scholar Umberto Eco, which appears to underline the necessity of a content moderation in an era of digital (social) media. In the second section, I will analyse, through a consequentialist perspective, critical and ethical issues posed by content moderation. In particular, I suggest the idea of a ‘moderate’ (reasonable and limited) content moderation that can only be assured by humans, as they are able to contextualise the content, to take emotions and subjective elements into account, to apply critical thinking and adaptability in complex circumstances. Heidegger and Badiou are not likely to be received as philosophical figures inheriting much in common. The only obvious ground which backs both thinkers is that of ontology as primary focus of their intellectual endeavors. However, this is divergence between their philosophies what makes an attempt to reveal some other conceptual foundations their doctrines have in common so important for a historian of the recent transformations in philosophy. The concept of subject looks as an indicator of differences between Heidegger and (...) Badiou, since Heideggerian destruction of the metaphysics of subject is opposed by positive and affirmative indoctrination of subject developed by Badiou. Affirmative concept of the subject implies certain references to Heidegger's negative hermeneutics of the Modern subjectivity where it says about reactionary subject or dark subject. As we see Badiou skillfully attunes his conception to the profound destructivity of Heidegger's negation of subject. What these two thinkers share is certainly the need for a middle term between totality and unifying force of being and particularity and contingency of the individual human life, which would be efficient in denoting the very transition of the particular into the common. The early Heidegger of decisive Dasein can be regarded as a forerunner of the Maoist revolutionary subject of Badiou, with its prophecy of becoming a historical driving force and gathering the strength of the particular around a traumatic Event. For both Heidegger and Badiou the "movement" of truth proceeds trough a series of choices which cannot be governed by a law or "an algorithm." The indiscernible truth forces a subject to permanently find him/herself amid the "undecidable." The procedure of fidelity traverses the existent knowledge. One can scarcely know whether an event has taken place, one can rather bet upon its truth. For both philosophers the concept of truth is indissolubly connected with the problems of ethics. Heidegger points to the "most primordial truth," which is the "truth of existence." Abiding in this truth, Dasein discloses itself to itself and discovers its ownmost potentiality-for-Being. Being built on the ground of mutual effect, facing the current state-isolation, international law is losing its grip on efficiency. This makes some of us to question (1) If law is not working, do we still need law? If we would say no, the history shows that such is the path to the state-suicide. As Smithian mutual benefits is the assurance of the individual benefits, we need international relationships to create the benefits for the individual states, hence international law, Yet (...) the current one is certainly not working, then, the question, (2) What should the international law be? The enforcement of the international law could be accomplished through the blockchain. As blockchain “went bypass” the national law, and simply negated it, yet it is still not immune to the scope of international jurisdiction. We also argue that the blockchain’ smart contract is not sufficient enough to operate smoothly. Human brain is structured as the mirror rather than a glass and transferring the law interpretation to the machine would not work, hence, we designed the formula of langue and parole, blockchain multiseg operating under the semiotics of the international law. Here the language learning is modelled with the supervisory and reinforcing algorithms, with supervisory predetermined with bias X,Y towards the values of law. Sort of form of constant repetends of Heidegger’s hermeneutics circle. The most important part in this paper is written with the purpose to explain that international law is at the same struggle that Kafka had. Carrying the weight of both, the clothed façade and true self, first being the morality guide and later the states will, and not being neither, international law is self-isolated from the real world, as Gregor Samsa was. Hence, this is not the paper of secularization, no customs, no higher purpose, nothing except the will of states, that can be constantly renewed with the signifier and signified being linked and re-linked. Through a critical analysis of recent developments in the theory and practice of data science, including nascent feminist approaches to data collection and analysis, this commentary aims to signal the need for a transnational feminist orientation towards data science. I argue that while much needed in the context of persistent algorithmic oppression, a Western feminist lens limits the scope of problems, and thus—solutions, critical data scholars, and scientists can consider. A resolutely transnational feminist approach on the other hand, can (...) provide data theorists and practitioners with the hermeneutic tools necessary to identify and disrupt instances of injustice in a more inclusive and comprehensive manner. A transnational feminist orientation to data science can pay particular attention to the communities rendered most vulnerable by algorithmic oppression, such as women of color and populations in non-Western countries. I present five ways in which transnational feminism can be leveraged as an intervention into the current data science canon. (shrink)

The central question of this conference is whether the media can contribute to high quality social dialogue. The prospects for resolving that question positively in the “sound and fury” depend on recovering the idea of truth. At present the news media are lurching along from one crisis to another with an empty centre. We need to articulate a believable concept of truth as communication's master principle. As the norm of healing is to medicine, justice to politics, critical thinking to education, (...) craftsmanship to engineering, and stewardship to business, so truth-telling is the news profession's occupational norm. Truth-telling is the ethical framework that fundamentally reorders the media's professional culture and enables them to enrich social dialogue rather than undermine it.Historically the mainstream press has defined itself in terms of an objectivist worldview. Centred on human rationality and armed with the scientific method, the facts in news have been said to mirror reality. The aim has been true and incontrovertible accounts of a domain separate from human consciousness. In Bertrand Russell's formula, “truth consists in some form of correspondence between belief and fact” . In the received view, truth is defined in elementary epistemological terms as accurate representation. News corresponds to context-free neutral algorithms, and ethics is equated with impartiality.The attacks on this misguided view of human knowledge had already originated in Giambattista Vico's fantasia and Wilhelm Dilthey's verstehen in the counter-Enlightenment of the 18th century. They have continued with hermeneutics, critical theory in the Frankfurt School, American pragmatism, Wittgenstein's linguistic philosophy, Gramsci, and in their own way, Lyotard's denial of master narratives and Derrida's sliding signifiers; until the anti-foundationalism of our own day indicates a crisis in correspondence views of truth. Institutional structures remain Enlightenment-driven, but in principle the tide has turned currently toward restricting objectivism to the territory of mathematics, physics, and the natural sciences. In reporting, objectivity has become increasingly controversial as the working press' professional standard, though it will remain entrenched in our ordinary practices of news production and dissemination until an alternative mission for the press is convincingly formulated.The demise of correspondence views of truth has created a predicament for the notion of truth altogether. However, instead of appealing to coherence versions or abandoning the concept, truth needs to be relocated in the moral sphere. Truth is a problem of axiology rather than epistemology. With the dominant scheme no longer tenable, truth should become the province of ethicists who can reconstruct it as the news media's contribution to social dialogue.When truth is articulated in terms of a moral framework, we can mold its richly textured meaning around the Hebrew emeth , the Greek aletheia . In Serbo-Croatian the true is justified as with plumbline in carpentry. In the powerful wheel imagery of the Buddhist tradition, truth is the immovable axle. The Truth and Reconciliation Commission in South Africa presumes that sufferings from apartheid can be healed through truthful testimony. In Ghandhi's “satyagrapha,” the power of truth through the human spirit eventually wins over force . Dietrich Bonhoeffer's Ethics contends correctly that a truthful account lays hold of the context, motives, and presuppositions involved .Telling the truth depends on the quality of discernment so that penultimates do not gain ultimacy. Truth means, in other words, to strike gold, to get at “the core, the essence, the nub, the heart of the matter” . For Henry David Thoreau – though addressing a different issue – when we are truthful, we attempt to “drive life into a corner and¼if it proves to be mean, why then to get the genuine meanness out of it and publish its meanness to the world; or if it were sublime, to know it by personal experience and be able to give a true account of the encounter” . For the former secretary general of the United Nations, Dag Hammarskjold, “the most dangerous of all moral dilemmas is when we are obliged to conceal truth in order to help the truth be victorious” . In the Talmud, the liar's punishment is that no one believes him.Augustine , professor of rhetoric at Milan and later Bishop of Hippo, illustrates a non-correspondence view of truth. His rhetorical theory is a major contribution to the philosophy of communication, contradicting the highly secular and linear view of the ancient Greeks. As with Aristotle, rhetoric entails reasoned judgement for Augustine; however, he “break[s] away from Graeco-Roman rhetoric, moving instead toward ¼rhetoric as aletheiac act” . Rhetoric for him is not knowledge-producing or opinion-producing but truth-producing . The Epistolae Doctrina Christiana scourges the value-neutral, technical language of “word merchants” without wisdom.Truth is not fundamentally a prescriptive statement. The aletheiac act in Augustine “tends to be more relational than propositional, a dialogically interpersonal, sacramentally charitable act rather than a statement¼taking into account and being motivated by [the cardinal virtues] faith, hope, and charity” . The truth for him does not merely make things clear, but motivates us to belief and action. In truthful communication for Augustine, “it is not enough to seek to move men's minds, merely for the sake of power; instead, the power to move is to be used to lead men to truth”. (shrink)

The theory of evolution of complex and comprising of human systems and algorithm for its constructing are the synthesis of evolutionary epistemology, philosophical anthropology and concrete scientific empirical basis in modern (transdisciplinary) science. «Trans-disciplinary» in the context is interpreted as a completely new epistemological situation, which is fraught with the initiation of a civilizational crisis. Philosophy and ideology of technogenic civilization is based on the possibility of unambiguous demarcation of public value and descriptive scientific discourses (1), and the object and (...) subject of the cognitive process (2). Both of these attributes are no longer valid. For mass, everyday consciousness and institutional philosophical tradition it is intuitively obvious that having the ability to control the evolutionary process, Homo sapiens came close to the borders of their own biological and cultural identity. The spontaneous coevolutionary process of interaction between the «subject» (rational living organisms) and the «object» (material world), is the teleological trend of the movement towards the complete rationalization of the World as It Is, its merger with the World of Due. The stratification of the global evolutionary process into selective and semantic (teleological) coevolutionary and therefore ontologically inseparable components follows. With the entry of anthropogenic civilization into the stage of the information society, firsty, the post-academic phase of the historical evolution of scientific rationality began, the attributes of which are the specific methodology of scientific knowledge, scientific ethos and ontology. Bioethics as a phenomenon of intellectual culture represents a natural philosophical core of modern post- academic (human-dimensional) science, in which the ethical neutrality of scientific theory principle is inapplicable, and elements of public-axiological and scientific-descriptive discourses are integrated into a single logic construction. As result, hermeneutics precedes epistemology not only methodologically, but also meaningfully, and natural philosophy is regaining the status of the backbone of the theory of evolution – in an explicit form. The goal of this article is twofold. First, it aims at sketching the outlines of material hermeneutics as a three-level analysis of technological artefacts. In the first section, we introduce Erwin Panofsky’s three levels of interpretation of an artwork, and we propose to import this approach in the field of philosophy of technology. Second, the rest of the article focuses on the third level, with a specific attention towards big data and algorithms of artificial intelligence. The thesis is that (...) these new technologies are not only radically transforming our interactions with the world, or our modes of production and consumption, but also our worldview. In the second section, we rely on Panofsky’s Gothic Architecture and Scholasticism to describe the Scholastic “mental habit” or worldview and its principles. In the third section, we confront this worldview with the mechanistic and informationistic worldviews. Our contribution consists in arguing that (1) despite the differences, the Scholastic, mechanistic, and informationistic worldviews are part of the same logical and causal order that dominated Western epistemology, and (2) today we are facing the appearance of a new worldview that we call “data worldview”. Examples from design, architecture, and visualization of knowledge will be set all along the article. (shrink)

The methodological basis for the implementation of the proposed project is the theory of research-oriented professional education and, thereafter, technology of advanced learning, which provide wide opportunities to (...) study the course of bioethics in the form of observation of remote virtual experiments on the portal Go-Lab; GRAASP environment for the implementation of author's developments and pedagogically structured programs in the process of performative interaction between teacher and students. Algorithms wield increasing control over our lives—over which jobs we get, whether we're granted loans, what information we're exposed to online, and so on. Algorithms can, and often do, wield their power in a biased way, and much work has been devoted to algorithmic bias. In contrast, algorithmic neutrality has gone largely neglected. Should decision-making algorithms be held to higher standards of transparency than human beings? The way we answer this question directly impacts what we demand from explainable algorithms, how we govern them via regulatory proposals, and how explainable algorithms may help resolve the social problems associated with decision making supported by artificial intelligence. Some argue that algorithms and humans should be held to the same standards of transparency and that a double standard of transparency is hardly justified. We give two arguments (...) to the contrary and specify two kinds of situations for which higher standards of transparency are required from algorithmic decisions as compared to humans. As algorithms have become ubiquitous in consequential domains, societal concerns about the potential for discriminatory outcomes have prompted urgent calls to address algorithmic bias. In response, a rich literature across computer science, law, and ethics is rapidly proliferating to advance approaches to designing fair algorithms. Yet computer scientists, legal scholars, and ethicists are often not speaking the same language when using the term ‘bias.’ Debates concerning whether society can or should tackle the problem of algorithmic bias are hampered (...) by conflations of various understandings of bias, ranging from neutral deviations from a standard to morally problematic instances of injustice due to prejudice, discrimination, and disparate treatment. This terminological confusion impedes efforts to address clear cases of discrimination. -/- In this paper, we examine the promises and challenges of different approaches to disambiguating bias and designing for justice. While both approaches aid in understanding and addressing clear algorithmic harms, we argue that they also risk being leveraged in ways that ultimately deflect accountability from those building and deploying these systems. Applying this analysis to recent examples of generative AI, our argument highlights unseen dangers in current methods of evaluating algorithmic bias and points to ways to redirect approaches to addressing bias in generative AI at its early stages in ways that can more robustly meet the demands of justice. Machine intelligence already helps medical staff with a number of tasks. Ethical decision-making, however, has not been handed over to computers. In this proof-of-concept study, we show how an algorithm based on Beauchamp and Childress’ prima-facie principles could be employed to advise on a range of moral dilemma situations that occur in medical institutions. We explain why we chose fuzzy cognitive maps to set up the advisory system and how we utilized machine learning to train it. We report on the (...) difficult task of operationalizing the principles of beneficence, non-maleficence and patient autonomy, and describe how we selected suitable input parameters that we extracted from a training dataset of clinical cases. The first performance results are promising, but an algorithmic approach to ethics also comes with several weaknesses and limitations. While in agreement with Miranda Fricker’s context-sensitive approach to hermeneutical injustice, this paper argues that this contextualist approach has to be pluralized and rendered relational in more complex ways. In the first place, I argue that the normative assessment of social silences and the epistemic harms they generate cannot be properly carried out without a pluralistic analysis of the different interpretative communities and expressive practices that coexist in the social context in question. Social silences and hermeneutical gaps are misrepresented if (...) they are uniformly predicated of an entire social context, instead of being predicated of particular ways of inhabiting that context by particular people in relation to particular others. I contend that a more nuanced—polyphonic—contextualization offers a more adequate picture of what it means to break social silences and to repair the hermeneutical injustices associated with them. In the second place, I argue that the particular obligations with respect to hermeneutical justice that differently situated subjects and groups have are interactive and need to be determined relationally. That is, whether individuals and groups live up to their hermeneutical responsibilities has to be assessed by taking into account the forms of mutual positionality, relationality, and responsivity (or lack thereof) that these subjects and groups display with respect to one another. The central argument is developed through an examination of what in race theory and in contemporary epistemologies of ignorance has been termed “white ignorance”; that is, the kind of hermeneutical inability of privileged white subjects to recognize and make sense of their racial identities, experiences, and social positionality. Fictionalist approaches to ontology have been an accepted part of philosophical methodology for some time now. On a fictionalist view, engaging in discourse that involves apparent reference to a realm of problematic entities is best viewed as engaging in a pretense. Although in reality, the problematic entities do not exist, according to the pretense we engage in when using the discourse, they do exist. In the vocabulary of Burgess and Rosen (1997, p. 6), a nominalist construal of a given discourse (...) is revolutionary just in case it involves a “reconstruction or revision” of the original discourse. Revolutionary approaches are therefore prescriptive. In contrast, a nominalist construal of a given discourse is hermeneutic just in case it is a nominalist construal of a discourse that is put forth as a hypothesis about how the discourse is in fact used; that is, hermeneutic approaches are descriptive. I will adopt Burgess and Rosen’s terminology to describe the two different spirits in which a fictionalist hypothesis in ontology might be advanced. Revolutionary fictionalism would involve admitting that while the problematic discourse does in fact involve literal reference to nonexistent entities, we ought to use the discourse in such a way that the reference is simply within the pretense. The hermeneutic fictionalist, in contrast, reads fictionalism into our actual use of the problematic discourse. According to her, normal use of the problematic discourse involves a pretense. According to the pretense, and only according to the pretense, there exist the objects to which the discourse would commit its users, were no pretense involved. My purpose in this paper is to argue that hermeneutic fictionalism is not a viable strategy in ontology. My argument proceeds in two steps. First, I discuss in detail several problematic consequences of any interesting application of hermeneutic fictionalism. Of course, if there is good evidence that hermeneutic fictionalism is correct in some cases, then some of these drastic consequences would have to be accepted.. (shrink)

Inspired by recent breakthroughs in predictive modeling, practitioners in both industry and government have turned to machine learning with hopes of operationalizing predictions to drive automated decisions. Unfortunately, many social desiderata concerning consequential decisions, such as justice or fairness, have no natural formulation within a purely predictive framework. In efforts to mitigate these problems, researchers have proposed a variety of metrics for quantifying deviations from various statistical parities that we might expect to observe in a fair world and offered a (...) variety of algorithms in attempts to satisfy subsets of these parities or to trade o the degree to which they are satised against utility. In this paper, we connect this approach to fair machine learning to the literature on ideal and non-ideal methodological approaches in political philosophy. The ideal approach requires positing the principles according to which a just world would operate. In the most straightforward application of ideal theory, one supports a proposed policy by arguing that it closes a discrepancy between the real and the perfectly just world. However, by failing to account for the mechanisms by which our non-ideal world arose, the responsibilities of various decision-makers, and the impacts of proposed policies, naive applications of ideal thinking can lead to misguided interventions. In this paper, we demonstrate a connection between the fair machine learning literature and the ideal approach in political philosophy, and argue that the increasingly apparent shortcomings of proposed fair machine learning algorithms reflect broader troubles faced by the ideal approach. We conclude with a critical discussion of the harms of misguided solutions, a reinterpretation of impossibility results, and directions for future research. (shrink)

Algorithms can now identify patterns and correlations in the (big) datasets, and predict outcomes based on those identified patterns and correlations with the use of machine learning techniques and big data, decisions can then be made by algorithms themselves in accordance with the predicted outcomes. Yet, algorithms can inherit questionable values from the datasets and acquire biases in the course of (machine) learning, and automated algorithmic decision-making makes it more difficult for people to see algorithms as biased. While researchers (...) have taken the problem of algorithmic bias seriously, but the current discussion on algorithmic fairness tends to conceptualize ‘fairness’ in algorithmic fairness primarily as a technical issue and attempts to implement pre-existing ideas of ‘fairness’ into algorithms. In this paper, I show that such a view of algorithmic fairness as technical issue is unsatisfactory for the type of problem algorithmic fairness presents. Since decisions on fairness measure and the related techniques for algorithms essentially involve choices between competing values, ‘fairness’ in algorithmic fairness should be conceptualized first and foremost as a political issue, and it should be (re)solved by democratic communication. The aim of this paper, therefore, is to explicitly reconceptualize algorithmic fairness as a political question and suggest the current discussion of algorithmic fairness can be strengthened by adopting the accountability for reasonableness framework. When we encounter extremist rhetoric, we often find it dumbfounding, incredible, or straightforwardly unintelligible. For this reason, it can be tempting to dismiss or ignore it, at least where it is safe to do so. The problem discussed in this paper is that such dismissals may be, at least in certain circumstances, epistemically unjust. Specifically, it appears that recent work on the phenomenon of hermeneutical injustice compels us to accept two unpalatable conclusions: first, that this failure of intelligibility when we (...) encounter extremist rhetoric may be a manifestation of a hermeneutical injustice; and second, that remedying this injustice requires that we ought to become more engaged with and receptive of extremist worldviews. Whilst some theorists might interpret this as a reductio of this framework of epistemic in/justice, we push back against this conclusion. First, we argue that with a suitably amended conception of hermeneutical justice—one that is sensitive to the contextual nature of our hermeneutical responsibilities, and to the difference between understanding a worldview and accepting it—we can bite the bullet and accept that certain extremists are subject to hermeneutical injustice, but without committing ourselves to any unpalatable conclusions about how we ought to remedy these injustices. Second, we argue that bringing the framework of hermeneutical in/justice to bear upon the experience of certain extremists actually provides a new and useful perspective on one of the causes of extremism, and how it might be undermined. Polyhedral functions provide a model for an important class of problems that includes both linear programming and applications in data analysis. General methods for minimizing such functions using the polyhedral geometry explicitly are developed. Such methods approach a minimum by moving from extreme point to extreme point along descending edges and are described generically as simplicial. The best-known member of this class is the simplex method of linear programming, but simplicial methods have found important applications in discrete approximation and statistics. (...) The general approach considered in this text, first published in 2001, has permitted the development of finite algorithms for the rank regression problem. The key ideas are those of developing a general format for specifying the polyhedral function and the application of this to derive multiplier conditions to characterize optimality.
