Systems of private regulation based on certification have recently emerged to address environmental issues in the forest products industry and labor issues in the apparel industry. To explain why the same regulatory form has emerged across these fields, the author uses a historical and comparative case study approach, closely examining early moments and paying attention to “roads not taken.” Two types of factors led to the initial emergence of private certification: social movement campaigns targeting companies and a neo-liberal institutional context. The implementation of transnational standards — in codes of conduct, certification, and monitoring initiatives — necessarily intertwines with domestic law and other types of rules. Yet much of the existing literature overlooks or obscures this fundamental point. Indeed, scholars often err either by treating private regulatory standards as transcendent or by viewing implementation as fundamentally a technical problem. This Article argues that understanding the operation of transnational private regulation requires attention to the layering of multiple rules in a given location. (...) It develops a framework for examining this layering and illustrates it by briefly looking at two major issues—community rights in sustainable forestry standards and freedom of association in fair labor standards — and their implementation in Indonesia. Explanation does not exist in a metaphysical vacuum. Conceptions of the structure of a phenomenon play an important role in guiding attempts to explain it, and erroneous conceptions of a phenomenon may direct investigation in misleading directions. I believe that there is a case to be made for thinking that much work on the neural underpinnings of consciousness—what is often called the neural correlates of consciousness—is driven by an erroneous conception of the structure of consciousness. The aim of this paper (...) is lay bare some connections between the explanation of consciousness and the structure of consciousness, and to argue for a conception of the structure of consciousness that is more adequate than that which currently drives much research into the neural correlates of consciousness. John McDowell's contribution to philosophy has ranged across Greek philosophy, philosophy of language, philosophy of mind, metaphysics and ethics. His writings have drawn on the works of, amongst others, Aristotle, Kant, Hegel, Frege, Russell, Wittgenstein, Sellars, and Davidson. His contributions have made him one of the most widely read, discussed and challenging philosophers writing today. Neural organoids are laboratory-generated entities that replicate certain structural and functional features of the human brain. Most neural organoids are disembodied—completely decoupled from sensory input and motor output. As such, questions about their potential capacity for consciousness are exceptionally difficult to answer. While not disputing the need for caution regarding certain neural organoid types, this paper appeals to two broad constraints on any adequate theory of consciousness—the first involving the dependence of consciousness on embodiment; the second involving the dependence of (...) consciousness on representations—to argue that disembodied neural organoids are not plausible candidates for consciousness. The paper aims to put certain basic mathematical elements and operations into an empirical perspective, evaluate the empirical status of various analytic operations widely used within psychology and suggest alternatives to procedures criticized as inadequate. Experimentation shows the "manyness" of items to be a perceptual quality for both young children and animals and that natural operations are performed by naive children analogous to those performed by persons tutored in arithmetic. Number, counting, arithmetic operations therefore can make distinctions that are not (...) inevitably arbitrary, and conceptual operations can obviously have a status as natural events with psychology. If the elements and conceptual operations involved in mathematical systems were not inherent in physiological process, various primitive discriminations could not be possible. Also, since some calculi have a natural status in a given empirical circumstance, the axioms of others can not be satisfied. Therefore the psychologist when acting as an empirical scientist seeks a calculus having a structure whose elements are isomorphic with natural units of stimulus and response and whose operations are isomorphic with whatever natural processes are involved. Measurement poses a special problem for the empirical scientist. It concerns but a single class of natural qualities and this only in a limited way. The concept of quantity has a natural counterpart but quantity and measurement are not wholly analogous. Measurement is defined, as H. S. Leonard suggests, as a theoretical activity. Measurement theory has a formal structure but empirical end. Measurement hypothesizes about the position of a particular quality within a definite range of qualities. It therefore is beholden to definite empirical restrictions. Some hypotheses-making systems use terms and relations per se as the context and starting point for dealing with discriminable events. Such procedures are 'transcendent." In empirical science, questions are part of problem-solving activity and their reference is naturally restricted. In providing description and explanation, psychological researchers frequently use calculi in a transcendent way. This results in theories that are only quasi-empirical and "half" true. The roles measurement plays in psychology are discussed. Of particular concern are those cases in which the results of measuring or a theory of measurement are used to define the "real" units, or the "real" relations involved in problematic psychological events, and thence to describe and explain behaviors of interest. Metaphysical or ontological usages of measurement sometimes occur. The implication of these arguments with regard to a view of empirical science is discussed. (shrink)

Hilary Putnam once suggested that “the actual existence of sets as ‘intangible objects’ suffers… from a generalization of a problem first pointed out by Paul Benacerraf… are sets a kind of function or are functions a sort of set?” Sadly, he did not elaborate; my aim, here, is to do so on his behalf. There are well-known methods for treating sets as functions and functions as sets. But these do not raise any obvious philosophical or foundational puzzles. For that, we (...) first need to provide a full-fledged function theory. I supply such a theory: it axiomatizes the iterative notion of function in exactly the same sense that ZF axiomatizes the iterative notion of set. Indeed, this function theory is synonymous with ZF. It might seem that set theory and function theory present us with rival foundations for mathematics, since they postulate different ontologies. But appearances are deceptive. Set theory and function theory provide the very same judicial foundation for mathematics. They do not supply rival metaphysical foundations; indeed, if they supply metaphysical foundations at all, then they supply the very same metaphysical foundations. (shrink)

It is common to distinguish between conscious mental episodes and standing mental states — those mental features like beliefs, desires or intentions, which a subject can have even if she is not conscious, or when her consciousness is occupied with something else. This paper presents a view of standing mental states according to which these states are less real than episodes of consciousness. It starts from the usual view that states like beliefs and desires are not directly present to the (...) mind, but are posited to explain thought and behaviour. Ascriptions of these states are attempts to model a subject’s “Worldview”: the totality of their cognitive, conative and affective dispositions. When ascribing standing states, we often significantly simplify the complexity of the Worldview. This simplification is a feature of models in general. The Worldview is also distinguished from the “Habitus” — the totality of dispositions that are associated with character traits. As with the Worldview, modelling the Habitus should be treated as a useful simplification of a very complex reality. It is argued that although these models have some similarities with fictions, these similarities are outweighed by the dissimilarities. (shrink)

Universals are putative objects like wisdom, morality, redness, etc. Although we believe in properties (which, we argue, are not a kind of object), we do not believe in universals. However, a number of ordinary, natural language constructions seem to commit us to their existence. Philosophy and Model Theory aims to understand their interactions -/- Model theory is used in every ‘theoretical’ branch of analytic philosophy: in philosophy of mathematics, in philosophy of science, in philosophy of language, in philosophical logic, and in metaphysics. But these wide-ranging appeals to model theory have created a highly fragmented literature. On the one hand, many philosophically significant mathematical results are found only in mathematics textbooks: these are aimed squarely at mathematicians; (...) they typically presuppose that the reader has a significant background in mathematics; and little clue is given as to their philosophical significance. On the other hand, the philosophical applications of these results are then scattered across disconnected pockets of papers, separated by decades or more. -/- The first aim of Philosophy and Model Theory, then, is to consider the philosophical uses of model theory. On a technical level, we try to show how philosophically significant results connect to one another, and also to state the best version of a result for philosophical purposes. On a philosophical level, we show how similar dialectical situations arise repeatedly, across fragmented debates in varied philosophical areas. -/- The second aim of Philosophy and Model Theory, though, is to consider the philosophy of model theory. Which systems/organisms are conscious? New tests for consciousness (‘C-tests’) are urgently needed. There is persisting uncertainty about when consciousness arises in human development, when it is lost due to neurological disorders and brain injury, and how it is distributed in nonhuman species. This need is amplified by recent and rapid developments in artificial intelligence (AI), neural organoids, and xenobot technology. Although a number of C-tests have been proposed in recent years, most are of limited use, and currently we have no (...) C-tests for many of the populations for which they are most critical. Here, we identify challenges facing any attempt to develop C-tests, propose a multidimensional classification of such tests, and identify strategies that might be used to validate them. (shrink)

Philosophical commentaries on the difficult task of forming a deep, respectful relationship with the land.

The Alaska National Interest Lands Conservation Act of 1980 requires federal agencies to provide a meaningful role for rural subsistence harvesters in management of fish and wildlife in Alaska. We constructed an interpretive analysis of qualitative interviews with residents of the Yukon-Kuskokwim Delta. Stakeholders' perceptions of their roles and motivations to participate in collaborative management are linked to unseen and often ignored cultural features and differing worldviews that influence outcomes of collaboration. Agencies need to better understand Yup'ik preferences for working (...) together and change their formats and methods of public engagement. More frequent and higher quality interactions among stakeholders in rural communities will create awareness of cultural differences. Improved awareness will allow managers to design and implement a process that is culturally appropriate and increase the meaningfulness of collaborative management. (shrink)

Several promising approaches have been developed to represent conscious experience in terms of mathematical spaces and structures. What is missing, however, is an explicit definition of what a ‘mathematical structure of conscious experience’ is. Here, we propose such a definition. This definition provides a link between the abstract formal entities of mathematics and the concreta of conscious experience; it complements recent approaches that study quality spaces, qualia spaces, or phenomenal spaces; and it provides a general method to identify and investigate (...) structures of conscious experience. A new theory of aesthetics and music, grounded in the collision between language and the body. In this book, Tim Hodgkinson proposes a theory of aesthetics and music grounded in the boundary between nature and culture within the human being. His analysis discards the conventional idea of the human being as an integrated whole in favor of a rich and complex field in which incompatible kinds of information—biological and cultural—collide. It is only when we acknowledge the clash of body and (...) language within human identity that we can understand how art brings forth the special form of subjectivity potentially present in aesthetic experiences. As a young musician, Hodgkinson realized that music was, in some mysterious way, “of itself”—not isolated from life, but not entirely continuous with it, either. Drawing on his experiences as a musician, composer, and anthropologist, Hodgkinson shows how when we listen to music a new subjectivity comes to life in ourselves. The normal mode of agency is suspended, and the subjectivity inscribed in the music comes toward us as a formative “other” to engage with. But this is not our reproduction of the composer's own subjectivation; when we perform our listening of the music, we are sharing the formative risks taken by its maker. To examine this in practice, Hodgkinson looks at the work of three composers who have each claimed to stimulate a new way of listening: Pierre Schaeffer, John Cage, and Helmut Lachenmann. (shrink)

My dissertation explores the nature of artifacts – things like chairs, tables, and pinball machines – and addresses the question of whether there is anything essential to being an artifact and a member of a particular artifact kind. My dissertation offers new arguments against both the anti-essentialist and current essentialist proposals. Roughly put, the view is that artifacts are successful products of an intention to make something with certain features constitutive of an artifact kind. The constitutive features are often functional (...) features, but may include structural, material, aesthetic, and other features. I further explore the ways in which artifacts are mind-dependent and I argue that this dependence is disjunctive. Not only do they depend on the intentions of their makers, but they also can depend on social groups or public norms and thus artifacts have an importantly social dimension and I argue that this disjunctive account applies not to artifact kinds but to individual artifacts depending on their context of creation.
