Recent scientific and technological developments have promoted the emergence of biobanks on a population scale. Although the storage of human biological material has taken place for a long time, it is only recently that biobanks have acquired a broader scientific significance, especially for genomic research. The increase in biobanks creates many ethical dilemmas, such as the protection of privacy, and creates the need for a new regulatory framework, which must enable the sustainable development of biobanks while also protecting the rights (...) of research subjects and biobank participants. This paper is a critical examination of Stephen Neale's *The Philosophical Significance of Godel's slingshot*. I am sceptical of the philosophical significance of Godel’s Slingshot (and of Slingshot arguments in general). In particular, I do not believe that Godel’s Slingshot has any interesting and important philosophical consequences for theories of facts or for referential treatments of definite descriptions. More generally, I do not believe that any Slingshot arguments have interesting and important philosophical consequences for theories of facts or for referential (...) treatments of definite descriptions. Friends of facts and referential treatments of definite descriptions can, and should, proceed with the construction of their theories, blithely ignoring the many Slingshots which now litter the landscape. ObjectivesTo determine to which degree industry partners in randomised clinical trials own the data and can constrain publication rights of academic investigators.MethodsCohort study of trial protocols, publication agreements and other documents obtained through Freedom of Information requests, for a sample of 42 trials with industry involvement approved by ethics committees in Denmark. The main outcome measures used were: proportion of trials where data was owned by the industry partner, where the investigators right to publish were constrained and if this was (...) mentioned in informed consent documents, and where the industry partner could review data while the trial was ongoing and stop the trial early.ResultsThe industry partner owned all data in 20 trials (48%) and in 16 trials (38%) it was unclear. Publication constraints were described for 30 trials (71%) and this was not communicated to trial participants in informed consent documents in any of the trials. In eight trials (19%) the industry partner could review data during the trial, for 20 trials (48%) it was unclear. The industry partner could stop the trial early without any specific reason in 23 trials (55%).ConclusionsPublication constraints are common, and data is often owned by industry partners. This is rarely communicated to trial participants. Such constraints might contribute to problems with selective outcome reporting. Patients should be fully informed about these aspects of trial conduct. (shrink)

Philosophers and logicians have long debated how best to understand conditional or hypothetical sentences. William G. Lycan has a distinctive approach to this debate, attending not just to the semantics of such sentences, but equally to their syntax. He shows how insights from linguistic theory help to illuminate problems about the meaning and function of conditionals. For instance, philosophers and logicians have had problems analysing the locutions 'only if', 'unless', and 'even if'. Lycan sets out a general semantic theory of (...) conditionals which works for all such sentences; he assigns meanings to them in a way that explains how and why those meanings depend upon features of utterance context. According to Lycan's theory the 'if'-clauses refer to items called 'events', 'circumstances', or 'conditions'.Real Conditionals gives at last the definitive presentation of this original approach to a topic at the intersection of philosophy, logic, and linguistics. In this paper I start discussing "originalism" as a practice of interpretation purporting the intent of the framers as "the" governing factor in interpretation. My first step is to contrast it with the approach of non-interpretivism. Then I discuss "interpretation" itself as a package to depict social practices of meaning production, focusing on three peculiar historical settings : Alexandria, Scholasticism, and the "birth" of Hermeneutics. My aim is to show the "essentialist" move of posing the concept of "meaning" as a (...) key factor in the "ideology" of interpretation. Such a discussion is introductory to a reappraisal of the current debate about criticism and of the distinction between interpretation and use-of-the-texts. I then examine archeology as a radical alternative to interpretive practices. But my final step will be to shift away from the blunt opposition between interpretivism and non interpretivism, to suggest a more complex arrangement based on an ironic misuse of interpretivism, and a framing of interpretation as an antagonistic process. Ever since the Proslogion was first circulated , critics have been bemused by St Anselm's brazen attempt to establish a matter of fact, namely, God's existence, from the simple analysis of a term or concept. Yet every critic who has proposed to ‘write the obituary’ of the Ontological Argument has found it to be remarkably resilient . At the risk of adding to a record of failures, I want to venture a new method for attacking this durable argument. Neither the (...) common version of Anselm's argument from Chapter II of the Proslogion nor the previously unrecognized modal version uncovered by Norman Malcolm from Pros , III can possibly get under way without Anselm's celebrated assertion that God is that than which no greater can be conceived. Studies of coexistence are based ultimately on the assumption that competitive exclusion is a general and accredited phenomenon in nature. However, the ecological and evolutionary impact of interspecific competition is of questionable significance. Review of three reputed examples of competitive exclusion in the field (Aphytis wasps, red and grey squirrels, and triclads) demonstrates that the widely-accepted competition-based interpretations are unlikely, that alternative explanations are overlooked, and that all other reported cases need critical reinvestigation. Although interspecific competition does undoubtedly occur, the (...) evidence suggests it is usually too weak and intermittent a force to achieve competitive exclusion or any other ecologically-significant result, except perhaps rarely and on a minor scale. Coexistence and community structure are therefore not ecological conditions to be especially accounted for, especially since their inherently comparative methods generate information that is largely superficial. Alternative questions that relate directly to species, the units of diversity, are discussed and they emphasize the primary habitat requirements of species, which are fixed during speciation. Neither the comparative approach of coexistence studies, nor the investigation of pattern is likely to be profitable, since the acquisition of species-specific characteristics during speciation requires historical research. At least one alternative theory of ecology, based on the close adaptation of organisms to the environment, is available. (shrink)

In this new context, the question about "what is human in humans" may end up being answered by geneticists, specialists of technoscience, and owners of biotech companies. The author defends, in this article, the idea that humanity is at risk in our age of genetic engineering, biotechnologies, and market-geared genetic research; he also argues that the values at the very core of our postgenomic era bring (...) to its peak the science-based ideology that has developed since the time of Galileo, Newton, Descartes, and Harvey; finally, it shows that the bioindustry has invented a new genomythology that goes against the scientific evidence produced by the research in human sciences in which life is interpreted as a language. This paper looks at what David Kaplan's work on indexicals can teach us about logic and the philosophy of logic, and also what Kaplan's logic (i.e. the Logic of Demonstratives) can teach us about indexicals. The lessons are i) that logical consequence is not necessary truth-preservation, ii) that that the linguistic doctrine of necessary truth (also called conventionalism about modality) fails, and iii) that there is a kind of barrier to entailment between non-context-sensitive and context-sensitive claims.

Starting from the conceptual premises of Garrod, who as long ago as 1902 spoke of chemical individuality, and of Burnet (1949), who recognized as self one's own molecular antigenic structures (as opposed to the antigenic alien: the non- self), the discovery and understanding of HLA antigens and of their extraordinarily individual and differentiated polymorphisms have gained universal recognition. Transplant medicine has now dramatically stressed, within man's knowledge of himself, the characteristic of his biological uniqueness. Today man, having become aware of (...) being a biological antigenic-molecular individuality which is unique and different from that of all of his fellow men (except for monozygotic twins), can therefore easily consider himself a true biological Ego.
