Originally published as 'Das Problem des Prinzipienforschung und die aristotelische Physik' in Kant-Studien 52 (1960-1), pp. 206-19, the revised text of a lecture given on 28 October 1959 in Hamburg. It presents in summary form the main line of argument developed in the introduction and first two parts of Wieland's book, Die aristotelische Physik (Göttingen: Vandenhoeck & Ruprecht 1962).

The old division of all sciences into the two equally important classes of theoretical and practical disciplines is hardly ever applied today. However, the proprium of a practical science that is aimed at what should be, can be elucidated using medicine as an example. The efforts of medicine are not limited to a mere `application' of methods and results of theoretical disciplines. Even the concepts of `illness' and `diagnosis', which are central to medicine, are defined in a normative-deontological manner. They (...) are supposed not only to help formulating and justifying assertions on facts, but also to be a means to enable and standardise action. Since every action takes place in a concrete situation, a practical science must always bridge the hiatus between the general and the particular. This requires judgement, a personal, individual capacity that cannot be operationalised without residue. In contrast to the theoretical disciplines, such a science is not the master of its own questions and problems; and is subject to the dictate of time, since all action is final and irrevocable. Rechtsnormen bedürfen der Anwendung auf konkrete Einzelfälle. Die Anwendung kann aber in letzter Instanz nicht mehr selbst normiert werden, da ein solcher Versuch nur in einen unendlichen Regreß führen würde. Ihm kommt Kant dadurch zuvor, daß (...) er die Normanwendung der Urteilskraft zuweist, einer naturgegebenen dispositionellen Ausstattung, die sich nur durch Übung, nicht aber durch Belehrung perfektionieren läßt. Kant hat eine anwendungsorientierte Rechtsphilosophie der Urteilskraft nirgends im Zusammenhang dargestellt. Der vorliegende Aufsatz will jedoch zeigen, wie sich eine solche Philosophie der Rechtsanwendung auf der Basis verstreuter Hinweise in den Werken, vor allem aber im handschriftlichen Nachlaß Kants rekonstruieren läßt. Aristotle not only develops for the first time practical philosophy as a independient discipline, but also points out the specific methological problems and bounds of such a discipline, insolar its target is not merely theoretical, but also practical. Such problems are connected basically with the impossibility of reaching the particular as the specific object of action on the level of theoretical reflection. The correa application of universal norms to the particular circumstances of action remains therefore a task to be solved (...) by the personal agent. Phronesis or "prudence" is the faculty that allows to cope with this task adequately, Le. in accordance with the normative standards of virtue. (shrink)

Mit der Einsicht in die Bezogenheit der Frage nach der Wahrheit uber die Wirklichkeit auf die Frage nach dem Masstab des richtigen Handelns tritt die antike Philosophie in ihre klassische Peride ein. Die das richtige Handeln betreffende Frage impliziert ein weiteres Problem, namlich in welcher Weise sich der denkende und haldende Mensch auf sich selbst zuruckbeziehen kann. Denn derartige Fragen erschopen sich nicht darin, bestimmte Gegenstande zu intendieren. Sie beziehen sich immer auf den Fragenden zuruck. Fur das Handeln selbst ist (...) es nicht ohne Belang, wie es von einem BewuBtsein intendiert wird. Kein Staat ist existenzfahig, wenn er sich nicht auf irgendein Bewusstsein stutzt, das ihn intendiert. Da man von richtigem und falschem Bewusstsein spricht, mussen wir die grundsatzliche Frage stellen, ob das Wissen um das richtige Handeln einen bivalenten Geltungsanspruch erhebt. (edited). (shrink)
