The International Criminal Court (ICC) seems to have finally realized the ending legal globalists have long yearned for: a potentially universal, centralized and permanent court, able to enforce international humanitarian law without the mediation of the state. A legal system of mankind seems now more possible than ever before. The universalistic claim of the ICC, I contend in this article, is nevertheless potentially biased by a West-centric prejudice. Critically drawing on the transcivilizational perspective suggested by Onuma Yasuaki, I (...) propose to overcome the West-centric approach of the ICC by assuming the multiplicity of universalisms, thus relativising each of them. Lo sviluppo del diritto internazionale penale è stato accolto con entusiasmo da attivisti per i diritti umani, giuristi e studiosi di questioni internazionali. La punizione dei crimini internazionali più gravi, come i crimini di guerra, quelli contro l’umanità e il genocidio è considerata un importante passo avanti verso l’effettiva protezione dei diritti umani e l’affermazione della pace. Questo entusiasmo sembra però aver lasciato sullo sfondo alcune domande fondamentali: come si giustifica l’esercizio del potere punitivo internazionale? Chi ne è il titolare (...) e in virtù di cosa? Il tribunale del mondo prova a rispondere a queste domande, indagando da una prospettiva filosofico-politico-giuridica la giustificazione del diritto internazionale penale e assumendo come punto di partenza le specificità del contesto internazionale. L’autrice auspica il superamento del diritto internazionale penale a favore di un sistema plurale di risposta alle gravi violazioni dei diritti elementari: un sistema che comprenda anche soluzioni non penali e che in alternativa all’universalismo del diritto penale internazionale offra meccanismi orientati alle esigenze delle comunità coinvolte. This book assesses the rapid transformation of the political agency of religious groups within transnational civil society under conditions of globalization weakening sovereign nation-states. It offers a synthesis of the resurgence of Jasper's axial thesis from distinct lines of research initiated by Eisenstadt, Habermas, Taylor, Bellah, and others. It explores the concept of cosmoipolitanism from the combined perspectives of sociology of religion, critical theory, secularization theory, and evolutionary cultural anthropology. At the theoretical level, cosmoipolitanism prescribes how local, national, transnational, global, (...) and virtual spaces ought publically to engage in transcivilizational discourse without presuming the secular assumptions tied to cosmopolitanism. Employing insights of critical theory, this book offers a micro-level analysis of the pragmatics of discourse of each axial tradition contributing to the role of religion within multiple modernities. While circumscribing the particular historical limits of each tradition, the book extends their internal claims to species universality in light of the potential for boundless communication Jaspers saw initiated with the Axial Age. There is a long-standing debate about whether poetry can make a substantive contribution to philosophy with compelling arguments to show that poetry and philosophy involve distinct modes of thought and aims, albeit with similar concerns. This paper argues that reading lyric poetry can play a substantive role in philosophy by helping the philosopher understand how to forge connections with the perspectives of others. The paper takes the view that poetry is not directly philosophical but can play an important role in (...) developing the philosopher's awareness of how perspective shapes beliefs and thought processes. Following Robert Nozick, David Lewis, and Helen Beebee, it argues for the need to broaden our conception of the aims of philosophy beyond aiming for conclusive proof, at the least where philosophical inquiry is focused on questions of value. This study articulates the leitmotif of civilizational analysis (the interaction of power and culture) with regard to the relation between religion and the state within the Islamic civilization or ‘Islamdom’. In a first step, it clarifies, by reference to Marshall Hodgson, the extent to which his view of Islamdom as a transcivilizational ecumene can fit into a comparative type of civilizational analysis. The comparative approach to civilizational analysis can be enriched by reevaluating the specific Islamic pattern of mild legitimization (...) of power through culture, and by integrating into the analysis the resulting field of tension vis-à-vis Western power and its supporting normative paradigms. In a second step, in order to better grasp the forms of power governing this field of tension, the article critically reconsiders Rémi Brague’s characterization of Western European civilization as the outcome of an expansive ‘Roman road’ that matched culture with power by investing into the charisma of corporate entities: first, the church, then the state. Against this double background, the study shows that the culture—power syndrome that is proper to Islamdom as a transcivilizational ecumene does not consecrate a separation of ‘religion’ from the body politic, but promotes the building of expansive patterns of connectedness. Islamic Perspectives on the Principles of Biomedical Ethics presents results from a pioneering seminar in 2013 between Muslim religious scholars, biomedical scientists, and Western bioethicists at the research Center for Islamic Legislation & Ethics, Qatar Faculty of Islamic Studies. Background Investigative genetic genealogy (IGG) is a technique that involves uploading genotypes developed from perpetrator DNA left at a crime scene, or DNA from unidentified remains, to public genetic genealogy databases to identify genetic relatives and, through the creation of a family tree, the individual who was the source of the DNA. As policymakers demonstrate interest in regulating IGG, it is important to understand public perspectives on IGG to determine whether proposed policies are aligned with public attitudes.Methods We conducted eight (...) focus groups with members of the public (N = 72), sampled from four geographically diverse US regions, to explore general attitudes and perspectives regarding aspects of IGG practices, applications, and policies. Five major topics were explored in each focus group: when IGG should be used; who should perform IGG; how to approach consent for genetic database users; what systems of oversight should govern IGG practitioners; and whether to notify database users if their data are involved in law enforcement (LE) matching.Results Participants were supportive of IGG in most scenarios, especially for cold and violent cases. The favorable attitudes toward IGG were, however, tempered by distrust of law enforcement among some participants. All participants agreed that databases must inform users if IGG is allowed, but they did not agree on how individual database users should be allowed to opt out or whether to notify them if their data are involved in specific investigations. All participants agreed that IGG should be subject to some prescriptive guidelines, regulations, or accountability mechanisms.Conclusions These findings suggest broad public support for IGG, and interest in developing systems of accountability for its practice. Our study provides useful insight for policy makers, genomic database stewards, law enforcement, and other stakeholders in IGG’s practice, and suggests multiple directions for future research. This book examines the idea of communalism in African cultures as a dominant philosophical theme that provides the conceptual foundation for African traditional moral thoughts, moral education, values, beliefs, conceptions of reality, practices, ways of life, and the now popular African saying, 'it takes a village to raise a child.' It defends communalism against various criticisms and argues that when properly understood and harnessed, it could provide the necessary foundation for Africa's development.

Feminists note an association of arguing with aggression and masculinity and question the necessity of this connection. Arguing also seems to some to identify a central method of philosophical reasoning, and gendered assumptions and standards would pose problems for the discipline. Can feminine modes of reasoning provide an alternative or supplement? Can overarching epistemological standards account for the benefits of different approaches to arguing? These are some of the prospects for argumentation inside and outside of philosophy that feminists consider. -/- (...) The further concern is that the academic study of argumentation – in philosophy and other disciplines – has failed to account for the type of reasoning needed for social justice movements. What resources for addressing these concerns can be found in informal logic and interdisciplinary argumentation theory? Since part of the perceived problem derives from assuming that arguing is a contest, are more collaborative epistemological frameworks better? Background: Current practice frequently fails to provide care consistent with the preferences of decisionally-incapacitated patients. It also imposes significant emotional burden on their surrogates. Algorithmic-based patient preference predictors (PPPs) have been proposed as a possible way to address these two concerns. While previous research found that patients strongly support the use of PPPs, the views of surrogates are unknown. The present study thus assessed the views of experienced surrogates regarding the possible use of PPPs as a means to help make (...) treatment decisions for decisionally-incapacitated patients. -/- Methods: This qualitative study used semi-structured interviews to determine the views of experienced surrogates [n=26] who were identified from two academic medical centers and two community hospitals. The primary outcomes were respondents’ overall level of support for the idea of using PPPs and the themes related to their views on how a PPP should be used, if at all, in practice. -/- Results: Overall, 21 participants supported the idea of using PPPs. The remaining five indicated that they would not use a PPP because they made decisions based on the patient’s best interests, not based on substituted judgment. Major themes which emerged were that surrogates, not the patient’s preferences, should determine how treatment decisions are made, and concern that PPPs might be used to deny expensive care or be biased against minority groups. -/- Conclusions: Surrogates, like patients, strongly support the idea of using PPPs to help make treatment decisions for decisionally-incapacitated patients. These findings provide support for developing a PPP and assessing it in practice. At the same time, patients and surrogates disagree over whose preferences should determine how treatment decisions are made, including whether to use a PPP. These findings reveal a fundamental disagreement regarding the guiding principles for surrogate decision-making. Future research is needed to assess this disagreement and consider ways to address it. In this volume, we present a collection of writings each offering their own novel perspective with respect to question of realism. No doubt it has gathered much attention of recent philosophical debates; and one of its characteristic aspects, among those it has had a most notable impact, has been in blurring the more the rigid way of thinking the traditional demarcations between "continental" and "analytic" philosophy. This volume, then, offers a contribution to some of the many discussions on realism (...) not only in the spirit that there is still much more to be said on the matter, but also in the recognition that a renewal of the discussion is necessary and should bypass old divisions. This is not to say that this volume departs entirely from any "old" sort of realism, or uncritically treats its object of study as creatable ex nihilo. In seeking to move beyond causal-reductivism, this book explores a variety of perspectives on the question of finding inherent meaning in madness and extreme states.

Consider a terrible situation that too many women find themselves in: 85,000 women are raped in England and Wales alone every year. Many of these women do not bring their cases to trial. There are multiple reasons that they might not want to testify in the courts. The incredibly low conviction rate is one. Another reason, however, might be that these women do not want the fact that they were raped to become the most salient thing about them. More specifically, (...) they do not want it to be the thing that others attend to the most—that others find most noticeable and memorable. In this paper, I introduce the notion of ‘harmful salience perspectives’ to help to explain this and related phenomena. This refers either to attention on things that should not be salient, or not enough attention on things that deserve to be made salient. Following ideas within the feminist literature on objectification, I argue that we can be harmed when aspects of our identity that do not reflect our personhood—our agency, rationality, personality, and so on—are more prominent in the minds of others than aspects that do reflect our personhood. Crucially, these ways of attending do not need to implicate false beliefs and harmful ideologies to be harmful, but can be harmful in their own right. (shrink)

The study deals with some of the central issues concerning the notion of death as discussed in Theravāda (Pāli Buddhism) as well as Mahāyāna Buddhism. What is the sense that death is regarded as an instance of duḥkha (Sanskrit) or dukkha (Pāli)? The research claims that here, firstly, the word duḥkha/dukkha is used as an adjective (which means ‘unsatisfactory’) rather than a noun (which means 'pain' or 'suffering'). Secondly, by death, the Buddha did not mean the act of dying but (...) the experience of someone's death or the idea of death. The Buddha also talked about deathlessness as the goal. Here, deathlessness does not amount to accepting something eternal but developing a proper perspective towards death by meditations such as that on impurity ( аśubhabhāvanā ) and contemplation on death ( maraṇānussati ). If the cessation of the cycle of rebirths and re-deaths ( punarmṛtyu ) is the ultimate goal that the arhat (Sanskrit), or arahant (Pāli), achieves, then the same should apply to Tathāgata. In that case, the problem suggests itself: how could the question of Tathāgata’s existence after death be accounted for as an unanswerable ( avyākṛta )? The study opines that the reason behind this is the profound, immeasurable, unfathomable nature attributed to Tathāgata. The research also discusses the basic difference between the attitudes on death in Śrāvakayāna and Mahāyāna. Lastly, it deals with the question of whether termination of one’s own life is permissible in Buddhism under certain conditions. (shrink)

The issues arising are vastly complicated, little understood, but of high importance. Philosophical Perspectives on Brain Data clarifies complex intersections of philosophical and neuroscientific interest, presenting an account of brain data that is comprehensible. This account can be the basis for evaluating practices based on brain data. As such, the book aims to open a novel space for evaluating hitherto arcane areas of academic research in order to provide the necessary scope for understanding their real-world consequences. These consequences will include personal, socio-political, and public health dimensions. Background The often poor prognosis associated with cancer necessitates empowering patients to express their care preferences. Yet, the prevalence of Advance Directives (AD) among oncology patients remains low. This study investigated oncologists' perspectives on the interests and challenges associated with implementing AD. Methods A French national online survey targeting hospital-based oncologists explored five areas: AD information, writing support, AD usage, personal perceptions of AD's importance, and respondent's profile. The primary outcome was to assess how frequently oncologists provide patients with information (...) about AD in daily clinical practice. Additionally, we examined factors related to delivering information on AD. Results Of the 410 oncologists (50%) who responded to the survey, 75% (n = 308) deemed AD relevant. While 36% (n = 149) regularly inform patients about AD, 25% (n = 102) remain skeptical about AD. Among the respondents who do not consistently discuss AD, the most common reason given is the belief that AD may induce anxiety (n = 211/353; 60%). Of all respondents, 90% (n = 367) believe patients require specific information to draft relevant AD. Physicians with experience in palliative care were more likely to discuss AD (43% vs 32.3%, p = 0.027). Previous experience in critical care was associated with higher levels of distrust towards AD (31.5% vs 18.8%, p = 0.003), and 68.5% (n = 281) of the respondents expressed that designating a “person of trust” would be more appropriate than utilizing AD. Conclusion Despite the perceived relevance of AD, only a third of oncologists regularly apprise their patients about them. Significant uncertainty persists about the safety and relevance of AD. This study investigated the perspective of Javanese Islamic philosophy on the Apak 'Beringin' rock fossil and its impact on the level of spirituality and community behavior, using a qualitative descriptive method with a phenomenological approach. Data analysis techniques were carried out using observation, interviews, and literature studies focusing on textual and contextual interpretations of the 'Beringin' Apak Fossil Rock. The main data sources came from the book of philosophy otak-athik gathuk (Javanese Islamic philosophical thought) by Damardjati Supadjar and the (...) book of commentary as-Sulami by Imam Abu Abd. Muhammad bin Husayn as-Sulami. The findings revealed that in Javanese Islamic philosophy, the symbolization of the universe depicted in the form of fossilized rocks aimed to train the soul in understanding the origin and purpose of everything in the universe or known as 'sangkan paraning damadi'. This is a manifestation of the Javanese Muslim community's way of knowing God or what is known as divine awareness ‘ilahiyah’. In the rock fossils that have been found, there are words Allah and Muhammad considered by the Javanese as a natural permit that is only obtained by people who reach certain maqam. The conclusion is that based on the elaboration of the meaning of the natural text which is symbolized in the form of the 'Beringin' Fossil rock, it is a reflection of oneself to always be close to Allah SWT. Moral certainty refers to those aspects of morality- moral acting, feeling, and thinking-that are beyond doubt, explanation, and justification. In two experiments, we demonstrate that intentional action intuitions vary as a function of whether one brings about or observes an event. In experiment 1a (N?=?38), participants were less likely to judge that they intended (M?=?2.53, 7 point scale) or intentionally (M?=?2.67) brought about a harmful event compared to intention (M?=?4.16) and intentionality (M?=?4.11) judgments made about somebody else. Experiments 1b and 1c confirmed and extended this pattern of actor-observer differences. Experiment 2 suggested that these actor-observer differences are not likely (...) to occur when participants are asked to ?imagine? being an actor. We argue that these results challenge the substantial philosophical and empirical reliance on hypothetical thought examples about intentional action. Our data offer new and necessary methodological avenues for understanding folk intentional action intuitions. (shrink)

"Liberal Perspectives for South Asia" discusses the essentials of the liberal philosophy, while also indicating how appropriate it is in the South Asian context. In the past, the subcontinent was renowned for the skill with which it took up the dominant ideologies of the west and articulated them for the Asian context. In the post-colonial period, the only dominant ideology that was sidetracked by all political parties was liberalism, the ideology that promoted freedom of the individual.
