This article probes the advisability of regulating U.S. food and drug safety according to the precautionary principle. To do so, a precautionary regulatory regime is formulated on the basis of the beliefs that motivate most proponents of this initiative. That hypothetical regime is critically analyzed on the basis of an actual instantiation of a similarly stylized initiative. It will be argued that the precautionary principle entails regulatory constraints that are apt to violate basis tenets of political legitimacy. The modifications that (...) would change this finding would also change precautionary regulation to the point that it would be indistinguishable from orthodox safety protocols. It is concluded on the basis of its impoverished content that the precautionary principle should not be taken seriously as a formal approach to the regulation of U.S. food and drug safety. (shrink)

Unger has recently argued that if you are the only thinking and experiencing subject in your chair, then you are not a material object. This leads Unger to endorse a version of Substance Dualism according to which we are immaterial souls. This paper argues that this is an overreaction. We argue that the specifically Dualist elements of Unger’s view play no role in his response to the problem; only the view’s structure is required, and that is available to Unger’s (...) opponents. We outline one such non-Dualist view, suggest how to resolve the dispute, respond to some objections, and argue that ours is but one of many views that survive Unger’s challenge. All these views are incompatible with microphysicalism. So Unger’s discussion does contain an insight: if you are the only conscious subject in your chair, then microphsyicalism is false. Unger’s mistake was to infer Substance Dualism from this; for microphysicalism is not the only alternative to Dualism. (shrink)

Appeals to the respective values of free will and of moral and spiritual development (soul‐making) have long been lynchpins in the project of theodicy. The two most prominent contemporary efforts at systematic and comprehensive theodicy have been executed by John Hick and Richard Swinburne, both of whom appeal explicitly to these values. This chapter sympathetically explicates their appeals to these values and considers some of the challenges facing any theodicy that follows them in doing so.

Four experiments supported the hypothesis that ordinary people understand free will as meaning unconstrained choice, not having a soul. People consistently rated free will as being high unless reduced by internal constraints (i.e., things that impaired people’s mental abilities to make choices) or external constraints (i.e., situations that hampered people’s abilities to choose and act as they desired). Scientific paradigms that have been argued to disprove free will were seen as reducing, but usually not eliminating free will, and the reductions (...) were because of constrained conscious choice. We replicated findings that a minority of people think lacking a soul reduces free will. These reductions in perceived free will were fully explained by reductions in people’s perceived abilities to make conscious decisions. Thus, some people do think you need a soul to have free will—but it is because they think you need a soul to make conscious decisions. (shrink)

The aim of this work was to elaborate on the author’s previously published hypothesis of the Soul of Multiverse, a suggested cosmic phenomenon that also appears to imbue the human Soul across its individual and noospheric scales. Without alternatives, the method of analysis continued to rely on the approach of cosmological neuroscience, which integrates scientific facts, religious insights, philosophical suggestions, engineering rules and artistic tools to grasp the complexity of the multidimensional phenomenon of Soul. The result of this examination was (...) the multilayered thought that just as the central medium of human Soul, the hypothesized prefrontal cortical supercircuitry of Self-Ken, seems to comprise domains representing Identity, Conscience, Will and Mission, analogous domains may also function in the noospheric and cosmic Souls. Regarding the human Soul, its four domains appear to be determined by both hereditary genetic and encountered environmental factors to present its host with a Mission enabling his or her mental engine and physical features to integrate into the surrounding society and space-time in the most meaningful and dignified way—if that way is undertaken. Regarding the noospheric Soul, it is made of individual human Souls interacting with the non-living system of interconnected computers to produce functions accessible to humans all over the world through uncontrolled communication across the Internet. Its most probable Mission is to let this global presence acquire its own Identity, develop its own Conscience and refine its own Will, so that their coherent, superior whole can be ready for sensing the cosmic Soul. Regarding the cosmic Soul, the hypothesized Soul of the Multiverse, its Identity appears to express the Laws of Mystery of Endlessness, Coexistence in Diversity, and Truth in Complexity. The concept of free will states that when more than one alternative is available to an individual, he/she chooses freely and voluntarily to render an action in any given context. A question arises, how do human beings choose to perform an action in a given context? What happens to an individual who compels him/her to choose an action out of many alternatives? The behaviorists state that free will guides individuals to choose an action voluntarily. Therefore, he/she is morally responsible for (...) his/her voluntary actions. This paper attempts to answer whether a person’s action is an outcome of his/her ‘moral luck’ or ‘designated cerebral cortex processes’? While answering this question the paper examines the relation between principle of causality and free will of a person. It analyses what causes free will. It elucidates use of free will for decision-making process(es), and the relation between human beings’ actions and their moral responsibility. This paper concludes that human beings are conscious of their free will. Free will decides their actions; therefore, they are morally responsible for their voluntary actions. I argue that the free-will defense and soul-making theodicy have more in common than traditionally has been thought and that their differences have more to do with their divergent aims than their relative merits as responses to the problem of evil. Moreover, I show how the two approaches are logically interdependent. The free-will defense depends for its success on some soul-making concepts, and the soul-making theodicy relies upon a prior concept of human freedom in order to succeed. In this book noted theologian and ethicist Gilbert C. Meilaender examines how the field of bioethics has developed over the last quarter century and reconsiders some of its central concepts and arguments. Because the literature of bioethics has become increasingly less influenced by religious and theological concerns over the past three decades, it is Meilaender's specific aim to uncover and recapture the importance of theological reflection for current debates in bioethics. Meilaender suggests that the development of bioethics as a discipline (...) in its own right has not been entirely benign. He argues that an increasing focus on public policy has obscured the importance of background beliefs about human nature and destiny, and that without drawing attention to those beliefs one cannot fully see what is at stake in many bioethical debates. Rather than seeking a minimalist consensus, Meilaender explores ethical problems surrounding the end and beginning of life in order to uncover the "soul"-that is, some of the deeper issues within bioethics that need our attention. Abortion, the issue that so often lurks just beneath the surface of bioethical argument, is discussed in the final chapter. Throughout the book Meilaender emphasizes the "soul" of all these issues -questions about who we are and what we may become, and suggests that recapturing that soul will lead us to a new appreciation of the living body as the locus of personal presence. Aristotle's highly influential work on the soul, entitled De anima, formed part of the core curriculum of medieval universities and was discussed intensively. It covers a range of topics in philosophical psychology, such as the relationship between mind and body and the nature of abstract thought. However, there is a key difference in scope between the so-called "science of the soul," based on Aristotle, and modern philosophical psychology. This book starts from a basic premise accepted by all medieval commentators, namely (...) that the science of the soul studies not just human beings but all living beings. As such, its methodology and approach must also apply to plants and animals. The Science of the Soul discusses how philosophers from Thomas Aquinas to Pierre d'Ailly dealt with the difficult task of giving a unified account of life and traces the various stages in the transformation of the science of the soul between 1260 and 1360. In The Democratic Soul, Aaron L. Herold argues that liberal democracy's current crisis—of extreme polarization, rising populism, and disillusionment with political institutions—must be understood as the culmination of a deeper dissatisfaction with the liberal Enlightenment. Major elements of both the Left and the Right now reject the Enlightenment's emphasis on rights as theoretically unfounded and morally undesirable and have sought to recover a contrasting politics of obligation. But this has re-opened questions about the relationship between politics and religion long thought (...) settled. To address our situation, Herold examines the political thought of Spinoza and Tocqueville, two authors united in support of liberal democracy but with differing assessments of the Enlightenment. Through an original reading of Spinoza's Theologico-Political Treatise, Herold uncovers the theological foundation of liberal democracy: a comprehensive moral teaching rehabilitating human self-interest, denigrating "devotion" as a relic of "superstition," and cultivating a pride in living, acting, and thinking for oneself. In his political vision, Spinoza articulates our highest hopes for liberalism, for he is confident such an outlook will produce both intellectual flourishing and a paradoxical recovery of community. But Spinoza's project contains tensions which continue to trouble democracy today. As Herold shows via a new interpretation of Tocqueville's Democracy in America, the dissatisfactions now destabilizing democracy can be traced to the Enlightenment's failure to find a place for religious longings whose existence it largely denied. In particular, Tocqueville described a natural human desire for a kind of happiness found, at least partly, in self-sacrifice. Because modernity weakens religion precisely as it makes democracy stronger than liberalism, it permits this desire to find new and dangerous outlets. Tocqueville thus sought to design a "new political science" which could rectify this problem and which therefore remains indispensable today in recovering the moderation lacking in contemporary politics. In the elaboration of his soul-making theodicy, John Hick agrees with a controversial point made by compatibilists Antony Flew and John Mackie against the free will defense. Namely, Hick grants that God could have created humans such that they would be free to sin but would, in fact, never do so. In this paper, I identify three previously unrecognized problems that arise from his initial concession to, and ultimate rejection of, compatibilism. The first problem stems from the fact that in (...) two important texts, Hick rejects compatibilism for different and seemingly contradictory reasons. His various explanations of soul-making theodicy’s relationship to compatibilism are therefore in conflict. The second problem is closely related to the first. It turns out that when Hick’s concession to compatibilism is closely examined, soul-making theodicy appears unable to explain the existence of moral evil. The final problem consists in understanding why Hick would have made any concessions to compatibilism in the first place given that he ultimately opts for incompatibilist free will. After identifying these three problems, I develop a distinctive way in which to interpret Hick’s soul-making theodicy that solves the first two. This distinctive interpretation, moreover, has the added benefit of solving another, well-recognized problem that has long plagued Hick’s exposition: the problem of the hypnotist metaphor. Finally, I address the third problem by suggesting a rationale for Hick’s initial concession to the compatibilists. (shrink)

Western culture has been moving away from its Christian roots for several centuries but the turn from Christianity accelerated in the 20th century. At the core of this decline is a loss of a sense of our own transcendence. Scientific materialism has so seriously impacted our belief in human transcendence that many people find it difficult to believe in God and the human soul. This anti-transcendent perspective has not only cast its spell on the natural sciences, psychology, philosophy, and literature, (...) it has also negatively impacted popular culture through the writings of Richard Dawkins, Daniel Dennett, and many others. The warning signs of this loss of transcendence have been expressed by thinkers as diverse as Carl Jung (psychiatrist), Mircea Eliade (historian of religion), Gabriel Marcel (philosopher), C.S. Lewis and J.R.R. Tolkien. These warnings were validated by a 2004 study in the American Journal of Psychiatry which showed that the absence of religion alone was responsible for a marked increase in suicide rates, sense of meaningless, substance abuse, separation from family, and other psychiatric problems. Thus, the loss of transcendence is negatively affecting not only individuals’ sense of happiness, dignity, ideals, virtues, and destiny, but also the culture. Ironically, the evidence for transcendence is greater today than in any other period in history. The problem is – this evidence has not been compiled and propagated. Fr. Spitzer’s book provides a bright light in the midst of this cultural darkness by presenting both traditional and contemporary evidence for God and a transphysical soul from several major sources. He also shows how human consciousness and intelligence is completely special – and cannot be replicated by artificial intelligence or animal consciousness. We are transcendent beings with souls capable of surviving bodily death – self-reflective beings aware of perfect truth, love, goodness, and beauty. We are beings with an unrestricted capacity to know and create science, law, culture, art, music, literature, and so much more. The evidence reveals that we have the dignity of being created in the very image of God, and if we underestimate it, we will undervalue one another, underlive our lives, and underachieve our destiny. In this article I will claim that from a Thomist perspective the question “Soul or Brain: What makes us human?” presents us with a false dilemma and hence must as such remain an unanswerable question. In order to corroborate this claim I will do two things. First, I present the framework of a Thomistic anthropology in so far as it relates to the unity of soul and body in the human person. Next, I deal with the question that immediately results (...) from this unity, i.e. the subsistence of the soul. Comparative philosophy has been interested in issues such as whether the familiar Western concepts of the soul and self can be applied in understanding Chinese philosophy about human selfhood and whether there are alternative Chinese modes of thinking about these concepts. I will outline a comparison of the main concerns of the Greeks and Chinese philosophers in their discussion about the soul and self, and examine some of the major comparative theories that are recently developed. The comparative discussion is significant (...) in helping us understand each tradition's views of soul and self in its own terms, and in identifying alternatives to familiar modes of thinking. Following the lead of Hannah Arendt and others, I want to argue that the imperial mystique seen in the British Empire found its way into Germany’s expansionist ambitions. I am concerned with the emotional costs of oppression, or what I call soul death. I focus on three key writers of the 20th century: Doris Lessing, Nadine Gordimer, and J. M. Coetzee, placing their writings in the context of war trauma and the barbarities associated with 20th century totalitarianism. My argument seeks (...) to elucidate the relationship between postcoloniality and the wars that shaped that century. These narratives of distress will be juxtaposed with novels by Imre Kertész and Arnošt Lustig whose writings of the Holocaust and the war atmosphere on the Eastern Front illuminate scenes of trauma and personal anguish. Here my study draws on the work of recent psychologists whose term soul murder is made much of. These writers’ works can be more fully understood to reveal patterns of personal destruction that are part of living under imperialism. They bring to the forefront behaviours that expose the debasement and hardening witnessed in the early decades of the century. (shrink)

The Soul of a Nation is a series of essays on American society’s culture, morality, law, education, and faith: subjects that confront our society and will be of interest to citizens and scholars who have studied its political drift in recent years.

In this paper, I will first add some thoughts on Cambron-Goulet and Côté-Remy’s analysis of the tension in Plotinus’ and Porphyry’s philosophy between the concept of the soul as genderless and the conceptual link between the soul becoming vicious and the soul becoming effeminate. I will argue that—despite of the emancipatory impulses in their philosophies—both Plotinus and Porphyry stick to conceptual connections which are constitutive for patriarchic discourses, especially to the conceptual link between being human, being male and being rational (...) which makes women “the other.” In the second part of my paper, I will discuss the question of whether the emphasis Plotinus and Porphyry put on the universal nature of the soul helps to explain why they suppress the hierarchy between souls born in male bodies and souls born in female bodies which Plato develops in the Timaeus. I will argue that there is nothing in Plotinus’ conception of the universal nature of soul which principally excludes a hierarchy between the souls of men and the souls of women, so that his emphasis of the universal nature of soul cannot explain his passing over the hierarchy of Plato’s Timaeus. There are many ways of interpreting the so-called new technologies. One of the most interesting is that which stems from defining them as a social imaginary, and therefore, as collective beliefs, fears and hopes. It is common to attribute to technologies all manner of threats that, founded or not, are real in the measure that the society makes decisions and acts in a way consistent with this conviction.The fears and anxieties of society lead to a consideration of the limits of (...) the human that technologies transgress. Among the figures with which one speaks about these limits there is Frankenstein, the modern Prometheus, which threatens modern fantasies with its deformity. There is, however, another man-made creature that can serve to orient our reflection, the Golem.In 1609, 400 years ago, Rabbi Loew died. He is credited with the creation of a homunculus by combining of secret codes. The problem of the Golem was its imperfect soul made manifest in its lack of speech. Its silent presence was a source of great fear in the community that finally asked to get rid of the creature.These figures of monstrosity, Frankenstein and above all Golem, will help us to make technologies understand from the fear that society projects onto them, and this will lead us to the question concerning the imaginary fears of the technological system. Richard Swinburne presents a powerful new case for substance dualism and for libertarian free will. He argues that pure mental events are distinct from physical events and interact with them, and claims that no result from neuroscience or any other science could show that interaction does not take place. Swinburne goes on to argue for agent causation, and claims that it is we, and not our intentions, that cause our brain events. It is metaphysically possible that each of us could (...) acquire a new brain or continue to exist without a brain; and so we are essentially souls. Brain events and conscious events are so different from each other that it would not be possible to establish a scientific theory which would predict what each of us would do in situations of moral conflict. Hence, we should believe that things are as they seem to be: that we make choices independently of the causes which influence us. It follows that we are morally responsible for our actions. (shrink)

Political integration has been part of the European project from its very beginnings. As far back as the early seventies there was concern in Brussels that an ingredient was missing in the political integration process. ‘Output legitimacy’ – the permissive consensus citizens grant to a government that is ‘delivering’, even if they do not participate in setting its goals – could not sustain unification indefinitely. Such a lacking ingredient – or ‘soul’ – has been labelled ‘European identity’ (EI) in an (...) abundant and growing academic literature. According to Aristotle, ‘polity’ is a specific ‘constitution’ (regime or politeia) of a ‘city’ (or polis): a (‘political’) community composed of ‘citizens’ (politai). No polis can exist unless the politai come together to form it and sustain it. But what will gather and keep them united? Citizens can be very diverse regarding their language, history, religion or economic activity. In absence of a motivation, diversity of itself will make each member of a community go their own way. What kind of bond is required among very diverse European citizens to keep their polis (the EU) – their political community – together? In this paper I analyse several responses – culture, deliberation, welfare, power, multiplicity. Then I attempt a synthesis suggesting that the answers might be referring to different aspects of a single notion – rather than exhaustive explanations of it. Finally I mention three issues regarding the concept of EI that require further study. (shrink)

In a recent issue of The Lancet, the historian Roger Cooter predicted that the field of bioethics will soon die of self-inflicted wounds. “Conspiring against it,” he wrote, “is exposure of the funding of some of its US centres by pharmaceutical companies; exclusion of alternative perspectives from the social sciences; retention of narrow analytical notions of ethics in the face of popular expression and academic respect for the place of emotions; divisions within the discipline ; and collusion with, and appropriation (...) by, clinical medicine.” Cooter's prognosis? “Hardly wet behind the ears, bioethics seems destined for a short lifespan.”. Charlene Burns University of Wisconsin-Eau Claire Buddhist-Christian dialogue seems to founder on the shoals of theological anthropology. The Christian concept of the soul and concomitant ideas of life after death appear to be diametrically opposed to the Buddhist doctrine of anatta, no-self. The anthropological terminology, with its personalist implications in Christianity and (...) its impersonal meanings for Buddhism offers perhaps the greatest challenge to interreligious understanding. The two traditions have built up stereotypical interpretations of one another's (and their own) vocabularies to such an extent that "personal" and "impersonal" have at times operated in dialogue as "party slogans and fighting words. " 1In this paper I explore the plausibility that new interpretations of the human being in both traditions may overcome this problem. There is no agreement across denominations on the meaning of soul for Christianity and likewise no single orthodox interpretation of no-self for all forms of Buddhism. There are of course basics for both traditions that serve as the starting point for all interpretations, and these will be identified below. During the last decade interesting and innovative ways of elaborating on the basics for both Buddhism and Christianity approach something of a middle ground in religious anthropology. It is my thesis that the moves made by Christian theologians toward emphasis on the person as a body-soul unity, and by at least one Buddhist scholar toward the idea of an empirical (not metaphysical) self, are closing what has been perhaps the most problematic gap between the two traditions. The State of the Personal Soul in Christianity The stereotype of Christian anthropology is of the human constituted by a separable body and soul. Although there have been important voices expressing otherwise in history, for the average believer the immaterial soul separates from the physical body at the moment of death, and most assume that the soul goes immediately to its eternal reward or punishment. 2 (While the issue of the timing and nature of resurrection is an important and contested one, attention cannot be given to it here, since the present issue is the soul before death. ) [End Page 87]Early Christians agreed that the human being is more than just a physical body. However, there has never been agreement on the number and kind of "ontological ingredients" it takes to make a person. 3 Trichotomy, dichotomy, and monism have all been proposed at one time or another. The trichotomist position, usually attributed to Paul, was first popular among Greek and Alexandrian Christians. In this view, the human is made up of body, soul, and spirit: the parts function in concert, with soul mediating between the spirit and body. Here, the spirit is the essential self that exists in relationship to God. Dichotomists say that we are made of two substances, body and soul/spirit. This dualism of separable metaphysical substances with soul animating the body came to dominate the Western theological scene, in part due to Augustine's influence. Although there are significant differences in detail between trichotomist and dichotomist positions, what matters for our purposes is the underlying common anthropological assumption that "persons survive apart from their bodies. " 4Strong challenges to dualist anthropologies came in the seventeenth century in the form of materialism and monism. Thomas Hobbes, in Leviathan, argued for materialism, saying that there is no such thing as incorporeal substance. Nothing survives death, he said: it is through divine grace that we will be resurrected into eternity. Present-day descendants of materialism include psychological behaviorism, brain-mind identity theory, and epiphenomenalism. The second strong challenge to dualism took the shape of monism, as in the philosophy of Baruch Spinoza. He believed that reality is a single substance, and matter and spirit are properties of it. All of creation manifests the absolute substance, God. Each entity exists as idea in the mind of God, and so the soul can be said to be eternal when it becomes one with the mind... (shrink)

This paper will critically assess Popper’s evolutionary philosophy. There exists a rich literature on the topic with which we have many reservations. We believe that Popper’s evolutionary philosophy should be assessed in light of the intriguing theoretical insights offered, during the last 10 years or so, by the philosophy of biology, evolutionary biology and molecular biology. We will argue that, when analysed in this manner, Popper’s ideas concerning the nature of selection, Lamarckism and the theoretical limits of neo-Darwinism can be (...) appreciated in their full biological and philosophical value. This article views the Hippocratic Oath from a new perspective and draws consequences for modern health care. The Oath consists of two parts, a family-like alliance where the teacher of the “art” is equal to a father and a set of maxims how the “art” is to be practiced. Self-commitments stated before the gods tie the parts together and give the alliance trustworthiness. One might call this a proto-profession. Modern physicians form a similar alliance. Specific knowledge and skills and specific (...) action guiding rules are elements of a profession but its trustworthiness rests on a combination of professional autonomy and public control. In order to be granted autonomy the profession must show some effort in enforcing its specific rules and in order to do so its members need to be convinced of the intrinsic value of their profession. Whereas in antiquity physicians acted as single individuals the modern alliance is shaped by division of labour. Physicians use each other and other professions by mutual consent and the health care system as means in the diagnostic-therapeutic process. As any actor is reponsible for the means he uses physicians are co-responsible accordingly. Thus, professional conduct now entails care for the organisation of the alliance as detailed in the “Charter on Medical Professionalism”. The effort the profession gives to this task will confirm its trustworthiness. (shrink)
