The aim of this study was to analyse experiences of moral concerns in intensive care nursing. The theoretical perspective of the study is based on relational ethics, also referred to as ethics of care. The participants were 36 intensive care nurses from 10 general, neonatal and thoracic intensive care units. The structural characteristics of the units were similar: a high working pace, advanced technology, budget restrictions, recent reorganization, and shortage of experienced nurses. The data consisted of the participants’ examples of (...) ethical situations they had experienced in their intensive care unit. A qualitative content analysis identified five themes: believing in a good death; knowing the course of events; feelings of distress; reasoning about physicians’ ‘doings’ and tensions in expressing moral awareness. A main theme was formulated as caring about - caring for: moral obligations and work responsibilities. Moral obligations and work responsibilities are assumed to be complementary dimensions in nursing, yet they were found not to be in balance for intensive care nurses. In conclusion there is a need to support nurses in difficult intensive care situations, for example, by mentoring, as a step towards developing moral action knowledge in the context of intensive care nursing. Emotion processing is known to be impaired in psychopathy, but less is known about the cognitive mechanisms that drive this. Our study examined experiencing and suppression of emotion processing in psychopathy. Participants, violent offenders with varying levels of psychopathy, viewed positive and negative images under conditions of passive viewing, experiencing and suppressing. Higher scoring psychopathics were more cardiovascularly responsive when processing negative information than positive, possibly reflecting an anomalously rewarding aspect of processing normally unpleasant material. When required to experience emotional (...) response, by ‘getting into the feeling’ of the emotion conveyed by a negative image, higher factor 1 psychopathic individuals showed reduced responsiveness, suggesting that they were less able to do this. These data, together with the absence of corresponding differences in subjective self-report might be used to inform clinical strategies for normalising emotion processing in psychopathic offenders to improve treatment outcome, and reduce risk amongst this client group. Aristotle and Natural Law lays out a new theoretical approach which distinguishes between the notions of 'interpretation,' 'appropriation,' 'negotiation' and 'reconstruction' of the meaning of texts and their component concepts. These categories are then deployed in an examination of the role which the concept of natural law is used by Aristotle in a number of key texts. The book argues that Aristotle appropriated the concept of natural law, first formulated by the defenders of naturalism in the 'nature versus convention debate' (...) in classical Athens. Thereby he contributed to the emergence and historical evolution of the meaning of one of the most important concept in the lexicon of Western political thought. Aristotle and Natural Law argues that Aristotle's ethics is best seen as a certain type of natural law theory which does not allow for the possibility that individuals might appeal to natural law in order to criticize existing laws and institutions. It is commonplace to speak of social groups as if they were capable of the same sorts of activities as individuals. We say, “Germany won the World Cup”; “The United States invaded Iraq”; and “The world mourned the passing of Nelson Mandela”. In so doing, we attribute agency, belief, and emotional states to groups themselves. In recent years, much literature devoted to analyzing such statements and their implications has emerged. Within this literature, the issue of “intentionalism,” whether individuals must have (...) a certain self-conception in order to constitute a collectivity, has received surprisingly little attention. While Paul Sheehy has criticized this view, claiming that individuals may be related in such a way as to constitute a collective without their realizing it :377–394, 2002), little other scholarship on the topic exists. The purpose of this article is to contribute to this debate. I will argue, drawing on Edith Stein’s phenomenology of social groups, that intentionalism, as Margaret Gilbert defines it, is false. I begin by establishing Gilbert’s account, Sheehy’s criticism of intentionalism, and what I take to be its shortcomings. I then explicate Stein’s phenomenology of collectives and argue that plural subjects who do not meet intentionalist requirements can exist. Given this, intentionalism must be rejected. Because the intentionalism debate presupposes that there are irreducibly social agents, I do not argue for this claim. (shrink)

Next SectionMaking threats and offers to patients is a strategy used in community mental healthcare to increase treatment adherence. In this paper, an ethical analysis of these types of proposal is presented. It is argued (1) that the primary ethical consideration is to identify the professional duties of care held by those working in community mental health because the nature of these duties will enable a threat to be differentiated from an offer, (2) that threatening to act in a way (...) that would equate with a failure to uphold the requirements of these duties is wrong, irrespective of the benefit accrued through treatment adherence and (3) that making offers to patients raises a number of secondary ethical considerations that need to be judged on their own merit in the context of individual patient care. The paper concludes by considering the implications of these arguments, setting out a pathway designed to assist community mental healthcare practitioners to determine whether making a specific proposal to a patient is right or wrong. The paper presents an interpretation of Aristotle's views on natural justice in the Nicomachean Ethics. It focuses, in particular, on Aristotle's understanding of the relationship which exists between natural justice and political justice, or between natural law and positive law. It is suggested that Aristotle's views on this subject are often misunderstood. It is also suggested that, contrary to what some commentators might think, Aristotle's comments on natural justice are actually central for our understanding of his political thought as a (...) whole. It is argued that Aristotle is, therefore, definitely a natural law theorist of some description. However, Aristotle's natural law theory is unconventional in certain respects. In particular, Aristotle does not consider natural law to be a critical standard by means of which positive law might be evaluated. This places Aristotle outside the mainstream of natural law theory as it has been traditionally understood. Aristotle is not, in this sense at least, the forerunner of the Stoic natural law tradition and of the individualistic, liberal natural law theory of the modern era. He is, rather, the founding father of what might best be described as the conservative natural law tradition, the most well known adherents of which in modern times are Montesquieu, Burke and Hegel. This paper outlines, from a sociological and social psychological perspective, a theoretical framework with which to define and analyse consciousness, emphasizing the importance of language, collective representations, conceptions of self, and self-reflectivity in understanding human consciousness. It argues that the shape and feel of consciousness is heavily social, and this is no less true of our experience of collective consciousness than it is of our experience of individual consciousness. The paper is divided into two parts. Part One argues that the (...) problem of consciousness can be approached fruitfully by beginning with human group and collective phenomena: community, language, language-based communication, institutional and cultural arrangements, collective representations, self-conceptions, and self-referentiality. A collective is understood as a group or population of individuals that possesses or develops collective representations of itself: its values and goals, its structure and modes of operating, its strategies, developments, strengths and weaknesses, etc. Collective reflectivity emerges as a function of an organization or group producing and making use of collective representations of the self in its discussions, critical reflections, and planning. A collective monitors its activities, achievements and failures, and reflects on itself as a defined and on-going collective being. In this perspective, human consciousness is understood as a type of reflective activity: observing, monitoring, judging and re-orienting and re-organizing self; considering what characterizes the self, what self perceives, judges, could do, should do . The reflectivity is encoded in language and developed in conversations about collective selves. Part Two of the paper applies the framework to analysing the individual experience of consciousness, self-representation, self-reference, self-reflectivity and self-development. (shrink)

Community treatment orders are a legal mechanism to extend powers of compulsion into outpatient mental health settings in certain circumstances. Previous ethical analyses of these powers have explored a perceived tension between a duty to respect personal freedoms and autonomy and a duty to ensure that patients with the most complex needs are able to receive beneficial care and support that maximises their welfare in the longer-term. This empirical ethics paper presents an analysis of 75 interviews with psychiatrists, patients and (...) family carers to show how these ethical considerations map onto the different ways that community treatment orders are used and experienced in practice. A complex and nuanced account of how the requirements to respect patients’ autonomy, to respect patients’ liberty and to act beneficently should be interpreted in order to make judgements about the ethics of community treatment orders is presented. The article argues that, due to such complexity, no general ethical justification for community treatment orders can be provided, but a justification on the basis of the promotion of patients’ autonomy could provide an ethical reason for community mental health practitioners to make use of a community treatment order in some limited circumstances. In recent years, some simulation theorists have claimed that the discovery of mirror neurons provides empirical support for the position that mind reading is, at some basic level, simulation. The purpose of this essay is to question that claim. I begin by providing brief context for the current mind reading debate and then developing an influential simulationist account of mind reading. I then draw on the works of Edmund Husserl and Edith Stein to develop an alternative, phenomenological account. In conclusion, (...) I look to determine whether his solution, which is based on the conjugate forms of faith, hope, and charity, and culminates in a heuristic where forgiveness plays an essential role in moving beyond the problem of evil is adequate. I examine the distinction between basic sin, moral evil, and physical evil as well as his claim that from the viewpoint of the unrestricted act of understanding the non-systematic vanishes.

In this article, I explicate Husserl’s phenomenology of the person as found in Ideen II by examining the most important aspects of persons in this work. In the first section, I explicate the concept of the surrounding world (Umwelt) with special attention to the difference between the different attitudes (Einstellungen) that help determine the sense of constituted objects of experience. In the second section, I investigate Husserl’s description of the person as a founded, higher order, spiritual (geistig) objectivity. I consider (...) this description of the person by examining the symmetry between the organization of Ideen II as a whole and the order of the constitution of the person. Joseph Dietzgen (1828-1888) had an important role in the history of Marxism. One reason for this is that he coined the phrase "dialectical materialism" — the hallmark of "orthodox" Marxism. Another reason is that at the beginning of the 20th century, in the absence of Marx's early writings, humanist critics of "orthodox" Marxism like Anton Pannekoek appealed to Dietzgen. An understanding of Dietzgen's thought sheds new light on our understanding of "dialectical materialism" and on the debate between "orthodox" and "Hegelian" (...) Marxists. (shrink)

This article argues that parliamentary institutions have increasing difficulty in addressing and dealing with the growing complexity, highly technical character and rapidity of many developments in modern societies. Deficits in representation, in knowledge and competence, and in engagement or commitment effectively erode the authority and status of parliamentary government. Major rule- and policy-making activities are being substantially displaced from parliamentary bodies and central governments to global, regional and local agents as well as agents operating in the many sectors of a (...) highly differentiated, modern society. Governance - and sovereignty - are increasingly diffused upward, downward and outward beyond parliament and its government. Although first published in 1969, the methodological views advanced in Quentin Skinner's “Meaning and Understanding in the History of Ideas” remain relevant today. In his article Skinner suggests that it would be inappropriate to even attempt to write the history of any idea or concept. In support of this view, Skinner advances two arguments, one derived from the philosophy of the later Wittgenstein and the other from that of J. L. Austin. In this paper I focus on the first of (...) these arguments. I claim that the conclusion which Skinner draws from this particular argument does not necessarily follow and that an alternative assessment of the methodological significance of Wittgenstein's philosophy for historians of ideas is possible. On this alternative view, far from ruling out conceptual history, an appeal to the view of meaning set out in Wittgenstein's Philosophical Investigations leads to a quite different conclusion, namely that the writing of such a history is arguably a necessary precondition for the elucidation of the meaning of a number of the core concepts in the canon of the history of political thought. Skinner's views have changed somewhat since 1969. Indeed, from the mid 1970s onwards he came to relax the strict opposition to the idea of conceptual history to which he was then committed. The paper concludes by noting that this evolution in Skinner's thinking has made him much more sympathetic than anybody reading “Meaning and Understanding in the History of Ideas” would have imagined to the research project of the Begriffgeschichte School of conceptual history. External cues and internal configuration states are the likely instigators of involuntary autobiographical memories (IAMs) and déjà vu experience. Indeed, Barzykowski and Moulin discuss relevant neuroscientific evidence in this direction. A complementary line of enquiry and evidence is the study of inhibition and its role in memory retrieval, and particularly how its (dys)function may contribute to IAMs and déjà vu.

This article illustrates the important scientific role that a systems approach might play within the social sciences and humanities, above all through its contribution to a common language, shared conceptualizations, and theoretical integration in the face of the extreme (and growing) fragmentation among the social sciences (and between the social sciences and the natural sciences). The article outlines a systems theoretic approach, actor-system-dynamics (ASD), whose authors have strived to re-establish systems theorizing in the social sciences (after a period of marginalization (...) since the late 1960s). This article introduces the first English translation of one of Tanabe’s early essays on metaphysics. It questions the relation of the universal to the particular in context of logic, phenomenology, Neo-Kantian epistemology, and classical metaphysics. Tanabe provides his reflections on the nature of the concept of universality and its constitutive relation to phenomenal particulars through critical analyses of the issue as it is discussed across various schools of philosophy including: British Empiricism, the Marburg School, the Austrian School, the Kyoto School, (...) and Platonism. In this essay, Tanabe reveals his ability to think metaphysically the ground for the possibility of reasoning and dares to voice his own thought beyond references to the most prominent thinkers of his time from distinct intellectual traditions in both the east and the west. This essay, therefore, demonstrates that his strong tendency to move beyond the received epistemology and phenomenology of the European intellectual tradition to metaphysics was already present in the early days of his academic life and thereby marks a more general contribution of the Kyoto School of Philosophy to distinct European schools of thought in the early twentieth century. This article presents a relatively straightforward theoretical framework about distributive justice with applications. It draws on a few key concepts of Sociological Game Theory. SGT is presented briefly in section 2. Section 3 provides a spectrum of distributive cases concerning principles of equality, differentiation among recipients according to performance or contribution, status or authority, or need. Two general types of social organization of distributive judgment are distinguished and judgment procedures or algorithms are modeled in each type of social organization. Section (...) 4 discusses briefly the larger moral landscapes of human judgment – how distribution may typically be combined with other value into consideration. The article suggests that Rawls, Elster, and Machado point in this direction. Finally, it is suggested that the SGT framework presented provides a useful point of departure to systematically link it and compare the Warsaw School of Fair Division, Rawls, and Elster, among others.
