This article challenges the widespread contention - promoted by the World Health Organization, the U.N. Human Rights Commission, and certain non-governmental organizations - that health care should be regarded as an individual human right. Like other "post-modern" rights, the asserted individual right to health care is a positive claim on the resources of others; it is unlimited by corresponding responsibilities; and it pertains exclusively to the individual. In fact, an individual human right to health, enforceable against either governments or corporations, (...) does not currently exist in law. If established, such a right would portend a dramatic expansion of government control over health care, with negative consequences for efficiency and patient welfare. Voluntary efforts based on partnership, rather than the imposition of legal requirements, are the most productive means of expanding access to health care while preserving incentives for continued development of innovative health technologies. The principle of autonomy is widely recognized to be of utmost importance in bioethics; however, we argue that this principle is often misapplied when one fails to distinguish two different contexts in medicine. When a particular patient is offered treatment options, she has the ultimate say in whether to proceed with any of those treatments. However, when deciding whether a particular intervention should be regarded as a form of medical treatment in the first place, it is the medical community who (...) has the ultimate say. Some argue that particular interventions should be allowed by virtue of the fact that they are autonomously requested. But making such an argument fails to distinguish between these two contexts and misapplies the principle of autonomy, ultimately having the potential to instigate problematic changes in the practice of medicine. The five commentators on my paper ‘Gettier Cases in Epistemic Logic’ (GCEL) demonstrate how fruitful the topic can be. Especially in Brian Weatherson's contribution, and to some extent in those of Jennifer Nagel and Jeremy Goodman, much of the material constitutes valuable development and refinement of ideas in GCEL, rather than criticism. In response, I draw some threads together, and answer objections, mainly those in the papers by Stewart Cohen and Juan Comesaña and by Goodman.

This paper is a study of higher-order contingentism – the view, roughly, that it is contingent what properties and propositions there are. We explore the motivations for this view and various ways in which it might be developed, synthesizing and expanding on work by Kit Fine, Robert Stalnaker, and Timothy Williamson. Special attention is paid to the question of whether the view makes sense by its own lights, or whether articulating the view requires drawing distinctions among possibilities that, according (...) to the view itself, do not exist to be drawn. The paper begins with a non-technical exposition of the main ideas and technical results, which can be read on its own. This exposition is followed by a formal investigation of higher-order contingentism, in which the tools of variable-domain intensional model theory are used to articulate various versions of the view, understood as theories formulated in a higher-order modal language. Our overall assessment is mixed: higher-order contingentism can be fleshed out into an elegant systematic theory, but perhaps only at the cost of abandoning some of its original motivations. This chapter takes up issues to do with Peter van Inwagen's (1990a) general composition question: what is it for one thing to be a part of another? The chapter begins with some background to do with formal mereology, the study of parts and wholes. In discussing the metaphysics of parts and wholes, it is helpful to have some specialized vocabulary, as well as a well thought‐out mathematical model of a very broad, inclusive theory. The theory of mereology, proposed by the (...) logician Stanislaw Lesniewski and introduced to the widerworld by Goodman and Leonard in an article in the Journal of Symbolic Logic, provides that vocabulary and such a model. These mereologists proposed some basic axioms for the part‐whole relation. Alternatively, the Composition as Identity (CAI) theorist could try to build transitivity into their definition of the part‐whole relation. Finally, the chapter provides some answers to the General Composition Question and considers whether those answers can supply a ground for the correct principles of mereology. (shrink)

In a series of recent papers, Timothy Williamson has argued for the surprising conclusion that there are cases in which you know a proposition in spite of its being overwhelmingly improbable given what you know that you know it. His argument relies on certain formal models of our imprecise knowledge of the values of perceptible and measurable magnitudes. This paper suggests an alternative class of models that do not predict this sort of improbable knowing. I show that such models (...) are motivated by independently plausible principles in the epistemology of perception, the epistemology of estimation, and concerning the connection between knowledge and justified belief. Knowledge and its Limits presents a systematic new conception of knowledge as a kind of mental stage sensitive to the knower's environment. It makes a major contribution to the debate between externalist and internalist philosophies of mind, and breaks radically with the epistemological tradition of analyzing knowledge in terms of true belief. The theory casts new light on such philosophical problems as scepticism, evidence, probability and assertion, realism and anti-realism, and the limits of what can be known. With this third edition of Nelson Goodman's The Structure of Appear ance, we are pleased to make available once more one of the most in fluential and important works in the philosophy of our times. Professor Geoffrey Hellman's introduction gives a sustained analysis and appreciation of the major themes and the thrust of the book, as well as an account of the ways in which many of Goodman's problems and projects have been picked up and developed by others. This chapter offers an opinionated introduction to higher-order formal languages with an eye towards their applications in metaphysics. A simply relationally typed higher-order language is introduced in four stages: starting with first-order logic, adding first-order predicate abstraction, generalizing to higher-order predicate abstraction, and finally adding higher-order quantification. It is argued that both β-conversion and Universal Instantiation are valid on the intended interpretation of this language. Given these two principles, it is then shown how we can use pure higher-order logic to (...) ask, and begin to answer, metaphysical questions with non-trivial implications. In particular, while we must reject the popular idea that structural differences between sentences correspond to parallel distinctions in the logical structure of extra-linguistic reality, it may still be possible to give a purely logical characterization of objectual aboutness and related notions. The Tattvasaṃgraha, or Encyclopedia of Metaphysics, is the most influential and most frequently studied philosophical text from the late period of Indian Buddhism. This edition includes verses by Śāntarakṣita (c. 725-788 CE), which are clarified and expounded in the commentary of his student Kamalaśīla (c. 740-795 CE); both of these authors played crucial roles in founding the Buddhist tradition of Tibet. In the Tattvasaṃgraha, they explain, discuss and critique a vast range of views and arguments from across the whole South (...) Asian philosophical and religious spectrum. The work deals at length with ideas drawn from Buddhism, Jainism, and a variety of traditions now incorporated within Hinduism, including Mīmāṃsā, Nyāya-vaiśeṣika, and Sāṃkhya; it also includes the earliest discussion of Advaita Vedānta in any Buddhist text. The chapters selected for translation from Sanskrit and Tibetan deal with such fundamental philosophical issues as the existence or nonexistence of God and the soul; the nature of matter and of causal relationships; the connection between words and their referents; the rules of logic; the sources of our knowledge; and the compatibility of beliefs about karma with Buddhism's fundamental claim that there is no self. In this paper, we consider recent attempts to metaphysically explain agentive modality in terms of conditionals. We suggest that the best recent accounts face counterexamples, and more worryingly, they take some agentive modality for granted. In particular, the ability to perform basic actions features as a primitive in these theories. While it is perfectly acceptable for a semantics of agentive modal claims to take some modality for granted in getting the extension of action claims correct, a metaphysical explanation of agentive (...) modality cannot, at least not in the way that conditional approaches to agentive modality do. We argue that this problem was present even in the classical conditional analysis. By a pessimistic induction, we suggest that, probably, no conditional approach to agentive modality will succeed. Closest-possible-world analyses of counterfactuals suffer from what has been called the ‘problem of counterpossibles’: some counterfactuals with metaphysically impossible antecedents seem plainly false, but the proposed analyses imply that they are all (vacuously) true. One alleged solution to this problem is the addition of impossible worlds. In this paper, I argue that the closest possible or impossible world analyses that have recently been suggested suffer from the ‘new problem of counterpossibles’: the proposed analyses imply that some plainly true counterpossibles (viz., (...) ‘counterlogicals’) are false. After motivating and presenting the ‘new problem’, I give reasons to think that the most plausible objection to my argument is not compelling. (shrink)

Knepper criticizes existing efforts in the philosophy of religion for being out of step with, and therefore useless to, the academic study of religion, then forwards a new program for philosophy of religion that is in step with, and therefore useful to, the academic study of religion.

According to the Fragmentation Analysis, epistemic akrasia is a state of conflict between beliefs formed by the linguistic and non-linguistic belief-formation systems, and epistemic akrasia is irrational because it is a state of conflict between beliefs so formed. I argue that there are cases of higher-order epistemic akrasia, where both beliefs are formed by the linguistic belief-formation system. Because the Fragmentation Analysis cannot accommodate this possibility, the Fragmentation Analysis is incorrect. I consider three objections to the possibility of higher-order epistemic (...) akrasia. Along the way, I offer a revision of the Fragmentation Analysis that can allow for the possibility of higher-order akrasia while avoiding the problems I point out for the original view. (shrink)

Second-order logic and modal logic are both, separately, major topics of philosophical discussion. Although both have been criticized by Quine and others, increasingly many philosophers find their strictures uncompelling, and regard both branches of logic as valuable resources for the articulation and investigation of significant issues in logical metaphysics and elsewhere. One might therefore expect some combination of the two sorts of logic to constitute a natural and more comprehensive background logic for metaphysics. Skeptical theism is a family of responses to the evidential problem of evil. What unifies this family is two general claims. First, that even if God were to exist, we shouldn’t expect to see God’s reasons for permitting the suffering we observe. Second, the previous claim entails the failure of a variety of arguments from evil against the existence of God. In this essay, we identify three particular articulations of skeptical theism—three different ways of “filling in” those two claims—and describes (...) their role in responding to evidential arguments of evil due to William Rowe and Paul Draper. But skeptical theism has been subject to a variety of criticisms, several of which raise interesting issues and puzzles not just in philosophy of religion but other areas of philosophy as well. Consequently, we discuss some of these criticisms, partly with an eye to bringing out the connections between skeptical theism and current topics in mainstream philosophy. Finally, we conclude by situating skeptical theism within our own distinctive methodology for evaluating world views, what we call “worldview theory versioning.”. (shrink)

The paper explores the main competing interpretations of Aristotle's view of the relation between happiness and external goods in the Nicomachean Ethics. On the basis of a careful analysis of what Aristotle says in the Nicomachean Ethics (and other works such as the Eudemian Ethics, Politics, Rhetoric, etc.) it is argued that it is likely that Aristotle takes at least some external goods to be actual constituents of happiness provided that (1) they are accompanied by virtuous activity and (2) the (...) agent enjoying and using those external goods does so in ways compatible with the continuous aim of acting virtuously. Orthodox Judaism is one of the fastest-growing religious communities in contemporary American life. According to the 2013 Pew Center Survey on American religious life, Orthodox Judaism is poised to surpass all other denominations of Judaism in the United States by 2050. Anyone who wishes to understand more about Judaism in America will need to consider the tenets and practices of Orthodox Judaism: who its adherents are, what they believe in, what motivates them, and to whom they turn for moral, intellectual, (...) and spiritual guidance. Among those spiritual leaders none looms larger than Rabbi Joseph B. Soloveitchik, heir to the legendary Talmudic dynasty of Brisk and a teacher and ordainer of thousands of rabbis during his time as a Talmud teacher at Yeshiva University from the Second World War until the 1980s. Soloveitchik was not only a Talmudic authority but a scholar of Western philosophy. While many books and articles have been written about Soloveitchik's legacy and his influence on American Orthodoxy, few have looked carefully at his disciples in Torah and Talmud study, and even fewer at his Jewish thought and philosophy. "Soloveitchik's Children: Irving Greenberg, David Hartman, Jonathan Sacks, and the Future of Jewish Theology in America" is the first book to study closely three of Soloveitchik's major disciples in Jewish thought and philosophy: Rabbis Irving ("Yitz") Greenberg, David Hartman, and Jonathan Sacks. Th ere is much controversy surrounding the nature of the relation between fictional individuals and possible individuals. Some have argued that no fictional individual is a possible individual; others have argued that (some) fictional individuals just are (merely) possible individuals. In this paper, I off er further grounds for believing the theory of fictional individuals defended by Amie Thomasson,viz., Artifactualism, by arguing that her view best allows one to make sense of this puzzling relation. More specifically, when we realize that (...) the view allows for an identification of merely possible individuals with fictional individuals, we seethat the utility, and hence the level of credence lent to Artifactualism, is increased. Philosophy can do still better in the future by applying model‐building methods more systematically and self‐consciously, with consequent readjustments to its methodology. An original study of late Enlightenment aesthetics, poetics, and environmental medicine as overlapping ways of comprehending the dislocations of historical existence lodged in the movements of bodies and minds This book studies later eighteenth-century medicine, aesthetics, and poetics as overlapping forms of knowledge increasingly concerned about the relationship between the geographical movements of persons displaced from home and the physiological or nervous "motions" within their bodies and minds. Looking beyond familiar narratives about medicine and art's shared therapeutic and harmonizing ideals, (...) this book explores Enlightenment and Romantic-era aesthetics and poetics in relation to a central but less well known area of eighteenth-century environmental medicine: pathology. No mere system of diagnosis or classification, philosophical pathology was an art of interpretation, offering sophisticated ways of reading the multiple conditions and causes of disease, however absent from perception, in their palpable, embodied effects. For medical, anthropological, environmental, and literary authors alike, it helped to locate the dislocations of modern mobility when a full view of their causes and conditions remained imperfectly understood or still unfolding. Goodman traces the surprising afterlife of the period's exemplary but unexplained pathology of motion, medical nostalgia, within aesthetic theory and poetics, arguing that nostalgia persisted there not as a named condition but as a set of formal principles and practices, perturbing claims about the harmony, freedom, and free play of the mind. In Talking about, Unnsteinsson defends an intentionalist theory of reference by arguing that confused referential intentions degrade reference. Central to this project is a “belief model” of both identity confusion and unconfused thought. By appealing to a well‐known argument from Campbell, I argue that this belief model falls short, because it fails to explain the inferential behavior it promises to explain. Campbell's argument has been central in the contemporary literature on Frege's puzzle, but Unnsteinsson's account of confusion provides an opportunity (...) for more clarity about how the argument is best interpreted, and what it shows.
