Burnout is a phenomenon characterized by fatigue and frustration, usually related to work stress and dedication to a cause, a way of life that does not match the person’s expectations. Although it seems to be associated with risk factors stemming from a professional environment, this problem may affect any person. Palliative care is provided in a challenging environment, where professionals often have to make demanding ethical decisions and deal with death and dying. This article reports on the findings of a (...) systematic review aimed at identifying described burnout levels in palliative care nurses and physicians, and the related risks and protective factors. The main findings indicate that burnout levels in palliative care, or in health care settings related to this field, do not seem to be higher than in other contexts. (shrink)

Background Ethical decision making in intensive care is a demanding task. The need to proceed to ethical decision is considered to be a stress factor that may lead to burnout. The aim of this study is to explore the ethical problems that may increase burnout levels among physicians and nurses working in Portuguese intensive care units . A quantitative, multicentre, correlational study was conducted among 300 professionals.Results The most crucial ethical decisions made by professionals working in ICU were related to (...) communication, withholding or withdrawing treatments and terminal sedation. A positive relation was found between ethical decision making and burnout in nurses, namely, between burnout and the need to withdraw treatments , to withhold treatments and to proceed to terminal sedation . This did not apply to physicians. Emotional exhaustion was the burnout subdimension most affected by the ethical decision. The nurses' lack of involvement in ethical decision making was identified as a risk factor. Nevertheless, in comparison with nurses , it was the physicians who more keenly felt the need to proceed to ethical decisions in ICU.Conclusions Ethical problems were reported at different levels by physicians and nurses. The type of ethical decisions made by nurses working in Portuguese ICUs had an impact on burnout levels. This did not apply to physicians. This study highlights the need for education in the field of ethics in ICUs and the need to foster inter-disciplinary discussion so as to encourage ethical team deliberation in order to prevent burnout. A semelhança entre o padrão de interação dos neurônios do cérebro humano e a colônia de formigas torna esta última objeto da hipótese de ser uma estrutura apta a ter uma consciência. Assim, neste artigo, a definição de Thomas Nagel da consciência como algo que é ser para um organismo se torna basilar para o exame dela como um possível sujeito experiencial. A colônia de formigas, se considerada um organismo, poderia ser um sujeito apto a ter experiências internas. Por isso, (...) neste artigo, eu desenvolvo com base no Pampsiquismo, critérios de análise da colônia, apresentando quais características ela deve atender para ser qualificada como consciente. Dessa maneira, ela se torna um modelo apropriado para o exame da relação corpo-mente. Não defendo que a colônia de formigas é um organismo genuíno, mas que, caso seja, terá algum tipo de experiência consciente. No tratamento dessa questão, eu examino se a colônia é um indivíduo biológico, e, em seguida, se é possível que as mentes das formigas embasem a mente da colônia. Concluo que, a partir do modo de interação das partes com o todo, pode haver mais de uma resolução para o problema, i.e., a consciência da colônia depende do modo como seus componentes estão física e fenomenalmente integrados. RESUMEN Aún no se ha explorado si el potencial comunicativo del principio humeano de simpatía se limita al intercambio de sentimientos y emociones o si permite también compartir creencias. Mostraremos que Hume considera esta última posibilidad tanto a partir de la universalidad de la naturaleza humana y del carácter inherentemente social del hombre, como de la existencia de una interconexión entre pensamientos y sentimientos. Contrariamente a la opinión de diversos autores, afirmamos además que la experiencia propia no es condición de (...) posibilidad para poner en acto el principio de simpatía, sino que podemos recibir los sentimientos y creencias de los demás aunque no contemos con experiencia similar. ABSTRACT It has not yet been explored whether the communicational power of the Humean principle of sympathy is limited to conveying feelings and emotions or it also allows sharing beliefs. I will show that Hume considers the latter possibility both by means of the universality of human nature and the inherently social character of man, and the interconnection between thoughts and feelings. Contrary to the opinion of several authors, I will also argue that our personal experience is not a necessary condition to start up the principle of sympathy, but we can receive feelings and beliefs from other people even though we do not have previous similar experience. A cidade nas práticas artísticas [The city in artistic practices] is the result of the work developed, of the presentations and the debates held within the cycle of seminars “The experience of the city between art and philosophy”, held between 3 March 2020 and 16 June 2021 (calendar dramatically compromised by the challenges of the COVID 19 pandemic), one of the main activities of the OBRA project — Fragmentation and Reconfiguration: experiencing the city between art and philosophy, based at IFILNOVA (...) — Philosophy Institute of NOVA, in Lisbon. The book is divided into five parts, relating to each of the artistic disciplines to which the seminars were dedicated – cinema, photography, sound arts, literature and architecture —, which are edited by the organizers responsible for each of them — respectively, Susana Viegas, Humberto Brito, Nuno Fonseca João Oliveira Duarte and Susana Ventura — and composed of the respective narrated accounts of each seminar and of short essays, some merely textual, others graphical or even photographic, which are either in-depth versions of the reflections and positions that were presented and debated by the participants and guests, or works that motivated and inspired the work of the seminars. The seminar cycle and the book now presented here intend to reflect on the role of artistic practices in the representation and reconfiguration of urban experience, trying to understand their different attempts to apprehend and express the fragmentation of aesthetic experience in modern and contemporary cities, as well as to evaluate their contribution to an eventual symbolic and imaginative reconfiguration of that experience. Each section tries, in its own way, to answer questions such as: How do these arts think and reinvent the city? What do they make us feel? And what is their social and political role? For reasons that are easy to understand, Lisbon was the starting point, but other cities were also part of the journey. (shrink)

Justin Garson introduces the distinction between two views on Madness we encounter again and again throughout history: Madness as dysfunction, and Madness as strategy. On the latter view, Madness serves some purpose for the person experiencing it, even if it’s simultaneously harmful. The strategy view makes intelligible why Madness often holds a certain allure – even when it’s prima facie terrifying. Moreover, if Madness is a strategy in Garson’s metaphorical sense – if it serves a purpose – it makes sense (...) to use consciously chosen strategies for living with Madness that doesn’t necessarily aim to annihilate or repress it as far as possible. In this paper, we use our own respective stories as case studies. We have both struggled to resist the allure of Madness, and both ended up embracing a kind of Pyrrhonian scepticism about reality instead of clinging to sane reality. (shrink)

The notion of aesthetic experience attempts to account for an important part of human experience and, although it embraces an immense and multifaceted variety, the complexity and vagueness of which have been an authentic challenge to its definition (to the point that some suggest its conceptual uselessness), it is still crucial and decisive for an entire philosophical discipline: aesthetics-which is not to be confused with the philosophy of art, although it often intersects with it. This chapter considers the case of (...) the city-which is not so much an object as a multifaceted and fragmented environment where aesthetic experiences can occur-in order to attempt to elucidate (or at least to make a contribution to the elucidation of) the meaning and scope of this philosophical topic. La Logique ou L'Art de Penser (LAP), also known as the Port-Royal Logic, is generally presented as a "logic of ideas" in which the idea, the central epistemological entity, is the starting point of this logic based on Cartesian ontology. Structured around the four main operations of the mind - conceiving, judging, reasoning and ordering - the first part of the LAP contains "reflections on ideas". The idea, "the form by which we represent things [objects]", thus takes the place of (...) the concept in Aristotelian-inspired logic. Some of the chapters in this first part deal with the problems raised in scholasticism by the theory of _proprietates terminorum_, which means that it is also a semantics of terms. The word 'term' itself must be understood in its logical and grammatical dimensions. The analyses of the 'Messieurs' of Port-Royal often have a logico-grammatical character, because, according to the anthropology of the authors, men need to make their thoughts heard by one another through language (institutional signs) and, therefore, "it is necessary in logic to consider ideas joined to words, and words joined to ideas". In this text, we shall endeavour to show the importance and innovative character of the semantics of terms in this logic of ideas which makes LAP a pivotal moment in the evolution of the language sciences, reviving the tradition and allowing dialogue with future developments (extension vs. comprehension, explanation, determination of terms, etc.). We will pay particular attention to the chapters on definition, "a remedy for the confusion that arises in our thoughts and speech from the confusion of words". (shrink)

In a special issue of “Ethics and Information Technology” (September 2012), various philosophers have discussed the notion of online friendship. The preferred framework of analysis was Aristotle’s theory of friendship: it was argued that online friendships face many obstacles that hinder them from ever reaching the highest form of Aristotelian friendship. In this article I aim to offer a different perspective by critically analyzing the arguments these philosophers use against online friendship. I begin by isolating the most common arguments these (...) philosophers use against online friendship and proceed to debunk them one by one by pointing out inconsistencies and fallacies in their arguments and, where needed, offering empirical findings from media and communication studies that offer a more nuanced view on online friendships. I conclude my analysis by questioning the correctness of the application of the Aristotelian theory of friendship by the critics of online friendship: in my view, the critics are applying the Aristotelian theory to online friendships in a rather narrow and limited way. Finally, I conclude my thesis by proposing that in the rapidly changing online landscape, a one-size-fits-all application of the Aristotelian theory on friendship is not sufficient to accurately judge the multitude of relationships that can exist online and that the various positive and valuable elements of online friendships should also be acknowledged and analyzed. In this article the authors identify and analyse points of agreement and disagreement between Michael Ayers and Charles Travis, starting from their views on ‘things before us’. The authors then try to spell out what separates these philosophers in matters concerning perception, knowledge and language. In spite of their both being self-professed realists, equally critical of conceptualism and representationalism, Ayers’ empiricism and Travis’ anti-empiricism lead them to different positions in these three areas. It is shown that in the case of (...) Ayers they hinge on “ordinary” objects and a KK principle (knowledge that and how we know), whereas in the case of Travis they are articulated around occasion-sensitivity and anti-psychologism. When interacting with other people, we assume that they have their reasons for what they do and believe, and experience recognizable feelings and emotions. When people act from weakness of will or are otherwise irrational, what they do can still be comprehensible to us, since we know what it is like to fall for temptation and act against one’s better judgment. Still, when someone’s experiences, feelings and way of thinking is vastly different from our own, understanding them becomes increasingly difficult. (...) Delusions and psychosis are often seen as marking the end of intelligibility. In this paper, I argue first for the importance of seeing other people as intelligible as long as this is at all possible. Second, I argue, based on both previous literature and my own lived experience, that more psychotic phenomena than previously thought can be rendered at least somewhat intelligible. Besides bizarre experiences like illusions, hallucinations and intense feelings of significance, I also explain what it is like to lose one’s bedrock, and how this loss impacts which beliefs one has reason to reject. Finally, I give an inside account of some disturbances of reason, and show that there are important similarities between certain psychotic reasoning problems and common non-pathological phenomena. Background Respect is essential to providing high quality healthcare, particularly for groups that are historically marginalized and stigmatized. While ethical principles taught to health professionals focus on patient autonomy as the object of respect for persons, limited studies explore patients’ views of respect. The purpose of this study was to explore the perspectives of a multiculturally diverse group of low-income women living with HIV (WLH) regarding their experience of respect from their medical physicians. Methods We analyzed 57 semi-structured interviews conducted (...) at HIV case management sites in South Florida as part of a larger qualitative study that explored practices facilitating retention and adherence in care. Women were eligible to participate if they identified as African American (n = 28), Hispanic/Latina (n = 22), or Haitian (n = 7). They were asked to describe instances when they were treated with respect by their medical physicians. Interviews were conducted by a fluent research interviewer in either English, Spanish, or Haitian Creole, depending on participant’s language preference. Transcripts were translated, back-translated and reviewed in entirety for any statements or comments about “respect.” After independent coding by 3 investigators, we used a consensual thematic analysis approach to determine themes. Results Results from this study grouped into two overarching classifications: respect manifested in physicians’ orientation towards the patient (i.e., interpersonal behaviors in interactions) and respect in medical professionalism (i.e., clinic procedures and practices). Four main themes emerged regarding respect in provider’s orientation towards the patient: being treated as a person, treated as an equal, treated without blame or prejudice, and treated with concern/emotional support. Two main themes emerged regarding respect as evidenced in medical professionalism: physician availability and considerations of privacy. Conclusions Findings suggest a more robust conception of what ‘respect for persons’ entails in medical ethics for a diverse group of low-income women living with HIV. Findings have implications for broadening areas of focus of future bioethics education, training, and research to include components of interpersonal relationship development, communication, and clinic procedures. We suggest these areas of training may increase respectful medical care experiences and potentially serve to influence persistent and known social and structural determinants of health through provider interactions and health care delivery. The issue of communicated accountability is particularly important in Faith-Based Charity Organisations as the donated funds and use of those funds are often meant to fulfil religious obligations for the well-being of society. Integrating Stewart’s (1984) ladder of accountability with the Statement of Recommended Practice guidance for charities, this paper examines communicated accountability practices of Muslim and Christian Charity Organisations in England and Wales. Our content analysis results indicate communicated accountability to be generally limited, focusing on providing basic descriptive information (...) rather than judgement-based information. Our interviews with trustees and preparers of Trustee Annual Reports in Muslim Charity Organisations identified the reasons being due to high donor trust and consequently weak demand by stakeholders for the latter type of information, as well as internal organisational issues related to the organisational structure and culture, lack of internal professional expertise and high accountability cost. Embodied and phenomenological approaches to neuropsychiatry have proven to be promising for assessing social cognition and its impairments. Second-person neuroscience has demonstrated that the dynamics of social interaction make a difference when it comes to how people understand each other. This article presents the Perceptual Crossing Experiment (PCE) as a paradigm for studying real-time dyadic embodied interactions in the context of schizophrenia. We draw on the phenomenological concept of interbodily resonance (IR) and show how the PCE can be used to (...) accurately model and assess IR. We then turn to disembodied interaction in schizophrenia and finally propose the PCE as a translational tool for systematically assessing the hindered IR that individuals with schizophrenia suffer from. We offer an experimental approach to phenomenology which could be informative for the development of more embodied interventions aiming to remedy the profoundly disrupted social life that patients with schizophrenia live with. In political theory it goes without saying that the constitution of government raises a claim for legitimacy. With the constitution of the people, however, it is different. It is often dismissed as a historical question. The conviction is that since the people cannot decide on its own composition the boundaries of democracy must be determined by other factors, such as the contingent forces of history. This article critically assesses this view. It argues that like the constitution of government, the constitution (...) of the people raises a claim for legitimacy. The failure to see this is what makes many theorists run into the arms of history. They submit the legitimacy of the people to the arbitrary and asymmetrical forces of the present. (shrink)

Neuroethics, in its modern form, investigates the impact of brain science in four basic dimensions: the self, social policy, practice and discourse. In this study, we analyzed a set of 461 peer-reviewed articles with neuroethics content, published by authors from 32 countries. We analyzed the data for: (1) trends in the development of international neuroethics over time, and (2) how challenges at the intersection of ethics and neuroscience are viewed in countries that are considered developed by International Monetary Fund (IMF) (...) standards, and in those that are developing. Our results demonstrate a steady increase in global participation in neuroethics from 1989 to 2005, characterized by an increase in numbers of articles published specifically on neuroethics, journals publishing these articles, and countries contributing to the literature. The focus from all countries was on the practice of brain science and the amelioration of neurological disease. Indicators of technology creation and diffusion in developing countries were specifically correlated with increases in publications concerning policy implications of brain science. Neuroethics is an international endeavor and, as such, should be sensitive to the impact that context has on acceptance and use of technological innovation. (shrink)

How should we adjust our beliefs in light of the testimony of those who are in a better epistemic position than ourselves, such as experts and other epistemic superiors? In this paper, I develop and defend a deference model of epistemic authority. The paper attempts to resolve the debate between the preemption view and the total evidence view of epistemic authority by taking an accuracy-first approach to the issue of how we should respond to authoritative and expert testimony. I argue (...) that when we look at the debate through the lens of accuracy, it becomes clear that matters are more complicated than either the preemption view or the total evidence view are able to account for. Consequently, a deference model, outlined within a credence-based framework, does a better job of capturing the relevant phenomena, and explaining how we should update our beliefs in response to epistemically authoritative testimony. Wouter Kusters argues that madness has much to offer philosophy, as does philosophy to madness. In this paper, i support both claims by drawing on a mad phenomenon which I label Radical Psychotic Doubt, or RPD. First, although skepticism is a minority position in epistemology, it has been claimed that anti-skeptical arguments remain unsatisfying. I argue that this complaint can be clarified and strengthened by showing that anti-skeptical arguments are irrelevant to RPD sufferers. Second, there's a debate about whether so-called (...) hinge commitments are beliefs or not. I argue that RPD can be used to strengthen the case that they are. Moreover, if hinges are beliefs, some madpeople are more epistemically rational than some sane philosophers. Third, drawing on my own mad experiences, I challenge evidentialism by presenting a better candidate for a truly forced cchoice about what to believe than William James' traditional religious example. I further show that in certain psychiatric contexts, evidentialism has more radical implications than Jamesian pragmatism, which comes out as more conservative. Finally, I discuss how philosophical theories like pragmatism and Pyrrhonism can provide inspiration for new and much-needed coping strategies for RPD sufferers. (shrink)

Robots are increasingly being studied for use in education. It is expected that robots will have the potential to facilitate children’s learning and function autonomously within real classrooms in the near future. Previous research has raised the importance of designing acceptable robots for different practices. In parallel, scholars have raised ethical concerns surrounding children interacting with robots. Drawing on a Responsible Research and Innovation perspective, our goal is to move away from research concerned with designing features that will render robots (...) more socially acceptable by end users toward a reflective dialogue whose goal is to consider the key ethical issues and long-term consequences of implementing classroom robots for teachers and children in primary education. This paper presents the results from several focus groups conducted with teachers in three European countries. Through a thematic analysis, we provide a theoretical account of teachers’ perspectives on classroom robots pertaining to privacy, robot role, effects on children and responsibility. Implications for the field of educational robotics are discussed. (shrink)

Women who suffer from fertility issues often use in vitro fertilization (IVF) to realize their wish to have children. However, IVF has its own set of strict administration rules that leave the women physically and emotionally exhausted. Feeling alienated and frustrated, many IVF users turn to internet IVF-centered forums to share their stories and to find information and support. Based on the observation of Dutch and Greek IVF forums and a selection of 109 questionnaires from Dutch and Greek IVF forum (...) users, we investigate the reasons why users of IVF participate in online communities centered on IVF, their need for emotional expression and support, and how they experience and use the information and support they receive through their participation in the online community. We argue that the emotional concerns expressed in such forums should be taken into account by health care ethics committees for IVF-related matters in order to promote more patient-oriented care and support for women going through IVF. Background:The understanding of factors that shape risk perception is crucial to modulate the perceived threat and, in turn, to promote optimal engagement in preventive actions.Methods:An on-line, cross-sectional, survey was conducted in Italy between May and July 2020 to investigate risk perception for COVID-19 and the adoption of preventive measures. A total of 964 volunteers participated in the study. Possible predictors of risk perception were identified through a hierarchical multiple linear regression analysis, including sociodemographic, epidemiological and, most of all, psychological factors. A path analysis was adopted to probe the possible mediating role of risk perception on the relationship between the independent variables considered and the adoption of preventive measures.Results:Focusing on the psychological predictors of risk perception, high levels of anxiety, an anxious attachment, and an external locus of control predicted higher perceived risk. Conversely, high levels of openness personality and of avoidant attachment predicted a lower perception of risk. In turn, the higher was the perceived risk the higher was the adoption of precautionary measures. Furthermore, psychological factors influenced the adoption of preventive behaviors both directly and indirectly through their effect on risk perception.Conclusions:Our findings might be taken into high consideration by stakeholders, who are responsible for promoting a truthful perception of risk and proper compliance with precautionary measures. Neste artigo, abordamos o processo de construção da educação das relações raciais a partir de uma perspectiva analítica que tem como elemento central a história da educação dos negros, no Brasil. Dessa forma, construímos um percurso que trata de diferentes momentos em relação ao processo de incorporação dos negros à sociedade brasileira, especificamente o tráfico de africanos escravizados, a abolição da escravidão e a constituição do movimento negro como sujeito coletivo. Analisamos esses eventos procurando destacar seu significado educacional e suas (...) implicações na construção do movimento negro como um agente transformador da sociedade. O ponto culminante da análise foi o processo de aprovação da Lei 10.639/2003 e a construção de uma política pública voltada para reconfiguração da educação das relações raciais. Destacamos esse processo como uma das mais importantes transformações pela qual passou a educação brasileira, sobretudo no que diz respeito ao reconhecimento da diversidade, o combate ao racismo e às desigualdades raciais. La educación religiosa ha estado presente en la historia de Colombia desde el patronato español hasta nuestros días bajo distintas denominaciones. Sin embargo, en estos tiempos de pluralidad, secularización y laicismos, se encuentran diversas actitudes frente a la religión en la escuela. Seguros de su necesidad e importancia, resulta pertinente pensar en las características de una educación religiosa escolar que resulte más pertinente para los tiempos actuales. Por tal razón, este artículo ahonda en su naturaleza, propósito y legitimación en procura (...) de brindar algunas claves que podrían ser traducidas en contenidos curriculares y modos didácticos que puedan contribuir a una mejor comprensión del fenómeno religioso y promover el crecimiento del sujeto en su dimensión religiosa. Following the COVID-19 pandemic, many countries worldwide have put lockdowns in place to prevent the virus from spreading. Evidence shows that lockdown measures can affect mental health; it is, therefore, important to identify the psychological characteristics making individuals more vulnerable. The present study aimed, first, to identify, through a cluster analysis, the psychological attributes that characterize individuals with similar psychological responses to the COVID-19 home confinement; second, to investigate whether different psychological characteristics, such as personality traits, alexithymia, and resilience, specifically (...) influence anxiety, stress, and depression, depending on the scope of the confinement. We analyzed data from 393 participants who completed an online survey on their experiences during two different phases of the Italian lockdown, characterized by more or less strict measures of confinement. Two clusters were identified which included participants reporting a better and worse emotional response to the lockdown, respectively. Individuals in the −ER group showed lower emotional stability, resilience, and higher alexithymia. Moreover, even if lifting part of the restrictions decreased psychological distress among all participants, a reduction in perceived stress was observed only among individuals with high resilience. Finally, personality traits, alexithymia, and resilience differently affected depression, anxiety, and stress. Our results suggest that different psychological interventions should be planned depending on the context: mental health professionals should focus on enhancing the individuals’ coping strategies to alleviate stress in emergencies, while long-term intervention aiming at alleviating anxiety and depressive symptoms should focus on alexithymic tendencies and personality constructs. In this commentary, as philosophers of evolutionary biology, we will consider the evolutionary framework used in the Target Article by: (i) emphasising the fruitfulness of the interdisciplinary approach employed; (ii) highlighting some potentially controversial aspects of the proposal; and finally (iii) outlining some ideas for further integration within the UAL framework. The critical analysis will focus on the relationship between learning and consciousness, on the assumed need for a function for consciousness, and on the type of phylogenetic demarcation introduced by (...) Praise, unlike blame, is generally considered well intended and beneficial, and therefore in less need of scrutiny. In line with recent developments, we argue that praise merits more thorough philosophical analysis. We show that, just like blame, praise can be problematic by expressing a failure to respect a person’s equal value or worth as a person. Such patronizing praise, however, is often more insidious, because praise tends to be regarded as well intended and beneficial, which renders it harder to recognize (...) and object to. Among other things, a philosophical analysis of patronizing praise helps people on the receiving end articulate why they feel uncomfortable or offended by it, shows patronizing praisers how their praise is problematic, and provides input for further philosophical analysis of blame.In the first section of the paper, we discuss how hypocritical praise, just like hypocritical blame, can fail to respect the equality of persons by expressing that the praiser applies more demanding moral standards to the praisee than to themself. We further discuss obstructionist praise, which loosely corresponds to complicit blame, and can similarly express that certain moral standards apply to others but not to the praiser. In the second part of the paper, we discuss another variety of patronizing praise. Praise can be an inaccurate appraisal of a person based on irrelevant considerations – like race, gender, or class – and thereby constitute a failure to recognize their equal worth as a person. We identify three ways in which such praise can manifest. (shrink)

The concept of ecofascism describes the distortion of ecology for the purpose of gaining greater and wider audience, popularising ideologies and fulfilling xenophobic and nationalistic goals by regimes such as the far-right agenda and the radical ecological groups. This study investigates the issue of ecofascism in Europe, using the example of Greece, by examining the views of the citizens of Greece on the links between the political parties and ecology and environment. A survey of 600 people was conducted in Greece, (...) using questionnaires on ecofascism, politics and ecological issues. The survey showed that the sample has, in general, humanistic, democratic and quite left-wing ideals. However, some of the respondents indicated nationalistic, even fascist, trends. Because the current socio-economic and political conditions in Europe can fuel an outbreak of fascism, we should be very cautious about these findings, due to the growing impact of far-right ideas on society. Some aspects of the ecofascist rhetoric still continue to mislead, revealing the sly and worrying penetration of fascism in Greek society on the pretext of the protection of the Greek environment. This article considers an international sample of venture capital and private equity funds to assess the role of law, corruption, and culture in setting fund manager fees. With better legal conditions, fixed fees are lower, carried interest fees are higher, clawbacks are less likely, and share distributions are more likely. Countries with lower levels of corruption have lower fixed fees and higher performance fees, and are less likely to have clawbacks and cash-only distributions. Hofstede's measure of power distance is negatively (...) related to fixed fees and the use of cash-only distributions, but positively related to performance fees and clawbacks. Overall, the data strongly indicate that corruption, culture, and legal settings are much more significant in determining fees than fund manager characteristics and/or market conditions. (shrink)

The medical and social model of disability is discussed and debated among researchers, scholars, activists, and people in general. It is common to hold a mixed view and believe that some disabled people suffer more from social obstacles and others more from medical problems inherent in their bodies or minds. Rachel Cooper discusses possible ‘test environments’, making explicit an idea which likely plays an implicit part in many disability discussions. We place or imagine placing the disabled person in a range (...) of different environments. If there is a relevant test environment in which they do fine, their problem was societal/external; if there is not, it was medical/internal. Cooper admits that deciding on the appropriate range of test environments is an ethical and political question. In this chapter, I argue that we often ought to widen our scope when discussing psychiatric disabilities. (shrink)

In this paper, I review arguments according to which harsh criminal punishments and poverty are undeserved and therefore unjust. Such arguments come in different forms. First, one may argue that no one deserves to be poor or be punished, because there is no such thing as desert-entailing moral responsibility. Second, one may argue that poor people in particular do not deserve to remain in poverty or to be punished if they commit crimes, because poor people suffer from psychological problems that (...) undermine their agency and moral responsibility. Third, one may argue that poor and otherwise marginalized people frequently face external obstacles that prevent them from taking alternative courses of action. The first kind of argument has its place in the philosophy seminar. Psychological difficulties may be important to attend to both in personal relationships and when holding ourselves responsible. Nevertheless, I argue that neither type of argument belongs in political contexts. Moral responsibility scepticism ultimately rests on contested intuitions. Labelling certain groups of people particularly irrational, weak-willed, or similar is belittling and disrespectful; such claims are also hard to prove, and may have the opposite effect to the intended one on people's attitudes. Arguments from external obstacles have none of these problems. Such arguments may not take us all the way to criminal justice reform, but in this context, we can supplement them with epistemic arguments and crime prevention arguments. (shrink)
