Se analiza la relación y la distinción entre los conceptos de regulación, autodeterminación y libertad, y se presentan las influencias teóricas que condujeron a su identificación. La cuestión se acota al tratamiento de la teoría de la autodeterminación y la teoría relacional de las necesidades. Se intenta mostrar que la autorregulación no puede identificarse con la autonomía, ni el concepto de autonomía es sinónimo de autodeterminación, porque la autonomía refiere a la propiedad de la voluntad de ser la fuente de (...) la ley, en sentido kantiano, y el concepto de autodeterminación refiere a la propiedad de la voluntad de ser dominio de sí y del resto de las capacidades. El concepto de autorregulación tiene su lugar de origen en la biología y luego se aplica, por extensión, al campo de la psicología. (shrink)

Cet article s’intéresse au phénomène des violences conjugales en montrant l’intérêt de considérer l’articulation des enveloppes psychiques au niveau individuel, familial et « couplal ». Il met le projecteur sur les matériaux psychiques transmis de génération en génération, qui traversent ces contenants. Si certaines traces du passé sont conscientes et élaborées, d’autres demeurent inconscientes et empreintes de traumatismes. Par l’effet d’emboîtement des enveloppes psychiques et par le biais du nouage des alliances inconscientes, ces héritages négatifs se retrouvent impliqués dans les (...) fondations du lien du couple. Une vignette clinique aide à comprendre le rôle des legs familiaux dans l’émergence d’agirs violents entre les partenaires amoureux et leur impact sur l’enveloppe psychique du couple. This book looks in particular at Achebe's Anthills of the Savannah and Petals of Blood by Ngugi wa Thiong'o, but situates these within the broader context of developments in African literature over the past half-century, discussing writers from Ayi Kwei Armah to Wole Soyinka. M.S.C. Okolo provides a thorough analysis of the authors' differing approaches and how these emerge from the literature. Clinical ethics committees (CECs) have been developing in many countries since the 1980s, more recently in the transitional countries in Eastern Europe. With their increasing profile they are now faced with a range of questions and challenges regarding their position within the health care organizations in which they are situated: Should CECs be independent bodies with a critical role towards institutional management, or should they be an integral part of the hospital organization? In this paper, we discuss the organizational context (...) in which CECs function in Europe focusing on five aspects. We conclude that in Europe clinical ethics committees need to maintain a critical independence while generating acceptance of the CEC and its potential benefit to both individuals and the organization. CECs, perhaps particularly in transitional countries, must counter the charge of “alibi ethics”. CECs must define their contribution to in-house quality management in their respective health care organization, clarifying how ethical reflection on various levels serves the hospital and patient care in general. This last challenge is made more difficult by lack of consensus about appropriate quality outcomes for CECs internationally. These are daunting challenges, but the fact that CECs continue to develop suggests that we should make the effort to overcome them. We believe there is a need for further research that specifically addresses some of the institutional challenges facing CECs. (shrink)

Clinical ethics support services are developing in Europe. They will be most useful if they are designed to match the ethical concerns of clinicians. We conducted a cross-sectional mailed survey on random samples of general physicians in Norway, Switzerland, Italy, and the UK, to assess their access to different types of ethics support services, and to describe what makes them more likely to have used available ethics support. Respondents reported access to formal ethics support services such as clinical ethics committees (...) (23%), consultation in individual cases (17.6%), and individual ethicists (8.8%), but also to other kinds of less formal ethics support (23.6%). Access to formal ethics support services was associated with work in urban hospitals. Informal ethics resources were more evenly distributed. Although most respondents (81%) reported that they would find help useful in facing ethical difficulties, they reported having used the available services infrequently (14%). Physicians with greater confidence in their knowledge of ethics (P = 0.001), or who had had ethics courses in medical school (P = 0.006), were more likely to have used available services. Access to help in facing ethical difficulties among general physicians in the surveyed countries is provided by a mix of official ethics support services and other resources. Developing ethics support services may benefit from integration of informal services. Development of ethics education in medical school curricula could lead to improved physicians sensititity to ethical difficulties and greater use of ethics support services. Such support services may also need to be more proactive in making their help available. (shrink)

I will not dwell overlong on the “meaning” of this story. But let me make two essential points. Plato tells us this story as though it were true: it is “a tale which, though passing strange, is yet wholly true.” Those words were to be translated into every language in the world and used to justify the most realistic fantasies. That is quite understandable, for Plato’s story started something new. With a perversity that was to ensure him great success, Plato (...) had laid the foundations for the historical novel, that is to say, the novel set in a particular place and a particular time. We are now quite accustomed to historical novels, and we also know that in every detective story there comes a moment when the detective declares that real life is not much like what happens in detective stories; it is far more complicated. But that was not the case in the fourth century B.C. Plat’s words were taken seriously, not by everyone, but by many, down through the centuries. And it is not too hard to see that some people continue to take them seriously today.As for the “meaning,” following others and together with others, I have tried elsewhere to show that essentially it is quite clear: the Athens and Atlantis of ancient lore represent the two faces of Plato’s own Athens. The former, the old primordial Athens, is what Plato would have liked the city of which he was a citizen to be; the latter is what Athens was in the age of Pericles and Cleon, an imperialistic power whose very existence constituted a threat to other Greek cities. Desde mediados del siglo XX, el devenir de la salvaguarda relacionada con las viviendas ha avanzado desde la monumentalidad hasta el contexto, desde la individualización hasta la caracterización paisajística, desde las condiciones materiales hasta los aspectos vivenciales. Sin embargo, amparar el cuerpo de las residencias típicas de cada territorio, en especial en los dinámicos marcos urbanos, resultó —y resulta— un desafío. Las experimentaciones de propuestas hacia un amparo residencial a más largo plazo han coincidido en dos aspectos de interés: la (...) promoción de indicadores de sustentabilidad patrimonial, inscriptos en cada marco estatal-local preservacionista, junto con el reconocimiento y el tratamiento del rol usuario. En este sentido, desde variables histórico-arquitectónicas y sociales se propuso la construcción y la aplicación de indicadores de sustentabilidad patrimonial residencial para visibilizar problemas y potencialidades hacia una formulación de estrategias de preservación apropiadas. Para ello se abordó la ciudad de Mar del Plata, una aglomeración intermedia bonaerense paradigmática debido a sus dinamismos pasados y presentes, con foco en sus chalets “estilo Mar del Plata” y sus usuarios. Se analizaron dos barrios históricos —Stella Maris y La Perla—, donde sobrevive una relevante diversidad de chalets en un marco de múltiples riesgos que afectan su permanencia. Desde una perspectiva principalmente cualitativa, apoyada por datos cuantitativos, se articularon relevamientos in situ, fuentes escritas (investigaciones previas, artículos científicos, cartas patrimoniales), gráficas (planimetrías, fotografías, imágenes aéreas) y orales (encuestas, entrevistas). De esta manera, la indagación desarrollada permitió avanzar en renovados caminos para progresar en la salvaguarda del legado residencial contextual. (shrink)

BackgroundThe emergence of artificial intelligence (AI) in medicine has prompted the development of numerous ethical guidelines, while the involvement of patients in the creation of these documents lags behind. As part of the European PROFID project we explore patient perspectives on the ethical implications of AI in care for patients at increased risk of sudden cardiac death (SCD).AimExplore perspectives of patients on the ethical use of AI, particularly in clinical decision-making regarding the implantation of an implantable cardioverter-defibrillator (ICD).MethodsSemi-structured, future scenario-based (...) interviews were conducted among patients who had either an ICD and/or a heart condition with increased risk of SCD in Germany (n = 9) and the Netherlands (n = 15). We used the principles of the European Commission’s Ethics Guidelines for Trustworthy AI to structure the interviews.ResultsSix themes arose from the interviews: the ability of AI to rectify human doctors’ limitations; the objectivity of data; whether AI can serve as second opinion; AI explainability and patient trust; the importance of the ‘human touch’; and the personalization of care. Overall, our results reveal a strong desire among patients for more personalized and patient-centered care in the context of ICD implantation. Participants in our study express significant concerns about the further loss of the ‘human touch’ in healthcare when AI is introduced in clinical settings. They believe that this aspect of care is currently inadequately recognized in clinical practice. Participants attribute to doctors the responsibility of evaluating AI recommendations for clinical relevance and aligning them with patients’ individual contexts and values, in consultation with the patient.ConclusionThe ‘human touch’ patients exclusively ascribe to human medical practitioners extends beyond sympathy and kindness, and has clinical relevance in medical decision-making. Because this cannot be replaced by AI, we suggest that normative research into the ‘right to a human doctor’ is needed. Furthermore, policies on patient-centered AI integration in clinical practice should encompass the ethics of everyday practice rather than only principle-based ethics. We suggest that an empirical ethics approach grounded in ethnographic research is exceptionally well-suited to pave the way forward. (shrink)

Animals and Business Ethics is an edited book that applies business ethical theory to nonhuman animals. It explores the ethics of commodifying animals in a business context, how stakeholder and social contract theories relate to animals, how business can be regulated to improve conditions for animals, how to create more humane jobs for humans and animals, and the linkages between human and animal well-being, in the context of human workers and consumers who interact with animals in business. Business ethics literature (...) has underrepresented animals, although this is beginning to change. This book is an introduction to how business ethics theory can be applied, through a range of theoretical chapters and case studies. Animals and Business Ethics is a valuable contribution to the literature, which opens space for additional research. (shrink)

As recently as 1970 about one-fifth of the children living in single-parent households resided in ones created by the death of a father. In colonial and nineteenth-century America, death was a much more important factor in disrupting parent-child relationships than it is today. Past societal reaction to the death of a parent continues to influence social policy; for example, widows and their dependent children receive more public assistance than divorced mothers or single mothers with children born out-of-wedlock. Although the material (...) conditions for widows have improved over time, the social network available to help them cope with the emotional distress caused by the death of a husband probably has diminished. Devant le constat du déclin toujours plus rapide de la diversité biologique et les limites des res- sources disponibles pour l’enrayer, il est nécessaire de déterminer quels moyens devraient être engagés dans sa protection. Pour ce faire, une méthode efficace serait d’évaluer les bénéfices tirés de la biodiversité afin d’estimer rationnellement les coûts légitimes de sa protection. L’évaluation économique, qui se présente d’emblée sur un mode quantitatif, serait alors un outil précieux. Dans ce texte, nous présentons différentes méthodes d’évaluation économique (...) de la biodiversité ainsi que certaines de leurs limites méthodologiques. Par la suite, nous montrons qu’en dépit de ses avantages pratiques, l’évaluation économique échoue à représenter l’ensemble des valeurs en jeu dans la protection de la biodiversité. Nous décrivons alors trois types de valeurs incommen- surables avec des bénéfices économiques : la valeur de legs, qui renvoie aux obligations de trans- mission du patrimoine naturel dont nous avons hérité ; la valeur d’existence, qui renvoie à la considération morale d’intérêts autres que ceux des êtres humains ; la valeur de transformation, qui renvoie à la capacité d’examiner et de critiquer nos préférences et inclinaisons afin d’inclure celles-ci dans une vision du monde rationnelle et cohérente. Pour conclure, nous plaidons en faveur de l’élaboration de méthodes de concertation et d’évaluation participatives et pluralistes permettant de rendre compte de la diversité et de l’hétérogénéité des valeurs de la biodiversité. Based on a sociological survey carried out in a camp for asylum seekers in Belgium, the article questions the modes of existence in this “out of place” and “out of time” that is the camp. Behind the apparent emptiness of waiting in a decelerated present, the investigation highlights three temporalities that together shape the breathing of the camp and the living conditions of asylum seekers: the rhythm of the framework that holds together daily life, the cycle and the passage that (...) gives a sense of the ordeal and finally the singular time of the articulations between present, past and future which characterize the “being in time” of asylum seekers. After exploring these three temporalities, the author proposes a concept that allows them to hold together in order to understand the texture of time that unfolds in these “out of place”, “out of time” that are the camps. ' Thus Kant formulates his attitude to morality (Critique of Practical Reason, p. 260). He draws a sharp distinction between these two objects of admiration. The starry sky, he writes, represents my relationship to the natural, empirical world. Moral law, on the other hand, is of a completely (...) different order. It ' . . . begins from my invisible self, my personality, and exhibits me in a world which has true infinity, but which is traceable only by the understanding and with which I discern that I am not in a merely contingent but in a universal and necessary connection (. . . ). ' (p. 260). So Kant sees morality as a separate metaphysical order opposed to the world of empirical phenomena. Human beings belong to both worlds. According to Kant, the personality derives nothing of value from its relationship with the empirical world. His part in the sensuous world of nature places man on a level with any animal which before long must give back to the rest of nature the substances of which it is made. (shrink)

The question about truth, experience and sharing of truth can be addressed from the viewpoint of a shared sense of community. The search for truth is related to the sensus communis and the conscience – con scientia – that is formed in the community. The sensus communis is not only a general faculty in all men, but also the sense that founds community. Thereby the knowledge is true only in front of the other. Truth reveals itself in conversation. By conversation (...) it means that there are both someone who asks questions and someone who answers them, and that they change their roles. In order to understand each other, they have to share a common field of experience. The approach to the concept of truth as a representation of things loses its place and gives way to the understanding of truth as something where meaning as sense and truth as open and exposed concept appears in the foreground. Phenomenology reveals that community correlates and imposes a set of senses to the consciousness and conscience of the individual. This lets phenomenologists focus on life, culture and language. The truth transforms from meaning into sense. It becomes a dynamic determination of a human being. (shrink)

Although there exists a strong uncertainty surrounding the evaluation of the decline of biodiversity, and a larger uncertainty still regarding projections of the decline to come, there is no controversy on the fact that the current rate of extinction is in a crisis. The fact that this decline is above all of anthropic origin is the object of a consensus within the scientific community. This text thus takes as a starting point the existence of a true crisis of biodiversity. This (...) crisis of biodiversity must conclude in the adoption of a principle of protection of the biodiversity, a normative principle which would constrain the relation of man with nature with regard to its diversity. I will show in this text that the principle of sustainable development is not sufficient to adequately define a principle of protection of the biodiversity. (shrink)
