Since the introduction of ultrasound technology in the 1960s as a tool to visibly articulate the interiors of the pregnant body, feminist scholars across disciplines have provided extensive critique regarding the visual culture of fetal imagery. Central to this discourse is the position that fetal images occupy- as products of a visualizing technology that at once penetrates and severs pregnant and fetal bodies. This visual excision, feminist scholars describe, has led not only to an erasure of the female body from (...) fetal images but also to an erasure of the pregnant body in social, political, and biomedical discourses. Vital to feminist scholarship is, thereby, an engagement with fetal images in ways that reinscribe the pregnant body onto fetal images and into political discourses pertaining to reproductive rights. In this paper, similar to the feminist aim, I am interested in engaging with fetal images as way to gain agency for pregnant women and their bodies. The critical question that I ask is: Can we conceive of medical technology in an embodied way -one that interacts organically, dynamically, and through multisensory dimensions with pregnant bodies? In attempting to answer this question, I turn to Bruno Latour and Gilles Deleuze’s articulations of how bodies and machines interact to produce visual fact. (shrink)

The COVID-19 outbreak has ravaged all societal domains, including education. Home confinement, school closures, and distance learning impacted students, teachers, and parents’ lives worldwide. In this study, we aimed to examine the impact of COVID-19-related restrictions on Italian and Portuguese students’ academic motivation as well as investigate the possible buffering role of extracurricular activities. Following a retrospective pretest–posttest design, 567 parents reported on their children’s academic motivation and participation in extracurricular activities. We used a multi-group latent change score model to (...) compare Italian and Portuguese students’: pre-COVID mean motivation scores; rate of change in motivation; individual variation in the rate of change in motivation; and dependence of the rate of change on initial motivation scores. Estimates of latent change score models showed a decrease in students’ motivation both in Italy and in Portugal, although more pronounced in Italian students. Results also indicated that the decrease in students’ participation in extracurricular activities was associated with changes in academic motivation. Furthermore, students’ age was significantly associated with changes in motivation. No significant associations were found for students’ gender nor for parents’ education. This study provides an important contribution to the study of students’ academic motivation during home confinement, school closures, and distance learning as restrictive measures adopted to contain a worldwide health emergency. We contend that teachers need to adopt motivation-enhancing practices as means to prevent the decline in academic motivation during exceptional situations. (shrink)

We begin this article by delineating the explanatory gaps left by prevailing gene‐focused approaches in our understanding of phenotype determination, inheritance, and the origin of novel traits. We aim not to diminish the value of these approaches but to highlight where their implementation, despite best efforts, has encountered persistent limitations. We then discuss how each of these explanatory gaps can be addressed by expanding research foci to take into accountbiological agency—the capacity of living systems at various levels to participate in (...) their own development, maintenance, and function by regulating their structures and activities in response to conditions they encounter. Here we aim to define formally what agency and agents are and—just as importantly—what they are not, emphasizing that agency is an empirical property connoting neither intention nor consciousness. Lastly, we discuss how incorporating agency helps to bridge explanatory gaps left by conventional approaches, highlight scientific fields in which implicit agency approaches are already proving valuable, and assess the opportunities and challenges of more systematically incorporating biological agency into research programs. With a focus on Asian philosophical traditions, this book examines varieties of philosophical thought and self-transformative practice that do not fit neatly on one side or another of the standard Western division between philosophy and religion. En novembre 1984, Christa Wolf ouvrait la première conférence de l'association des gynécologues psy-chosomaticiens de RDA réunis à Mag-Debourg. Dans son discours intitulé "Maladie et privation d'amour", elle s'interrogeait sur l'évolution de la médecine moderne dont les progrès en matière d'appareils médicaux éloignaient toujours davantage les praticiens de leurs patients. Par-delà son regard sur la relation entre l'âme et le corps, Christa Wolf informait aussi des attentes des femmes qui avaient pris au mot les promesses d'égalité des sexes en régime (...) "socialiste réel". Quelques années plus tôt Georges Canguilhem, résistant au scientisme triomphant, se proposait de continuer à penser la médecine comme un art qui devait s'adapter à chaque individu malade. Déplorant la disparition progressive de la clinique, il plaidait pour un dialogue continu entre le patient et le médecin Tandis que Sonia Combe s'appuie sur le discours de Christa Wolf pour appréhender l'expérience communiste à partir de l'étude de genre, revenant sur la double leçon de Christa Wolf et de Canguilhem, Antoine Spire se demande dans quelles conditions un retour de la médecine à la pratique clinique pourrait se faire et répondre à la demande des malades. The standards for translating texts in specialized fields have become particularly rigorous with the increasing complexity of material and growing demand for its translation. While translations simply aimed at communication and produced by machine translation are proliferating, the need for reliable and high-quality translations is also increasing. The demand for expert-dependable legal translation is higher than ever, requiring competence-based training in the field of legal translation. This paper describes a guided-task framework for developing subject area competence at the earliest stage (...) of an English–Arabic legal translation course. It presents the three most problematic phases of concept processing in legal translation in terms of: legal systems; branches of law; and genre-based phraseology. The approach presented below is part of a more general study that aims to describe the first course in a series of three graduate courses on legal translation, each of them motivated by a guided-task framework that has the aim of developing three specific competences in legal translation: legal concept processing => subject area competence; documentary research => instrumental competence; and legal rhetorics => communicative and textual competence. In this paper we intend to focus on the first course of legal concept processing as a key prerequisite for legal knowledge development. We illustrate the relevance of addressing specific variables when analysing legal concepts in the text that is to be translated, before proceeding to the information search and communication, according to established formulae and conventions. Dans les sociétés démocratiques, le droit est le texte où s'écrivent nos croyances fondatrices : croyances en une signification de l'être humain, croyances dans la force des lois et l'empire de la justice, croyances dans les valeurs sociales de l'Interdit. Le droit impose donc un sens commun qui permet aux individus de se lier entre eux et de vivre ensemble, il fonctionne aussi comme une vérité du moment. Il se nourrit et accompagne les transformations sociales et culturelles qui touchent non (...) seulement les sociétés nationales, mais également l'espace mondialisé. Le droit enregistre, selon ses propres temporalités, les changements de valeurs, l'émergence de nouvelles inquiétudes, l'évolution des techniques et des connaissances. Depuis quelques années, nous assistons à une "demande" accrue de droit et de régulation juridique. Nous chercherons tout d'abord à repérer et identifier les nouveaux territoires du droit en montrant comment la norme juridique contribue en permanence à réinventer le réel, à fabriquer inlassablement la condition humaine, à se présenter sans cesse comme l'instituteur du social. Ce mouvement de juridicisation du social et du politique se traduit non seulement par une prolifération et une diversification de la règle de droit, mais également par un processus parallèle de judiciarisation qui voit un certain nombre de problèmes être traités par l'institution judiciaire (politiques de santé, de sécurité, phénomènes de criminalité internationale, etc.). Entrons-nous dans un nouvel âge du droit? Ces nouvelles interactions entre la société et le droit inaugurent-elles l'ère d'une future démocratie juridique? Y a-t-il une seule et unique morale dont on puisse se prévaloir aujourd'hui? Les réflexions philosophiques sur la morale se sont toujours combattues, remplacées, démenties au fil du temps, tout en étant chacune valable. Le stoïcisme, la morale de la vertu, le recours à la loi morale, l'utilitarisme sont autant de courants qui irriguent encore notre façon de penser. Mais laquelle de ces "visions" choisir? Et pourquoi choisir celle-là plutôt qu'une autre? Michel Meyer opère ici un retournement de la pensée (...) traditionnelle sur l'éthique. C'est parce que l'homme est un problème pour l'homme qu'il y a des réponses qu'on appelle la morale. Michel Meyer ne part plus des sujets éthiques (Moi, l'Autre) comme référents moraux, mais de la distance, plus ou moins grande, entre les individus. C'est la variation de cette distance qui influence nos choix quant au bien et au mal, à ce que l'on recherche ou à ce que l'on veut fuir ou éviter, et qui fera qu'on sera tantôt stoïcien, tantôt utilitariste ou kantien. Le positionnement des sujets les uns par rapport aux autres conduit à agir de telle ou telle manière, donc à adopter tel ou tel type de conduite morale et à juger ce qui est bien ou mal de façon différente. Le problème moral, c'est l'Autre comme problème, auquel il convient de répondre selon la distance qui nous sépare, nous divise ou nous rapproche, et auquel on répond toujours d'ailleurs, parce qu'il constitue une menace, un appel à l'aide, ou encore la nécessité de coopérer. Sans chercher à édicter de nouvelles règles ou de nouveaux préceptes, Michel Meyer replace les grandes théories morales, comme celles d'Aristote, de Kant, de Mill ou encore de Hume, dans un espace philosophique virtuel qui est leur espace de validité. Avec le concept de distance entre les êtres, il nous offre ainsi une approche nouvelle et synthétique de la morale. (shrink)

Can one coherently integrate Darwin's view of evolution with an affirmation of the value of existence? In this fresh, lean, and substantive volume, William Meyer addresses this important question. By carefully analyzing Darwin's own writings and by drawing on the philosophical perspectives of William James, Alfred North Whitehead, and others, Meyer persuasively redirects the cultural conversation about Darwin away from the retrospective question of origins toward the prospective question concerning the ultimate significance of evolutionary life. As James recognized, the question (...) about the reality of God is more critical for the forward-looking question of value than it is for the backward-looking question of origins. Darwin was a theist in search of a better theism, and because theology had not yet caught up to him, he became increasingly agnostic and caught between his mechanistic understanding of nature, on the one hand, and his affirmation of the value and beauty of the world, on the other. Whitehead's philosophy of organism offers a way to integrate Darwin's evolutionary insights with his affirmation of the grandeur of nature. This article explores gender inequities and sexual double standards in teens’ digital image exchange, drawing on a UK qualitative research project on youth ‘sexting’. We develop a critique of ‘postfeminist’ media cultures, suggesting teen ‘sexting’ presents specific age and gender related contradictions: teen girls are called upon to produce particular forms of ‘sexy’ self display, yet face legal repercussions, moral condemnation and ‘slut shaming’ when they do so. We examine the production/circulation of gendered value and sexual morality via teens’ discussions (...) of activities on Facebook and Blackberry. For instance, some boys accumulated ‘ratings’ by possessing and exchanging images of girls’ breasts, which operated as a form of currency and value. Girls, in contrast, largely discussed the taking, sharing or posting of such images as risky, potentially inciting blame and shame around sexual reputation (e.g. being called ‘slut’, ‘slag’ or ‘sket’). The daily negotiations of these new digitally mediated, heterosexualised, classed and raced norms of performing teen feminine and masculine desirability are considered. (shrink)

This study focuses on retraction notices from two major Latin American/caribbean indexing databases: SciELO and LILACS. SciELO includes open scientific journals published mostly in Latin America/the Caribbean, from which 10 % are also indexed by Thomson Reuters Web of Knowledge Journal of Citation Reports. LILACS has a similar geographical coverage and includes dissertations and conference/symposia proceedings, but it is limited to publications in the health sciences. A search for retraction notices was performed in these two databases using the keywords “retracted”, (...) “retraction” “withdrawal”, “withdrawn”, “removed” and “redress”. Documents were manually checked to identify those that actually referred to retractions, which were then analyzed and categorized according to the reasons alleged in the notices. Dates of publication/retraction and time to retraction were also recorded. Searching procedures were performed between June and December 2014. Thirty-one retraction notices were identified, fifteen of which were in JCR-indexed journals. “Plagiarism” was alleged in six retractions of this group. Among the non-JCR journals, retraction reasons were alleged in fourteen cases, twelve of which were attributed to “plagiarism”. The proportion of retracted articles for the SciELO database was approximately 0.005 %. The reasons alleged in retraction notices may be used as signposts to inform discussions in Latin America on plagiarism and research integrity. At the international level, these results suggest that the correction of the literature is becoming global and is not limited to mainstream international publications. (shrink)

This book examines how regulatory and liability mechanisms have impacted upon product safety decisions in the pharmaceutical and medical devices sectors in Europe, the USA and beyond since the 1950s. Thirty-five case studies illustrate the interplay between the regulatory regimes and litigation. Observations from medical practice have been the overwhelming means of identifying post-marketing safety issues. Drug and device safety decisions have increasingly been taken by public regulators and companies within the framework of the comprehensive regulatory structure that has developed (...) since the 1960s. In general product liability cases have not identified or defined safety issues, and function merely as compensation mechanisms. This is unsurprising as the thresholds for these two systems differ considerably; regulatory action can be triggered by the possibility a product is harmful, whereas establishing liability in litigation requires proving that the product was actually harmful.As litigation normally post-dates regulatory implementation, the 'private enforcement' of public law has generally not occurred in these sectors. This has profound implications for the design of sectoral regulatory and liability regimes, including associated features such as extended liability law, class actions and contingency fees. This book forms a major contribution to the academic debate on the comparative utility of regulatory and liability systems, on public versus private enforcement, and on mechanisms of behaviour control. This article examines the relationship between Jeremy Waldron’s supersession thesis and compensation. Recently, Waldron has argued that claims for material compensation for the original injustice cannot be superseded. He limits supersession to issues of restitution. Waldron’s supersession thesis is frequently cited by opponents of claims based on historical injustice, so his view of compensation warrants close examination. In our article, we explain the details of Waldron’s ‘simple model’ of compensation, offer an internal critique of it, and try to sympathetically reconstruct (...) it. We contend that a crucial claim about this model does not work; his model would result in many more backward-looking compensatory claims than he realizes. Waldron’s allowing for material compensation claims from historical injustice is in tension with, or incompatible with, his long-expressed view that the spirit of the supersession thesis is that justice should be forward-looking and look to present-day costs. We have argued elsewhere that the abstract possibility that restitution claims may be superseded due to changing circumstances (what we call the ‘supersession thesis proper’) is separable from the question of whether justice has a forward-looking or backward-looking orientation. We argue here that Waldron’s model of compensation can best be made sense of through our distinction of ‘full supersession’ and ‘partial supersession.’ This allows us to show that Waldron’s model relies on a more strongly backward-looking orientation than he seems to endorse in his earlier works on restitution and his most recent article discussing compensation. We conclude by offering external criticisms of Waldron’s model of compensation. (shrink)
