This paper articulates a functionalist account of intra-party democracy (IPD). Like realist critics, we insist that IPD practices be evaluated on the basis of whether they facilitate resistance to domination and capture at the level of the polity as a whole, and therefore accept certain realist worries about IPD. Yet realists neglect the possibility that wealthy interests could control the political agenda by capturing all viable parties simultaneously-and that mass-facing IPD could counter this threat of oligarchic agenda capture. Taking this (...) as the key function of IPD within broader democratic systems, we conclude that inclusionary party reform is less urgent in more flexible party systems, where dissenters are better able to resist this threat from within the framework of inter-party competition. Regardless of the context, meanwhile, we also conclude that mass-facing IPD practices should aim at enabling ordinary members and supporters of a party to resist agenda capture by oligarchic interests. Though we stop short of defending any particular set of reforms, we reject the emphasis of recent IPD advocates on individualized forms of deliberative participation, in favor of a more oppositional and collectively-oriented approach-on the grounds that the latter is more likely to encourage the development of effective institutions of countervailing power. This paper explores how political parties should be regulated in jurisdictions with anti-defection laws, which constitutionalise parties’ control over the legislative process. It begins by arguing that parties in such jurisdictions should be understood as neither private organisations nor quasi-public bodies but as legislative entities. Next, it argues that recognising the legislative status of the party should affect how we think about the legal regulation of its internal affairs. In particular, the law may justifiably demand that decision-making power within the (...) extra-parliamentary party be dispersed across multiple persons and not concentrated in the hands of a few. Finally, I examine the implications of this argument for India and Pakistan, two jurisdictions with anti-defection laws in place. (shrink)

Narain, Vin It seems that primitive man, everywhere and in every culture, had an instinctive belief in some sort of existence after death. For the primitive psyche perhaps there was no other way to come to terms with the dread and mystery of death. As the traditional religions evolved, elaborate myths were created, claiming that every man had an immortal soul that survived his bodily death. In a masterstroke (deliberate or otherwise) traditional religions linked the fate of this immortal (...) soul with good behaviour in this life. Ordinary people, conditioned as they were from early childhood to adapt to regimes of earthly reward and punishment, readily accepted this vastly magnified scheme of reward and punishment that extended into eternity. Morality, which really had its roots in human nature, became a prisoner of reward and punishment. 'RAP morality' is perhaps a good name for it. RAP morality gave religion an iron grip on the lives of people. (shrink)

This essay addresses tensions within political philosophy between group rights, which allow historically marginalized communities some self-governance in determining its own rules and norms, and the rights of marginalized subgroups, such as women, within these communities. Community norms frequently uphold patriarchal structures that define women as inferior to men, assign them a subordinate status within the community, and cut them off from the individual rights enjoyed by women in other sections of society. As feminists point out, the capacity for voice (...) and exit cannot be taken for granted, for community norms may be organized in ways that deny women any voice in its decision-making forums as well as the resources they would need to survive outside the community. This essay draws on research among the Gond, an indigenous community in India, to explore this debate. Given the strength of the forces within the community militating against women’s capacity for voice or exit, the question motivating our research is: Can external organizations make a difference? We explore the impacts of two external development organizations that sought to work with women within these communities in order to answer this question. (shrink)

The aim of this paper is to explain the emergence and use of DNA fingerprinting technology in India, noting the specific concerns faced by the Indian Legal System related to the use of this novel forensic technology in the justice process. Furthermore, the proposed construction of a National DNA Data Bank is discussed taking into consideration the challenges faced by the government in legislating the DNA Bill into law. A critical analysis of the DNA Technology (Use and Application) Regulation Bill, (...) 2019 is provided to throw light upon many ethical, social, and legal issues that need to be addressed before the operationalization of the Bill to ensure that this technology is governed democratically to protect the civil liberties of citizens. _Riassunto_: Il presente lavoro proporre una rassegna che consideri il fenomeno delle allucinazioni uditive da due diverse prospettive: quella neurobiologica e quella fenomenologica. La neurobiologia indaga i meccanismi cerebrali correlati alle _allucinazioni uditive_, focalizzandosi sulla presenza di attivazioni neurali anomale; la fenomenologia, diversamente, si concentra sui processi psichici, mostrando come i pazienti hanno difficoltà a distinguere le sensazioni causate dalle proprie azioni da quelle che derivano da influenze esterne. Queste prospettive non sono mutualmente esclusive. Phenomenology pays attention to psychic processes, demonstrating that patients have difficulty distinguishing sensations caused by their own actions from those derived from external influences. These two perspectives are not mutually exclusive. In this paper we claim, first, that there are high-level visual experiences of grouping properties, i.e., properties that an array of elements we see can have to be organised in a certain way. Second, we argue that there are auditory experiences of groupings that share certain important properties with visual experiences of groupings, thereby being perceptual and high-level as well. Third, these results enable us to understand the nature and structure of our meaning experiences. We claim that, although meaning experiences (...) depend on the auditory experiences we discuss, they are not perceptual, for they lack one of the features that make those auditory experiences perceptual; namely, being holistically attended to.
