Few thinkers have left such an influence across such a diverse range of studies as Michel Foucault has. This book pays homage to that diversity by presenting a multidisciplinary series of analyses dedicated to the question of power today.

Writings by a thinker—a psychiatrist, a philosopher, a cybernetician, and a poet—whose ideas about mind and brain were far ahead of his time. Warren S. McCulloch was an original thinker, in many respects far ahead of his time. McCulloch, who was a psychiatrist, a philosopher, a teacher, a mathematician, and a poet, termed his work “experimental epistemology.” He said, “There is one answer, only one, toward which I've groped for thirty years: to find out how brains work.” Embodiments of (...) Mind, first published more than fifty years ago, teems with intriguing concepts about the mind/brain that are highly relevant to recent developments in neuroscience and neural networks. It includes two classic papers coauthored with Walter Pitts, one of which applies Boolean algebra to neurons considered as gates, and the other of which shows the kind of nervous circuitry that could be used in perceiving universals. These first models are part of the basis of artificial intelligence. We face reality presented with the data of conscious experience and nothing else. The project of early modern philosophy was to build a complete theory of the world from this starting point, with no cheating. Crucial to this starting point is the data of conscious sensory experience – sense data. Attempts to avoid this project often argue that the very idea of sense data is confused. But the sense-data way of talking, the sense-data language, can be freed from every blemish (...) using ideas from contemporary metaontology. We can adopt a sense-data framework that vindicates the traditional claims of sense-data theories and leads to plausible theories of perception and color. We can, we should, and in a sense, we must. Yet when we do, we face the traditional problem of external world skepticism, head-on. The real challenge of skepticism is forced upon us; it cannot honestly be avoided using externalist tricks, burden of proof shifting, or other razzle dazzle. But the challenge can be met: we are rational to posit the external world as the best explanation of the many synchronic and diachronic patterns over our sense-data. This paper argues for all of these points and ends with a plea for analytic empiricism – a traditional sense-data version of empiricism that uses all of the tools of analytic philosophy while avoiding the more questionable doctrines of the Vienna Circle (phenomenalism, verificationism). Marxism's collapse in the twentieth century profoundly altered the style and substance of Western European radical thought. To build a more robust form of democratic theory and action, prominent theorists moved to reject revolution, abandon class for more fragmented models of social action, and elevate the political over the social. Acknowledging the constructedness of society and politics, they chose the "symbolic" as a concept powerful enough to reinvent leftist thought outside a Marxist framework. Following Maurice Merleau-Ponty's Adventures of the Dialectic, (...) which reassessed philosophical Marxism at mid century, Warren Breckman critically revisits these thrilling experiments in the aftermath of Marxism. The post-Marxist idea of the symbolic is dynamic and complex, uncannily echoing the early German Romantics, who first advanced a modern conception of symbolism and the symbolic. Hegel and Marx denounced the Romantics for their otherworldly and nebulous posture, yet post-Marxist thinkers appreciated the rich potential of the ambiguities and paradoxes the Romantics first recognized. Mapping different ideas of the symbolic among contemporary thinkers, Breckman traces a fascinating reflection of Romantic themes and resonances, and he explores in depth the effort to reconcile a radical and democratic political agenda with a politics that does not privilege materialist understandings of the social. Engaging with the work of Claude Lévi-Strauss, Cornelius Castoriadis, Claude Lefort, Marcel Gauchet, Ernesto Laclau, Chantal Mouffe, and Slavoj Žižek, Breckman uniquely situates these important theorists within two hundred years of European thought and extends their profound relevance to today's political activism. Daniel Dennett’s Consciousness Explained is probably the most widely read book about consciousness ever written by a philosopher. Despite this, the book has had a surprisingly small influence on how most philosophers of mind view consciousness. This might be because many philosophers badly misunderstand the book. They claim it does not even attempt to explain consciousness, but instead denies its very existence. Outside of philosophy the book has had more influence, but is saddled by the same misunderstanding. Now, 30 years (...) after publication, Consciousness Explained deserves reconsideration from anyone interested in consciousness. Here I make a case for this. To start, I will clear up the central misunderstanding of the book. With that done, I will explain and update Dennett’s tantalizing approach to consciousness and the mind. The result brings us very, very close to explaining consciousness. Or so I will argue. (shrink)

Quietist Moral Realists accept that there are moral facts and properties, while aiming to avoid many of the explanatory burdens thought to fall on traditional moral realists. This chapter examines the forms that Quietist Moral Realism has taken and the challenges it has faced, in order to better assess its prospects. The best hope, this chapter argues, lies in a pragmatist approach that distinguishes the different functions of diverse areas of discourse. This paves the way for a form of Quietism (...) that does not simply remain quiet about the explanatory demands of metaethics, but rather is able to diagnose where they go wrong. By combining a neopragmatic analysis of the discourse with an easy approach to ontology, , we can develop a form of Quietist Moral Realism that is far stronger than critics of quietism have appreciated. Corporate social accounting and stakeholder engagement is happening on an unprecedented scale. Rather than welcoming such initiatives, academics have been quick to pick faults with contemporary social auditing and reporting, claiming that in its current form it is not about demonstrating accountability at all, (...) but rather about building corporate reputation. Academics argue that ‘accountability should hurt’, that if accountability is an enjoyable process, then the organisation isn’t doing it right. For organisations that are currently engaging with stakeholders and ostensibly becoming more transparent about their corporate social performance, this kind of critique is likely to be bewildering. This paper argues that central to the notion of accountability and to contemporary social accounting practice is the concept of trust. Accountability is based upon a distrust of corporate management, whereas corporate reputation building is about strategically seeking to establish trust in stakeholder relationships in order to negate formal accountability requirements. Using a split trust continuum, the paper seeks to explain and synthesise what seem to be two very different paradigms of organisational transparency. (shrink)

Self-plagiarism requires clear definition within an environment that places integrity at the heart of the research enterprise. This paper explores the whole notion of self-plagiarism by academics and distinguishes between appropriate and inappropriate textual re-use in academic publications, while considering research on other forms of plagiarism such as student plagiarism. Based on the practical experience of the authors in identifying academics’ self-plagiarism using both electronic detection and manual analysis, a simple model is proposed for identifying self-plagiarism by academics.

Once upon a time, logical conventionalism was the most popular philosophical theory of logic. It was heavily favored by empiricists, logical positivists, and naturalists. According to logical conventionalism, linguistic conventions explain logical truth, validity, and modality. And conventions themselves are merely syntactic rules of language use, including inference rules. Logical conventionalism promised to eliminate mystery from the philosophy of logic by showing that both the metaphysics and epistemology of logic fit into a scientific picture of reality. For naturalists of all (...) stripes, this was paradise. Alas, paradise was lost. By the end of the twentieth century, logical conventionalism had been almost universally abandoned. But more recently, it has been revitalized. This chapter provides an overview of logical conventionalism and its history, clears away misunderstandings, and briefly responds to both the canonical objections to conventionalism (from Quine, Dummett, Boghossian, and many others) as well as new objections (from Field and Golan). Because of the “all-or-none” character of nervous activity, neural events and the relations among them can be treated by means of propositional logic. It is found that the behavior of every net can be described in these terms, with the addition of more complicated logical means for nets containing circles; and that for any logical expression satisfying certain conditions, one can find a net behaving in the fashion it describes. It is shown that many particular choices among possible neurophysiological assumptions (...) are equivalent, in the sense that for every net behaving under one assumption, there exists another net which behaves under the other and gives the same results, although perhaps not in the same time. An exceptional collection of letters, postcards, original writings, and photographs The First World War witnessed an unprecedented mobilization of philosophers and their families: as soldiers at the front; as public figures on the home front; as nurses in field hospitals; as mothers and wives; as sons and fathers. In Germany, the war irrupted in the midst of the rapid growth of Edmund Husserl's phenomenological movement – widely considered one of the most significant philosophical movements in twentieth century thought. Philosophers at (...) the Frontoffers a documentary history of phenomenology in the First World War. Through an exceptional collection of primary source materials (letters, postcards, original writings, photographs) from the Husserl Archives in Leuven, the Bayerische Staatsbibliothek, and the Archives of the University of Göttingen, the complex narratives of how the war affected the lives and thought of central figures in the phenomenological movement are charted. Key figures such as Edmund Husserl, his sons Wolfgang and Gerhart, Max Scheler, Edith Stein, Adolf Reinach, Martin Heidegger, and others are included in this collection of materials. Community Engagement (CE) has been presented by bio-ethicists and scientists as a straightforward and unequivocal good which can minimize the risks of exploitation and ensure a fair distribution of research benefits in developing countries. By means of ethnographic fieldwork undertaken in Kenya between 2007 and 2009 we explored how CE is understood and enacted in paediatric vaccine trials conducted by the Kenyan Medical Research Institute and the US Centers for Disease Control (KEMRI/CDC). In this paper we focus on the role (...) of paid volunteers who act as an interface between villagers KEMRI/CDC. Village Reporters’ (VRs) position of being both with the community and with KEMRI/CDC is advantageous for the conduct of trials. However it is also problematic in terms of exercising trust, balancing allegiances and representing community views. VRs role is shaped by ambiguities related to their employment status and their dual accountability to researchers and their villages. VRs are understandably careful to stress their commitment to self-less community service since it augments their respectability at community level and opens up opportunities for financial gain and self-development. Simultaneously VRs association with KEMRI/CDC and proximity to trial participants requires them to negotiate implicit and explicit expectations for material and medical assistance in a cultural setting in which much importance is placed on sharing and mutuality. To ensure continuity of productive interactions between VRs, and similar community intermediaries, and researchers, open discussion is needed about the problematic aspects of relational ethics, issues concerning undue influence, power relations and negotiating expectations. The COVID-19 pandemic caused an unprecedented and highly threatening, constrained, and confusing social and educational environment, we decided to expand the traditional focus of the extraneous load in Cognitive Load Theory acknowledging the psychological environment in which learning occurs. We therefore adapted and implemented principles of the CLT to reduce extraneous load for our students by facilitating their educational activities. Given previous empirical support for the principles of CLT, it was expected that the adoption of these principles might enable our (...) students to cultivate attitudes and skills across multiple domains such as online learning and presentation technologies, implementing and maintaining a “classroom atmosphere” in a virtual environment, participating in discussions among large online groups of students, facilitating group work, providing virtual office hours for students, and proactively planning for upcoming semesters. Real-world judgements and decisions often require choosing from an open-ended set of options which cannot be exhaustively considered before a choice is made. Recent work has found that the options people do consider tend to have particular features, such as high historical value. Here, we pursue the idea that option generation during decision making may reflect a more general mechanism for calling things to mind, by which relevant features in a context-appropriate representational space guide what comes to mind. In this (...) paper, we evaluate this proposal primarily based on what comes to mind in different familiar categories. We first introduce an empirical approach for deriving the space of features that people use to represent items in a particular category and for locating the category members that come to mind within that space. We show that in both familiar and ad hoc categories, a category member’s location along certain dimensions of the derived feature space predicts its likelihood of coming to mind. Next, we show that category members from these feature space locations come to mind by default in a way that is somewhat impervious to conscious control. We then demonstrate that the extent to which a given dimension is a predictor of what comes to mind within a category is related to how relevant that feature is for representing the category in question, using a novel measure of general feature relevance. Finally, we illustrate the usefulness of this framework in the context of a decision making task. We close with the proposal that people call category members to mind according to their location in representational space, specifically based on the predicted usefulness of considering category members with particular features. This paper contends that principles of virtue ethics have the potential to both supplement and complement academic integrity policy in the adjudication of undergraduate student academic integrity breaches. The paper uses elements of grounded theory to explore responses from 15 Academic Integrity Breach Decision Makers at an Australian university, and in particular, the process they use to determine outcomes for student breaches of academic integrity. The findings indicate that AIBDMs often use principles of virtue ethics to help provide nuanced judgement (...) on sometimes complicated breaches of ethical behaviour. The findings demonstrate that many AIBDMs supplemented their knowledge of institutional academic integrity policy with a deep commitment to their own virtuous behaviour. (shrink)

In 2014, Lord Saatchi launched his ultimately unsuccessful Medical Innovation Bill in the UK. Its laudable aim was to free doctors from the shackles that prevented them from providing responsible innovative treatment. Lord Saatchi’s principal contention was that current law was the unsurmountable barrier that prevented clinicians from delivering innovative treatments to cancer patients when conventional options had failed. This was because doctors feared that they might be sued or tried and convicted of gross negligence manslaughter if they deviated from (...) standard practice. Concerns about fear of the law and potential negative effects on medical practice are not new. Fear of litigation has been suggested as the reason for doctors practising “defensive medicine,” by opting for treatments regarded as “grievance-resistant,” rather than clinically indicated, for example, by ordering diagnostic tests or performing certain procedures, which are not strictly medically necessary. Whilst this claim is plausible and apparently accepted by the courts, there is limited empirical evidence in support of it so far as practitioners in the UK are concerned. In this paper, we report on our empirical research which provides a snapshot of medical opinion to begin to rectify this gap. We ran focus groups of different medical specialties, asking what these medical practitioners thought the barriers to medical innovation to be. We found that fear of the law was not the principal barrier to be lowered, and that the answer was far more multifaceted. (shrink)

Drawing on a variety of philosophical, theoretical and methodological approaches, the book examines how researchers relate to and with their participants before, during, and after the collection and/or production of data; reimagining the rights of participants, the role/s of participants, the concept/s of "participant" itself.

International Law in Context is a pedagogy-forward textbook. It reflects the recent paradigm shift in legal education, which focuses more on what students actually learn rather than the material to which they are exposed. The text aims to prepare the next generation of U.S. lawyers to engage with our interconnected world and to critically evaluate the U.S.'s role within the international legal order. The work is divided into three parts that accomplish these goals. Part One lays a foundation. It covers (...) the various actors within the system, the theories that help explain their behavior, and the principles and sources of law they create. Part Two turns to the fora that define and support the international order, the historical and political contexts that impacted their design, and their efficacy. Part Three is a capstone section that asks students to weave together everything they have learned in Parts One and Two. Students will engage in normative development regarding climate change, including the existing international treaty regime and U.S. implementation options, and the law of war in the modern age. The cornerstone of this book is its organization. The text groups material into conceptual frameworks that promote understanding and retention. For example, rather than consider the various dispute resolution fora in isolation, Part Two asks students to consider them in the context of what types of disputes arise and what legal rules can be employed to resolve them in various international and domestic fora. The institutions also are presented in chronology. In this way, students are encouraged to chart the developmental progression and to make connections and comparisons between various institutions. The use of conceptual frameworks continues within each part. For example, Chapter Six covers the sovereign State as a conflict resolution forum. Under this umbrella, the author discusses (a) State Jurisdiction; (b) The Reception of International Law into the Domestic Sphere; (c) The Qualification as a State Forum or State Litigant (i.e., Recognition of States & Governments); and (d) Protections Afforded Within the Forum: Sovereign, Diplomatic, and Consular Immunity. A typical coursebook might locate this material in four different chapters. The conceptual framework approach, however, allows students to see the big picture and the relationship between concepts. In addition to the frameworks, there are several other innovative pedagogical devices that support student learning. There are Foundation Questions that initially direct readers through the material and cumulatively help students confirm whether they have grasped key takeaways from each section. There also are Assessment Sets in each section, which provide students with immediate opportunities to apply material and gauge their understanding, and "Why Is This Important (a/k/a WITI Moment)" prompts designed to delve deeper into the underpinnings and consequences of various rules. Discussions surrounding music and ethical responsibility bring to mind arguments about legal ownership and purchase. Yet the many ways in which we experience music with others are usually overlooked. Musical experience and practice always involve relationships with other people, which can place limitations on how we listen to and act upon music. In Music and Ethical Responsibility, Jeff Warren challenges current approaches to music and ethics, drawing upon philosopher Emmanuel Levinas's theory that ethics is the responsibilities that arise from (...) our encounters with other people. Warren examines ethical responsibilities in musical experiences including performing other people's music, noise, negotiating musical meaning, and improvisation. Revealing the diverse roles that music plays in the experience of encountering others, Warren argues that musicians, researchers, and listeners should place ethical responsibility at the heart of musical practices. Dreaming is often characterized as lacking high-order cognitive skills. In two studies, we test the alternative hypothesis that the dreaming mind is highly similar to the waking mind. Multiple experience samples were obtained from late-night REM sleep and waking, following a systematic protocol described in Kahan . Results indicated that reported dreaming and waking experiences are surprisingly similar in their cognitive and sensory qualities. Concurrently, ratings of dreaming and waking experiences were markedly different on questions of general reality orientation and (...) logical organization . Consistent with other recent studies , experiences sampled from dreaming and waking were more similar with respect to their process features than with respect to their structural features. (shrink)

In this paper we set out the basic model theory of differential fields of characteristic 0, which have finitely many commuting derivations. We give axioms for the theory of differentially closed differential fields with m derivations and show that this theory is ω-stable, model complete, and quantifier-eliminable, and that it admits elimination of imaginaries. We give a characterization of forking and compute the rank of this theory to be ω m + 1.

The measurement of sensory intensity has had a long history, attracting the attention of investigators from many disciplines including physiology, psychology, physics, mathematics, philosophy, and even chemistry. While there has been a continuing doubt by some that sensation has the properties necessary for measurement, experiments designed to obtain estimates of sensory intensity have found that a general rule applies: Equal stimulus ratios produce equal sensory ratios. Theories concerning the basis for this simple psychophysical rule are discussed, with emphasis given to (...) the physical correlate theory, which considers judgments of subjective magnitudes to be based upon estimates of physical dimensions that vary regularly with changes in degree of stimulation. For the most thoroughly investigated sensory scales, brightness and loudness, the physical correlate is considered to be distance. Our “tacit knowledge” of the sensory effects of changing distance plays an essential role in matching motor activities to environmental conditions and in ensuring accurate perceptual evaluations through brightness and loudness constancies. In psychophysical experiments, subjects apparently use this same tacit knowledge when required to estimate relative subjective magnitudes. The evidence related to the physical correlate theory is summarized, and it is concluded that, while under appropriate conditions we demonstrate considerable skill in evaluating environmental relationships, we are quite unable to estimate the neurophysiological nature or quantity of sensory response. A psychophysics devoted to studying conditions required for accuracy and conditions producing errors in the perception of environmental relationships would seem to be more valuable than one devoted to subjective magnitudes. Means–ends decoupling has recently been suggested as one consequence of the problems organizations face in trying to comply with institutional rules in contexts of institutional complexity. Such decoupling is characterized by the adoption, implementation, and scrutiny of particular codes of practice, which tend not to deliver the outcomes they were developed to produce. Recent scholarship focusing on this issue has suggested that such decoupling is a consequence of the trade-off organizations need to make between compliance and goal achievement, most especially (...) when the latter is difficult to evaluate. Although recent scholarship has suggested that this tension might be mitigated by the activities of developers of compliance rules, in this article, we explore how actors internal to organizations, in this case, two charitable organizations, mitigate this tension via nonconformance with particular codes. We focus on how the process of accounting for nonconformance results in the discursive coupling of means and ends as actors creatively develop vocabularies of motive, which respond to anticipated social criticism. Maimonides requires the multitude to observe many ceremonial commandments, while Spinoza makes no such demand. This chapter focuses on some of the main points of agreement between Maimonides and Spinoza on true religion, the religion of reason, or philosophic religion. True religion includes also piety, that is, moral conduct, which follows from the rational life. The piety of the philosopher and the non‐philosopher both consist in doing good to others. Maimonides’ approach to true religion adumbrates Spinoza's. Spinoza's concept of amor (...) Dei intellectualis echoes Maimonides’ concept of the passionate intellectual love of God. Spinoza's concept of piety is adumbrated in Maimonides. The Maimonidean thrust of Spinoza's concept of true religion is evident in his discussion of “the divine Law” or, more precisely, “the natural divine Law” and the summum bonum in TTP4. In Maimonides’ language, true religion is based on the intelligibilia and popular religion on generally accepted opinions. (shrink)

The current international healthcare focus on ensuring the perspectives and needs of individual persons, families or communities are met has led to the core tenet of person‐centred care for all. The nurse–patient relationship is central to the provision of care, and enhancing this relationship to ensure trust and respect supports optimal care outcomes for those accessing healthcare services. Engaging authentically is one of the recognised key approaches in person‐centred practice, and this scoping review of the literature aims to gain an (...) understanding of the role this process plays in developing effective relationships between nurses and the people they care for. A systematic search of databases and grey literature was undertaken, and twenty‐one research papers met the inclusion criteria. A thematic analysis revealed four themes: ‘getting to know the patient as a person’, ‘the complexity of relationship building—it takes time’, ‘the nurse: characteristics and behaviours that support the nurse–patient relationship’ and ‘the patient voice’. Nurses and patients both benefit from effective relationships, feeling valued and experiencing greater satisfaction with care. Key elements of engaging authentically were revealed as a nurse–patient relational process through this literature review; however, further research is needed to gain a greater understanding of this concept. This study examines the relationship between gender, class, and race through a case study of the Ontario, Canada dental profession in the first two decades of the twentieth century. During this time period dentists endeavored to solidify their claims to professional status by defining their relations with patients, the public, and with dental assistants. Dentists drew on gender, class, and racial-ethnic relations and ideology in defining these relations and fostering their professional identity. In the past twenty years, advances in forensic DNA technology have revolutionized the American criminal justice system. The use of forensic DNA testing in America began in 1987, and its demonstrated scientific accuracy quickly led jurisdictions to accept expert testimony regarding DNA matches between suspects and crime scene evidence. Wielding the power to exonerate the innocent and apprehend the guilty, the use of DNA identification technology has become an indispensable resource for prosecutors and law enforcement officials, as well as for (...) defense lawyers representing persons falsely accused or wrongfully convicted of crimes they did not commit. As states began to compile DNA profiles from convicted offenders, the need for a repository for these profiles resulted in the DNA database.Originally, DNA databases included only “those classes of offenders with a high recidivism rate, such as sex offenders and violent felons.” Recognizing the crime-solving potential of this technology, state legislatures soon began to expand the scope of DNA database statutes to include broader classes of offenders. Thirty-eight “practiced” dreamers and 50 “novice” dreamers completed questionnaires assessing the cognitive, metacognitive, and emotional qualities of recent waking and dreaming experiences. The present findings suggest that dreaming cognition is more similar to waking cognition than previously assumed and that the differences between dreaming and waking cognition are more quantitative than qualitative. Results from the two studies were generally consistent, indicating that high-order cognition during dreaming is not restricted to individuals practiced in dream recall or self-observation. None of the measured (...) features was absent or infrequent in reports of either dreaming or waking experiences. In the past twenty years, advances in forensic DNA technology have revolutionized the American criminal justice system. The use of forensic DNA testing in America began in 1987, and its demonstrated scientific accuracy quickly led jurisdictions to accept expert testimony regarding DNA matches between suspects and crime scene evidence. Wielding the power to exonerate the innocent and apprehend the guilty, the use of DNA identification technology has become an indispensable resource for prosecutors and law enforcement officials, as well as for (...) defense lawyers representing persons falsely accused or wrongfully convicted of crimes they did not commit. As states began to compile DNA profiles from convicted offenders, the need for a repository for these profiles resulted in the DNA database.Originally, DNA databases included only “those classes of offenders with a high recidivism rate, such as sex offenders and violent felons.” Recognizing the crime-solving potential of this technology, state legislatures soon began to expand the scope of DNA database statutes to include broader classes of offenders. Evidence of reflective awareness and metacognitive monitoring during REM sleep dreaming poses a significant challenge to the commonly held view of dream cognition as necessarily deficient relative to waking cognition. To date, dream metacognition has not received the theoretical or experimental attention it deserves. As a result, discussions of dream cognition have been underrepresented in theoretical accounts of consciousness. This paper argues for using a converging measures approach to investigate the range and limits of cognition and metacognition across the sleep–wakefulness (...) cycle. The paradigm developed by LaBerge and his colleagues to study "lucid-control" dreaming offers one such framework for relating phenomenological, cognitive, and physiological measures. In a lucid-control dream, the dreamer is both aware that the experimental context is a dream and has the ability to intentionally regulate aspects of the dream . Subjects can make patterns of deliberate eye movements to signal from the dream and thus index significant events such as the time of lucidity onset and the completion of previously agreed-upon tasks in the dream. Lucid dreaming and other examples of reflective awareness during dreaming have important implications for models of human cognition. The existence of these phenomena raises fundamental questions about current assumptions regarding "state" constraints on consciousness and cognition. (shrink)
