The World Trade Organization (WTO) is a multilateral trade organization that, at least partially, governs trade relations between its member states. The WTO (2011a) proclaims that its “overriding objective is to help trade flow smoothly, freely, fairly and predictably.” The WTO is a “treaty-based” organization – it has been constituted through an agreed, legally binding treaty made up of more than 30 articles, along with additional commitments by some members in specific areas. At present, 153 (...) states are members of the WTO, which collectively make up over 97 percent of all trade worldwide (WTO 2011b). Together, the WTO treaty specifies the rights and obligations of its member states. To become a member of the WTO, a state must treat the agreement as a “single undertaking.” Members cannot choose à la carte which agreements – for example, regarding tariffs, or trade in services or intellectual property – they want to accede to and which they do not. Instead, they must take on the obligations of the agreement in toto. The WTO is one of the most consequential governance institutions in the world, a lodestar of political debate about globalization (see globalization), attracting increased interest from moral and political philosophers in recent years (James 2006; Moellendorf 2005; Risse 2007; Brock 2009). After briefly surveying the mission and principles of the World Trade Organization (WTO), I argue that international trade may be assessed from the perspective of justice, and that the correct account of justice for these purposes is egalitarian in fundamental principle. I then consider the merits of the WTO's basic commitment to liberalized trade in the light of egalitarian considerations. Finally, I discuss the justice of several WTO policies. While noting the complexity of the empirical issues (...) relating to the effects of trade institutions and policies, I conclude that egalitarians have reasons to object to certain of the principles and policies of the WTO. September 11, 2001 brought to legal awareness an issue that has long puzzled metaphysicians. The general issue is that of event-identity, drawing the boundaries of events so that we can tell when there is one event and when there are two. The September 11th version of that issue is: how many occurrences of insured events were there on September 11, 2001 in New York? Was the collapse of the two World Trade Center Towers one event, despite the two (...) separate airliners crashing into each tower? Or were these two separate insured events? (shrink)

The World Trade Organization has faced many criticisms from human rights and social justice advocates. And yet it is difficult to identify direct clashes between WTO obligations and human rights obligations. Nevertheless, as demonstrated in this article, the concerns of WTO critics are justifiable, for example in the areas of the organisation's democratic deficit, the effect of its rules on developing States, and in the arena of labour rights. The criticisms are not, as it were, manifestations of mere (...) 'regime envy' by social justice constituencies. Indeed, the present imbalance in effectiveness between international economic institutions and international social justice institutions must be redressed. The hierarchically nested structure is widely observed in a broad range of real systems, encompassing ecological networks, economic and trade networks, communication networks, among many others. However, there remain statistical challenges of the prevalence of nestedness. In response to this problem, we focus on the effect of incomplete information and the inputted matrix size, the role of network density and degree sequences, and the relevance of degree-degree correlation to conduct systematic research on the significance of the nested structure according (...) to multiplex world trade networks. Firstly, the nested structure can observe significantly when suffering incomplete information and varying inputted matrix size. Secondly, to analyze the role of network density and degree sequences in nested structure, we use “swappable rows, swappable columns” null model which conserves the network size and density, and “fixed in-degree, fixed out-degree” null model which not only preserves the network size and density but also keeps node degree to do randomization tests of nestedness. The randomizations of two null models remark that most nested structures are not determined by network density and degree sequences but closely related to them. Finally, we investigate degree-degree correlation in nested networks, and the results show that the nested structure is negatively related with degree-degree correlation of the network. Following the empirical analysis train of thought, we argue that nestedness is still a unique feature of the network. (shrink)

This article empirically analyzes how victims’ remains were recovered, identified, repatriated, and retained after the World Trade Center terrorist attacks of September 11, 2001. It does so by asking the question whose body is it. This question brings to the fore issues related to personhood and ownership: how are anonymous and unrecognizable bodily remains given back an identity; and who has ownership of or custody over identified and unidentified human remains? It is in this respect that the article (...) engages with technoscientific and legal, or “technolegal,” trajectories of human remains in the wake of the WTC tragedy. By using the metaphor of “materialization,” it becomes possible to trace how remains are forensically identified and implicated in legal regimes. “Technolegal materialization” as a concept and methodological sensitivity contributes to the current “actor-network theory” -inspired legal scholarship, which tends to focus on legal practices in courtrooms but not those beyond them. In this article, 9/11 victims’ remains are followed from “Ground Zero” to the forensic laboratory and beyond and articulates five instances of technolegal materialization of bodily remains and their past and contemporary existences. This article applies social entropy theory to international trade law, suggesting that observed shifts in world trading system towards disorder are the consequence of insufficient ‘energy’ inputs in the form of an effective, centralized legal framework and focused authoritative organization. In support of this claim, the article draws attention to recognized, substantive deficiencies in the World Trade Organization (WTO). These include trade round negotiation impasse, the rise of bilateralism, indeterminacy in the treaty texts and inadequate (...) enforcement procedures. These problems represent increasing disorganization, or entropy, in the world trading system, a phenomenon characterized most notably by growing income inequality between states and failure to achieve progress in further trade liberalization. While this article does not propose either specific predictions or comprehensive solutions to the dilemma of social entropy in the world trading system, it does suggest that a more robust, authoritative and trade-focused WTO is essential to counter the entropic tendencies within the supra-national trading system. This should help to ensure future growth and achieve the fuller distribution of economic prosperity through global trade. (shrink)

This paper addresses the issue of food security in developing countries and how agriculture plays an important role in achieving not only food security, but also in reducing poverty and promoting sustainable development. The promotion of trade liberalization by the World Trade Organization (WTO) through the Agreement on Agriculture (AoA) has undermined the productive capacity of developing countries and their comparative advantage in the agricultural sector, marginalizing small-scale farmers and benefitting the big corporations. The paper looks at (...) the issue of intellectual property rights that big corporations have for seeds and their effects on small-scale farmers, and how corporate social responsibility (CSR) is insufficient to regulate the dominance of big corporations in the food and agricultural market. The paper is divided into seven sections: trade liberalization and food security, the WTO and the AoA, the effects of the AoA on developing countries, the role of transnational corporations (TNCs) on food security, CSR and TNCs, policy recommendations, and conclusions. The purpose of the paper is to examine trade boycott of Arab countries of Danish goods and role of WTO.

Under the WTO’s dispute settlement procedures, a party that has been injured by a scofflaw state’s failure to comply with its trade obligations may retaliate against the scofflaw state by withdrawing equivalent trade concessions. Legal and economic commentators generally view retaliation as an economically perverse strategy for enforcing freetrade norms. This Article explores an alternative explanation, arguing that retaliation may provide the optimal enforcement mechanism for trade liberalization given the prevalence of low compliance incentives and high enforcement (...) costs in international cooperation agreements. The Article argues that retaliation is superior to other remedial options because it enables an injured state to inflict maximum political costs on the scofflaw state by mobilizing powerful export groups in the scofflaw state against protectionist policies. Furthermore, this Article shows how the presence of significant protectionist groups in the injured state, which stand to benefit from retaliatory measures, also improves the injured state’s ability to commit to retaliation. Even if states have asymmetric preferences about protectionist policies, retaliation threats can still be credible since there is uncertainty about each state’s retaliation costs. Finally, the Article concludes that contrary to the conventional wisdom, the substantial role of uncertainty in this model indicates that specific performance, and not compensation, ought to be the goal of the WTO’s enforcement mechanism. This study was a preliminary exploration of the value changes taking place in the United States since the September 11, 2001 terrorist attack on the World Trade Center in New York, which was a significant emotional event or cultural upheaval. Rokeach told us that "a person's total value system may undergo change as a result of socialization, therapy, or cultural upheaval..." (Rokeach, The Nature of Human Values, 1973, p. 37). The researchers explored the value changes of 500 aviation (...) industry employees before the attack and 500 after the attack. The statistically significant research results showed a total of twenty-seven of thirty-six values changed. Before the attack respondents valued much higher self-esteem and self-actualization values like A Sense of Accomplishment and Self-Respect. After the attack respondents placed a much higher value importance on survival, safety and security values like A World at Peace, Freedom, Family Security, National Security, Mature Love, Salvation, and True Friendship. Free Trade Reimagined begins with a sustained criticism of the heart of the emerging world economy, the theory and practice of free trade. Roberto Mangabeira Unger does not, however, defend protectionism against free trade. Instead, he attacks and revises the terms on which the traditional debate between free traders and protectionists has been joined. Unger's intervention in this major contemporary debate serves as a point of departure for a proposal to rethink the basic ideas with which (...) we explain economic activity. He suggests, by example as well as by theory, a way of understanding contemporary economies that is both more realistic and more revealing of hidden possibilities for transformation than are the established forms of economics. One message of the book is that we need not choose between accepting and rejecting globalization; we can have a different globalization. Traditional free trade doctrine rests on shaky empirical and theoretical ground. Unger takes a new approach to show when international trade is likely to be useful or harmful to the socially inclusive economic growth that every nation wants. Another message is that the movement of people and ideas is more important than the movement of things and money, and that freedom to change the institutions defining a market economy is just as important as freedom to exchange goods on the basis of those institutions. Free Trade Reimagined ranges broadly within and outside economics. Presenting technical issues in plain language, it appeals to the general reader. It puts a disciplined imagination in the service of rebellion against the dictatorship of no alternatives that characterizes life and thought today. (shrink)

The current debate on literary cognitivism in the philosophy of fiction typically assumes that we can rigorously distinguish between fictional and factual, and focuses on the question of whether and how works of fiction can impart propositional knowledge to the reader. In this paper we suggest that this way of framing the debate may be problematic. We argue that works of fiction almost inevitably include a reference to the real world and that – contrary to what is usually assumed (...) – the exchange between fiction and reality is vivid as well as potentially fruitful. We shed a new light on these complex dynamics by building on the metaphors of trade exchange and smuggling between the two worlds. While the current debate exclusively focuses on cognitively relevant goods that “officially” cross the border through “customs”, as it were, we show that exchanges between fiction and reality run deeper. Indeed, as we show, a substantial part of the cognitive impact that we derive from fiction goes “under the table” and is “smuggled” from fiction to reality. As such, it bypasses the audience’s conscious control, which in turn explains the manipulative force that fiction can exert. Smuggling takes place when cognitively relevant contents are passed on to the reader in subliminal ways, as it happens when they imprint implicit biases or prejudices, shift perspectives or subtly modify habits or patterns of behavior. By elaborating on the metaphors of trade exchange and smuggling, we aim at presenting a more comprehensive and nuanced understanding of the relations between fiction and reality and on the impact that imagination has on our real-world beliefs. The international trading system remains a locus of fierce social conflict. The protesters who besiege gatherings of its managers—most famously on the streets of Seattle at the turn of the millennium—regard it with suspicion and hostility, as a threat to their livelihoods, an enemy of global justice, and their grievances are exploited by populist statesmen peddling their own mercantilist agendas. If we are to support the trading system, we must first assure ourselves that it can withstand moral scrutiny. We must (...) ensure that it works for and not against those whom it envelops; that it serves to emancipate, not ensnare. While there is an extensive literature addressing the economic and legal aspects of trade, the ethical questions its raises have escaped close inspection. This book contributes to resetting the balance. It grapples with moral quandaries relating to world politics, globalization, and international commerce, and recognizes that resolving these problems is essential if we are to move toward a world in which trade justice is a reality. This paper disputes the notion, endorsed by much of narrative theory, that the reading of literary narrative is functionally analogous to an act of communication, where communication stands for the transfer of thought and conceptual information. The paper offers a basic typology of the sensorimotor effects of reading, which fall outside such a narrowly communication-based model of literary narrative. A main typological distinction is drawn between those sensorimotor effects pertaining to the narrative qua verbal utterance (verbal presence) and those sensorimotor (...) effects pertaining to the imaginary physical world(s) of the story (direct presence). While verbal presence refers to the reader's vicarious perception of the voices of narrators and characters, direct presence refers to the emulated sensorimotor experience of the imaginary worlds that the narrators' and characters' utterances refer to. The paper further elaborates on how, by which kinds of narrative content and structure, direct presence may be prompted. The final section addresses some of the observational and historical caveats that must be attached to any theoretical inquiry made into the sensorimotor effects of reading. As a preliminary for further research, a few ideas about the model's potential for empirical validation are put forward. A brief, tentative history of the sensorimotor benefits of literary narrative reading is then outlined. (shrink)

Growth of the private sector and privatization of state companies around the world have led to the emergence of various stock markets, some of which are depicted by insider trading. Law literature uses the arguments of unfairness, breach of fiduciary rights and damage to others to define and rule against insider trading. Economic literature can be used to interpret insider trading from other perspectives. This study argues that the question of insider trading in developing markets can be resolved by (...) the extent stock markets generate externalities and are public goods. It advocates structural changes in the developing markets and examines the conditions under which the Coase Theorem would work. (shrink)

Even though Plamondon's kinematic model fits the data well, we do not share the view that it explains movements other than ballistic ones. The model does not account for closed-loop control, which is the more common type of movement in everyday life, nor does it account for recent data indicating interference with ongoing processing.

Fair trade aims at humanising the capitalist economy by serving the community, instead of simply striving for financial profit. The current fair trade sector is an excellent example of an innovation where networks based on ethical principles can help to effectively serve this market. Our analysis is based on 48 interviews amongst fair trade innovators in France and illustrates the advent of a new type of entrepreneur, one that is grounded in the social and solidarity economy (SSE). Since the development of assisted reproductive technologies, infertile individuals have crossed borders to obtain treatments unavailable or unaffordable in their own country. Recent media coverage has focused on the outsourcing of surrogacy to developing countries, where the cost for surrogacy is significantly less than the equivalent cost in a more developed country. This paper discusses the ethical arguments against international surrogacy. The major opposition viewpoints can be broadly divided into arguments about welfare, commodification and exploitation. It is argued that the (...) only valid objection to international surrogacy is that surrogate mothers may be exploited by being given too little compensation. However, the possibility of exploitation is a weak argument for prohibition, as employment alternatives for potential surrogate mothers may be more exploitative or more harmful than surrogacy. It is concluded that international surrogacy must be regulated, and the proposed regulatory mechanism is termed Fair Trade Surrogacy. The guidelines of Fair Trade Surrogacy focus on minimizing potential harms to all parties and ensuring fair compensation for surrogate mothers. (shrink)

In his 1966 paper “The Strategy of model-building in Population Biology”, Richard Levins argues that no single model in population biology can be maximally realistic, precise and general at the same time. This is because these desirable model properties trade-off against one another. Recently, philosophers have developed Levins’ claims, arguing that trade-offs between these desiderata are generated by practical limitations on scientists, or due to formal aspects of models and how they represent the world. However this project (...) is not complete. The trade-offs discussed by Levins had a noticeable effect on modelling in population biology, but not on other sciences. This raises questions regarding why such a difference holds. I claim that in order to explain this finding, we must pay due attention to the properties of the systems, or targets modelled by the different branches of science.Keywords: Trade-offs; Population biology; Scientific models; Generality; Precision. What should environmentalists say about free trade? Many environmentalists object to free trade by appealing the “Race to the Bottom Argument.” This argument is inconclusive, but there are reasons to worry about unrestricted free trade’s environmental effects nonetheless; the rules of trade embodied in institutions such as the World Trade Organization may be unjustifiable. Programs to compensate for trade-related environmental damage, appropriate trade barriers, and consumer movements may be necessary and desirable. At (...) least environmentalists should consider these alternatives to unrestricted free trade if they do not prevent the achievement of other important moral objectives, can efficiently reduce environmental problems, and institutional safeguards can prevent their abuse. Subject and purpose: Using annual data for the periods 2009–2019, this paper examines trade flows between China and the Visegrad Group countries. The aim of this article is to assess real changes taking place in international trade in the Visegrad Group countries over the last eleven years. The starting point for the analysis was 2009 – the time after the 2008 economic crisis, and it was compared especially to 2018 – a year marked by a significant improvement in (...) the economy. The purpose is to discuss concerns related to the differences in bilateral trade between China and Poland, Czech Republic, Hungary, and Slovak Republic. The main aim of this research is to distinguish the characteristics of bilateral trade by products between V4 and China in years 2009–2019. The purpose of this article is also to systematize and discuss points of view, rationalizing further empirical research. Two research hypotheses, resulting from the research purpose, were formulated: H1: in the V4 countries import exceeds export, and this trend seems to be growing, H2: Chinese goods imported to the V4 are much more sophisticated than those exported. Design/methodology/approach: To assess the initial and current situation on international trade between the V4 and China, the author uses variables obtained from WTO and OEC resources, diagnosing the situation in Poland, Czech Republic, Hungary, and Slovak Republic. The collected empirical data were processed using theoretical methods such as analysis, synthesis, and comparison to formulate conclusions using deductive and inductive inference methods. Practical Implications: The results can be used in scientific and expert work on diagnostic and forecast trends in bilateral trade by products between the V4 and China. Originality/value: It concerns the indication of the importance of the V4 trade with China compared to the share of the V4 countries in world trade. It was also possible to identify the top export and import products of the V4. The findings also confirm the significant change in China’s trading structure. (shrink)

This study conducted a social network analysis of the evolutionary characteristics of the world dairy trade network based on the overall trade pattern. In addition, the evolution of trade blocs and the co-opetition relationships involving dairy products in major countries were analyzed in terms of supply and demand. The results show that continuous and complex changes have taken place in the world’s dairy trade network since 2001. The number of trade entities in dairy (...) products has stabilized since 2012. At present, approximately 94% of countries (regions) are involved in dairy product trade, such that the world dairy trade network exhibits the small-world effect and scale-free property. The world import pattern for dairy products has changed. While export centers have not changed, import centers have shifted from Europe, America, and East Asia to North America, East Asia, and the Middle East. The world dairy trade network consists of the EU trade bloc headed by Germany, the former Soviet Union–Brazil trade bloc, and the Asia–Australia–America trade bloc. The trade blocs have evolved due to geographical positions, historical cultures, and political relations. In a trade bloc, the diversification of import sources is more prominent in demand countries. European and Asian markets have become the main markets of the major exporters. In this study, the evolutionary characteristics of the world dairy trade network and the co-opetition relationships were analyzed to provide scientific support to inform the development of dairy trade policies. The results can provide technical and psychological support to policy-makers in various countries in their dairy trade decision-making. (shrink)
