BackgroundAssessment of capacity to consent to treatment is an important legal and ethical issue in daily medical practice. In this study we carefully evaluated the capacity to consent to treatment in patients admitted to an acute medical ward using an assessment by members of the medical team, the specific Silberfeld's score, the MMSE and an assessment by a senior psychiatrist.MethodsOver a 3 month period, 195 consecutive patients of an internal medicine ward in a university hospital were included and their capacity (...) to consent was evaluated within 72 hours of admission.ResultsAmong the 195 patients, 38 were incapable of consenting to treatment (unconscious patients or severe cognitive impairment) and 14 were considered as incapable of consenting by the psychiatrist (prevalence of incapacity to consent of 26.7%). Agreement between the psychiatrist's evaluation and the Silberfeld questionnaire was poor (sensitivity 35.7%, specificity 91.6%). Experienced clinicians showed a higher agreement (sensitivity 57.1%, specificity 96.5%). A decision shared by residents, chief residents and nurses was the best predictor for agreement with the psychiatric assessment (sensitivity 78.6%, specificity 94.3%).ConclusionPrevalence of incapacity to consent to treatment in patients admitted to an acute internal medicine ward is high. While the standardized Silberfeld questionnaire and the MMSE are not appropriate for the evaluation of the capacity to consent in this setting, an assessment by the multidisciplinary medical team concurs with the evaluation by a senior psychiatrist. The question of whether transgender athletes should be permitted to compete in accordance with their gender identity is an evolving debate. Most competitive sports have male and female categories. One of the primary challenges with this categorization system, however, is that some transgender athletes (and especially transgender women) may be prevented from competing in accordance with their gender identity. The reason for this restriction is because of the idea that transgender women have an unfair advantage over their cisgender counterparts; this (...) is seen as a problem since sports are typically guided a principle called ‘the skill thesis’, which suggests that sports are supposed to determine who is most skillful by maintaining a fair starting point. In this paper, I argue that if the skill thesis ought to be maintained and there continues to exist no conclusive evidence in support of unfair advantages possessed by trans women, then we may want to re-consider the gender binary in sport. Rather than having male/female categories, it may make more sense to categorize athletes based other sport-specific factors (e.g., height, weight, etc.). This may help to maintain the skill thesis while at the same time removing potentially unfair and discriminatory barriers against transgender athletes. (shrink)

Anerkennung ist ein schillernder Begriff, der erst seit wenigen Jahrzehnten Aufmerksamkeit findet, aber in Ethik, politischer Philosophie und Kritischer Theorie mit großen Erwartungen verbunden wird. Sein Ursprung in den Intersubjektivitätstheorien Fichtes und Hegels lässt hoffen, dass er von sich aus Impulse für Freiheit und Gerechtigkeit in sich trägt. Vor diesem Hintergrund ist es eine Entdeckung ersten Ranges, dass ein Denker wie Nietzsche den Begriff der Anerkennung in durchaus grundlegender Weise verwendet, ohne den erst Ende des 20. Jahrhunderts mit ihm verknüpften (...) Hoffnungen zu widersprechen. Nietzsches Verständnis von Anerkennung zeigt sich in seiner Lebensphilosophie. Wie die Individuen konkret "einander nöthig" sind, arbeitet Sarah Bianchi anerkennungstheoretisch für das ganze menschliche Leben in seinen verschiedenen Dimensionen heraus. Qua Anerkennung sind die Individuen vom Selbstverhältnis, über zwischenmenschliche Beziehungen bis hin zum Recht und Staat existentiell verwoben. (shrink)

Widely recognized as one of the main characteristics of Latin Aristotelianism, the 'Christianisation' of Aristotle from the thirteenth to the seventeenth century has received as yet little attention. Aiming to answer the need for a more systematic investigation, the articles here collected approach Christian readings of the Stagirite|s works from different perspectives. Setting aside abstract discussions about |degrees of orthodoxy|, they address a few specific questions: which |images| of Aristotle were offered by Medieval and Renaissance interpreters, and in particular how (...) did some of them argue that - far from being a pagan or even an impious thinker - he did not contradict the truths revealed by Holy Scripture? Questo primo volume degli "Scritti di Ugo Bianchi" - "Religions in Antiquity" - raccoglie contributi relativi a temi e problemi del cristianesimo antico. Con esso si realizza un progetto, formulato in anni lontani (1983) dallo stesso autore, che contemplava varie sezioni di cui l'ultima - "Christiana" comprendeva i saggi che costituiscono la prima metà del volume; a questi ne sono stati aggiunti altri, sulle medesime tematiche, che risalgono ad anni successivi. Precede i saggi un contributo di carattere metodologico ("Tipologia (...) storica delle religioni e comparazione: il caso del dualismo"). "Ugo Bianchi, nel suo lungo itinerario scientifico che abbraccia alcune delle più significative aree del vasto panorama delle esperienze religiose della storia umana, non ha mai proposto una "teoria" interpretativa generale e onnicomprensiva di esse, quale molto spesso - con esiti e fortune diversi hanno fatto tanti storici delle religioni. Founding our analysis on the Geneva-Brussels approach to quantum mechanics, we use conventional macroscopic objects as guiding examples to clarify the content of two important results of the beginning of twentieth century: Einstein–Podolsky–Rosen’s reality criterion and Heisenberg’s uncertainty principle. We then use them in combination to show that our widespread belief in the existence of microscopic particles is only the result of a cognitive illusion, as microscopic particles are not particles, but are instead the ephemeral spatial and local manifestations of (...) non-spatial and non-local entities. We consider the classical concept of time of permanence and observe that its quantum equivalent is described by a bona fide self-adjoint operator. Its interpretation, by means of the spectral theorem, reveals that we have to abandon not only the idea that quantum entities would be characterizable in terms of spatial trajectories but, more generally, that they would possess the very attribute of spatiality. Consequently, a permanence time shouldn’t be interpreted as a “time” in quantum mechanics, but as a measure (...) of the total availability of a quantum entity in participating to a process of creation of a spatial localization. This paper focuses on Kant's account of physical geography and his theory of the Earth. In spelling out the epistemological foundations of Kant's physical geography, the paper examines 1) their connection to the mode of holding-to-be-true, mathematical construction and empirical certainty and 2) their implications for Kant's view of cosmopolitan right. Moreover, by showing the role played by the mathematical model of the Earth for the foundations of Kant's Doctrine of Right, the exact relationship between the latter and physical geography (...) is highlighted. Finally, this paper shows how, in Kant's view, the progress of physical geography can be assured if and only if the free circulation of human beings is established and regulated by law. Therefore, examining the mutual relationship between the theory of Earth and the foundations of right opens new perspectives on the relationship between epistemology and practical philosophy within Kant's system. In The Explanatory Dispensability of Idealizations, Sam Baron suggests a possible strategy enabling the indispensability argument to break the symmetry between mathematical claims and idealization assumptions in scientific models. Baron’s distinction between mathematical and non-mathematical idealization, I claim, is in need of a more compelling criterion, because in scientific models idealization assumptions are expressed through mathematical claims. In this paper I argue that this mutual dependence of idealization and mathematics cannot be read in terms of symmetry and that Baron’s non-causal (...) notion of mathematical difference-making is not effective in justifying any symmetry-breaking between mathematics and idealization. The function of making a difference that Baron attributes to mathematics cannot be referred to physical facts, but to the features of quantities, such as step lengths or time intervals taken into account in the models. It appears, indeed, that it does not follow from Baron’s argument that idealizations do not help to carry the explanatory load at least for two reasons: mathematics is not independent of idealizations in modelling and idealizations help mathematics to carry the explanatory load of a model in different degrees. This paper deals with the semantic issues of epistemological contextualism - the doctrine according to which the truth-conditions of knowledge ascribing sentences vary depending on the context in which they are uttered. According to the contextualist, a sentence of the form "S knows that p" does not express a complete proposition. Different utterances of this same sentence, in different contexts of utterance, can express different propositions: "know" is context-dependent. Little attention has been paid to a precise formulation of the semantic (...) contextualist thesis grounding epistemological contextualism. My goal is then to assess differences and similarities between "know" and context-sensitive terms in a natural language – in particular pure indexicals and demonstratives: my remarks are a strong argument against the postulation of an indexical element in ascriptions of propositional knowledge. Giving money to others feels good. It is now standard to use the label ‘warm glow feelings’ to refer to the pleasure people take from giving. But what exactly are warm glow feelings? And why do people experience them? To answer these questions, we ran two studies: a recall task in which participants were asked to remember a donation they made, and a donation task in which participants were given the opportunity to make a donation before reporting their affective states. (...) Correlational and experimental results converge towards the conclusion that, if the nature of the warm glow is straightforward, its source is multifaceted. Regarding the nature of the ‘warm glow’, the pleasure people took in giving was mainly predicted by one particular type of positive emotion and was indeed described by participants as ‘warm’. Regarding the underlying psychological mechanisms, warm glow feelings were elicited by positive appraisals regarding the donor’s moral character, positive appraisals regarding the actual impact of the donor’s donation on the welfare of others and a feeling of communion with others. In the section of the Antinomy of pure Reason Kant presents three notions of infinity. By investigating these concepts of infinity, this paper highlights important ‘building blocks’ of the structure of the mathematical antinomies, such as the ability of reason of producing ascending and descending series, as well as the notions of given and givable series. These structural features are discussed in order to clarify Ernst Zermelo’s reading of Kant’s antinomy, according to which the latter is deeply rooted in the (...) tendency of the mind of producing “creative progress” and “inclusive closure”. The aim of this paper is to explain in which sense and why Kant’s treatment of the antinomies attracts the attention of Zermelo in the early 1900s and which aspects of his second axiomatic system have been inspired by Kant’s philosophy. Thus, by reading Kant’s antinomy ‘through Zermelo’s eyes’—with emphasis on the concept of regressive series in indefinitum and on that of regressive series ad infinitum – this paper identifies the echoes of Kant’s work in the making of the ZFC set theory. Background:Nurses and nursing students appear vulnerable to moral distress when faced with ethical dilemmas or decision-making in clinical practice. As a result, they may experience professional dissatisfaction and their relationships with patients, families, and colleagues may be compromised. The impact of moral distress may manifest as anger, feelings of guilt and frustration, a desire to give up the profession, loss of self-esteem, depression, and anxiety.Objectives:The purpose of this review was to describe how dilemmas and environmental, relational, and organizational factors contribute (...) to moral distress in undergraduate student nurses during their clinical experience and professional education.Research design:The research design was a systematic literature review.Method:The search produced a total of 157 articles published between 2004 and 2014. These were screened with the assessment sheet designed by Hawker and colleagues. Four articles matched the search criteria (one quantitative study and three qualitative), and these were separately read and analyzed by the researchers. The process of review and analysis of the data was supervised by a colleague experienced in moral distress who provided an independent quality check.Ethical consideration:Since this was a systematic review, no ethical approval was required.Findings:From the analysis, it emerged that inequalities and healthcare disparities, the relationship with the mentor, and students’ individual characteristics can all impact negatively on the decisions taken and the nursing care provided, generating moral distress. All these factors condition both the clinical experience and learning process, in addition to the professional development and the possible care choices of future nurses.Conclusion:Few studies dealt with moral distress in the setting of nurse education, and there is a knowledge gap related to this phenomenon. The results of this review underline the need for further research regarding interventions that can minimize moral distress in undergraduate nursing students. (shrink)

Mit diesem Aufsatz soll ein Beitrag zur Klärung von Nietzsches Humanitätsverständnis in binnenrelationaler Perspektive geleistet werden. Dabei wird in drei Schritten vorgegangen: Der erste Schritt setzt an den kritischen Vorzeichen von Nietzsches Humanitätsverständnis an. Hierbei geht es um die Skizzierung der kritischen Verfahren der genealogischen Kritik und des Perspektivismus. In einem zweiten Schritt soll sodann aufgezeigt werden, worin bei Nietzsche die genealogische Kritik ihren Halt findet, damit nicht jeglicher Wert destruiert wird. Dabei soll die binnenrelationale Perspektive des Individuums in der (...) Dimension der existentiellen Selbstanerkennung freigelegt werden. Trotz aller Emphase des Individuums bei Nietzsche geht es ihm stets um die Verbindung von Partikularem und Allgemeinem im Lebenszusammenhang. Diese Dimensionen kann der Mensch in seiner Binnenrelationalität selbst abwiegen. Nietzsches Verständnis des Selbst kann für ihn vor dem Hintergrund seines Anerkennungsverständnisses keinen essentialistischen Wesenskern beinhalten; das Selbst entwickelt sich für Nietzsche ursprünglich durch die sozialen Bezüge im Lebensvollzug: Es geht somit um die praktische Dimension, die immer schon relational verschränkt ist. In einem dritten Schritt soll Nietzsches Humanitätsverständnis als existentielle Selbstbeschreibung des Menschen herausgearbeitet werden. Indem Nietzsches kritische Vorzeichen berücksichtigt werden, zeigt sich, dass sich seine Kritik zentral auf ein bloß tradiertes Humanitätsverständnis richtet. Worauf es ihm dagegen ankommt, ist sein Verständnis des Individuums als „freier Geist“, der von sich aus in der Lage ist, sein Leben selbst in die Hand zu nehmen. (shrink)
