The privilege against self-incrimination entails that anyone accused of a criminal offence has the right to remain silent. However, waiving the privilege is possible, but such waiver must be voluntary and in accordance with the will of the accused. This article examines the impact of sentence reductions based on confessions on the voluntariness of confessions. I argue that the concept of voluntariness must be interpreted from the perspective of the values and objectives underlying the privilege against self-incrimination. Depending on the (...) perspective chosen (i.e. objectives and values), sentence reductions can be problematic from the standpoint of the privilege against self-incrimination and the voluntariness requirement it entails. However, it should be also noted that moderate incentives can simultaneously promote the realization of these values and objectives, such as material truth. Categorical negative attitude towards all sentence reductions can be detrimental to the values that the privilege and the voluntariness requirement seek to protect. (shrink)

The objective of our article is to show how “quality of evidence” and “imprecision,” as they are defined in Grading of Recommendations Assessment, Development, and Evaluation articles, may lead to confusion. We focus only on the context of systematic reviews.

In medical research, it is not unusual that risks are ruled out without any specification the exact risk that was ruled out. This makes it difficult to balance expected health benefits and risk of harm when choosing between alternative treatment options. International guidelines for reporting medical research results are sufficiently specific when it comes to establishing health benefits. However, there is a lack of standards for reporting on ruling out risks. We argue that transparency is needed, as in the case (...) of non-inferiority trials. The Consolidated Standards of Reporting Trials and the Preferred Reporting Items for Systematic Reviews and Meta-Analyses statements should be revised accordingly. (shrink)

In 1936, Gerhard Gentzen published a proof of consistency for Peano Arithmetic using transfinite induction up to ε0, which was considered a finitistically acceptable procedure by both Gentzen and Paul Bernays. Gentzen’s method of arithmetising ordinals and thus avoiding the Platonistic metaphysics of set theory traces back to the 1920s, when Bernays and David Hilbert used the method for an attempted proof of the Continuum Hypothesis. The idea that recursion on higher types could be used to simulate the limit-building in (...) transfinite recursion seems to originate from Bernays. The main difficulty, which was already discovered in Gabriel Sudan’s nearly forgotten paper of 1927, was that measuring transfinite ordinals requires stronger methods than representing them. This paper presents a historical account of the idea of nominalistic ordinals in the context of the Hilbert Programme as well as Gentzen and Bernays’ finitary interpretation of transfinite induction. Having the ability to understand emotionally how other people feel and see things is an essential fabric for building and sustaining functional interpersonal relationships. Without such an ability, social interaction crumbles, engagement fails, and learning is eroded. Yet, empirical evidence on the relationship between study burnout and study engagement, and empathy between upper secondary school students is limited. We are tackling the challenge by exploring the association between empathy between peers and study engagement and study burnout among upper secondary school (...) students. Two hundred and eighty upper secondary education students took part in our cross-sectional study. Structural equation modeling was used to analyze the association between empathy, and study burnout and study engagement. The results showed that cognitive empathy contributed to affective empathy, which was further related to increased levels of study engagement, and decreased levels of cynicism, and sense of inadequacy. The role of cognitive empathy seemed to be more complicated: while cognitive empathy contributed directly to increased levels of cynicism, and inadequacy and decrease in study engagement, the indirect effects of cognitive empathy on cynicism and inadequacy were negative, and positive on study engagement. Neither of the empathy dimensions explained students’ emotional exhaustion. The results indicate that merely teaching students to recognize and identify their peers’ emotions is not sufficient to enhance study wellbeing, but they need to learn to share emotions and to tune into each other’s emotions. The evolution of arm-leg relationships presents something of a problem for embodied cognitive science. The affordances of habitual bipedalism and upright posture make our two sets of appendages and their interrelationships distinctively human, but these relations are largely neglected in evolutionary accounts of embodied cognition. Using a mixture of methods from historical linguistics, Cognitive Linguistics and linguistic anthropology to analyze data from languages around the world, this paper identifies a robust, dynamic set of part-whole relations that emerge across the human (...) waistline between upper and lower appendage sets cross-culturally. The general pattern—identified as “arm-leg syncretism”—provides a plausible primary source for the uniquely human penchant for creative analogy, or “double-scope conceptual blending”, said to underlie the human language faculty (Fauconnier and Turner 2002, 2008; Deely 2002; Anttila 2003; Bybee 2010). This account not only addresses a conspicuous gap in the literature but also enables us to better understand what it means to be human—including how we came to be unique among other species and how we are still vitally interrelated with other species. Deely (2010) blends both sides of this tension into a single phrase: “the semiotic animal”. The paper further develops this distinction by drawing attention to one of the roles upright posture played in the emergence of semiotic consciousness. (shrink)

Inflected words in Finnish show a range of interdependent stem and suffix alternations which are conditioned by syllable structure and stress. In a penetrating study, Anttila (1997) shows how the statistical preferences among optional alternants of the Genitive Plural can be derived from free constraint ranking. I propose an analysis which covers the rest of the nominal morphology and spells out the phonological constraints that interact to produce the alternations, and show how it supports a stratal version of OT (...) phonology. In a remarkable confirmation of OT in an empirical domain for which it was not originally intended, phonological and morphological variation has been successfully modeled by partially ranked categorical constraints (Anttila 1997, 2002). Poetic meter is a good place to extend and test this approach to variation, because there is abundant and diverse quantitative data available for it, and because it is typically governed by a relatively small number of well-understood constraints. I report the results of four such studies (...) here. They confirm that choices among metrical options are governed by the interaction of partially ranked constraints, in each case constraints that are grounded, and motivated independently of variation data by related systems in which they have a fixed rank. The partially ranked constraint systems turned out to predict not only the relative preferences among metrical options, but also their actual frequencies in the corpora, with surprising accuracy. These findings support the partial ranking model of variation, and provide an explanatory benchmark beyond the reach of intrinsically weaker stochastic approaches that posit a statistical component for metrical competence (Hayes & MacEachern 1998).
