Quality health care relies upon communication in a patient's preferred language. Language access in health care occurs when individuals are: Welcomed by providers regardless of language ability; and Offered quality language services as part of their care. Federal law generally requires access to health care and quality language services for deaf and Limited English Proficient patients in health care settings, but these patients still find it hard to access health care and quality language services.Meanwhile, several states are implementing Medicaid Accountable (...) Care Organization initiatives to reduce health care costs and improve health care quality. Alternative payment methods used in these initiatives can give Accountable Care Organizations more flexibility to design linguistically accessible care, but they can also put ACOs at increased financial risk for the cost of care. If these new payment methods do not account for differences in patient language needs, ACO initiatives could have the unintended consequence of rewarding ACOs who do not reach out to deaf and LEP communities or offer quality language services.We reviewed public documents related to Medicaid ACO initiatives in six states. Some of these documents address language access. More could be done, however, to pay for language access efforts. This article describes Medicaid ACO initiatives and explores how different payment tools could be leveraged to reward ACOs for increased access to care and quality language services. We find that a combination of payment tools might be helpful to encourage both access and quality. (shrink)

The break necessary to establish a rigorous science of cultural works is something more and something else than a simple methodological reversal.1 It implies a true conversion of the ordinary way of thinking and living the intellectual enterprise. It is a matter of breaking the narcissistic relationship inscribed in the representation of intellectual work as a “creation” and which excludes as the expression par excellence of “reductionist sociology” the effort to subject the artist and the work of art to a (...) way of thinking that is doubly objectionable since it is both genetic and generic.It would be easy to show what the most different kinds of analysis of the work of art owe to the norms that require treating works in and for themselves, with no reference to the social conditions of their production. Thus in the now-classic Theory of Literature, René Wellek and Austin Warren seem to advocate “an explanation in terms of the personality and the life of the writer.” In fact, because they accept the ideology of the “man of genius” they are committed, in their own terms, to “one of the oldest and best-established methods of literary study”—which seeks the explanatory principle of a work in the author taken in isolation .2 In fact, this explanatory principle resides in the relationship between the “space” of works in which each particular work is taken and the “space” of authors in which each cultural enterprise is constituted. Similarly, when Sartre takes on the project of specifying the meditations through which society determined Flaubert, the individual, he attributes to those factors that can be perceived from that point of view—that is, to social class as refracted through a family structure—what are instead the effects of generic factors influencing every writer in an artistic field that is itself in a subordinate position in the field of power and also the effects specific to all writers who occupy the same position as Flaubert within the artistic field. 1. Writings by a thinker—a psychiatrist, a philosopher, a cybernetician, and a poet—whose ideas about mind and brain were far ahead of his time. Warren S. McCulloch was an original thinker, in many respects far ahead of his time. McCulloch, who was a psychiatrist, a philosopher, a teacher, a mathematician, and a poet, termed his work “experimental epistemology.” He said, “There is one answer, only one, toward which I've groped for thirty years: to find out how brains work.” Embodiments of (...) Daniel Dennett’s Consciousness Explained is probably the most widely read book about consciousness ever written by a philosopher. Despite this, the book has had a surprisingly small influence on how most philosophers of mind view consciousness. This might be because many philosophers badly misunderstand the book. They claim it does not even attempt to explain consciousness, but instead denies its very existence. Outside of philosophy the book has had more influence, but is saddled by the same misunderstanding. Now, 30 years (...) after publication, Consciousness Explained deserves reconsideration from anyone interested in consciousness. Here I make a case for this. To start, I will clear up the central misunderstanding of the book. With that done, I will explain and update Dennett’s tantalizing approach to consciousness and the mind. The result brings us very, very close to explaining consciousness. Or so I will argue. (shrink)

We face reality presented with the data of conscious experience and nothing else. The project of early modern philosophy was to build a complete theory of the world from this starting point, with no cheating. Crucial to this starting point is the data of conscious sensory experience – sense data. Attempts to avoid this project often argue that the very idea of sense data is confused. But the sense-data way of talking, the sense-data language, can be freed from every blemish (...) using ideas from contemporary metaontology. We can adopt a sense-data framework that vindicates the traditional claims of sense-data theories and leads to plausible theories of perception and color. We can, we should, and in a sense, we must. Yet when we do, we face the traditional problem of external world skepticism, head-on. The real challenge of skepticism is forced upon us; it cannot honestly be avoided using externalist tricks, burden of proof shifting, or other razzle dazzle. But the challenge can be met: we are rational to posit the external world as the best explanation of the many synchronic and diachronic patterns over our sense-data. This paper argues for all of these points and ends with a plea for analytic empiricism – a traditional sense-data version of empiricism that uses all of the tools of analytic philosophy while avoiding the more questionable doctrines of the Vienna Circle (phenomenalism, verificationism). Analytic empiricism is our last best hope for completing the great philosophical project of early modern philosophy. (shrink)

Quietist Moral Realists accept that there are moral facts and properties, while aiming to avoid many of the explanatory burdens thought to fall on traditional moral realists. This chapter examines the forms that Quietist Moral Realism has taken and the challenges it has faced, in order to better assess its prospects. The best hope, this chapter argues, lies in a pragmatist approach that distinguishes the different functions of diverse areas of discourse. This paves the way for a form of Quietism (...) that does not simply remain quiet about the explanatory demands of metaethics, but rather is able to diagnose where they go wrong. By combining a neopragmatic analysis of the discourse with an easy approach to ontology, , we can develop a form of Quietist Moral Realism that is far stronger than critics of quietism have appreciated. This book completes medical care by adding the comprehensive humanistic perspectives and philosophy of medicine.

It is often assumed that morally permissible acts are morally better than impermissible acts. We call this claim Betterness of Permissibility. Yet, we show that some striking counterexamples show that the claim’s truth cannot be taken for granted. Furthermore, even if Betterness of Permissibility is true, it is unclear why. Apart from appeals to its intuitive plausibility, no arguments in favour of the condition exist. We fill this lacuna by identifying two fundamental conditions that jointly entail betterness of permissibility: ‘reasons (...) monotonicity of permissibility’ and the ‘weak classical view’. We then argue that there are good reasons for accepting both of the fundamental conditions. We note that there exist plausible moral theories that reject one of the fundamental conditions. However, the way in which those theories reject the fundamental conditions does not allow them to endorse the counterexamples that motivate the belief that Betterness of Permissibility might be false. In this chapter, Kyle Ferguson argues for an individualist account of Sellarsian we-intentions. According to the individualist account, we-intentions’ intersubjective form renders them shareable rather than requiring that they be shared. Contrary to collectivist accounts, one may we-intend independently of whether and without presupposing that one's community shares one's we-intentions. After providing textual support, Ferguson proposes and implements a strategy of reportorial ascent, which strengthens the case for the individualist account. Reportorial ascent involves reflecting on the sentences one (...) would use to report or self-ascribe we-intentions. As Ferguson argues, we-intention-reporting sentences have ‘I’ as their subjects, which reveals that their truth conditions, like the performance conditions of their expressive counterparts, are satisfied by the individual who reports or expresses those intentions rather than by the host community. We-intention-reporting sentences, which make explicit both dimensions of independence and shareability, also reveal that intersubjective form is a feature of we-intentions qua mental states rather than a feature of their contents. Ferguson concludes that although the individualist account needs further development, the sketch provided in this chapter is compelling enough to demand that individualism and independence be moved from the periphery to the core of our study of we-intentions in Sellars's practical philosophy. Because of the “all-or-none” character of nervous activity, neural events and the relations among them can be treated by means of propositional logic. It is found that the behavior of every net can be described in these terms, with the addition of more complicated logical means for nets containing circles; and that for any logical expression satisfying certain conditions, one can find a net behaving in the fashion it describes. It is shown that many particular choices among possible neurophysiological assumptions (...) are equivalent, in the sense that for every net behaving under one assumption, there exists another net which behaves under the other and gives the same results, although perhaps not in the same time. Once upon a time, logical conventionalism was the most popular philosophical theory of logic. It was heavily favored by empiricists, logical positivists, and naturalists. According to logical conventionalism, linguistic conventions explain logical truth, validity, and modality. And conventions themselves are merely syntactic rules of language use, including inference rules. Logical conventionalism promised to eliminate mystery from the philosophy of logic by showing that both the metaphysics and epistemology of logic fit into a scientific picture of reality. For naturalists of all (...) stripes, this was paradise. Alas, paradise was lost. By the end of the twentieth century, logical conventionalism had been almost universally abandoned. But more recently, it has been revitalized. This chapter provides an overview of logical conventionalism and its history, clears away misunderstandings, and briefly responds to both the canonical objections to conventionalism (from Quine, Dummett, Boghossian, and many others) as well as new objections (from Field and Golan). Like many intensional logics, William Parry’s logic of analytic implication PAI admits extensions determined by imposing semantic conditions on its account of modality. PAI is unique, however, in its allowing a second dimension—a topic-theoretic dimension—along which extensions can be defined. The recent introduction by Francesco Berto of topic-sensitive intentional modals (TSIMs)—which disagree with PAI on this type of condition—provide further motivations to examine such topic-theoretic extensions. In this paper, we introduce, motivate, and characterize a number of such extensions of PAI, (...) paying special attention to applications to Berto’s framework and to ways in which the modal and topic-theoretic dimensions influence one another. It reflects the recent paradigm shift in legal education, which focuses more on what students actually learn rather than the material to which they are exposed. The text aims to prepare the next generation of U.S. lawyers to engage with our interconnected world and to critically evaluate the U.S.'s role within the international legal order. The work is divided into three parts that accomplish these goals. Part One lays a foundation. Part Two turns to the fora that define and support the international order, the historical and political contexts that impacted their design, and their efficacy. For example, rather than consider the various dispute resolution fora in isolation, Part Two asks students to consider them in the context of what types of disputes arise and what legal rules can be employed to resolve them in various international and domestic fora. The institutions also are presented in chronology. In this way, students are encouraged to chart the developmental progression and to make connections and comparisons between various institutions. The use of conceptual frameworks continues within each part. For example, Chapter Six covers the sovereign State as a conflict resolution forum. Although the work of G.F.C. Griss is commonly understood as a program of negationless mathematics, close examination of Griss’s work suggests a more fundamental feature is its executability, a requirement that mental constructions are possible only if corresponding mental activity can be actively carried out. Emphasizing executability reveals that Griss’s arguments against negation leave open several types of negation—including D. Nelson’s strong negation—as compatible with Griss’s intuitionism. Reinterpreting Griss’s program as one of executable mathematics, we iteratively develop a pair of (...) bilateral constructive logics and argue for their adequacy as accounts of the propositional basis of Griss’s work. We conclude by observing connexive features exhibited by the two bilateral logics and by investigating the difficulties connexive principles reveal for the development of executable mathematics. Maimonides requires the multitude to observe many ceremonial commandments, while Spinoza makes no such demand. This chapter focuses on some of the main points of agreement between Maimonides and Spinoza on true religion, the religion of reason, or philosophic religion. True religion includes also piety, that is, moral conduct, which follows from the rational life. The piety of the philosopher and the non‐philosopher both consist in doing good to others. Maimonides’ approach to true religion adumbrates Spinoza's. Spinoza's concept of amor (...) Dei intellectualis echoes Maimonides’ concept of the passionate intellectual love of God. Spinoza's concept of piety is adumbrated in Maimonides. The Maimonidean thrust of Spinoza's concept of true religion is evident in his discussion of “the divine Law” or, more precisely, “the natural divine Law” and the summum bonum in TTP4. This book brings together recent work on the topic of exploitation from philosophy, political science, and economics in one volume, organised around three main questions: what is exploitation?, why is exploitation wrong?, and what should we do about it? These questions are increasingly relevant in public policy discussions. The past decade has witnessed the rise of populism and an increasing sense that politics is a game rigged to benefit certain classes of persons at the expense of others. Interestingly, this sense (...) of unfairness has been shared across the political spectrum though, of course, the left and right differ in both their moral diagnosis and their political prescription. Current debates over minimum wage laws, immigration reform, and undue corporate influence on politics can all be understood as drawing on and developing these concerns over exploitative political treatment. This book also draws upon the natural opportunities for interdisciplinary engagement that the topic of exploitation presents. Questions about exploitation often involve not only philosophical issues, but economic and political ones as well. The contributors to this volume add to that breadth of knowledge. With the re-emergence of Politics, Philosophy, and Economics (PPE) as a burgeoning field of academic inquiry, now is the perfect time to explore issues of exploitation in an interdisciplinary, public-policy focused context. In this paper, the notion of structural completeness is explored in the context of a generalized class of superintuitionistic logics involving also systems that are not closed under uniform substitution. We just require that each logic must be closed under D-substitutions assigning to atomic formulas only ∨\documentclass[12pt]{minimal} \usepackage{amsmath} \usepackage{wasysym} \usepackage{amsfonts} \usepackage{amssymb} \usepackage{amsbsy} \usepackage{mathrsfs} \usepackage{upgreek} \setlength{\oddsidemargin}{-69pt} \begin{document}$$\vee $$\end{document}-free formulas. For these systems we introduce four different notions of structural completeness and study how they are related. We focus on superintuitionistic inquisitive logics (...) that validate a schema called Split and have the disjunction property. In these logics disjunction can be interpreted in the sense of inquisitive semantics as a question forming operator. It is shown that a logic is structurally complete with respect to D-substitutions if and only if it includes the weakest superintuitionistic inquisitive logic. Various consequences of this result are explored. For example, it is shown that every superintuitionistic inquisitive logic can be characterized by a Kripke model built up from D-substitutions. The measurement of sensory intensity has had a long history, attracting the attention of investigators from many disciplines including physiology, psychology, physics, mathematics, philosophy, and even chemistry. While there has been a continuing doubt by some that sensation has the properties necessary for measurement, experiments designed to obtain estimates of sensory intensity have found that a general rule applies: Equal stimulus ratios produce equal sensory ratios. Theories concerning the basis for this simple psychophysical rule are discussed, with emphasis given to (...) the physical correlate theory, which considers judgments of subjective magnitudes to be based upon estimates of physical dimensions that vary regularly with changes in degree of stimulation. For the most thoroughly investigated sensory scales, brightness and loudness, the physical correlate is considered to be distance. Our “tacit knowledge” of the sensory effects of changing distance plays an essential role in matching motor activities to environmental conditions and in ensuring accurate perceptual evaluations through brightness and loudness constancies. In psychophysical experiments, subjects apparently use this same tacit knowledge when required to estimate relative subjective magnitudes. The evidence related to the physical correlate theory is summarized, and it is concluded that, while under appropriate conditions we demonstrate considerable skill in evaluating environmental relationships, we are quite unable to estimate the neurophysiological nature or quantity of sensory response. A psychophysics devoted to studying conditions required for accuracy and conditions producing errors in the perception of environmental relationships would seem to be more valuable than one devoted to subjective magnitudes. What is wrong with colonialism? The standard—albeit often implicit—answer to this question has been that colonialism was wrong because it violated the territorial rights of indigenous peoples, where territorial rights were grounded on acquisition theories. Recently, the standard view has come under attack: according to critics, acquisition based accounts do not provide solid theoretical grounds to condemn colonial relations. Indeed, historically they were used to justify colonialism. Various alternative accounts of the wrong of colonialism have been developed. According to some, (...) colonialism involved a violation of territorial rights grounded on legitimate state theory. Others reject all explanations of colonialism's wrongfulness based on territorial rights, and argue that colonial practices were wrong because they departed from ideals of economic, social, and political association. In this article, we articulate and defend the standard view against critics: colonialism involved a procedural wrong; this wrong is not the violation of standards of equality and reciprocity, but the violation of territorial rights; and the best foundation for such territorial rights is acquisition based, not legitimacy based. We argue that this issue is not just of historical interest, it has relevant implications for the normative evaluation of contemporary inequalities. (shrink)

Background: According to the Declaration of Helsinki, patients who take part in a clinical trial must be adequately informed about the trial's aims, methods, expected benefits, and potential risks. The declaration does not, however, elaborate on what “adequately informed” might amount to, in practice. Medical researchers and Local Research Ethics Committees attempt to ensure that the information which potential participants are given is pitched at an appropriate level, but few studies have considered whether the patients who take part in such (...) trials feel they have been given adequate information, or whether they feel able to understand that information.Objectives: To explore trial participants' views on the amount of information provided, and of their own understanding of that information.Design: Structured interviews of patients participating in clinical trials for the treatment of chronic medical condition.Findings: Patients generally felt they were given an appropriate amount of information, and that they were able to understand all or most of it. They felt they were given adequate time to ask questions before agreeing to take part. In comparison with treatment given outwith the research setting, patients generally felt they received more information when participating in a clinical trial.Conclusions: Researchers sometimes complain that patients are given too much information during clinical trials, and have limited understanding of that information. The present study shows that this perception is not necessarily shared by patients. More research is needed in this area, particularly to gauge whether patient understanding is indeed accurate. The past decade has witnessed the rise of populism and an increasing sense that politics is a game rigged to benefit certain classes of persons at the expense of (...) others. Interestingly, this sense of unfairness has been shared across the political spectrum though, of course, the left and right differ in both their moral diagnosis and their political prescription. Current debates over minimum wage laws, immigration reform, and undue corporate influence on politics can all be understood as drawing on and developing these concerns over exploitative political treatment. At the same time, the literature on exploitation has blossomed. What was once a topic of relatively narrow interest to philosophers working in the tradition of analytical Marxism has been reinvigorated and diversified. The essays in this book both represent and extend that diversity. While the condition of labor remains an important and central topic, the current volume extends the analysis to such neglected topics as the relationship between children and parents, interactions between states, and interactions between generations. This chapter investigates forgiveness through a phenomenological inflected analysis of its temporal constitution as an inter-subjective self-constitution. A central claim to phenomenological thinking is the recognition of temporality as fundamental to the constitution of human subjectivity. The intentionality of forgiveness directs the offender as its primary object in view of her past wrongdoing. The conjunction of repudiation and responsibility plays itself out along two intersecting distinctions: between act and self, and between the past and present/future. An interpretation of shame within (...) the etiology of self-repudiation is then reported. The assumption of responsibility by the offender does not separate the past misconduct. Bitterness mobilises the offender to responsibility, and demands of the offender that he or she recognize and respect the victim. The offender accepts the burden of his or her past wrong into the compass of the person he or she is today and thus becomes the living questionability of his or her own wrongdoing. (shrink)

This article explores the synthesis between the theories and practice of Humanistic Management and Self-Determination Theory of Motivation (SDT). Moving from Economistic to Humanistic Management involves considering human action as uniting internal and external dimensions, having ethics as a guide for a good life, viewing society as a community of people, and being open to beauty and transcendence. The recently elucidated 50-year legacy of SDT describes it as a truly human science of motivation that takes into consideration our attributes as (...) persons, including our capacities for awareness and self-regulation. It also focuses on one’s capacity for autonomy as it applies to individual functioning, interpersonal relationships, and societal interactions. SDT posits a continuum of motivational regulation ranging from amotivation through controlled to autonomous motivation. The current empirical study of Millennials' motivation to support local and global hunger charities based on social media communication employs the complete SDT continuum. Digitalization and globalization have fundamentally changed the nature of human communication. Millennials are central to the humanistic functioning of today’s society. The study findings of the dominance of integrated personal value autonomy demonstrates the necessity of assessing the complete set of SDT motivations in various contexts and situations. Given that SDT and Humanistic Management investigations have mainly involved corporations, one must also be open to investigating the humanistic management of non-profit social and governmental organizations. The non-greenwashed triple sustainability values of corporate, social and environmental good are pertinent targets for Humanistic Management research and Practices. (shrink)
