É bem sabido que a estética de Kant está estruturada intersubjetivamente, porque ele honra a reivindicação do gosto pela universalidade. No entanto, o fundamento transcendental desta universalidade compartilhada é uma base suprasensível tida por certa, mas que não pode ser trazida diretamente para dentro da experiência comunicativa. O apelo kantiano à estrutura sintética a priori do juízo estético também remove-o da esfera da interação pessoal observável. Esta estratégia argumentativa expõe-no a desafios céticos e gera referências inacessíveis às representações internas (sejam (...) elas intuições, categorias do entendimento ou idéias racionais). Não é suficiente, como faz Kant, propor uma descrição da experiência estética que seja subjetivamente plausível e, a partir disso, reivindicar sua validade intersubjetiva. É indispensável encarnar a intersubjetividade no comportamento e na linguagem. Na intersubjetividade prática, lida-se com as atitudes estéticas em um modo concreto e acessível, sem depender de pressupostos mentalistas como fundamento. Termos conceituais como 'agradável', 'belo', 'sublime', 'feio', 'universalidade' adquirem novo significado em um contexto interativo e reivindicações estéticas são testadas em um modelo dialógico de jogo semântico. For centuries, natural law was the main philosophical legal paradigm. Now, it is a wonder when a court of law invokes it. Arthur Kaufmann already underlined a modern general "horror iuris naturalis". We also know, with Winfried Hassemer, that the succession of legal paradigms is a matter of fashion. But why did natural law become outdated? Are there any remnants of it still alive today? This book analyses a number of prejudices and myths that have created a general misconception of (...) natural law. As Jean-Marc Trigeaud put it: there is a natural law that positivists invented. Not the real one(s). It seeks to understand not only the usual adversaries of natural law (like legalists, positivists and historicists) but also its further enemies, the inner enemies of natural law, such as internal aporias, political and ideological manipulations, etc. The book puts forward a reasoned and balanced examination of this treasure of western political and juridical though. Considerações acerca da emenda da sociologia das religiões -- Conceito da sociologia da arte.

This volume is dedicated to the topic of the human evaluation and interpretation of animals in ancient and medieval cultures. From a transcultural perspective contributions from Assyriology, Byzantine Studies, Classical Archaeology, Egyptology, German Medieval Studies and Jewish History look into the processes and mechanisms behind the transfer by people of certain values to animals, and the functions these animal-signs have within written, pictorial and performative forms of expression.

Significant disagreement remains in ethics about the duties we have towards wild animals. This paper aims to mediate those disagreements by exploring how they are supported by, or diverge from, the common-sense ethical principles of non-maleficence, beneficence, autonomy and justice popular in medical ethics. We argue that these principles do not clearly justify traditional conservation or a ‘hands-off ’ approach to wild-animal welfare; instead, they support natural negative duties to reduce the harms that we cause as well as natural positive (...) duties to promote the welfare of wild animals. Viewing emotion from an evolutionary perspective, researchers have argued that simple responses to affective stimuli can be triggered without mediation of cognitive processes. Indeed, findings suggest that positively and negatively valenced stimuli trigger approach and avoidance movements automatically. However, affective stimulus–response compatibility phenomena share so many central characteristics with nonaffective stimulus–response compatibility phenomena that one may doubt whether the underlying mechanisms differ. We suggest an “affectively enriched” version of the theory of event coding (TEC) that is able to account for (...) both affective and nonaffective compatibility, and that can account for the observation that both types of compatibility seem to be modulated by goals and intentions. Predictions from the model are tested in an experiment where participants carried out approach and avoidance responses to either the valence or the orientation of emotionally charged pictures. Under affective instruction the positive-approach/negative-avoid mapping yielded faster responses than the positive-avoid/negative-approach mapping, but no such effect was observed under spatial instruction. Conversely, spatial compatibility effects were obtained under spatial, but not under affective instruction. We conclude that affective and nonaffective compatibility effects reflect the same mechanism. (shrink)

Political philosophy was once dominated by discussion of the virtues of character and their importance to the good life and the good society. Contemporary political philosophers, however, following the towering influence of John Rawls, have primarily focused on a single virtue of institutions: justice, while largely avoiding controversial claims about the good life. As a result, political philosophy lacks a unified account of the virtues of institutions and the virtues of character. More importantly, we lack an understanding of the connection (...) between the just society and the good life. This book begins to mend this broken seam, which, on reflection, lies at the heart of our deepest political problems. The book’s central argument is that the virtues of character require institutions, while good institutions enable persons to live together virtuously. Political institutions are a necessary precondition for the moral agency exhibited by the virtues. But good institutions enable virtue to grow, while helping to constrain the excesses of vice. On this view, justice emerges primarily as a virtue of character, not institutions. The just person balances conformity to existing institutional norms with practically wise reforms. Ultimately, this book concludes that the just society and the good life are linked through the common good of virtuous activity within the shared institutions of a political community. (shrink)

Georges Palante, figure oubliée de la sociologie naissante, fut le théoricien d'une révolte intransigeante de l'individu face aux mécanismes oppressifs déployés par la société. Lecteur de Nietzsche et de Schopenhauer, ennemi déclaré des durkheimiens, socialiste non marxiste, farouche défenseur de l'individu, Georges Palante est un penseur iconoclaste qui n'a eu de cesse de développer une éthique individualiste et libertaire en vue du plein épanouissement des facultés et des potentialités individuelles. Cependant, par un étrange paradoxe, l'éthique palantienne prend sa source dans (...) une philosophie pessimiste qui offre à la révolte un caractère tragique et indompté : elle doit avoir lieu et ce, malgré la certitude de sa défaite. C'est précisément ce paradoxe que cet ouvrage entend questionner tout en offrant une introduction à l'oeuvre de Georges Palante. Interroger la possibilité d'une révolte pessimiste, c'est interroger ce moment de l'insoumission et de la désobéissance propre à la condition humaine. Palante ouvre la voie qui inscrit la révolte et le mouvement du refus dans la constitution même de l'homme. Avec Albert Camus, Palante pourrait affirmer : "Qu'est-ce qu'un homme révolté? Over the years, phenomenology has provided illuminating descriptions of discrimination, with its mechanisms and effects being thematised at the most basic levels of embodiment, (dis)orientation, selfhood, and belonging. What remains somewhat understudied is the lived experience of the discriminator. In this paper I draw on Husserl's phenomenological account of normality to reflect on the ways in which we discriminate at the prereflective levels of perceptual experience and bodily being. By critically reflecting on the intentional structures undergirding discriminatory practices, I argue (...) that discrimination is characteristic of a naïve normalising attitude which is habitually interested in securing a familiar experience of a static normality. I first demonstrate how this attitude problematically tends to reproduce, enforce, and further sediment discriminatory and exclusionary norms. Further, I provide an internal critique which problematises discrimination—without recourse to external normative standards—on three fronts: as epistemically unproductive, experientially obscuring, and normatively non-instantiating. In discriminatory acts we see an abnormal refusal to enrich, revise, and genetically establish new normative commitments, new ways of seeing, and a new normality. (shrink)

RESUMO:O objetivo deste artigo é discutir sobre os conceitos de obrigação e lei natural, tendo como referência o polêmico debate moderno envolvendo intelectualismo e voluntarismo. Em um primeiro momento, destacaremos a rejeição de Wolff ao voluntarismo de Pufendorf e sua orientação em direção ao intelectualismo de Leibniz. Conforme essa nova orientação, uma teoria da lei natural não deve basear seu conceito de obrigação na autoridade das leis e em seu poder coercitivo, mas, por outro lado, unicamente na ideia de necessidade (...) moral, interpretada como expressão da ligação natural universal dos seres racionais com o dever. Im Fokus steht der Umgang mit dem kosmopolitischen Erbe der Aufklärung im 19. und frühen 20. Jahrhundert zwischen Deutschland und Frankreich. 0Auf der Suche nach Transferphänomenen, Spannungen und Verflechtungen werden entscheidende Umbruchsphasen beleuchtet: die Debatten des Revolutionszeitalters, die Erneuerung des Internationalismus nach 1848/1849, das Wechselverhältnis (...) von Nationalismus und Universalismus um 1871, die Friedensbewegung vor 1914 und der Versuch, nach dem Krieg eine friedliche Weltordnung weltbürgerlich zu begründen. It is well known that Kant’s aesthetics is framed intersubjectively because he upholds the claim of taste to universality. However, the transcendental foundation of this shared universality is a supersensible ground which is taken for granted but which cannot be brought directly into communicative experience. Kant’s reliance on the synthetic a priori structure of aesthetic judgment also removes it from the sphere of observable personal interaction. This argumentative strategy exposes it to skeptical challenge and generates inaccessible references to inner representations (...) (be they intuitions, categories of the understanding or rational ideas). It is not sufficient, as Kant did, to propose a description of aesthetic experience that is subjectively plausible and thereby claim its intersubjective validity. It is indispensable to embody intersubjectivity in behavior and language. In practical intersubjectivity, aesthetic attitudes are dealt with in a concrete and accessible manner without relying on mentalistic assumptions as a foundation. Conceptual terms such as ‘agreeable’, ‘beauty’, ‘sublime’, ‘ugly’, ‘universality’ acquire new meaning. (shrink)

Criteria of historical assessment are applied to the Turin Shroud to determine which hypothesis relating to the image formation process is the most likely. To implement this, a ‘Minimal Facts’ approach is followed that takes into account only physicochemical and historical data receiving the widest consensus among contemporary scientists. The result indicates that the probability of the Shroud of Turin being the real shroud of Jesus of Nazareth is very high; historians and natural theologians should therefore pay it increased attention.

We propose a liminality-based analysis of the process of ethical leadership/followership in organizations. A liminal view presents ethical leadership as a process taking place in organizational contexts that are often characterized by high levels of ambiguity, which render the usual rules and preferences dubious or inadequate. In these relational spaces, involving leaders, followers, and their context, old frames may be questioned and new ones introduced in an emergent way, through subtle processes whose evolution and implications may not be easy to (...) grasp even by those participating in them. In this article, I discuss Otto Neurath’s philosophy in the context of Vienna Circle modernism. Following recent scholarship, the discussion considers as a starting point Neurath’s participation at the fourth International Congress of Modern Architecture (CIAM IV). However, the image of Neurath’s modernism that results from this perspective is incomplete because it tends to overlook the importance of scientific utopianism in Neurath’s thought. Scientific utopianism is a methodology proposed by Neurath for the social sciences in technological contexts, in which scientists (...) elaborate and develop plans (utopias) for the transformation of society, thus contributing to an informed societal debate. Decisions are nevertheless kept outside the domain of scientific activity. I claim that recognizing the centrality of scientific utopianism in Neurath’s philosophy is fundamental to understand Neurath’s modernism. This interpretation highlights the affinities of Neurath’s philosophy of the social sciences with the modern utopianism of H. G. Wells. Both authors consider that there can be no ultimate solution to social problems but that a plural and constant debate of proposals is fundamental for the improvement of society. Therefore, Neurath’s modernism connects his philosophy of science to the literary utopian tradition. (shrink)

Otto Neurath’s empiricist methodology of economics and his contributions to politi- cal economy have gained increasing attention in recent years. We connect this research with contemporary debates regarding the epistemological status of thought experiments by reconstructing Neurath’s utopias as linchpins of thought experiments. In our three reconstructed examples of different uses of utopias/dystopias in thought experiments we employ a reformulation of Häggqvist’s model for thought experiments and we argue that: (1) Our reformulation of Häggqvist’s model more adequately complies with many (...) uses of thought experiments, especially with the open-ended discussions of utopias and dys- topias in thought experiments. (2) As a strict logical empiricist, Neurath is committed to a strictly empiricist account of thought experiments. John Norton’s empiricist argument view can indeed account for the justifications of empirical beliefs and genuine discoveries targeted by scientific utopianism in three distinct (yet connected) ways, all of which Neur- ath already contemplated: (2.I) Dealing with utopias and thought experiments on a regular basis increases creativity and inventiveness. (2.II) Particular ways of presenting knowl- edge facilitate scientific discovery and social progress. (2.III) The use of utopias in thought experiments can prompt conceptual change and allow access to new phenomena. We con- clude by highlighting that, even though thought experiments support a positive attitude for exploring new social possibilities, Neurath points out that active decisions are unavoidable. The exploration of alternatives and the awareness of a need for decisions in policy discus- sion avert a technocratic outlook in social science. (shrink)

Obedience: a simple term. Stanley Milgram, the famous experimental social psychologist, shocked the world with theory about it. Another man, Pol Pot, the infamous leader of the Khmer Rouge, showed how far the desire for obedience could go in human societies. Milgram conducted his experiments in the controlled environment of the US psychology laboratory of the 1960s. Pol Pot experimented with Utopia in the totalitarian Kampuchea of the 1970s. In this article, we discuss the process through which the Khmer Rouge (...) regime created an army of unquestioningly obedient soldiers – including child soldiers. Based on these two cases, we advance a framework on how obedience can be grown or countered. (shrink)

L'objectif de cet article est de montrer dans quelle mesure, depuis la fin des années 1980, les théories de la mondialisation culturelle, nées d'une convergence dans le champ académique anglo-saxon entre certains tenants des Cultural Studies, de l'anthropologie et de la sociologie, ont marqué une rupture dans la façon d'appréhender les enjeux de l'internationalisation des médias. Nous appuyant sur quelques-uns des principaux textes ayant donné corps à ces théories de la mondialisation, nous retraçons les principaux déplacements du centre de gravité (...) de l'analyse qu'elles opèrent. Prenant acte des apports de ces théories pour la compréhension des processus d'appropriation des flux transnationaux, cet article souligne aussi leurs limites et conclut à la nécessité d'inclure les perspectives de l'économie politique dans l'étude des processus de transnationalisation pour que ceux-ci soient appréhendés dans toute leur complexité.The objective of this paper is to show how, since the late 1980s, theories of cultural globalization, born of a convergence in the Anglo-Saxon academic field between some proponents of cultural studies, anthropology and sociology, marked a break in the way of understanding issues of internationalization of the media. Drawing on some of the main texts that gave substance to these theories of globalization, we trace the main movements of center of gravity analysis they operate. Acknowledging the contributions of these theories for understanding the process of appropriation of transnational flows, this article also highlights limitations and concludes with the need to include the perspectives of political economy in the study of transnational processes that they are apprehended in all their complexity. Hydraulic fracturing ('fracking') has enabled the recovery of previously inaccessible resources and rendered new areas of the underground 'productive'. While a number of studies in the US and UK have examined public attitudes toward fracking and its various impacts, how people conceptualise the deep underground itself has received less attention. We argue that views on resources, risk and the deep underground raise important questions about how people perceive the desirability and viability of subterranean interventions. We conducted day-long deliberation workshops (two (...) in each country), facilitating discussions among diverse groups of people on prospective shale extraction in the US and UK. Themes that emerged in these conversations include seeing the Earth as a foundation; natural limits (a greater burden than the subsurface can withstand versus simply overuse of natural resources); and ideas about the fragility, instability and opacity of the deep underground. We find that concerns in both countries were not limited to specific, localised impacts but also addressed ecosystem links between surface and subsurface environments and broader questions about the use, identification and value of natural resources. Gillian Russell has recently proposed counterexamples to such elementary argument forms as Conjunction Introduction and Identity. These purported counterexamples involve expressions that are sensitive to linguistic context—for example, a sentence which is true when it appears alone but false when embedded in a larger sentence. If they are genuine counterexamples, it looks as though logical nihilism—the view that there are no valid argument forms—might be true. In this paper, I argue that the purported counterexamples are not genuine, on the grounds (...) that they equivocate. Having defused the threat of logical nihilism, I argue that the kind of linguistic context sensitivity at work in Russell’s purported counterexamples, if taken seriously, far from leading to logical nihilism, reveals new, previously undreamt-of valid forms. By way of proof of concept I present a simple logic, Solo-Only Propositional Logic, designed to capture some of them. Along the way, some interesting subtleties about the fallacy of equivocation are revealed. (shrink)

Traditional whistleblowing theories have purported that whistleblowers engage in a rational process in determining whether or not to blow the whistle on misconduct. However, stressors inherent to whistleblowing often impede rational thinking and act as a barrier to effective whistleblowing. The negative impact of these stressors on whistleblowing may be made worse depending on who engages in the misconduct: a peer or advisor. In the present study, participants are presented with an ethical scenario where either a peer or advisor engages (...) in misconduct, and positive and the negative consequences of whistleblowing are either directed to the wrongdoer, department, or university. Participant responses to case questions were evaluated for whistleblowing intentions, moral intensity, metacognitive reasoning strategies, and positive and negative, active and passive emotions. Findings indicate that participants were less likely to report the observed misconduct of an advisor compared to a peer. Furthermore, the findings also suggest that when an advisor is the source of misconduct, greater negative affect results. Post-hoc analyses were also conducted examining the differences between those who did and did not intend to blow the whistle under the circumstances of either having to report an advisor or peer. The implications of these findings for understanding the complexities involved in whistleblowing are discussed. (shrink)

A great need for systematic evaluation of ethics training programs exists. Those tasked with developing an ethics training program may be quick to dismiss the value of training evaluation in continuous process improvement. In the present effort, we use a case study approach to delineate how to leverage formative and summative evaluation measures to create a high-quality ethics education program. With regard to formative evaluation, information bearing on trainee reactions, qualitative data from the comments of trainees, in addition to empirical (...) findings, can ensure that the training program operates smoothly. Regarding summative evaluation, measures examining trainee cognition, behavior, and organization-level results provide information about how much trainees have changed as a result of taking the ethics training. The implications of effective training program evaluation are discussed. (shrink)

Data subject rights provide data controllers with obligations that can help with transparency, giving data subjects some control over their personal data. To date, a growing number of researchers have used these data subject rights as a methodology for data collection in research studies. No one, however, has gathered and analysed different academic research studies that use data subject rights as a methodology for data collection. To this end, we conducted a systematic literature review that searched, compiled, and analysed 32 (...) academic studies that use data subject rights as a data collection method. We find that the right of access is the most commonly-used data subject right by researchers, most studies are interested in measuring data subject rights compliance, and that a variety of difficulties exist in conducting research studies with data subject rights. We conclude that researchers should explore other data subject rights for alternative purposes, ease the process of exercising data subject rights, and improve the scalability of these studies. What is the relationship between justice as an individual virtue and justice as an institutional virtue? The latter has been exhaustively explored by political philosophers, whereas the former remains underexplored in the literature on virtue ethics. This article defends the view that individual justice is logically prior to institutional justice, and argues that this view requires a conception of individual justice I call ‘justice as lawfulness’. The resulting view consists of three claims. First, just institutions are composed of the relations (...) between just persons. Second, the just person has a disposition to act in accordance with the legal and social norms (collectively, thenomoi) of the existing political tradition. Third, departures from thenomoirequire that the just person act with practical wisdom to reform thenomoiaccording to an implicit standard of justice in the political tradition. (shrink)

Cultural capital and hegemonic masculinity are two concepts that have received intense attention. While both have received serious consideration, critique and analysis, the context or field-specificity of each is sometimes ignored. They have been used in a diversity of ways. Using ethnographic and interview data from a US male bodybuilding community, this study highlights one useful employment. Hegemonic masculinity takes different shapes in different fields of interaction, acting as a form of cultural capital: gender capital. Inherent in this discussion are (...) the cultural contradictions apparent among individuals striving for either physical or ideological embodiments of gender capital. Individuals can attempt to embody hegemonic idealizations, but bodies are not only inscribed with gender, inscriptions are read, and read differently by different social actors and in different settings. The capacity of gender capital to remain elusive is precisely what enables gender practices and projects like bodybuilding to retain passionate participation. (shrink)
