This bibliographical study involved first the exploitation of four data-banks: Medline, CNRS, Bioethics and AIDS, with the following key words (in conjunction with AIDS): ethics, human rights, confidentiality, legislation, jurisprudence. A total of 412 references were listed between 1983 and the end of 1987. Examination of the quantitative increase of articles over these years shows that, while references to AIDS and/or HIV infection--referred to as 'AIDS' for brevity--increased by about one third per year, the number of papers treating ethical problems (...) linked to AIDS doubled each year. This increase makes it clear that these problems are important and pressing, that they are evolving rapidly and can be given no easy solution. After reading and analysis of accessible articles in readily comprehensible languages, the different themes can be classified in two categories: 1: Measures intended to protect society (starting with the most coercive); quarantine and isolation; discriminatory measures concerning specific groups; non-respect of the confidential nature of medical information; application of the penal code; screening; obligatory declaration and registration; testing of blood given by donors; vaccination and medical innovations, therapeutic assays; information, education. 2. Measures intended to protect the individual: fundamental rights of the patient: his/her right to confidentiality, to information and to treatment; civil rights: civil liberty, right to education, right to work, etc...; rights of the healthy individual: right of those in contact with the patients, safety of hospital staff, of those receiving blood-transfusions, etc... The legislation adopted in the various countries and the main opinions to be found in these articles are listed and analysed, and for each particular theme it is possible to refer to a list of the 232 most important articles. While the debate seems to concentrate on the conflict between the right of society to protect itself against the spread of infection and the 'civil' rights of the infected minorities, our conclusion tends to reduce this antagonism, showing that, particularly as far as the confidential nature of medical information is concerned, measures intended to protect the individual also protect society. Investors with standard monetary preferences will give a fund manager incentives to increase firm profits, which can be achieved through a share in profits via carried interest. When investors have social preferences, it is not clear which incentives the manager should receive. We explore this puzzle by applying an agency theory perspective to impact investing, a practice where investors seek both financial returns and a measurable social or environmental impact. Using an inductive, qualitative approach, we identify and describe the ethical (...) tensions and challenges faced by fund managers to structure and implement impact-based variable compensation schemes. Our results indicate that economic incentives tied to non-financial objectives are useful to alleviate goal incongruity between principals and agents during fund creation but have the potential to lead to perverse effects during the fund lifecycle, where managers may exploit subjective non-financial metrics to maximize personal wealth. We introduce the concept of impact fidelity, a conceptual equivalent of fiduciary duty, to ensure that investment decisions reflect the asset owner’s impact preferences. (shrink)

Psychiatry is rapidly adopting digital phenotyping and artificial intelligence/machine learning tools to study mental illness based on tracking participants’ locations, online activity, phone and text message usage, heart rate, sleep, physical activity, and more. Existing ethical frameworks for return of individual research results (IRRs) are inadequate to guide researchers for when, if, and how to return this unprecedented number of potentially sensitive results about each participant’s real-world behavior. To address this gap, we convened an interdisciplinary expert working group, supported by (...) a National Institute of Mental Health grant. Building on established guidelines and the emerging norm of returning results in participant-centered research, we present a novel framework specific to the ethical, legal, and social implications of returning IRRs in digital phenotyping research. Our framework offers researchers, clinicians, and Institutional Review Boards (IRBs) urgently needed guidance, and the principles developed here in the context of psychiatry will be readily adaptable to other therapeutic areas. Through the publication of Ensei kanshō zusetsu in 1823, Yoshio Nankō does achieve posthumously the project designed two years earlier by his young disciple, Kusano Yōjun, to spread this knowledge widely among the society. The book is a great and unprecedented success. Well known (...) nowadays for its appendix (Chidō wakumon) and the influence that its content, while claiming the mobility of the Earth, did exert on the propagation of the heliocentrism in Japan until the very end of the Edo period, the book also provides as we think an unexpected and completely new platform for classical science, being the emissary of certain concepts invented by Shizuki Tadao from his relentless studies of Newtonian mechanics. Once we briefly recount Yoshio's career and discuss the sources and the morphology of his work, we give some arguments towards it. (shrink)

This paper develops a general account of special relations and special obligations, and uses it as a framework to argue for a modest form of speciesism – mitigated speciesism – based on an understanding of species co-membership as a thick concept. Mitigated speciesism steers a middle ground between anti-speciesism and crude speciesism. Unlike anti-speciesists, I maintain that species co-membership is a morally relevant special relation, which indeed grounds special obligations among the members of the same species. But unlike crude speciesists, (...) I argue that our special obligations to our fellow human beings do not warrant that we should always count their interests more than comparable interests of non-human animals. Instead, special obligations based on species co-membership are subject to three constraints. (shrink)

Scott Aiken and Thomas Dabay contend that a satisfactory account of truth is both infallibilist and antiskeptical. Externalist correspondence theories, they say, preserve the infallibility of the truth-relation yet invite skeptical qualms. In tying truth to experience, pragmatist theories resist skeptical challenges, but embrace a fallibilism that renders their account of truth inconsistent and even incoherent. While agreeing with Aiken and Dabay that externalist accounts are vulnerable to skepticism, I dispute each of the four arguments they offer against pragmatist fallibilism. (...) Though partially successful against Peirce’s more popular view that truth is the final belief of a community of inquirers, their arguments are wholly ineffective against Dewey’s account of truth as warranted assertability. The rapid economic growth and surge of consumerism in emerging markets have placed significant pressure on the environment and consumers. While well-researched ethical consumption remedies may be effective in the Western contexts, they may not be readily translatable in emerging markets due to institutional and socio-cultural differences. This research examines the popular practice of Danshari in China and investigates how this self-oriented practice leads to other-oriented ethical consumption behaviours. Using qualitative data gathered from online sharing and interviews, we unpack how (...) Danshari practitioners question and reshape their relationship with possessions and consumption to enhance their self-concept clarity. This clarified and elevated self-concept, in turn, leads to ethical consumption behaviours. Unlike Western ethical consumption concepts that are driven by principles or ideologies, Danshari’s essence of detachment, self-orientation, and action focus resonate with traditional Chinese teachings, providing a pragmatist approach to cultivating ethical consumption behaviours in China. This research adds to the growing body of pragmatism-based ethics research, expands the discussion of the link between consumption and the self, and offers valuable insights into promoting ethical consumerism in emerging markets. The Metaphysical Club, a gathering of intellectuals in the 1870s associated with Harvard, is widely recognized as the crucible where pragmatism, America's distinctively original philosophy, was refined and proclaimed. Louis Menand's bestseller about the group was a dramatic publishing success. However, only three actual members - Oliver Wendell Holmes Jr., Charles S. Peirce, and William James - appear in this book, alongside other thinkers such as John Dewey who were never in the Club. The Real Metaphysical Club tells the full (...) story of how this influential group shifted the course of philosophy in America. In addition to pioneering pragmatism, the group explored radical empiricism and idealism, and formulated personalism and process philosophy, equally important developments. This volume contains thirty-seven important writings dating from 1870 to 1885 by the real members of the Metaphysical Club. The first section centers on pragmatism and science; the second part collects writings of the lawyers; and the third part covers idealist and personalist philosophers. Many of these writings have never been reprinted before, and nothing like this impressive collection has ever been attempted. A general introduction provides a narrative history, and the editors' three introductions to the volume's sections vividly bring to life the intense meetings, sustained debates, and pioneering thought from the Metaphysical Club. This essay illustrates what the Chinese family-based and harmony-oriented model of medical decision making is like as well as how it differs from the modern Western individual-based and autonomy-oriented model in health care practice. The essay discloses the roots of the Chinese model in the Confucian account of the family and the Confucian view of harmony. By responding to a series of questions posed to the Chinese model by modern Western scholars in terms of the basic individualist concerns and values (...) embedded in the modern Western model, we conclude that the Chinese people have justifiable reasons to continue to apply the Chinese model to their contemporary health care and medical practice.
