This article is an attempt to explore and explain the complex processes and mechanisms involved in creating myth signs as presented in Roland Barthes’ Mythologies (1957) through an interdisciplinary and an interdiscursive approach. The article presupposes that the mythic system of signification occupies a liminal space of a multiplicity of disciplines and discourses. The mythic sign integrates a myriad of epistemological spaces philosophical, scientific, and cultural. Therefore, this article wants to cross the borderlines between fields of knowledge to understand the (...) unique position of the mythic sign. We are going to use scientific discourse of virology to investigate the parasitic and viral nature of the mythic sign. Moreover, we investigate the role of the mythologist in exploring the signs that are infected by ideology and how to demystify their intentionality and artificiality. Finally, we are going to rely on quantum physics to investigate the superposition of the mythologist and the role this position plays in understanding the ambiguous and multidimensional nature of the mythic sign. Among various changing views on sex and gender, transsexualism, theoretically as well as clinically, raises a paradoxical issue: transsexual subjects seem to confirm something that they simultaneously disclaim or, at least, destabilize with their transition. These days psychoanalysis remains rather critical towards transsexualism. Jacques Lacan has developed several theories on sex and gender, reworking them during the course of his lifetime. That is why his work includes possibilities of understanding transsexual phenomena at the level of singular solutions that he himself, (...) especially with respect to some of his earlier cases, has not been able to formulate. Gerontologists have proposed different concepts for ageing well such as ‘successful ageing’, ‘active ageing’, and ‘healthy ageing’. These conceptions are primarily focused on maintaining health and preventing disease. But they also raise the questions: what is a good life in old age and how can it be achieved? While medical in origin, these concepts and strategies for ageing well also contain ethical advice for individuals and societies on how to act regarding ageing and old age. This connection between gerontology and (...) ethics is overlooked by both schools of thought. We thus develop this research programme for a systematic geroethics in four steps. First, we analyze ‘successful ageing’ as put forward by Rowe and Kahn as a paradigmatic example of a gerontological conception of ageing well. Then, in a second step, we move from criticisms within gerontology to an ethical perspective; in particular, we want to clarify the problem of the claim of universal validity of conceptions of the good life. In a third constructive step, we explain how the ‘capabilities approach’ could be applied in this context as a normative foundation for the implicit normative assumptions of gerontological conceptions of ageing well, such as a particular choice of functionings, the ethical relevance of human agency, and the resulting claims of individuals towards society. Finally, using a concept developed by the German philosopher Ursula Wolf, we systematically develop the different aspects of the connection between ageing well and the theory of the good life in their full complexity and show their interconnectedness. University students from Bulgaria, Estonia, Finland, and Portugal were given a list of morally relevant behaviors, the Schwartz Value Survey and Tangney’s TOSCA, measuring empathic guilt, guilt over norm-breaking, and shame. A factor analysis of MRB yielded 4 dimensions: prosocial behaviors, interpersonal transgressions, antisocial behaviors and secret transgressions. Prosocial behaviors were predicted by self-transcendence–self-enhancement value contrast only while the three transgression categories were associated with both SET and openness to change–conservation contrast. Norm-breaking guilt was more strongly associated with behaviors than (...) were empathic guilt and shame. However, shame was associated with secret transgressions in three countries, after controlling for values. The associations were strongest in Bulgaria and Estonia while fewer associations were found in Finland and Portugal. The implications of the findings for the cross-cultural psychology of morality are discussed. (shrink)

Unfounded—conspiracy and health—beliefs about COVID-19 have accompanied the pandemic worldwide. Here, we examined cross-nationally the structure and correlates of these beliefs with an 8-item scale, using a multigroup confirmatory factor analysis. We obtained a two-factor model of unfounded (conspiracy and health) beliefs with good internal structure (average CFI = 0.98, RMSEA = 0.05, SRMR = 0.04), but a high correlation between the two factors (average latent factor correlation = 0.57). This model was replicable across 50 countries (total N = 13,579), (...) as evidenced by metric invariance between countries (CFI = 0.96, RMSEA = 0.06, SRMS = 0.07) as well as scalar invariance across genders (CFI = 0.98, RMSEA = 0.04, SRMS = 0.03) and educational levels (CFI = 0.98, RMSEA = 0.04, SRMS = 0.03). Also, lower levels of education, more fear of COVID-19, and more cynicism were weakly associated with stronger conspiracy and health beliefs. The study contributes to knowledge about the structure of unfounded beliefs, and reveals the potential relevance of affective (i.e., fear of COVID-19) and cognitive (i.e., cynicism) factors along with demographics, in endorsing such beliefs. In summary, we obtained cross-cultural evidence for the distinctiveness of unfounded conspiracy and health beliefs about COVID-19 in terms of their structure and correlates. (shrink)

The objective of Working Group 4 of the COST Action NET4Age-Friendly is to examine existing policies, advocacy, and funding opportunities and to build up relations with policy makers and funding organisations. Also, to synthesize and improve existing knowledge and models to develop from effective business and evaluation models, as well as to guarantee quality and education, proper dissemination and ensure the future of the Action. The Working Group further aims to enable capacity building to improve interdisciplinary participation, to promote knowledge (...) exchange and to foster a cross-European interdisciplinary research capacity, to improve cooperation and co-creation with cross-sectors stakeholders and to introduce and educate students SHAFE implementation and sustainability. To enable the achievement of the objectives of Working Group 4, the Leader of the Working Group, the Chair and Vice-Chair, in close cooperation with the Science Communication Coordinator, developed a template to map the current state of SHAFE policies, funding opportunities and networking in the COST member countries of the Action. On invitation, the Working Group lead received contributions from 37 countries, in a total of 85 Action members. The contributions provide an overview of the diversity of SHAFE policies and opportunities in Europe and beyond. These were not edited or revised and are a result of the main areas of expertise and knowledge of the contributors; thus, gaps in areas or content are possible and these shall be further explored in the following works and reports of this WG. But this preliminary mapping is of huge importance to proceed with the WG activities. In the following chapters, an introduction on the need of SHAFE policies is presented, followed by a summary of the main approaches to be pursued for the next period of work. The deliverable finishes with the opportunities of capacity building, networking and funding that will be relevant to undertake within the frame of Working Group 4 and the total COST Action. Müslümanlar, dillerin ortaya çıkmasıyla ilgili iki teori öne sürmüşlerdir: Birincisi, tevkîf teorisidir. Buna göre dil ilahi bir mevhibe olup insana Allah tarafından öğretilmiştir. Understanding the developments in the early period when Ṣūfism became widespread in the Islamic society, both necessitates studies on other disciplines from Ṣūfism, and also requires the consideration of Ṣūfism from the perspective of other religious sciences. In this regard, one of the important names is the famous Ḥanbalī scholar Abū Yaʿlā al-Farrā. Abū Yaʿlā al-Farrā who was interested in ḥadīth, Islamic law and tafsīr as well as Ṣūfism and theological issues, has an important place especially with his works in (...) the Ḥanbalī tradition. Abū Yaʿlā, who grew up in a period when the Sunnī theology schools were formed, spread and exercised its influence, he maintained the Ḥanbalī viewpoint and criticized both some schools of kalām and the Ṣūfis by using the kalām method. Therefore, analyzing his views is important for understanding the formative conditions of the first period of religious science tradition, as well as giving clues about the relationship between Ṣūfism and Ḥanbalī tradition. In this article, his views of zuhd, tawakkul and Ṣūfism in general is examined in the context of his works Kitāb al-Muʿtamad fī uṣūl al-dīn and Kitāb al-tawakkul, and his importance in understanding the relationship between Ṣūfism and Ḥanbalī tradition is emphasized. Whence does international law derive its normative force as law in a world that remains, in many respects, one where legitimate politics is practiced primarily at the national level? As with domestically focused legal theories, one standard answer is positivistic: the law's authority is based on its origin in agreed procedures of consent. This is certainly plausible with respect to treaty obligations and commitments that derive from the United Nations Charter, but it leaves customary international law vulnerable to legitimacy critiques—of (...) which there is no shortage among international law skeptics. Even with respect to conventional international norms, such as treaty provisions, there is often a sense that such consent is democratically thinner than the public consent to domestic law, particularly fundamental domestic law, constitutional norms, and derivative principles of legitimate governance. State consent in international law, in this view, is often a very imperfect proxy for democratic consent to international legal norms. While it is obvious to international lawyers why state consent should make international norms prevail over domestic norms to which there is arguably deeper democratic consent, persistent critics of international law have questioned whether this should be so as a matter of legitimacy. Abstract The claim that the Shi’i Imamite thought is heavily influenced by the Mu’tazilite outlook has been alleged since the fouth century of hijra. However, beginning with Shaikh Mufid, the first representative of the Usuli branch of Shi’a, the Shi’is vehemently denied this allegation. In this article, this issue is dealt with by making a comparison between the idea of Qadi Abd al-Jabbar, the prominent Mu’tazilite scholar who made a major contribution to the consolidation of the schools’ theaching and that of al-Tusi, who also made a contrubitued to the integration of the Shi’ite kalam and the spreading of the usuli approach initiated by Shaikh Mufid. Leaving aside the differences in deatil, it seems that there is no noteworthy difference between their approcah to the issue of justice. Al-Qāḍī Ḥusayn al-Marwarrūdhī is one of the important representatives of Khurāsān Shāfi‘ī School. Al-Ta‘līḳa is his famous work, which is one of the first commentaries of al-Muzanī’s Mukḫtaṣar. One of the important features of this work is the introduction to some of the subjects of ijtihād (process of juristic legal reasoning), taqlīd (acting upon the word of another without asking for specific proof), ijmā‘ (consensus of jurists) and view’s of the companions of the Prophet. The first systematic, complete and detailed (...) works of uṣūl al-fiqh (Islamic legal theory) that belonged to the Khurāsān Shāfi‘ī School have reached to the present day belong to the second half of the V./XI. century. Making research on the studies which were done about uṣūl al-fiqh and formed the basis of this period is essential to follow the development of uṣūl al-fiqh of the Khurāsān Shāfi‘ī School. Transfer of the uṣūl al-fiqh in al-Qāḍī Ḥusayn al-Marwarrūdhī’s al-Ta‘līḳa make it possible to determine the literatüre, which was formed in Khurāsān region in the period from the death of Shāfi‘ī to the first half of the V./XI. century until the first half of the Khurāsān region, which allows the determination of the uṣūl al-fiqh. In this study, on the basis of ijmā‘, al-Qāḍî Ḥusayn al-Marwarrūdhī’s method in al-Ta‘līḳa will be examined.Summary: Al-Qāḍī Ḥusayn al-Marwarrūdhī is considered to be one of the most important representatives of the Khurāsān Shāfi‘ī School. In addition to receiving fiqh education from al-Qaffāl al-Marwazī, who is accepted as the founder of the Khurāsān Shāfi‘ī School in Shāfiʿī fiqh circles. Al-Qāḍī Ḥusayn, one of the most distinguished students of al-Qaffāl al-Marwazī, has become one of the important bearers of the fiqh heritage of Khurāsān Shāfi‘ī School. The fact that the epithet “el-kāḍî” is used in the works of Khurāsān Shāfi‘ī School to absolutely refer to al-Qāḍî Ḥusayn, is another issue that shows his being authority on fiqh. Al-Qāḍī Ḥusayn al-Marwarrūdhī has accomplished many works in the field of fiqh. The most famous and most important work of al-Qāḍī Ḥusayn is the al-Ta‘lîḳa, written according to the Mukḫtaṣar arrangement style of al-Muzanī. He is often cited as the author of the well-known work al-Ta‘lîḳa in the sect. Al-Ta‘lîḳa, commonly cited in fiqh studies to refer to the views of al-Qāḍī Ḥusayn, is one of the first commentary on Mukḫtaṣar by Muzanī. With these characteristics, al-Ta‘lîḳa is one of the outstanding manuscripts for exploring the fiqh legacy of the Khurāsān Shāfi‘ī School. Another important feature of this text is that uṣūl al-fiqh issues such as ijtihād, taqlīd, ijmā‘ and view’s of the companions of the Prophet (qawl al-ṣaḥābah) have been covered in the introduction of the work. Al-Qāḍī Ḥusayn discusses the issues of evidentiality and types of ijmā‘ and ijmā‘ of ṣaḥābah in the chapter on ijmā‘ in al-Ta‘lîḳa. Al-Qāḍī Ḥusayn also handles the debates on view’s of the companions of the Prophet in the section on ijmā‘ of ṣaḥābah. It is also seen that the proofs proposed for evidentiality of ijmā since Shāfiʿī’s period became more versatile and differed. The fact that the arguments al-Qāḍī Ḥusayn cites in the chapter of the evidences of ijmā‘ were also mentioned by his contemporary, al-Māwardī, an Iraqi Shāfiʿī jurist, points out the accumulation of knowledge in terms of proofs of ijmā. Al-Qāḍī Ḥusayn makes two related distinctions that are fundamentally related to the types of ijmā. The first is the division between ijmā supporters, those who argue for knowability of ijmā, and their opponents. According to this, ijmā is divided into two parts as ‘āmm (general public) ijmā‘ and khāṣṣ (scholars) ijmā‘. Opposition to ‘āmm ijmā‘, such as fardhs (obligations) in prayer, rawātib sunnah (the practice that the Prophet regularly performed) and feast prayer requires kufr (blasphemy). Al-Qāḍî Ḥusayn, who considers issues such as ‘awl (a sharing method in Islamic inheritance law), mut‘a marriage (a type of temporary marriage) and riba’l-faḍl (interest in exchange or sale transactions) which are seen as controversial ijmā‘ issues in literature, as khāṣṣ ijmā‘ and evaluates opposition to this type of ijmā‘ as fisq (impiety). The second division al-Qāḍī Ḥusayn makes is between ijmā‘ based on the text and apparent comparison, and the ijmā‘ based on hidden comparison. Al-Qāḍī Ḥusayn thinks that the opposition to ijmā‘ that is based on ijtihād or the text in terms of sanad (chain of narrators), requires blasphemy. In a sense, this is to accept ijmā‘ as a provision on an equal basis and to reduce the distinctions of ijmā‘ to literary level. Al-Qāḍī Ḥusayn also discusses evidentiality of qawl al-ṣaḥābah in connection with the issues of ijmā‘. Al-Qāḍī Ḥusayn opposes the thesis that ijmā‘ is only limited to companions’ era and argues that it can be realized in any century after the Prophet. Al-Qāḍī Ḥusayn, who discusses ṣaḥābah’s ijmā‘ under two categories: the views of ṣaḥābah that have gained prevalence among other ṣaḥābahs and those that have not gained prevalence among other companions, argues for evidentiality of qawl al-ṣaḥābah, which have gained prevalence and known not to be opposed. He provides significant information on ijmā‘ discussion in Shāfi‘ī fiqh methods with regard to the evidentiality of this type of qawl al-ṣaḥābah, which is referred ijmā‘ al-suqūtī (consensus based on lack of opposition-silence). The knowledge al-Qāḍī Ḥusayn cites with regard to the evidentiality of qawl al-ṣaḥābah which have not gained prevalence among other ṣaḥābahs differs from Māwardī, one of his contemporary, and his predecessors. The fact that he cites Shāfi‘ī’s previous and latest views with regard to the state of such qawl al-ṣaḥābah in the face of qiyās (legal analogy) enables him to make comparison using uṣūl material available in his era. Al-Qāḍī Ḥusayn, who mentions debatable issues among ṣaḥābah, makes controversial narrations. While al-Qāḍī Ḥusayn reports that there is not any conflict on the argument that it is legitimate to express a third view with regard to issues on which ṣaḥābah is divided in two groups and fall into conflict, his contemporary al-Māwardī and other Shāfi‘ī jurists report that it is not legitimate to propose a third view on such an issue as there is ijmā‘ on these issues. The part that expresses certain information in the news is mutawatir.One of the scholars who discussed the details of the news in the Hijri 4th century and took a detailed view of it in his works is Qādi Abd al-Jabbar (415/1025). He has opened independent titles in his works on the value of news and knowledge of the news, and has based his views on this subject in various ways, using the methods of Islam as the basic sources of Islam, using the methods of intelligence and transportation against the Sumenians who do not accept the news as a source of information and Berahime who do not accept the prophethood of the prophethood. In this study, Qāḍī Abd al-Jābbār’s views on knowing Allah (ma‘rifatullah) and following issues have been analysed. In this context, either the divine message has reached to a person or not, it is examined whether ma‘rifatullah is obligatory (wajib) upon him. Subsequently, it is discussed whether this obligation is ensured by reasoning (‘aql) or revelation (naql). Furthermore, while keeping in mind the role of intellect (nazar) and argumentation (istidlāl), we have established and evaluated religious state and source of nazar and (...) istidlāl. Also, we discussed to what extend God can be the subject of knowledge and from which aspects He can be known. Besides, we discussed whether ma‘rifatullah is an obligation and if not what its justification is. In addition, we examined whether imitative knowledge (taqlīd) is possible in the case of ma‘rifatullah or not and whether it’s sufficient to know God just by taqlīd without the reasoning at all. Finally, Qāḍī Abd al-Jābbār’s opinions on the religious situation of people to whom the divine revelation did not reach at all and so they lack of knowledge on God. (shrink)

The rule of law is a moral ideal that protects distinctive legal values such as generality, equality before the law, the independence of courts, and due process rights. I argue that one of the main goals of an international rule of the law is the protection of individual and state autonomy from the arbitrary interference of international institutions, and that the best way to codify this protection is through constitutional rules restraining the reach of international law into the internal affairs (...) of a state. State autonomy does not have any intrinsic value or moral status of its own. Its value is derivative, resulting from the role it plays as the most efficient means of protecting autonomy for individuals and groups. Therefore, the goal of protecting state autonomy form the encroachment of international law will have to be constrained by, and balanced against the more fundamental goal of an international rule of law, the protection of the autonomy of individual persons, best realized through the entrenchment of basic human rights. Prophets are messengers in charge of communicating the orders and prohibitions they received from God. Throughout history, there are those who believe in these prophets as well as those who do not. While the thought rejecting prophethood sometimes manifested itself as a trend, sometimes it came out on a personal basis. For example, the "Berâhime", known to be of Indian origin, and the "Sümeniyya" movement, which has different rumors about its origin, can be given as examples. Again, it can be (...) said that the current of thought emerging under the name of “Deism” serves this purpose. On the other hand, personalities such as Abu Isa al-Verrâq, Ibn al-Rawendi and Abu Bakr ar-Razi, It is known that they objected to the prophethood of the Prophet. Although Ibn al-Rawendi was a scholar of Mu'tezile at first, he later left this idea and put forward mulhidish ideas. In addition to he tried to cancel the Hz Mohammed's prophethood. While Ibn al-Rawendi was doing this, sometimes he emphasized the miracles of the Prophet and sometimes claimed that there were some deficiencies and contradictions in the rhetoric of the Quran. According to Ibn al-Rawendi, there are many contradictory information in the Quran. According to him, unnecessary repetitions, unnecessary prolongation of the word in some places and the presence of non-Arabic origin words show that the Quran is not a miracle book and cannot be described as universal. Qâdî Abdulcabbâr, one of the scholars of Mu'tezile, handled these objections with great care and answered them. The number of such discussions in Kalam sources is quite high. For example, there are such polemics in Imam Mâturîdî's Kitâbü't-Tevhîd and in Bâkillânî's Kitâbü't-Temhîd. In this study, the discussion in the 16th volume of al-Muğnî of Qadi Abdulcabbâr will be discussed. In the aforementioned discussion, Qadı Abdulcabbâr firstly stated Ibn al-Rawendi's objection to the Qur'an, and then duly eliminated this objection. The most striking point here is that Ibn al-Rawendi ignored the features of the Arabic language, the integrity of the Quran and that it has a purpose while making these criticisms. For this reason, while presenting the criticisms, he severed the verses from their contexts, did not consider the before and after, and therefore did not understand or understand the message correctly. Following the formation of disciplines/sciences in different fields of Islamic thought, the specific concepts and terminologies of these disciplines/sciences began to emerge. Then the special meaning and the area of utilization for every concept in each discipline/science were further clarified by compiling specific epistles of definition (ḥudūd), which would contribute to this process of conceptualization. For the terminological meaning of the used concept to be determined primarily and thus for the followed theological/sectarian affiliation to be supported, works belonging to this (...) genre have been written specifically for the field of theology. Especially, the Muʿtazilī theologians undoubtedly made the greatest contribution. Thusly, specific treatises containing theological concepts were compiled by names such as al-Qāḍī ʿAbd al-Jabbār (d. 415/1025), and his students Abū Rashīd al-Nīsābūrī (d. after 420/1029) and Ibn Sharwīn (fl. first half of the Vth/XIth century). Zaydī theologian and jurist Abū’l-Qāsim al-Bustī’s (d. 420/1029) Tahdhīb al-ḥudūd, which has no available copy, is also contemporary to the mentioned works. This tradition found its reflection in the Imāmī-Muʿtazilī line in Abū Jaʿfar al-Ṭūsī’s (d. 460/1067) al-Muqaddimah fī l-madkhal ilá ṣināʿat ʿilm al-kalām, which could be seen as a concise theological work in terms of its construct and the explanations which it comprises, and in the work called al-Ḥudūd wa-l-ḥaqāʾiq, which is attributed to al-Sharīf al-Murtaḍá (d. 436/1044). Abū Jaʿfar al-Muqrī al-Nīsābūrī’s (d. mid-VIth/XIIth century [?]) al-Ḥudūd stands out as the most voluminous example in this tradition. The most important work belonging to this genre in the Muʿtazilī tradition, as it is the first among the available works, is the Ḥudūd al-alfāẓ of al-Qāḍī ʿAbd al-Jabbār, which is found together with some other important Zaydī-Muʿtazilī works in a compilation discovered by us and thought to be lost until recently. In this treatise, which generally includes theological concepts and partially includes the concepts of Islamic law and the history of sects, al-Qāḍī ʿAbd al-Jabbār has put forward a language-based definition theory. His approach here is in line with the views he put forward on definition in his al-Mughnī. Accordingly, instead of definition (ḥadd) and description (rasm) carried out over five universals in classical logic, he adopted a method of lexical definition based on wording that agrees with the meaning of the concept in question and is clearer than it, and consequently gave a brief definition and explanation of the concept he deals with. This clearly shows that the previous Muʿtazilī theologians’ approach of language-based definition, which was used as an alternative to the conception of Aristotelian definition due to their distanced stance to philosophy was also inherited by al-Qāḍī ʿAbd al-Jabbār. The approach seen in some sources in the period following al-Qāḍī, such as Abū Rashīd al-Nīsābūrī’s al-Ḥudūd, also indicates his influence. (shrink)

The work named Fusûlü'l-İmadî, which belongs to Ebü'l-Feth Zeynüddîn el-İmadî, the grandson of Burhaneddin el-Mergînânî, the owner of the famous Hidaye, which includes the subjects of Fürû-i Fiqh and the law of trial, has been one of the main works that has been applied by influencing many mufti, kadi and jurists, especially the Ottoman sheikhs. The work is also important in terms of being a source for many fatawa and fürû-i fiqh works. The fact that the work written in (...) the Fergana region is one of the main sources referenced both in the Ottoman geography and in other Muslim geographies also shows that the work is valuable. In this study, by pointing out the importance and value of the work, it was tried to determine the contribution of the work to the Ottoman period fetâvâ mecmuas and Hanafi fiqh literature. In the study, the life of Ebü'l-Feth Zeynüddîn el-İmadî was mentioned, and his work Fusûlü'l-İmadî was examined in detail. The contribution of the Ottoman Fetvâhâne, which uses Fusûlü'l-İmadî as a source, to some of the fetâva works, which are accepted as one of the most respected fetâva journals, is discussed and some quotations from the work are included with their examples. In addition, the contribution of the work to the Hanafi fiqh literature was examined on the basis of some fürû-i fiqh works of the Ottoman period and the work called Mir'ât-ı Mecelle. Thus, by pointing out the importance of Fusûlü'l-İmadî and his contribution to the literature of fiqh and fatwa, this work was drawn attention to new studies. (shrink)

This chapter examines how the frontier and the changing fate of the region influenced the military system as well as the provincial administration and agrarian regime. It focuses on Vidin in the period of the wars which made it a frontier outpost again, being either directly occupied or under immediate threat. As in many other frontier areas, military activity affected relations between Muslims and Christians in the province and the town of Vidin. This chapter contributes to a better understanding of (...) the complex impact of the wars during the expansion and contraction of the Ottoman state. The discussion is based mainly on documents from the series of kadi sicils, the records of the sharia court in the town, preserved from the last years of the seventeenth century onwards and kept in the Sofia National Library. This article examines the role of normative hierarchies in constitutional argumentation. A threefold distinction between formal, material, and axiological hierarchy is employed. The correlative concepts of formal validity, material validity, and applicability are also briefly described. Within this framework, four cases are analysed: Decisions 1146/1988 and 10/2010 of the Italian Constitutional Court, and Kadi I and Opinion 2/2013 of the Court of Justice of the European Union. As a result, it is argued that axiological hierarchies are frequently used to (...) reshape certain fundamental legal arrangements, namely, the hierarchy of sources (Decision 1146/1988 and Kadi), competence clauses (Decision 10/2010), and interpretive methodologies (Opinion 2/13). Wichtige Aspekte der Spinoza-Rezeption sind lange Zeit im Hintergrund geblieben. Spinoza galt seit dem öffentlich gemachten Bekenntnis des Aufklärers Lessing zum Hen kai Pan als Vertreter einer Substanzenontologie für Atheisten. Friedrich Heinrich Jacobi war es, der 1785 und 1789 eine breite Debatte um Pantheismus, Atheismus, letztbegründende Prinzipien der Metaphysik, ferner um Freiheit und Notwendigkeit auslöste. Spinozas Trieb- und Affektenlehre blieb in der Forschung weitgehend unbeachtet. Weniger lautstark als im ausgehenden 18. Jahrhundert, aber durchaus wirksam, ist Spinoza im 20. und 21. (...) Jahrhundert durch Denker wie Gilles Deleuze oder den Neurologen Antonio Damasio erneut in den Fokus der Aufmerksamkeit geraten. Diesmal ist es Spinozas vormals wenig beachtete Affektenlehre, die für Theorien vom ganzen, nicht bloß vom einseitig rationalen Menschen Interesse weckte. Galt das Interesse der Aufklärung der Rationalität des Denkens, die gegen Aberglauben und Irreführungen der Vernunft ins Recht zu setzen war, so wenden sich das 20. und das 21. Jahrhundert der Entdeckung der Intelligenz und Rationalität der Gefühle zu – zuerst in der Psychologie, bald auch in der Philosophie. Der Band nimmt das neue Interesse an Spinoza zum Anlass zu untersuchen, ob und inwieweit im Deutschen Idealismus, in der Romantik und im 19. Jahrhundert bis heute der andere Spinoza, der Spinoza einer bemerkenswerten Trieb- und Affektenlehre sowie des amor Dei intellectualis, wahrgenommen wurde. This article argues that the existing philosophy of EU law, such as it may be perceived, is flawed. Through a series of propositions it claims that EU law is infected by an underlying indeterminacy of ideal that has deeply affected the appreciation and realization of stated values. These values, the most fundamental of which appear in Article 6(1) of the Treaty of European Union, have been applied in a haphazard fashion and without an understanding of normative content. The European Court (...) of Justice has instead adopted a largely pragmatic approach that has focused on principles or virtues of governance rather than attempting to offer a way of satisfactorily defining values or ensuring their realization. The underlying philosophy thus appears to be based on a theory of interpretation (of original political will) rather than a theory of justice. The recent decision in Kadi paradoxically offers not only confirmation of the argument presented but also a judicial appreciation that a new direction may be desirable, one inspired by a law based on the predominance of fundamental values with particular emphasis on respect for fundamental rights. Resumo O autor defende uma descrição normativa fraca do constitucionalismo internacional à luz de dois factos: a contínua relevância da soberania do Estado face à hegemonia de superpotências e a necessidade imperiosa de um regime supranacional eficaz de direitos humanos. Ao defender uma institucionalização constitucional de direitos humanos, que inclui aspectos de justiça processual e material, mostra-se que, como nos casos domésticos, tal institucionalização pode e, talvez deva, incorporar um procedimento de controlo judicial que ascende ao nível de controlo constitucional. (...) De facto, o parecer do Tribunal Europeu de Justiça no caso Kadi estabeleceu um possível precedente para o controlo do Conselho de Segurança no sentido do cumprimento dos direitos humanos e outras normas peremptórias. Dada a necessidade de perícia técnico legal para a elaboração de tal controlo, um caso prima facie pode ser feito para o estabelecimento de um Tribunal Constitucional especializado ao nível internacional. Contudo, dado o impacto desempenhado pelo poder político na resolução técnica da adjudicação de casos específicos e concretos, dentro de um sistema jurídico altamente fragmentado, e dado o facto de que o controlo constitucional também toca questões mais abstractas e menos técnicos de justiça social, o autor recomenda, que a função de controlo constitucional seja disseminada por várias instituições globais, incluindo a actual Assembleia Geral das Nações Unidas e na esfera pública global. O controlo constitucional pluricêntrico, bem como a institucionalização dos direitos humanos decorre do desacordo multicultural existente acerca do significado desses direitos e da ameaça da hegemonia de superpotências sobre as instituições globais. Assim antecipa-se também a realização de uma constitucionalização mais monista no Direito Internacional com o crescimento da solidariedade global entre os povos. In arguing for a constitutional institutionalization of human rights that includes aspects of procedural and substantive justice, I show that, as in the domestic case, such an institutionalization could and perhaps should incorporate a procedure for judicial review ascending to the level of constitutional review. In fact, the European Court of Justice’s review of the Kadi case establishes a possible precedent for reviewing Security Council compliance with human rights and other peremptory norms. Given the need for technical legal expertise in elaborating such review, a prima facie case can be made for establishing a specialized constitutional court at the international level. However, given the impact that political power plays in the technical resolution of concrete, case-specific adjudication within a highly fragmented legal system, and given the fact that constitutional review also touches on more abstract and less technical issues of social justice, I recommend that the function of constitutional review be dispersed in several global institutions, including the current United Nations General Assembly and a global public sphere. The pluralization of constitutional review and the accompanying interpretation and institutionalization of human rights recognizes existing multicultural disagreement on the meaning of human rights and the threat of superpower hegemony over global institutions while anticipating the realization of a more monistic constitutionalization of international law with the growth of global solidarity between peoples. The theory of the tab' in the physics of Mu 'tazila has a distinct place. It is necessary to distinguish the scholars from the atheist naturalists who adopt the idea of nature. Tab ' theory is a problem with the essence of the entity. This theory is related to the structure of living and inanimate beings. When it comes to the habit and tempering of man, we use the word tab'; it is used the term of nature when it comes (...) to the structure of objects. In particular, the Basra School of Muʿtazila has given the emphasis on tab' theory emphasizing the freedom of man. They have implemented the tab ' theory to a number of topics related to knowledge, action, metaphysical, moral and Spiritual life. The nature, which is defended by Muʻtezile, is a force that Allah places in the nature of man and body. Nature, which is in the essence of both living and inanimate substances, is not independent of Allah. It has caused some problems defending some scholars, such as Muammer and Câhız from Basra School of Muʿtazila the idea of compulsory natural causality in the interpretation of some metaphysical subjects. In this regard, The scholars of Muʿtazila such as Nazzâm and Kâdî Abdülcebbâr, have acted more carefully. While Nazzâm does not see the theory of natural nature independently of divine power, he prefers to use the word "itimat" instead of the tab ' theory ', which he sees as part of pagan culture. Among the Muslims the most common sect is Ḥanafī. It is mentioned in the Ḥanafī sect that there are a line of students who transfer the principles of the sect from generation to generation. In order for the Islamic conquests that started simultaneously in the Eastern and Western lands to be permanent, people were sent to teach Islamic morality, worship and fiqh that encompass daily life. From the 2nd century (A.H.) the sectarianization process that started in the centers such as (...) Kufa, Medina and Damascus has naturally spread to the geography of the West. Many jurists who were educated in the madrasas in the East transferred this education to the newly conquered lands in the West, thus contributing to the fact that sectarianization began in the East and West at the same time. During this period, the views of many mujtahids, including Abū Ḥanīfa and his students, began to enter this geography again through his students. In this article, the most important person who introduced the Ḥanafī sect in the Andalusian region and transferred Abu Ḥanifa's ijtihads, ʿAbdallāh Ibn Farrūkh's life, his scientific personality, his contributions to the spread of the sect and the reasons for the Ḥanafī sect to find supporters in the region will be followed by a short course and the history of the sect will be tried to uncover in the history of Andalusia.Summary: Among the Muslims the most common sect is Ḥanafī. It is not a coincidence that the Ḥanafī sect spread more than other sects and found supporters. Abū Ḥanīfa (d. 150/767) is the most senior among the imams of four leading sects. He experienced about commercial and everyday life, had loyal students. This is because he discussed with his students before deciding on a ruling.Islamic conquests in the east and west started at the same time. Experts teaching Islamic morality were sent to conquered places. In this way, both morality and Islamic law, which encompasses worship and daily life, were also taught. Since the implementation of justice was considered as the main duty of the state, legal affairs were dynamic and systematically organized. For this purpose, both in the Medina and the newly conquered lands, various issues such as, management, use, distribution, non-muslim marriage, trade and so on emerged. These issues were carried out with the "kadi" establishment, which is like today's ministry of justice.In the Hijri 2nd century, Fiqh schools produced practical solutions to matters of process and worship in centers such as, Iraq, Medina and Damascus. These schools completed the sectarianization process after a century. Many Islamic jurists who took madrasah education in the east taught these training in the west. They pioneered the development of this sectarianization process both in the east and the west at the same time.The Islamic jurisprudence solved the problems that emerged with the conquest process that began in Andalusia, primarily through the independent jurisprudence, kadi and muftis in the region. After 710 A.C., the Ḥanafī sect reached Andalusia. After the death of Abū Ḥanīfa, Abu Yusuf became the chief justice. Later, the views of Abū Ḥanīfa gained importance. Abu Yusuf appointed the judges who knew the Ḥanafī sect. Abū Ḥanīfa's students, like a gold mine, embraced the views of their teachers. These jurisprudences were adopted by the supporters. Imam Muhammad was the first to write the case law of Abū Ḥanīfa. The views and thoughts of Abū Ḥanīfa, which were published by Imam Muhammad, spread throughout Iraq, Damascus, Iran and Khorasan. Later these thoughts reached North Africa that was under the control of Aghlabid (A.C. 800-909).In the same era, ʿAbdallāh b. Farrūkh passed to the way 6500 km to learn western sciences. The purpose of Farrūkh is to write the views of his teacher, Abū Ḥanīfa. In this way, he returned to Andalusia by writing ten thousand subjects. Beginning from 767 A.C., Ḥanafī sect gradually began to form in this region. He served as a judge voluntarily, although he did not serve as the official judge. Therefore, it contributed greatly to the spread of this sect in the west. The Mālikī sect, which due to from the animosity of Umayyad (A.C. 661-750) and Abbasids (A.C. 750-1258), came to the forefront. Abdullah b. Ferrûh was not as famous as the other disciples of Abū Ḥanīfa.Although Ḥanafīism spread in the west, it was in the foreground in the eastern geographies. Scholars such as Qadi Ayyad (d. 544/1149), Ibn Farḥūn (d. 799/1397), Muhammad Abū Zahra (d. 1974) and Hintātī state that this sect was effective for a short time in the west. On the other hand, Maqdisī (d. 380/999) states that Ḥanafī existed in Andalusia until the second half of the third century A.C. and was at least as widespread as Mālikīism. Orientalist Lévi Provençal (d. 1956) says that Ḥanafī sect did not reach to Andalusia. However, it can be understood from the above statements that this view is not real. In addition, according to the student hierarchy described in the article, it is understood that the Ḥanafī sect maintained its existence in this region for a while. In Andalusia, the views of the sect from the 8th to the 13th centuries known, recognized and followed by experts and the public. Because this sect was not official, its books were not in demand. For this reason, the basic works belonging to the sect were not reproduced.It is not true that the Ḥanafī sect never came to Andalusia or did not stay for a long time. ʿAbdallāh b. Farrūkh, who studied at Abū Ḥanīfa for 5 years, introduced Ḥanafī sect in Andalusia. Then his students continued this teaching. In this study, the life, mastery and students of ʿAbdallāh b. Farrūkh, who made important contributions for the first time in teaching Ḥanafīsm's to Andalusia, have been brought together. This information is summarized in terms of Ḥanafīsm's entry into Andalusia, the reasons for acceptance in social life and the duration of the sect in the region. (shrink)

This work deals with Mollā Gūrānı̄’s critique (d. 813/1488) of Qāḍı̄ al-Bayḍawı̄ (d. 596/1200) and Zamakhsharı̄ (d. 538/1144). The Fātiḥ̣a and Baqara sūras in his manuscript tafsı̄r “Ghāyat al-Amānı̄” are chosen as the texts to examplify Mollā Gūrānı̄’s critique. His criticism is mostly related to language, qirāʾa (recitation and vocalization of Qur’ānic text), conceptual meaning and disagreement in interpretations of the Qur’ānic verses in question. Gūrānı̄ primarly criticisez Qāḍı̄ due to his reputation among Ottoman scholars. Guranı̄ has not only criticized (...) Kādı̄ and Zamahsharı̄ in the commentary of the surahs Fātiḥ̣a and Baqara but also Taftāzānı̄ and Kavāshı̄. This clearly shows thah he is a well-versed scholar in researching especially in comperative analysis. In this study, our investigation is limited to, however, Zemakhsharı̄ and Qāḍı̄. This stuyd shows that Zemakhsharı̄ is strictly bound to Ahl al-Sunnah. Moreover, the hadith reports are considerably important for him in understanding and interpreting the Qur’ānic verses. He closely follows the interpretive traditions of early Muslim scholars, especially on the matters that Muslim scholars had an argeemnet.Summary: This study discusses the criticism of Mollā Gūrānı̄ (d. 813/1488), one of the Ottoman commentary scholars, against Qāḍı̄ al-Bayḍāwı̄ (d. 685/1286) and Zamakhsharı̄ (d. 538/1144). The two Qur’ānic Surahs Fātiḥ̣a and Baqara are chosen from his critiques in a manuscript of his commentary called Ghāyat al-Amānı̄. Mollā Gūrānı̄’s manuscript is registered in Sulaymāniye Library, Dāmād Ibrāhı̄m Pasha Section at number 146 and consists of 352 pages in total. This copy is one of the oldest among other its existent copies. The main reason of our preference of this copy is that it is both legible and at the end of the book (the farāgh part), it writes that it was proofread by his author himself and that handwriting notes at the margins of the pages belonged to the author. We have examined this copy by comparing another copy which is again in the Sulaymāniye Library, Haji Maḥmūd Efendı̄ section at number 162, consisting of 484 pages in total, comparatively. We have examined critiques of 41 verses in total from Fātiḥ̣a and Baqara surahs.Gūrānī’s critiques of Zamakhsharı̄ and Qāḍı̄ are too wide to be discussed within the limits of an article. Therefore, we have tried to briefly introduce these critiques. While presenting the commentators views, we tried to make their inexplicit expressions clear and furthermore elaborate their purposes by making use of some other resources. We have to say that we also used bracketed explanatory statements while giving commentators opinions.Most of the critiques of Gūrānı̄ are aimed at Qāḍı̄ since the latter’s commentary was one of the favourite ones among Ottoman intellectual circles. Therefore, in writing his commentary manuscript, Gūrānı̄ ambivalently both followed and criticized Qāḍı̄’s commentary. When Fātiḥ̣a and Baqara surahs are used as a base, it is evident that Gūrānı̄’s commentary Ghāyat al-Amānı̄ is a reason-based (dirāyah) in line with those of Zamakhsharı̄ and Qāḍı̄ as commentary methodology. Gūrānı̄ modelled himself so much on Qāḍı̄ in this commentary of his that it seems as an abridged copy of Qāḍı̄’s. Ghāyat al-Amānı̄ as a commentary example of Ottoman era shows that the commentary methodology of the time did not change even four hundred years after Zamakhsharı̄.It is possible to say that Gūrānı̄ criticized Zamakhsharı̄ and Qāḍı̄ in this commentary in a meticulous manner. Although many of his critiques are disputable, his rigorous approach to texts and his courage of critique, instead of imitative attitude, of Qāḍı̄’s commentary, which was held in high esteem in madrasahs of the time, and of commentary of Zamakhsharı̄, who was competent in Arabic language, is of great significance. Gūrānı̄ used a comparative scientific methodology and was a prominent. When his commentary manuscript examined it can be seen that it was not only Zamakhsharı̄ and Qāḍı̄ but also Taftāzānı̄ (d. 792/1390) and Kavāshı̄ (d. 680/1281) who got their shares from his critiques. Most of Gūrānı̄’s critiques were on the subtleties of Arabic language. He sometimes expressed his criticism using Arabic grammar rules and sometimes rhetoric requirements. His other critiques involved topics such as, conceptual meaning, verses integrity, recitation and some interpretations of verses that he disagreed with. His critical method was based on the integrity of the Qurʾān, interpretive traditions, Salaf’s views and logical contradictions. We ought to mention that Gūrānı̄ showed his strong commitment to his predecessors and scholars for matters on which they had consensus. We comprehend this commitment on occasions when he rejected the claim that, for instance, a given form of qirā’a from Salaf was wrong according to Arabic grammar in favour of Salafı̄ reciter. The aim of this study is to give an idea about commentary understandings and methods of commentators in Ottoman era and to make contribution to introducing Gūrānı̄, who criticized Zamakhsharı̄ and Qāḍı̄, two prominent commentators competent in their field, to researchers in terms of his attribute as a critic. An earlier study on his critiques made in this commentary of Gūrānı̄ only covered his critiques of Qāḍı̄ for some of his interpretations in Fātiḥ̣a and Baqara surahs. Therefore, another important factor leading to this study was to cover all critiques he made against the views and comments of both Zamakhsharı̄ and those shared by Zamakhsharı̄ and Qāḍı̄. Hence, this study aims to contribute to the fiedl as an analytical study or a translation made by researchers on this concise and handwritten manuscript.Some conspicuous features are seen in Gūrānı̄’s critiques. As he pointed out in his reviews, in case of subjects with availability of narratives (rivāyah) and of suitability of the literal meaning of verses, he did not prefer allegorical interpretation. He gives the impression that he based his reviews on Ahl al-Sunnah, and he took pains to follow Ashaʿrı̄te school of thought. Although Gūrānı̄, did not see harm in sharing the same things with Zamakhsharı̄, opposing Qāḍı̄ as regards Arabic language, he was always in opposition with Zamakhsharı̄ in relation to commitment to sectarian view and Ḥadı̄ths. It can also be said that Gūrānı̄ did not favour esoteric-allusive commentary style.It can also be said that Gūrānı̄ had sound and deep knowledge in the field of Kalām. This can be deduced from his considering Qāḍı̄’s arguments to criticize Muʿtazila as insubstantial and sometimes from his criticism of Qāḍı̄ for his careless selection of phrases he used in theological issues. Meanwhile, Gūrānı̄ criticized some views which did not belong to Qāḍı̄. For example, it is seen that he criticized Qāḍı̄ for his citation of an opinion through the phrase “it is said that” as if it was his own view by writing an annotation on the margin that it was Qāḍı̄ who said it. In our opinion, the most important thing that the critique of Gūrānı̄ shows is his scholarly identity and his outspoken character of enunciating of what he believed scholarly and conscientiously. The Hanafi Sect was the first among the fiqh sects that completed its formation and codification. Abu Hanifa, the founding imam of the sect, raised many students. His most prominent students were Abu Yusuf, Muhammed al-Shaybani and Zufar. While teaching his students, Abu Hanifa created a free environment and was pleased that his students adopted opposing views to his. Accordingly, different views emerged among the imams in question for reasons such as interpreting the texts, taking into account the changes in (...) customs and time, and approaching the issues from different perspectives. After the death of Abu Hanifa, Abu Yusuf served as a kadi, i.e. a judge. Muhammad al-Shaybani played an important role in the formation of the sect. Zakat is one of the subjects where different opinions and disagreements occurred among the imams of the madhhab, or sect. Hanafi books exhibited different approaches in revealing these differences of opinion. For example, there were jurists who mentioned and discussed their differences of opinion in detail, as in Ka-sana’s work Bedai al-sanai fi tertib al-sharai, as well as in Mawsili’s work el-Ihtiyar li-talil al-Muhtar. There were also jurists who took a middle way on the subject. In this study, the differences of opinion of the sect imams Abu Hanifa, Abu Yusuf, Muhammed al-Shaybani and Zufar on zakat will be explained based on the book al-Hidaye by Burhaneddin al-Merginani, which is one of the most popular books of the Hanafi sect. However, the commentaries of al-Hidaye and the books of the sect on fiqh will also be consulted occasionally. Bişr el-Merîsî taraftarları ile Osman ed-Dârimî arasında burada tartışma konusu yapılan hadisler haberî sıfatları konu alan ve müşkil nitelikte olan rivayetlerden oluşmaktadır. Bu rivayetleri genelde Bişr el-Merîsî ve taraftarlarının tecsîm ve teşbîh içerdiği iddiasıyla münker kabul ettikleri görülmektedir. Ehl-i re’y özellikleri taşımakla birlikte ilahî sıfatlar konusunda Mu’tezilî bir anlayışa sahip olduklarından tenzih anlayışları gereği sıfatları reddetmektedirler. Yaratılmışlara ait niteliklerin yaratıcıya nisbet edilmesini tenzîh anlayışlarına aykırı gördüklerinden bu tür müşkil rivayetleri ya kendi anlayışları doğrultusunda te’vîl ya da reddettikleri gözlenmektedir. Sert bir (...) ehl-i hadîs âlimi olan Osman ed-Dârimî ise, ayet ve hadislerde bildirilen ilahî sıfatlara iman edilmesi gerektiğini kabul etmektedir. Bu anlayışı sebebiyle bu rivayetlerde bildirilen haberî sıfatlara da te’vîl etmeksizin lafzî anlamıyla yaklaşmakta; kendi görüşü doğrultusunda Bişr el-Merîsî ve taraftarlarının yaptığı te’vîlleri reddetmekte, bu te’vîllerin ta’tîle yol açacağını ileri sürmektedir. Bu rivayetlerin lafzî (literal) anlamları doğrultusunda anlaşılması gerektiğini savunmaktadır. Bu hadisler üzerinde yapılan tartışmalar, temel hadis eserlerinin yazıldığı dönemde Ehl-i re’y ve Ehl-i hadîs ekollerine mensup âlimlerin hadislere yaklaşımlarını göstermesi bakımından önem arzetmektedir. Burada vermiş olduğumuz hadisler üzerindeki tartışmalar bu iki ekolün uluhiyet anlayışını, haberî sıfatlara yaklaşımlarını ortaya koyduğu gibi bunların genel anlamda hadis perspektifi hakkında bizlere bilgi vermektedir.ÖzetBu araştırma, temel hadis kitaplarının yazıldığı dönemde, yani III./IX asırda, haberî sıfatlar ihtiva eden bazı hadisler üzerinde yapılan tartışmaları ele almaktadır. Tartışma Osman ed-Dârimî (ö. 280/894) ile Bişr el-Merîsî’nin (ö. 218/833) taraftarları arasında geçmektedir. Hadisler üzerinde Ehl-i hadîs ile Ehl-i re’y mensubu âlimler arasında gerçekleşen bu tartışmalar bir yönüyle hadislerin anlaşılması ve yorumlanmasını ilgilendirmektedir. Tartışmanın, burada ele alınan hadislerin nasıl anlaşılması gerektiği; lafızların kelime anlamı mı (literal) yoksa bu lafızların ötesindeki muhtemel mecazî anlamları dikkate alınarak mı anlaşılması gerektiği noktasında odaklandığı söylenebilir. İnceleme konusu yapılan hadisleri tartışan tarafları kısaca tanıtmak yerinde olacaktır. Sözünü ettiğimiz rivayetlerle ilgili tartışmalar Bişr el-Merîsî taraftarları ile Osman ed-Dârimî arasında geçmektedir. Ehl-i hadîs’in önemli simalarından biri olan Osman ed-Dârimî, hadislerle ilgili bu tartışmaları içeren ayrı bir eser yazmıştır. Bu eser, Allah’ın sıfatları ve bazı hadis meseleleri konusunda Bişr el-Merîsî ve onun iki talebesinin görüşlerine reddiye olarak yazılmıştır. Bişr el-Merîsî, Ebû Yusuf’tan (ö. 182/798) fıkıh tahsil etmiş, önemli bir kelâmcı olarak tanınmıştır. O, kelâmla ilgili konularda aralarında İmâm Şâfiî’nin (ö. 204/820) de bulunduğu pek çok âlimle ilmî tartışmalar yapmış bir ehl-i re’y âlimdir. Halife Me’mûn’un (ö. 218/833) danışma meclisinde bulunmuş, Kur’ân’ın yaratılmışlığı (Halku’l-Kur’ân) görüşünün benimsenmesinde önemli payı olmuştur. Osman ed-Dârimî ise, Yahyâ b. Ma’în (ö. 233/848), Ali b. Medînî (ö. 234/848-49), İshâk b. Râhûye (ö. 238/853) ve Ahmed b. Hanbel (ö. 241/855) gibi döneminin otoritelerinden hadis öğrenmiş bir ehl-i hadîs âlimidir. Hadis tahsili için önemli bütün şehirleri dolaşarak hadis öğrenmiş ve rivayette bulunmuştur.Haberi sıfatları ispat ve bunlarla ilgili rivayetlerin teviline karşı çıkan anlayış ile, bu rivayetlerin tenzih anlayışına uygun biçimde tevilini savunan kesimler ilk dönemden itibaren eserler telif etmişlerdir. Osman ed-Dârimî’ye göre, ehl-i hadîs’in eleştiri edebiyatının ortaya çıkmasında, Mu’tezile’nin ilahî sıfatları reddetmesi etkili olmuş ve pek çok müellif bu yönde eserler yazmışlardır. Ebû Hüreyre’den nakledilen bir rivayetle ilgili olarak muârız, bu rivayetin Allah için bildiğimiz göz ve kulak organlarından oluştuğu izlenimi verildiğini söyler. Osman ed-Dârimî, bu hadisin göz ve kulak organlarını değil görme ve işitmeyi ispat ettiğini söyler. Hiçbir konuda Allah’ın benzerinin bulunmadığını belirtir. Dolayısıyla Allah’ın organlardan oluştuğu iddiasını ehl-i hadîs’e nisbet etmek iftiradır. Ebû Dâvûd, bu hadis ile Allah için görme ve işitme sıfatlarının ispat edildiğini ve Cehmiyye’nin ilahî sıfatları inkar görüşüne reddiye olduğunu belirtir. Ebû Hüreyre’in Hz. Peygamber’e nispet ederek naklettiği: "İman Yemenlidir, hikmet Yemenlidir! Ben Rabbi’nizin nefesini Yemen tarafından hissediyorum!" rivayetini de muârız münker kabul etmiştir. Çünkü Bişr el-Merîsî ve ashâbına göre nefes ancak karın boşluğu olanlardan çıkar, Allah ise bundan münezzehtir. Osman ed-Dârimî’ye göre, muârız yanlış anlamıştır. Burada kastedilen, Yemen tarafından esen ve insanı rahatlatan rüzgardır. Bu rivayet bağlamında bakıldığında, Bişr el-Merîsî taraftarlarının rivayeti literal değerlendirdiğini, Osman ed-Dârimî’nin ise rivayeti yorumladığını görmekteyiz. İbnü’s-Selcî, "Siz, Allah’a ondan çıkandan (Kur’ân’dan) daha faziletli bir şeyle yaklaşamazsınız!" rivayeti hakkında, Müşebbihe’nin bunu, karın boşluğu olan, kendisinden kelâm çıkan şeklinde anladıklarını belirtir. Allah boşluğu olmayan anlamında "samed" olduğundan bu anlayış geçersizdir. Bu hadisle, Kur’ân’ın Allah’tan değil O’nun katından çıkması kastedilmiştir. Osman ed-Dârimî’ye göre, İbnü’s-Selcî’nin asıl maksadı Allah’ın kelâm sıfatını inkâr etmektir. Kur’ân’ın O’ndan çıktığında bir şüphe yoktur, bunu sadece kelâm sıfatını kabul etmeyenler inkâr etmektedir. İbn Abbâs’a atfedilen; "Rükn (Hacerülesved) yeryüzünde Allah’ın sağ elidir, halk ile onunla musafaha eder" rivayetinde geçen "yemînullah" (Allah’ın sağ eli) sözünün anlamı, İbnü’s-Selcî’ye göre bildiğimiz sağ el değil, Allah’ın nimeti ve ikrâmıdır. Hacerülesved ile elin kastedilmediğini kabul eden Osman ed-Dârimî’ye göre, İbnü’s-Selcî’nin maksadı, geçersiz te’villerle Allah hakkında ayet ve hadislerde belirtilen iki eli inkar etmektir. İbn Abbâs’ın Hz. Peygamber’den naklettiği başka bir rivayeti İbnü’s-Selcî’nin eserine alıp nakletmesini eleştiren Osman ed-Dârimî, bu tür zayıf rivayetlerin yayılmaması gerektiğini söyler. Buna ilave olarak İbnü’s-Selcî’nin yaptığı yorumun da çirkin olduğunu belirtir ve eleştirir. Çünkü sözü edilen rivayette Allah, yeşil bir takım elbise giymiş kıvırcık saçlı bir genç olarak tasvir edilmektedir. Böyle bir rivayet Hz. Peygamber’den gelen sahih rivayetlerle çeliştiği için de güvenilmez bir rivayettir. Rivayetle ilgili bu değerlendirmeyi yapan Osman ed-Dârimî, rivayet hakkında muârızın yaptığı yorumları da reddeder. Muârıza göre, "Rabbimin yanına girdim" sözü, "Adn cennetinde Rabbimin huzuruna girdim" demektir. Osman ed-Dârimî’ye göre bu gibi müşkil (problemli) hadisler re’y ile tefsir edilmemeli, rivayet edilip bırakılmalıdır. Hz. Peygamber’e dayandırılan ve Allah’ın kendisine geldiğinden bahisle cevabını bilemediği bazı sorulan sorduğundan, sonra Rabbinin elini sırtına koymasıyla parmaklarının serinliğini hissettiğinden ve her şeyi öğrendiğinden bahseden rivayetle ilgili olarak muarız şu değerlendirmede bulunur: Allah Resûlü’ne gelen Rabbi değil güzel suretli bir melekti, o melek Allah tarafından yönledrilmekteydi ve elini koyan da o melekti. Osman ed-Dârimî, muârızın bu yorumunu reddeder. Bu yorum aynı zamanda diğer sahih hadislere de aykırıdır. Osman ed-Dârimî, sözkonusu rivayet hakkında muârızın yorumunu reddettikten sonra zikrettiği sahih rivayetlere dayanarak buna güvenilemiyeceğini ifade etmiştir. İlahî sıfatlar hakkında konuşmak en zor konular arasında görüldüğünden, selef âlimleri bu konuda susmayı tercih etmişlerdir. Ancak sonraki nesiller bu konuda farklı yollar tutmuşlardır. İlahi sıfatları anlama konusundaki temel yaklaşımları tefvîz, teşbîh ve te’vîl şeklinde üç ana başlıkta toplamak mümkündür. Tefvîz, selef alimlerinin benimsediği yol olup, Allah’ın zâtı ve sıfatlarının mahiyetine ilişkin bilgiyi ilâhî ilme havale etmek demektir. Teşbîh, Allah’ı yaratılmışlara veya yaratılmışları Allah’a benzetmek anlamına gelir. Te’vil, Allah’ın yaratılmışlara benzediği izlenimini veren ayet ve hadisleri dil bilimi ve aklî bilgilerle yorumlamaktır. Sıfatları inkar edenlere Muattıla denilmiş, sıfatları ispat edenler Sıfâtiyye diye anılmıştır. Ehl-i re’y’e göre Allah’a atfedilen ve sözlük anlamı bakımından teşbîh ve tecsîm izlenimi veren sıfatları uygun biçimde te’vil etmek gerekir. İlâhî sıfatlarda Mu’tezile tenzihi öne çıkarmış, Eş’ariyye ve Mâtürîdiyye ise tenzihe uygun te’vili benimsemiştir. Müşebbihe, Vehhâbî-Selefî anlayış da ilahî sıfatlardaki lafızları zahiri anlamlarıyla almışlardır. Hadis ilminde en önemli temel eserlerin telif edildiği II./VIII. ve III./IX. asırda yaşamış olan âlimler arasında cereyan eden inceleme konusu yaptığımız tartışma, ilk döneme ait olması bakımından önemlidir. Bunun yanında tartışma, âyet ve hadislerden oluşan naslara yaklaşımda, iki temel yaklaşımı göstermesi bakımından da önemli bilgiler ihtiva etmektedir. Bu iki temel yaklaşımdan biri ehl-i re’y ekolünü, diğeri ise Ehl-i hadîs anlayışını temsil etmektedir. Osman ed-Dârimî genel olarak rivayetin lafzına bağlı kalmayı savunmakta, Bişr el-Merîsî ve ashâbı ise münker olduğu gerekçesiyle rivayeti eleştirmekte ya da te’vil etmektedir. Nadir de olsa Osman ed-Dârimî’nin rivayeti ret ya da te’vil ettiği, Bişr el-Merîsî ve ashâbının ise rivayeti savunduğu yerler de görülebilmektedir. Müteşâbih (problemli) rivayetler hakkında Bişr el-Merîsî’nin yaptığı te’viller sonraki âlimler üzerinde etkili olmuştur. Onun te’villeri, Cübbâî (ö. 303/916), Kādî Abdülcebbâr (ö. 415/1025), Ebü’l-Hüseyin el-Basrî (ö. 436/1044) gibi Mu’tezilî âlimlerin yanı sıra, İbn Fûrek, Gazâlî (ö.505/1111), İbn Akîl (ö. 513/1119), Fahreddîn er-Râzî (ö. 606/1210) gibi sünnî âlimler tarafından da iktibâs edilmiştir. Rivayete dayalı olan hadis ilminde hakikatin ortaya konulabilmesi, "rivayet" ve "re’y" seçeneklerinden birini tercih etmekle değil; bunların her ikisini de yerinde ve dengeli olarak kullanılmasına bağlı olduğunu hatırda tutmak gerekir. Hakikatin ortaya çıkarılmasında rivayet re’ye, re’y de rivayete muhtaçtır. Rivayet ve re’y birbirinin rakibi değil tamamlayıcı unsurları olarak görmek gerekir. (shrink)

Osmanlı dönemi şairi Ahmed el-Behlûl, şairlik yönünün yanı sıra Akâid sahasında Durretu’l-‘Akâi’d, Fıkıh sahasında el-Mu‘ayyene ve el-‘Izziyye ve Arap Dili ve Edebiyatı sahasında el-Makâmetu’l-Vitriyye gibi eserleri telif ederek çeşitli sahalarla ilgilenmiş bir âlimdir. Behlûl, ed-Durru’l-Asfâ ve’z-Zebercedu’l-Musaffâ fî Medhi’l-Mustafâ ismiyle meşhur divânını tamamıyla Hz. Muhammed’i medhe tahsis etmiştir. Başta Libya olmak üzere Kuzey Afrika’da meşhur olan Divan, Kâdî ‘İyâz’ın (...) el-‘Iyâdiyye isimli manzumesine yazılmış bir tahmis olup Arap alfabesinin 29 harfinin her biriyle başlayıp beşlemelerin sonlarını da yine aynı harfle bitirdiği 29 kasideden oluşur. Şair, divanında Hz. In the 16th century Ottoman judicial system, there is a type of kadi which is mentioned as a land judge in both Rumelia and Anatolian provinces. The territorial judgeship, which is subject to different evaluations in terms of its nature, has been handled as a mobile kadi in charge of inspection by Ottoman historians since İsmail Hakkı Uzunçarşılı. Recently, some legal historians have put forward the idea that the land judge is a local judge. For this reason, first (...) of all, current discussions in the literature are discussed. It is focused on when and how the term land kadı was used in Ottoman records. Based on the documents, the different characteristics of these kadis were examined. Evaluation was made about the duties and responsibilities of the edicts sent from the center and it was determined how much this issue overlaps with the duty of the district/town kadis. It has been examined within the framework of archive records, fatwa books, kadi registries and the laws issued in the relevant periods over a period of about two centuries. As a result of the examinations made, it was concluded that the term land judge is not an independent kadi, but rather the kadi of the place where the events took place. (shrink)

Dervish lodges and cults were among the important elements of the Ottoman social life and in those times, they had spread to nearly all city centers, towns and villages. Dervish lodges served as non-formal educational institutions for people from all ages and all segments of the society. In addition to education, these structures also played important roles in political, economic, social and military life of the Ottoman Empire. In general, wise people and scholars contributed to the development and dissemination of (...) Islamic sciences in general, and specifically, mystic thought. As a matter of fact, it was determined that there were a great number of Dervish lodges that were founded or supported by shaykh al-Islam (the chief justice), kādī (judge), scholars and mudarrisīn (teachers) in the history of sufism. One of them was Mullah Çelebi Dervish Lodge, which was founded in the 16th Century by Mehmed Vusuli Efendi, who belonged to the Ilmiya class (d. 998/1590). Until today no detailed studies have been conducted on lodges, which continued their existence until 1925. For this reason, this article will be the first study that deals with the dervish lodges in the light of archive sources. In this article, which was written to shed light on the course of our sufi cultural history, the prominent names, shaykhs and physical status of the Dervish lodges, especially Mehmed Vusuli Efendi, who was the founder of these lodges, will be dealt with.Summary: Our country, which hosts scientific moral centers like dervish lodges, school, madrasa and masjids, has a rich historical cultural treasure. As it is already known, the above-mentioned institutions had an important place in the life of Ottoman social life. Dervish lodges and madrassas were considered as science and wisdom centers because there is no distinction between zāhir (exterior) and bātin (interior) in our tradition. Under then-present conditions, the institutions that were needed most were supported. In this sense, the sultans and scholars cared about the dervish lodges, which were the places where sciences were studied contributing to the construction of these structures. One of these was Mullah Çelebi Dervish Lodge, which was founded in the center of Eyupsultan by the Ottoman man of letter, poet and scholar, Mehmed Vusuli Efendi (d. 998/1590).Mullah Çelebi Dervish Lodge is located in the Debbaghane/Tabakhane (Tannery) district in the center of Eyupsultan. As Suleyman Çelebi stated, “the valiant ones worked in the Tannery”. For this reason, it is possible to say that there were tanners among the disciples and followers of Mullah Çelebi Dervish Lodge.Mullah Çelebi Dervish Lodge was built by Mehmed Vusuli Efendi, who belonged to the scholar class in the Ottoman Empire. Mehmed Vusuli Efendi, who served as a professor in various madrasahs, served as a kādī in cities like Konya, Kutahya and Istanbul. Mehmed Vusuli Efendi was called “Mullah” because of his madrasah origin and “Çelebi” because of being a member of the scholar class. For this reason, dervish lodge in question was known as Mullah Çelebi Dervish Lodge in his honor. Sources mention the religious, knowledgeable and modest personality of Mehmed Vusuli Efendi. In this sense, the establishment of a dervish lodge by someone from the scholar class is important in terms of being a sign of the togetherness of dervish lodges and madrasahs in the Ottoman Empire. In addition to his scientific personality, Mehmed Vusuli Efendi was also an important figure who wrote works both as prose and as poetry, and made some translations into Turkish. In addition to the Dervish Lodges mentioned here, Mehmed Vusuli Efendi also established mosques and public baths in various places in Istanbul and was interested in charity works. Cemaleddin Server Revnakoglu stated that he was given the nickname “FındıklıÇelebi” because he had established a mosque in Fındıklı District.Mehmed Vusuli Efendi was the son-in-law of Aise Hubbi Hatun (d. 997/1589), who was one of the lady poets of the 16th century divan literature. Aise Hubbi Hatun was the granddaughter of Kanuni Sultan Suleyman’s foster brother Yahya Efendi from Beşiktaş. Aise Hubbi Hatun was also the wife of Semsi Çelebi, who was one of the grandchildren of Aksemseddin. In this sense, Aise Hubbi Hatun was a person who served in the palace during the reign of Selim II. According to the sources, Mullah Çelebi was appointed to a post that was as high as being the kādī of Istanbul with the help of Aise Hubbi Hatun, who was one of the prominent figures of the palace. For this reason, Mehmed Vusuli Efendi was also known as “Hubba/Hubbi Mullah”.In the present study of ours on Mullah Çelebi Dervish Lodge, one of the most prominent lady poets was Serife Zubeyde Fitnat Hanım (d. 1194/1780). In the sources, some authors discussed whether Fitnat Hanım’s tomb was in Mullah Çelebi Dervish Lodge. Since there is no inscription on it, the tomb of Mehmed Vusuli Efendi was assumed to belong to Fitnat Hanım. Actually, in the past, Istanbul Tombs and Museums Directorate hung a plate saying that the tomb in question belonged to Fitnat Hanim. However, Bilgin Turnalı revealed that the tomb of Fitnat Hanım was not in the Mullah Çelebi Dervish Lodge in his article with the title “The Tomb of the Poet Fitnat Hanım”.The archive sources, which we can examine on Mullah Çelebi Dervish Lodge, generally belong to the 18th century and onwards. For this reason, the information on the establishment years of the Dervish Lodge was not determined fully. However, some of the archive sources reported some revenues of Mullah Çelebi Dervish Lodge. For example, it was recorded in the archives that payments were made to this Dervish Lodge in Muharramiya activities. As it is known, ceremonies were held in the Ottoman Palace in the month of Muharram, which was the initial month of the Hijri calendar, and a number of people and institutions in Istanbul and its surroundings were paid by the Sultan under the name of “Muharramiyya”.In Mullah Çelebi Dervish Lodge, there were some prominent shaykhs like Mahmud Efendi and Nureddin Efendi. For example, since Mahmud Efendi had a lot of influence on the lodge, it was named after him for a period of time. Another prominent shaykh in the above-mentioned dervish lodge was Nureddin Efendi. As a matter of fact, he was closely interested in the maintenance and repair works of the dervish lodge and the activities related to the cults, and applied to Evkāf-i Humāyūn many times for repair works. Mehmed Esref Sabri Efendi, who was the shaykh before the last one in this dervish lodge, contributed to the training of many people of cult, especially Saadeddin Ceylan, who was the shaykh of Haki Baba Lodge. The last shaykh of Mullah Çelebi Dervish Lodge was Hafiz Hussein Kamil Efendi, who was the son-in-law of Mehmed Esref Sabri Efendi.When the physical condition of Mullah Çelebi Dervish Lodge is examined, it is understood that it was ruined in some periods in the history due to erosion; and for this reason, it had renovations. It was determined that Mullah Çelebi Dervish Lodge, which belonged to the Kadiriyye cult, remained until the last period of the Ottoman Empire; however, after the closure of the dervish lodges in 1925, it disappeared rapidly. In our present day, two tombs that belong to Mehmed Vusuli Efendi and Aise Hubbi Hatun and a graveyard where the members of the lodge were buried are left behind from this Dervish Lodge. As it is known, Dervish Lodges had an important place in the religious, scientific, political and economic life of the Ottoman society. In this article, which was planned to examine the Ottoman sufi culture, the historical course of Mullah Çelebi Dervish Lodge, its founder, shaykhs, physical location, etc. were discussed in the light of the archive sources.
