Un premier ouvrage proposait d'étudier si l'approche de la qualité d'une œuvre par 1' (c effet de vie ", invariant mis en évidence par Marc-Mathieu Münch pour le domaine littéraire, s'applique à la musique : Musique et effet de vie ; puis le corollaire le plus (...) important de l'effet de vie, la "cohérence", en élargissant du texte à la musique et de la littérature aux arts : Arts, Langue et cohérence. La troisième rencontre scientifique, organisée par le Réseau Asie-Imasie (CNRS/FMSH) et l'Observatoire musical français (OMF) de l'université Paris-Sorbonne, posait que l'impulsion créatrice provenait du jeu, par hasard ou dans l'inconscient. Il semblerait que le surgissement créateur se produise dans un entre-deux, le va-et-vient entre l'inconscient et le conscient ou le basculement de l'intuition en intention, voire un entre-trois quand le hasard s'en mêle. A new theory about the origins of consciousness that finds learning to be the driving force in the evolutionary transition to basic consciousness. What marked the evolutionary transition from organisms that lacked consciousness to those with consciousness—to minimal subjective experiencing, or, as Aristotle described it, “the sensitive soul”? In this book, Simona Ginsburg and Eva Jablonka propose a new theory about the origin of consciousness that finds learning to be the driving force in the transition to basic consciousness. Using (...) a methodology similar to that used by scientists when they identified the transition from non-life to life, Ginsburg and Jablonka suggest a set of criteria, identify a marker for the transition to minimal consciousness, and explore the far-reaching biological, psychological, and philosophical implications. After presenting the historical, neurobiological, and philosophical foundations of their analysis, Ginsburg and Jablonka propose that the evolutionary marker of basic or minimal consciousness is a complex form of associative learning, which they term unlimited associative learning (UAL). UAL enables an organism to ascribe motivational value to a novel, compound, non-reflex-inducing stimulus or action, and use it as the basis for future learning. Associative learning, Ginsburg and Jablonka argue, drove the Cambrian explosion and its massive diversification of organisms. Finally, Ginsburg and Jablonka propose symbolic language as a similar type of marker for the evolutionary transition to human rationality—to Aristotle's “rational soul.”. (shrink)

We discuss the evolutionary transition from animals with limited experiencing to animals with unlimited experiencing and basic consciousness. This transition was, we suggest, intimately linked with the evolution of associative learning and with flexible reward systems based on, and modifiable by, learning. During associative learning, new pathways relating stimuli and effects are formed within a highly integrated and continuously active nervous system. We argue that the memory traces left by such new stimulus-effect relations form dynamic, flexible, and varied global sensory (...) states, which we call categorizing sensory states . These CSSs acquired a function: they came to act as internal “evaluators” and led to positive and negative reinforcement of new behavior. They are therefore the simplest, distinct, first-person motivational states that an animal can have. They constitute what we call basic consciousness, and are the hallmark of animals that can experience. Since associative learning has been found in many invertebrate taxa that first appeared during the Cambrian era, we propose that the processes underlying basic consciousness are phylogenetically ancient, and that their emergence may have fueled the Cambrian explosion. This is the first of two papers in which we propose an evolutionary route for the transition from sensory processing to unlimited experiencing, or basic consciousness. We argue that although an evolutionary analysis does not provide a formal definition and set of sufficient conditions for consciousness, it can identify crucial factors and suggest what evolutionary changes enabled the transition. We believe that the raw material from which feelings were molded by natural selection was a global sensory state that we call (...) overall sensation, which is a by-product of the incessant activity of the highly interconnected nervous systems that characterize all neural animals. We argue that global sensory states generated limited experiencing once they became coupled to the simplest kinds of nervous-system-mediated learning, a coupling that occurred in the most ancient taxa of neural animals, which were similar to present-day cnidarians and ctenophores. In such animals, limited experiencing involves a small number of persistent global sensory states. These sensory states, however, do not have a function and do not act as motivational states. As we argue in the next paper, with the evolution of associative learning they evolved into systems that gave animals basic consciousness. (shrink)

En matière de méthodologie, les juristes ont le plus souvent eu pour réflexe de se réapproprier des modèles provenant d'autres champs de savoir. Cette attitude présente plusieurs difficultés. Elles reposent tout d'abord sur une part de fiction. Les juristes ne sont ni des mathématiciens, ni des physiciens, ni des biologistes, ni des historiens, ni encore des sociologues. Tout au mieux font-ils comme s'ils Tétaient. Par ailleurs, bien que les réappropriations méthodologiques opérées visent fréquemment à ériger le savoir juridique au rang (...) de science, cette prétention n'est pas exempte d'ambiguïtés, ni de malentendus. Cela tient essentiellement au fait que, dans le domaine juridique, il existe deux niveaux de langage, à savoir le langage du droit lui-même et le langage du savant qui l'appréhende. Du point de vue d'une méthodologie analytique, ces deux niveaux devraient être rigoureusement distingués. Toutefois leur confusion est régulièrement entretenue. Pour certains, en effet, les juristes feraient d'autant plus preuve de science qu'ils se révèleraient capables de reproduire, parfois en vue de les prédire, les méthodes, les raisonnements et les solutions retenus par les autorités normatives qu'ils observent. Pour d'autres également, le métier de juriste est avant tout celui d'un bon connaisseur de la technique du droit positif. Cette proximité gardée à l'égard de l'objet analysé est mal comprise par les autres sciences humaines et sociales qui situent les efforts de distanciation et d'objectivation au rang des premiers réquisits méthodologiques du savoir scientifique. Dès lors, les réflexions méthodologiques dépassent les enjeux internes au champ juridique. Elles sont cruciales pour qui veut comprendre les déplacements épistémologiques dont sont porteuses l'évolution des techniques de connaissance et l'affirmation d'objets transverses qui défient les découpages disciplinaires hérités du siècle dernier. In addition to thin concepts like the good, the bad and the ugly, our evaluative thought and talk appeals to thick concepts like the lewd and the rude, the selfish and the cruel, the courageous and the kind -- concepts that somehow combine evaluation and non-evaluative description. Thick concepts are almost universally assumed to be inherently evaluative in content, and many philosophers claimed them to have deep and distinctive significance in ethics and metaethics. In this first book-length treatment of thick (...) concepts, Pekka Väyrynen argues that all this is mistaken. Through detailed attention to the language of thick concepts, he defends a novel theory on which the relationship between thick words and evaluation is best explained by general conversational and pragmatic norms. Drawing on general principles in philosophy of language, he argues that many prominent features of thick words and concepts can be explained by general factors that have nothing in particular to do with being evaluative. If evaluation is not essential to the sort of thinking we do with thick concepts, claims for the deep and distinctive significance of the thick are undermined. The Lewd, the Rude and the Nasty is a fresh and innovative treatment of an important topic in moral philosophy and sets a new agenda for future work. It will be essential reading to anyone interested in the analysis and the broader philosophical significance of evaluative and normative language. (shrink)

Merleau-Ponty's phenomenological ontology engages deeply with visual art, and this aspect of his work remains significant not only to philosophers, but also to artists, art theorists, and critics. Until recently, scholarly attention has been focused on the artists he himself was inspired by and wrote about, chiefly Cézanne, Klee, Matisse, and Rodin. Merleau-Ponty at the Gallery expands and shifts the focus to address a range of artists (Giorgio Morandi, Kiki Smith, Cy Twombly, Joan Mitchell, and Ellsworth Kelly) whose work came (...) to prominence in the second half of the twentieth century and thus primarily after the philosopher's death. Véronique M. Fóti does not confine her analyses to Merleau-Ponty's texts (which now importantly include his late lecture courses), but also engages directly with the art. Of particular concern to her is the art's ethical bearing, especially as related to animal and vegetal life. The book's concluding chapter addresses the still-widespread rejection of beauty as an aesthetic value. (shrink)

Much attention has been given to determining whether an adolescent patient has the capacity to consent to research. This study explores the factors that influence adolescents' decisions to participate in a research study about youth violence and to determine positive or negative feelings elicited by being a research subject. The majority of subjects perceived their decision to participate to be free of coercion, and few felt badly about having participated. However, adolescents who were alone in the room during the assent (...) process were more likely to report that they chose freely to be a research subject. Over the past two decades, Ginsburg and Jablonka have developed a novel approach to studying the evolutionary origins of consciousness: the Unlimited Associative Learning framework. There are many different notions of information in logic, epistemology, psychology, biology and cognitive science, which are employed differently in each discipline, often with little overlap. Since our interest here is in biological processes and organisms, we develop a taxonomy of functional information that extends the standard cue/signal distinction. Three general, main claims are advanced here. This new taxonomy can be useful in describing learning and communication. The scientific study of consciousness or subjective experiencing is a rapidly expanding research program engaging philosophers of mind, psychologists, cognitive scientists, neurobiologists, evolutionary biologists and biosemioticians. Here we outline an evolutionary approach that we have developed over the last two decades, focusing on the evolutionary transition from non-conscious to minimally conscious, subjectively experiencing organisms. We propose that the evolution of subjective experiencing was driven by the evolution of learning and we identify an open-ended, representational, generative and recursive form of associative (...) learning, which we call Unlimited Associative Learning (UAL), as an evolutionary transition marker of minimal consciousness. This evolutionary marker provides evidence that the evolutionary transition to consciousness has gone to completion and allows reverse-engineering from this learning capacity to the system that enables it – making possible the construction of a toy model of UAL. The model allows us to identify some of the key processes and structures that constitute minimal consciousness, points its taxonomic distribution and the ecological context in which it first emerged, highlights its function and suggests a framework for exploring developmental and evolutionary modifications of consciousness. We point to ways of experimentally testing the relationship between UAL and consciousness in human and in non-human animals and discuss the theoretical and ethical implications of our approach. The framework we offer allows the exploration of the evolutionary changes in agency, value systems, selective processes and goals that were involved in the transition to subjective experiencing from a perspective that resonates with the approaches of bio-semioticians. Heyes argues that human metacognitive strategies (“cognitive gadgets” or “mills”) are the products of cultural evolution based on domain‐general cognition with few simple biases. Although like Heyes, we believe that the evolution of domain‐general cognitive processes played a crucial role in the evolution of human cognition, we argue that Heyes' distinction between mills and grist is too sharp, that associative learning evolved gradually to become more complex and hierarchical, something that is not captured by the system 1/system 2 distinction, and (...) that human cognitive plasticity required the genetic accommodation of gadget‐specific processes that led to more plasticity‐enhancing human‐specific biases. Although the three sections contain essays written from a wide spectrum of viewpoints, they emphasize, respectively, the important connections of Merleau-Ponty's thought to that of Derrida and Levinas, the Husserlian heritage and complex implications of his philosophy of material existence, and the relation of his philosophy of painting to contemporary abstract art. A distinguishing feature of this collection is its emphasis on contemporaneity.

Ce livre rassemble les Actes du colloque qui s’est tenu au Centre Culturel International de Cerisy-la-Salle du 9 au 16 juin 2012. Ce colloque est le premier qui ait été consacré à la philosophie de Robert Misrahi. Ce colloque a permis de parcourir un itinéraire dans l’ensemble de l’oeuvre de Robert Misrahi. Des philosophes ont d’abord exposé les grands axes de sa pensée, des spécialistes d’autres disciplines ont ensuite montré que cette pensée avait essaimé dans de nombreux champs de pratiques (...) : psychanalytique, bioéthique, coopérative, poétique, artistique, monde de l’entreprise, de l’éducation. On a ainsi pu mesurer l’ampleur et la cohérence d’une oeuvre. La particularité de ce colloque résidait aussi dans la présence de Robert Misrahi, et on se rend compte à la lecture des actes de son engagement permanent. Ses trois communications tissent une trame depuis son inscription dans l’histoire des idées, à l’élaboration de ses propres concepts pour ensuite synthétiser l’aboutissement d’une oeuvre et d’une vie. Les échanges qui ont été retranscrits permettent aussi d’avoir un témoignage des relations très intenses et éclairantes qui ont eu lieu. (shrink)

This is a response to the nine commentaries on our target article “Unlimited Associative Learning: A primer and some predictions”. Our responses are organized by theme rather than by author. We present a minimal functional architecture for Unlimited Associative Learning that aims to tie to together the list of capacities presented in the target article. We explain why we discount higher-order thought theories of consciousness. We respond to the criticism that we have overplayed the importance of learning and underplayed the (...) importance of spatial modelling. We decline the invitation to add a negative marker to our proposed positive marker so as to rule out consciousness in plants, but we nonetheless maintain that there is no positive evidence of consciousness in plants. We close by discussing how UAL relates to development and to its material substrate. (shrink)

The attribution of sentience or consciousness to plants is currently a topic of debate among biologists and philosophers. The claim that plants are conscious is based on three arguments: (i) plants, like all living organisms, are sentient (biopsychism); (ii) there is a strong analogy between the phloem transport system of plants and the nervous system of animals; and (iii) plants are the cognitive equals of sentient animals. On the basis of a model of consciousness that spells out criteria for assigning (...) sentience to a living organism and presents a diagnostic evolutionary marker of consciousness, we argue that these arguments are flawed and discuss some of the ethical issues they raise. We suggest a teleological approach to subjective experiencing or phenomenal consciousness. Like living, subjective experiencing is a teleology-constituting mode of being, which is made up of coupled, functional processes. We explicate our notion of a 'teleological mode of being' and distinguish between three different modes: a living (non-sentient) mode of being, a sentient mode of being, and a rational-symbolic (human) mode of being, which correspond to the three levels of soul suggested by Aristotle. These evolved teleological modes of being are (...) characterized by the possession of distinct, hierarchically nested goals and value systems. We argue that the functions of parts and processes within living systems have to be situated within the appropriate teleological frame of reference. Our evolutionary and comparative approach to the mode of being of subjectively experiencing animals clarifies why functions are best attributed to the parts that constitute sentience. Our proposal resolves the problem of attributing functions to phenomenal consciousness, resonates with basic teleological intuitions and distinctions, and corresponds to the modern broad understanding of selection and evolution. This volume is a Festschrift in honor of Jacques Taminiaux and examines the primacy of the political within phenomenology. These objectives support each other, in that Taminiaux's own intellectual itinerary brought him increasingly to an affirmation of the importance of the political. Divided into four sections, the essays contained in this volume engage with different aspects of the political dimension of phenomenology: its dialogue with classic texts of political philosophy, the political facets of phenomenological praxis, phenomenology’s contribution to actual political (...) debates, and the impact of Taminiaux’s work in the shaping of phenomenology’s notion of politics. The phrase “the primacy of the political” echoes the “primacy of perception” as it was famously defined by Merleau-Ponty. This book emphasizes, however, the inescapability of the political rather than its “foundational” character, i.e. the fact that various itineraries of thought, explored in different fields of phenomenological research, give rise to politically relevant reflections. It points out and elucidates political connotations that haunt phenomenological concepts, such as ‘world’, ‘self’, ‘nature’, ‘intersubjectivity, or ‘language’, and traces them to a broad range of approaches, concepts, and methods. In its explorations, the book discusses a broad range of thinkers, including, but not limited to, Aristotle and Kant, Bergson, Husserl, Heidegger, Merleau-Ponty, Gadamer, Ricoeur, and Arendt. This paper defends doubts about the existence of genuine moral perception, understood as the claim that at least some moral properties figure in the contents of perceptual experience. Standard examples of moral perception are better explained as transitions in thought whose degree of psychological immediacy varies with how readily non-moral perceptual inputs, jointly with the subject's background moral beliefs, training, and habituation, trigger the kinds of phenomenological responses that moral agents are normally disposed to have when they represent things as (...) being morally a certain way. Alors, ne peut-on trouver, des résonances entre langages artistiques entre l'Asie et l'Occident? Tel est le pari qui sous-tend le recueil de textes rassemblés ici.

Definition in the genre of travel writing has a special status: the discovery of otherness leads to a new relationship between language and the world. In this genre, written by lexicologists who are often amateurs, the definition of an absent reality evolves between analogy, approximation and invention.

In our target article, “Learning and the evolution of conscious agents” we outlined an evolutionary approach to consciousness, arguing that the evolution of a form of open-ended, representational, and generative learning (unlimited associative learning, UAL) drove the evolution of consciousness. Our view highlights the dynamics and functions of consciousness, delineates its taxonomic distribution and suggests a framework for exploring its developmental and evolutionary modifications. The approach we offer resonates with biosemioticians’ views, but as the responses to our target article show, (...) our proposal also faces challenges and has led to suggestions that extend, develop and qualify it. Our response to the 14 varied and rich commentaries starts with the recurring and deep question raised by many of them – the relation between life and sentience. We explore this question by introducing and expanding on “vivaciousness”, a term we coined to describe the turbulent, flexible exploration-stabilization processes inherent in the living condition, as well as addressing the related concepts of Umwelt and selfhood. We then consider the question of the adequacy of unlimited associative learning (UAL) as an evolutionary transition marker (ETM) of minimal consciousness (rather than as a marker of a complex form of sentience), and the possible precursors of sentience. The engagement with these broad themes is entangled with a discussion of evolutionary transitions, constitutive emergence and the function/s of consciousness. The suggestions of our commentators, urging us to explore new concepts and new avenues of research within the framework of a richer view of evolution are then discussed. We end by briefly considering what we regard as a conceptual lacuna, which is leading to the indiscriminate use of the term “sentience” and which awaits further investigation. (shrink)

This article explores the development of ideas in constitutional design. The point of departure is a perspective of constitutions-as-products, and thus, an examination of the invention, innovation, and an uptake of these products. The article conceptualizes constitutional innovation and distinguishes its manifestations with respect to constitutional products, the process of constitution-making, and in supporting institutions. The last two elements, in line with Schumpeter’s approach to innovation, would seem especially important to constitutional development. The article provides several examples from the area (...) of human rights and argues that innovations tend to be found in situations in which there is strong aversion to a prior order. It also shows that innovations tend to come from the periphery rather than the global core of the field. One of the sources of “mixed” constitutions is precisely such innovations, which then form raw material for further mixing. (shrink)

This paper argues that the recent metaethical turn to reasons as the fundamental units of normativity offers no special advantage in explaining a variety of other normative and evaluative phenomena, unless perhaps a form of reductionism about reasons is adopted which is rejected by many of those who advocate turning to reasons.
