The aim of this paper is to provide (by using Dunn semantics) dual equivalent two-valued under-determined and over-determined interpretations for Ł3, Ł3a (...) and Ł3b. The logic Ł3 is axiomatized as an extension of Routley and Meyer’s basic positive logic following Brady’s strategy for axiomatizing many-valued logics by employing two-valued under-determined or over-determined interpretations. We analyze selected iterated conditionals in the framework of conditional random quantities. We point out that it is instructive to examine Lewis's triviality result, which shows the conditions a conditional must satisfy for its probability to be the conditional probability. In our approach, however, we avoid triviality because the import-export principle is invalid. We then analyze an example of reasoning under partial knowledge where, given a conditional if A then Cas information, the probability of A should intuitively increase. We (...) explain this intuition by making some implicit background information explicit. We consider several iterated conditionals, which allow us to formalize different kinds of latent information. We verify that for these iterated conditionals the prevision is greater than or equal to the probability of A. We also investigate the lower and upper bounds of the Affirmation of the Consequent inference. We conclude our study with some remarks on the supposed "independence" of two conditionals, and we interpret this property as uncorrelation between two random quantities. 2020 Elsevier Inc. Two experiments using a realistic version of the selection task examined the relationship between participants' probability estimates of finding a counter example and their selections. Experiment 1 used everyday categories in the context of a scenario to determine whether or not the number of instances in a category affected the estimated probability of a counter-example. Experiment 2 modified the scenario in order to alter participants' estimates of finding a specific counter-example. Unlike Kirby 1994a, but consistent with his proposals, both studies (...) showed that probability estimates significantly predicted selection. Overall results point to the value of understanding selections in terms of their subjective expected utility. (shrink)

In this paper, I intend to defend the following hypothesis: Foucault's definition of politics from 1979, i.e. the game between heterogeneous governmentalities, overdetermines the two other dimensions of the concept: the warlike or antagonistic relationship between subjects and the resistance of a form of subjectivation against a governmentality. To this end, I address the problem of the possible relationship between overdetermination and the Foucauldian concept of politics. In this sense, Laclau and Mouffe’s work and Althusser’s criticism delimit the field of (...) inquiry, although they do not exhaust it. This contrast will serve to bring to light the implications of a Foucauldian interpretation of overdetermination and thus describe Foucault’s critiques of the poststructuralist model for political thought. From this, I intend to state the fact that Mouffe’s latest writings seem to be oriented towards avoiding the risks that Foucault pointed out, bringing her reflection close to that of the French philosopher. A simple Henkin-style completeness proof for Gödel 3-valued propositional logic G3 is provided. The idea is to endow G3 with an under-determined semantics of the type defined by Dunn. The key concept in u-semantics is that of “under-determined interpretation”. It is shown that consistent prime theories built upon G3 can be understood as u-interpretations. In order to prove this fact we follow Brady by defining G3 as an extension of Anderson and Belnap’s positive fragment (...) of First Degree Entailment Logic. (shrink)

Chapter 1: An Introduction: The ‘Semantic Sting’ Argument Describes Dworkin’s theory as concerning the conditions of legal validity. “A legal system is a system of norms. Validity is a logical property of norms in a way akin to that in which truth is a logical property of propositions. A statement about the law is true if and only if the norm it purports to describe is a valid legal norm…It follows that there must be certain conditions which render certain norms, (...) but not others, legally valid. Hence it also follows that there can be two types of disagreement over the truth or falsehood of propositions about the law. People can disagree over the question ‘What are the conditions of legal validity?’, in which case their disagreement is a theoretical one. Or they can agree on the conditions of validity, and disagree as to whether or not those conditions actually obtain in a given case or not.” Argues that the best way to interpret Dworkin’s ‘semantic-sting argument’ is as a general argument against conventionalism in legal positivism. Summarizes the outcome of Dworkin’s argument as follows: “[I]f Dworkin is right about the legal reasoning of lawyers and judges, conventionalism would be self-defeating: if lawyers and judges recognize as legally binding not only those norms which are uncontroversially identifiable under the Rule of Recognition, that is, if what they recognize as binding is not only source-based law, then conventionalism turns out to be false on its own terms. In other words, either law is not what lawyers and judges think that it is, in which case law is not a matter of conventions, or – if it is what lawyers and judges think – conventionalism is false, as they do not see the law as purely a matter of conventions.” Dworkin’s theory, then, is a new conception of jurisprudence aiming to present itself as a rival to conventionalism. The book will be concerned with re-examining positivism in light of the interpretative challenge. Chapter 2: Meaning and Interpretation “[R]oughly, interpretation can be defined as an understanding or explanation of the meaning of an object.” Interpretation in this narrow sense is distinct from a less formal and broader use of interpretation that makes it equivalent to explanation. “Hence also, only those objects which are capable of bearing some meaning qualify as objects of interpretation.” [Why shouldn’t we think of interpretation as object-identification? This seems to be closer to what Dworkin has in mind.] Thus, a consideration of the philosophical work on meaning is appropriate. First, a consideration of Davidson on interpretation. The thesis is that Davidson’s “radical interpretation” can only account for sentence meaning and not for linguistic interpretation in general. Davidson cannot account for the non-rule-governed aspects of communication. “Semantics, as opposed to interpretation, concerns those aspects of communication which are rule or convention governed…but such rules are normally unavailable as reasons or justifications for an interpretation. On the contrary, interpretation is usually required because the issue is not determined by rules or conventions.” Interpretation, rather, is parasitic with understanding the meaning of an expression and not equivalent with it. As Dummett notes, any reflection on the meanings of words assumes prior knowledge of ordinary meanings. “This leads to the conclusion that understanding or explaining the meaning of an expression and interpreting it, are two conceptually separate things. It also indicates that seman ics can only be employed, if at all, to elucidate the concept of interpretation by way of contrast: interpretation concerns those aspects of communication which are under-determined by semantic rules or conventions.” Pragmatics, the study of problems posed by discrepancies between utterer’s meaning and sentence meaning, would seem to be closer to inquiry into interpretation. Both are concerned with understanding how meaning is possible where conventional rules leave off. Contemporary pragmatics, moreover, recognizes the logically indeterminate character of communicative inferences beyond conventional meaning and that the contextual conditions that account for the possibility cannot be realized in the semantic structure of the sentence. However, different criteria of success may be at work in pragmatics than interpretation. Pragmatics is concerned with how communication is achieved and thus the criteria of success would be grasping a speaker’s intentions. Many think, however, that communication is unimportant in certain spheres of communication, e.g. artistic interpretation, and that in these cases the aim of interpretation is not to uncover the actual artist’s intentions. What kind of meaning is interpretation aimed at then? It cannot be the meaning the object has for the interpreter. “Interpretation purports to be a statement about the object interpreted, not about the subject who offers the interpretation…it is crucial to remember that not everything we say about a work of art, or any other text, amounts to an interpretation of it. Only those aspects of a text which can shed light on its meaning form part of the text’s interpretation. What the text means for someone rarely entails anything about what the text means.” [This is puzzling to some extent for it remains somewhat ambiguous what it means to talk of subject-independent meaning.] Interpretive meaning attribution is, rather, counterfactual. “In general, I will suggest that the answer to this question consists in the fact that meaning is assigned by a counterfactual statement. Given that x is the meaning attributed to, for instance a text T, and x is not the literal meaning of T, nor is it the meaning of T intended by its author, then the attribution of meaning x to T can only be understood as the contention that on the basis of certain assumptions a certain fictitious or stipulated speaker would have meant x by expressing T.” Thus, on this account, interpretation, when it does not concern an actual speaker, turns out to be a kind of counterfactual intention attribution. Twofold point: “First, that interpretation is essentially a matter of attributing intentions, that is, in the pragmatics sense of ‘meaning’, namely, meaning that such-and-such by an act or expression. At the same time, interpretations need not be based on the intentions of actual authors; the meaning of an act or expression is understandable in terms of counterfactual intentions.” [Are we really restricted to understanding the coherence and integrity of meaning in such a way? Presumably the author is a kind of device for organizing meaning, much like Dworkin’s integrity, but need it take that format?] The logic of interpretation is typically reducible to intention attribution. [What role does the counterfactual author play in structuring meaning?] The criteria of interpretive success will depend upon the object, whether it is the real author or the counterfactual author. If the former, success will depend upon the retrieval of the author’s actual intentions. “Likewise, if the author is characterized in terms of some ideal representative of a certain genre, for instance, the presumptions which are taken to determine this c aracterization would provide the criteria of success for the particular interpretation offered.” [The criteria of success would seem, then, to be the principles, ideals, etc. that we attribute to the counterfactual author. These attributed qualities would be doing all the work – is the attribution of intention to the hypothetical author, then, really necessary at all?] [Does this account presuppose a weird dichotomy between what an object is and what it means? This dichotomy is different, if present at all, in Dworkin.] Chapter 3: Dworkin’s Theory of Interpretation and the Nature of Jurisprudence Three main insights of Dworkin’s theory of interpretation: “First, that interpretation strives to present its object in its best possible light. Second, that interpretation is essentially genre-dependent. And third, that there are certain constraints that determine the limits of possible interpretations of a given object.” Why the best light? Dworkin doesn’t really address this question in depth but claims that otherwise we are left with no way of justifying and choosing an interpretation or we are left with the author’s intention model, which we should reject. [Marmor doesn’t seem clear on what precisely it means to present something in its best light – seems to conflate it with most appealing light which, I take it, is different than what Dworkin has in mind.] “Dworkin is quite right to maintain that without having some views about the values inherent in the genre to which the text is taken to belong, no interpretation can take off the ground. The values we associate with the genre partly, but crucially, determine what would make sense to say about the text, what are the kinds of meaning we could ascribe to it.” There is no necessity for an interpretation to present an object in its best light with regards to the genre it is taken to be part of. Interpretations “could simply strive to present it in a certain light, perhaps better than some, worse than others, but in a way which highlights an aspect of the meaning of the text which may be worth paying attention to for some reason or another.” [What kind of reasons would count in choosing to present it in one light rather than another?] There is simply zero grounds for Dworkin’s assertion that we have no reason to pay attention to an interpretation that does not present it in its best light. Take a psychoanalytic interpretation of Hamlet, for example – not the best light, but a legitimate one. [This seems related to the next criticism – clearly Dworkin would have to loosen his insistence on the best, though not to detriment.] Moreover, especially with regards to art, it doesn’t appear possible to make an all things considered judgment about the best interpretation given the incommensurability of different values that are taken to inhere in a given genre. [Dworkin can respond here that we may have different available interpretations that could be justified with respect to the relevant value. Moreover, a lack of common denominator does not prevent any comparison whatsoever.] Constructive interpretation concerns social practices constituted by norms – it imposes a purpose or value rendering intelligible the normative character of the practice. There is a separate aspect of constructive interpretation that maintains that elements of the practice are sensitive to the point of the practice. It is important to note that different social practices will institutionalize themselves in different ways – thus, different practices will establish varying conditions on how the practice can be altered. The position of the positivists is that evaluative judgments concerning what the law should be are insufficient for determining what the law is given the nature of law’s institutionalization.&nb p; [This would seem to reside on a certain conception of law, i.e. an interpretation about where the value of law lies.] “[T]his being one of the main points of dispute between Dworkin and his positivist opponents, Dworkin cannot at this initial state presume law to be sensitive to its value in the manner that other, non-institutional practices might be, without incurring the charge of having assumed the very point at issue.” The upshot for Dworkin is that any explanation of a social practice such as law requires the same kind of reasoning as participation in that practice. This will be called the hermeneutic thesis. We can try to reconstruct a justification for this view based on the necessity of shared background assumptions – but this will not do since Dworkin’s claim is stronger: it contends that participants’ and theorists’ must “adopt one and the same normative point of view.” [The sense of normative here is unclear. It is true, though, that shared background assumptions do not imply viewing the law as valuable in any particular way, or at least it does not imply this in any strong sense.] Dworkin makes two distinct points with the hermeneutic thesis: “First, that the explanation of a social practice, like law or the arts, is essentially interpretative, and as such, necessarily value laden. Second, that the interpretation of such social practices, which Dworkin calls ‘argumentative’, is unique in the sense that the practice itself is an evaluative enterprise, and that therefore the interpreter of such a practice must form an evaluative judgment of her own about those values which are inherent in the practice that she purports to interpret.” [As stated, the first thesis is terribly ambiguous – for Dworkin, it clear implies a commitment to constructive interpretation. For Marmor, who accepts it, it is totally unclear what commitment he intends to make. He seems to mean simply that we have criteria for success concerning what counts as a successful explanation.] Mamor denies the second thesis. “What Dworkin seems to ignore here is that there is a crucial difference between forming a view about the values which are manifest in a social practice, like law, and actually having evaluative judgments about them.” [The problem, however, it that it is a contentious matter what values are part of the law – a theorist’s account of what values are constitutive of a particular legal system must rely on the kind of arguments which participants rely on. Of course, a theorist might simply note a debate about values and attempt to remain agnostic, but this will fail to be a full theoretical account of what law is!] Dworkin’s thesis seems to depend exclusively on his account of constructive interpretation. [This seems exactly right.] Chapter 4: Coherence, Holism, and Interpretation: The Epistemic Foundation of Dworkin’s Legal Theory Begins with discussion of Rawls’ reflective equilibrium. Sums up dual criticism as follows: “[T]he assumption that intuitions are independently true and the converse one, that their truth depends on fitting a coherent scheme, both seem to yield paradoxical results.” Dworkin, in his article “The Original Position”, claims that Rawls cannot commit himself to ethical realism. “[T]he natural model presupposes some form of ethical realism, while the constructive model does not. One important difficulty arising from an attempt to apply the natural model to Rawls is, that under the natural model, any theory which dopes not account for an intuition, at least for one which is held firmly, cannot be wholly satisfactory, just as scientific theory which does not account for certain observational data it is supposed to cover, would not be satisfactory in a familiar way.” Rawls, rather, is committed to a constructivist view of morality. Moreover, the reason we value coherence epistemically in moral theory is that it itself is a value of political morality – fairness requires consistency and publicity in the application of moral standards. Marmor notes the following problem with such a view: “[I]f coherence is justified, as it is here, with reference to certain moral values, that is, a specific conception of fairness, then we face the following problem: the presupposed values of fairness must themselves be based upon intuitive convictions, in which case the question of their truth cannot be ignored. If they are taken to be true…we are driven back to the perplexities of the natural model.” Discusses, helpfully, the Fish/Dworkin debate. The upshot is that Dworkin’s interpretive model is best off if it commits itself to a Quineian holism. However, this undermines his distinction between internal and external skepticism since holism must deny that moral judgments constitute a closed system. [This analysis seems exactly right.] Endorses Simmonds view that Dworkin’s theory does not meet the requirements of complexity he identifies as necessary to avoid vicious circularity in interpretive judgments of fit and identity. Coherence is doing the work through and through and therefore the interpretive theory of law is circular. [Will require further investigation, though it is unclear how coherence is doing any work in the pre-interpretive stage. At this stage, the judgments, if interpretive, seem to be derived from different sources. In any case, using coherence as a value seems to be highly suspect.] Why doesn’t Dworkin just reject Fish’s assumptions: because of his jurisprudence. “If legal texts can have a meaning that is not entirely dependent on a process of interpretation, then it is at least sometimes the case that the law can simply be understood, and applied, without the mediation of interpretation. And if that is the case, then the argument from interpretation against legal positivism collapses. It is no longer the case that every conclusion about what the law is, depends on evaluative considerations about what it ought to be.” Chapter 5: Semantics, Realism, and Natural Law Assessment of Michael Moore’s legal realism and its implications. [The final criticisms of Moore are not decisive.] Chapter 6: Constructive Identification and Razian Authority A consideration of Dworkin’s denial that the communication model of interpretation is appropriate for legal interpretation. Marmor argues that intentions do play a crucial role in the identification of legal norms in a way that is incompatible with Dworkin’s “coherence thesis”. Marmor takes Dworkin to be committed to the constructive identification thesis: that the identification of something as part of the legal, artistic, etc. genre can be done sufficiently by evaluative considerations. “Here, one must maintain that evaluative considerations are sufficient to determine whether something is a legal norm or a work of art”. [Fit, however, constrains possible evaluative considerations – thus evaluative considerations are not sufficient in themselves.] “Now the crucial point here is this: if you maintain the possibility of constructive identification in art, you must assume that works of art can be identified as such on the basis of certain features they happen to possess, features which contain no reference to any particular intention to create a work of art…unless we take intentions into account, how can we discriminate between the concept of an aesthetic artifact and the con ept of a work of art?” [It is unclear, and I think false, that constructive interpretation of anything requires identifying something irrespective of an artificers intentions. Those intentions may be relevant, dependent upon the genre under which we are trying to classify the object. Nothing, seemingly, about constructive interpretation in general excludes this possibility.] Marmor’s point is that it turns out to be impossible to identify art as art without reference to an artist’s intentions – especially given the state of contemporary art. [It is notable that Marmor’s response to counterexample implicitly depends upon a fully developed theory of aesthetics. His cursory comments on the matter of identifying art seem insufficient to say the least.] The rest of the chapter considers the incompatibility of Raz’s account of authority with constructive interpretation. The incompatibilities mentioned do not move beyond what Raz identifies in his article “Authority, Law and Morality”, but a defense of this notion of authority is defended in several [inconclusive] respects. [Raz and Marmor want to separate identification from content. This is not clearly a defensible separation.] Chapter 7: No Easy Cases? Chapter defends notion that there is a distinction between easy and hard cases in the positivist sense. Takes a Hartian approach and ultimately defends the distinction by associating it Wittgenstein’s conception of rule following. The point is that one need to look the purpose of rule in order to understand what the rule requires. Chapter 8: Legislative Intent and the Authority of Law Examines the following doctrine concerning the role of legislative intent in adjudication: “[F]irst, it would hold that laws, at least in certain cases, are enacted with relatively specific intentions, and that this is a matter of fact which is discernible through an ordinary fact-finding procedure. Second, that in certain cases the presence of such a fact, namely, that the law was enacted with a certain intention, provides judges with a reason to decide the legal dispute in accordance with the relevant legislative intent.” [It is important that for Marmor, interpretive strategies are only appropriate in hard cases. However, we should wonder what grounds positivism can offer for deciding a hard case in any manner which is not the morally best manner according to the judgment of the judge. There are no legal grounds, by definition, in hard cases and so what justificatory strategy would endorse any judicial decision except for the morally best one?] We can ascribe intentions to a legislative body, when this is possible at all, by taking the shared intentions of the majority, rather than some group intention, to be the significant intentions. Moreover, we should expect a good deal of consensus about intentions for otherwise it is hard to explain how legislative bodies are able to produce so much legislation. Discussion of kinds of intentions concludes as follows: “I have distinguished between three main types of intention that are potentially relevant from the legal point of view. Apart from the intentions that are manifest in the language of the law itself, legislators typically have further intentions in enacting a given law, and sometimes they would have certain intentions bearing on its proper application. I have also suggested that some of these further intentions may be essentially non-avowable, in which case they are rendered initially irrelevant. Finally, I have pointed out that considerations of consistency require that the legislator’s application intentions be taken into account only if, and to the extent that, they are in accord with his further intentions.” The manner in which intentionalism is to be justif ed relies on the distinction, Marmor maintains, between expert and mere collective action authority. “The point I wanted to make is strictly conditional: if, and only if, a certain law is justified on the basis of the expertise branch of the normal justification thesis, would it make sense to defer to the legislature’s intentions in the interpretation of the law, that is, to the extent that there is, in fact,; such an intention and it can clarify something that needs clarification.” Insofar as a legislature can be considered an expert on the matter requiring adjudication and interpretation should the body’s intention be taken into account. Chapter 9: Constitutional Interpretation Begins by laying out general necessary features of a constitution. Then Marmor moves on to consider general questions of constitutional legitimacy. First, he considers what grounds might be offered for the legitimacy of a constitution at all. He notes that the central question is what permits a single generation to bind future generations. He then examines four arguments to avoid this problem. The first is based on the moral legitimacy of the constitution; Marmor rejects this solution for the [truly dubious] reason that the constitution would make no practical difference because it would not supply reasons in addition to those provided by morality [but, presumably, the point is that these legally valid rules would be institutionally enshrined]. The second is based on the moral authority of the framers and Marmor rightly rejects this on the basis of the idealization of the framers it requires and less rightly on the basis that there cannot be moral authorities. Third is the “argument from interpretation” which claims that “as long as the particular content of the constitution is determined by its interpretation, and the authoritative interpretation at any time correctly instantiates the values which ought to be upheld in the community, the constitution would be morally legitimate”. The fourth is Raz’s which argues that a constitution is valid so long as its constraints are morally permissible because conventions of this type might aid the continuity of the legal system, i.e. it is important to have a convention of this type and the constitution is a kind of this type. Marmor appears to endorse these two approaches and concludes: “The conditions for the legitimacy of a constitution must comprise the following conditions. First, the values and principles enshrined in it must be morally permissible…Second, when certain choices are made in particular cases, they would be legitimate if they are either morally underdetermined, or else, morally correct…It follows from this that both arguments must assume that at least in those areas in which the constitution would make a moral difference, it can be interpreted to make the difference that it should, that is, according to the true moral principles that should apply to the particular case...the moral legitimacy of constitutions very much dependent on the practices of their interpretation. In other words, a great deal of the burden of moral legitimacy is shifted by these arguments to the application of the constitution, thus assuming that the constitution is legitimate only if the courts are likely to apply the constitution in a morally desirable way.” [This implies that the only significant value constitutions have is in providing a conventional practice where some such practice is required.] Moves on to argue that courts typically rely, and rightly so, on moral considerations when deciding constitutional issues because typically, in cases of the kind that reach the supreme or constitutional court, there is no law on the case. Much of this relies on his earlier discussion about the nature of interpretation in the law – that legal interpretation is always a matter of cha ging the law. (shrink)

Over the past decade, there has been an extensive debate about whether researchers have an obligation to disclose genetic research findings, including primary and secondary findings. There appears to be an emerging (but disputed) view that researchers have some obligation to disclose some genetic findings to some research participants. The contours of this obligation, however, remain unclear. -/- As this paper will explore, much of this confusion is definitional or conceptual in nature. The extent of a researcher’s obligation to (...) return secondary and other research findings is often limited by reference to terms and concepts like “incidental,” “analytic validity,” “clinical validity,” “clinical relevance,” “clinical utility,” “clinical significance,” “actionability,” and “desirability.” These terms are used in different ways by different writers to describe obligations in different sorts of cases. -/- Underneath this definitional confusion is a general notion, supported by much of the literature, that findings only need to be disclosed when they surpass certain presumably objective or measureable thresholds, such as medical importance or scientific reproducibility. The problem is that there is significant variability in the way that these terms and concepts are used in the literature and, as such, in defining the scope of an obligation to return findings that surpasses the relevant thresholds. -/- The goal of this paper is to analyze the definitional muddle underlying the debate about returning genetic research findings, with the hope of answering a few questions. First, what is the range of definitions being used in this debate? Based on an extensive literature review, Part 1 will lay out a range of articulated definitions for each relevant term, with the goal of categorizing them into a handful of distinct types. Part 2 explains the definitional redundancy and confusion in the current literature, and, drawing from the terminological patterns identified in Part 1, outlines more cohesive building blocks to inform the development of future disclosure frameworks.Our minimum goal in articulating these conceptual building blocks is to promote clearer articulations of, and distinctions between, future disclosure frameworks. More ambitiously, we suggest which definitions and conceptualizations we consider most appropriate to use in future disclosure frameworks. Here, we seek to balance benefits to participants through the disclosure of important information with the minimization of undue burdens on individual researchers and the research enterprise more generally. -/- Our analysis builds upon the central philosophical distinction between concepts and conceptions. The basic idea is that the “concept” of X refers to the general (and relatively uncontroversial) structure/shape of X, while various “conceptions” of X are more particular, filled out, and controversial elaborations of the concept. In other words, “concepts” of X will be formal representations of X, while “conceptions” of X will be substantive interpretations of the key elements and relationships operating within that formal framework. (Implicit in this distinction is an important point about the nature of disagreement – namely, that in order for two or more parties to “disagree” about X as opposed to simply talk past one another, there must be at least enough shared agreement about X to know that the parties are referring to the same thing. A concept of X provides this point of common agreement, while competing conceptions of X mark the areas where disagreement arises.) In this paper, we will employ this distinction in a fundamental way to clarify exactly where the primary disagreements arise in the debate over disclosing genetic research findings. -/- We propose that, underlying all the seeming confusion and disagreement, there are three central and widely agreed upon concepts at work in this debate—validity, value, and volition. The first two concepts concern the nature of the information itself. An obligation to disclose only exists when findings are valid and have value but there are competing conceptions of how to determine or define validity and valuableness. The third concept—volition—pertains not to the information but rather to the person to whom it will be disclosed. Does that person want or not want the information, and what is the best way of determining this? Here, too, competing conceptions arise. Our key point, though, is that almost all of the ethical disagreement arises because of competing conceptions of these three concepts. Understanding and appreciating this key point can help to refocus the substantive debate by providing some common ground to start from in determining how best to interpret these shared concepts. This refocusing can, ideally, produce more productive debate and facilitate some progress in resolving it. (shrink)

The determination of death by neurological criteria remains controversial scientifically, culturally, and legally, worldwide. In the United Kingdom, although the determination of death by neurological criteria is not legally codified, the Code of Practice of the Academy of Medical Royal Colleges is customarily used for neurological death determination and treatment withdrawal. Unlike some states in the US, however, there are no provisions under the law requiring accommodation of and respect for residents' religious rights and commitments when secular conceptions of (...) death based on medical codes and practices conflict with a traditional concept well-grounded in religious and cultural values and practices. In this article, we analyse the medical, ethical, and legal issues that were generated by the recent judgement of the High Court of England and Wales in Re: A [2015] EWHC 443. Mechanical ventilation was withdrawn in this case despite parental religious objection to a determination of death based on the code of practice. We outline contemporary evidence that has refuted the reliability of tests of brainstem function to ascertain the two conjunctive clinical criteria for the determination of death that are stipulated in the code of practice: irreversible loss of capacity for consciousness and somatic integration of bodily biological functions. We argue that: the tests of brainstem function were not properly undertaken in this case; the two conjunctive clinical criteria set forth in the code of practice cannot be reliably confirmed by these tests in any event; and absent authentication of the clinical criteria of death, the code of practice wrongly invokes a secular definition of death based on the loss of personhood. Consequently, the moral obligation of a pluralistic society to honor and respect diverse religious convictions to the greatest extent possible is being violated. Re A is contrasted with the US case of Jahi McMath in which the court accommodated parental religious objection to the determination of neurological death codified in the Uniform Determination of Death Act. We conclude that the legal system in the United Kingdom should not favour a secular definition of death over a definition of death that is respectful of religious values about the inviolability and sanctity of life. We recommend the legal recognition of religious accommodation in death determination to facilitate cultural sensitivity and compassionate care to patients and families in a pluralistic society. In this essay, I argue that at least in two phases of pharmaceutical research, especially while assessing the adequacy of the accumulated data and its interpretation, the influence of non-epistemic values is necessary. I examine a specific case from the domain of pharmaceutical research and demonstrate that there are multiple competing sets of values which may legitimately or illegitimately influence different phases of the inquiry. In such cases, the choice of the appropriate set of values—epistemic as well as non-epistemic—should be (...) made on the basis of the set’s viability to promote specific epistemic and social aims of the research, in the case at hand, rather than other competing aims. I put forth an account which addresses two philosophically significant and interrelated questions in the context of values in science debates: which aim should be prioritized when there are different stakeholders who try to achieve competing but, sometimes, conflicting goals; and what should be the criteria according to which the prioritization of a particular goal over other competing goals can be determined? I argue that both these questions can be addressed by invoking the principle of non-arbitrariness and the mere means principle and self-determination right. The philosophical import of raising and addressing these questions from an ethical perspective is that this approach leads to a better understanding of problems in today’s pharmaceutical research and guides us in efforts to alleviate these problems. ʿImād al-Dīn Ibn Kathīr (d. 774/1373), is an important historian, mufassir, muhaddith and Shāfiʿī jurist who lived in the 8th century. Ibn Kathīr’s work titled Tafseer al-Qurʾān al-ʿAẓeem, beside its tafsir identity, can be utilized due to its rich ḥadīth content and its comments on isnad and text of the ḥadīths. Ibn Kathīr, due to his competency in history and ḥadīth, analyzed the ḥadīth rigorously and noted any necessary aspect regarding the isnad or the text. In this paper, the analysis (...) and criticism of ḥadīth texts in Ibn Kathīr’s tafsir is examined. Regarding the analysis aiming to understand the meaning of the ḥadīth, issues such as explanation of unknown words, utilizing the chapter headings, evaluation of all related ḥadīths, comments of previous scholars as well as Ibn Kathīr’s original interpretations are examined. Regarding the criticism of the text, issues such as general criticism under the heading of munkar which indicates a ḥadīth the text of which contains unacceptable meanings, specific criticisms due to conflict with the Qurʾān, the Sunnah, reasoning and historical facts, solutions regarding the ḥadīths which have conflicting meanings are examined. Summary: Ibn Kathīr (d. 774/1373) who lived in the 8th century is a competent scholar in fields such as ḥadīth, history, tafsir and jurisprudence. In this article the criticism and analysis of ḥadīths in the Tafseer al-Qurʾān al-ʿAẓeem by Ibn Kathīr who is an authority in ḥadīth and history are studied. Although the structure and plan of this book do not give it an appearance of a classic ḥadīth commentary, the rich ḥadīth content which it has, and the examination of this content with respect to isnad and text as in a ḥadīth commentary provide this book a ḥadīth commentary identity besides its tafsir identity. Ibn Kathīr’s tafsir is distinguished among other tafsirs by the ḥadīth commentary method and ḥadīth criticism that it employs. This is because it does not only provide ḥadīths as is seen in many other tafsirs, but also informs about the important issues that need to be known about these ḥadīths, and even in many times makes original evaluations. It is possible that Ibn Kathīr provides important evaluations about a ḥadīth which other famous commentators do not provide. He corrects some of the great ḥadīth scholars by showing the presence of isnads for ḥadīths that these scholars think do not exist. With all these aspects, Tafseer al-Qurʾān al-ʿAẓeem is an invaluable source for both tafsir readers and ḥadīth scholars due to its rich ḥadīth content, the skillful application of ḥadīth methodology and ḥadīth commentary. Ibn Kathīr’s tafsir is also an important ḥadīth source due to its very rich ḥadīth content. According to the catalogue at the end of the book, it includes over eight thousand ḥadīths which corresponds to a content similar to that of Ṣaḥīḥ al-Bukhārī. Looking at the studies over Tafseer al-Qurʾān al-ʿAẓeem, it can be said that it has been subject to many examinations with respect to tafsir, however, it has not received the same attention with respect to ḥadīth at a sufficient level. It is aimed in this study on one side to prove the value and originality of Tafseer al-Qurʾān al-ʿAẓeem as a ḥadīth commentary and on the other side to attract attention to the text criticism activities of ḥadīth scholars by using both specific criteria and concepts such as munkar.In our study the criticism and analysis of ḥadīth texts in Ibn Kathīr’s tafsir are studied under various headings. It is quite important to identify possible mistakes in ḥadīth texts as well as to understand the ḥadīth texts correctly. For this purpose the principles of text criticism such as conflict with the Qurʾān, the Sunnah, reasoning and historical facts have been used since the time of the Companions. Ibn Kathīr has approached ḥadīths in view of these text criticism principles and pointed to the mistakes in the texts of the ḥadīths which are in conflict with these principles. Often times, Ibn Kathīr criticized the points in ḥadīth texts which are not in line with the general principles of Islam and which he perceived not appropriate by using the term munkar in a general manner. He utilized this concept explicitly for isnad and text. He always warned the reader against baseless information. Finally, he pointed out to instances which can be determined as a result of the comparison of the various channels of a ḥadīth. Text analyses are efforts to correctly understand the ḥadīth text which enable to clarify the meaning of the ḥadīth. Efforts such as the explanation of the unknown words, the evaluation of all the ḥadīths related to a subject in a unified manner, making use of another ḥadīth in understanding of a ḥadīth, making using of the opinions of the previous ḥadīth scholars and making original interpretations, identification of the unknown persons in the text, making connections with the chapter headings to better understand the meaning, explanations of the contradictions arising from different ḥadīths and collecting different historical ḥadīths in a common theme contribute to a better understanding of the meaning of ḥadīths. It can be seen clearly how Ibn Kathīr applied these text analyses with success through sample ḥadīth texts selected from his tafsir.Two points that we think important are underlined at the end of our study. First, it is the exceptional position of Tafseer al-Qurʾān al-ʿAẓeem among the Qurʾān tafsirs with respect to ḥadīth content and analysis. When compared with the famous tafsirs that emerge in the tafsir history, Ibn Kathīr’s tafsir is easily distinguished. When the importance of ḥadīth in the Qurʾān tafsir is thought, it is important that the ḥadīth material is filtered with respect to its authenticity and the meaning of the ḥadīth is clarified at a sufficient level. Compared to the limited number of ḥadīths in the famous tafsirs that are used to explain the verses, the rich information with respect to isnad and text in Tafseer al-Qurʾān al-ʿAẓeem makes significant contribution in the explanation of the verses and provide the reader with valuable ḥadīth knowledge.The second point that we think is important is that the text criticism efforts seen in Tafseer al-Qurʾān al-ʿAẓeem help to correct the opinion that ḥadīth scholars ignored text criticism compared to isnad criticism. In this respect, it is evaluated that our study is a contribution to the recent studies that shed light on the text criticism efforts of the ḥadīth scholars. In this regard, it seems important to make use of a criterion such as “conflict with the inner consistency of a ḥadīth” among other criteria. Moreover, it is pointed out in our study that the munkar concept and the thesis that this concept has been utilized by ḥadīth scholars in text criticism, is a topic which attracted the interest of the researchers and the usage of this concept in Ibn Kathīr’s tafsir contributes to this thesis. Robert Stalnaker contrasts two interpretations, semantic and metasemantic, of the two-dimensionalist framework. On the semantic interpretation, the primary intension or diagonal proposition associated with an utterance is a semantic value that the utterance has in virtue of the actual linguistic meaning of the corresponding sentence, and that primary intension is both what a competent speaker grasps and what determines different secondary intensions or horizontal propositions relative to different possible worlds considered as actual. The metasemantic interpretation reverses the order of (...) explanation: an utterance has the primary intension it has because it yields the secondary intensions it yields relative to different possible worlds considered as actual. In these possible worlds, the semantic facts can be different: the metasemantic interpretation is metasemantic in the sense that the secondary intensions are determined relative to possible worlds considered as actual given the meanings the expressions have there. Stalnaker holds a causal picture of the reference of names, according to which names have no meaning over and above their unique referent, and therefore maintains that the semantic interpretation is not an option. He thus endorses the metasemantic interpretation, while insisting that this interpretation does not, contrary to what he originally thought, yield any account of a priori truth and knowledge. My double aim in this paper is to show (i) that the metasemantic interpretation, as sketched by Stalnaker, is not compatible with one natural understanding of the causal picture of reference, on which names are rigid because they have their original bearers essentially , and (ii) that a third kind of interpretation of the framework is available, the metasyntactic interpretation, which grants that names have their bearers essentially and yields some account of a priori knowledge. The issue of gender is one of the important indicators for understanding religious interpretations at the individual and social levels. One of the responsible institutions in shaping the gender approach in Turkey are the Faculty of Theologies. The majority of the students who are studying in theology faculties and who will take part in the religious services of the society after completing their education are women. It is clear that the religion and gender understanding of female students of theology (...) faculties will have various levels of influence on the religious and social life of women and men in society, now and in the future. This article, which is studied with a qualitative research method, focuses on the religious and gender understanding of female students of theology faculty. The most basic conclusion reached in this article; the female students of the faculty of theology do not have a homogeneous understanding of religion and gender, they have traditional and modern approaches together. The students are mentally inconsistent and indecisive about many issues related to gender.Summary: Gender perceptions are One of the areas that have changed rapidly with the modernization processes. The issues concerning gender and religion recently have become a matter which is the subject of intense debate in Turkey. Theology faculties also take part as a party to the debates and tensions about gender and religion. This study focuses on the gender and religious understanding of the female students of the Faculty of Theology and to examine the intellectual and material factors that nurture them. The scope of the study was limited to Dicle University Theology Faculty female students. The data of the study was obtained by the qualitative research method. In this article, which takes the religion and gender understanding of female students of Theology Faculty as the main problem; the ontological value of women, the authority of men over women, the paid work and management of women in the public, the change of the Shari'ah provisions on gender with social change, the beating of women and the themes formed in this context are examined.The religious and social status of women in Muslim societies was not shaped by the Qur'an or practices of the Prophet, but by the discourse created by hadith narrations and the influence of economic and political conditions. The development of this discourse was also influenced by the image of the ‘seductive’ Eve and the patriarchal culture of Mesopotamia, which were inherited from the Jewish and Christian tradition.Women's social position within the traditional society structure was legitimized by religious traditions, some of which date back to pre-Islamic times, and by the contribution of the rising jurisprudence and ascetic movements in the historical process and has resisted change for centuries.Nearly all of the female students of the Faculty of theology consider that there is no difference between men and women ontologically in the context of the value that Allah gives to both sexes.According to them, the physical and emotional naivety of women cannot be interpreted as the ontological worthlessness of women or as their lack of intellect and religion.About half of female students think the final decision in the family should not always be in the male.According to them The Prophet's practices on this subject are a very important example. In some cases, he consulted his wives and followed their suggestions. Therefore, narrations that trivialize the thoughts and demands of women in the family have cultural and not religious influences.All female students think that women can work outside the home on a paid basis. Moreover, according to the vast majority of female students, women can be managers in the public sector. The students who are in this view think that the narrations stating that the woman cannot be a manager in the public can be ignored for reasonable reasons. About one-third of female students think that the Shari'a provisions in Islamic law regarding women and family may be able to changed with new jurisprudence, while one-third think that some of them may be able to changed with the change of social conditions. Another view shared by nearly a third of students is that Sharia provisions on gender will not be changed over time. Nearly two-thirds of the female students in the research sample do not approve of beating women under any circumstances. A third of female students think that a woman can be beaten if she disobeys her husband. Some of them are confused about how to interpret the verse about the beating of women.It is unthinkable that the Faculties of Theology, which cannot be an actor of religious social change, stay away from the wind of change of a rapidly modernizing society. The rapid flow of time of change on the one hand, and the absence of a tradition or strategy of the Faculties of Theology on the other, resulted in the Faculties of Theology becoming the object of social change in many contexts. This situation made the Faculty of Theology's understanding of religion hybrid, fragmented and unstable between traditional and modern approaches and quite open to the effect of political conjuncture. In this context, although the understanding of gender in theological faculties is not at the same level in all, it can be said that traditional understandings are in the form of a softened form in favor of modernity.The students of the Faculty of Theology at Dicle University are mostly grown up in the Eastern and Southeastern Anatolia regions and are generally members of the lower-middle societies. In most of the female students who come from a social structure where the social status of women is quite low and girls are regarded as worthless compared to boys, an awareness be formed about the social position of women during the education of the Faculty of Theology. Through the study of the Faculty of theology, female students realize that religion is not responsible for the otherized position of women, but for religionized traditions. Two main factors determining the gender understanding of women students of the Faculty of theology can be mentioned. These can be roughly categorized as the main sources of religion and their interpretation by denominations, as well as the socio-cultural habitats of the students and their individual experiences. On the subject of gender, there is a tension between verse, Hadith and their interpretations made by sects and the values and norms of modernity internalized by female students. At Dicle University Faculty of Theology, it is not possible to talk about a learning system and intellectual accumulation that would allow to overcome this tension. This causes mental and emotional bifurcation in female students and leads them to become caught up in a vortex between religious and social reality on many issues. An important consequence of this is the lack of updated religious norms to guide them in many issues that have emerged as an alternative to religious beliefs and practices in the context of gender and have become established values and have common practices in modern life, and have led them to modern secular tendencies and this leads to an internal secularization. The lack of updated religious norms to guide female students in many subjects that are widely practiced in Modern life leads them to modern secular tendencies, which lead to an insider secularization. How are we to understand the use of probability in Popper’s corroboration function? Popper says logically, but this raises a problem that becomes apparent when his views on logical probability are compared with those of Keynes. Specifically, Popper does not make it clear how we could have access to, or even calculate, probability values in a logical sense. For first, he would likely want to deny the Keynesian distinction between primary and secondary propositions, and the underlying notion of knowledge-by-acquaintance with (...) Neo-Platonic entities. Second, he would presumably reject not only the notion of non-numerical probabilities, but also the claim that the principle of indifference is aught other than a heuristic, given paradoxes such as Bertrand’s. An attempt might be made to solve this problem by appeal to semantic or possible world analyses over the relative truth-values of statements, but this seems to fail due to concerns relating to infinity: if the set of possible worlds in which p is true is infinite, and the set of possible worlds in which q is true is infinite, then no numerical value for P can be reasonably determined by a comparison between those worlds. As such, an all-too-familiar sort of criticism of Popper’s view of science seems to loom large: if the corroboration function only makes sense when the probabilities employed therein are subjective, then what counts as impressive evidence for a theory might seem to be a matter of convention, or even whim. However, we now have a new interpretation of probability at our disposal: the intersubjective interpretation, recently championed by Gillies, according to which probabilities can lie on a spectrum between the aleatory and the epistemic. It (...) is rarer to hear a philosopher asking questions about the general relationship between philosophy and science, even when, as in the cases above, the answer to this question provides the necessary ground for any specific investigation of the allegedly genuine philosophical problems arising in physics, biology, or cognitive science.The main difficulty lies in the intrinsic ambiguity of the term "science." On the one hand, "science" can be considered as a descriptive term: it is the genus of the empirically given, scientific disciplines (the "sciences," in the plural). On the other hand, "science" (episteme, scientia, Wissenschaft) (always in the singular) is a theoretical term that denotes a form of knowledge. More precisely, it refers, as philosophers say, to a "conceptually unified body of objective knowledge." Traditionally, the latter meaning includes philosophy itself within its denotation. In the context of two recent yet distinct philosophical debates—over choice under conditions of moral uncertainty and over transformative choices—several philosophers have implicitly adopted a thesis about how to evaluate alternatives of uncertain value. The thesis says that the value a rational agent ought to attach to an alternative under the hypothesis that the value of this alternative is x, ought to be x. I argue that while in some contexts this thesis trivially holds, in the (...) context of the two debates in which the thesis has been adopted, it does not. A practising lawyer is not always aware of the fact that case decisions are more determined by legal doctrine – attitudes of authoritative lawyers and scientific legal discussion of other forms – than by changes in positive law. Regulations of specific case decisions are directly reliant on the ideas and statements of legal discussions – as one of the factors influencing the decisions of the courts. During the twenty years of independence, the form, content and argumentation of the Lithuanian (...) court judgments has fundamentally changed, especially with regard to the understanding of the courts (the judiciary) in terms of how unrestrained they are when interpreting a legal text and making decisions. The judicial discretion to interpret a legal text is treated diversely in various legal traditions and within the scope of the western legal tradition itself. In common law countries, the competence of a judge to deviate from a legal text or to create their own legal framework is treated with much greater understanding. In civil law tradition, the attempts of judges to take over the functions of the legislature are usually considered more critically. Even the representatives of comparative law emphasise that judges in civil law tradition countries tend to call the creation of legal rules differently – mostly as interpretation of the law. The discussion on the power of judges to create law through its interpretation has been taking place everywhere and at all times. Judicial discretion in decision-making is not due to individual factors such as era, social structure, cultural background, but is determined by some other factors that are not easy to identify. The interpretative activity of the courts is also influenced by the prevailing doctrinal regulations of judicial activity. It is the changes of the Lithuanian legal doctrines that could have encouraged the courts to determine the scope of their activity in the direction of its growth. After the restoration of independence, the Lithuanian legal community began an active discussion on whether legal positivism was the correct form of legal understanding. Studies appeared, in which legal positivism was seen exclusively negatively, reminding that it was specifically this legal concept that had eliminated values from law and was likely to be blamed for the ills of humanity such as the Holocaust or genocide. Numerous publications emerged calling judges to be active and reminding them to check every rule of law in accordance with its consistency with the principles of law and to disapply any rule of law that did not meet this requirement. Almost universally, lawyers (and especially the courts) were encouraged to move from mechanical (a priori improper) application of the law to the creative (a priori the best and aspirational) one. The courts were encouraged: they started to freely interpret legal rules, under which the legislature established their competence; although court judgments have become more reasoned, this did not prevent them from applying speculative or ambivalent arguments; criticism could be expressed to courts due to lengthy processes that are, objectively looking, not required, and for low activity in exercising their powers to prevent abuse of law. Respect for the legislature directly responsible for creating legal rules and taking care of legal protection, judicial recognition that a court should deviate from the legal text or otherwise create new rules only when it is objectively inevitable, and lawyers’ societal openness to discussion on various issues – these can become conceptual prerequisites for higher confidence in the courts. The politics of interpretation should not be confused with interpretive practices such as political theory, political commentary, or histories of political institutions, parties, and conflicts that have politics itself as a specific object of interest. In these other interpretive practices, the politics that informs or motivates them—“politics” in the sense of political values or ideology—is relatively easily perceived and no particular meta-interpretive analysis is required. The politics of interpretation, on the other hand, arises in those interpretive practices which are ostensibly (...) most remote from overtly political concerns, practices which are carried out under the aegis of a purely disinterested search for the truth or inquiry into the natures of things which appear to have no political relevance at all. This “politics” has to do with the kind of authority the interpreter claims vis-à-vis the established political authorities of his society, on the one side, and vis-à-vis other interpreters in his own field of study or investigation, on the other, as the basis of whatever rights he conceives himself to possess and whatever duties he feels obligated to discharge as a professional seeker of truth. This politics which presides over interpretive conflicts is difficult to identity because traditionally, in our culture at least, interpretation is thought to operate properly only as long as the interpreter does not have recourse to the one instrument which the politician per vocationem utilizes as a matter of course in his practice—the appeal to force as a means of resolving disputes and conflicts.11. I have followed the lead of Max Weber in defining the phrase “politics of interpretation.” In “Politics as Vocation,” Weber wrote that “ ‘politics’ means for us striving to share power or striving to influence the distribution of power, either among states or among groups within a state” . Rather than discuss the age-old problem of the professional interpreter’s political responsibilities, I will consider that politics which is endemic to the pursuit of truth—the striving to share power amongst interpreters themselves. The activity of interpreting becomes political at the point where a given interpreter claims authority over rival interpreters. As long as this claim is not reinforced by appeal to the power of the state to compel conformity of belief or conviction, it is “political” only in a metaphorical sense. Of course, interpretation becomes political when a given point of view or finding is taken as orthodoxy of belief by those holding political power, as in the Soviet Union, Germany under Hitler, or any number of religiously puritanical regimes. But these are the easy cases. The two main psychological theories of the ordinary conditional were designed to account for inferences made from assumptions, but few premises in everyday life can be simply assumed true. Useful premises usually have a probability that is less than certainty. But what is the probability of the ordinary conditional and how is it determined? We argue that people use a two stage Ramsey test that we specify to make probability judgements about indicative conditionals in natural language, and we describe (...) experiments that support this conclusion. Our account can explain why most people give the conditional probability as the probability of the conditional, but also why some give the conjunctive probability. Most contemporary bioethicists believe that Western bioethical principles, such as the principle of autonomy, are universally binding wherever bioethics is found. According to these bioethicists, these principles may be subject to culturally‐conditioned further interpretations for their application in different nations or regions, but an ‘abstract content’ of each principle remains unchanged, which provides ‘an objective basis for moral judgment and international law’. This essay intends to demonstrate that this is not the case. Taking the principle of autonomy as an (...) example, this essay argues that there is no such shared ‘abstract content’ between the Western bioethical principle of autonomy and the East Asian bioethical principle of autonomy. Other things being equal, the Western principle of autonomy demands self‐determination, assumes a subjective conception of the good and promotes the value of individual independence, whilst the East Asian principle of autonomy requires family‐determination, presupposes an objective conception of the good and upholds the value of harmonious dependence. Łukasiewicz 3-valued logic Ł3 is often understood as the set of all valid formulas according to Łukasiewicz 3-valued matrices MŁ3. Following Wojcicki, in addition, we shall consider two alternative interpretations of Ł3: ‘truth-preserving’ Ł3a and ‘well-determined’ Ł3b defined by two different consequence relations on the 3-valued matrices MŁ3. The aim of this article is to provide a Routley–Meyer ternary semantics for each one of these three versions of Łukasiewicz 3-valued logic: Ł3, Ł3a and Ł3b.

Psychological research on people’s understanding of natural language connectives has traditionally used truth table tasks, in which participants evaluate the truth or falsity of a compound sentence given the truth or falsity of its components in the framework of propositional logic. One perplexing result concerned the indicative conditional if A then C which was often evaluated as true when A and C are true, false when A is true and C is false but irrelevant“ (devoid of value) when A is (...) false (whatever the value of C). This was called the “psychological defective table of the conditional.” Here we show that far from being anomalous the “defective” table pattern reveals a coherent semantics for the basic connectives of natural language in a trivalent framework. This was done by establishing participants’ truth tables for negation, conjunction, disjunction, conditional, and biconditional, when they were presented with statements that could be certainly true, certainly false, or neither. We review systems of three-valued tables from logic, linguistics, foundations of quantum mechanics, philosophical logic, and artificial intelligence, to see whether one of these systems adequately describes people’s interpretations of natural language connectives. We find that de Finetti’s (1936/1995) three-valued system is the best approximation to participants’ truth tables. (shrink)

This study will focus on a systematic exemplification of the notion of art and artwork based on Hegels aesthetics. It opposes two forms of skepticism which (1) question the possibility and value of a definition of art and (2) reject the category of the artwork for art is regarded as a process rather than a material thing. As such it is no longer something that can be conceived by seeing, hearing or touching the end product of that process. The criticism (...) of these postions results in an understanding of works of art as objects or processes with a specific structure of meaning. The study developes ideas which are related to Hegel's thought, insofar as Hegel regards the artwork as an expression of the ‘idea’, and the term ‘idea’ designates a complex semantic structure. The question of how judgments of explanatory value inform probabilistic inference is well studied within psychology and philosophy. Less studied are the questions: How does probabilistic information affect judgments of explanatory value? Does probabilistic information take precedence over causal information in determining explanatory judgments? To answer these questions, we conducted two experimental studies. In Study 1, we found that probabilistic information had a negligible impact on explanatory judgments of event-types with a potentially unlimited number of available, alternative explanations; causal (...) credibility was the main determinant of explanatory value. In Study 2, we found that, for event-token explanations with a definite set of candidate alternatives, probabilistic information strongly affected judgments of explanatory value. In the light of these findings, we reassess under which circumstances explanatory inference is probabilistically sound. (shrink)

A study is reported testing two hypotheses about a close parallel relation between indicative conditionals, if A then B , and conditional bets, I bet you that if A then B . The first is that both the indicative conditional and the conditional bet are related to the conditional probability, P(B|A). The second is that de Finetti's three-valued truth table has psychological reality for both types of conditional— true , false , or void for indicative conditionals and win , (...) lose , or void for conditional bets. The participants were presented with an array of chips in two different colours and two different shapes, and an indicative conditional or a conditional bet about a random chip. They had to make judgements in two conditions: either about the chances of making the indicative conditional true or false or about the chances of winning or losing the conditional bet. The observed distributions of responses in the two conditions were generally related to the conditional probability, supporting the first hypothesis. In addition, a majority of participants in further conditions chose the third option, “void”, when the antecedent of the conditional was false, supporting the second hypothesis. (shrink)

The first chapter explores the theory developed in Kripke's "Outline of a Theory of Truth." A tension in Kripke's account of the concept of truth is revealed--a conflict between two intuitions. The first intuition, called the "fixed point conception of truth," is that the whole meaning of the truth predicate is given by the formula "we may assert of a sentence that it is true iff we may assert that sentence." The second intuition, called the "thesis of the supervenience of (...) semantics," is that the interpretation of the truth predicate is determined by the interpretations of all the other non-logical constants of the language. I show that these two intuitions cannot be reconciled within the context of Kripke's theory, and I argue for the choice of the fixed point conception of truth over the principle of the supervenience of semantics. Chief among the considerations that I advance is the fact that the fixed point conception of truth yields a natural logic of truth. In the second chapter I present that logic of truth in the form of a cut-free sequent calculus. I then turn, in chapter three, to a discussion of the significance of such cut-free sequent calculi. I argue that we may view the sequent calculus introduction rules for a logical constant as giving the meaning of that constant, under certain conditions. In particular, we can see our logic of truth as providing an explication of our intuitive concept of truth which complements Kripke's original model-theoretic explication. The fourth chapter takes up some criticisms of Kripke's theory which center on the logic of truth. In addition, the general ideas developed in the first three chapters are applied in a discussion of the various schemes of three-valued logic which can be used in the development of Kripke's approach. Finally, in the last chapter, it is shown that Kripke's technical concepts, and the logical ideas developed in the second and third chapters, can be used to provide a unified account of many contexts in which paradox arises. The new Bayesian paradigm in the psychology of reasoning aims to integrate the study of human reasoning, decision making, and rationality. It is supported by two findings. One, most people judge the probability of the indicative conditional, P(if A then B), to be the conditional probability, P(B|A), as implied by the Ramsey test. Two, they judge if A then B to be void when A is false. Their three-valued response table used to be called ‘defective’, but should be termed (...) the de Finetti table. A current interpretative issue in reading John Locke’s texts is the relationship between Locke’s theology and political philosophy. 1 Reacting against the secular interpretations of C. B. Macpherson and Leo Strauss, John Dunn argued that Locke’s theology was axiomatic for the political philosophy of the Two Treatises of Government in (...) that Locke’s liberalism was based on a religious individualism. 2 Dunn thus decisively reoriented Lockean scholarship away from seeing Locke as an apologist for a new capitalist economic order, and James Tully and Richard Ashcraft have since substantiated the view that theological presuppositions were foundational for Locke’s political writings but they emphasized the radical nature of Locke’s political position. 3 This view has in turn been challenged by more recent contextual studies of the development of Locke’s thought. John Marshall has argued that the political argument in the Two Treatises of Government is not dependent on religious individualism in [End Page 83] that Locke’s natural theology was itself driven by epistemological investigations, and that it was this epistemological impetus which inclined the Christian Locke towards the Socinian tendencies of his later years. 4 Ian Harris accepts that theological explanation was central to Locke’s writings in ethics and government, but he also emphasizes the reverse process of determination where Locke’s theology, particularly with respect to revealed religion, is in turn reliant upon Locke’s broader thinking. There is wide support in logic, philosophy, and psychology for the hypothesis that the probability of the indicative conditional of natural language, P(if A then B), is the conditional probability of B given A, P(B|A). We identify a conditional which is such that P(if A then B)=P(B|A) with de Finetti's conditional event, B|A. An objection to making this identification in the past was that it appeared unclear how to form compounds and iterations of conditional events. In this paper, we illustrate (...) how to overcome this objection with a probabilistic analysis, based on coherence, of these compounds and iterations. We interpret the compounds and iterations as conditional random quantities which, given some logical dependencies, may reduce to conditional events. We show how the inference to B|A from A and B can be extended to compounds and iterations of both conditional events and biconditional events. Moreover, we determine the respective uncertainty propagation rules. Finally, we make some comments on extending our analysis to counterfactuals. (shrink)

Training under high interference conditions through interleaved practice results in performance suppression during training but enhances long-term performance relative to repetitive practice involving low interference. Previous neuroimaging work addressing this contextual interference effect of motor learning has relied heavily on the blood-oxygen-level-dependent response using functional magnetic resonance imaging methodology resulting in mixed reports of prefrontal cortex recruitment under IP and RP conditions. We sought to clarify these equivocal findings by imaging bilateral PFC recruitment using functional near-infrared spectroscopy while (...) discrete key pressing sequences were trained under IP and RP schedules and subsequently tested following a 24-h delay. An advantage of fNIRS over the fMRI BOLD response is that the former measures oxygenated and deoxygenated hemoglobin changes independently allowing for assessment of cortical hemodynamics even when there is neurovascular decoupling. Despite slower sequence performance durations under IP, bilateral PFC oxygenated and deoxygenated hemoglobin values did not differ between practice conditions. During test, however, slower performance from those previously trained under RP coincided with hemispheric asymmetry in PFC recruitment. Specifically, following RP, test deoxygenated hemoglobin values were significantly lower in the right PFC. The present findings contrast with previous behavioral demonstrations of increased cognitive demand under IP to illustrate a more complex involvement of the PFC in the contextual interference effect. IP and RP incur similar levels of bilateral PFC recruitment, but the processes underlying the recruitment are dissimilar. PFC recruitment during IP supports action reconstruction and memory elaboration while RP relies on PFC recruitment to maintain task variation information in working memory from trial to trial. While PFC recruitment under RP serves to enhance immediate performance, it does not support long-term performance. (shrink)

It seems that these teachings were translated into Chinese in the form of sutras. One of them, preserved in stone as the Monument Sutra, features the cross rising from the lotus, the symbol chosen by Karl Reichelt for Tao-fung Shan, his Christian center in Buddhist style at Sha-tin outside Hong Kong, many centuries later. Thousands of Buddhist texts were preserved in the library cave at Dunhuang monastery, about one thousand miles west of Xian, where they were rediscovered by the Taoist priest Wang Yuanlu, who arrived there in the 1890s and became the self-appointed guardian of the scrolls.Included in this treasure trove were the Jesus Sutras, which are now scattered in museums and private collections, largely inaccessible to the public. But if the selection published here in a very elegant translation is anything to go by, they are [End Page 190] extremely significant religious documents with a spiritual value all their own. They represent a Higher Dharma of perfect purity (p. 86), which, like a mirror, reflects the world with no trace of self: no desire, no action, no virtue, no truth (pp. 80–83, 126–129). The Jesus story is retold, and Jesus is portrayed as the teacher of this Higher Path. The sutras speak of One Spirit who is self-created, One God who is creator of the world, and One Lord, the Messiah who will return. There are prayers, too: "O Loving Father, Enlightened Son, Holy Spirit King"; "Lamb of Love and Bliss"; "O Holy Sage, Universal Lord, Messiah" (pp. 110–113). The aim of this dissertation is to propose and justify the thesis that Kant's theory of judgment, which plays a vital role in the Critique of Pure Reason, Critique of Practical Reason, and Critique of Judgment, is fundamentally theoretical in nature, and that this theory insures the unity of the critical philosophy. Most of the contemporary writers who have dealt with the question of the unity of Kant's philosophy on the basis of his theory of judgement have emphasized the priority (...) of either practical, aesthetic, or even political judgment. Such interpretations, however, seem at odds with the fact that Kant's theory of judgment is rooted in the non-practical, theoretical discipline of formal logic, a discipline that underlies the structure of all three Critiques. The "theoretical" understanding of judgment is first developed in the Critique of Pure Reason wherein Kant distinguishes between general and transcendental logic. This distinction governs the distinction between two ways of employing the same logical form of judgment, viz., indeterminately and determinately. The determinate-indeterminate distinction with respect to judging is elaborated in both the first and the second editions of the Critique of Pure Reason as well as in the Prolegomena and the Preface to the Metaphysical Foundations of Natural Science . ;In the Groundwork of the Metaphysics of Morals , Kant distinguishes between "general practical philosophy" and "the metaphysics of morals." In fact, general practical philosophy "differs from a metaphysics of morals in the same way that general logic is distinguished from transcendental philosophy." Thus, the distinction between general practical philosophy and the metaphysics of morals in Kant's practical philosophy represents the distinction between indeterminate and determinate functions of judging practically, i.e., of willing. ;In the Critique of Judgment , the determinate-indeterminate distinction is expressed by means of the distinction between determinative and reflective power of judgment . There is a new Bayesian, or probabilistic, paradigm in the psychology of reasoning, with new psychological accounts of the indicative conditional of natural language. In psychological experiments in this new paradigm, people judge that the probability of the indicative conditional, P(if A then C), is the conditional probability of C given A, P(C | A). In other experiments, participants respond with what has been called the 'de- fective' truth table: they judge that if A then C is true when A (...) holds and C holds, is false when A holds and C does not, and is neither true nor false when A does not hold. We argue that these responses are not 'defective' in any negative sense, as many psychologists have implied. We point out that a number of normative researchers, including de Finetti, have proposed such a table for various coherent interpretations of the third value. We review the relevant general tables in the normative literature, in which there is a third value for A and C and the logically compound forms of the natural language conditional, negation, conjunction, disjunction, and the material conditional. We describe the results of an experiment on which of these tables best describes ordinary people's judgements when the third value is interpreted as indicating uncertainty. (shrink)

In the history of İslāmic thought, Māturīdī is a famous scholar both in the field of kalām and tafsir. Being approved by Māturīdī, the distinction of tafsir and ta’wīl, which makes possible to take the comments made about the verses into sistematic framework, is quite important. There is an important information both about content of the distinction approved by Māturīdī and the main reasons that necessiated this distinction in the introduction of Samarqandī’s Sharh at Ta’wīlāt. From this information, it is (...) understood that the distinction of tafsir and ta’wīl had dated back to older time than Māturīdī and previous scholars dealed with the problem that necessiated this distinction and Māturīdī inherited this distinction from his predecessors. Information in the Sharh at Ta’wīlāt reveals that according to Māturīdī the companions had made interpretation (ta’wīl) in addition to tafsir and the explanations made by certain evidences is tafsir too. Therefore this information gives us the opportunity flexing the acceptance of the idea “tafsir, is dedicated to the companions, ta'wīl is dedicated to fuqaha (jurists)” and asserting that companions and scholars made both tafsir and ta’wīl. In this paper, we will research whether the distinction tafsir and ta’wīl regarded by Māturīdī completely belonged to his or not and content of the distinction and its reasons. We will also analyze this distinction according to examples in the Ta’wîlāt. Summary: An important distinction is made between the concepts of tafsir and ta’wīl in the short preface of Māturīdī's tafsir, and this distinction is particularly prominent in contemporary tafsir studies. Because from the point of view of the value they carry, the explanations for these differences and concepts express the legitimacy of the following mufassirūn (writers of a commentary on the Qur’an) to be able to perform tafsir, as well as the value of the explanations found in tafsir literature in terms of certainty. In Ta'wīlāt, tafsir is described as the precise determination of what is intended. Determination of what is exactly intended in verse/wording is bound to certainly know the conditions under which it was revealed. Because they are the first to be addressed directly and they witnessed the context, the tafsir is only for the companions (ṣaḥābah pl. aṣḥāb). On the other hand, ta’wīl is not a definite determination of what is intended, but rather it is explained as putting the possibilities forward. In this case, ta’wīl is dedicated to the scholars after the companions. When we look at the other tafsir sources that include his views, it can be understood that this brief information in the preface of the tafsir which survived to our day is partially incomplete. Samarqandī's Sharhu’t-ta'wīlāt is the most important of these sources. According to the information here, Māturīdī states that some scholars distinguish tafsir and ta’wīl from each other. In these distinctions, tafsir is either described in relation to a definitive statement or in relation to being familiar with the conditions of revelation, while ta’wīl is described as extracting meanings from the verses and making possible meanings without claiming certainty. These explanations show that the distinction between tafsir and ta’wīl in Ta'wīlāt's preface was mainly based on the period before Māturīdī. These statements, which Māturīdī transmitted from some scholars in the beginning of Sharhu’t-ta'wīlāt, were then transmitted by Omar al-Nasafī, Mahāyimī and Molla Husrev. In some sources, it was also transmitted that similar explanations were made by scholars such as an-Nadr b. Shumayl, al-Hussein b. Fadl al-Bacelī and Ibn Durayd before Māturīdī.Some explanations of Māturīdī in Ta'wīlāt enables the theory of tafsir-ta’wīl to be understood at a wider level. When the examples are examined, it is observed that Māturīdī exhibited two types of attitude against the tafsir of the companions. He states that one of these is that if the transmission is true, what is intended is exactly what is stated in the narrated. The second is that he sometimes does not accept these explanations and suggests additional opinions. The reason he refuses is that sometimes he does not find the transmission reliable, and sometimes he thinks that companions performed ta'wīl. If this is the case, the dedication of ta’wīl to those coming later should not be absolutized. Because the companions can perform both tafsir and ta’wīl. The examples in Ta'wīlāt clearly reveal what areas tafsir, which is defined as a definite statement, covers. According to this, first, tafsir is related to the field of “invisible” about the past and the future. Secondly, its meaning and practice is only about the information of the “statement” about the issues that can be revealed by the Prophet (pbuh). In the third aspect, it is related to “revelation” information reporting the context in which the verses descended. In the beginning of Sharhu’t-ta'wīlāt, Māturīdī says that the explanations made based on the definitive evidences such as mutawātir (repetition; narration reported by large number reporters) and ijmā (consensus) also fall under the category of tafsir. However, it is also necessary to add intellectual evidence to these evidences. Because intellectual evidence is also important in the epistemology of Māturīdī. In fact, the truthfulness of nass (text) is primarily based on intellectual evidence. First, the issues of theology are proven by certain intellectual evidence, and then, on the basis of this, the meanings expressed by the nass acquire the value of certainty and truthfulness. With the definitive acceptance of reason in theology, what some nass express confirm each other and are used as evidence in the process of interpretation. Therefore, since some of the intellectual evidence, ijmā and mutawātir news provide definitive information, explanations based on them are also seen as tafsir. Considering the fact that the above-mentioned evidence was also used by those coming after the companions, it can be concluded that tafsir can be performed by not only the companions but also those coming after them. In this case, it should be accepted that tafsir is not performed only by the companions, and that the succeeding mufassirūn can also perform tafsir as well as ta’wīl. When we look at the examples based on these evidence, there are two different situations in Ta'wīlāt. The first is that Māturīdī sometimes has views on evidence based on mutawātir and ijmā and sometimes suggests different opinions from the assumptions that he said there was ijmā in particular. Because these evidences are certain, it is understandable that he remains bound to them. However, as a possible reason for his opposition to ijmā, it can be said that he thinks only the following generations enter the scope of ijmā. Because, according to Samarqandī, Māturīdī's objection to such information does not seem possible, since ijmā of the companions in a matter is accepted. Although he sometimes said that there was ijmā, the reason why no such ijmā was mentioned in other tafsir sources and sometimes, it may be considered that he did not respect other views in the face of ijmā as a reason for including different views or it may be thought that he was unaware of the different views that were transmitted. The second remarkable situation is that according to Māturīdī, intellectual evidence, in particular, can reveal only the “knowledge of existence” of the issues related to theology. Māturīdī thinks that their nature cannot be certainly known, and that the explanations made regarding their nature are only ta’wīl. For this reason, he firmly rejects the interpretation of the khabarī attributes about Allah in accordance with the idea of tashbīh and tajsīm (anthropomorphism). (shrink)

Democratic politics might be defined as the agonistic struggle of different parties, groups or individuals over resources, recognition and influence under reciprocal and inclusive conditions. It is based on an unconditional orientation to equality as well as freedom of all those involved to consent to - or dissent from - the norms, policies and practices that are established in the process of public dialogue. This article reconstructs the general agent-based capabilities required for a democratically defined public sphere (...) class='Hi'>under conditions of globalization. Making capabilities central is intended to correct a certain over-emphasis regarding institutional macro-structures in the discourse on globalization and cosmopolitanism. After setting the stage with a critical analysis of Martha Nussbaum’s concept of capabilities, the analysis proceeds in two major steps. In the first part, a notion of hermeneutic agency is introduced that avoids a Foucauldian reduction of agency to power structures, while thoroughly situating agency in a symbolically mediated social context. The symbolic mediation of agency is, in the second part, taken as a ground of potentiality for reflexive capabilities that, once actualized and enacted, allow for a normatively satisfying process of public deliberation. The aim of the analysis is to relate a normative model of value-orientation to the linguistically grounded empirical resources of social agents. The core argument lays out as basic capabilities (1) to be able to normatively orient oneself at contextually defined yet universally open postconventional commitments, (2) to be able to engage in an interpretive and dialogical perspective-taking vis-a-vis differently situated agents and backgrounds, and (3) to be able to critically distance oneself from one’s taken-for-granted assumptions and background structures via a power-alert social reflexivity. The new Bayesian paradigm in the psychology of reasoning aims to integrate the study of human reasoning, decision making, and rationality. It is supported by two findings. One, most people judge the probability of the indicative conditional, P, to be the conditional probability, P, as implied by the Ramsey test. Two, they judge if A then B to be void when A is false. Their three‐valued response table used to be called ‘defective’, but should be termed the de Finetti (...) table. In lieu of an abstract, here is a brief excerpt of the content:TRUE INTERPRETATIONS by Stephen Davies Could conflicting interpretations of a literary work be equally true? Bodi Monroe C. Beardsley and Joseph Margolis assumed fhis to be impossible in their famous debate about the relationship between the multiplicity of interpretations of literary works and the assessment of such interpretations for truth.1 The assumption was implicit in the first premise of the following argument. Although they disagreed (...) about the argument's soundness, they did agree about the truth of this premise. The argument goes like this: (1)No work of literature can be interpreted truly both as p and not-p (nor as both p and q where p and q are contraries). (2)Many a work of literature admits of equally plausible/convincing/ revealing but contradictory or contrary interpretations; so (3)Interpretations of works of literature cannot be assessed for truth (nor can they be assessed for falsity). This argument is an important one for, ifit is accepted, it entails that literary criticism and analysis are not deductively based. The use of deduction in practical (as opposed merely to formal) reasoning is possible only where the premises and conclusion might be assessed for truth. Margolis accepts the soundness of this argument, but Beardsley does not. Both accept that the premises of the argument are true. Because Beardsley believes that the conclusion is false, he believes that the argument must be invalid. (Beardsley thinks that the appropriate con290 Stephen Davies291 elusion to draw is that sometimes we cannot discover which of several conflicting interpretations is the true and correct reading.) Margolis believes that the argument is valid and, hence, that the conclusion is proved. The disagreement between them centers on the role of the second premise in generating the conclusion. Beardsley argues that the only test for "plausibility" or "convincingness " or "revealingness" is truth. How could an interpretation be plausible except by being plausibly true? On the (inadequate) evidence available, two interpretations might be equally plausible, but that is to say that, on the given evidence, their truth is equally probable. This means only that there is no way of settling which of them is true and that, under the condition of ignorance which obtains, we are in no position to judge which of them is true. It does not show that interpretations cannot be assessed for truth, although it does show that the matter of their truth might not be satisfactorily determinable. So, according to Beardsley, the conclusion does not follow from the premises: "I hold that all of the literary interpretations that deserve the name obey [the principle of 'the Intolerability of Incompatibles']. But of course I do not wish to deny that there are cases of ambiguity where no interpretation can be established over its rivals; nor do I wish to deny that there are many cases where we cannot be sure that we have the correct interpretation." 2 Margolis's reply might be developed as follows: where two interpretations are equally consistent with the text, it would make sense to claim that one of them is true and the other false only if there might be some further evidence, as yet unconsidered, which could settle the matter. But, in the case ofmany conflicting and equally plausible interpretations of literary works, all the evidence that there could be is in; there is no further (hidden) evidence to be appealed to. So there is no truth ofthe matter. The judgment that the interpretations are equally plausible is not equivalent to a decision to suspendjudgment for the lack ofdecisive evidence, but, rather, a recognition that all the relevant evidence underdetermines questions of truth. Thus, there can be no right, no true, interpretation and, accordingly, in being tested for revealingness or whatever, interpretations are not being tested for truth. : The two main psychological theories of the ordinary conditional were designed to account for inferences made from assumptions, but few premises in everyday life can be simply assumed true. Useful premises usually have a probability that is less than certainty. But what is the probability of the ordinary conditional and how is it determined? We argue that people use a two stage Ramsey test that we specify to make probability judgements about indicative conditionals in natural language, and we (...) describe experiments that support this conclusion. Our account can explain why most people give the conditional probability as the probability of the conditional, but also why some give the conjunctive probability. We discuss how our psychological work is related to the analysis of ordinary indicative conditionals in philosophical logic. (shrink)

abstract Trusting agents characteristically anticipate beneficial outcomes, under conditions of uncertainty, in their engagement with others. However, debates about trust incorporate different interpretations of risk, uncertainty, calculation, affect, morality and motivation in explaining when trust is appropriate and how it operates. This article argues that discussions about trust have produced a concept without coherent boundaries and with little operational value. Two paradigms are identified, which distinguish the characteristics of trust and confidence. It is argued that a reliance on (...) confidence in human affairs makes trust redundant and that this has undesirable moral consequences. Discussion is illustrated by the UK Government's ‘modernisation’ policy in health and social care, which privileges confidence in systems over trust in moral agents. (shrink)

The first strategy is to defeat the principled case for open borders, such as the global equality of opportunity argument for more lax immigration control. The second strategy is to establish the democratic community’s prima facie right to determine the shape of its future, including membership and the right to exclude. First, I argue (...) that Miller’s conception of global equality of opportunity is overly narrow and that his objections to the principle, to the metric and to what counts as feasible political action misfire against other, more plausible, accounts. Second, I argue that his democratic interpretation of collective self-determination does not solve the pressing question concerning the morally justified scope and content of self-determination and the moral limits of the right to exclude. I conclude by questioning Miller’s general strategy: whether theories of immigration should be engaged in an exercise of shifting the burden of proof between open and closed borders. By contrast, I argue that a more desirable task for the political philosophy of immigration is to find ways in which the joint requirement of global equality of opportunity and collective self-determination can be coherently upheld. In this reply, we rebut claim 1 by describing the instructions more comprehensively, and claim 2 by reiterating the importance of making certain theoretical distinctions which Oaksford does not make. This paper develops an interpretive framework around ethical learning by using qualitative methods to examine the collective impact of Experiential Learning Activity (ELA) and Critical Action Learning (CAL) on student learning of ethics. The aim is to determine not only the effectiveness of two ethical learning theories but also the student “needs” being fulfilled. To understand their perceptions, we collected students’ personal narratives through focus groups and semi-structured interviews post participation on the experiential and action learning activities. Results indicate that (...) teaching through ELAs and CAL in business ethics lead to social benefits and co-creation which portrayed improved engagement with peers, academics and industry. The outcomes suggest that instead of focussing on teaching ethics, the curriculum should provide opportunities for developing interaction with peers, academics and the society and engage students in real time hands on projects to experience and learn about ethics and the consequences of unethical behaviour. Early period (h. I-III) works are the most basic data sources in tafsīr studies. However, the related works were shaped within the conditions of the period. In this process, the literacy and schooling rate is low. It is not easy to obtain sufficient writing materials. For this reason, the information was initially transferred as a verbal, some of the original material that has been written has not survived. The information, which is usually narrated and sometimes written, can be learned through (...) the written copies of the next dates. However, there are serious time intervals between the author and the manuscript copies. This time period has led to some problems. There are such works that the author is controversial. There is such information that it is obvious that it was added later. Although some works belonging to the period were compiled from the sources of the following centuries, they were printed under the name of some people who lived in the early period, as if they gave the impression of author copy. Each of these matters has the quality to affect the nature of the information to be used as reference and the perception to be created on it. The relation of the subject with the interpretation of the Qur'ān and the fact that it is binding has a special importance, therefore, it requires knowing the formation stages of the reference source, especially in the commentary of tafsīr. In the article, the author-work relation in early tafsīr works has been tried to be processed on a sufficient number of examples with their respective dimensions.Summary: Early works in tafsīr studies are the most basic data sources. However, the related works were shaped within the conditions of the period. The data at the beginning were verbally transmitted, but some original material that has been written has not survived until nowadays. Therefore, the information about tafsīr are derived from the mainly Buhkārī (d. 256/870), Muslim (d. 261/875), Tirmidhī (d. 279/892), Nasā’ī (d. 303/915) which have tafsīr contents, and encyclopedic sources which have been contended narrations suhc as Țabarī (d. 310/923) and Ibn Abī Ḥātim (d. 327/938).Some later dated work/s belonged to people who lived in the early period alo contribute to this accumulation. However, in scientific studies it is necessary to pay attention to the harmony or difference between the author manuscripts and copies which have been survived. Because the limited possibilities of the period, the time interval between the author and the writing copy, the corrosion that occurred in the texts over time, the capacity or thought the scribe has caused the addition and reduction of the original copy of the text. Although it is rare, it is also possible to attribute the work to a well-known person of the period in order to gain the reputation of the views in the work.In this regard, the article first draws attention to the time difference between the author and the copies that have survived to the present day. Accordingly, it was emphasized that there may be works with controversial belonging to the author. Because, it may be that the names of those who expand, explain or shorten the work with additions are given as the author's name.It is shown with examples that additions to the work could be made in the time interval between the author and the manuscript that has survived to the present day. However, sometimes the difference between copies can be based on many reasons, from the ignorance of the obscene to its forgetfulness and even deliberate replacement. Even in the hadith narrations that attribute special importance to its narration, it is quite possible that the additions were made intentionally or unknowingly, even after the transition to the written period.However, this study was carried out only on tafsīr works. Because even the sampling on a limited number of tafsīr works pushes the limits of the article.In the study, the original texts of the selected works as samples such as Ibn ʿAbbās, al-Farrāʾ, Abū ʿUbayda, etc. were reviewed, and the master's and doctorate studies on the relevant works and the period, especially their editorial evaluations, were tried to be examined as much as possible. In the evaluations, the classical period sources such as Ibnu-Nadīm, Thaʻlabī and Ibn Khallikān, where tafsīr works were subject, as well as the Ottoman period like Edirnevī; Modern era works such as Brockelman and Sezgin were used. Books, articles and encyclopedia articles evaluating the manuscripts were also used.The study revealed that when the early tafsīr references were given, the author-copy relationship should be taken into consideration. Because, although some names are mentioned as mufassīr in the sources, it is controversial whether some of them convert the relevant information into written form. Because the period of the compilation is started in the period of tâbiûn in its earliest form. It is understood that even though the writing is partially activated, the tendency to convey information by narration continues from the examples given.The fact that no original work of the period reaches the present day, there is a serious time gap between the oldest manuscripts carrying the relevant information to the present day and its authors raises the issue of the reliability of the information. This is an issue to be considered in research and updating of information. Because it was seen that some information was difficult to determine the author. In addition, it has been understood that there may be additions afterwards besides the possibility of missing or misreported information due to various factors during the transfer. The fact that narration analysis has not been done properly in the context of the tafsīr science can lead to wrong conclusions in some works, if the possibility of reaching the information added later has not been taken into consideration.In addition, creating author copies from manuscripts is a challenging process with some difficulties in itself. No matter how fastidious it is shown, it should not be forgotten that the work is compiled from manuscripts, it should be known that errors may occur despite the maximum sensitivity.It is another point to consider that some information should be associated with the author and turned into a book based on the narrations in the sources of the next period. It should not be forgotten that some works were created by collecting the narrations of the next period. When the process in its formation is not taken into account, there is a possibility that the relevant information creates an early perception of false perception, as well as the belief that it expresses correct and precise information in all aspects due to its connection with the sacred. It is obvious that there is a difference between the original information from the author's pen and the quality and knowledge value of the information collected by claiming belonging to the author from later works. It is necessary to pay attention to this difference in information transfer.Therefore, during the investigation of the envoy, whose main task is to determine the will of Allah, he has to take into account the mentioned features of the early works. Imagine that you’ve just spent the last several months reading Don Quixote—and that you’re all but fifty pages away from finishing. Unfortunately for you, the book was due back before you could finish, and so begrudgingly, you turn it back in, having not known what happens in the end. Riddled with curiosity, you make your best guess about Quixote’s eventual fate and suppose it is the most likely scenario. Entirely unbeknownst to you, it turns out that you were right; Quixote’s (...) ultimate destiny was just what you had supposed it would be! What luck! Quite naturally, we would say that, when all is said and done, knowing what happens to Don Quixote in the end is surely better than merely believing truly what happens in the end—the predicament you find yourself in having not actually finished the book. After all, it was just by dumb luck that you guessed the ending right—a point you could deny only on the pain of some embarrassing claim of clairvoyance. We might put the idea more generally by saying that from a purely cognitive standpoint, it is better to know the truth than to stumble upon it by luck. This general idea betrays two distinct insights about knowledge. The first is the insight that while true belief is valuable, knowledge is distinctively so—knowing the truth is valuable in a way that merely having a true belief is not. The second insight here is that you lack knowledge if it’s just by dumb luck that the belief you have is true. Call these the value insight and the anti-luck insight: Value insight: Knowledge is distinctively valuable. Luck insight: Knowledge excludes luck. In contemporary epistemology, and especially over the past five years, separate projects have arisen in correspondence with these distinct intuitions: value-driven epistemology is concerned with issues surrounding the first insight, and projects under the description of anti-luck epistemology have arisen out of the second. Now we might reasonably suppose that whatever it is that makes knowledge relevantly un-lucky would be something we could cite in accounting for what makes knowledge distinctively valuable. This natural idea reflects the thought that the insights about value and luck should not be entirely disconnected. There is a problematic tension though between this reasonable expectation and the resources epistemologists have provided for us to accommodate it. What explains the tension is the fact that value-driven and anti-luck projects in epistemology have by and large been developed apart from each other, each focused on one of our two guiding insights at the expense of the other. Consequently, value-driven epistemology’s focus on the normative but not modal properties of knowledge leaves these two aspects of knowledge disconnected much in the way that anti-luck epistemology’s focus on the modal but not the normative properties of knowledge leaves these same aspects disconnected. The lacuna here between what value driven epistemologists tell us about what makes knowledge valuable and what the anti-luck epistemologists tell us about what makes knowledge exclude luck is troubling. We may resist that there should be such a disconnect if we avoid the common flaw shared by each of these projects pursued in isolation from the other. The flaw here is essentially one of naivety: that of supposing that we can give an account of knowledge exclusively in terms of conditions that would accommodate one of the two insights, while still managing to account for the other insight—which itself we did not appeal to directly in our theory of what knowledge is—e.g. in the analysis provided of it. This is the flaw behind the value-driven approaches that think about knowledge in terms of valuable properties they can’t explain to ensure modal robustness and the anti-luck projects that think of knowledge in terms of modal properties into which we can’t well smuggle the normativity needed to explain its value. To avoid this flaw, then, we should let both of these insights dictate the conditions our analysis offers as essential to knowing.
