If we are looking for an Ur-explanation for the persistence of the Ur-myth, or any other myth, in our literature, could we not more directly find it in the structure of a mind which does not have to remember in order to imitate? The occasion of both myth and literature is the social life of the species which, in Starobinski's sense, is a history of continual eviction; but as regards the apparatus of thought by which this social life is reflected (...) in art it is more a history of assimilation and repetition. "The work of the brain," to cite a recent article in Scientific American, "is to create a model of a possible world rather than to record and transmit to the mind a world that is metaphysically true…Different worlds are presumably constructed by similar species."1 And, presumably, similar worlds are constructed by similar species. Weisinger hints briefly at something like this in his essay "The Mythic Origins of the Creative Process," but one has the clear impression, as his title suggests, that he would like to have the [myth/ritual] cart before the creative horse.2 However much this may satisfy our longing to crown our literature, if not creativity itself, with a mythic genealogy, it seems a wistful hypothesis. For over a century, Hegel’s view of war is seen as controversial that results in mutually exclusive interpretations. To reach a proper evaluation of Hegel’s views, it is necessary to consider both Hegel’s initial states of philosophical doctrine about war and peace, and the development of his understanding of war from early works to mature ones. In the first part of the paper, I characterize Kant’s position on war, since it was the starting point for Hegel. Contrary to (...) popular representations about Kant as an exclusive pacifist, the philosopher of Koenigsberg had a philosophical-historical treatment of war, in which the war appeared as something sublime. However, both legal-ethical peace understanding and veto of war from the point of practical reason were not dominant in Kant’s philosophy, subordinating the sublime treatment of war. Kant’s next contemporaries could not already keep this position, emphasizing either one or the other side of war interpretation. Starting from the early writings (the paper “On the Scientific Ways of Treating Natural Law” or manuscripts “System of Ethical Life” and “The German Constitution”), Hegel stresses an ethical aspect of war and its necessity, so that the shield is arranged on the way of systems isolation and individuals atomization, and the unity in its ethical health is saved. Perpetual peace, on the contrary, leads to diseases. The statement about equality of claims and the same truthfulness of warring parties’ rights is the originality of Hegel’s view. It makes absolutely impossible the war evaluation from the point of its justice and injustice. (shrink)

The polis, the dominant political form around which ancient Greeks structured their lives and activities, is perhaps their most fundamental creation and enduring legacy. It was a highly successful form of social organization in which Greek culture thrived, including architecture, literature, and philosophy. In this book, ancient historian John Ma offers a new history of the polis from its origins in the Early Iron Age through its eclipse in Late Antiquity. He aims to answer a few big questions about (...) it-Why did it emerge? What needs did it fulfill? How did it work? In addition, it is often assumed that the polis, along with the concomitant values of democracy and freedom, came to an end with the Classical period. Taking a contrary view, Ma explores how it endured under imperial control (the Persian Achaimenids, the Hellenistic kings, the Roman Empire), as well as why and how it eventually ended. In addressing these questions, Ma examines not only the most well-known ancient city-states like Sparta and Athens but also many lesser-known ones. He shows how complex the relations of power, access, and membership between the city, the territory, and the members of the polis were. Ma also examines the polis's significance as a social form and looks to the people who constitute the polis, from free adult men-stakeholders in institutional power, slaveowners, or heads of households-and elites to women, foreigners, and enslaved peoples, however disempowered. He draws on recent work on gender and slavery to evaluate the place of domination and violence in the polis. In doing so, Ma shows how the composition of the citizen body is both a political and social issue. The powerful combination of central political ideas and conflict around the issues of autonomy and social power led, Ma argues, to a "great convergence" of polis forms, producing a relatively uniform, stable organism, centred on communitarian, democratic forms and bargains between the community and its elites. This convergence led to the diffusion and harmonization of polis forms, both within and beyond the Aegean, and which allowed them to endure for almost a thousand years with an even longer legacy. As the greatupheaval in Kant's thought took place in 1769, and as thisupheaval had as one of itsmain characteristicsthe rejection of (...) sensibility as the sole source of knowledge,2 it is easy to infer that Kant's reading of the NE may have been one of the elements prompting him to adopt his new solution. Based on close readings of texts from the whole of his career, including less well-known and previously unpublished material, it sheds new light on the crucial role of psychoanalysis in shaping Derrida's response to a number of key questions. These questions range from the psyche's relationship to technology to the role of fiction and metaphor in scientific discourse, from the relationship between memory and the archive to (...) the status of the political in deconstruction. Focusing on Freud but proposing new readings of texts by Lacan, Torok and Abraham, Laplanche and Pontalis, amongst other seminal figures in contemporary French thought, the book argues that Derrida's writings on psychoanalysis can also provide an important bridge between deconstruction and the recent materialist turn in the humanities. Challenging a still prevalent 'textualist' reading of Derrida's work, it explores the ongoing contribution of deconstruction and psychoanalysis to pressing issues in critical thought today, from the localizing models of the neurosciences and the omnipresence of digital technology to the politics of affect in an age of terror. In many ways, Benedict (Baruch) de Spinoza appears to be a contradictory figure in the history of philosophy. From the beginning, he has been notorious as an "atheist" who seeks to substitute Nature for a personal deity; yet he was also, in Novalis's famous description, "the God-intoxicated man." He was an uncompromising necessitarian and causal determinist; yet his ethical ideal was to become a "free man." He maintained that the human mind and the human body are identical; yet he also (...) insisted that the human mind can achieve a kind of eternality that transcends the death of the body. He has been adopted by Marxists as a precursor of historical materialism, and by Hegelians as a precursor of absolute idealism. He was a psychological egoist, proclaiming that all individuals necessarily seek their own advantage and implying that other individuals were of value to him only insofar as they were useful to him; yet his writings aimed to promote human community based on love and friendship, he had many devoted friends, and even his critics were obliged to acknowledge that his personal conduct was above reproach. He held that the state has the right to do whatever it has the power to do, while at the same time he defended democracy and freedom of speech. He denied supernatural revelation and criticized popular religion as a grave danger to the peace and stability of the state; yet he devoted himself to the careful interpretation of scripture and argued for toleration and freedom of religion. Rarely employing figures of speech or rhetorical flourishes of any kind, his works are nevertheless among the most magisterial and uplifting of all philosophical writings, and they have inspired more poets and novelists than those of any other philosopher of the early modern period. Abbot Heng Lyu, the monks and nuns, and members of the Dharma Realm Buddhist Association hosted the dialogue at the (...) City of Ten Thousand Buddhas in Talmage, California. The community had transformed their Confucius Hall into a chapel, with a large, newly constructed wooden cross on a wall above an altar facing out from a raised platform, so the Catholic delegation would have a space for worship. A special poster announcing the theme of the conference, "Walking the Bodhisattva Path/Walking the Christ Path," showing a Buddhist dharma wheel at one foot of a bridge and a Celtic cross at the other foot, had been created by the hosting community.The daily schedule for the dialogue did not interfere with the monastic routine at the City of Ten Thousand Buddhas, which included early morning chanting (4:00-5:00 am), daily rituals in the Buddha Hall, and the single large meal for monastics before noon to which all participants were invited. Catholics and Buddhists meeting in the dialogue began each day with an optional forty-five minutes of quiet sitting together in the monastery meditation hall, each following their own form of meditation and prayer. There was a Eucharist on Friday and Saturday evenings for the Catholics and to which the Buddhists were invited, and additional meals of breakfast and supper throughout the meeting at the City's Jyun Kang Restaurant.Fourteen Buddhists and fourteen Catholics participated in the formal discussions. Each participant spoke on what it means to them to follow Christ or the way of the Bodhisattvas or enlightened beings. In addition to speaking, each participant distributed a short passage, usually from a traditional text, on this topic. Several passages from Master Dogen's Shobogenzo and the Gospel of John were among those shared by the group. Other passages shared were taken from the Avatamsaka Sutra and the Shurangama Sutra and from the other gospels and the writings of Zen master HakuinZenji, the Dalai Lama, Korean Zen Master I-sahn Hye-yeon, the teachings of Master [End Page 247] Hsuan Hua, Shantideva, Origen, St. Ignatius, St. Benedict, the author of The Cloud of Unknowing, St. John of the Cross, and Chiara Lubich. A minute of silence separated the fifteen-minute segments for each presentation. With so large a group, most of the time in the formal sessions involved listening to series of presentations; however, during discussion periods the participants asked several challenging questions of one another.Some participants noted the tension they felt between belonging to a particular religious group and the need to let go of any consequential narrowness. The goal of the discussion was to promote understanding of the differences and similarities between Christianity and Buddhism. At one point, the participants noted several concerns about mutual enrichment: whether Buddhist methods can be separated from Buddhism and Christian methods from Christianity, and what specific aspects of Christian practice truly enrich Buddhists and which Buddhist practices likewise enrich Christians. Several times participants discussed their understanding of terms such as transformation, grace, the incarnation and the passion of Jesus, discernment of spirits, prayer, Buddha-nature, and related terms. There was consensus that Buddhists and Catholics can practically help one another regarding mental cultivation and religious precepts. They expressed this consensus in their choice of the topic forthe next dialogue, "Transformation of Hearts and Minds: Chan/Zen-Catholic Approaches to Precepts."The group agreed to reconvene in 2004 to respond to six presentations, three from each side, on different aspects of this topic.Chairing the sessions were Rev. Heng Sure for the Dharma Realm Buddhist Association, Rev. Taigen Dan Leighton for the San Francisco Zen Center, and Bishop John Webster for the United States Conference of Catholic Bishops. Religion and science dialogues that orbit around rational method, knowledge, and truth are often, though not always, contentious. In this article, I suggest a different cluster of gravitational points around which religion and science dialogues might usefully travel: philosophical anthropology, ethics, and love. I propose seeing morality as a natural outgrowth of the human desire to establish and maintain social bonds so as not to experience the condition of being alone. Humans, of all animals, need to feel loved—defined as a (...) compassionate present-with in dynamic dyadic relation such that one experiences the sense of mattering—but that need has an equally natural tendency to be met by creating biased us-and-them distinctions. A “critical” natural ethics, then, is one in which we become aware of and work to undermine our tendency to reify in-group distinctions between “us” and “them.” Religious communities that work intentionally on this can be seen, to some extent, as laboratories of love—or as sites for co-creating knowledge in perilous times. The early writings of Jean-Jacques Rousseau were dismissed by his contemporaries as the paradoxes of a madman. Later critics, weighing the early works against such classics as the Confessions and Emile, were convinced that the views of the young Rousseau could not be reconciled with those of his more famous period. From Presocratic philosophy to more recent reflections on Big Tech and democracy, Cassin's work is rooted in "sophistics," an approach that emphasizes the primacy of language in shaping our interactions with the world. Situating this sophistical approach vis-à-vis classical philology (Bollack) and the (...) philosophical tradition (Heidegger, Derrida), this essay explores the contribution of "sophistical reading" to our understanding of philosophical and literary texts. The early period Ismaili jurist Al-Qādî al-Nu'mān appears as an important figure in the formation of Ismaili jurisprudence. There is very little information about Kadı Nu'mân's family, childhood, education and intellectual environment. His full name is Abû Hanîfah Nu'man b. Muhammad b. Mansûr al-Qādî at-Tamîmî Al Qayrawānî. He was born around 290/903 (late 3rd (9th) century) into an educated family in Qayravan in North Africa. There are different opinions about the sect he belonged to when he was growing up. (...) On the other hand, it is difficult to say for certain whether Nu’mān received education in the Ismaili sect due to the understanding of taqiyya in the madhhab. However, it is understood from the basic jurisprudence texts Nu’mān wrote that he most likely did not receive a Sunni education. Historians refer to him as 'Qadi Nu’mān or Abu Hanifah al-Shi'i' in order not to confuse him with the imam of the Hanafi school. Qādî Nu’mān served at different levels of the Fatimid State. Around 313/925, he entered the service of the first Fatimid caliph, Mahdi (r. 909-934 CE/297-322 AH), as a copyist and secretary. During the reigns of the third caliph Mansur and the fourth Fatimid caliph Mu’izz (d. 365/975), Qādî Nu’mān first served as a judge in Tripoli and then in Mansouriya, the Fatimid capital. After the Fatimids conquered Egypt and the center of government was moved to Cairo, Qādî Nu’mān was appointed by the fourth caliph Mu’izz as the head of the appellate courts (maẓālim). Qadi Numans career was at the peak in the period of Caliph Muiz. Qādî Nu’mān worked as a judge in the Fatimid State for about twenty-six years and continued this duty until his death in 363 (973). After the fall of the Fatimid caliphate, there haven’t been any other Fatimid or Ismaili jurists. Qādî Nu’mān is considered by contemporary Ismaili writers as a figure who systematically transformed Ismaili fiqh into an independent sect of fiqh. It can be said that Ismaili fiqh was developed through his works in the Fatimid period. His works continued as the main references in the fiqh studies and after the Fatimid period. With the death of Qādî Nu’mān, the period of ijtihad in Ismaili fiqh and its the establishment phase of Ismaili fiqh came to an end; The sect, in which esoteric interpretations were at the forefront, emerged as a distinctive school of fiqh by discarding ambiguity. Qādî Nu’mān was a very productive writer. He wrote important works related to the field of furu al-fiqh and usûl al-fiqh. Among his works, Ikhtilāf uṣūl al-madhāhib is undoubtedly one of the most important works in the early history of fiqh methodology. The work in question, which was originally written with the aim of rejecting the Sunni fiqh method, discusses the approaches of the Sunni schools of fiqh on ikhtilāf, taqlid, ijma, nazar, qiyas, istihsan, ijtihad and ra’y in a polemical manner. It reveals the differences of the Ismaili method from the Sunni method in terms of the sources on which the fiqh is based, the authority to make ijtihad and the theory of interpretation of the texts. Qādî Nu’mān examined the relationship between reason and revelation in general and the role of religious authority in comprehending and interpreting the texts while criticizing Sunni methods. Ikhtilāf uṣūl al-madhāhib has the characteristics of the works of development period as a form. It is possible to observe the question-answer and dialectic form which can be seen in the works of the development period throughout the work in question. Qādî Nu’mān endeavoured to persuade his opponents with a dialectical and argumentative style. Again, he replied to the Sunnis, who were his interlocutors, with their own proofs. In addition to these, Ikhtilāf uṣūl al-madhāhib has a unique feature in the matter of content. Because it is not very familiar to any Sunni handbook of usûl al-fiqh. It does not mention the hâss, âmm, ijma, qiyas, amir, nahy, alfaz bets, etc. The text is very similar to the Ahbari movement of the Jafari sect for it rejects all forms of ijtihad. It was written at a time when fiqh was not yet stable. Ikhtilāf uṣūl al-madhāhib gives us crucial information about the development of different usûl and fiqh sources in the middle of the fourth century. However, what is interesting here is that the information he gives about Ismaili method and fiqh is very little compared to the one about Sunni method and fiqh. Much of it centered on Sunni thought and its rejection. However, his ultimate goal was to defend the Ismaili doctrine. (shrink)

The Nikāyas contain several apophatic descriptions of a state of cessation that occurs during the life of an individual. Furthermore, some texts suggest that this cessation paradoxically coincides with liberating insight. This article attempts to draw out philosophical implications of these passages and to reconstruct the ideas serving as their basis. To make better sense of these ideas, the article compares early Buddhist views with certain developments in modern philosophy of mind. It argues that cessation of khandha-s and saḷāyatana-s (...) may be viewed as suspension of various aspects of globally available phenomenal consciousness. It hypothesizes that this suspension is necessary due to the latter's processed character, which precludes direct cognition of reality. It attempts to account for a cognitive nature of cessation by suggesting the possibility of the mind (citta) working independently of phenomenal consciousness. It also considers the issue of cognitive content of cessation and of its expressibility. (shrink)

The Islamic historical narrative indicates a sharp break between the “age of ignorance” and the age of Islam that extends beyond religion and ethics to politics and culture. This article contributes to the scholarly effort to refute that break by examining an aspect of continuity in political thought, the Circle of Justice, a shorthand description of the organization of the state in the Middle East since ancient times. The stereotype sees the Circle as a Persian product; this article shows that (...) the Circle of Justice emerged millennia before the Persians, that the Persians were actually slow to make it their own, that aspects of it were part of Arabic culture before Islam, and that many people other than Persian scribes quoted or used it in the early Islamic centuries. Examining ancient cuneiform royal inscriptions, Pahlavi documents, the poetry addressed to Umayyad and ʿAbbāsid rulers, and early works of history and political thought, the article traces the Circle’s ideas down through the centuries until their encapsulation in the form we know today, the earliest version of which is found in the work of the historian and adab writer Ibn Qutayba. After briefly presenting the first formulation of the equilibrium constant stated by Guldberg and Waage, this study examines the early thermodynamic and kinetic deductions of the equilibrium law. Firstly, it is discussed how Horstmann applied the concept of entropy to chemical equilibrium reactions, which meant the first thermodynamic explanation of the Guldberg-Waage law of mass action proposed in 1864. A different theoretical derivation of the equilibrium constant came from the works of van’t Hoff. This study analyses the first (...) accurate kinetic treatment of equilibrium reactions as well as van’t Hoff’s imaginative thermodynamic foundation of the constant ratios in chemical equilibrium systems. ABSTRACT This paper examines early modern discussions of democracy in the context of a chartered company: namely, the Virginia Company. It examines descriptions of the Company’s constitution and politics as democratic. It focuses, in particular, upon a petition that William Cavendish presented to the Virginia Company assembly defending the democratic constitution of the Company. Cavendish's secretary, Thomas Hobbes, may or may not have assisted with drafting that petition, but he was closely involved in the debates to which it contributed. (...) The discussion, therefore, provides a broader context for debates about the role of democratic ideas in Hobbes’ works. More importantly, however, it shows that sub-state bodies politic in early modern England, such as chartered companies, provided an environment in which political thought, including democracy, could flourish removed from the dangers of national politics. Theo Verbeek provides the first book-length examination of the initial reception of Descartes’s written works. Drawing on his research of primary materials written in Dutch and Latin and found in libraries all over Europe, even including the Soviet Union, Theo Verbeek opens a period of Descartes’s life and of the development of Cartesian philosophy that has been virtually closed since Descartes’s death. Verbeek’s aim is to provide as complete a picture as possible of the discussions that accompanied the introduction (...) of Descartes’s philosophy into Dutch universities, especially those in Utrecht and Leiden, and to analyze some of the major problems that philosophy raised in the eyes of Aristotelian philosophers and orthodox theologians. The period covered extends from 1637, the year in which Descartes published his _Discours de la Méthode, _until his death in 1650. Verbeek demonstrates how Cartesian philosophy moved successfully into the schools and universities of Holland and how this resulted in a real evolution of Descartes’s thought beyond the somewhat dogmatic position of Descartes himself. Verbeek further argues that this progression was an essential step in the universal propagation of Cartesian philosophy throughout Europe during the second half of the seventeenth century. As he details the disputes between Cartesians and anti-Cartesians in Holland, Verbeek shows how the questions raised were related on the one hand to religious conflicts between the Remonstrants and the Orthodox Calvinists and on the other hand to political conflicts between more liberal factions fighting for the union of church and state to enhance religious control of society in general. Contending that Descartes and Cartesian philosophy were central to the development of the modern Dutch state, Verbeek illuminates the role they played in Dutch political, religious, and intellectual life. Moore’s 1897 and 1898 Trinity College dissertations and an informative look at the historical context in which they were written. This story—including information about Moore’s early life, the philosophical influences at Cambridge and a critical commentary on his dissertations and readers’ reports— is clearly and carefully presented in their 78-page introduction.1 The book is a valuable addition to the history of analytic philosophy and will be of special interest to Moore (and Russell) scholars and to historians generally who wish to know more about the genesis of the ideas shaping the new analytic philosophy at the end of the century. Moore entered Trinity in 1892 to study classics. There he met Russell (who was in his third year) and took his advice to study philosophy in his last two years and take his final exams (Tripos, Part ii) in both disciplines, which he did successfully in 1896. And like Russell—who had won a Trinity prize fellowship in 1895 (with a dissertation on the foundations of geometry2 ) only one year after his graduation—he submitted a dissertation (1897) in hopes of winning a prize fellowship. Moore’s first attempt failed, but his 1898 version was successful. And not only did the success of the 1898 dissertation launch Moore’s career as a professional philosopher, it also paved the way for the new analytic philosophy of the next century. Moore’s dissertations and his Trinity examiners’ reports (by Caird, Sidgwick, Ward and Bosanquet3 ) are fascinating reading, and it’s a great convenience to have them handy in a single volume. The five volumes of this set reprint an impressive collection of long unavailable texts by five largely forgotten nineteenth-century American authors, each of whom was familiar with at least some aspects of the philosophical revolution (...) that began in Germany with the appearance of Kant's Critiques and whose own writings were deeply influenced by German Idealism. Largely due to the efforts of these five authors, idealism began to rival empiricism and common-sense realism as a major philosophical movement in the United States by the end of the nineteenth century and was an important part of that intellectual context from which later movements, notably pragmatism, grew. But despite the obvious importance of these authors and texts for understanding both the American "reception" of German Idealism and the history of American philosophy, they are today virtually unknown and most of the volumes reprinted in this set are exceedingly rare. Every student of the history of American thought must therefore be grateful to Thoemmes Press and to James A. Good for making these important works once again available. Each volume is prefaced by an excellent introduction summarizing the essential biographical and historical facts, the relevant intellectual context, and the immediate and lasting influence of the work or author in question. Good's introductions also include insightful, albeit brief, comments on the philosophical contents and distinctive character of each volume. Indeed, one of the pleasures of perusing these volumes is the opportunity this affords to appreciate the originality and philosophical talent of some of these long neglected authors, particularly Marsh, Hickok, and Everett.Volume One reprints what would appear to be the first book on Hegelian "psychology" to be published in America: Psychology; or a View of the Human Soul, by Frederick Augustus Rauch (1841). Rauch (1806-41) was a German emigrant classicist who became enamored with Hegelian philosophy during his student years and was particularly influenced by the Heidelberg theologian Charles Daub. In America, Rauch became head of the Classics Department at Marshall College, where he also taught theology and philosophy. Described as "the first enthusiastic Hegelian in the United States," Rauch's Hegelianism was of the "Old" or "Right" variety. Despite its title, "psychology" is the topic of only the second half of this volume, the first part of which is devoted to "anthropology." These divisions correspond almost exactly to the similarly titled sections of Hegel's "philosophy of subjective spirit," which is the obvious model for Rauch's Psychology. The latter, however, displays none of the dialectical power of Hegel's work and is larded with empirical observations and sundry opinions on a variety of topics. It is perhaps illuminating to discover that American "Hegelianism" can trace its roots to such an eccentric and unrigorous work, which was widely read and even adopted as a textbook by several colleges in the mid-nineteenth century and thus can be described as the book that begin the process of "introducing Hegelianism to America."Volume Two contains The Remains of the Rev. James Marsh, D.D.: Late President and Professor of Moral and Intellectual Philosophy in the University of Vermont; with a Memoir of His Life, edited by Joseph Torrey (1843). Marsh (1794-42), who was reputedly "the first American to study Kant," was a polymath who trained at Dartmouth College and at Andover and Union Seminaries as a classicist, theologian, and philosopher and then served for many years as the President of the University of Vermont. Abstractabstract:While the political aspects of the interwar dystopias have received much attention, less focus has been given to the specific correlation to the economic thinking and developments of the period, in particular the prominence of economic planning. This article suggests that such a connection is significant by examining a key Swedish novel from the period, Kallocain, in relation to the early economic theory of the Scandinavian welfare state. The article then relates these findings to links between Brave New World (...) and the thinking of John Maynard Keynes. Finally, the kinds of critique articulated in these fictional works are centered around the citizens’ emotional and interior lives in new planned societies, and around their views on bad, disloyal, or painful feelings. This article examines the place of gender and gendered identities both in representations of "the state" and the substance of social policy under the early Third Republic in France. In conceiving programs of assistance for abandoned or endangered children at the end of the nineteenth century, representatives of the state drew upon broad representation of the state and its relationship to the populace at large which universalized male identities and suppressed feminine specificity. The use of familial metaphors and the (...) gendering of the valid subject of the future was intrinsic to a process of interpreting collective and individual experience as the foundation for new institutions and new social policies. The case of the Ecole d'Yzeure, a state vocational school founded in 1887 exclusively for the training of female state wards, illustrates the manner in which the French Third Republic was forced to confront the ideological and practical contradictions imposed by its attribution--and suppression--of gendered identities. By the middle of the twentieth century, the Ecole d'Yzeure virtually disappeared from both the institutional infrastructure and the historical memory of Public Assistance in France, the victim of paradox and the state's fear of its own moral culpability; in producing female workers unable to support themselves on their "honest" wages or to resist the material and moral seductions of urban life, authorities came to admit that they had implicated the state itself in the "corruption" of women workers in nineteenth-century France. At a deeper level, the category of the state-produced "woman worker" proved irreconcilable with the larger historical and ideological frame within which Third Republic officials constructed the paradigms and institutions of state assistance to children. Volume 4 of’ “The Early Works” series covers the period of Dewey’s last year and one-half at the University of Michigan and his first half-year at the University of Chicago. In addition to sixteen articles the present volume contains Dewey’s reviews of six books and three articles, verbatim reports of three oral statements made by Dewey, and a full-length book, The Study of Ethics. Like its predecessors in this series, this volume presents a “clear text,” free of interpretive (...) or reference material. Apparatus, including references, corrections, and emendations, is confined to appendix material. Fredson Bowers, the Consulting Textual Editor, has provided an essay on the textual principles and procedures, and Wayne A. R. Leys, Professor of Philosophy at Southern Illinois University, has written an Introduction discussing the relationship between Dewey’s writings of this period and his later work. That Dewey’s scholarship and writing was at an especially high level during 1893 and 1894 may be considered an index to the significance of this two-year period. (shrink)

The work contains a critical comparison of two competing American penitentiary disciplines known as the Auburn and Philadelphia systems, an evaluation of whether American penitentiaries can successfully work in France, a detailed description of Houses of Refuge as the first juvenile detention centers, and an argument against penal (...) colonization. The work provides valuable insights into understanding Tocqueville as a statesman, as well as a comparative look at civic engagement in early American and French penal reform movements. The Translator’s Introduction provides historical context for understanding Tocqueville’s work in French penal reform and the major themes of the report. Jones The Catholic University of America Introduction Between 1980 and 1993, the Japanese Zen scholar Masao Abe resided in the United States, teaching in various places.1 This brought him into contact with (...) many American scholars and theologians, among whom was John Cobb, a Protestant theologian then working in the area of process theology. Many of the ideas that Abe brought from Japanese Buddhism and particularly from the "Kyōtō School" of Japanese philosophy appeared to Cobb intriguingly congruent with his theological work, and the two began a series of dialogues that came to include a larger and larger circle of Christian theologians2 and (mostly Western) Buddhist scholar-practitioners. The end result was a series of informal encounters as well as a series of three formal "International Buddhist-Christian Conferences" (1980, 1984, 1987; a second series of dialogues were held without Abe's attendance starting in 1998 after a hiatus under the name "International Buddhist-Christian Theological Encounter"3 ). From these encounters came an impressive number of publications from Abe and from a variety of other participants in what is sometimes known as the "Abe-Cobb Encounter."The agenda, following Cobb's suggestion and vocabulary, was to allow each side to "cross over" into the other; in other words, to study and internalize the worldview of the other in as much depth as possible without converting or losing one's connection with one's home tradition, abiding in the other side as a guest. Later, one was to "cross back," come home to one's own tradition and reflect on the benefits gained in wearing the other's shoes for a time.4 This agenda, which emphasized understanding the other's worldview and concepts of ultimate reality, suited the highly intellectual style of the dialogues, focused as they were on philosophical and theological concerns. [End Page 117]Nevertheless, even given the concern to study and understand the other's philosophical standpoint, a curious disconnect emerges when one studies the literature produced in this dialogue. During the early phase of these encounters in the 1980s, each side, Buddhist and Christian, appears to have taken one text as normative for the entirety of the other's tradition. For Abe, following his predecessors in the KyōtōSchool, the emblematic textfor Christianity was avery short one: the hymn toChrist recorded by Paul in Philippians 2:6-11. He was particularly drawn to the concept of kenōsis, "emptying," which he thought might serve as a cognate for the Buddhist idea of "emptiness" (Skt: śūnyatā ). While the Christians participating in the dialogueaccepted this as a point of contact, albeit with some reservations, others have objected strenuously to this approach, saying that Abe's method of interpreting this text did not hold to responsible methods of exegesis, and at any rate the passage was much too minute to support an entire theology of God and creation.5The Christian side by and large adopted much the same strategy in coming to grips with Buddhist thought, choosing a brief text as the paradigmatic statement of the Buddhist view of ultimate reality: the Mūlamadhyamaka-kārikā (Root Stanzas on the Middle Way; hereafter the MMK) of the second-century Buddhist thinker Nāgārjuna. In this instance, objections from the Buddhist side were not forthcoming, because Abe himself took the MMK as a normative statement of Buddhist thought. Nevertheless, his own presentation of Buddhism, especially his key notion of "dynamic śūnyatā, " went considerably beyond Nāgārjuna's presentation and thus elicited some objections from the Christian side for not hewing to their own understanding of Nāgārjuna. Excerpt from A Study in the Ethics of the Early Romantic School in Germany It is very probable that any writer or group of writers will be subjected to the pen of the critic, whether they abound in deficiencies or not. But, should the ethics of the individual or group diverge somewhat from the line drawn by society, there is no limit to the untold severity of merciless criticism, no element of defense in the many comments. Still it must (...) be remembered that no one can calculate the depth of a body of water by merely scanning the surface: nor can anyone fully realize the profundity of any situation by viewing it superficially. In other words, it is absolutely necessary that the critic resort to detailed investigation. He must go below the surface to solve the complicated problems which may be presented. Thereby he will acquaint himself with the factors that mould the pattern for the times. Then again, the average human being does or says as he or she sees fit, and can very often furnish justifiable reasons therefor. Everyone reserves for oneself the privileged right of personal opinion and belief. But herein lies a decisive difference. Some people are lovers of the truth, and therefore speak candidly and act openly; others are prone to lose courage and try to hide behind a transparent veil of false modesty. Those, who can be included within this latter category, are only reticent and untrue to themselves, simply because they are in the majority. If the proportion be reversed, they would be more than glad to feel the relief from the pressure removed. But those poor unfortunates, who are forced by their nature and spurred on by their immediate environment to be outspoken, become down-trodden social outcasts. If we ask ourselves why this is so, the answer is: primarily because they are in the minority, as all persecuted classes are. No credit or encouragement is given them for their originality. This first volume of The Collected Works of Rudolf Carnap includes Carnap’s published writings from 1921 when he submitted his dissertation Der Raum (Space) in Jena to Bruno Bauch to 1926 the year he completed his habilitation in Vienna under Moritz Schlick. Originally published in 1995, The Antievolution Works of Arthur I. Brown is the third volume in the series, Creationism in Twentieth Century America. The volume brings together original sources from the prominent surgeon and creationist Arthur I. Brown. Brown discredited evolution as it was contrary to the 'clear statements of scripture' which he believed infallible, stating evolution instead to be both a hoax and 'a weapon of Satan'. The works included focus on Brown's polemic through his early (...) twentieth century writings. The essays focus on his scientific investigations and provide a negative commentary upon Darwin's theory of evolution instead focusing on biblical explanations for evolution. As a scientist Brown's unique view of evolution from a creationist and scientific viewpoint provides a fascinating lens through which to view the historical debates surrounding evolution and provides a unique insight into how Darwinian theory affected both the scientific and religious communities. The writings collected in this volume make an important addition to The Collected Works of Jeremy Bentham. They lend credence to Bentham's claim that his ideas were appropriate `for the use of all nations and all governments professing liberal opinions'. The essays, dating mainly from late 1822 and early 1823, are based exclusively on manuscripts, many of which have not been previously published. -/- Turning his attention towards the Mediterranean basin, Bentham here attempts to legislate for one Islamic (...) state, and offers advice to another in the process of throwing off Islamic rule. The Writings for Tripoli include the famous `Securities against Misrule', in which Bentham draws up a constitutional charter with an accompanying explanation of its provisions. He also discusses the social, political, and religious institutions of the country, and proposes a scheme for the introduction of constitutional reform both there and in the other Barbary states. The Writings for Greece include a rare commentary on the first Greek constitution of 1822, and advice and warnings to the Greek legislators against the temptation of `sinister appetites'. The main theme in both groups of writings is the efficacy of representative institutions and the publicity of official actions in preventing the abuse of government power. (shrink)

Bentham's central concern during the 1810s and 1820s was with the codification of the law. Rejecting both the common law and the historical approach to codification, he argued that a code of law should be based on a rigorous logical analysis of the categories of human action, and that each enactment should be followed by the reasons which justified it. Such an `all-comprehensive' code containing an `interwoven rationale' would signal a new era in legislation. Once one state had adopted such (...) a code, other states would be obliged to follow its example, and Bentham would become in effect 'legislator of the world'. Bentham attempted to persuade legislative authorities in the United States of America, Russia, Spain, Portugal, Greece, South and Central America, and elsewhere, to invite him to draft a code of law for them. The works presented in this volume record in fascinating detail Bentham's dealings with such eminent figures as James Madison, John Quincy Adams, Emperor Alexander I, Prince Adam Czartoryski, Alexander Mavrokordatos, Bernadino Rivadavia, and José del Valle. The production of a methodology for codification ranks as one of Bentham's outstanding theoretical achievements. Through the materials presented in this volume he emerges as a seminal figure in the development of liberalism throughout Europe and America in the early nineteenth century. (shrink)

ABSTRACT This paper offers an account of the early career of Martha Kneale, née Hurst, and of the five papers she published between 1934 and 1950. One on metaphysical and logical necessity, from 1938, is particularly interesting. In it she considers the metaphysics of time and offers an explanation of ‘the necessity of the past’, which has some resemblance to Kripke’s ideas about metaphysical necessities, in that it assigns an important role to experience in how we come to know (...) them. But Kneale’s view is very different from Kripke’s, depending not on doctrines about rigid designation but rather on recognition of the failure of the atomist/empiricist account of ‘simple’ and ‘complex’ concepts. That account cannot deal with such things as the relations of the determinates of a determinable like colour. A plausible corollary of this, which Kneale exploits, is that some of our experience reveals to us that there are phenomena which are intrinsically complex in having multiple distinguishable aspects, but where those aspects are inseparable. Other of the papers show Kneale to have been pursuing interesting lines of thought about McTaggart’s argument against the reality of time and on the mind-body problem. (shrink)

Let me offer an early disclaimer. I know exactly who the Founders were. I know exactly the crimes against humanity that they were responsible for and those they inherited and were not responsible for. I do not spend time extolling the virtues of Mr. Jefferson, Mr. Adams, Mr. Franklin, and Mr. Madison. Nothing in this work or in my experiment (my life's work) can change the fact or alter the history of the debasement of humanity that preceded the Declaration (...) of Independence (1776), the Constitution (1787), and the Bill of Rights (1791) they were a part of and the obvious fact that the major accomplishment of the Founders' theories about self-government did not apply to African Americans and Native Americans, women, and specifically Black women in their thinking. Still, there exists in their theological imagination infinite hope for their experiment. This work seeks to identify the evidence that shows and suggests that some of them were aware of a grand architectural experiment and design for the nation and its future. Every cracked, broken, and imperfect vessel can be used to bring forward hope. I am a personal witness to this fact of human existence. (shrink)

Morris's death in 1889 left vacant the Department of Philosophy chairmanship and led to Dewey's returning to fill that post after a year's stay at Minnesota. Appearing here, among all his writings from 1889 through 1892, are Dewey's earliest comprehensive statements on logic and his first book on ethics. (...) Dewey's marked copy of the galley-proof for his important article The Present Position of Logical Theory, recently discovered among the papers of the Open Court Publishing Company, is used as the basis for the text, making available for the first time his final changes and corrections. The textual studies that make The Early Works unique among American philosophical editions are reported in detail. One of these, A Note on Applied Psychology, documents the fact that Dewey did not co-author this book frequently attributed to him. Six brief unsigned articles written in 1891 for a University of Michigan student publication, the Inlander, have been identified as Dewey's and are also included in this volume. In both style and content, these articles reflect Dewey's conviction that philosophy should be used as a means of illuminating the contemporary scene; thus they add a new dimension to present knowledge of his early writing. Volume 1 of The Early Works of John Dewey, 1882-1898 is entitled Early Essays and Leibniz's New Essays Concerning the Human Understanding, 1882-1888. Included here are all Dewey's earliest writings, from his first published article through his book on Leibniz. The materials in this volume provide a chronological record of Dewey's early development--beginning with the article he sent to the Journal of Speculative Philosophy in 1881 while he was a high-school teacher in Oil City, Pennsylvania, and (...) closing with his widely-acclaimed work on Leibniz in the Grigg's Series of German Philosophical Classics, written when he was an Assistant Professor at the University of Michigan. During these years be-tween 1882 and 1888, Dewey's life course was established: he decided to follow a career in philosophy, completed doctoral studies at Johns Hopkins University, became an Instructor at the University of Michigan, was promoted to Assistant Professor, and accepted a position as Chairman of the Department of Philosophy at the University of Minnesota. With the publication of Psychology, he became well known among scholars in this country; a series of articles in the British journal Mind brought him prominence in British philosophical circles. His articles were abstracted in the Revue philosophique. None of the articles collected in this volume was reprinted during the author's lifetime. For the first time, it is now possible for Dewey scholars to study consecutively in one publication all the essays which originally appeared in many periodicals. (shrink)

This paper has two purposes: to provide a contextualised account of the Young Hegelian theory of the state, and to argue that Marx began working on the manuscript known as his ‘Critique of Hegel’s Philosophy of Law’, not in the Summer of 1843, as most commentators assume, but at least as early as the Spring of 1842. The established narrative describes the Young Hegelians as ‘liberals’, and suggests that Marx ‘Critique of Hegel’s Philosophy of Law’ represents his rejection of (...) their liberalism and turn towards a more radical democratic and revolutionary position. Conversely, I argue that the Young Hegelians (notably Arnold Ruge and Bruno Bauer) were never liberal (at least not by any standard definition of that term) but articulated a radical and revolutionary theory of the state from the outset – one that understood freedom, not as independence, but as political participation, and that characterised the modern state, not as the guarantor of private rights, but as the institutional framework in which all citizens could realise their public freedom. In this sense, Marx’s ‘Critique of Hegel’s Philosophy Law’ does not represent a break with the Young Hegelians theory of state, but a contribution to it. (shrink)
