This paper examines ethical, legal and economic dimensions of the decision facing employers regarding whether it is appropriate to monitor the electronic mail (e-mail) communications of its employees. We review the question of whether such monitoring is lawful. Recent e-mail monitoring cases are viewed as a progression from cases involving more established technologies (i.e., phone calls, internal memoranda, faxes and voice mail).The central focus of the paper is on the extent to which employer monitoring of employee e-mail presents a structure (...) of costs and benefits to the employer which are unlikely to make such a practice profitable or practical to the employer. We apply Benacerraf’s distinction between mathematical ontology and mathematical practice to examine contrasting interpretations of infinitesimal mathematics of the seventeenth and eighteenth century, in the work of Bos, Ferraro, Laugwitz, and others. We detect Weierstrass’s ghost behind some of the received historiography on Euler’s infinitesimal mathematics, as when Ferraro proposes to understand Euler in terms of a Weierstrassian notion of limit and Fraser declares classical analysis to be a “primary point of reference for understanding the eighteenth-century theories.” Meanwhile, scholars like (...) Bos and Laugwitz seek to explore Eulerian methodology, practice, and procedures in a way more faithful to Euler’s own. Euler’s use of infinite integers and the associated infinite products are analyzed in the context of his infinite product decomposition for the sine function. Euler’s principle of cancellation is compared to the Leibnizian transcendental law of homogeneity. The Leibnizian law of continuity similarly finds echoes in Euler. We argue that Ferraro’s assumption that Euler worked with a classical notion of quantity is symptomatic of a post-Weierstrassian placement of Euler in the Archimedean track for the development of analysis, as well as a blurring of the distinction between the dual tracks noted by Bos. Interpreting Euler in an Archimedean conceptual framework obscures important aspects of Euler’s work. Such a framework is profitably replaced by a syntactically more versatile modern infinitesimal framework that provides better proxies for his inferential moves. (shrink)

This volume contains thirteen papers that were presented at the 2017 Annual Meeting of the Canadian Society for History and Philosophy of Mathematics/Société canadienne d’histoire et de philosophie des mathématiques, which was held at Ryerson University in Toronto. It showcases rigorously reviewed modern scholarship on an interesting variety of topics in the history and philosophy of mathematics from Ancient Greece to the twentieth century. A series of chapters all set in the eighteenth century consider topics such as John Marsh’s techniques (...) for the computation of decimal fractions, Euler’s efforts to compute the surface area of scalene cones, a little-known work by John Playfair on the practical aspects of mathematics, and Monge’s use of descriptive geometry. After a brief stop in the nineteenth century to consider the culture of research mathematics in 1860s Prussia, the book moves into the twentieth century with an examination of the historical context within which the Axiom of Choice was developed and a paper discussing Anatoly Vlasov’s adaptation of the Boltzmann equation to ionized gases. The remaining chapters deal with the philosophy of twentieth-century mathematics through topics such as an historically informed discussion of finitism and its limits; a reexamination of Mary Leng’s defenses of mathematical fictionalism through an alternative, anti-realist approach to mathematics; and a look at the reasons that mathematicians select specific problems to pursue. Written by leading scholars in the field, these papers are accessible to not only mathematicians and students of the history and philosophy of mathematics, but also anyone with a general interest in mathematics. Background The first COVID-19 wave started in February 2020 in France. The influx of patients requiring emergency care and high-level technicity led healthcare professionals to fear saturation of available care. In that context, the multidisciplinary Ethics- Support Cell (EST) was created to help medical teams consider the decisions that could potentially be sources of ethical dilemmas. Objectives The primary objective was to prospectively collect information on requests for EST assistance from 23 March to 9 May 2020. The secondary aim was (...) to describe the Cell’s functions during that period. Research design This observational, real-time study of requests for Cell consultations concerned ethical dilemmas arising during a public health crisis. The EST created a grid to collect relevant information (clinical, patient’s/designated representative’s preferences and ethical principles strained by the situation), thereby assuring that each EST asked the same questions, in the same order. Participants and research context Only our university hospital’s clinicians could request EST intervention. Ethical considerations The hospital Research Ethics Committee approved this study (no. CER-2020-107). The patient, his/her family, or designated representative was informed of this ethics consultation and most met with EST members, which enabled them to express their preferences and/or opposition. Findings/results 33 requests (patients’ mean age: 80.8 years; 29 had COVID-19: 24 with dyspnea, 30 with comorbidities). 17 Emergency Department solicitations concerned ICU admission, without reference to resource constraints; others addressed therapeutic proportionality dilemmas. Discussion Intervention-request motives concerned limited resources and treatment intensity. Management revolved around three axes: the treatment option most appropriate for the patient, the feasibility of implementation, and dignified care for the patient. Conclusions COVID-19 crisis forced hospitals to envisage prioritization of ICU access. Established decision-making criteria and protocols do not enable healthcare professionals to escape ethical dilemmas. That acknowledgement highlights ethical risks, enhances the added-value of nursing and encourages all players to be vigilant to pursue collective deliberations to achieve clear and transparent decisions. The fourteen authors in this collection used phenomenology and hermeneutics to conduct deep inquiry into perplexing and wondrous events in their work and personal lives. These seasoned scholar-practitioners gained remarkable insight into areas such as health care and illness, organ donation, intercultural communications, high-performance teams, artistic production, jazz improvisation, and the integration of Tai Chi into education. All authors were transformed by phenomenology's expanded ways of seeing and being.

BackgroundGiven that advances in research continuously raise new ethical issues, a multidisciplinary working group of investigators involved in biomedical research has gathered to discuss and compare ethical viewpoints in their daily practice.MethodsThe working group has drafted a Charter for Ethics in Biomedical Research that encompasses all the steps in the research process, i.e. from the initial idea to analysis and publication of the results.ResultsBased on key principles for ethically responsible research, the Charter may serve as a tool for performing research, (...) discussing research issues and training researchers.ConclusionsThe Charter should stimulate researchers to think about their responsibility for research in a progressive, caring society. The air pollution generated by motor vehicles and by static sources is, in certain geographic areas, a very serious problem, a problem that exists because of a failure of the marketplace. To address this marketplace failure, the State of California has mandated that by 2003, 10% of the Light-Duty Vehicle Fleet (LDV) be composed of Zero-Emission Vehicles (ZEVs). However, the policy-making process that was utilized to generate the ZEV mandate was problematic and the resulting ZEV mandate is economically unsound. Moreover, (...) an ethical analysis, based primarily upon the work of John Rawls, suggests that implementation of the California ZEV mandate is—in spite of the wide latitude that ought to be given to policy decision makers—unethical. A more ethical and economically efficient approach to the pollution caused by marketplace failure is one that relies on market incentives and thereby achieves the desired improvement in air quality by appealing both to the self-interest of motorists and to those businesses that are directly or indirectly involved with the automobile industry. Such an approach would take better advantage of the creative forces of the market and improvements in technology over time and avoid the infringements on individual liberty and fairness embodied in the ZEV mandate. In “The Possibility of Epistemic Nudging” (2021), Thomas Grundmann examines nudging as applied to doxastic attitudes. Grundmann argues that given the right presuppositions about knowledge, justified beliefs, and the relevant belief-forming processes, doxastic nudging can result in justified beliefs and even knowledge in the nudgee. In this short response we will raise some critical concerns for Grundmann’s project as well as open up a path for epistemic nudges (nudges that result in justified beliefs or knowledge) that Grundmann too quickly (...) dismisses. In this contribution, we shall examine how Valéry leaves Descartes, and the paradigm of sight, in favor of the dancer Athiktè, typical of the paradigm of hearing and touch. If Descartes offers the pattern of an analytic mapping, that method reveals itself irrelevant to take into account what Valéry calls the C.E.M (Corps Esprit Monde). On the other side, a dancer, like Athiktè appears as the model of poiesis, showing the natura naturans in progress.

In “The Possibility of Epistemic Nudging” (2021), I address a phenomenon that is widely neglected in the current literature on nudges: intentional doxastic nudging, i.e. people’s intentional influence over other people’s beliefs, rather than over their choices. I argue that, at least in brute cases, nudging is not giving reasons, but rather bypasses reasoning altogether. More specifically, nudging utilizes psychological heuristics and the nudged person’s biases in smart ways. The goal of my paper is to defend the claim that nudging, (...) even when it bypasses reasoning, can result in justified beliefs and knowledge. As I argue, it takes two things to accomplish this goal: suitable meta-epistemological views and appropriate circumstances. If a broadly reliabilist account of justified beliefs and knowledge is correct, and if the relevant belief-forming methods are externally individuated in the right way, then nudging to knowledge is possible. If, in addition, the nudger is knowledgeable, epistemically benevolent and systematically effective, then nudging to knowledge will become reality. In their replies Neil Levy (2021) and Jonathan Matheson and Valerie Joly Chock (2021), put pressure on my argument from different angles. Levy thinks that a better case can be made for his view that nudging is giving testimonial reasons, and finds my objections to this view unconvincing. Matheson and Joly Chock, on the other hand, point out that acquiring knowledge through nudging (i.e. epistemic nudging) is compatible with evidentialism, even if nudging is not giving reasons. On their view, evidentialism provides an explanation of epistemic nudging that is superior to my own account, which, according to them, also suffers from a number of counterintuitive consequences. I am grateful to my critics for raising these concerns, because considering them deepens our perspective on the target phenomenon, and has made me think harder about the relevant epistemological issues. Nevertheless, I am convinced that my core claims can be defended against these criticisms. (shrink)

A key facet of Valerie Plumwood’s feminist critique of logic is her analysis of classical negation. On Plumwood’s reading, the exclusionary features of classical negation generate hierarchical dualisms, i.e., dichotomies in which dominant groups’ primacy is reinforced while underprivileged groups are oppressed. For example, Plumwood identifies the system collapse following from ex contradictione quodlibet—that a theory including both φ and ∼φ trivializes—as a primary source of many of these features. Although Plumwood considers the principle of excluded middle to be compatible (...) with her goals, that she identifies relevant logics as systems lacking a hierarchical negation—whose first-degree fragments are both paraconsistent and paracomplete—suggests that excluded middle plays some role in hierarchical dualisms as well. In these notes, I examine the role of excluded middle in generating oppressive homogenization and try to clarify the relationship between Plumwood’s critique and this principle from several contemporary perspectives. Finally, I examine the matter of whether Plumwood’s critique requires relevance or whether a non-relevant logic could satisfy her criteria and serve as a liberatory logic of difference. (shrink)

here was a brief inaugural session of the Association for the Scientific Study of Consciousness during the Psychonomic Society Conference in Los Angeles in November 1995, but the first full conference of the Association was held this June in the very pleasant surroundings of the Claremont Colleges. Being at this conference was very different from being at ‘Tucson II’ the previous year. This was a less ballyhooed, more intimate event, maybe less exciting, and less intellectually eclectic, but also perhaps more (...) conducive to serious scientific exchange. Certainly the roster of speakers was replete with luminaries of the consciousness studies movement, and highly respected names from psychology, neuroscience and philosophy: Christof Koch, Bernard Baars, Ned Block, Philip Merikle, Daniel Schacter, Larry Jacoby, Walter Freeman, Valerie Hardcastle, both Churchlands, Melvyn Goodale, Owen Flanagan . . . to unfairly pick out just a few. The essay examines solitude not as fate, sacrifice or passion, but as an experience that is actively initiated, that is perceived ambivalently, sometimes painfully, but also sensually, and that functions as context as well as occasion for the practice of cultural techniques – talking (to oneself), reading, writing, drawing or painting. Solitude techniques are analysed as “technologies of the self” (Michel Foucault) and “techniques of the body” (Marcel Mauss), as strategies for self-perception and “internal policy” (Paul Valéry). The history of (...) these self-techniques as solitude techniques is unfolded using examples from Stoic philosophy and early Christian theology. An emphasis is placed on self-doubling or splitting techniques: those who are alone with themselves also see themselves as more or less resilient objects that can be strengthened against the influences of other voices and people. Among the techniques of solitude is, above all, the quest for suitable places that are often – desert, sea, mountain peak, etc. – characterised not only by being devoid of humans, but also by a kind of uniformity. In this way, they resemble writing or drawing surfaces on which meanings can be brought to light through sketches or graphic characters. (shrink)

Robert Johnson argues that virtue ethical accounts of right action fail because they cannot take account of the fact that there are things we ought to do precisely because we do not possess virtuous character traits. Self-improving actions are his paradigm case and it would indeed be a problem if virtue ethics could not make sense of the propriety of self-improvement. To solve this serious problem, I propose that virtue ethics ought to define right action in terms of the virtuous (...) agent's reasons for action instead of defining right action in terms of the actions that the virtuous agent performs. I argue that this revised definition of right action makes sense of the rightness of self-improving actions and that it can be given a genuinely virtue ethical interpretation. (shrink)

China’s extensive media presence in Africa aims to distinguish itself through the use of constructive journalism in contrast with the perceived dominance of conflict journalism by Western media outlets. However, many scholars have raised questions of consistency surrounding Chinese media’s use of constructive journalism in representing Africa (e.g. Marsh, Citation2016). With perspectives from Galtung’s (Citation1987, p. 1998) conflict and peace journalism, this research applies Critical Discourse Analysis to examine Chinese media’s representation of Africa to an international audience. Using linguistic data (...) from China Radio International’s Today, it challenges the distinctions among peace journalism, solutions journalism and constructive journalism. The findings show that China’s claim of constructive journalism strongly favors the coverage of China, yet is largely absent in the coverage of the African continent. It suggests that while Chinese state-sponsored media utilizes the so-called constructive journalism when presenting information about a specific region to that region, these representations are not consistent across their international coverage. Hence, Africa remains a victim of conflict journalism. (shrink)

The aim of the book is to encourage discussion among experts on De ira, a text of philosophical nature, by reading it page by page, from a philosophical, philological, and literary perspective (a multidisciplinary choice which is the conditio sine qua non of all judicious research on Seneca). Moreover, the way in which each of these close readings is conducted adds an additional value: they each deal with a section of the text, presenting all the data necessary for its understanding. (...) All together, they cover the whole work. Each of them is also an attempt at a global interpretation of the treatise, examined through the particular framing of the textual passage around which the “Lectures plurielles” are conceived. Around this “polyphonic” analysis of the text, we have built a structure that aims to offer the reader a complete reference work on all the issues of the De ira. Sources, manuscript tradition, images, political and philosophical concepts, posterity – in short, all the aspects that a traditional commentary of the text would not have allowed us to distinguish so clearly – find their place here. Social problems such as racism, sexism, and inequality are often cited as structural rather than individual in nature. What does it mean to invoke a social structural explanation, and how do such explanations relate to individualistic ones? This article explores recent philosophical debates concerning the nature and usages of social structural explanation. I distinguish between two central kinds of social structural explanation: those that are autonomous from psychology, and those that are not. This distinction will help clarify the explanatory power (...) that each type of SSE has, points of convergence with methodological traditions such as critical theory and rational choice theory, and the difficulties that each type of SSE faces. Thomas Reid was a philosopher who founded the Scottish school of 'common sense'. Much of Reid's work is a critique of his contemporary, David Hume, whose empiricism he rejects. In this work, written after Reid's appointment to a professorship at the university of Glasgow, and published in 1785, he turns his attention to ideas about perception, memory, conception, abstraction, judgement, reasoning and taste. He examines the work of his predecessors and contemporaries, arguing that 'when we find philosophers maintaining that (...) there is no heat in the fire, nor colour in the rainbow … we may be apt to think the whole to be only a dream of fanciful men, who have entangled themselves in cobwebs spun out of their own brain'. Sugar, pork, beer, corn, cider, scrapple, and hoppin' John all became staples in the diet of colonial America. The ways Americans cultivated and prepared food and the values they attributed to it played an important role in shaping the identity of the newborn nation. In A Revolution in Eating, James E. McWilliams presents a colorful and spirited tour of culinary attitudes, tastes, and techniques throughout colonial America. Confronted by strange new animals, plants, and landscapes, settlers in the colonies and West (...) Indies found new ways to produce food. Integrating their British and European tastes with the demands and bounty of the rugged American environment, early Americans developed a range of regional cuisines. From the kitchen tables of typical Puritan families to Iroquois longhouses in the backcountry and slave kitchens on southern plantations, McWilliams portrays the grand variety and inventiveness that characterized colonial cuisine. As colonial America grew, so did its palate, as interactions among European settlers, Native Americans, and African slaves created new dishes and attitudes about food. McWilliams considers how Indian corn, once thought by the colonists as "fit for swine," became a fixture in the colonial diet. He also examines the ways in which African slaves influenced West Indian and American southern cuisine. While a mania for all things British was a unifying feature of eighteenth-century cuisine, the colonies discovered a national beverage in domestically brewed beer, which came to symbolize solidarity and loyalty to the patriotic cause in the Revolutionary era. The beer and alcohol industry also instigated unprecedented trade among the colonies and further integrated colonial habits and tastes. Victory in the American Revolution initiated a "culinary declaration of independence," prompting the antimonarchical habits of simplicity, frugality, and frontier ruggedness to define American cuisine. McWilliams demonstrates that this was a shift not so much in new ingredients or cooking methods, as in the way Americans imbued food and cuisine with values that continue to shape American attitudes to this day.
