Résumé Cet article porte sur l’analyse des interrelations entre les pratiques non officielles du sulh, de la réconciliation, et le travail des cours de justice à partir d’enquêtes menées en Algérie et, subsidiairement, au Soudan. J’illustrerai en particulier l’idée que le sulh – action faisant bien souvent référence au ‘ûrf (conventions usuelles ou droit coutumier) ou encore à la loi coranique et aux jurisprudences musulmanes (malékite en particulier) – s’inscrit en continuité et en complément avec le travail judiciaire. Je propose (...) ici de réfléchir à la pluralité des acteurs, mais également aux dimensions spatiales et temporelles qui orientent l’ensemble du processus articulant pratiques non officielles de réconciliation et celles (officielles) des cours de justice. Nous avons en effet une pluralité de lieux – lieu du crime, lieux de la réconciliation, cours de justice – qui imprègnent et l’interprétation que l’on se fait de l’offense et le procès socio-légal (réconciliation/cours de justice) dans son ensemble. Je discuterai ainsi des conséquences pratiques et théoriques de cette articulation entre réconciliation (sulh) et processus judiciaire. (shrink)

A Common Word Between Us and You is an open letter, dated 13 October 2007, from leaders of the Islamic religion to those of the Christian religion. It calls for peace between Muslims and Christians and seeks common ground and understanding between both religions. This volume examines the document from a number of perspectives. Exploring the events that led to ACW, it provides an overview of responses to the document and its use of scripture. It also relates the reception of (...) The Morphogenetic Régulation approach (MR) contributes to the Morphogenetic Approach by explaining the material and ideational origins of change and stasis in agency, structure, and culture. In this paper, we focus on the expressive quality of ideas and systemic persistence in three research projects. The first demystifies inclusive governance and its adverse impacts. It shows how, contrary to institutions of governance, inclusiveness is not simply a norm but actually the explication of corporate agents’ ideas about rational choice institutionalism which leads (...) to adverse impacts on vulnerable groups and ecologies known as adverse inclusion. The second investigates the role of ideas as adequacy and self-explication in guiding Palestinian actors’ actions towards the deepening of neoliberalization in Palestine. The third explains the relevance of the systemic persistence problematique for understanding how three juxtaposed themes – Web2, Web3, and Artificial Intelligence (AI) – are shaping the political economy and infrastructure of the Internet. This book tells the story of how the Platonic vision of Michael Polanyi – the Hungarian-British chemist and philosopher – bridges the gap between speculative metaphysics and scientific practice, thus making sense of the broad swathe of human experience in a phenomenologically satisfying fashion. The central proposal is that Polanyi is a Platonist due to his affirmation of the ontological status of abstract objects, with particular focus placed on the question of uninstantiated universals. The book engages contemporary, speculative realists from (...) both continental and analytic traditions as it introduces Polanyi’s influential epistemology and unpacks the fascinating metaphysics implied thereby. It then proceeds to develop Polanyi’s rather unsystematic metaphysics into a coherent, post-critical Platonism which incorporates his well-known theory of tacit knowledge, thus achieving something akin to the ancient Neoplatonic synthesis of Plato and Aristotle in our contemporary, scientific context. We argue that in contemporary business organizations, in which fundamental purpose is construed to be increased value—especially in ‘participative’ organizations, in which non–hierarchal interaction (for example, work teams) is the norm; and in ‘adaptive’ organizations, in which unpredictable change is the rule—a process of values covenanting will be much more valueable than just espoused values or even values covenants. We propose such a process model for organizational values covenanting and argue that such covenanting reflects an anthropomorphism of the human character (...) development process, validated in terms of the theory of viable systems. Research has established that exposure to a combination of diagnostic (i.e., relevant) and nondiagnostic (i.e., irrelevant) information results in predictions that are more regressive than predictions based on diagnostic information (Hackenbrack, 1992; Hoffman and Patton, 1997). This phenomenon has been labeled the dilution effect (e.g., Tetlock and Boettger, 1989) and has been documented when individuals make predictions. This study tests for the dilution effect when small groups make predictions, and examines the effect of using a procedure designed to reduce the (...) dilution effect. Results indicate that group predictions are influenced by nondiagnostic information in the same manner as are individual predictions, and allowing participants to rate the diagnosticity of information prior to making predictions does not reduce the dilution effect. This book examines the intricate web linking water science and society using diverse philosophical lenses. Highlighting the tensions within the threads of this web, we spotlight major conceptual tightropes that water researchers tread daily. To effectively navigate these delicate threads, a 'healthy' tension in the encompassing web is necessary. Drawing inspiration from Freud's examination of tensions in "Society and Its Discontents," we illuminate the tension-filled paradoxes inherent to water science, emphasizing the challenges in keeping these paradoxical threads taut enough to (...) ensure a navigable and sustainable bond with society. Central to our narrative is the escalating societal urge to quantify and 'manage' water—something interwoven throughout every environmental layer, including the fabric of our being. An excessive focus on management may alienate users from their water realities, jeopardizing the vital threads that sustainability tether water science and society. Consequently, this book explores compelling and inescapable tensions that resist tidy universal resolution, such as: the language of water science, including its mathematical reductions (i.e., models); the effect of water's commodification on its science; hydrology’s intersection with colonialism; and other concerns that reveal distortions in our hydrology. We aim to aid water professionals in recognizing and fine-tuning the paradoxes intrinsic to their work. To underscore the interwoven complexity of contemporary hydrology, "Hydrology and Its Discontents" guides readers into the tempestuous depths of water research, all the while urging a recalibration of perspectives and motivations. Neurotechnologies that promise to dampen (via pharmacologicals), disassociate (via electro-convulsive therapy), erase (via deep brain stimulation), and replace (via false memory creation) unsavory episodic memories are no longer the subject of science fiction. They have already arrived, and their funding suggests that they will not disappear anytime soon. In light of their emergence, this essay examines the neurostructure of normative morality to clarify that memory manipulation, which promises to take away that which is bad in human experience, also removes that (...) which enables human beings to be good. Concepts such as free will, moral responsibility, and the neurobiological basis of moral reasoning are explored to underscore the fundamental hubris inherent to the memory manipulation enterprise. Ethical training in graduate programs is an important part of the professional development process. Such training has taken a position of prominence in both counseling and clinical psychology but seems to be lagging behind in the field of sport psychology. A debate exists about whether such training is necessary and, if so, how it should be provided. An important step in better understanding these issues is to identify how such training is currently taking place. This study surveyed the program directors (...) of sport psychology programs listed in the Directory of Graduate Programs in Applied Sport Psychology about the ethical training that takes place in their programs and their perceptions of the preparedness of the students in their programs. Of those contacted, 54% responded to the e-mail based survey. The results from these respondents indicated that 64.4% of programs require training in ethics and that the training was most commonly integrated into other nonethics courses. Overall, respondents did not feel as if students were completely prepared for either the ethical or legal issues that they will face in their professional careers. The importance of ethical training and suggestions for improving ethical training are discussed. (shrink)

Open peer commentary on the article “Radical Constructivist Structural Design Education for Large Cohorts of Chinese Learners” by Christiane M. Herr. Upshot: Herr’s thought-provoking approach to structural design education targets goals that include fostering the development of students’ intrinsic motivation and shifting the instructor’s role from one of dispensing knowledge to one of guiding students’ conceptual organization of their experiences. This commentary is intended to start a dialogue regarding the affordances and constraints of particular approaches to achieving these goals. In (...) particular, opportunities for self-generated feedback within the context of students’ productive activity and the use of models of individual student thinking to guide instructional planning are presented as promising possibilities. The second edition of Jack Crumley's An Introduction to Epistemology strikes a balance between the many issues that engage contemporary epistemologists and the contributions of the major historical figures. He shows not only how philosophers such as Descartes, Hume, Locke, Berkeley, and Kant foreground the contemporary debates, but also why they deserve consideration on their own terms. A substantial revision of the first edition, the second edition is more even more accessible to students. The new edition includes recent work on (...) contextualism, evidentialism, externalism and internalism, and perceptual realism; as well, the chapter on coherence theory is substantially revised, reflecting recent developments in that area. New to this second edition is a chapter on feminist epistemology, which includes discussions of major positions and themes, such as feminist empiricism, feminist standpoint epistemology, postmodern epistemology, and feminist critiques of objectivity. It presents the important contributions of philosophers such as Sandra Harding, Helen Longino, Genevieve Lloyd, and others. This essay is a reconstruction and defense of Davidson's argument against the intelligibility of the notion of conceptual scheme. After presenting a brief clarification of Davidson's argument in 'On the Very Idea of a Conceptual Scheme', I turn to reconstructing Davidson's argument. Unlike many commentators, and occasionally Davidson, who hold that the motive force of the argument is the Principle of Charity (or the denial of the Third Dogma), I argue that there is a further principle which underlies the argument. (...) This principle I call the Strong Discrimination Principle. But the argument of the paper is not purely exegetical. Not only do I show how the Strong Discrimination Principle meets certain objections to Davidson's argument, but I show how the Principle clarifies the realist position. In particular, I show how a line of argument advanced by Rorty and Putnam against (metaphysical) realism can be rejected. (shrink)

A commentary on Trygve Lavik's article "Climate change denial, freedom of speech and global justice".

ABSTRACT:Corporate governance scholarship focuses on executive malfeasance, specifically its antecedents and consequences. Academic efforts primarily focus on prevention while practitioners are often left to hold firms and executives (including directors) accountable through a variety of sanctions. Even so, executive malfeasance still occurs even in the face of the vast resources used to monitor, control, and penalize firms and executives. In this paper, we posit equity markets do not adequately penalize firms for inaccurate earnings reports. Using a sample of 129 firms (...) identified by the U.S. General Accounting Office for reporting fraudulent earnings in 10K filings, we found support for our assertion. Consequently, the one party who may benefit but escape accountability is firm shareholders. Moreover, we find little empirical evidence that the subset of firms sanctioned by the SEC is penalized more heavily than the full sample by markets at the time they report and correct their 10K filings. Our results raise serious questions whether such managerial opportunism can be eradicated given the apparent lack of consequences in equity markets for investors. We also question whether the SEC is able to discern between fraud and error in financial reporting and its implications. (shrink)
