Agger, Ben, Critical Social Theories - An Introduction (reviewed by Thomas Murakami).

Heidegger’s two modes of thinking, calculative and meditative, were used as the thematic basis for this qualitative study of physicians from seven countries . Focus groups were conducted in each country with 69 physicians who cared for the elderly. Results suggest that physicians perceived ethical issues primarily through the lens of calculative thinking with emphasis on economic concerns. Meditative responses represented 24% of the statements and were mostly generated by Canadian physicians whose patients typically were not faced with economic barriers (...) to treatment due to Canada’s universal health care system. Plato's dialogue the Timaeus-Critias presents two connected accounts, that of the story of Atlantis and its defeat by ancient Athens and that of the creation of the cosmos by a divine craftsman. This book offers a unified reading of the dialogue. It tackles a wide range of interpretative and philosophical issues. Topics discussed include the function of the famous Atlantis story, the notion of cosmology as 'myth' and as 'likely', and the role of God in Platonic cosmology. Other areas commented (...) upon are Plato's concepts of 'necessity' and 'teleology', the nature of the 'receptacle', the relationship between the soul and the body, the use of perception in cosmology, and the work's peculiar monologue form. The unifying theme is teleology: Plato's attempt to show the cosmos to be organised for the good. A central lesson which emerges is that the Timaeus is closer to Aristotle's physics than previously thought. (shrink)

In this article we provide an in-depth description of a new model of informed consent called ‘meta consent’ and consider its practical implementation. We explore justifications for preferring meta consent over alternative models of consent as a solution to the problem of secondary use of health data for research. We finally argue that meta consent strikes an appropriate balance between enabling valuable research and protecting the individual.

This paper examines what it takes to be the intrinsic human goods of knowledge and achievement and argues that they are at many points parallel. Both are compounds, and of parallel elements: belief, justification, and truth in the one case, and intentional pursuit, competence, and success in the other. Each involves a Moorean organic unity, so its full presence or value requires a connection between its elements: an outside-in connection, where what makes a belief true helps explain why it’s justified, (...) for knowledge, and an inside-out connection, where what makes a pursuit competent helps explain its success, for achievement. The features that determine the degrees of value of instances of the two goods, or make some truths more worth knowing and some goals more worth achieving, are also similar, turning in both cases largely on two forms of generality. And more specific goods that follow from valuing generality, such as integrated understanding and complex, difficult achievement, mirror each other structurally. Taken together, these many parallels suggest that knowledge and achievement may both instantiate a more abstract value of rational connection to reality. With or without that deeper unification, the parallels strengthen the claims of both to be genuine goods. (shrink)

In his groundbreaking Grundlagen, Frege (1884) pointed out that number words like ‘four’ occur in ordinary language in two quite different ways and that this gives rise to a philosophical puzzle. On the one hand ‘four’ occurs as an adjective, which is to say that it occurs grammatically in sentences in a position that is commonly occupied by adjectives. Frege’s example was (1) Jupiter has four moons, where the occurrence of ‘four’ seems to be just like that of ‘green’ in (...) (2) Jupiter has green moons. On the other hand, ‘four’ occurs as a singular term, which is to say that it occurs in a position that is commonly occupied by paradigmatic cases of singular terms, like proper names: (3) The number of moons of Jupiter is four. Here ‘four’ seems to be just like ‘Wagner’ in (4) The composer of Tannhäuser is Wagner, and both of these statements seem to be identity statements, ones with which we claim that what two singular terms stand for is identical. But that number words can occur both as singular terms and as adjectives is puzzling. Usually adjectives cannot occur in a position occupied by a singular term, and the other way round, without resulting in ungrammaticality and nonsense. To give just one example, it would be ungrammatical to replace ‘four’ with ‘the number of moons of Jupiter’ in (1): (5) *Jupiter has the number of moons of Jupiter moons. This ungrammaticality results even though ‘four’ and ‘the number of moons of Jupiter’ are both apparently singular terms standing for the same object in (3). So, how can it be that number words can occur both as singular terms and as adjectives, while other adjectives cannot occur as singular terms, and other singular terms cannot occur as adjectives? This textbook introduces undergraduate students of language and linguistics to the basic ideas, insights, and techniques of contemporary semantic theory. The book starts with everyday observations about word meaning and use and then gradually zooms in on the question of how speakers manage to meaningfully communicate with phrases, sentences, and texts they have never come across before. Extensive English examples provide ample illustration.

The question of the political potential possessed by the philosophies of the Vienna Circle is complex for more than one reason. It is so partly due to the politically heterogeneous membership of the Circle, partly due to the difficult if not extreme political circumstances under which they had to operate, and partly due to the variable meanings of the parameter "political," some of which are and some of which are not compatible with, in turn, variable versions of the doctrine of (...) the value-neutrality of science. For instance, philosophies of science may steadfastly be standing guard against pseudo-scientific nonsense being paraded as worthy of credence in public discourse, this concern for intellectual hygene... Decision-makers face severe uncertainty when they are not in a position to assign precise probabilities to all of the relevant possible outcomes of their actions. Such situations are common—novel medical treatments and policies addressing climate change are two examples. Many decision-makers respond to such uncertainty in a cautious manner and are willing to incur a cost to avoid it. There are good reasons for taking such an uncertainty-averse attitude to be permissible. However, little work has been done to incorporate it (...) into an egalitarian theory of distributive justice. We aim to remedy this lack. We put forward a novel, uncertainty-averse egalitarian view. We analyse when the aims of reducing inequality and limiting the burdens of severe uncertainty are congruent and when they conflict, and highlight practical implications of the proposed view. We also demonstrate that if uncertainty aversion is permissible, then utilitarians must relinquish a favourite argument against egalitarianism. (shrink)

The fourteenth-century thinker Thomas Bradwardine is well known in both the history of science and the history of theology. The first of the Merton Calculators (mathematical physicists) and passionate defender of the Augustinian doctrine of salvation through grace alone, he was briefly archbishop of Canterbury before succumbing to the Black Death in 1349. This new edition of his Insolubilia, made from all thirteen known manuscripts, shows that he was also a logician of the first rank. The edition is accompanied (...) by a full English translation. In the treatise, Bradwardine considers and rejects the theories of his contemporaries about the logical puzzles known as 'insolubles,' and sets out his own solution at length and in detail. In a substantial introduction, Stephen Read describes Bradwardine's analysis, compares it with other more recent theories, and places it in its historical context. The text is accompanied by three appendices, the first of which is an extra chapter found in two manuscripts (and partly in a third) that appears to contain further thoughts by Bradwardine himself. The second contains an extract from Ralph Strode's Insolubilia, composed in the 1360s, repeating and enlarging on Bradwardine's text; and the third consists of an anonymous text that applies Bradwardine's solution to a succession of different insolubles"--P. ‘Hybrid’ theories of personal good, defended by e.g. Parfit, Wolf, and Kagan, equate it, not with a subjective state such as pleasure on its own, nor with an objective state such as knowledge on its own, but with a whole that supposedly combines the two. These theories apply Moore's principle of organic unities, which says the value of a whole needn't equal the sum of the values its parts would have by themselves. This allows them, defenders say, to combine the (...) attractions of purely subjective and purely objective views. This common understanding of the theories is, however, mistaken. At the most fundamental level they don't combine a subjective and an objective element but two objective ones. Once this is understood, their attraction as hybrid theories diminishes: the value in their wholes may be just the sum of the values in their parts. (shrink)

This paper offers a novel account of how complaints of unfairness arise in risky distributive cases. According to a recently proposed view in distributive ethics, the Competing Claims View, an individual has a claim to a benefit when her well-being is at stake, and the strength of this claim is determined by the expected gain to the individual’s well-being, along with how worse off the individual is compared to others. If an individual is at a lower level of well-being than (...) another, their claim to a given benefit is stronger. On this view, the strength of individuals’ claims are a function of their comparative well-being levels. In this paper, I instead argue that competing claims obtain only when a particular relationship obtains between the fates of individuals: that one individual’s gain is at the expense of another. This is a particular complaint that obtains when the fates of individuals are tied together in such a way that inequality that is to the detriment of the person who is worse off is guaranteed to obtain. I demonstrate that this complaint arises only when individuals are exposed to a particular type of risk that allows some to gain only if others lose. As such, I propose that complaints of unfairness occur less frequently than we might think if we take the Competing Claims View to be true. A purely comparative view is unable to account for this unique complaint of unfairness. I argue that this complaint is not only independently plausible, but can serve as a foundation for a more general account of competing claims complaints. (shrink)

Ernst Mach and Wilhelm Jerusalem may be considered exponents of a homegrown European version of pragmatism. The purpose of this paper is to highlight the strongly social orientation Jerusalem gave to his. Particular attention will be paid to some of his predecessors to exhibit the relevance of a pioneering but largely forgotten type of social science for the development of his version of European pragmatism. Broadly speaking, considerations from Völkerpsychologie played the role for the development of Jerusalem’s views that considerations (...) from the history of science played for the views of Mach. Of particular interest to us here is how these broadly sociological ideas fed into Jerusalem’s philosophy and his understanding and appreciation of pragmatism. (shrink)

We give a direct and elementary proof of the fact that every real-valued probability measure can be approximated—up to an infinitesimal—by a hyperreal-valued one which is regular and defined on the whole powerset of the sample space.

: Considerable unclarity exists in the literature concerning the origin and authorship of Wissenschaftliche Weltauffassung. Der Wiener Kreis, the Vienna Circle's manifesto of 1929 and on the extent of and the reasons for the mixed reception it received in the Circle itself. This paper reconsiders these matters on the light of so far insufficiently consulted documents.

There are at least two politically salient senses of “representation”—acting-for-others and portraying-something-as-something. The difference is not just semantic but also logical: relations of representative agency are dyadic (x represents y), while portrayals are triadic (x represents y as z). I exploit this insight to disambiguate constructivism and to improve our theoretical vocabulary for analyzing political representation. I amend Saward’s claims-based approach on three points, introducing the “characterization” to correctly identify the elements of representational claims; explaining the “referent” in pragmatic, not (...) metaphysical terms; and differentiating multiple forms of representational activity. This enables me to clarify how the represented can be both prior to representation and constituted by it, and to recover Pitkin’s idea that representatives ought to be “responsive” to the represented. These points are pertinent to debates about the role of representatives, the nature of representative democracy, and the dynamics of revolutionary movements. (shrink)

Through the criminal justice system so-called dangerous offenders are, besides the offence that they are being convicted of and sentenced to, also punished for acts that they have not done but that they are believe to be likely to commit in the future. The aim of this paper is to critically discuss whether some adherents of retributivism give a plausible rationale for punishing offenders more harshly if they, all else being equal, by means of predictions are believed to be more (...) dangerous than other offenders. While consequentialism has no problem, at least in principle, with this use of predictions most retributivists have been opponents of punishing offenders on the basis of predictions. How can an offender deserve to be punished for something that he has not done? But some retributivists like Anthony Duff and Stephen Morse have argued in favor of punishing offenders who are considered to be dangerous in the future more harshly than non-dangerous offenders. After having reconstructed their arguments in detail, it will be argued that both Duff’s and Morse’s attempts to give a retributivistic justification have several shortcomings. (shrink)

The relevant alternatives approach in epistemology1 arose some years ago partly out of the hope to be able to reconcile our ordinary claims of knowledge with our inability to answer the skeptic. It was supposed to give rise to an account of knowledge according to which our ordinary claims of knowledge are true, even though the claims about our lack of knowledge that the skeptics make in one of their more persuasive moments are also true. To know, according to such (...) an account, is to have evidence sufficient to rule out all the relevant alternatives. In ordinary life few alternatives are relevant. For example, whether or not we are brains in a vat is not a relevant alternative that we have to be able to rule out. In the debate with the skeptic it may become relevant, and accordingly we might not know something any more then, even though we have the same evidence as in ordinary life. The skeptics cleverly make more and more alternatives relevant, and that is how they succeed. But their success in the philosophy seminar is no threat to our ordinary claims of knowledge, or so the theory goes. (shrink)

What is freedom? In this study, Thomas Dumm challenges the conventions that have governed discussions and debates concerning modern freedom by bringing the work of Michel Foucault into dialogue with contemporary liberal thought. While Foucault has been widely understood to have characterized the modern era as being opposed to the realization of freedom, Dumm shows how this characterization conflates Foucault’s genealogy of discipline with his overall view of the practices of being free. Dumm demonstrates how Foucault’s critical genealogy does (...) not shrink from understanding the ways in which modern subjects are constrained and shaped by forces greater than themselves, but how it instead works through these constraints to provide, not simply a vision of liberation, but a joyous wisdom concerned with showing us, in his words, that we “are much freer than we feel.” Both as an introduction to Foucault and as an intervention in liberal theory, Michel Foucault and the Politics of Freedom is bound to change how we think about the limits and possibilities of freedom in late modernity. More than a century ago, John Dewey challenged the education community to look to civic involvement for the betterment of both community and campus. Today, the challenge remains. In his landmark book, editor Thomas Ehrlich has collected essays from national leaders who have focused on civic responsibility and higher education. Imparting both philosophy and working examples, Ehrlich provides the inspiration for innovative new programs in this essential area of learning.

In Civic Liberalism, prominent political theorist Thomas A. Spragens, Jr. asserts that most versions of democratic ideals—libertarianism, liberal egalitarianism, difference liberalism, and the liberalism of fear—lead our polity significantly astray. Spragens offers another alternative. He argues that we should recover the multiple and complex aspirations found within the tradition of democratic liberalism and integrate them into a more compelling public philosophy for our time—or what he calls civic liberalism.

Despite Kant's explicit statement that every murderer must suffer death, there are at least four situations to be found in Kant's work in which the killing of a human being should not lead to the death penalty: when too many murderers are involved; when a mother kills her illegitimate child; when one duellist kills the other; when one person pushes another off a plank in order to save his life. This paper discusses these situation and concentrates on the last situation (...) - Kant's interpretation of the plank of Carneades – with an eye to what they learn us about Kant understanding of the law. Does Kant acknowledge a legal vacuum? In order to come to a conclusion, Kant's 'solution' of the plank is compared with those suggested by other authors, such as Cicero, Pufendorf and Lon Fuller in his famous 'speluncean explorers' case. In the aftermath of the modern science world scientists are still searching for some kind of ontological and epistemological common ground. In this paper I try to show that we, by the aid of Michael Polanyi’s concepts of knowledge, of personal as well as objective knowledge, and his descriptions of the tacit dimensions in the process of knowing, can take some substantial steps toward a better understanding of the contemporary scientific conduct.

Macromarketing attempts to address issues that engage marketing and society and previous ethical scholarship has focused on distributive justice and on exchanges that occur in conventional markets. As our research highlights, however, the distributive justice approach alone is insufficient for managing the complexities, ethical paradoxes, and out-of-market conditions associated with wicked, cross-national social concerns. In this article, we integrate macromarketing with the theory of the common good in order to provide a foundation for framing societal change that can encompass nonmarket (...) value, stakeholder rights, collective social priorities, organizational responsibilities, and political action. Although many challenges remain, business ethics is flourishing in North America. Prominent organizations give annual business ethics awards, investments in socially screened mutual funds are increasing, ethics officers and corporate ombudspersons are more common and more influential, and new ideas are being tested in practice. On the academic side, two major journals specializing in business ethics are well-established and other major journals often include articles on business ethics and new organizations emphasizing ethics have been initiated. Within business schools, the number (...) of endowed chairs is growing and the ethics curriculum is expanding. Canada is a major player in the business ethics discipline while business ethics in Mexico is just beginning to emerge as a focus of interest in both the business and academic communities. (shrink)

Most arguments about conscientious objections in medicine fail to capture the full scope and complexity of the concept before drawing conclusions about their permissibility in practice. Arguments favoring and disfavoring the accommodation of conscientious objections in practice tend to focus too narrowly on prima facie morally contentious treatments and religious claims of conscience, while further failing to address the possibility of moral perspectives changing over time. In this paper, I argue that standard reasons against permitting conscientious objections in practice—that their (...) permission may result in harm to patients, the idea that medical providers willingly enter into the medical field, and that conscientious objections stand contrary to medical professionalism—do not apply in all cases and that the medical field and health systems in which many physicians now practice should continue to tolerate conscientious objections in practice. The SARS-CoV-2 pandemic constituted a crisis situation in which science was very far from Kitcher’s ideal of well-ordered science. I suggest that this could and should have been different. Kitcher’s ideal should play a role in assessing the allocation of research resources in future crisis situations, as it provides a way to balance highly divergent interests and incorporate the common good into decision-making processes on research.

In my commentary I will try to illustrate the fruitfulness of his approach by pointing to some connections with the phenomenology of the body as well as with recent memory and infant research.As Blankenburg himself indicates, the (...) notion of common sense developed by a shift of meaning from the classical sensus communis and thus has its original basis in the sensual-bodily experience. By the koinè aísthesis, Aristoteles meant a central sense organ integrating all single modalities of sensation (which he localized in the heart). In German physiology and psychiatry of the nineteenth century, the sensus communis was still translated as "Gemeingefühl" ("common feeling") or "cenesthesia" (Fuchs 1995). This term denoted the inner, proprioceptive bodily sensations, but also an original unity of the senses, which has been rediscovered by recent infant research as intermodal sensory perception. The affection of the body was thus regarded as the common basis of all sensation.Looking on this track for a bodily basis of the common sense, we find it in the habitual structure of the lived-body as analysed by Merleau-Ponty (1945). The body is the primary "matter-of-course," namely, the tacitly functioning medium of our everyday being-in-the-world prior to any subject-object split. The body schema, in Merleau-Ponty's view, is not only a system of familiar units of movement or "kinetic melodies," it also incorporates the surrounding things, tools, and spaces that are familiar to us and that we "inhabit." Thus, the musician "does not only manipulate the instrument like a separate object, but lives in it like a limb and inhabits the expressive musical space it opens" (Behnke 1997). But for Merleau-Ponty, the body schema is also the basis of "intercorporeity," i.e., a prepersonal sphere of reciprocal comportment and understanding prior to any explicit consensus and symbolic communication. In this sphere of elementary contact, the "atmospheric" senses play a major role: The sense of smell (as shown, e.g., by the expression "to scent treason" or in German, "jemand nicht riechen können" [not be able to "smell" or stand someone]) as well as the sense of taste whose ambiguous meaning, mentioned by Blankenburg, points to the bodily basis of the feeling for what is suitable, decent, or aesthetically pleasing. Even the designation of homo sapiens that we give to ourselves is derived from the latin sapere (to taste/to know), and thus shows that the knowledge characteristic for man is not an explicit one, but an intuitive, implicit knowing or "feel" for his surroundings, or as Kant says, an "aesthetic rather than intellectual judgment" (cited by Blankenburg).Polanyi (1967) has analysed this knowledge at the roots of common sense as "tacit knowledge." It is based on processes of Gestalt formation that enable us to grasp unified wholes through their constituting elements without still being aware of the latter. Thus, we understand the facial expression of others immediately but cannot tell from which details. Or we know how [End Page 323] to waltz without knowing the single movements or being able to explain it. Tacit knowledge implies all the taken-for-granted that we have forgotten once it has become our second nature and part of our bodily habits. It is mainly based on the neuronal coupling of single sensori-motor units by repeated perception or action. This unconscious knowing has only recently come to be explored by psychology under the heading of "implicit" or "procedural memory" (Schacter 1987, 1996). It contains familiar styles or "melodies" of moving, perceiving, and being-with-others in which our whole bodily and emotional experience is engaged. There is an atmospheric, "felt" quality about them that cannot be analysed into single elements. Implicit knowledge may, therefore, never be wholly expressed by words—it is only realized in the concrete situation. Cet article propose une étude conceptuelle d’une pratique scientifique. L’analyse phylogénétique, méthode phare en biologie de l’évolution, permet d’inférer les relations évolutives entre différentes espèces ou organismes. De nos jours, elle fait souvent intervenir l’usage de données moléculaires, dont les résultats sont appelés des phylogénies moléculaires. Comment caractériser cette pratique? Nous commençons par une présentation de la méthode, en la découpant en quatre étapes : l’identification puis l’alignement de séquences homologues ; la construction puis l’interprétation d’un arbre phylogénétique. Nous montrons (...) que l’analyse phylogénétique n’est pas une expérimentation, et donc n’appartient pas au « style de laboratoire », tel que défini par Hacking. Elle ne correspond pas non plus à une méthode typique des sciences historiques, telle que décrite par Cleland. Bien que la correspondance de l’analyse phylogénétique avec ces catégorisations ne soit que partielle, nous défendons l’utilité de chacune de ces confrontations pour souligner des aspects distincts de cette pratique. This article employs an intersectional analysis of ethical discourse guiding the US context in the era of Trump. Illustrating the viability of intersectionality for the broader utility of Christian social ethics, this essay explores the contemporary development of surreality and sub-rosa morality indicative of the current political situation in the United States in the wake of Donald Trump’s political ascendancy from the reality TV boardroom of The Apprentice to the Oval Office of the White House. Faced with the escalating nature (...) of lies and deception emanating from the Trump administration, this article provides the moral rationale for civil disobedience as well as suggesting prescriptions for a redemptive ethic intended to remedy the legitimation crises which have become the defining ethos of our time.
