The field of socio-legal research has encountered three fundamental challenges over the last three decades - it has been criticized for paying insufficient attention to legal doctrine, for failing to develop a sound theoretical foundation and for not keeping pace with the effects of the increasing globalization and internationalization of law, state and society. This book examines these three challenges from a methodological standpoint. It addresses the first two by demonstrating that legal sociology has much to say about justice (...) as a kind of social experience and has always engaged theoretically with forms of normativity, albeit on its own empirical terms rather than on legal theory's analytical terms. The book then explores the third challenge, a result of the changing nature of society, by highlighting the move from the industrial relations of early modernity to the post-industrial conditions of late modernity, an age dominated by information technology. It poses the question whether socio-legal research has sufficiently reassessed its own theoretical premises regarding the relationship between law, state and society, so as to grasp the new social and cultural forms of organization specific to the twenty-first century's global societies. This book shows that Hauriou's positivist and pragmatic jurisprudence and social theory, as well as their application to the study of institutions, is satisfactorily supported by his idealistic philosophy. The nine chapters first locate Hauriou's influences, then situate his disciplinary methodologies within methodology in general. The central chapters concern each of the three methodologies in turn.

The following paper is a descriptive and retrospective study that analyses the basic elements of a methodological design in projects approved by Fondecyt in 1992 and 1999 considering the disciplines of anthropology and sociology. The analyses used four steps to create a methodological design. First, the projects selected were classified as qualitative or quantitative, according to the definition given by the own authors and looked for the arguments used by the authors for using the selected methodology. There are realist philosophers and social scientists who believe in the indispensability of social ontology. However, we argue that certain pragmatist outlines for inquiry open more fruitful roads to empirical research than such ontologizing perspectives. The pragmatist conceptual tools in a Darwinian vein—concepts like action, habit, coping and community—are in a particularly stark contrast with, for instance, the Searlean and Chomskian metaphysics of human being. In particular, we bring Searle's realist philosophy of society and mind under critical survey in this (...) paper and contrast it with a pragmatist, sociologizing approach. Drawing from Dewey, James, and recent antirepresentationalism, we propose for research work a methodological relationalism of its own kind, altogether detached from the ontologies of society and mind. The explanatory power of structures in analytical sociologists’ agent-based models brings into question methodological individualism. We defend that from an explanatory point of view, the syntactic properties of models require semantic conditions of interpretation drawn from a conceptual research framework; in such a framework, social/relational structures have only partial, explanatory power ; and taking the explanation further through generative mechanism modeling necessitates calling upon methodological individualism’s generic framework of interpretation that relies on social actors’ rational capacity. These mark two different attitudes toward philosophical metaphysics and ontological commitments. Applied sociology will be understood in the following discussion as a unique and original form of sociology; i.e., in its logic and practice distinguished from traditional sociology it is understood as an explanatory body of knowledge and an intellectual discourse about intentional/purposeful social action and behavior. The application of sociology proper to such substantive fields as family, art, law and sport, commonly called applied sociology, which reproduce the body of sociological knowledge just a second time, (...) is not part of such understanding. Applied sociology in its original sense has its own logic in which purpose, implementation and the process of social-problem solution are crucial. It will in the end lead to an applied action or implementation theory. It is, to paraphrase Lazarsfeld, the methodology of “sociology in action” (1960). (shrink)

Max Weber’s methodology is often treated by some as his principal contribution to social science, while his comparative sociology of religion starting with the famous Calvinist thesis is the Schwerpunkt in his work, according to others. There are several reasons to locate and analyze the conjunctions between these two interpretations. Weber’s ideal type is formulated in several places, not only in the so-called ‘Objectivity’ essay from 1904, but also for instance in the marginal utility-essay from 1908. His three (...) meta-texts for the three volumes in GARS (Gesammelte Aufsätze zur Religionssoziologie) are also illuminating, especially in ‘Einleitung’ (‘Introduction’) and ‘Zwischenbetrachtung’ (or ‘Intermediate Reflections’). It was in the ‘Zwischenbetrachtung’ where he commented on religion in India, partly as an ‘identity giving other’, that the ideal type reappeared. Weber deals with the uniqueness of Occidental culture and his comparative religion serves as supporting evidence, much in line with J S Mill’s canons for the logic of isolating independent variables by similarities and differences -as indicated in a letter by Weber to Georg von Below. As a result Weber serves still today as a sparring partner for theorists of the Axial Age and the multi-modernity paradigm. (shrink)

Nowadays, the widespread view is that classical sociology is tainted with ‘methodological nationalism and it would appear that there has been a significant overlap between social and political space. We disagree with this point of view for three reasons: (1) by dealing with the global world, classical sociology has already glimpsed the possibility of going beyond the nation-state as a unit of analysis; (2) having operated above all with the notion of ‘social’ rather than ‘national’, its categories are (...) transnational; and (3) when classical sociology has dealt with national society, studies have not reified it within its political boundaries. Consequently, in our opinion, classical sociology highlights both analytical categories that go beyond the ontology of the nation-state as well as new socio-political forms defined within the trajectory of modernity under the pressure of globalization processes. Historically, the sociology of emotion has been relatively long on theory and short on methods. This collection of articles seeks to remedy this by introducing new ways to capture the four factors of emotion, as articulated by Thoits : meaning, expression, label, and physiology. As a group, these studies reify existing dichotomies in the literature—that is, emotional experience versus emotional expression—and seek to reconcile them. Additionally, they all champion the use of mixed methods—either simultaneously or sequentially—adopting some combination of (...) direct or indirect observation, subjective understanding/experience, and physiological change. Emotions are an emergent feature of interaction, and many of the articles in this special section touch on this. What I find interesting is that we get a glimpse into how emotions unfold in a situation, and how the flow of emotions in any study can run from participant to participant, participant to researcher, and researcher to participant. Part of this flow of emotions is influenced by reflexivity or the awareness of self and other feeling states, which is addressed by (...) some of the contributors. What is particularly challenging is how to carefully study emotions as they surface in situations, and many of the contributors encourage us to pause and think about how to do this. (shrink)

Google Trends reveals that at the time we were writing our article on ‘The Coming Crisis of Empirical Sociology’ in 2007 almost nobody was searching the internet for ‘Big Data’. It was only towards the very end of 2010 that the term began to register, just ahead of an explosion of interest from 2011 onwards. In this commentary we take the opportunity to reflect back on the claims we made in that original paper in light of more recent discussions (...) about the social scientific implications of the inundation of digital data. Did our paper, with its emphasis on the emergence of, what we termed, ‘social transactional data’ and ‘digital byproduct data’ prefigure contemporary debates that now form the basis and rationale for this excellent new journal? Or was the paper more concerned with broader methodological, theoretical and political debates that have somehow been lost in all of the loud babble that has come to surround Big Data. Using recent work on the BBC Great British Class Survey as an example this brief paper offers a reflexive and critical reflection on what has become – much to the surprise of its authors – one of the most cited papers in the discipline of sociology in the last decade. In recent years methodological debates in the social sciences have increasingly focused on issues relating to epistemology. Realism and Sociology makes an original contribution to the debate, charting a middle ground between postmodernism and positivism.

Sociology is experiencing what can only be described as hyperdifferentiation of theories - there are now many approaches competing for attention in the intellectual arena. From this perspective, we should see a weeding out of theories to a small number, but this is not likely to occur because each of the many theoretical perspectives has a resource base of adherents. As a result, theories in sociology do not compete head on with each other as much as they coexist. (...) Drawing on and extending the Foucaultian philosophical framework that Jeffrey Bishop develops in his masterful book, The Anticipatory Corpse: Medicine, Power, and the Care of the Dying, we undertake a sociological analysis of the neurological procedure—deep brain stimulation —which implants electrodes in the brain, powered by a pacemaker-like device, for the treatment of movement disorders. Following Bishop’s work, we carry out this analysis through a two-fold strategy. First, we examine how a multidisciplinary team evaluates candidates for this implant at a (...) major medical center. We present excerpts from an ethnographic study of the “case conference” where disease entities are presented, contested, ratified, and made objects for intervention with this technology. The case conference becomes the key site in the transition from “person-with-illness” to “person-with-brain-implant” as a team of health professionals determines a plan of action by interpreting both statistical and “quality of life” data regarding their patients. Second, this article explores these decision-making processes through Bishop’s conceptualization of evidence-based medicine, which relies on statistical approaches as the ultimate authority in knowledge production and medical decisions. We then reflect on Bishop’s critique of the social sciences and the methodological, analytical, and substantive ramifications that The Anticipatory Corpse can offer future sociological work. Current sociological theories appear to have lost their general persuasiveness in part because, unlike the theories of the ‘classical era’, they fail to maintain an integrated stance toward society, and the practical role that sociology plays in society. The authors explore various facets of this failure and possibilities for reconstructing sociological theories as integrated wholes capable of conveying a moral and political immediacy. They discuss the evolution of several concepts (for example, the social, structure, and self) and address the (...) significant disputes (for example, structuralism versus humanism, and individual versus society) that have dominated twentieth-century sociological thought. Their ideas and analyses are directed towards an audience of students and theorists who are coming to terms with the project of sociological theory, and its relationship with moral discourses and political practice. The authors of these essays are sociological theorists from the United States, the United Kingdom and Canada. They are all established, but not ‘establishment’ authors. The book contains no orthodoxies, and no answers. However, the essays do contribute to identifying the range of issues that will constitute the agenda for the next generation of sociological theorists. (shrink)

Scientific reasoning – presumed unique, perfect, objective – still solidly bases its foundations on the consequences of the evident success (theoretical and practical) obtained over the centuries starting from Galilean intuition. Over time, the granitic belief that scientific success can depend exclusively on a single, simple principle of method, has actually been slightly undermined; there is still a solid scientific basis about this idea, but the demands for rethinking and eclecticism also in the methodological approach begin to be "important". It (...) therefore seems absolutely compelling to note the difference between "inanimate" sciences – which have gradually seen the level of compliexity growing, however, resulting from the fact that the more the system of knowledge grows and the greater are the dark areas to be revealed – and "animated" sciences who have as their object of interest people, sensibility, ethics, behaviors and social actions. Manzo (2023/2020, this volume) objects to Nathalie Bulle's article with Denis Phan “Can Analytical Sociology Do Without Methodological Individualism?” (Philosophy of the Social Sciences, 2018) that the rationality associated with the understanding interpretation of MI cannot be taken to be trans-situational. This reply argues that either (1) this is a misunderstanding resulting from a confusion between the general rational capacity of human beings, to which Bulle and Phan refer, and the specific behavioral patterns associated with given situations and models (...) or (2) this objection supports a structural reductionism in which the structural level tends to “reduce” the individual level, so that the behavioral patterns are directly implied by the structures. This dissertation seeks to contribute to research in the philosophy of social science. The study focuses upon select epistemological and ontological aspects of Hannah Arendt’s work from which methodological implications are drawn pertaining to sociology. Arendt, although critical of the sociology of her time, has become increasingly cited and influential for emerging sociological research and this study seeks to contribute to this by focusing upon the problem of novelty. The aim is to explore the philosophical and methodological implications (...) of novelty for social science by working through three case studies that are theoretically pivotal for social science—action, the ‘social’, and the self—in terms of novelty as expressed in Arendt’s writing. Arendt is critical of methodology and epistemology, aiming to draw her readers to ontological concerns outlined from her preoccupation with the 'world' and social reality. In this aim, Arendt seeks to distance herself from social sciences that she claims ignore human novelty in favour of reading social regularities, tendencies and similarities. Despite her disdain for method, Arendt suggests a anti-methodological 'method' (outlined in an overlooked footnote) for keeping trained upon and for dealing with novel, anomalous events. In the seed of this method lies a unique opportunity for social science to reassess and extend its methods, addressing this oversight and in so doing bring to light the novel social object as a legitimate subject of social research. The aim of the paper is to deal with the links between Schutz and Wittgenstein on the centrality of language and intersubjectivity in the structure of meanings. I believe there are similarities between Schutz’s proto-trust in the natural attitude and Wittgenstein’s animal faith in the basic life form of language games. To this end, Cicourel’s analysis of the relationship between language, Verstehen and empirical research methods will be used. Cicourel renders Schutz and Wittgenstein contiguous, by interpreting the different techniques of (...) empirical research as languages that structure the understanding of meanings on the basis of the order of different realities and different language games.
