Le droit de l’entreprise s’est « environnementalisé ». La protection de l’environnement est désormais partie intégrante de la réglementation économique. Pour comprendre quels ont été les effets du principe de développement durable sur l’entreprise et quelles sont les méthodes de gestion du risque environnemental utilisées par les opérateurs économiques, il est nécessaire de distinguer entre l’approche « produits » et l’approche « holistique ». L’approche « produits », c’est-à-dire l’approche centrée sur la conception et la consommation des marchandises ou des (...) services, a été développée en premier. L’approche « holistique », plus globale, a pour mission d’englober toute l’activité économique, de la production des biens et des services à leur distribution, en passant par le financement de l’activité et le transport des biens. Sans prétendre à l’exhaustivité, sont présentés de nombreux dispositifs relevant de modalités, de natures et de ressorts très divers : la sécurité des produits, la labellisation et la certification, la responsabilité sociale et environnementale, le devoir d’information, le devoir de vigilance, le financement vert (avec les green bonds ). Le législateur cherche à accroître la place de la médiation devant les tribunaux et, plus généralement, dans le droit. Cependant cela ne peut se faire sans une réflexion sur les règles que le médiateur doit appliquer et sur sa responsabilité en cas de non-respect des diverses garanties de la qualité de la médiation. Pour bien comprendre la responsabilité du médiateur, il faut dresser une liste de ses nombreuses obligations.

La justice prédictive séduit en ce qu’elle promet une justice plus sûre et meilleure. Pourtant, sa dénomination même, son utilisation, ses symboles, sa légitimité et ses effets méritent d’être critiqués et discutés.

On parle beaucoup aujourd’hui de la nécessité d’imposer une formation aux médiateurs. Cette obligation n’existe pas encore mais elle impliquerait de déterminer précisément selon quel modèle on désire professionaliser la fonction de médiateur.

Les propositions de réforme de la responsabilité pour troubles anormaux du voisinage semblent claires et opportunes ; elles permettent au juge la recherche de solutions équilibrées entre le droit à la tranquillité, à une vie paisible et saine et les enjeux du vivre ensemble, qu’ils soient économiques, sociaux et environnementaux.

S’interroger sur les risques et les responsabilités juridiques liés à l’artificialisation du corps humain, c’est se demander quel est le rôle du droit pour répondre à ces nouveaux enjeux? Quel droit de l’artificialisation du corps humain, quel droit de l’hybridation homme-technologie pouvons-nous imaginer eu égard aux risques nouveaux? Ce serait un droit capable de surveiller la fabrication des dispositifs artificiels, d’éviter les risques, de garantir l’indemnisation des victimes de dysfonctionnements, enfin de protéger la personne humaine. Ainsi, le rôle du droit (...) est de trois ordres : premièrement, contrôler la mise sur le marché des dispositifs médicaux destinés au corps humain ; deuxièmement, protéger les victimes de dispositifs médicaux déficients ; troisièmement et plus généralement, protéger la personne humaine. Resumen La argumentación es una forma de discurso en la que un hablante defiende una postura en una discusión. El presente trabajo se enfoca en la complejidad argumentativa y los recursos evaluativos y evidenciales que caracterizan las disputas de niños de diverso nivel socioeconómico. Se analizaron 94 disputas entre niños de 4 años y otros niños (5 a 10 años) en situaciones de juego espontáneo registradas en hogares de sectores socioeconómicos medio y bajo. El análisis identificó diferencias marginales en la (...) complejidad argumentativa entre los grupos. Por su parte se hallaron diferencias significativas en recursos de evaluativos de emocionalidad y en los evidenciales deónticos y exclamativos a favor de los sectores de nivel socioeconómico bajo. Los sectores medios registraron un mayor empleo de expresiones de causalidad y conectores. Los resultados se discuten a la luz de los hallazgos de investigaciones previas. Abstract Argumentation is a type of discourse in which a speaker defends a claim in a discussion. The present work focuses on the argumentative complexity and the evaluative and evidential resources that characterize the disputes of children of different socioeconomic levels. We analyzed 94 disputes between 4-year-old children and other children (5 to 10 years old) in situations of spontaneous play registered in homes of middle and low socioeconomic status (SES). The analysis identified marginal differences in argumentative complexity between the groups. On the other hand, significant differences were found in evaluative expressions of emotion and in deontic and exclamatory evidential markers, more frequently used by the low SES group. The mid SES group tends to use a higher number of expressions of causality and connectors. The results are discussed with reference to the findings of previous research. (shrink)

Robert Johnson argues that virtue ethical accounts of right action fail because they cannot take account of the fact that there are things we ought to do precisely because we do not possess virtuous character traits. Self-improving actions are his paradigm case and it would indeed be a problem if virtue ethics could not make sense of the propriety of self-improvement. To solve this serious problem, I propose that virtue ethics ought to define right action in terms of the virtuous (...) agent's reasons for action instead of defining right action in terms of the actions that the virtuous agent performs. I argue that this revised definition of right action makes sense of the rightness of self-improving actions and that it can be given a genuinely virtue ethical interpretation. (shrink)

Su principal objeción, como bien ya se deja ver en Ley y juicio, es que esta teoría se queda en la pura abstracción de los textos jurídicos y no toma en consideración los aspectos concretos de la realidad a la que las categorías normativas se deben aplicar Este trabajo pretende justificar que ya en estos textos tempranos el pensador alemán identifica que uno (...) de los principales problemas del positivismo jurídico radica en el hecho de que se construye sobre la base de una interpretación ontológica del ser humano que resulta inadecuada. En particular, argumentaremos que Schmitt aboga por una comprensión del fenómeno jurídico que se erija sobre la base de la consideración de la existencia humana concreta, lo que importa, a su vez, el reconocimiento de ciertas estructuras fundamentales y originarias que operan en todo conocimiento humano. ABSTRACT In his first legal texts, Schmitt repeatedly engages in criticizing what is known as “legal positivism”'. His main objection, as it is well seen in Law and Judgment, is that this theory remains in the pure abstraction of legal texts and does not take into account the concrete aspects of reality to which the normative categories should apply. This work aims to justify that in those first texts, the German thinker identifies that one of the main issues of legal positivism lies in the fact that it is built based on an inadequate ontological interpretation of the human being. In particular, we will argue that Schmitt defends an understanding of the legal phenomenon that is constructed based on the consideration of concrete human existence, which in turn means the recognition of certain fundamental and original structures that operate in all human knowledge. China’s extensive media presence in Africa aims to distinguish itself through the use of constructive journalism in contrast with the perceived dominance of conflict journalism by Western media outlets. However, many scholars have raised questions of consistency surrounding Chinese media’s use of constructive journalism in representing Africa (e.g. Marsh, Citation2016). With perspectives from Galtung’s (Citation1987, p. 1998) conflict and peace journalism, this research applies Critical Discourse Analysis to examine Chinese media’s representation of Africa to an international audience. Using linguistic data (...) from China Radio International’s Today, it challenges the distinctions among peace journalism, solutions journalism and constructive journalism. The findings show that China’s claim of constructive journalism strongly favors the coverage of China, yet is largely absent in the coverage of the African continent. It suggests that while Chinese state-sponsored media utilizes the so-called constructive journalism when presenting information about a specific region to that region, these representations are not consistent across their international coverage. Hence, Africa remains a victim of conflict journalism. (shrink)

Social problems such as racism, sexism, and inequality are often cited as structural rather than individual in nature. What does it mean to invoke a social structural explanation, and how do such explanations relate to individualistic ones? This article explores recent philosophical debates concerning the nature and usages of social structural explanation. I distinguish between two central kinds of social structural explanation: those that are autonomous from psychology, and those that are not. Sugar, pork, beer, corn, cider, scrapple, and hoppin' John all became staples in the diet of colonial America. The ways Americans cultivated and prepared food and the values they attributed to it played an important role in shaping the identity of the newborn nation. In A Revolution in Eating, James E. McWilliams presents a colorful and spirited tour of culinary attitudes, tastes, and techniques throughout colonial America. Confronted by strange new animals, plants, and landscapes, settlers in the colonies and West (...) Indies found new ways to produce food. Integrating their British and European tastes with the demands and bounty of the rugged American environment, early Americans developed a range of regional cuisines. From the kitchen tables of typical Puritan families to Iroquois longhouses in the backcountry and slave kitchens on southern plantations, McWilliams portrays the grand variety and inventiveness that characterized colonial cuisine. As colonial America grew, so did its palate, as interactions among European settlers, Native Americans, and African slaves created new dishes and attitudes about food. McWilliams considers how Indian corn, once thought by the colonists as "fit for swine," became a fixture in the colonial diet. He also examines the ways in which African slaves influenced West Indian and American southern cuisine. While a mania for all things British was a unifying feature of eighteenth-century cuisine, the colonies discovered a national beverage in domestically brewed beer, which came to symbolize solidarity and loyalty to the patriotic cause in the Revolutionary era. The beer and alcohol industry also instigated unprecedented trade among the colonies and further integrated colonial habits and tastes. Victory in the American Revolution initiated a "culinary declaration of independence," prompting the antimonarchical habits of simplicity, frugality, and frontier ruggedness to define American cuisine. McWilliams demonstrates that this was a shift not so much in new ingredients or cooking methods, as in the way Americans imbued food and cuisine with values that continue to shape American attitudes to this day. To what extent should we focus on implicit bias in order to eradicate persistent social injustice? Structural prioritizers argue that we should focus less on individual minds than on unjust social structures, while equal prioritizers think that both are equally important. This article introduces the framework of transactive memory into the debate to defend the equal priority view. The transactive memory framework helps us see how structure can emerge from individual interactions as an irreducibly social product. If this is right, (...) then debiasing interventions are structural interventions. One upshot is that the utility of the individual versus structural distinction is not apparent for the purposes of intervention. (shrink)

Practical wisdom (hereafter simply ‘wisdom’), which is the understanding required to make reliably good decisions about how we ought to live, is something we all have reason to care about. The importance of wisdom gives rise to questions about its nature: what kind of state is wisdom, how can we develop it, and what is a wise person like? These questions about the nature of wisdom give rise to further questions about proper methods for studying wisdom. Is the study of (...) wisdom the proper subject of philosophy or psychology? How, exactly, can we determine what wisdom is and how we can get it? In this chapter, we give an overview of some prominent philosophical answers to these questions. We begin by distinguishing practical wisdom from theoretical wisdom and wisdom as epistemic humility. Once we have a clearer sense of the target, we address questions of method and argue that producing a plausible and complete account of wisdom will require the tools of both philosophy and empirical psychology. We also discuss the implications this has for prominent wisdom research methods in empirical psychology. We then survey prominent philosophical accounts of the nature of wisdom and end with reflections on the prospects for further interdisciplinary research. (shrink)

This paper argues that some widely used laws of implication are false, and arguments based upon them invalid. These laws are Exportation, Commutation, (as well as various restricted forms of these), Exported Syllogism and Disjunctive Syllogism. All these laws are false for the same reason – that they license the suppression or replacement in some position of some class of propositions which cannot legitimately be suppressed or replaced. These laws fail to preserve the property of sufficiency of premiss set for (...) conclusion. They are false, and can be seen to be false, independently of their respon- sibility for the paradoxes. Hence the main ‘independent’ argument for the paradoxes – that they follow from an allegedly immaculate set of laws – is undermined. Counterexamples to all these laws are produced. (shrink)

Ethical dilemmas and decision-making are a persistent feature of the everyday operations of animal shelters and animal protection organizations. These organizations frequently face difficult decisions about how to treat the animals in their care, decisions that are made all the more difficult by limited funding, material resources, and human labor. Moreover, animal protection organizations must also determine how to act within and toward the wider social and institutional environment in which non-human animals are routinely exploited. The first section of The (...) Ethics of Animal Shelters contains practical recommendations developed by ethicists in response to the ethical challenges identified by employees of the Montreal Society for the Prevention of Cruelty to Animals. These challenges arise across the organization's activities, including its internal structure; shelter operations; public campaigns and advocacy work; dealing with the public, animal agriculture and governmental agencies; and their work with feral animals. The second section offers philosophical analyses of the ethical challenges unique to animal shelters. Issues explored include the killing of shelter animals; shelter animals' diets; medical decision-making procedures; adoption policies; and the role shelters might play in transforming social attitudes and norms. It is commonly accepted that what we ought to do collectively does not imply anything about what each of us ought to do individually. According to this line of reasoning, if cooperating will make no difference to an outcome, then you are not morally required to do it. And if cooperating will be personally costly to you as well, this is an even stronger reason to not do it. However, this reasoning results in a self-defeating, yet entirely predictable outcome. If (...) everyone is rational, no one will cooperate, resulting in an aggregate outcome that is devastating for everyone. This dismal analysis explains why climate change and other collective action problems are so difficult to ameliorate. The goal of this paper is to provide a different, exploratory framework for thinking about individual reasons for action in collective action problems. I argue that the concept of commitment gives us a new perspective on collective action problems. Once we take the structure of commitment into account, this activates requirements of diachronic rationality that give individuals instrumental reasons to cooperate in collective action problems. On this paper, we intend to make a psychological description of Creon as presented in Antigone, Sophocles tragedy. First, we will make a general description of the narcissistic personalities, based on the descriptions that the DSM-V and some authors make of this personality disorder. Then we will show that Creon’s case corresponds to this psychological description and intend to study the cause of his behavior. Finally, we will answer possible objections that could be made to the fact that we are (...) applying psychological categories to the Greek tragedy. Based on Kierkegaard’s description of the Greek tragedy, we will show that it cannot be understood on purely moral terms and how psychoanalysis allows us to rescue the tragic character of Creon. The number of distributors selling Fair Trade products is constantly increasing. What are their motivations to distribute Fair Trade products? How do they organise this distribution? Do they apply and communicate the Fair Trade values? This research, based on five case studies in Switzerland, aims at understanding and structuring the strategies and the managerial practices related to Fair Trade product distribution, as well as analysing if they denote an engagement with Fair Trade principles. The results show a high heterogeneity of (...) strategies and engagement. In general, strategies implemented by mainstream actors contribute to increase Fair Trade global sales but do not convey the transformative message of Fair Trade through their engagement. The latter is rather communicated through alternative channels. Problems and potential solutions to this issue are discussed. (shrink)
