How can you give your interlocutor a reason to act? One way is by manipulating his deliberative context through threats, flattery, or other incentives. Another is by addressing him in the way distinctive of reasoning with him. I aim to account for the possibility of this non-manipulative form of address by showing how it is realized through the performance of a specific illocutionary act, that of advising as inviting to trust. I argue that exercise of a capacity for reasonable (...) trust can give us reasons that are not grounded in our motivational susceptibilities. Here I echo Kant on moral motivation. But this rational faculty assesses not principles but persons. Here I echo Hume on the moral virtues. We can thus agree with Kant about the motivational efficacy of practical reasons dispensed through advice but agree with Hume about the form of intelligence needed to put ourselves in touch with them. Contemporary virtue ethics was revolutionized by Alasdair MacIntyre’s reconfiguration using practices as the starting point for understanding virtues. However, MacIntyre has very pointedly excluded the professions of the financial world from the reformulation. He does not count these professions as practices, and further charges that virtue would actually hinder or even rule out one’s pursuit of these professions. This paper addresses three tasks, in regard to the financial profession of investment advising. First, the paper lays out MacIntyre’s soon-to-be-published charges (...) against the investment world, as specified to this profession. Second, it sets forth the role function of investment advising and shows that it does possess internal goods—the crucial aspect of practices disputed by MacIntyre in this case—including goods of production and goods of performance. Third, it demonstrates that this function, and the goods tied to it, cannot be achieved apart from the virtuous pursuit of the profession, thereby showing that MacIntyre’s charges are mistaken. Investment advising is shown to be a virtue-based practice, and the groundwork is laid for showing that other financial professions are so, as well. (shrink)

Plutarch charges that Stoic theory is inconsistent with Stoic political engagement no matter what they decide to do, because the Stoics' endorsement of the political life is inconsistent with their cosmopolitan rejection of ordinary politics (Stoic.rep., ab init.). Drawing on evidence from Chrysippus and Seneca, I develop an argument that answers this charge, and I draw out two interesting implications of the argument. The first implication is for scholars of ancient Stoicism who like to say that Stoicism is apolitical. The (...) argument I reconstruct turns on the political importance of the practice of giving and taking advice, and in this way makes clear a philosophically significant way in which Stoic ethics is itself political. The second implication is for moral and political theorists who are quick to contrast cosmopolitanism with patriotic political engagement. My Chrysippean and Senecan argument shows how Stoics could envision local political engagement as an instantiation of cosmopolitan commitments. (shrink)

Theorists and practitioners in the fields of both Corporate Responsibility and Corporate Reputation have recently stressed the importance of taking a stakeholderperspective when researching the nature, development and impact of these concepts. While models of Corporate Reputation, such as the Reputation Quotient and SPIRIT were developed by actively engaging stakeholders in research, models of Corporate Responsibility have been developed in a more theoretical manner. There have thus been calls for the research approaches taken in reputation research to be applied to (...) the field of responsibility. This paper answers these calls and thereby provides two related outcomes: First, a conceptualisation of Corporate Responsibility is developed that draws directly upon stakeholder perceptions (in this case customers and employees of a financial institution). Secondly, a comparison between this conceptualisation and two existing models of Corporate Reputation is conducted. A formal comparison between the model of Corporate Responsibility developed in this paper and the RQ and SPIRIT models of Corporate Reputation suggests that there are considerable similarities between stakeholder conceptualisations of responsibility and models of reputation.Stakeholders may therefore not view responsibility separate from reputation, but rather as a largely overlapping concept. Questions about the causal relationship between the two concepts are also discussed. (shrink)

This essay argues that, in place of the present hit-and-miss system of specialist advisement (a system of scientific experts performing case-by-case studies at numerous regulatory agencies, the US Office of Technology Assessment, for example), we require a corps of professional public servants for the dissemination of credible, learned, relevant and useful information pertaining to the issues of the day. This is necessary because scientists as a group are poorly prepared for the task of advising (as contrasted with the quite (...) different task of conducting research in their subject area), and, more importantly, because governments cannot ask scientists to provide that information without also incentivizing third parties (albeit unintentionally) to compromise the institution of science itself. This corps must also be poised to perform such aggregations of opinion (or arbitrations between conflicting opinions and interests) when requests are duly submitted by both governmental and citizen bodies. The product of this corps will be a dynamic, massively cross-referential, virtual document that I shall refer to as the Citizenpedia. This essay is devoted to justifying the government subsidy of such a document, as well as to evaluating the best role for scientists in a democracy. It will contrast the Citizenpedia proposal with practices that have been tried: (1) governmental agencies and (2) citizen panels. Most importantly, it is devoted to showing that a world in which the Citizenpedia advises governments is substantially different from one in which either citizens or “experts” do, just as it is substantially different from a world (our own) in which the media plays the largest role in educating the public on science policy matters. ABSTRACT It has recently been argued that in Analects 17.21, Confucius advises a disciple to do something that he, Confucius, believes to be morally wrong. According to Frederick Choo, despite believing that it is morally wrong to not properly observe the three-year mourning ritual for a deceased parent, Confucius tells Zai Wo that he should do so. Choo offers two justifications for Confucius’s doing this. In this essay, I argue that the justifications Choo offers for Confucius’s advising Zai Wo (...) to do what he believes to be morally wrong are untenable. Indeed, I argue that Confucius does not, in fact, advise Zai Wo to do what he believes to be morally wrong. Instead, I argue that Confucius’s advice to Zai Wo in Analects 17.21 is best understood as an expression of exasperation and sarcasm. (shrink)

We spend a good deal of time thinking about how and when to advise others, and how to respond to other people advising us. However, philosophical discussions of the nature and norms advising have been scattered and somewhat disconnected. The most focused discussion has come from philosophers of language interested in whether advising is a kind of assertive or directive kind of speech act. This paper argues that the ordinary category of advising is much more heterogenous (...) than has been appreciated: it is possible to advise by asserting relevant facts, by issuing directives, and by asking questions and other kinds of adviceless advising. The heterogeneity of advising makes speech act-theoretic accounts of advising look like accounts of special cases, and motivates us to look elsewhere for an account of what advising is. I suggest that we think about advising as a distinctive species of joint practical thinking—which I will call collaborative deliberation—and show how our need for a concept to pick out this kind of joint activity emerges from our practical needs as deliberators. This view helps to shed light on a number of puzzling features of advising and offers some guidance to be better at advising and at being advised. (shrink)

United States Army Special Forces who deployed to Iraq in mid-2014, and who were seeking to help Iraqi forces to combat Islamic State faced a considerable challenge: how could a force of fewer than 50 operators provide guidance and support to their Iraqi allies while also keeping in line with Washington’s policy of seeking to avoid any possibility of combat casualties among deployed U.S. Special Forces? Their solution to this dilemma came to be dubbed ‘Remote Advise and Assist’. By cobbling (...) together a system of voice and text communications, cameras, interactive maps and mobile handsets, these Special Forces personnel found they could ‘virtually accompany’ their Iraqi partners into hot zones where U.S. boots on the ground were forbidden. This approach seems to have been extremely successful, but potentially raises a range of ethical concerns. Against the backdrop of a general account of the ethics of employing surrogate forces, this paper explores the ethical questions raised by the practice of ‘Remote Advise and Assist’. (shrink)

Abstract:This paper reads parallel scenes in Herodotus and Thucydides to find a shared emphasis on flawed deliberation as the cause of catastrophic defeats for imperial powers. Both texts question the foresight and rhetorical strategies of self-styled wise advisers who ironically advance the very decisions they seek to forestall. Yet both authors also suggest that better strategies of advice could have altered the outcome. In contrast with those who read Herodotus and Thucydides as fatalists showing the futility of wise counsel in (...) the face of imperial aggression, we find that they evince a belief in the constructive possibilities of advice. Since 2013, mortgage advisory has become an independent profession in the Netherlands. Initially working for mortgage providers, the newly nonpartisan advisers now work for standard advisory fees, thereby reducing conflicts of interest. In this article, I provide an ethical analysis of the different types of ethos of mortgage advisers, that is, the ways they see and talk about, and relate to their work in a certain way. The central research question is: What different kinds of ethos do mortgage advisers have, (...) and which moral dilemmas do they experience in their advisory work? The existence of moral dilemmas is controversial in ethics but nonetheless experienced in real-world business practice. An “ethological” understanding of morality is developed in this paper to understand how these dilemmas are experienced. Twenty-nine mortgage advisers have participated in Q methodological research, a mixed qualitative–quantitative small-sample method. Three different types of ethos were found: Principled Advisers, Moral Advisers, and Minimal Morality Advisers. In considering these three types, I argue that many mortgage advisers should professionalize their ethical stance and learn to address situations in which moral values are neglected. Business ethicists, in turn, need to acknowledge that something may be considered morally inappropriate but is still defensible in some other sense. In this paper, I develop a “layered” conception of business ethics that broadens the perspective from universal notions, such as “rights” and “duties,” toward a concrete ethos that people have in a certain professional practice. Given that the practices and institutions of knowledge production commonly referred to as ‘science’ are believed to have ‘Western’ origins, their apparent proliferation entails negotiations and power dynamics that shape both science and diplomacy in specific locales. This paper investigates a facet of this co-production of science and diplomacy in the emergence of knowledge infrastructure in Japan during the Allied Occupation. It focuses on the 1947 delegation from the United States National Academy of Sciences to Japan and its role in (...) creating the Science Council of Japan (SCJ). While historians view this mission as having been dispatched to provide advice on the foundation of the SCJ, it was in fact an unintentional outcome. The original plan was to recruit long-term scientific advisers on science policy to Douglas MacArthur's headquarters. The creation of the SCJ was not the brainchild of any individual but the result of an unforeseen alteration of the original idea through negotiations among various actors. By examining the transnational aspects of this process and the complex social process underlying it, and drawing on Manuel DeLanda's assemblage theory, this paper proposes the concept of ‘techno-diplomatic assemblage’ for understanding the transnational construction of knowledge infrastructure such as the emergence of the SCJ. When humanity has either suppressed coronavirus disease 2019 or learned to come to terms with its continued existence, governments and corporations probably return to their prepandemic stances. Solutions to the world’s problems are sought from technology and business innovations, not from considerations of equality and well-being for all. This is in stark contrast with the pandemic-time situation. Many governments, at least initially, listened to the recommendations of expert advisers, most notably public health authorities, who proceeded from considerations of equality and (...) common good. I suggest that we should continue on this path when the immediate threat of the disease is over. Other crises are already ongoing—poverty, conflicts, climate change, financial bubbles, and so on—and it would be good to use expert knowledge rather than interests and ideologies in dealing with them. To assist in this, I outline the characteristics of a new kind of counsellor, impartial adviser, who is normatively motivated by a sense of copathy and who takes into account all views, nice and not-so-nice alike. I illustrate the nature and ideological orientation of copathic impartial advisers by placing them on a map of justice and examining their relationships with the main political moralities of our time. This paper describes the approach that Computer Professionals for Social Responsibility uses to advise and influence government policymakers at the local, state, and federal levels. It analyzes why CPSR - a relatively small organization - has enjoyed a fair amount of success in influencing policy. It also describes a recurring pattern that applies to CPSR's involvement in policymaking, using as an example CPSR's involvement in policymaking on the Calling Number Identification telephone service. The recommendations, during the past 20 years, to improve PhD scientific training and graduate school success, have focused on the significance of mentoring. It is well established that PhD students with mentors have significantly more success in graduate school as demonstrated by publishing papers before they graduate and by making presentations. Have faculty and academic institutions embraced the mentoring role? This study explores the views of 3,500 scientists who have primary responsibilities to educate PhD and MD/PhD students. Faculty members report (...) they are more likely to prefer being viewed as advisors (54 %) than mentors (38 %). Through an examination of perceptions about specific responsibilities of advisors and mentors, faculty members provide a description of their culture and the expectations they have about themselves and others. One would expect that because mentoring requires additional time and involvement that faculty would report differences between advising and mentoring. However, faculty members perceive few differences between advisors and mentors. We examine the implications of these findings. Future scientists need to be confident their education includes the opportunity to acquire the best possible research skills. To develop advisors who have the ability to provide this training, the process begins by defining role expectations and responsibilities and preparing advisors to interact with doctoral students in ways comparable to mentors. We expect faculty members to know how to teach and how to mentor; yet, we rarely discuss how to develop and shape the necessary skills of advisors so, that they more closely resemble those of mentors. Many companies are now implementing ethics and regulatory compliance programs. The growth of employment of both lawyers and specialist "compliance professionals" to advise on and facilitate implementation of these programs has expanded concomitantly. This paper examines the ethical role that should be played by these advisors. Traditional ways of conceptualising corporate lawyers' ethics are shown to be inadequate because they see the legal advisor as an autonomous adversarial advocate or an independent and aloof counsellor. Instead interviews with compliance practitioners are (...) used to show that a superior conceptualisation of the compliance advisor's role is emerging. Compliance practitioners identify explicitly with business and, at the same time, identify with a broader ethical community of other compliance professionals, regulators and stakeholders in order to play a transformative role within the organisation. AbstractWe show that social capital has a strong mitigating effect on financial adviser misconduct in the United States. Moreover, advisers who have committed misconduct are also more likely to relocate to counties with a relatively lower level of social capital than that of his previously residing county. These findings provide support for both the deterrence and displacement effects of social capital on financial adviser misconduct, and are robust to tests that address potential endogeneity concerns. Our results shed new light on (...) social capital as an informal governing and monitoring mechanism against individual unethical behavior. (shrink)

In “The Case for Investment Advising,” Keith Wyma argues that investment advising is what Alasdair MacIntyre calls a “practice”—that is, it is an activity marked by what MacIntyre calls an “internal good.” In this Commentary, though, I argue that Wyma seriously misunderstands what internal goods are.

The WHO recently made news by apparently advising couples in Zika affected areas to delay pregnancy. On closer inspection, however, it is not so clear what advice was actually being offered in their interim guidance regarding the prevention of the sexual transmission of Zika. In this paper, we lay out a framework for considering the ethical issues that arise in the context of advising and use it to evaluate the WHO guidance. We argue that advising is not (...) merely an informative act. The choices that agencies make in how and whom they advise are ethical choices with practical implications; these choices change not only how people ought to think about their options but also how they indeed ought to act. While we focus on these interim guidance updates from the WHO, the framework we provide can shed light more generally on the ethical issues surrounding advising in other public health contexts. The process of advisement in the research of a doctoral dissertation is prolonged and harbors a variety of ethical aspects and issues. In some cases it gives rise to dissatisfaction on the part of both advisor and student regarding the process itself and/or the publication of the dissertation. To ameliorate these problems, the Dissertation Committee of the School of Social Work at the University of Haifa recently set out guidelines for both advisor and doctoral student, in accordance with which both (...) parties will draw up an agreement in advance to suit the student’s research. The present article discusses the components of the advisement process and presents recommendations for an advisor-doctoral student agreement. Although no evaluation was undertaken by the authors to assess the impact of the guidelines agreement, our brief experience with these guidelines reinforces the importance of such an agreement, which can help assure mutual satisfaction on the part of both the advisor and the student. Guidelines advise that x-rays do not contribute to the clinical management of simple nasal fractures. However, in cases of simple nasal fracture secondary to assault, a facial x-ray may provide additional legal evidence should the victim wish to press charges, though there is no published guidance. We examine the ethical and medico-legal issues surrounding this controversial area.

Motivated by the increasing economic significance of investment advisory industries and the prevalence of wrongdoing in financial planning services, we examine whether, and to what extent, employee misconduct is shaped by their local corruption culture. Using novel data of more than 4.7 million adviser-year observations of financial advisers and the Department of Justice’s data on corruption, we find that financial advisers and advisory firms located in areas with higher levels of corruption are more likely to commit misconduct. These results hold (...) for both individual advisor and firm level analyses and are robust to the use of various fixed effects, model specifications, proxies for corruption and misconduct, and an instrumental variable approach. Using the passage of the Dodd-Frank Whistleblower Provision, which provides incentives for reporting corruption incidences and thereby reduces the incentives for fraud, we find that the relation between local corruption culture and adviser misconduct is attenuated after the provision enacted by the SEC. Overall, our study highlights the externalities of corruption culture on individual ethics and the essential role of whistleblowing laws in reducing corruption-prone norms. (shrink)
