The upcoming Regulation No 536/2014 on clinical trials on medicinal products for human use, which will replace the current Clinical Trial Directive at the end of 2021, has triggered a significant reform of research ethics committee systems in Europe. Changes related to ethics review of clinical trials in the EU were considered to be essential to create a more favourable environment to conduct clinical trials in the EU. The concern is, however, that the role of the research ethics committees will (...) weaken in at least some of the Member States because the new Regulation allows narrowing down the scope of ethics review as compared with the currently valid Clinical Trial Directive. Although the new Regulation may lead to faster approval procedures for clinical trials, which is especially relevant in the context of pandemics, high-quality ethics reviews integrating methodological aspects of a clinical trial should nevertheless be ensured. To maintain high research ethics standards as well as to foster measures to mitigate potential negative consequences of the reform, it is therefore of vital importance to start debating and sharing the reflections about the potential consequences of these transformations and trends as soon as possible. During the last two decades, national bioethics committees have been established in many countries all over the world. They vary with respect to their structure, composition, and working methods, but the main functions are similar. They are supposed to facilitate public debate on controversial bioethical issues and produce opinions and recommendations that can help inform the public and policy‐makers. The dialogue among national bioethics committees is also increasingly important in the globalized world, where biomedical technologies raise ethical dilemmas that traverse (...) national borders. It is not surprising, therefore, that the committees are established and active in the technologically advanced countries. There have also been a few international capacity‐building initiatives in bioethics that have had a dual task: networking among existing national bioethics committees and helping establish such committees in those countries that still lack them. The problem is that, due to a lack of information, it is not clear what problems and challenges committees face in the transitioning societies often characterized as low‐ and middle‐income countries. The laws concerning driving licences and epilepsy in different countries are very diverse with regard to the criteria for issuance or renewal of licences, and also the methods of evaluating fitness. In 2011, a law was issued in Italy implementing the European directives on driving licences, including provisions for mandatory notification that a driver is epileptic. This was established regardless of the European rules that require compulsory notification only of patients. The Federation of Italian Boards of Physicians has made recommendations (...) against mandated physician reporting, resulting in a current confusion between legal and ethical recommendations to medical doctors. The mandatory notification enacted by Italian law raises ethical concerns about disparities in access to care and possible violations of the right to confidentiality of patient information. Moreover, the law discussed here fails to emphasise the importance of physicians ensuring compliance by the patient, by sharing the correct information about the risks associated with illegal driving and by obtaining information from the patient through regular check-ups. An urgent revision of the law is required to implement the duty of the physician to provide information and to ensure that the rule about mandatory notification should be erased in favour of optional self-reporting by epileptics as the preferred way to notify the licensing authority. The implementation of these measures could correct the dichotomy between the law and the ethical recommendations for medical doctors and protect the rights of people with epilepsy as well as those of any other patients whose pathology or impairment could imply a risk to the community. A common worry regarding normative supervenience theses is that they are easily trivialized unless we somehow restrict the set of descriptive base properties on which the normative properties supervene. The idea is that if all descriptive properties are included in the base, any two individuals that share all their base properties must be the same individual in the same world, from which it follows that they have the same normative properties. We argue that this trivial explanation for unrestricted normative supervenience (...) fails. Moreover, we argue that even if it succeeded, this wouldn’t undermine the explanation challenges associated with normative supervenience. (shrink)

It is commonly assumed that if normative terms are analyzable in descriptive terms, as claimed by analytic reductionists, this provides an easy explanation why normative supervenience would be a conceptual truth. This chapter argues that our knowledge of normative supervenience has two important features this explanation fails to account for: first, the idea that normative properties supervene on descriptive properties seems obvious to us and, secondly, we don’t come to accept this thesis distributively by finding it plausible in each of (...) its particular instances but rather by seeing a pattern that all normative properties must conform to. An alternative is suggested, an expressivist account of normative supervenience that allows us to explain both of these features. The chapter closes by arguing that they require explanation even on the assumption that normative supervenience is not a conceptual truth. This makes the explanation problem concerning our knowledge of normative supervenience more general than previously thought. (shrink)

This paper explores some key discrepancies between two sets of normative requirements applicable to the research use of personal data and human biological materials: the data protection regime which follows the application of the European Union General Data Protection Regulation, and the Declaration of Helsinki, CIOMS guidelines and other research ethics regulations. One source of this controversy is that the GDPR requires consent to process personal data to be clear, concise, specific and granular, freely given and revocable and therefore has (...) challenged the concept of ‘broad consent’, which has been widely applied in the context of biobanking. Another source of controversy is the interplay between regulations of research ethics and protection of personal data related to the secondary use of personal data and biological materials. In this case, the GDPR ‘research condition’ provides an alternative to re-consent for the use of previously collected personal data and biological materials. Although the mentioned controversies have been raised in the legal literature, they have not been explicitly addressed from the research ethics perspective. Should consent be regarded as a priority legal basis for personal data processing in health data research? Can broad consent still be a suitable legal ground for biobanking? What should be the role of research ethics provisions that differ from the GDPR standards, and what should be the role and function of research ethics committees in the changing environment of health data research? These are the ongoing controversies to be explored in the paper. (shrink)

So far, social factors have dominated the definitions of CC, but citizenship functions can also be found in other areas. In fact, for maximum benefit, the type of citizenship should be tied to the sector (...) and business field of the corporation in question. Using data drawn from three internationally operating corporations headquartered in Finland, we introduce three different types of CC that are in line with their core business ideas: cultural citizenship, environmental citizenship and technological citizenship. These new types of citizenships can help in grasping the complexity of business responsibility and ethics, and offer tools for gaining competitive advantage by differentiation. (shrink)

Legal English, being among the most complex and multifaceted areas of English for Specific Purposes, has duly received considerable attention on the part of linguists, discourse and learner needs′ analysts, sociolinguists and ESP researchers. Most research has been carried out to investigate lexical, syntactic, grammatical and other communicative competences of law students in various cycles of higher education. An area that is still highly in need of examination is the development of communicative competences of Legal English among law practitioners who (...) might have had a course of Legal English in their law studies and face with an urge of revision or might have not been introduced to Legal English whatsoever. In light of these observations, the present study examines the needs and problems regarding the use of general and legal English faced by 34 law practitioners, namely lawyers and judges working at two law companies and a district court in Kaunas, Lithuania. The study assumes qualitative methodology including a semi-structured interview and a questionnaire. The results have revealed that communicative competence of legal practitioners gained during their formal education does not meet the demands of their legal practice. While skills of general English appear not to cause many problems, skills of legal English are not developed to an adequate level. Therefore, as the study shows, it is absolutely inevitable to develop and offer in-service education of Legal English carefully attuned to the diverse levels of competences and needs of legal practitioners. In higher education, scientists live and breathe their work every single day, providing the conditions for potential conflict between professional and family life. This phenomenological inquiry explores the question: “How do female university academics experience being between the family and work responsibilities in their daily activities?” Twelve male and female academics from different scientific/ research fields participated in the study. Phenomenological analysis of the interviews with female academics revealed the challenges they face in reconciling family and work commitments. The emerging (...) themes include experience of feeling guilty by prioritizing their research, aligning family holidays with academic conferences, automating activity, compelling the body and mind to work in a different mode, and doing housework alongside academic activity – all of which reveal the bodily presence of female academics between two important areas of life without having a clear focus on either one of them. This study showed that, while increasing equality in the work sphere has unified the opportunities of men and women, female academics still experience conflict between family and work, as well as a feeling of guilt, when they talk about significant moments in their own experience of the university environment. RESUMEN En el presente artículo se reconoce la significación de la estimulación prenatal de la comunicación y la necesidad de brindar una orientación familiar oportuna y certera tanto a la embarazada como a sus familiares y su objetivo está encaminadoa contribuir a la capacitación del personal de salud dirigida a la orientación a la familia para la estimulación prenatal de la comunicación. En él se tiene en cuenta la influencia de los médicos y enfermeras, en dicha labor, además, se encuentran (...) reflexiones, comentarios, acciones y técnicas, con el propósito de elevar la calidad de la orientación para que la familia potencie la estimulación de la comunicación desde la gestación. This research focuses on how research ethics committee and integrity board members discuss and decide on solutions to case scenarios that involve a dimension of research ethics or integrity in collaborative settings. The cases involved issues around authorship, conflict of interest, disregard of good scientific practice and ethics review, and research with vulnerable populations (children and neonates). The cases were set in a university, a hospital, or a research institute. In the research, we used a deductive qualitative approach with thematic (...) analysis. Twenty-seven research ethics committee and research integrity board members from 16 European countries and one country outside Europe participated. Participants represented natural and life sciences, social sciences, and humanities. They worked on cases involving ethical/integrity issues in six different constellations. Results show that experts apply key elements of ethical decision making, namely identification of ethical issues, stakeholders, guidelines, solutions, and own positionality, in dealing collaboratively with ethics/ integrity problems, and the nature of the application depends on the complexity of the case. Understanding how individuals knowledgeable in research ethics and integrity, in this case, individuals serving on research ethics committees and integrity boards, approach ethical/ moral issues can help to identify strategies that may be useful in the development of research ethics and integrity training for junior researchers who may benefit from learning professional strategies. El artículo constituye un acercamiento a las razones que sustentan la necesidad de elevar la calidad de la orientación a las familias de niños en la primera infancia y su objetivo consistió en capacitar al personal de la salud para desarrollar la orientación familiar en función de la prevención de desviaciones en el desarrollo en esta etapa. En él se aborda el rol que tiene la familia en la formación de los niños y la incidencia de los médicos y enfermeras (...) en su orientación; se encuentran reflexiones y comentarios sobre cómo elevar la calidad de la orientación para que la familia pueda desarrollar, en las condiciones de convivencia familiar, la prevención de desviaciones en el desarrollo mediante la realización de un proceso educativo de calidad. The article is an approach to the reasons that support the need to improve the quality of the guidance given to families of early childhood children and its objective consisted on training health staff to develop family guidance according to the prevention of deviations in development during this stage. It deals with the role family plays in children's education and the impact of doctors and nurses on its guidance. Thoughts and comments on how to improve the quality of guidance can also be found so that the family can develop, on family living conditions, the prevention of deviations in development through a quality educational process. Background: The present article aims to measure the extent to which the physical and recreational needs of elderly persons in the communities of Posorja and Puna are being met. Nowadays, it is known that physical activity is beneficial for the elderly, as it helps to diminish illness and all kinds of diseases. Method: The population in this study is comprised on 378 elderly persons between 65 and 79 years of age: 200 belong to the community of Posorja and 178, to (...) the community of Puna in Guayas Province. The tools used for this research include, among others, the ADL Test, which evaluates the degree of self-care and mobility; the Lawton and Brody Scale, which is an appropriate instrument to evaluate the level of independence and skills; and the MMT, which evaluates cognitive functions such as memory, language, praxis and attention. They all are essential to detecting and diagnosing Alzheimer´s disease. Results: Various statistical techniques were used to obtain the results, such as descriptive analysis, contingency tables and main components. Conclusions: The population between 65 and 90 years of age was analyzed and it accounted for 35.9% of the total population back in 2010, which means there was a variation. Nowadays, it represents 56.6% of the obtained sample. This generational group refers to the elderly, who should be favored by public policies that are intended to improve health programs, generate recreational areas, and create senior care centers. Generally, the demographic dynamics of Posorja show a structured pyramid, with an expanding population, a large amount of young people and adults who contribute to the economic dynamics and productivity of the area. The questionnaire could be adapted and contain the specifications required to suit the true dimensions of this population. (shrink)

Por tal motivo este trabajo tiene como objetivo analizar aspectos esenciales del desarrollo de la comprensión de (...) textos con fines específicos en el estudiantado de los cursos preparatorios de las ciencias de la salud. In order to highlight the intimate relationship between imagining, drawing and making worlds, this essay questions the educational meaning of children to initiate in the action of drawing in face of the growing cultural tendency of the body being less and less required to produce senses. The incarnated action of drawing, as an aesthetic action of touching and being touched by the world when transposing the visible limits and entering into the intimacy of worldly invisibility, constitutes an experience that is (...) as recurrent and trivialized in school daily life as it is existentially complex due to its poetic power to enter the invisible and inaugurate worldviews. The historical disqualification of the image and imagination in Western thought, supported by the separation between subjectivity of the body and objectivity of the world, does not allow educational thought to consider the phenomenon of poetic imagination as an existential experience of language insertion in the world from the gesture of drawing. Gesture that finds its specificity in the instant the hand traces and inscribes lines on the surface of the supports as infinitely creative writing. The aesthetic gesture of drawing, temporalized by the rhythm of the body in the emergence of the fabulation that accompanies the repetition of the marks, implies a poetic experience of language that involves the fusion of two senses: that of the gesture in materiality and that of the mark configured in it, marked and cicatrized in the surface of the support by the body’s action that performed it. The approximation between education, arts and childhood allows us to highlight the philosophical and pedagogical tensions that involve the question of poetic imagination and to take another look at the action of drawing in the context of children's education. What emerges, from the dialogue between Gaston Bachelard, Maurice Merleau-Ponty and Jean-Luc Nancy, is the relevance of the educational intention of caring for the vital function of language as an aesthetic and poetic experience that is constituted in the processuality of the body to make something appear that produces and contains presence, that which promotes and expands the existential density of the real. _Edward Bibring Photographs the Psychoanalysts of His Time_ provides us with a unique pictorial window into a fascinating period of psychoanalytic history. It is the gift of Edward Bibring, a passionate photographer who, Rolleiflex in hand, chronicled international psychoanalytic congresses from 1932 to 1938. The period in question spans the ascendancy of Hitler, the great exodus of analysts to England and the U.S., and the Anschluss of 1938. A year after the Paris Congress, the last meeting photographed by Bibring, Europe (...) would be in flames. At Wiesbaden in 1932, we find an ever dignified Ernest Jones relaxing aboard a sight-seeing ship, and Helene Deutsch and Heinz Hartmann delightfully at ease at a coffee shop. At the Lucerne Congress of 1934, Anna Freud, Ludwig Jekels, Wilhelm Reich, Grete Bibring, Max Eitingon, and Franz Alexander happily converse outside a hotel. At Marienbad in 1936, there are smiling new faces: Annie Reich, Ernst Kris, Otto Fenichel, Edward Glover, and others. At Budapest in1937 the women – Anna Freud, Vilma Kovacs, Dorothy Burlingham, and Elisabeth Geleerd – speak animatedly among themselves. A demure Margaret Mahler and a chic Marianne Kris make their appearance. In 1938, we see a series of table shots, where analysts, now with suit jackets removed and even a few collars loosened, relax with their food, wine, and cigars. Bracketed by Sanford Gifford’s brief introduction and biographical sketches of all the captured parties, Bibring’s photographs, digitized and enlarged, retain just enough graininess to evoke a different era in the history of psychoanalysis. It is heartening to see the paragons of “classical psychoanalysis” as warmly human, their analytic reserve supplanted by relaxed affability. But it is sobering to remember that the high spirit engendered by Congresses – in Bibring’s time no less than our own – may overlay the gravest political developments and the deepest personal anxieties.
