Currently, electronic agents are being designed and implemented that, unprecedentedly, will be capable of performing legally binding actions. These advances necessitate a thorough treatment of their legal consequences. In our paper, we first demonstrate that electronic agents behave structurally similar to human agents. Then we study how declarations of intention stated by an electronic agent are related to ordinary declarations of intention given by natural persons or legal entities, and also how the actions of electronic agents in this respect have (...) to be classified under German law. We discuss four different approaches of classifying agent declarations. As one of these, we propose the concept of an electronic person (i.e., agents with limited liability), enrolment of agents into an agent register, and agent liability funds as means to serve the needs of all contracting parties. In this article, we draw on established views of CSR dysfunctionalities to show how and why CSR is regularly observed to be both shaped by and supportive of capitalism. We proceed to show that these dysfunctionalities are maintained by both the pro- and anticapitalist approaches to CSR, both of which imply an ill-defined separation of the economy and society as well an overly strong problem or solution focus on political and economic issues. Finally, we present a post-capitalist approach to CSR (...) that overcomes (1) the ill-defined separation of the economy and society, (2) the capitalist bias towards economic rationalities, and (3) the overidentification of society with its political system; this approach thus helps to manage the abovementioned CSR dysfunctionalities. In a merely verbal agreement, a misunderstanding between two parties creates the false impression of agreement: one or both parties think they agree on something, when in fact they do not. There is reason to believe that merely verbal agreements are as common as merely verbal disagreements and disputes. Unlike the latter, however, merely verbal agreements have so far been ignored by philosophers. The purpose of this paper is twofold: first, to clarify what merely verbal agreement is by considering various (...) ways of defining and refining the notion; and second, to explore the effects of merely verbal agreement on conversational common ground, collaborative action, and academic philosophy. It will be argued that merely verbal agreement is best understood in terms of divergent speaker-meanings, that it has specific negative effects on common ground, that it impedes collaborative action, and that it is likely to play a significant role in academic philosophy. A philosopher argues that state-sponsored cyberattacks against central military or civilian targets are always acts of war. What is this philosopher doing? According to conceptual analysts, the philosopher is making a claim about our concept of war. According to philosophical realists, the philosopher is making a claim about war per se. In a quickly developing literature, a third option is being explored: the philosopher is engineering the concept of war. On this view, the philosopher is making a proposal about which (...) concept we should have – even if it deviates from the extant concept, and even if it does not capture ‘what war really is’. The activity or method of proposing such revisionary definitions, as well as the metaphilosophical reflection on it, has become known as conceptual engineering. (shrink)

It is often assumed that how we talk about the world matters a great deal. This is one reason why conceptual engineers seek to improve our linguistic practices by advocating novel uses of our words, or by inventing new ones altogether. A core idea shared by conceptual engineers is that by changing our language in this way, we can reap all sorts of cognitive and practical benefits, such as improving our theorizing, combating hermeneutical injustice, or promoting social emancipation. But how (...) do changes at the linguistic level translate into any of these worthwhile benefits? In this paper, we propose the nameability account as a novel answer to this question. More specifically, we argue that what linguistic resources are readily available to us directly affects our cognitive performance on various categorization‐related tasks. Consequently, our performance on such tasks can be improved by making controlled changes to our linguistic resources. We argue that this account supports and extends recent motivations for conceptual engineering, as categorization plays an important role in both theoretical and practical contexts. (shrink)

Conceptual engineers aim to revise rather than describe our concepts. But what are concepts? And how does one engineer them? Answering these questions is of central importance for implementing and theorizing about conceptual engineering. This paper discusses and criticizes two influential views of this issue: semanticism, according to which conceptual engineers aim to change linguistic meanings, and psychologism, according to which conceptual engineers aim to change psychological structures. I argue that neither of these accounts can give us the full story. (...) Instead, I propose and defend the Dual Content View of Conceptual Engineering. On this view, conceptual engineering targets concepts, where concepts are understood as having two kinds of contents: referential content and cognitive content. I show that this view is independently plausible and that it gives us a comprehensive account of conceptual engineering that helps to make progress on some of the most difficult problems surrounding conceptual engineering. Genes induced by the plant hormone auxin are probably involved in the execution of vital cellular functions and developmental processes. Experimental approaches designed to elucidate the molecular mechanisms of auxin action have focused on auxin perception, genetic dissection of the signaling apparatus and specific gene activation. Auxin‐responsive promoter elements of early genes provide molecular tools for probing auxin signaling in reverse. Functional analysis of several auxin‐specific promoters of unrelated early genes suggests combinatorial utilization of both conserved and variable elements. These (...) elements are arranged into autonomous domains and the combination of such modules generates uniquely composed promoters. Max Deutsch has recently argued that conceptual engineering is stuck in a dilemma. If it is construed as the activity of revising the semantic meanings of existing terms, then it faces an unsurmountable implementation problem. If, on the other hand, it is construed as the activity of introducing new technical terms, then it becomes trivial. According to Deutsch, this conclusion need not worry us, however, for conceptual engineering is ill-motivated to begin with. This paper responds to Deutsch by arguing, first, (...) that there is a third construal of conceptual engineering, neglected by him, which renders it both implementable and non-trivial, and second, that even the more ambitious project of changing semantic meanings is no less feasible than other normative projects we currently pursue. Unlike conceptual analysis, conceptual engineering does not aim to identify the content that our current concepts do have, but the content which these concepts should have. For this method to show the results that its practitioners typically aim for, being able to change meanings seems to be a crucial presupposition. However, certain branches of semantic externalism raise doubts about whether this presupposition can be met. To the extent that meanings are determined by external factors such as causal histories or microphysical (...) structures, it seems that they cannot be changed intentionally. This paper gives an extended discussion of this ‘externalist challenge’. Pace Herman Cappelen’s recent take on this issue, it argues that the viability of conceptual engineering crucially depends on our ability to bring about meaning change. Furthermore, it argues that, contrary to first appearance, causal theories of reference do allow for a sufficient degree of meaning control. To this purpose, it argues that there is a sense of what is called ‘collective long-range control’, and that popular versions of the causal theory of reference imply that people have this kind of control over meanings. To commemorate 40 years since the founding of the Journal of Business Ethics, the editors in chief of the journal have invited the editors to provide commentaries on the future of business ethics. This essay comprises a selection of commentaries aimed at creating dialogue around the theme Ethics at the centre of global and local challenges. For much of the history of the Journal of Business Ethics, ethics was seen within the academy as a peripheral aspect of business. However, in (...) recent years, the stakes have risen dramatically, with global and local worlds destabilized by financial crisis, climate change, internet technologies and artificial intelligence, and global health crises. The authors of these commentaries address these grand challenges by placing business ethics at their centre. What if all grand challenges were framed as grand ethical challenges? Tanusree Jain, Arno Kourula and Suhaib Riaz posit that an ethical lens allows for a humble response, in which those with greater capacity take greater responsibility but remain inclusive and cognizant of different voices and experiences. Focussing on business ethics in connection to the grand challenge of environmental emergencies, Steffen Böhm introduces the deceptively simple yet radical position that business is nature, and nature is business. His quick but profound side-step from arguments against human–nature dualism to an ontological undoing of the business–nature dichotomy should have all business ethics scholars rethinking their “business and society” assumptions. Also, singularly concerned with the climate emergency, Boudewijn de Bruin posits a scenario where, 40 years from now, our field will be evaluated by its ability to have helped humanity emerge from this emergency. He contends that Milieudefensie v. Royal Dutch Shell illustrates how human rights take centre stage in climate change litigation, and how business ethics enters the courtroom. From a consumer ethics perspective, Deirdre Shaw, Michal Carrington and Louise Hassan argue that ecologically sustainable and socially just marketplace systems demand cultural change, a reconsideration of future interpretations of “consumer society”, a challenge to the dominant “growth logic” and stimulation of alternative ways to address our consumption needs. Still concerned with global issues, but turning attention to social inequalities, Nelarine Cornelius links the capability approach to global and corporate governance, arguing that CA will continue to lie at the foundation of human development policy, and, increasingly, CSR and corporate governance. Continuing debate on the grand challenges associated with justice and equality, Laurence Romani identifies a significant shift in the centrality of business ethics in debates on managing differences, positing that dialogue between diversity management and international management can ground future debate in business ethics. Finally, the essay concludes with a commentary by Charlotte Karam and Michelle Greenwood on the possibilities of feminist-inspired theories, methods, and positionality for many spheres of business ethics, not least stakeholder theory, to broaden and deepen its capacity for nuance, responsiveness, and transformation. In the words of our commentators, grand challenges must be addressed urgently, and the Journal of Business Ethics should be at the forefront of tackling them. (shrink)

Conceptual engineering concerns the assessment and improvement of our concepts. But how can proposals to engineer concepts be implemented in the real world? This is known as the implementation challenge to conceptual engineering. In this paper, I am concerned with the meta-philosophical implications of the implementation challenge. Specifically, must we overcome the implementation challenge prior to undertaking conceptual engineering? Some critics have recently answered this question affirmatively. I intend to show that they are mistaken. I argue as follows. First, successful (...) implementation is not an integral part of conceptual engineering. Second, the idea that the value of conceptual engineering relies on successful implementation is in tension with widespread assumptions about normative theorizing. (shrink)

This paper argues for explanatory eliminativism about topics (and cognates, such as subject matters) relative to the domain of conceptual engineering. It has become usual to think that topics serve an important explanatory role in theories of conceptual engineering, namely, to determine the limits of revision. I argue, first, that such limits can be understood either as thenormative limitspertaining to the justification of conceptual engineering, as themetaphysical limitspertaining to the identity of the concepts in question, or as theterminological limitspertaining to (...) usage of the original terminology. Second, I argue that the metaphysical reading is disputable as a theory of concepts and inconsequential for conceptual engineers, and that neither of the two leading accounts of topics that have been presented in the literature—the samesaying account and functionalism—determine the limits of revision in either of the two remaining senses. In the absence of more promising competitors, I conclude that there is no theoretical role for topics to play in theories of conceptual engineering. An upshot of my argument is that conceptual engineers should stop worrying about things like topic (dis)continuity, and instead shift their attention to the issues that really matter for justifying conceptual revisions or replacements, making terminological choices, and underpinning conceptual engineering with a theory of concepts. Ethical issues concerning brain–computer interfaces have already received a considerable amount of attention. However, one particular form of BCI has not received the attention that it deserves: Affective BCIs that allow for the detection and stimulation of affective states. This paper brings the ethical issues of affective BCIs in sharper focus. The paper briefly reviews recent applications of affective BCIs and considers ethical issues that arise from these applications. Linguistic interventions aim to change our linguistic practices. A commonly discussed type of linguistic intervention is meaning revision, which seeks to associate existing words with new or revised meanings. But why does retaining old words matter so much? Why not instead introduce new words to express the newly defined meanings? Drawing on relevant psycholinguistic research, this paper develops an empirically motivated, general, and practically useful pro tanto reason to retain rather than replace the original word during the process of conceptual (...) improvement. In his recent book, The Concept of Democracy: An Essay on Conceptual Amelioration and Abandonment (OUP, 2023) Herman Cappelen argues that we should abandon the concept of democracy, and hence stop using the words “democracy” and “democratic.” In the course of developing his arguments for this surprising claim, Cappelen also offers a more general theory of what kind of reasons count in favor of abandoning a concept. In this paper, which is part of a book symposium on Cappelen’s book, I (...) review and criticize both his theory of abandonment and his case for abandoning the concept of democracy. I argue that Cappelen’s abandonment theory is inconclusive, and that his case for abandoning the concept of democracy is unconvincing. (shrink)

Ameliorative projects design and propagate new linguistic content for some expressions we use for political or social justice purposes. These projects are often driven by an anti-essentialist agenda: they aim to debunk the idea that social categories such as “woman,” “man,” or “race” are constituted by natural essences. But critics argue that nouns tend to trigger essentialist thinking. And because ameliorative projects typically retain nouns, it is argued that these projects cannot achieve their anti-essentialist goals. In response, I argue that (...) the psychological effects of noun use tend to support, rather than hinder, the anti-essentialist goals of ameliorators. (shrink)

It is often suggested that social media is a hostile environment for critical thinking and that a major source for epistemic problems concerning social media is that it facilitates emotions. We argue that emotions per se are not the source of the epistemic problems concerning social media. We propose that instead of focusing on emotions, we should focus on the affective scaffolding of social media. We will show that some affective scaffolds enable desirable epistemic practices, while others obstruct beneficial epistemic (...) practices, or enable hostile epistemic practices. Particularly, we will show that emotions play a crucial role in the epistemic practice of critical thinking and that the affective scaffolding of social media can support, or hinder, online critical thinking. The upshot of our argument is that affective scaffoldings of social media can harness emotions to support beneficial epistemic practices, like online critical thinking. (shrink)

Multi-stakeholder initiatives have become a vital part of the organizational landscape for corporate social responsibility. Recent debates have explored whether these initiatives represent opportunities for the “democratization” of transnational corporations, facilitating civic participation in the extension of corporate responsibility, or whether they constitute new arenas for the expansion of corporate influence and the private capture of regulatory power. In this article, we explore the political dynamics of these new governance initiatives by presenting an in-depth case study of an organization often (...) heralded as a model MSI: the Forest Stewardship Council. An effort to address global deforestation in the wake of failed efforts to agree a multilateral convention on forests at the Rio Summit in 1992, the FSC was launched in 1993 as a non-state regulatory experiment: a transnational MSI, administering a global eco-labeling scheme for timber and forest products. We trace the scheme’s evolution over the past two decades, showing that while the FSC has successfully facilitated multi-sectoral determination of new standards for forestry, it has nevertheless failed to transform commercial forestry practices or stem the tide of tropical deforestation. Applying a neo-Gramscian analysis to the organizational evolution of the FSC, we examine how broader market forces and resource imbalances between non-governmental and market actors can serve to limit the effectiveness of MSIs in the current neo-liberal environment. This presents dilemmas for NGOs which can lead to their defection, ultimately undermining the organizational legitimacy of MSIs. (shrink)

Recently developed large language models (LLMs) perform surprisingly well in many language-related tasks, ranging from text correction or authentic chat experiences to the production of entirely new texts or even essays. It is natural to get the impression that LLMs know the meaning of natural language expressions and can use them productively. Recent scholarship, however, has questioned the validity of this impression, arguing that LLMs are ultimately incapable of understanding and producing meaningful texts. This paper develops a more optimistic view. (...) Drawing on classic externalist accounts of reference, it argues that LLM-generated texts meet the conditions of successful reference. This holds at least for proper names and so-called paradigm terms. The key insight here is that the LLM may inherit reference from its training-data through a reference-sustaining training mechanism. Any account of “what is special about the human brain” (Passingham 2008) must specify the neural basis of our unique ability to produce speech and delineate how these remarkable motor capabilities could have emerged in our hominin ancestors. Clinical data suggest that the basal ganglia provide a platform for the integration of primate-general mechanisms of acoustic communication with the faculty of articulate speech in humans. Furthermore, neurobiological and paleoanthropological data point at a two-stage model of the phylogenetic evolution of this (...) crucial prerequisite of spoken language: (i) monosynaptic refinement of the projections of motor cortex to the brainstem nuclei that steer laryngeal muscles, presumably, as part of a “phylogenetic trend” associated with increasing brain size during hominin evolution; (ii) subsequent vocal-laryngeal elaboration of cortico-basal ganglia circuitries, driven by human-specificFOXP2mutations.;>This concept implies vocal continuity of spoken language evolution at the motor level, elucidating the deep entrenchment of articulate speech into a “nonverbal matrix” (Ingold 1994), which is not accounted for by gestural-origin theories. Moreover, it provides a solution to the question for the adaptive value of the “first word” (Bickerton 2009) since even the earliest and most simple verbal utterances must have increased the versatility of vocal displays afforded by the preceding elaboration of monosynaptic corticobulbar tracts, giving rise to enhanced social cooperation and prestige. At the ontogenetic level, the proposed model assumes age-dependent interactions between the basal ganglia and their cortical targets, similar to vocal learning in some songbirds. In this view, the emergence of articulate speech builds on the “renaissance” of an ancient organizational principle and, hence, may represent an example of “evolutionary tinkering” (Jacob 1977). It seems natural to think that Carnapian explication and experimental philosophy can go hand in hand. But what exactly explicators can gain from the data provided by experimental philosophers remains controversial. According to an influential proposal by Shepherd and Justus, explicators should use experimental data in the process of ‘explication preparation’. Against this proposal, Mark Pinder has recently suggested that experimental data can directly assist an explicator’s search for fruitful replacements of the explicandum. In developing his argument, he also proposes (...) a novel aspect of what makes a concept fruitful, namely, that it is taken up by the relevant community. In this paper, I defend explication preparation against Pinder’s objections and argue that his uptake proposal conflates theoretical and practical success conditions of explications. Furthermore, I argue that Pinder’s suggested experimental procedure needs substantial revision. I end by distinguishing two kinds of explication projects, and showing how experimental philosophy can contribute to each of them. (shrink)

Connecting human minds to various technological devices and applications through brain-computer interfaces (BCIs) affords intriguingly novel ways for humans to engage and interact with the world. Not only do BCIs play an important role in restorative medicine, they are also increasingly used outside of medical or therapeutic contexts (e.g., gaming or mental state monitoring). A striking peculiarity of BCI technology is that the kind of actions it enables seems to differ from paradigmatic human actions, because, effects in the world are (...) brought about by devices such as robotic arms, prosthesis, or other machines, and their execution runs through a computer directed by brain signals. In contrast to usual forms of action, the sequence does not need to involve bodily or muscle movements at all. A motionless body, the epitome of inaction, might be acting. How do theories of action relate to such BCI-mediated forms of changing the world? We wish to explore this question through the lenses of three perspectives on agency: subjective experience of agency, philosophical action theory, and legal concepts of action. Our analysis pursues three aims: First, we shall discuss whether and which BCI-mediated events qualify as actions, according to the main concepts of action in philosophy and law. Secondly, en passant, we wish to highlight the ten most interesting novelties or peculiarities of BCI-mediated movements. Thirdly, we seek to explore whether these novel forms of movement may have consequences for concepts of agency. More concretely, we think that convincing assessments of BCI-movements require more fine-grained accounts of agency and a distinction between various forms of control during movements. In addition, we show that the disembodied nature of BCI-mediated events causes troubles for the standard legal account of actions as bodily movements. In an exchange with views from philosophy, we wish to propose that the law ought to reform its concept of action to include some, but not all, BCI-mediated events and sketch some of the wider implications this may have, especially for the venerable legal idea of the right to freedom of thought. In this regard, BCIs are an example of the way in which technological access to yet largely sealed-off domains of the person may necessitate adjusting normative boundaries between the personal and the social sphere. Kripke complained that counterpart theory makes modal claims be about counterparts and not about us, and that it is a misguided model of modality since we do not care about counterparts in the same way we care about ourselves. The first part of the complaint, I argue, has been met by Hazen and Lewis, while the second can be countered by observing that most of our modal concerns are about role‐fillers and that counterparts are well‐suited to such concerns. The role‐filler (...) analysis of modal concerns, however, does not seem to capture certain attitudes ‐ especially that of regret. Regret, however, I will argue, is not intrinsically modal and thus is no challenge to my general analysis of modal concerns. (shrink)

Social media technologies are routinely identified as a strong and pervasive threat to digital well-being. Extended screen time sessions, chronic distractions via notifications, and fragmented workflows have all been blamed on how these technologies ruthlessly undermine our ability to exercise quintessential human faculties. One reason SMTs can do this is because they powerfully affect our emotions. Nevertheless, how social media technology affects our emotional life and how these emotions relate to our digital well-being remain unexplored. Remedying this is important because (...) ethical insights into and open the possibility of designing for social media technologies in ways that actively reinforce our digital well-being. In this article, we examine the way social media technologies facilitate online emotions because of emotional affordances. This has important implications for evaluating the ethical implications of today’s social media platforms, as well as for how we design future ones. (shrink)

People share their emotions on social media and evidence suggests that in times of crisis people are especially motivated to post emotional content. The current Coronavirus pandemic is such a crisis. The online sharing of emotional content during the Coronavirus crisis may contribute to societal value change. Emotion sharing via social media could lead to emotional contagion which in turn could facilitate an emotional climate in a society. In turn, the emotional climate of a society can influence society’s value structure. (...) The emotions that spread in the current Coronavirus crisis are predominantly negative, which could result in a negative emotional climate. Based on the dynamic relations of values to each other and the way that emotions relate to values, a negative emotional climate can contribute to societal value change towards values related to security preservation and threat avoidance. As a consequence, a negative emotional climate and the shift in values could lead to a change in political attitudes that has implications for rights, freedom, privacy and moral progress. Considering the impact of social media in terms of emotional contagion and a longer-lasting value change is an important perspective in thinking about the ethical long-term impact of social media technology. This commentary draws critical attention to the ongoing commodification of trust in policy and scholarly discourses of artificial intelligence (AI) and society. Based on an assessment of publications discussing the implementation of AI in governmental and private services, our findings indicate that this discursive trend towards commodification is driven by the need for a trusting population of service users to harvest data at scale and leads to the discursive construction of trust as an essential good on a par with data (...) as raw material. This discursive commodification is marked by a decreasing emphasis on trust understood as the expected reliability of a trusted agent, and increased emphasis on instrumental and extractive framings of trust as a resource. This tendency, we argue, does an ultimate disservice to developers, users, and systems alike, insofar as it obscures the subtle mechanisms through which trust in AI systems might be built, making it less likely that it will be. To understand how small business entrepreneurs respond to government policy one has to know their risk and time preferences. Are they risk averse, or have high discount rates, such that they are hard to motivate? We have conducted a set of field experiments in Denmark that will allow a direct characterization of small business entrepreneurs in terms of these traits. We build on experimental tasks that are well established in the literature. The results do not suggest that small business entrepreneurs (...) are more or less risk averse than the general population under the assumption of Expected Utility Theory. However, we generally find an S-shaped probability weighting function for both small business entrepreneurs and non-entrepreneurs, with entrepreneurs being more optimistic about the chance of occurrence for the best outcome in lotteries with real monetary outcomes. The results also point to a significant difference in individual discount rates between entrepreneurs and non-entrepreneurs: entrepreneurs are willing to wait longer for certain rewards than the general population. Cases of reference change have sometimes been invoked to challenge traditional versions of semantic externalism, but the relevant cases have never been tested empirically. The experiments we have conducted use variants of the famous Twin Earth scenario to test folk intuitions about whether natural kind terms such as ‘water’ or ‘salt’ switch reference after being constantly (mis)applied to different kinds. Our results indicate that this is (...) indeed so. We argue that this finding is evidence against Saul Kripke’s causal-historical view of reference, and at least provisional evidence in favor of the causal source view of reference as suggested by Gareth Evans and Michael Devitt.
