One of the fundamental components of the concept of economic rationality is that preference orderings are “complete,” i.e., that all alternative actions an economic agent can take are comparable. The idea that all actions can be ranked may be called the single utility assumption. The attractiveness of this assumption is considerable. It would be hard to fathom what choice among alternatives means if the available alternatives cannot be ranked by the chooser in some way. In addition, the efficiency criterion makes (...) sense only if one can infer that an individual's choice reflects the best, in expected welfare terms, among all choices that individual could have made. The possibility that a rearrangement of resources could make someone “better off” without making others “worse off” can be understood only if the post-rearrangement world is comparable with the pre-rearrange-ment world. ABSTRACT This essay seeks to clarify a facet of Montesquieu’s doux-commerce thesis. On the one hand, I agree with the scholarly consensus that Montesquieu was a doux-commerce thinker. Indeed, I argue that from the Persian Letters to The Spirit of the Laws he consistently presented self-interest as a psychological spring of action superior in point of humanity to virtue. On the other hand, I contend that he went out of his way to show that commercial regimes need not be characterized (...) by ‘softness’, even if they are marked by ‘gentleness’. Not only are these qualities conceptually distinct, but there is no reason why they must go together in practice. Keeping in mind the distinction between douceur and mollesse helps to establish that Montesquieu made not only a doux-commerce argument but also a dur-commerce argument. In other words, he maintained that commerce went hand-in-hand with hardiness and vigour, as well as gentleness. (shrink)

We argue that it is not the familiar argument from epistemic relativism, but a formal condition on the structure of justifications: the principle that epistemic grounding relations cannot be reflexive. Traditionally, medical ethics has focused on the isolated relationship of physician to patient in a setting that has left the physician virtually untouched by market constraints or government regulation. Arguing that changes in health care institutions and legal attention to patient rights have made conventional approaches obsolete, Troyen Brennan points the way to (...) a new, more aware and engaged medical ethics. The medical profession is no longer isolated, even theoretically, from the liberal, market-dominated state. Old ideas of physician beneficence and altruism must make way for a justice-based medical ethics, assuming a relationship between equals more compatible with liberal political philosophy. Brennan offers clinical examples of many of today's most challenging medical problems—from informed consent to care rationing and the repercussions of the HIV epidemic—and gives his recommendation for a new ethical perspective. A critical revaluation of the humanist tradition, _Borrowed Light_ makes the case that the 20th century is the "anticolonial century." The sparks of concerted resistance to colonial oppression were ignited in the gathering of intellectual malcontents from all over the world in interwar Europe. Many of this era's principal figures were formed by the experience of revolution on Europe's semi-developed Eastern periphery, making their ideas especially pertinent to current ideas about autonomy and sovereignty. Moreover, the debates most prominent then—human vs. (...) inhuman, religions of the book vs. oral cultures, the authoritarian state vs. the representative state and, above all, scientific rationality vs. humanist reason—remain central today. Timothy Brennan returns to the scientific Enlightenment of the 17th century and its legacies. Several of these studies have also shown that the actual use of advance directives is significantly lower than this enthusiasm would suggest, but they have not explained the apparent discordance. Nor have researchers explained why members of minority groups are much less likely to complete advance directives than are white patients. In this study, we used a focus group methodology to examine (...) the ways in which diverse populations of patients view the medical, philosophical, and practical issues surrounding advance directives. We were motivated by the significantly lower prevalence of advance directives among African-American and Hispanic patients at one urban teaching hospital . Our premise was that African-American and Hispanic populations, who have had higher rates of morbidity and mortality across numerous disease categories, and historically have had limited access to care and opportunities to discuss health concerns, may be more suspicious about the right of autonomy that an advance directive is designed to ensure. In the January 6, 1991, issue of the Washington Post Magazine, reporter Walt Harrington wrote a profile of Bryan Stevenson. Mr. Stevenson is a 31-year-old working-class African-American from Delaware who graduated from Harvard Law School and the Kennedy School of Government. Like the typical graduate of Harvard Law School, Mr. Stevenson had the opportunity to join the worlds of six-figure corporate law or high-visibility politics. Rather than follow his colleagues, however, Mr. Stevenson works seven-day, eighty-hour weeks as director of the (...) Alabama Capital Representation Center. He appeals death sentences, handling twenty-four death-row cases himself, supervises five other lawyers who cover about thirty cases, and raises federal government and foundation funding. He does this living a Spartan existence on a salary of $24,000, refusing even the $50,000 directorship salary offered to him. (shrink)
