Although the main responsibility for informed consent of medical procedures rests with doctors, nurses’ roles are also important, especially as patient advocates. Nurses’ preparation for this role in settings with a hierarchical and communal culture has received little attention. We explored the views of hospital managers and nurses regarding the roles of nurses in informed consent and factors influencing these roles. We conducted a qualitative study in a private, multispecialty hospital in Indonesia. Semi-structured interviews were conducted with seven managers. Two (...) rounds of focus group discussions with nurses (n = 27) were conducted. Constant comparative approach was used in the analysis. Nurses can act as manager, witness, information giver, and advocate in the informed consent process. These roles are influenced by nurses’ preparedness, hospital culture and policy, patients’ understanding, family involvement, and cost-related issues. In preparation for these tasks, nurses should acquire communication skills, clinical knowledge, and legal and ethical knowledge. (shrink)

The tradition of Western philosophy has been tracing out the significations of logos and centered around logos. This in fact has given birth to many significant results. Through its logical structuring of empirical reality it has made possible critical understanding transcending the past and progressive creation of the future. But this Logology or Logocentrism has eventually also led to its self-destruction and to the brink of absolute nihilism.Along the history, logos has been interpreted in various ways. The history implies that (...) at least in the cosmic, theological and ideological frameworks logos used to be seen as extralinguistic substance; whereas starting from the scientific mode of thinking logos has been seen more as intralinguistic substance . This ends up in the political perspective in which logos is without substance: mere effects of the play of texts and discourse.While the latter appears like a predicament, the fact is that it can also be taken as a moment of liberation, a liberation from the keen yet stifling Western paradigm of logos apophanticos which has animated all kinds of “positivistic” mode of thinking; a liberation from the so-called Metaphysics of Presence, hence an openness towards the Absence, the ambiguity, the indefinability or the elusiveness of reality ; an openness towards the richness and complexity of human experience; hence an openness for mutual interogative and transformative dialogues among different semiotic systems, traditions and language games, which would also empower and incorporate non-Western as well as non-scientific mode of thinking into global discourse.Perhaps wisdom lies in the courage to recognize the fact that ultimately reality or the so-called Being is not a substance, but rather, fleeting relations, ever-changing networks, or elusive flux. Wisdom ultimately might mean an ability to come to terms with insecurity, an ability to see through the “absence”. (shrink)

Visual arts have undergone significant changes in their character, identities, structures, And perceptions of what it means to be an artist. Arts have been ‘dematerialized’, so to say. This, in turn, creates a dilemma’: on the one hand, art turns into philosophy or mere strategy of representation; on the other, art becomes anything, with its pluralistic, pragmatic and multicultural characters. Corollary to this is that now art can hardly be judged, and hence, art criticismdisappears. Today art bears the character of (...) pop-products : traumatic, nostalgic, transgressive, and nomadic. In such a cultural plight, however, art is not without significance. While the exclusive ‘world of Art’ seems to dissolve, its significant relation with broader life is resolved. (shrink)

Amidst the lingering prominence of idealist and rationalist traditions in the philosophy of education, the notion of living, sentient body (or soma) seems to have received scant attention by educational philosophers hitherto. These traditions—whose strong influence can be traced back to such philosophers as Plato, Descartes, Leibniz and Wolff—elevate and privilege the import of reasoning and mind over the body, rendering the latter ancillary and even distorting to the pursuit of knowledge and truth. Drawing on the idea of somaestehtic philosophy (...) initially proposed by Richard Shusterman, this article first discusses this philosophical outlook and then expands it by foregrounding the notion of the libidinal body—that is, the potentiality of the performative dimension of the soma in constructing and reconstructing knowledge. It argues that the soma itself is, in fact, the site of desire for knowledge production and reproduction. To buttress this argument, the article provides evidence from Borneo's Dayaknese communities as one of the instances of the somatic society where the practices of the libidinal body for the community's education are most conspicuous. The article ends with some thoughts on the possible research directions the philosophy of education ought to take to push the field forward in its pursuit for virtue and the good life. (shrink)

This paper has two aims. The first is to present and defend a new argument for rights contributionism – the view that the notion of a moral claim-right is a contributory (or pro tanto) rather than overall normative notion. The argument is an inference to the best explanation: it is argued that (i) there are contributory moral factors that contrast with standard moral reasons by way of having a number of formal properties that are characteristic of rights, even though (...) they can be overridden, and (ii) that this is best explained by a view that takes these factors to correlate with rights. The second aim is to show that the truth of rights contributionism matters for normative ethics. More specifically, it is argued that rights contributionism clears the way for deontologists to justify the pre-theoretically plausible verdict that we have a duty to save the greater number in so-called Taurek scenarios – scenarios in which we have to choose between saving either a greater or a smaller number of different people. The chapter offers a novel and distinctively deontological explanation of this verdict that is based on the assumption that everyone has a pro tanto right to be saved in a Taurek scenario. (shrink)

Judith Jarvis Thomson and others contend that rights are pro-tanto rather than absolute, that is, that rights may permissibly be infringed in some circumstances. Alan Gewirth maintains that there are some rights that are absolute because infringing them would amount to unspeakable evil. However, there seem to be possible circumstances in which it would be permissible to infringe even those rights. Specificationists, such as Gerald Gaus, Russ Shafer-Landau, Hillel Steiner and Kit Wellman, argue that all rights are absolute because (...) they have implicit exceptions, the exceptions being either right-voiding or right-compatible. Specificationists have charged pro-tantoism with preventing rights from being action-guiding, and pro-tantoists have levelled the same charge against specificationism. I show that both charges are mistaken. Pro-tantoists claim that specificationists cannot account for the moral remainder that we recognise in some circumstances and which can be explained by reference to a permissible right-infringement. Specificationists retort that the moral remainder can be explained by invoking compensation-rights. I show that the pro-tantoist claim is true and that the specificationist retort is false on two counts: explanation in terms of compensation-rights is not applicable to all cases; and it fails to account for the moral dynamic in the cases to which it is applicable. The contention that rights are pro-tanto does not conflict with the substance of the contention that rights are trumps, despite claims of specificationists to the contrary. (shrink)

One early step of the book’s main argument is to claim that whistleblowing is pro tanto wrong. This claim which many parties of the debate accept affects the narrative of the discussion and also plays a role against attempts to justify whistleblowing based on moral rights. In opposition to such a claim, I argue that one (...) can similarly ascribe pro tanto rightness to whistleblowing. However, this would also be a mistake. In principle, such claims are inaccurate concerning how pro tanto reasons work. Considering the motivations for taking up Ross’s idea of prima facie duties, and having in mind the theoretical role they are supposed to play, I suggest that only simple type-acts (as contrasted with complex act-types) may be called pro tanto right or wrong. Therefore, although widely appealed to, such claims about whistleblowing are neither helpful nor successful in the debate. (shrink)

I summarize a conception of morality as containing a set of rules which hold ceteris paribus and which impose pro-tanto obligations. I explain two ways in which moral rules are ceteris-paribus, according to whether an exception is duty-voiding or duty-overriding. I defend the claim that moral rules are ceteris-paribus against two qualms suggested by Luke Robinson’s discussion of moral rules and against the worry that such rules are uninformative. I show that Robinson’s argument that moral rules cannot ground pro- (...) class='Hi'>tanto obligations is unsound, because it confuses an absolute reason for an obligation with a reason for an absolute obligation, and because it overlooks the possibility that priority rules may be rules for ordering pro-tanto obligations rather than rules for eliminating contenders for the status of absolute obligation. There are many uses in English of the word “ought” (see Ought). This essay concerns the normative uses and the concepts or properties denoted thereby. In particular, it concerns two nonfinal oughts commonly used in the philosophical literature: prima facie oughts and pro tanto oughts.

I defend one way of solving the Impermissibility Problem—that is, the problem that on moralized approaches to coercion, coerciveness and permissibility are mutually exclusive. This brings up intuitive difficulties for cases such as taxation, which seem to be both coercive and permissible. I gloss three popular theories of coercion—the moralized baseline, nonmoralized baseline, and enforcement approaches—and conclude that only the nonmoralized baseline approach clearly solves the problem. However, Robert Nozick’s famous “slave case” raises another serious issue for the nonmoralized baseline (...) approach. So, in order to solve both the slave case and the Impermissibility Problem, I draw on Grant Lamond’s discussion of the coerciveness of law to propose the pro tanto wrong approach. On this approach, coercion is not impermissible simpliciter, but requires some sort of special justification. The pro tanto wrong approach is moralized, but on it, moralization comes in coercion’s need for justification, not in whether it is, in fact, justified. Thus impermissibility is neither necessary nor sufficient for coerciveness, and the Impermissibility Problem is avoided. I conclude that solving the problem in this way is desirable because it preserves a core belief of liberalism: certain acts, including taxation, may be both coercive and permissible. (shrink)

Some recent scholarship in the philosophy of criminal law has claimed that sexual penetration ‘per se’—meaning, consensual or otherwise—is pro tanto morally wrong, or that there exist ‘general reasons’ against it. On such a view, penetrative sex is only ever at best justified wrongdoing. When paired with an influential view about the theoretical basis of the offence-defence distinction in criminal law, the apparent implication is that sexual penetration alone ought to constitute the actus reus of rape, with the question (...) of consent relegated to a defence matter. This article firstly sets out some of the difficult upshots of considering all sexual penetration to be pro tanto wrong, particularly when one attends to the full moral entailments of justified wrongdoing. Assuming, arguendo, that sexual penetration is pro tanto wrong, it is also far from clear, I suggest, that consent, of all things, amounts to a justification for penetrative sex. This creates further difficulties for the pro tanto wrong view. Finally, I argue that even if penetrative sex is a pro tanto moral wrong of some kind, it does not follow, as some scholars have suggested, that there is a case for making penetrative sex as such the offence element of rape. In Climate Matters (2012), John Broome argues that individuals have private duties to offset all emissions for which they are causally responsible, grounded in the general moral injunction against doing harm. Emissions do harm, therefore they must be neutralized. I argue that individuals' private duties to offset emissions cannot be grounded in a duty to do no harm, because there can be no such general duty. It is virtually impossible in our current social context―for those in developed countries at least―to (...) do no harm, and we cannot have duties to do what we cannot do. I argue that this shifts the general injunction from 'do no harm' to 'do the least harm', and thereby reopens the question of tradeoffs which Broome had set aside as a matter of 'goodness' rather than 'justice'. He admits that when it comes to goodness, reducing emissions is not the best way to promote the good. The focus of this paper is on whether when it comes to minimizing injustice, reducing emissions is the best way. Climate change is undoubtedly one of the most important issues we face; it's clear that it matters prima facie. The question is whether―and to what extent―it matters all-things-considered. (shrink)

Partiendo de su debate con el ‘psicologismo’ y el ‘a-psicologismo’, mostramos la originalidad y la tensión de su posición, que intenta de articular el contenido- de-juicio con la inmanencia del acto intencional y la trascendencia de la objetividad, a partir de los conceptos de co-percepción e intencionalidad.

The identity is an arduous and complex topic that includes practically all the aspects of the life of a human being. The identity, mediated narrative, plays a role aimed at the personal direction of ours lives and sociocultural function linked to the quest for recognition of the rights of social groups to which one feels attached . Between economic globalization and pluralization of the life forms, identity is the result of a double disorientation. At the individual level, the insecurity work, (...) the flexibility of human relations, the rise in divorces or international migrations require rethinking, constantly, the circumstances on which our lives are developed. At the collective level, the new transnational agents like ONU or OTAN and local agents like nationalism, ethnic or immigrant groups forced to rethink the space of groups, collectives and communities between the global homogenization and local heterogeneity. Critics often argue that Ross’s metaphysical and epistemological accounts of all-things-considered duties suffer from the problem of explanation. For Ross did not give us any clear explanation of the combination of pro tanto duties, i.e. how principles of pro tanto duties can combine. Following from this, he did not explain how we could arrive at overall justified moral judgements. In this paper, I will argue that the problem of explanation is not compelling. First of all, it is based (...) on the classical account of pro tanto duties. Principles of pro tanto duties can be understood in another way, i.e. in terms of reason-giving account that might be of help to provide a response to the critics. Furthermore, critics fail to see some evidence in Ross about how we can arrive at moral judgements. (shrink)

Entre 1991 e 2000, a porcentagem de católicos caiu de 83,3% para 73,9%, a dos evangélicos cresceu de 9% para 15,6% e a dos “sem religião” subiu de 4,7% para 7,4%. Como entender essas mudanças? Qual a responsabilidade da Igreja católica? O artigo apresenta, primeiramente, a visão sobre a diversidade religiosa, as mudanças ocorridas nas últimas décadas. Discute a seguir sobre a “Força e fraqueza da presença católica”, construindo um “mapa do catolicismo”. O terceiro enfoque reflete sobre as causas desse (...) “enfraquecimento”, especialmente, os movimentos migratórios da população brasileira e os problemas da resposta da Igreja para acompanhar essa mudança, tanto nas “novas frentes migratórias” quanto nas periferias dos grandes centros. Deixando o campo católico, analisa-se a diversidade das igrejas evangélicas ou os protestantes tradicionais e depois a “expansão pentecostal”, em sua enorme diversidade, com destaque ao neopentecostalismo e seu profissionalismo empresarial. Beyond the Catholic scope, it analyses the diversity of evangelical churches r traditional protestants, and then ‘pentecostal expansion’, in its enormous diversity, with emphasis on neopentecostalism and its entrepreneurial professionalism. Particularmente, colocaremos el foco de la lectura en la problematización que Foucault despliega respecto de la formación de la economía política en tanto saber estratégico de la racionalidad liberal. Por ello, en el primer apartado, nos detendremos en la grilla de la gubernamentalidad como herramienta que la permite a Foucault elaborar una arqueo-genealogía de las formas de objetivación. Luego, dirigiremos (...) la lectura hacia la arqueo-genealogía de las formas de objetivación inmanentes a la constitución del discurso de la economía política en tanto saber estratégico de la gubernamentalidad liberal. La lectura kantiana sobre la obra de Descartes, antes que evidenciar un conocimiento detallado del planteamiento cartesiano, muestra los pretextos claros para que Kant realice precisiones a su sistema. ¿Cuál es el peso y el lugar del "yo pienso" en la filosofía kantiana?, ¿qué se puede derivar de la existencia de las cosas en relación con su conocimiento?, ¿cómo combina Kant el realismo empírico con el idealismo trascendental?, ¿cuáles son los límites del yo pienso trascendente, frente al yo pienso trascendental? En este artículo, el análisis de las diferencias entre la Crítica de 1781 y la de 1787, pasando por los Prolegómenos de 1783, ofrece precisiones sobre las preocupaciones de Kant provocadas por autores como Descartes y, en menor medida, Berkeley. The Kantian reading of Descartes is the pretext for Kant to make clarifications on his system, rather than demonstrate a detailed knowledge of the Cartesian approach. What is the role of the proposition "I think" in the kantian Philosophy? Is it possible to derive the existence of things from their knowledge? Does Kant mix the empirical realism with the transcendental realism? Which are the limits of the transcendent "I think" in confrontation with the transcendental "I think"? In this article, it is analyze the differences between the two editions of the Critique of the Pure Reason and the Prolegomena to any future metaphysic in order to suggest how the disagreement between Kant and Descartes let him to be more accurate with his Philosophy. Las últimas décadas han supuesto la irrupción de la nueva disciplina de la “política judicial”, heredera del realismo jurídico y empeñada en estudiar el comportamiento judicial con herramientas científico-sociales y desde variables explicativas sociopolíticas. Al hacerlo, sin embargo, dichos estudios han preterido el papel del derecho en la explicación del comportamiento de los magistrados, para lo cual se han esgrimido razones teóricas acerca de la indeterminación de la norma jurídica. En este artículo, defiendo que dicha preterición constituye una importante limitación (...) para la construcción de modelos empíricos de comportamiento judicial. (shrink)
