Leading experts and rising stars in the field explore whether cosmopolitanism becomes impossible in the theoretical framework that assumed the absence of a final ground. The questions that the volume addresses refer exactly to the foundational predicament that characterizes cosmopolitanism: How is it possible to think cosmopolitanism after the critique of foundations? Can cosmopolitanism be conceived without an ‘ultimate’ ground? Can we construct theories of cosmopolitanism without some certainties about the entire world or about the cosmos? Should we continue to (...) look for foundations of cosmopolitan rights, norms and values? Alternatively, should we aim towards cosmopolitanism without foundations or towards cosmopolitanism with ‘contingent foundations’? New natural lawyers--notably Grisez, Finnis, and George--have written much on civil marriage's moral boundaries and grounds, but with slight influence. The peripheral place of the new natural law theory (NNLT) results from the marital grounds they suggest and the exclusionary moral conclusions they draw from them. However, I argue a more authentic and attractive NNLT account of marriage is recoverable through overlooked resources within the theory itself: friendship and moral self-constitution. This reconstructed account allows us to identify the relation between (...) marriage and human flourishing and the morality of same-sex marriage without making marriage infinitely plastic. (shrink)

A person skeptical about other minds supposes it is possible in principle that there are no minds other than his. A person skeptical about an external world thinks it is possible there is no world external to him. Some philosophers think a person can refute the skeptic and prove that his world is not the solitary scenario the skeptic supposes might be realized. In this paper I examine one argument that some people think refutes solipsism. The argument, from Wittgenstein, is (...) grounded in a thesis about language. Some people believe that in using language a person necessarily is linked to persons other than himself. Some people think a person can use the ‘communalist’ principle to refute forms of solipsism. I show that people do not refute solipsism with the Wittgensteinian, language-necessarily-is-shared principle. (shrink)

Two Conceptions of Wittgenstein's Contextualism How should we understand Wittgenstein's proposals that "the meaning of a word is its use in the language" and that a name only has a meaning in a language-game? Are they incompatible with occasion-invariant semantics? In this paper I present two leading interpretations of Wittgenstein's contextualism: James Conant's meaning-eliminativism and Charles Travis's meaning-underdetermination. I argue that, even though these two interpretations are very similar, the latter gives a more nuanced account of Wittgenstein's contextualism which does (...) not involve a commitment to the claim that words have no meaning outside immediate contexts of use. This book is about the mind and its connection to the brain. The first two chapters discuss the basic characteristics of the mind, and places it in historical context by noting trends in popular culture, and various people's ideas about the mind. This discussion ends by concluding that the most fruitful approach to studying the mind is a scientific approach that looks for connections between the mind and the brain. An important feature of this discussion is that it is supported by empirical research, by briefly describing experiments. The intent of the book is to give readers a feel for the latest scientific thinking about the mind, by focusing on basic principles that hold across many different functions of the mind. Despite their centrality and importance to both science and philosophy, relatively little has been written about thought experiments. This volume brings together a series of extremely interesting studies of the history, mechanics, and applications of this important intellectual resource. A distinguished list of philosophers and scientists consider the role of thought experiments in their various disciplines, and argue that an examination of thought experimentation goes to the heart of both science and philosophy.

This article starts by noting the general lack of acknowledgment of alternative traditions in the dominant western sustainability discourse in education. After critically analyzing the western human–nature relationship in the context of Enlightenment, modernity and colonial expansion, this article introduces two non-western ecological discourses from Eurasia and Asia, Noöspherism and Neo-Confucianism, which offer clear contrasts to the western sustainability framework. Using theoretical argumentations, the article goes on to examine the cosmological and ontological categories expounded by Vladimir Vernadsky of Russia and (...) Yulgok Yi of Korea, whose philosophical foundations with unique foci on the anthropocosmic and cosmoanthropic types of human–nature relationships could well be alternatives and/or additions to the dominant western discourse. The article concludes with a twofold comparison: between Eurasian and Confucian heritages, and these two with the mainstream western ecological discourse. (shrink)

To what extent can philosophical thought experiments reveal norms? Some ethicists have argued that certain thought experiments reveal that people draw a morally significant distinction between "doing" and "allowing". I examine one such thought experiment in detail and argue that the intuitions it elicits can be explained by "prospect theory", a psychological theory about the way people reason. The extent to which such alternative explanations of the results of thought experiments in philosophy are generally available is an empirical question.

Attitudes toward sow husbandry differ between citizens and conventional pig farmers. Research showed that moral values could only predict the judgment of people in case of culling healthy animals in the course of a disease epidemic to a certain extent. Therefore, we hypothesized that attitudes of citizens and pig farmers cannot be predicted one-on-one by moral values. Furthermore, we were interested in getting insight in whether moral values can be useful in bridging the gap between attitudes toward sow husbandry of (...) citizens and pig farmers. Based on a questionnaire, it was found that pig farmers and citizens, when considered as one group, shared the valuation of most moral values. However, when studying the four clusters of citizens with different attitudes toward sow husbandry, determined in a previous study, a variation in valuation of the moral values between the clusters of citizens and farmers came to the fore. This means that moral values are interpreted differently by groups of people when forming attitudes toward sow husbandry. The results of our study give an indication of which moral values are weighed differently between clusters of citizens and pig farmers. This information can be useful in future research on attitudes toward animal husbandry in order to understand why attitudes differ between groups of people. Besides, our results can be useful for the pig sector and citizens to learn to understand each other’s attitudes. With this understanding it is possible to invest in a husbandry system that can build on societal support. (shrink)

À l’époque où la photographie n’existait pas encore, les reproductions d’oeuvres d’art et de peintures célèbres dominaient le marché de l’art. Au dix-huitième siècle, la comparaison entre les graveurs et les traducteurs était fort commune. Si, à l’époque, on accordait une grande importance à la fidélité des traductions aux textes originaux, de telles comparaisons amenaient à conclure à une sorte de submissivité purement technique des graveurs par rapport au talent génial des peintres. En examinant de près les copies réalisées, on (...) remarque toutefois que la fidélité à l’original n’était pas nécessairement la préoccupation première de ces traducteurs visuels. Ces derniers seraient plutôt des médiateurs. Cet article réexamine les actes de traduction visuelle du dix-huitième siècle afin de recadrer la pratique de la gravure pendant cette période et de permettre de mieux comprendre le mouvement qui irait d’un langage visuel artistique à un autre. Une étude de cas, celle de Nicolas de Launay, qui est sans doute l’un des plus grands graveurs du dix-huitième siècle, nous permettra de contextualiser cette pratique au coeur des débats historiques autour de la traduction. Notre objectif principal sera, finalement, de mettre en lumière les tensions qui existent entre les différentes disciplines associées à la peinture et à la gravure, ainsi que les processus complexes par le biais desquels les graveurs ont réussi à rester fidèles à la fois aux peintres, à leur public et à leur propre identité artistique. Asylum legal aid lawyers are under continuous public scrutiny. On the one hand, these lawyers are portrayed as being solely motivated by profit. On the other hand, they are depicted as leftist activists frustrating the legal system. When assisting their asylum seeking clients under the state's legal aid scheme, lawyers need to balance the client's interest, the public interest in the administration of justice and their own interest in profit or survival. The current book examines this balancing act and explores (...) the role of the institutional context. It does so by studying the decision making of asylum legal aid lawyers in the Netherlands and England in respect of two ethical issues: 'time vs. money' and 'hopeless cases'. What reason does one have to resist oppression? The reasons that most easily come to mind are those having to do with justice—reasons that arise from commitments to human equality and the common good. In this paper, I argue that there are also reasons of love—reasons that arise from personal attachments to specific people, projects, or activities. I defend a distinctive form of resistance that is characteristically undertaken for reasons of love, which I call Quiet Resistance. Contrary to theories that (...) build reasons of justice into the definition of resistance, I argue that we have strong reason to consider Quiet Resistance a genuine form of resistance. Finally, I argue that the reasons in favor of engaging in Quiet Resistance help to explain its distinctive value. In short, when one engages in Quiet Resistance, one’s actions are valuable in large part because they allow one to maintain respect for one’s personal values and meaning in life under oppressive conditions. The Great Divide in metaphysical debates about laws of nature is between Humeans, who think that laws merely describe the distribution of matter, and non-Humeans, who think that laws govern it. The metaphysics can place demands on the proper formulations of physical theories. It is sometimes assumed that the governing view requires a fundamental / intrinsic direction of time: to govern, laws must be dynamical, producing later states of the world from earlier ones, in accord with the fundamental direction of (...) time in the universe. In this paper, we propose a minimal primitivism about laws of nature (MinP) according to which there is no such requirement. On our view, laws govern by constraining the physical possibilities. Our view captures the essence of the governing view without taking on extraneous commitments about the direction of time or dynamic production. Moreover, as a version of primitivism, our view requires no reduction / analysis of laws in terms of universals, powers, or dispositions. Our view accommodates several potential candidates for fundamental laws, including the principle of least action, the Past Hypothesis, the Einstein equation of general relativity, and even controversial examples found in the Wheeler-Feynman theory of electrodynamics and retrocausal theories of quantum mechanics. By understanding governing as constraining, non-Humeans who accept MinP have the same freedom to contemplate a wide variety of candidate fundamental laws as Humeans do. (shrink)

This article focuses on the follow question: Are human enhancement technologies likely to be justice impairing or justice promoting? We argue that human enhancement technologies may not be inherently just or unjust, but when situated within obtaining social contexts they are likely to exacerbate rather than alleviate social injustices.

One of the achievements of Hans Blumenberg’s historical anthropology is to have reflected on the way individuals can preserve themselves when they come up against points of significance (Bedeutsamkeiten). Goethe’s encounter with Napoleon, in which the poet succeeded in standing up to the emperor at eye level, was of such self-preserving significance. For Blumenberg himself, his sole encounter with Thomas Mann was of comparable significance, since the Nobel prize-winner asserted himself in the face of the ascendant Nazis as the representative (...) of Goethe and the defender of a humane world. Blumenberg likewise sought contact with Carl Schmitt in order to claim his own interpretative sovereignty over Goethe and thereby — following the model of Goethe and Thomas Mann — assert himself against a representative of the Third Reich. Primate research suggests that affiliation is a highly complex construct. Studies of primate affiliation demonstrate the need to distinguish between various affiliative behaviors, consider relationships as emergent properties of these behaviors, define affiliation in the context of general environmental responsiveness, and address developmental changes in affiliation across the lifespan.

In criminal trials, evidence often involves a degree of uncertainty and decision-making includes moving from the initial presumption of innocence to inference about guilt based on that evidence. The jurors’ ability to combine evidence and make accurate intuitive probabilistic judgments underpins this process. Previous research has shown that errors in probabilistic reasoning can be explained by a misalignment of the evidence presented with the intuitive causal models that people construct. This has been explored in abstract and context-free situations. However, less (...) is known about how people interpret evidence in context-rich situations such as legal cases. The present study examined participants’ intuitive probabilistic reasoning in legal contexts and assessed how people’s causal models underlie the process of belief updating in the light of new evidence. The study assessed whether participants update beliefs in line with Bayesian norms and if errors in belief updating can be explained by the causal structures underpinning the evidence integration process. The study was based on a recent case in England where a couple was accused of intentionally harming their baby but was eventually exonerated because the child’s symptoms were found to be caused by a rare blood disorder. Participants were presented with a range of evidence, one piece at a time, including physical evidence and reports from experts. Participants made probability judgments about the abuse and disorder as causes of the child’s symptoms. Subjective probability judgments were compared against Bayesian norms. The causal models constructed by participants were also elicited. Results showed that overall participants revised their beliefs appropriately in the right direction based on evidence. However, this revision was done without exact Bayesian computation and errors were observed in estimating the weight of evidence. Errors in probabilistic judgments were partly accounted for, by differences in the causal models representing the evidence. Our findings suggest that understanding causal models that guide people’s judgments may help shed light on errors made in evidence integration and potentially identify ways to address accuracy in judgment.
