In this paper, I argue that there is a picture of how law works that most legal theorists are implicitly committed to and take to be common ground. This Standard Picture (SP, for short) is generally unacknowledged and unargued for. SP leads to a characteristic set of concerns and problems and yields a distinctive way of thinking about how law is supposed to operate. I suggest that the issue of whether SP is correct is a fundamental one for the philosophy (...) of law, more basic, for example, than the issue that divides legal positivists and anti-positivists, at least as the latter issue is ordinarily understood. The goals of the paper are fourfold: 1) to identify and articulate in some detail the Standard Picture; 2) to show that SP is widely held and has important consequences for other debates in the philosophy of law; 3) to show that SP leads to a serious theoretical problem; 4) to sketch an alternative picture that promises to avoid this problem. I emphasize the modesty of these goals in one respect. I make no claim to refute SP or to fully develop and defend an alternative picture. (shrink)

It is argued that standard music notation pictures Aristotle’s time (time, as Aristotle conceived of it) in a number of important respects, which concern its micro-structure. It is then argued that this allows us to see some features of Aristotle’s time more clearly. Most importantly, Aristotelian instants can be pictured by bar-lines. This allows us to see as how radically devoid of any content Aristotelian instants should be interpreted. Thus, attention to music notation may show why Aristotle was not a (...) presentist. The Standards' ecumenical implications are critically assessed in view of the risks which their cross-denominational or cross-faith cooperation implications on the one hand, and, on the other hand, their secular commitments to mutual learning, non-proselytizing, professionalism, and efficiency assessment might carry for chaplains' properly spiritual orientation. The problem posed by the ambiguity of language is raised as a warning that concepts like human dignity have a profoundly different meaning in secular and Christian contexts. This thesis provides an introduction to the physics of the Standard Model and beyond, and to the methods used to analyse Large Hadron Collider (LHC) data. The 'hierarchy problem', astrophysical data and experiments on neutrinos indicate that new physics can be expected at the now accessible TeV scale. This work investigates extensions of the Standard Model with gravitons and gravitinos (in the context of supergravity). The production of these particles in association with jets is studied as one of the most (...) promising avenues for researching new physics at the LHC. It is a search for standards that would, as it were, show the way to philosophical wisdom for anyone who is willing and able to assess it. Considered by many to be Abraham Robinson's magnum opus, this book offers an explanation of the development and applications of non-standard analysis by the mathematician who founded the subject. Non-standard analysis grew out of Robinson's attempt to resolve the contradictions posed by infinitesimals within calculus. He introduced this new subject in a seminar at Princeton in 1960, and it remains as controversial today as it was then. This paperback reprint of the 1974 revised edition is indispensable reading for anyone interested (...) in non-standard analysis. It treats in rich detail many areas of application, including topology, functions of a real variable, functions of a complex variable, and normed linear spaces, together with problems of boundary layer flow of viscous fluids and rederivations of Saint-Venant's hypothesis concerning the distribution of stresses in an elastic body. This thesis studies collider phenomenology of physics beyond the Standard Model at the Large Hadron Collider (LHC). It also explores in detail advanced topics related to Higgs boson and supersymmetry - one of the most exciting and well-motivated streams in particle physics. In particular, it finds a very large enhancement of multiple Higgs boson production in vector-boson scattering when Higgs couplings to gauge bosons differ from those predicted by the Standard Model. The thesis demonstrates that due to the loss of (...) unitarity, the very large enhancement for triple Higgs boson production takes place. This is a truly novel finding. The thesis also studies the effects of supersymmetric partners of top and bottom quarks on the Higgs production and decay at the LHC, pointing for the first time to non-universal alterations for two main production processes of the Higgs boson at the LHC-vector boson fusion and gluon-gluon fusion. Continuing the exploration of Higgs boson and supersymmetry at the LHC, the thesis extends existing experimental analysis and shows that for a single decay channel the mass of the top quark superpartner below 175 GeV can be completely excluded, which in turn excludes electroweak baryogenesis in the Minimal Supersymmetric Model. This is a major new finding for the HEP community. This thesis is very clearly written and the introduction and conclusions are accessible to a wide spectrum of readers. (shrink)

This paper assesses the epistemic challenges of giving nutrition advice to elite athletes in light of recent philosophical discussion concerning evidence-based practice. Our trust in experts largely depends on the assumption that their advice is based on reliable evidence. In many fields, the evaluation of the reliability of evidence is made on the basis of standards that originate from evidence-based medicine. I show that at the Olympic or professional level, implementing nutritional plans in real-world competitions requires contextualization of knowledge (...) in a way that contravenes the tenets of evidence-based thinking. Nutrition experts need to be able to combine and apply evidence from multiple sources, including the previous successes and failures of particular athletes. I argue that in this sense, the practice of elite sport nutrition embodies casuistic reasoning. (shrink)

I argue that Greco’s handling of barn-façade cases is unsatisfactory as it is at odds with his treatment of standard Gettier cases. I contend that this is so as there is no salient feature of either type of case such that that feature provides a ground to grant, as Greco argues, that there is an exercising of ability in one type of case, standard Gettier cases, but not in the other, barn-façade cases. The result, I argue, is that either Greco (...) must revise his grounds for treating barn-façade cases as he does or he must revise his treatment of standard Gettier cases. (shrink)

The problem of standard of care in clinical research concerns the level of treatment that investigators must provide to subjects in clinical trials. Commentators often formulate answers to this problem by appealing to two distinct types of obligations: professional obligations and natural duties. In this article, I investigate whether investigators also possess institutional obligations that are directly relevant to the problem of standard of care, that is, those obligations a person has because she occupies a particular institutional role. I examine (...) two types of institutional contexts: (1) public research agencies – agencies or departments of states that fund or conduct clinical research in the public interest; and (2) private-for-profit corporations. I argue that investigators who are employed or have their research sponsored by the former have a distinctive institutional obligation to conduct their research in a way that is consistent with the state's duty of distributive justice to provide its citizens with access to basic health care, and its duty to aid citizens of lower income countries. By contrast, I argue that investigators who are employed or have their research sponsored by private-for-profit corporations do not possess this obligation nor any other institutional obligation that is directly relevant to the ethics of RCTs. My account of the institutional obligations of investigators aims to contribute to the development of a reasonable, distributive justice-based account of standard of care. (shrink)

The standards of energy and environmental design are improving day by day, are flexible enough, and in continuous change. The designers are the first ones which introduce the inputs into the system in order to improve it. The overall city should be planned as a socio-natural hybrid system. The LEED program has been developed in the US since 1998. It has been adopted in almost 40 countries and it is widely used by public. The LEED standards are based (...) on reducing overall impact rather than on a specific issue or topic, trying to be green as much as possible. The reliance to outside sources (programs and standards) is also important in order to enlarge the expertise area and the variety of subjects. The green city should be well planned and well documented since the early stage of design, reducing the costs and synchronizing the work of different systems that operates within the building. The LEED standards involve the environmental, economic, and social impact, regardless at this point the standards are socially neutral. The city planned according to LEED standards is a socio-neutral hybrid one. On the other hand, BREEAM is established since 1990 in the UK and certifies the sustainability of buildings. For each environmental certification, there exist differences between various criteria related to building energy efficiency. The evaluation of the performance improvement over specified baseline requirements is the common point of the two building standards. The sustainable assessments such as BREEAM or LEED can be applied or adopted in any region of the world. The Albanian case does not adopt any of them. Based on EPC (energy performance certificate), the building is considered to be in compliance with the minimum performance requirements of energy, aiming to achieve optimal levels of energy consumption for a typical use of the building. The building is considered as zero energy building when the ratio of the total energy consumption of the current building per sqm of the surface is equal or be less than 50% and the ratio of renewable energy produced in the building during a year compared to the consumption of total energy of the current building for one sqm of the surface. In the last three decades, considerable theoretical and empirical research has been undertaken on the topic of moral distress among health professionals. Understood as a psychological and emotional response to the experience of moral wrongdoing, there is evidence to suggest that—if unaddressed—it contributes to staff demoralization, desensitization and burnout and, ultimately, to lower standards of patient safety and quality of care. However, more recently, the concept of moral distress has been subjected to important criticisms. Specifically, some authors argue that (...) the standard account of moral distress elucidated by Jameton :542–551, 1984) does not refer to a discrete phenomenon and/or that it is not sufficiently broad and that this makes measuring its prevalence among health professionals, and other groups of workers, difficult if not impossible. In this paper, we defend the standard account of moral distress. We understand it as a concept that draws attention to the social, political and contextual determinants of moral agency and brings the emotional landscape of the moral realm to the fore. Given the increasing pressure on health professionals worldwide to meet efficiency, financial and corporate targets and reported adverse effects of these for the quality and safety of patient care, we believe that further empirical research that deploys the standard account moral distress is timely and important. The aim of this paper is to show that it’s not a good idea to have a theory of truth that is consistent but ω-inconsistent. In order to bring out this point, it is useful to consider a particular case: Yablo’s Paradox. In theories of truth without standard models, the introduction of the truth-predicate to a first order theory does not maintain the standard ontology. Firstly, I exhibit some conceptual problems that follow from so introducing it. Secondly, I show that (...) in second order theories with standard semantics the same procedure yields a theory that doesn’t have models. So, while having an ω- inconsistent theory is a bad thing, having an unsatisfiable theory of truth is actually worse. This casts doubts on whether the predicate in question is, after all, a truthpredicate for that language. Finally, I present some alternatives to prove an inconsistency adding plausible principles to certain theories of truth. (shrink)

There is a growing body of global research demonstrating the significance of mental health to individuals’ overall happiness and productivity. The research evidence has encouraged governmental agencies in the United Arab Emirates (UAE) to divert more attention toward the provision and development of mental health services. As the sector grows, one of the first issues of concern is the adherence to a unified set of ethics of practice. The purpose of this paper is to present and discuss the existing ethical (...) codes of conduct relevant to the mental health profession in the unique context of the UAE. Specifically, this discussion will focus on the interaction of cultural factors with the ethical standards of confidentiality, informed consent, and multiple relationships. It has been argued that an epistemically rational agent’s evidence is subjectively mediated through some rational epistemic standards, and that there are incompatible but equally rational epistemic standards available to agents. This supports Permissiveness, the view according to which one or multiple fully rational agents are permitted to take distinct incompatible doxastic attitudes towards P (relative to a body of evidence). In this paper, I argue that the above claims entail the existence of a unique and more reliable (...) epistemic standard. My strategy relies on Condorcet’s Jury Theorem. This gives rise to an important problem for those who argue that epistemic standards are permissive, since the reliability criterion is incompatible with such a type of Permissiveness. (shrink)

As a consequence of the changing conditions of doing business, we can observe the emergence of an increasing number of industrial and company-specific codes of conduct, as well as social and environmental standards. This paper considers these initiatives as being self-regulating governance mechanisms, which are characterized by a process of voluntary adherence on the part of firms to certain mechanisms or principles that seek to promote a “good society.” Two specific internationally established standards are discussed: Social Accountability 8000 (...) and AccountAbility 1000. These institutionalized approaches are described and then contrasted in relation to a number of different factors, particularly the degree to which they foster “reflexivity,” in terms of how businesses think about these issues, and “dialog,” in terms of how businesses interact with stakeholders. Such questions are relevant to the ways in which these standards might be introduced and implemented, and which of these institutionalized approaches are the most promising for international businesses in developing countries. Biomedical research funding bodies across Europe and North America increasingly encourage—and, in some cases, require—investigators to involve members of the public in funded research. Yet there remains a striking lack of clarity about what ‘good’ or ‘successful’ public involvement looks like. In an effort to provide guidance to investigators and research organisations, representatives of several key research funding bodies in the UK recently came together to develop the National Standards for Public Involvement in Research. The Standards have critical (...) implications for the future of biomedical research in the UK and in other countries as researchers and funders abroad look to the Standards as a model for their own policy development. We assess the Standards and find that despite offering useful suggestions for dealing with practical challenges associated with public involvement, the Standards fail to address fundamental questions about when, why and with whom public involvement should be undertaken in the first place. We show that presented without this justificatory context, many of the recommendations in the Standards are, at best, fragments that require substantial elaboration by those looking to apply the Standards in their own work and, at worst, subject to potentially harmful misapplication by well-meaning investigators. As funding bodies increasingly push for public involvement in research, the key lesson of our analysis is that future recommendations about how public involvement should be conducted cannot be coherently formulated without a clear sense of the underlying goals and rationales for public involvement. This paper develops Richard Wollheim’s claim that the proper appreciation of a picture involves not only enjoying a seeing-in experience but also abiding by a standard of correctness. While scholars have so far focused on what fixes the standard, thereby discussing the alternative between intentions and causal mechanisms, the paper focuses on what the standard does, that is, establishing which kinds, individuals, features and standpoints are relevant to the understanding of pictures. It is argued that, while standards concerning kinds, (...) individuals and features can be relevant also to ordinary perception, standards concerning standpoints are specific to pictorial experience. Drawing on all this, the paper proposes an ontology of depiction according to which a picture is constituted by both its visual appearance and its standard of correctness. (shrink)

The concept of minimal risk has been used to regulate and limit participation by adolescents in clinical trials. It can be understood as setting an absolute standard of what risks are considered minimal or it can be interpreted as relative to the actual risks faced by members of the host community for the trial. While commentators have almost universally opposed a relative interpretation of the environmental risks faced by potential adolescent trial participants, we argue that the ethical concerns against the (...) relative standard may not be as convincing as these commentators believe. Our aim is to present the case for a relative standard of environmental risk in order to open a debate on this subject. We conclude by discussing how a relative standard of environmental risk could be defended in the specific case of an HIV vaccine trial among adolescents in South Africa. (shrink)

In discussions of standards of proof, a familiar perspective often emerges. According to what we call specificationism, standards of proof are legal rules that specify the quantum of evidence required to determine that a litigant’s claim has been proven. In so doing, they allocate the risk of error among litigants (and potential litigants), minimizing the risk of certain types of error. Specificationism is meant as a description of the way the rules actually function. We argue, however, that its (...) claims are either mistaken or at a minimum deeply misleading, especially when it comes to standard of proof rules (SPRs) that contain indeterminate formulas, as is typical. As against specificationism, we argue that SPRs are best understood as rules that confer competence to decide whether a given standard has been met—according to whatever vague or inchoate interpretation (if any) of the rule in question triers of fact implicitly or explicitly employ. The purpose of this paper is to investigate the Korean public relations practitioners'' perceptions toward ethical issues, individual practices, and ethical standards in the context of ethical ideology. The survey was conducted with the Korean public relations practitioners. A 2 (Relativism: High/Low) × 2 (Idealism: High/Low) factorial design was devised for the analysis.The MANOVA results showed that ethical ideology (idealism and relativism) had significant effects on ethical decision-making. Idealistic ideology had a main effect on ethical issues, individual practices, and (...) ethical standards. However, relativistic ideology only affected the decision-making process related to ethical issues. No interaction effects were detected. This study indicated that the individual''s ethical ideology could be an important variable in explaining the outcomes of the individual''s ethical decision-making among Korean public relations practitioners. This paper responds to the commentaries from Stacy Carter and Alan Cribb. We pick up on two main themes in our response. First, we reflect on how the process of setting standards for empirical bioethics research entails drawing boundaries around what research counts as empirical bioethics research, and we discuss whether the standards agreed in the consensus process draw these boundaries correctly. Second, we expand on the discussion in the original paper of the role and significance of the (...) concept of ‘integrating’ empirical methods and ethical argument as a standard for research practice within empirical bioethics. The existence of non-standard numbers in first-order arithmetics is a semantic obstacle for modelling our arithmetical skills. This article argues that so far there is no adequate approach to overcome such a semantic obstacle, because we can also find out, and deal with, non-standard elements in Turing machines.

The role of private food standards in agriculture is increasingly raising questions of legitimacy, particularly in light of the impacts such standards may have on food producers. While much work has been carried out at a macro policy level for developing countries, there have been relatively few empirical case studies that focus on particular food supply chains, and even fewer studies still of the impact of private standards on developed countries such as Australia. This study seeks to (...) address this imbalance, with a particular focus on examining the impact of private standards on an Australian vegetable supply food system in North Tasmania as well as tracing the impact of perceived and actual power relations among actors. Applying a governance framework and adopting a Foucauldian position we show that private standards are a “technology of power” that have risen out of a crisis discourse in the mid-1990s about on-farm food safety. Private standards have the effect of using knowledge from particular actors to establish truths about good agricultural practice (GAP), however we show that Tasmanian vegetable growers are not docile bodies and are employing alternative knowledge and technologies of power to challenge how GAP is implemented on-farm. This research is motivated by the program of reverse mathematics and non-standard arguments in second-order arithmetic. Within a weak subsystem of second-order arithmetic ACA0, we investigate some aspects of non-standard analysis related to sequential compactness. We present a model of the distribution of labour in science. Such models tend to rely on the mechanism of the invisible hand . Our analysis starts from the necessity of standards in distributed processes and the possibility of multiple standards in science. Invisible hand models turn out to have only limited scope because they are restricted to describing the atypical single-standard case. Our model is a generalisation of these models to J standards; single-standard models such as (...) Kitcher are a limiting case. We introduce and formalise this model, demonstrate its dynamics and conclude that the conclusions commonly derived from invisible hand models about the distribution of labour in science are not robust against changes in the number of standards. I review some theoretical ideas in cosmology different from the standard “Big Bang”: the quasi-steady state model, the plasma cosmology model, non-cosmological redshifts, alternatives to non-baryonic dark matter and/or dark energy, and others. Cosmologists do not usually work within the framework of alternative cosmologies because they feel that these are not at present as competitive as the standard model. Certainly, they are not so developed, and they are not so developed because cosmologists do not work on them. It is a (...) vicious circle. The fact that most cosmologists do not pay them any attention and only dedicate their research time to the standard model is to a great extent due to a sociological phenomenon . We might well wonder whether cosmology, our knowledge of the Universe as a whole, is a science like other fields of physics or a predominant ideology. (shrink)

Although ethical decision‐making theory has evolved over the years, within the field of management, research still revolves around James Rest’s (1986) four‐step framework, dominated by a positivist epistemology and a quantitative methodology. Given that currently there is a call for a theoretical, epistemological, and methodological renovation for the enlargement and enrichment of knowledge about how decisions are morally made in organizations, this paper has a double aim. First, by showing the models’ main flaws and limitations, it critically assesses the prominent (...) theoretical models of Rest, Trevino, and Jones. Then, for decision making in organizations, the paper aims to posit a fresh moral theory that addresses the phenomenon from a comprehensive epistemological perspective. To do so, it steps back from those prominent models in order to review John Dewey’s “theory of moral life.” At the core of the proposed comprehensive theoretical framework are Dewey’s concepts of a “moral standard” and “valuation.” Finally, the paper shows how the Dewey‐based framework can both overcome the flaws and limitations that are identified in those prominent models and can enrich empirical research, therefore contributing to developing as a whole the ethical decision‐making field. In an important and widely cited paper, Zerilli, Knott, Maclaurin, and Gavaghan (2019) argue that opaque AI decision makers are at least as transparent as human decision makers and therefore the concern that opaque AI is not sufficiently transparent is mistaken. I argue that the concern about opaque AI should not be understood as the concern that such AI fails to be transparent in a way that humans are transparent. Rather, the concern is that the way in which opaque AI (...) is opaque is very different than the way in which humans are opaque. What matters is the degree to which the opaque processes of a class of decision makers are stable, uniform, and safe. The degree to which such processes have these features in humans is higher than the degree to which such processes have these features in opaque AI. And therefore we should require AI to be more transparent than humans. (shrink)

This study delves into the significant ethical criteria in the context of global standards. It addresses the moral wrongdoings and adverse side effects associated with global value chains as discussed in the business ethics literature. The methodology involves theoretical application and synthesis. The study employs ethical principles from deontology, consequentialism, and political cosmopolitanism to establish normative criteria such as “injustice and harm to others” and “bad outcomes.” It further investigates how these criteria should influence consumers' decisions, actions, and responsibilities. (...) These criteria are then used to examine the moral wrongdoings and negative effects mentioned in global standards. The study explores how global standards implicitly express consumers' roles in governing global value chains. It scrutinizes consumers' actions and decisions by applying ethical frameworks to global standards. The study outlines consumers' individual and political responsibilities in achieving the goals of global standards. The research findings have implications for governments, consumers, and organizations in practicing shared responsibility. What has sometimes been called the "standard" argument for fatalism never achieved the critical popularity of Richard Taylor's (1962) infamous argument. But it has enjoyed far greater longevity. In De Fato Cicero (1960) tells us it was known in ancient Greece as the "idle argument", for it purports to show the futility of attempting to control one's fate and, hence, those persuaded by it could be led to a life of inaction and idleness. Even with such antiquated credentials, however, the (...) argument continues to exercise fine contemporary minds (e.g. Schlesinger 1993). (shrink)

Non-standard models were introduced by Skolem, first for set theory, then for Peano arithmetic. In the former, Skolem found support for an anti-realist view of absolutely uncountable sets. But in the latter he saw evidence for the impossibility of capturing the intended interpretation by purely deductive methods. In the history of mathematics the concept of a nonstandard model is new. An analysis of some major innovations–the discovery of irrationals, the use of negative and complex numbers, the modern concept of function, (...) and non-Euclidean geometry–reveals them as essentially different from the introduction of non-standard models. Yet, non-Euclidean geometry, which is discussed at some length, is relevant to the present concern; for it raises the issue of intended interpretation. The standard model of natural numbers is the best candidate for an intended interpretation that cannot be captured by a deductive system. Next, I suggest, is the concept of a wellordered set, and then, perhaps, the concept of a constructible set. One may have doubts about a realistic conception of the standard natural numbers, but such doubts cannot gain support from non-standard models. Attempts to utilize non-standard models for an anti-realist position in mathematics, which appeal to meaning-as-use, or to arguments of the kind proposed by Putnam, fail through irrelevance, or lead to incoherence. Robinson’s skepticism, on the other hand, is a coherent position, though one that gives up on providing a detailed philosophical account. In “All Play and No Work,” Andrew Kania claims that standard form jazz involves no works, only performances. This article responds to Kania by defending one of the alternative ontological proposals that he rejects, namely, that jazz works are ontologically continuous with works of classical music. I call this alternative “the standard view,” and I argue that it is the default position in the ontology of standard form jazz. Kania has three objections to the standard view. MacCann, Matthews, and Roberts (2012) and Mayer, Salovey, and Caruso (2012) have offered responses to my evaluation of the validity of the Mayer-Salovey-Caruso Emotional Intelligence Test (MSCEIT) as a measure of emotional intelligence. MacCann et al. argue that my standards for validity evidence are unrealistically high, but their argument mistakenly supposes that the concept of measurement is somehow relative, rather than absolute. Mayer et al. offer valuable clarifications regarding their emotional intelligence (EI) model, and some new evidence of its (...) correlates. However, the new evidence is not persuasive, and I think that they have largely missed the point of my call for a stronger focus on causal explanations of test performance. (shrink)

The World Medical Association’s revised Declaration of Helsinki endorses the view that all trial participants in every country are entitled to the worldwide best standard of care. In this paper the authors show that this requirement has been rejected by every national and international committee that has examined this issue. They argue that the consensus view now holds that it is ethically permissible, in some circumstances, to provide research participants less than the worldwide best care. The aim of the research is to identify the relationship between the performance criteria and the achievement of the objectives of supervision which is represented in the performance of the job at the Islamic University in Gaza Strip. To achieve the objectives of the research, the researchers used the descriptive analytical approach to collect information. The questionnaire consisted of (22) paragraphs distributed to three categories of employees of the Islamic University (senior management, faculty members, their assistants and members of the (...) administrative board). A random sample of 314 employees was selected, 276 responses were retrieved with a return rate of 88.1%. The SPSS program was used to enter, process, and analyze the data. The results of the study showed a positive relationship between the performance criteria and the achievement of the control objectives represented by the job performance in the Islamic University from the point of view of the members (senior management, faculty and their assistants and the administrative board). The researchers also recommended a number of recommendations, including the provision of an appropriate level of control system components today through the continuous updating and development of performance standards and the need to provide the necessary physical and financial resources to continue the development and achievement within the university. Expand the development of technology in the various activities of the university through the construction of a complete and integrated system to support the control systems in the university to suit its size. The researchers also recommended the follow-up, review of the performance standards and work to modify them in line with the mission of the university and the goals that the university seeks to reach.
