The introduction of new medical treatments based on invasive technologies has often been surrounded by both hopes and fears. Hope, since a new intervention can create new opportunities either in terms of providing a cure for the disease or impairment at hand; or as alleviation of symptoms. Fear, since an invasive treatment involving implanting a medical device can result in unknown complications such as hardware failure and undesirable medical consequences. However, hopes and fears may also arise due to the cultural (...) embeddedness of technology, where a therapy due to ethical, social, political and religious concerns could be perceived as either a blessing or a threat. While Deep Brain Stimulation (DBS) for treatment resistant depression (TRD) is still in its cradle, it is important to be proactive and try to scrutinize both surfacing hopes and fears. Patients will not benefit if a promising treatment is banned or avoided due to unfounded fears, nor will they benefit if DBS is used without scrutinizing the arguments which call for caution. Hence blind optimism is equally troublesome. We suggest that specificity, both in terms of a detailed account of relevant scientific concerns as well as ethical considerations, could be a way to analyse expressed concerns regarding DBS for TRD. This approach is particularly fruitful when applied to hopes and fears evoked by DBS for TRD, since it can reveal if our comprehension of DBS for TRD suffer from various biases which may remain unnoticed at first glance. We suggest that such biases exist, albeit a further analysis is needed to explore this issue in full. (shrink)

Este artículo sintetiza algunos aspectos del proyecto “Hierro y bronce. Criterios para la valoración y conservación de la herrería artística en el patrimonio arquitectónico del Uruguay”[i], cuyo objetivo es establecer los atributos patrimoniales de los elementos ornamentales metálicos asociados a fachadas del patrimonio arquitectónico nacional y contribuir a su difusión, puesta en valor y conservación. A lo largo de la investigación se abordan los aspectos socioculturales, artísticos, formales, técnicos y, por último, los relativos al deterioro de estos elementos y las (...) pautas para su preservación y restauración. La metodología se basa en el estudio de fuentes primarias, éditas e inéditas, en la revisión de bibliografía especializada y en el trabajo de campo sobre una muestra representativa de elementos ornamentales metálicos aplicados a las fachadas de la arquitectura montevideana. Fue relevado un total de 250 edificios, correspondientes a los distintos períodos que distinguimos en la evolución de la herrería local entre finales del siglo XVIII y mediados del siglo XX. Se trata de un aporte inicial que profundiza en un campo escasamente abordado en nuestro medio acerca del conocimiento y difusión de los trabajos de herrería en el marco del patrimonio arquitectónico y artístico uruguayo, proporcionando información útil a la academia, las instituciones vinculadas a la valoración y conservación patrimonial y el público general. I argue that the accounts of inference recently presented (in this journal) by Paul Boghossian, John Broome, and Crispin Wright are unsatisfactory. I proceed in two steps: First, in Sects. 1 and 2, I argue that we should not accept what Boghossian calls the “Taking Condition on inference” as a condition of adequacy for accounts of inference. I present a different condition of adequacy and argue that it is superior to the one offered by Boghossian. More precisely, I point out (...) that there is an analog of Moore’s Paradox for inference; and I suggest that explaining this phenomenon is a condition of adequacy for accounts of inference. Boghossian’s Taking Condition derives its plausibility from the fact that it apparently explains the analog of Moore’s Paradox. Second, in Sect. 3, I show that neither Boghossian’s, nor Broome’s, nor Wright’s account of inference meets my condition of adequacy. I distinguish two kinds of mistake one is likely to make if one does not focus on my condition of adequacy; and I argue that all three—Boghossian, Broome, and Wright—make at least one of these mistakes. This chapter explores how what is dismissed as “trans activism” is often public philosophy. It considers how so‐called “public philosophy” on trans issues often does a substantially worse job of living up to the name. The chapter discusses how the dichotomy between “trans activism” and “public philosophy” provides a pretext for marginalizing trans voices. To draw on Black feminist philosophical thought, lived experience is a criterion for knowledge of the needs of marginalized people. Like other marginalized communities, trans communities have (...) encountered many areas in which hermeneutical liberation is needed. Public philosophy as trans activism is often systemically and systematically ignored or willfully misinterpreted as being biased and motivated by self‐interest, whereas anti‐trans (public) philosophy is seen as asking the important questions. This book casts new light on the application of the principle of proportionality in international law. Proportionality is claimed to play a central role governing the exercise of public power in international law and has been presented as the 'ultimate rule of law'.

Organizations routinely make choices when addressing conflicting stakes of their stakeholders. As stakeholder theory continues to mature, scholars continue to seek ways to make it more usable, yet proponents continue to debate its legitimacy. Various scholarly attempts to ground stakeholder theory have not narrowed down this debate. We draw from the work of Juergen Habermas to theoretically advance stakeholder theory, and to provide practical examples to illustrate our approach. Specifically, we apply Habermas’ language-pragmatic approach to extend stakeholder theory by advancing (...) seven sets of normative axioms. We conclude that a deliberative approach, with its focus on the conditions of legitimation and deliberative democracy, has the potential to become a cornerstone of stakeholder theory. The need for global stakeholder discourse and its internalization in corporate structures and institutions is exemplified by a multitude of CSR and stakeholder initiatives that have mushroomed in response to global risk scenarios such as climate change, nuclear warfare, or terrorism. Further research may help to build a functioning global governance system in order to provide guidance for management in the 21st century. (shrink)

It argues that pragmatism's use of Romanticism is an integral part of a modern antifoundationalist story of progress, and that it can help us appreciate the significance of Romanticism in the twenty-first century. In this paper, we examine the scientific, legal, and ethical foundations for inclusion of transgender women athletes in competitive sport, drawing on IOC principles and relevant Court of Arbitration for Sport decisions. We argue that the inclusion of trans athletes in competition commensurate with their legal gender is the most consistent position with these principles of fair and equitable sport. Biological restrictions, such as endogenous testosterone limits, are not consistent with IOC and CAS principles. We explore the implications for recognizing (...) that endogenous testosterone values are a ‘natural physical trait’ and that excluding legally recognized women for high endogenous testosterone values constitutes discrimination on the basis of a natural physical trait. We suggest that the justificatory burden for such prima facie discrimination is unlikely to be met. Thus, in place of a limit on endogenous testosterone for women, we argue that ‘legally recognized gender’ is most fully in line with IOC and CAS principles. (shrink)

In this article, I argue that conventional reasoning on corporate social responsibility (CSR) is based on the assumption of a liberal market economy in the context of a nation state. I build on the study of Scherer and Palazzo (Acad Manage Rev 32(4):1096-1120, 2007), developing a number of criteria to identify elements of liberal philosophy in the ongoing CSR debate. I discuss their occurrence in the CSR literature in detail and reflect on the implications, taking into account the emerging political (...) reading of the firm. I conclude that the apolitical framework in the mainstream CSR literature has to be overcome since it does not reflect recent changes in the socio-economic conditions for economic actors in a globalizing world. At the outset of an ethnographic inquiry, we navigated national and international resources to search for theoretical and practical guidance on obtaining parents and children’s informed consent/assent. While much theoretical guidance debating ethical issues to children’s participation in research was found, a paucity of published papers offering practical guidance on assent processes and/or visual representations of child assent forms and information sheets was discovered. The purpose of this article is to describe our experiences, both theoretically and practically, of negotiating the (...) process of obtaining informed consent and assent with parents and children for a non-therapeutic qualitative research study. We hope this article instigates a platform for others to explicate their experience and contributes to the construction of a coherent body of knowledge which will clearly delineate important elements that must be considered when negotiating children’s agreement to participate in research. Restrictive border protection policies directed toward managing the flow of refugees coming into neoliberal democracies (and out of failing nation-states) are a defining feature of contemporary politics. In this book, Verónica Tello analyses how contemporary artists-such as Tania Bruguera, Isaac Julien, Rosemary Laing, Dinh Q. Lé, Dierk Schmidt, Hito Steyerl, Lyndell Brown and Charles Green-negotiate their diverse subject positions while addressing and taking part in the production of images associated with refugee experiences and histories. Tello argues that their practices, (...) which manifest across a range of contexts including Cuba, the United States, Australia and Europe, represent an emergent, global paradigm of contemporary art, 'counter-memorial aesthetics'. Counter-Memorial Aesthetics, Tello argues, is characterized by its conjunction of heterogeneous signifiers and voices of many times and places, generating an experimental, non-teleological approach to the construction of contemporary history, which also takes into account the complex, disorienting spatial affects of globalization. Spanning performance art, experimental 'history painting', aftermath photography and video installation, counter-memorial aesthetics bring to the fore, Tello argues, how contemporary refugee flows and related traumatic events critically challenge and conflict with many existing, tired if not also stubborn notions of national identity, borders, history and memory. Building on the writings of such thinkers as Michel Foucault and Jacques Rancière, this book offers a useful concept of 'counter-memory' for the twenty-first century. It shows how counter-memorial aesthetics is not only central to the nexus of contemporary art and refugee histories but also how it can offer a way of being critically present with many other, often interrelated, global crises in the contemporary era. After giving some contextual information, we propose an analysis of music and meaning in the song “The Garden,” as performed by the rock group Einstürzende Neubauten in the official video from the 1996 release of the album Ende Neu. We present a semiotic blending model of the narrative content of the song and of its imagery, partly determined by the structure and character of the music. Finally, we add a view of the apocalyptic perspective of some comparable creations.

Pragmatist aesthetics has not yet reached its full potential. This is primarily due to the legacy of John Dewey’s aesthetics. In order to confront the shortcomings and insufficiencies of his aesthetics, pragmatist aestheticians ought to establish a dialogue with continental aesthetics. The attempt to clarify what pragmatist aesthetics can learn from Theodor W. Adorno’s materialist aesthetics is still a desideratum. This essay focuses on two aspects. First, it shows that pragmatist aestheticians can use Adorno’s modern aesthetics in order to gain (...) a deeper and more complex understanding of the social nature or register of form (of what might be termed “die Gesellschaftlichkeit der Form”). Second, the essay demonstrates that Adorno, in contrast to Dewey, is valuable for the endeavor to grasp the significance of the dialectics of harmony and dissonance or organicity and fragmentation when analyzing modern art and literature. Schulenberg continues the thought-provoking argument he developed in his previous two monographs by advancing the idea that one can only grasp the unique contemporary significance of pragmatism when one realizes how pragmatism, humanism, anti-authoritarianism, and postmetaphysics are interlinked.

Although solidarity is a key issue in sociology, surprisingly little attention has been given to the question what constitutes solidarity from a sociological perspective. In this paper I suggest a concept of solidarity which might work as a general framework for theoretical and empirical investigations. The central idea is that solidarity norms make up the core of the concept. Solidarity norms demand from their addressees that they transfer resources without compensation either to a collective or to individuals. It is argued (...) that there are two levels of solidarity to be distinguished: (1) the level of social systems where solidarity is manifested in solidarity norms and (2) the level of individuals where solidarity is embedded in commitment to solidarity norms. I differentiate between four universal solidarity norms which can be found in associations on every level of social aggregation: norms of provision, of sharing, of supporting, and of loyalty. En este trabajo presentamos el proceso del ordenamiento, catalogación y curaduría de los materiales fotográficos de un antropólogo estadounidense que realizó trabajo de campo en Atlixco, Puebla, México, con indígenas de la etnia nahua en las décadas de 1970 y 1980La metodología utilizada para este trabajo se basó en una propuesta propia de catalogación mínima de materiales fotográficos.Concluimos que la catalogación mínima es adecuada para la interoperabilidad con los estándares internacionales y resulta fácil de aplicar en los contextos universitarios y (...) de archivos locales. This article aims to reconstruct the essential lines of Kant’s theory of meaning as it appears in critical Kantian philosophy. More particularly, an originality of the Kantian theory of meaning is highlighted, namely the distinction that this theory introduces between two modalities of meaning, namely a theoretical modality and a practical, that is to say a moral modality.

Several cognitive accounts of human communication argue for a language-independent, prelinguistic basis of human communication and language. The current study provides evidence for the universality of a prelinguistic gestural basis for human communication. We used a standardized, semi-natural elicitation procedure in seven very different cultures around the world to test for the existence of preverbal pointing in infants and their caregivers. Results were that by 10–14 months of age, infants and their caregivers pointed in all cultures in the same basic (...) situation with similar frequencies and the same proto-typical morphology of the extended index finger. Infants’ pointing was best predicted by age and caregiver pointing, but not by cultural group. Further analyses revealed a strong relation between the temporal unfolding of caregivers’ and infants’ pointing events, uncovering a structure of early prelinguistic gestural conversation. Findings support the existence of a gestural, language-independent universal of human communication that forms a culturally shared, prelinguistic basis for diversified linguistic communication. It is commonly thought that that the best system account of lawhood ((Mill (1843), Ramsey (1978)[fp. 1928], Lewis (1973)) makes available a nice explanation for why laws are ‘distinctively appropriate targets of scientific inquiry’ (Hall, 2015). The explanation takes the following general form: laws are especially valuable for agents like us because they efficiently encode a lot of valuable (non-nomic) information in a tractable format. The goal of this paper is to challenge this style of explanation: I argue that the (...) general principle it presupposes is in conflict with our best account of practical rationality. After considering and rejecting a number of proposals for dissolving the tension, I conclude that BSA proponents may need to scale back the explanatory ambitions of their theory; in particular, they may need to give up the hope of non-circular explanations of the value of nomic information. I end by outlining some challenges for the humean world-view that results after this shift. (shrink)

This is a response to a claim by Sven Ove Hansson to the effect that Poppers dictum that falsification lies at the heart of all pursuit of science has once and for all been falsified by his study of articles published in Nature during the year 2000. We claim that this is based on a misunderstanding of Poppers philosophy of science interpreting it too literally, and that alternative readings of those papers are fully compliant with falsification. Background:Ethical competence in nursing practice helps clinical nurses to think critically, analyse issues, make ethical decisions, solve ethical problems and behave ethically in their daily work. Thus, ethical competence contributes to the promotion of high-quality care. However, studies on ethical competence in Malawi are scanty.Objectives:The aim of this study was to explore ethical competence among clinical nurses in selected hospitals in Malawi.Methodology:A cross-sectional survey was conducted in four selected hospitals in Malawi with a sample of 271 clinical nurses. Data were (...) collected using self-administered questionnaires, which included a Moral Competence Scale for Home Care Nurses. Descriptive statistics and logistic regression were computed for the dataset using STATA version 12.0.Ethical consideration:The study protocol complied with all ethical requirements and was approved by the College of Medicine Research Ethics Committee under the University of Malawi.Results:The clinical nurses in Malawi are ethically competent. However, there is a significantly high number (p 0.05). Three determinants of high ethical competence level (strong will, judgement skills and recognition of discrepancy of intention) were identified through a reduced model after stepwise logistic regression analysis. Furthermore, results show that indicators of ethical competence include caring, confidentiality and observance of nurses dressing code. The study has also confirmed that the Moral Competence Scale for Home Care Nurses is a reliable tool to assess ethical competence in low-resource settings.Conclusion:The majority of nurses who completed the survey had low ethical competence. However, clinical nurses with high ethical competence level are required to competently manage complex ethical challenges in health facilities. Strategies for enhancing ethical competence such as continuing ethics education, establishment of ethics committees and provision of supportive supervision are recommended to enable nurses in Malawi attain a high level of ethical competence. Moral disengagement was initially conceptualized as a process through which people reconstrue unethical behaviors, with the effect of deactivating self-sanctions and thereby clearing the way for ethical transgressions. Our article challenges how researchers now conceptualize moral disengagement. The current literature is overly liberal, in that it mixes two related but distinct constructs—process moral disengagement and the propensity to morally disengage—creating ambiguity in the findings. It is overly conservative, as it adopts a challengeable classification scheme of “four points in moral self-regulation” (...) and perpetuates defining moral disengagement via a set of eight psychological mechanisms, narrowing our understanding of the phenomenon. To address these problems, we propose to define process moral disengagement intensionally (specifying the necessary and sufficient conditions for correct application of the term) as intrapsychic cognitive reasoning processes through which people selectively reconstrue a moral judgment “behavior B by actor A is morally wrong” and shift it toward becoming “behavior B is not morally wrong” or “actor A is not responsible for behavior B.” This definition achieves disambiguation and increased concept clarity. We leverage the definition to motivate a classification scheme for psychological mechanisms of moral disengagement along two dimensions—reconstruing morality and reconstruing agency—and to initiate an open inventory of psychological mechanisms that specify how process moral disengagement operates.
